Constitution bench to hear plea on impeachment of CJI Misra
NEW DELHI MAY 7 (AGENCIES): Supreme Court has formed a Constitution Bench to hear the petition filed by two Congress MPs seeking initiation of impeachment proceedings against Chief Justice Dipak Misra. The list of business for the Supreme Court showed that the petition would be heard Tuesday at 10.30 a.m. by a five-judge bench comprising Justices A K Sikri, S A Bobde, N V Ramana, Arun Mishra and A K Goel. This sudden development comes after the matter was mentioned on Monday before Justice Jasti Chelameswar. The petitioners had not mentioned the matter before the CJI since the case is against him. Justice Chelameswar had said he would take a call on Tuesday on whether he should decide about listing of the petition but a bench to hear the case has been formed before he could make a decision. “You come back tomorrow. We will see,” the
judge had told senior lawyer Kapil Sibal, who mentioned the matter before the most senior judge. While Justice Sikri, who will head the bench, is number six in the seniority list, others follow him in the sequence of seniority. It is significant that the matter has not been listed before the judges who are number two to five in the seniority. These judges - Justices J Chelameswar, Ranjan Gogoi, M B Lokur and Kurian Jospeh - had held the controversial January 12 press conference in which they had virtually revolted against the CJI by raising a litany of allegations against him. The petition, filed by Rajya Sabha MPs Partap Singh Bajwa and Amee Harshadray Yajnik, has challenged Vice President Venkaiah Naidu’s decision to reject the notice of impeachment filed by seven opposition parties last month. The petition told the court that Naidu’s decision appears to be motivated by “political consideration”
and should be set aside for being “arbitrary and illegal”. “The rejection seems to be motivated by political consideration beyond the constitutional scheme which is buttressed by the fact that one of the charges against the Chief Justice is that he has been partial in assigning political sensitive cases pertaining to the ruling party before particular benches of this Hon’ble Court in order to get a predetermined outcome,” claimed the petition. “None of the reasons given by the chairman in the impugned order carry any weight or are legally tenable. It deserves to be set aside for being wholly extraneous and ultra vires to the provisions of the Constitution of India and the Inquiry Act,” stated the petition filed through advocate Sunil Fernandes. It asked for a declaration that VP, as chairman of the Rajya Sabha, cannot exercise discretion and that he must set up an inquiry panel under the Judges’ Inquiry
Act, to probe the allegations against Justice Misra. Recently, Vice President and Rajya Sabha Chairman Venkaiah Naidu had rejected a notice of impeachment motion against CJI Misra moved by Opposition parties led by the Congress. Earlier in the day, the Congress challenged Naidu’s dismissal of the impeachment notice in the Supreme Court. The party said that Naidu’s decision was “illegal and arbitrary” and taken in a “cavalier, cryptic and abrupt manner”. Senior Congress leader and lawyer Kapil Sibal, who settled the petition, asked senior apex court judge Justice Chelameshwar to set up a panel to hear the plea. Sibal argued that since the case involved CJI Misra himself, he can’t set up the panel or hear the plea. However, Justice Chelameshwar said that it has already been cleared that Chief Justice was the master of the roaster and only he will allocate the cases and set up benches.

NEW DELHI, MAY 7 (NPN): Centre has approved 100 additional One Stop Centres (OSCs) in nine states including Nagaland. This was approved at the Programme Approval Board (PAB) meeting of the Ministry of Women and Child Development in New Delhi on Monday. In Nagaland, the One Stop Centre would be set up in Tuensang district. Dimapur district and Kohima district already have one stop centres, which were inaugurated in 2016. The Ministry has set up 182 Centres till date under the scheme of One Stop Centres (OSCs) for women affected by violence since April, 2015. The purpose of OSC is to facilitate integrated services for women affected with violence such as police assistance, medical aid, psycho-social counselling, legal aid/counselling, temporary stay for 5 days etc. Cabinet Decision at a meeting on April 21, 2018 decided that in the coming years every district will be covered by one OSC and each OSC will be strengthened with an additional annual grant of Rs. 50,000 for immediate assistance for first aid.

D I M A P U R , M AY 7 (NPN): Nagaland Governor and Swachh Bharat Mission (SBM) brand ambassador, P.B. Acharya convened a review meeting of SBM State ambassadors at Raj Bhavan, Kohima on Monday. According to a press release issued by PRO Raj Bhavan, Acharya appreciated the State ambassadors and the work they have been doing under Swachh Bharat.
He encouraged them to construct public toilets in all their respective districts and stated that public toilets play a key role in community health and individual well-being. He added that women face a lot of difficulties when public toilets are not available. Also harping on the importance of rainwater harvesting, the governor opined that as hill stations face water
scarcity during dry season, rainwater harvesting is the need of the hour. He called on the SBM ambassadors to encourage others to take up rainwater harvesting in their respective districts. On their part, the ambassadors apprised the governor on the various activities and programmes taken up by them in their respective areas. They also submitted their reports during the meeting.
Cong as single largest party in K’taka, JD(S) to be kingmaker: poll NEW DELHI MAY 7 (AGENCIES): As the Karnataka poll date inches closer, an opinion poll conducted by ABP has projected ruling Congress to emerge as the single largest party in a hung Assembly. The opinion poll said that Congress would get a 38% vote share, followed by BJP at 33% and Janata Dal (Secular) at 22%. But none of the parties would get the magic figure of 112, and hence, fall short of forming a government in the state on their own. The survey showed that Congress could win 97 seats in the House of 225, while BJP led by BS Yeddyurappa is projected to win 84 seats. The opinion poll, like others before it, suggested JD(S) could emerge as the kingmaker with 37 seats. Earlier, the India Today opinion polls had predicted that the BJP’s vote share is likely to go up, but not enough to dislodge the current Congress government. According to the India Today Group’s Karvy Insights opinion poll, the Congress would retain its vote share with 90-101 seats. Meanwhile, the BJP’s seat share, although showing an improvement, stayed at 78-86. Meanwhile, the poll predicted that JD(S) would secure 34-43 seats. The Karnataka election results will be declared on May 15 and the current Chief Minister Siddaramaiah’s tenure will expire on 24 May.
Manipur CSOs seek clarification from PM, HM on Naga accord Correspondent
IMPHAL, May 7 (NPN): Days after possible shape of the Naga peace accord was reported by a national daily, three Manipur civil society organisations (CSOs) have sought clarification from the Government of India, particularly from Prime Minister’s office, on the matter. Recently, Indian Express had published a news story how the Naga accord was almost finalised and that it was likely to be signed before the monsoon session of Parliament. Quoting official sources, the newspaper reported that inter-State boundaries would not be changed, while autonomous Naga territorial councils would be constituted in Arunachal Pradesh and Manipur, besides a common cultural body for Nagas living across States, among others. A law for Manipur restricting sale of land in the valley could be announced simultaneously with signing of the accord, the daily reported. Reacting to the report, All Manipur United Clubs Organisation (AMUCO), United Committee Manipur (UCM) and Coalition of Civil Societies Kangleipak (CCSK) have demanded that Prime Minister Narendra Modi, Union home minister Rajnath Singh and the BJP government in the State clarify on the matter. According to AMUCO president Ph Deben, the report published in In-
dian Express on April 26 was in total contradiction to the assurance given by the Prime Minister, Home minister and Central government leaders to the CSOs during a meeting in December last year. Since the statement of RN Ravi contradicts the assurance given by Modi and Singh, they should clarify on the matter at the earliest, he demanded. Deben demanded that the BJPled government in Manipur must clarify its stand on the issue since the party was ruling both at the Centre and in the State. He said such a deal will only ignite public opposition in Manipur, and warned that a major uprising will follow such a settlement. He also urged the people of the State to stay alert for any eventuality in the wake of likely announcement of the Naga accord that could affect the integrity of Manipur. Pointing out that there is no place where there are no settlements of Nagas or Kukis in Manipur, Deben said the proposal for an autonomous Naga territorial council was a clear case of divide and rule policy. He warned that, if the Centre continued to indulge in activities against the interest of integrity of Manipur, a mass movement demanding pre-merger status for the State could emerge.
STSU serves two Belgian diplomat calls on Gov, CM weeks deadline on Shamator CHC MO D I M A P U R , M AY 7 (NPN): Shamator Town Student’s Union (STSU) Monday served a two-week deadline on the Medical Officer posted at Community Health Centre (CHC) Shamator, who it claimed had been “wilfully abstaining” from duty since November 2017, to report to his posting place. In an open letter the medical officer CHC Shamator, the STSU president, K Tsukhumong, and general secretary, K Shokum, stated that Chief Medical Officer Tuensang has been apprised of the matter, but the patients were left unattended and deprived of even their basic right in availing medical services owing to the “prolonged unauthorized absence” of the lone MO.

During his visit, Belgian Ambassador visited Kohima War Cemetery, and paid his respects to the soldiers fallen during the battle of Kohima in April 1944.
‘Floods in NE becoming a perpetual phenomenon’ Gov greets on World Red Cross Day New Delhi/DIMAPUR, May 7 (AGENCIES/NPN): Floods in the North East have virtually become a perpetual phenomenon and a serious and comprehensive strategy is required to handle it, Union minister Jitendra Singh said Monday. Floods, particularly in Assam, Arunachal Pradesh and Manipur, have virtually become a perpetual phenomenon, occurring year after year and causing tremendous loss to lives and property, Singh said after a research report on the Assam floods, prepared by the Delhi Alumni Association of Assam (DAAA), was presented to him here. The minister for Development of North Eastern Region (DoNER) said a serious and comprehensive strategy to avoid such occurrences again and again was needed urgently. He said the DoNER
Ministry had, on its own, helped set up the “Brahmaputra Study Centre” at the Gauhati University. The Centre had started functioning in this regard and the first major research study, initiated a few months ago, dealt with the ways and means to control and prevent the occurrence of floods, Singh said. For this purpose, he said, experts of international repute were also being involved. The minister said a number of options were suggested in the past for prevention of a flood-like situation and these included embankments along the Brahmaputra river, dredging for de-siltation in the large rivers, construction of a high gravity concrete dam etc. However, Singh added that a final call could only be taken after studying the various aspects, including
feasibility, cost-effectiveness and sustainable viability, of any future arrangement.
More T-storms likely to hit NE till May 11
The North Eastern region is likely going to be hit by more thunderstorm and gusty winds in the upcoming days. In a weather warning bulletin, the India Meteorological Department (IMD) said the North East states likely to be affected by thunderstorms and gusty winds till May 11 are Sikkim, Assam, Meghalaya, Nagaland, Manipur, Mizoram and Tripura. Heavy rain is also expected in the six North East states. It may be mentioned that thunderstorms have affected many places in Meghalaya, Nagaland and Assam during the past few days.
NSDMA issues weather alert
Nagaland State Disaster Management Authority (NSDMA), Home Department, has informed all the District Disaster Management Authorities (DDMAs) to take precautionary measures as weather forecast still indicates possibility of rains and thunderstorms accompanied by squally/gusty winds across the State. NSDMA has requested to all the line departments engaged in emergency response/maintenance of public utilities, the DDMAs and the State Disaster Response Force (SDRFs) to remain alert for any monsoon related disasters. NSDMA said that due to incessant rains for the past few days, there was likelihood of floods in the low lying areas (Dimapur, Tizit and Tuli), erosion of river banks and landslides.
DIMAPUR, MAY 7 (NPN): On the occasion of World Red Cross Day, the Nagaland Governor, PB Acharya, who is also president of Indian Red Cross Society Nagaland Branch (IRCS) State Branch, called for reaffirming commitment to relieve human suffering, protect human lives and dignity and respond to emergencies. World Red Cross and Red Crescent Day, an annual celebration of the principles of International Red Cross and Red Crescent Movement, is celebrated on May 8 each year coinciding with the birth anniversary of Henry Dunant, founder of International Committee of the Red Cross and recipient of the first Nobel Peace Prize. In his message, Acharya paid tribute to the founder, Henri Dunant, and to the millions of volunteers who have followed in his footsteps to provide assistance and humanitarian service to the vulnerable.
Reminding of this year’s World Red Cross Day theme –– “Everywhere for Everyone”, the governor called upon all responsible to have a generous heart, kind speech and a life of service and compassion, which, he said were essential for nurturing humanity. Lauding the Nagaland chapter, Acharya said the society, since its inception, has grown and has been rendering humanitarian network in the state by providing humanitarian values, disaster response and health care in the community. “On this significant day let us reiterate that ‘selfless service’ lies at the heart of the Red Cross Movement and all of us should reaffirm our commitment...,” he said. Meanwhile, the governor appreciated members for their hard work and sincerity in helping the needy and wished the IRCS, Nagaland State Branch success in all future endeavours.

NSEE 2018 on May 23 D I M A P U R , M AY 7 (NPN): Nagaland Board of School Education (NBSE) has notified that the Nagaland State Entrance Examination (NSEE) 2018 for Para Medical/Agri and Allied degree courses would be held on May 23, 2018 from 10am to 1pm. In a notification, the NBSE informed that examination centres would be notified at a later date. Candidates have been informed to collect the provisional admit card personally, which would be issued on May 21 and 22, 2018 in the office of the NBSE. The board informed that signature in all the required places -- forms, counterfoil of the admit card, attendance register, etc -- must tally. Further, it has been informed that examination fee of Rs. 600 was to be paid during collection of admit card. As proof of identity, the candidate have been asked to produce the original/photocopy of the admit card of the HSSLC or HSLC Examination while collecting the NSEE Admit card and also have it in their possession in the examination hall. NBSE informed that no admit cards would be issued on the day of the examination.
