SC clean chit to Modi govt on Rafale deal
NEW DELHI, NOV 14 (PTI): Supreme Cour t Thursday gave clean chit to the Modi government on the purchase of 36 fully loaded Rafale fighter jets from French company Dassault Aviation, rejecting the plea for registration of an FIR by the CBI for alleged commission of cognisable offence in the deal. The apex court dismissed the pleas seeking review of the December 14, 2018 verdict in which it had said that there was no occasion to doubt the decision-making process in the procurement of 36 Rafale fighter jets. The top court was not satisfied with the submission that it decided the disputed questions of facts in the Rs 58,000 crore deal “prematurely” without investigation. The rejection of review petitions is tantamount to the apex court giving the clean chit to the Narendra Modi government for the second time. “We do not consider this to be a fair submission for the reason that all counsels, including counsel representing the petitioners in this matter addressed

elaborate submissions on all the aforesaid three aspects. “No doubt that there was a prayer made for registration of FIR and further investigation but then once we had examined the three aspects on merits we did not consider it appropriate to issue any directions, as prayed for by the petitioners which automatically covered the direction for registration of FIR, prayed for,” said a bench headed by Chief Justice Ranjan Gogoi. The review applications cannot be entertained unless there is an “error apparent on the face of the record”, the apex court said. The bench said it can-
not lose sight of the fact that it is dealing with a contract for aircrafts, which was pending before different governments for quite some time and the necessity for those aircrafts has never been in dispute. “We had concluded that other than the three aspects -- Decision Making Process, Pricing and Offsets -- that too to a limited extent, this Court did not consider it appropriate to embark on a roving and fishing enquiry. “We were, however, cautious to note that this was in the context of the writ petition filed under Article 32 of the Constitution of India, the jurisdiction
invoked,” said the bench, also comprising Justices S K Kaul and K M Joseph. The petition seeking re-examination of the December 14, 2018 verdict was filed by former Union ministers Yashwant Sinha, Arun Shourie and activist lawyer Prashant Bhushan. Other review petitions were filed by lawyer Vineet Dhandha and Aam Aadmi Party lawmaker Sanjay Singh. The Rafale fighter is a twin-engine Medium Multi Role Combat Aircraft (MMRCA) manufactured by French aerospace company Dassault Aviation. While dealing with the allegation of irregularities on the pricing of the jets, the top court said that it satisfied itself with the material made available and it is not the function of this court to determine the prices and act on mere “suspicion” of certain persons. “The internal mechanism of such pricing would take care of the situation. On the perusal of documents we had found that one cannot compare apples and oranges. Thus, the pricing of the basic aircraft had
All Nagaland FPS dealers to launch phase-wise agitation DIMAPUR, NOV 14 (NPN): All Nagaland Fair Price Shop Association (ANFPSA), which has been demanding release of transportation and handling charges that has been kept pending for the last 31 months, has resolved to launch phase-wise agitation against the state government. ANFPSA through its media unit stated that the FPS dealers at a joint meeting held on November 13, 2019 in Dimapur unanimously resolved to stage sit in protest on November 26, 2019 at Directorate of Food & Civil Supplies Dimapur. In the phaseII, ANFPSA said they would down shutter of all FPS (Cease deposit and lifting of essential commodities). The association lamented that the present state government instead of addressing the problem faced by the dealers and releasing the transportation and handling charges have turned a deaf ear to their appeal. FPS dealers have appealed the citizens, village and colony chairman of urban & rural, GBs
and the beneficiaries throughout the state to extend cooperation and support their genuine approach. ANFPSA stated that FPS dealers representing different districts met on November 13, 2019 and discussed various issue confronting the FPS in particular and the general public (beneficiaries) as whole. At the meeting, the members shared difficulties faced in their respective areas with regard to handling and distribution of essential commodities to the beneficiaries under public distribution system (PDS). During the discourse, ANFPSA said one of the common difficulties faced by FPS dealers was the sum of money spent in transportation of goods from FCI godown to respective FPS, recuperation of transit loss in handling and distributing essential commodities and non release of transportation & handling commission by the state govern(Cont’d on p-7) ment.
to be compared which was competitively marginally lower. “As to what should be loaded on the aircraft or not and what further pricing should be added has to be left to the best judgment of the competent authorities,” the bench said. With regard to the decision making process, the apex court said the petitioners contended there was contradictory material on the basis of certain documents obtained. The bench said it appears that the petitioners construed themselves as an appellate authority to determine each aspect of the contract and involve the court to do the same. On the contention that some aspects were not available to them and came to light subsequently by their ‘sourcing’ information after the December 14, 2018 decision, the apex court said, “We decline to, once again, embark on an elaborate exercise of analysing each clause, perusing what may be the different opinions, then taking a call whether a final decision should or should not have been taken in such technical matters”.

evaded the Naga people for a long time, beginning from their forefathers and their headhunting traditions followed by World War I and II and the longstanding conflict between GoI and NNPGs, which was yet to be resolved completely. ACAUT lauds advocate for exposing illegal collections Demands state govt take suo moto action D I M A P U R , N OV 1 4 (NPN): ACAUT Nagaland has appreciated the setting up of the Enquiry Committee on illegal collections at check gates and highway under Kohima district on complaint from the Kohima District Truck Owners and Drivers Union (KDTODU) and the relentless efforts of advocate Kezhokhoto Savi, who it said has been a “leading crusader for justice” and rising above “narrow domestic walls” by placing the rights of Naga citizens above one’s own tribal organisation. ACAUT Nagaland in particular, lauded advocate Kezhokhoto Savi (president NVCO) for having the “courage to expose”
the conduct of Southern Angami Public Organisation (SAPO) in the abetment of “illegal collection” and the audacity to “issue tender period of collection of tax in Phesama police check gate”. In this regard, ACAUT Nagaland has demanded that the state government take cognizance of the “illegal modus operandi” and immediately issue suo moto action against such organisations “so that the rule of law reign supreme.” Media cell of ACAUT Nagaland also reminded that the collection “totally contrived” the state government’s standing order dated June 22,2009 and also the order of the Gauhati High Court, Kohima Bench dated June 3,2014. ACAUT said in this regard, SAPO was setting a “bad precedence” for other
civil society organisations “ to follow suit” and thus “ making mockery and belittling Article 371(A) instead of safeguarding it’s true essence.” ACAUT also reminded that it had on earlier occasions, expounded the view that tribal apex bodies “should rein in their own tribesmen creating menace and indulging in anti-social activities and illegal collections.” Further, ACAUT said it was disheartening that “our own hardworking Naga farmers and entrepreneurs are forced to part with their hard earned money by these unauthorised collections and taxes, manned by few individuals with parasitic mentality under various names, just to loot the public” adding that in the end, the customers end up paying the price.
see light of the day, live in peace and prosper in all aspects of life. Kohima DPDB chairman and urban development & municipal affairs adviser Dr Nicky Kire also spoke on the occasion and highlighted the various developmental activities currently being undertaken in Kohima district. He urged all the officials present to work diligently and contribute in whatever way they could towards development of the State Capital as well as the rural areas in the district. L e g i s l a t o r Ke n e i zhakho Nakhro, who also attended the programme, expressed his gratitude to the board, especially the adoption committee, for all its efforts and contribution towards uplift of the people in rural areas and wished the board all the best on all its future endeavours. The programme was chaired by Kohima deputy commissioner Thejawekie Gregory, while Kohima district planning officer Pudusul Luho pronounced the vote of thanks. This was stated in a DIPR press release.
PAC clarifies on Nov 10 meet DIMAPUR, NOV 14 (NPN): Public Action Committee (PAC) through its media cell has clarified that the committee had no knowledge of the November 10 meeting with the Working Committee of the NNPGs and that it was not party to it. PAC further clarified that the co-convenor of PAC, who is also the vice president of Naga Council Dimapur (NCD) attended on behalf of NCD and not PAC. Therefore, PAC said it disowned the signature appended on behalf of PAC as the meeting was attended only by NCD and councillors.
CAKU lauds PAC for curbing illegal taxation Chakhro Angami Kuda Union (CAKU) has credited PAC under the banner of NCD for bringing down illegal taxation, stating general public were witness to this. Referring to the October 13, 2013 resolution of “One Government One Tax”, CAKU in a statement by its president Zelhou Ziekhrü and general secretary Thejangulie Angami further reaffirmed to continue to stand by the resolution. Pointing out that PAC was a conglomeration of all Naga tribal bodies, including all mass-based organisation of Dimapur, CAKU said whatever movement the committee had initiated till date was in the interest of general public, adding the public was fully aware of taxes levied upon them as they were directly or (Cont’d on p-7) indirectly victims.

The other four States are Assam, Chhattisgarh, Odisha and Jharkhand. Announcing this at the agriculture department’s one day coordination meetingcum-preparation of AWP and B (2019-2020) for SCATE with stakeholders at the agriculture directorate’s conference hall on Thursday, agriculture director M Ben Yanthan said the five States were selected based on higher levels of poverty, low levels of farm power availability and low levels of appropriate technology development and diffusion. States with less than 1.00 kw/ ha farm power, along with Jharkhand and Chhattisgarh which too had a large area under hill agriculture and with low levels of appropriate technology diffusion and adoption. He said all the five States had significant tribal population where exposure to and adoption of technology was less than the national average. The project will be implemented in 31 selected districts of these five States, and in Nagaland this will be imple-
mented in Mon, Longleng, Zunheboto, Wokha, Kiphire, Phek, Mokokchung and Kohima in line with Fostering Climate Resilient Upland Farming Systems (FOCUS)IFAD module. The total project cost is USD 124.27 million, which will be funded by International Fund For Agricultural Development (IFAD) through Indian Council of Agricultural Research (ICAR) in convergence with Sub-Mission on Agricultural Mechanisation (SMAM) and Banks. The
project duration is from 201920 till 2025-26. Yanthan explained that India, despite being the third largest economy in purchasing power parity terms, remained dependent on agriculture. He said the current focus of the government was to double farmers’ income by 2022, and promoting agriculture mechanisation was one of the important interventions to achieve this goal. Ben declared that the project would reach out to 4,00,000 households in the
country and the immediate benefits from the project would be reduction in agriculture production costs by 31%, incremental production ranging between 11% and 15% and improved access of small and marginal farmers to farm mechanisation services and agriculture-based primary processing. He said technology promotion and adoption would be undertaken through existing self-help groups (SHGs), village organisations and community institutions comprising socio-economically disadvantaged households largely below the poverty line, targeted small and marginalised farmers whose landholding was less than 2 ha and who represented more than 75% of the farming population, women members of SHGs and producer groups and the youth.
wedding pics: GPRN/NSCN
DIMAPUR, NOV 14 (NPN): Coming to the defence of a newlywed couple whose photo in which they were seen holding guns went viral and sparked controversy, the GPRN/NSCN has said that social media in Nagaland and print and electronic media in India have “taken the news reporting to a new high or rather low.” GPRN/NSCN through its MIP stated that the couple took photos in a private space with a few family members around, but somehow the photo got forwarded to WhatsApp. “The social media in Nagaland went berserk. The Indian media smelled blood as the viral photo of the newly married couple posing with automatic weapons created a storm. Indian TV channels finally realised there was life in Nagaland!” GPRN/NSCN stated. It maintained that “a single harmless wedding photo” has been abused and criminalized as though the bride and the groom have “brought down another World Trade centre or the most elusive dreaded terrorist couple were caught in a wedding dress with assault rifles!” GPRN/NSCN expressed the view that law must exist to protect citizens and should not demonise and brand spontaneous wedding photos (Cont’d on p-7) as terrorist acts.
