Rio presents `1630.67 cr deficit budget

KOHIMA, MAR 23 (NPN): Nagaland chief minister, Neiphiu Rio presented an accumulated deficit budget of Rs 1630.67 crore in the first Budget Session of the 13th Nagaland Legislative Assembly Friday. In his budget speech, Rio, who also holds the Finance portfolio, said the total estimated receipts was Rs 18232.51 crore and total estimated expenditure was Rs 18305.40 crore, adding that transaction for the financial year 2018-19 was estimated to result in a negative balance of Rs 22.94 crore. Rio said the main reason for the negative balance was on account of implementation of revision of pay (RoP) 2017, which would have a huge additional burden. He added that with the negative opening balance of Rs 1,607.73 crore, the year was estimated to close with a negative balance of Rs 1,630.67 crore. NPF concerned over ‘lawlessness’ DIMAPUR, MAR 23 (NPN): NPF Central on Friday expressed alarm at what it described the “lawlessness” prevailing in the State in recent times, especially the killing of Lunkholal Singsong, a government official, in Zunheboto district and shooting of businessman Joy Chandra on Thursday and shopkeeper Rekha Das on Friday, in Dimapur. In a press release, NPF said the assassination bids on two persons in 24-hour span had created a fear psychosis in the minds of the business community. Vehemently condemning the “atrocious” acts, NPF demanded that, whatever the case might be, the government should immediately put its foot down and bring the culprits to book without delay, lest it was construed to have ushered in a change for worse in the society. NPF also asked NNPGs to rein in their erring cadres involved in such lawlessness. The party said that efforts of all sections of Naga people to bring about a final and acceptable solution to the Naga political problem would go in vain “if we perpetrate such violent atrocities or allow them to continue in our society.”

Rio said at the close of the 13th Finance Commission, the total budgetary deficit stood at Rs 1,419.35 crore and total liability at Rs 956.45 crore, both totalling Rs 2375.80 crore. With this size of accumulated deficit, Rio said his government had been facing an uphill task of fulfilling the development requirements of the State. He said with the term of 14th Finance Commission period ending in two years, the Government of
India had already constituted the 15th Finance Commission and the commission was expected to visit Nagaland within the next few months. In this regard, he said the State Finance department was gearing up by preparing various documents as well as memoranda to be submitted to the commission, adding that his government would highlight various issues and specific needs of the State. Elaborating in detail, Rio said for the financial year 2018-19, the total estimated receipts was Rs 18,232.52 crore, including Ways and Means Advances (WMA) of Rs 4200 crore, out of which the receipts from the share of Central taxes was estimated at Rs 3,777.86 crore as against Rs 3,353.09 crore in 2017-18, a growth of 12.67%. He said the State’s own tax receipts were estimated at Rs 640.56 crore as against Rs 570.70 crore of 2017-18, reflecting a growth of 12.24%, and non-tax revenue receipts were estimated at Rs 347.45 crore as against Rs 294.25 crore of 2017-18, reflecting a growth of 18.08%.

NEW DELHI, MAR 23 (PTI): In a major relief to the Aam Aadmi Party (AAP), the Delhi High Court today sets aside the disqualification of its 20 MLAs in the office-of-profit case and directed the Election Commission (EC) to hear the matter afresh. A bench of justices Sanjiv Khanna and Chander Shekhar quashed the Centre’s notification disqualifying the AAP MLAs, saying the EC’s recommendation against the legislators was “bad in law” and “vitiated”. Remanding the MLAs’ plea back to the EC, the bench said that there was violation of natural justice and no oral hearing was given to the MLAs before disqualifying them as legislators of the Delhi Assembly. “Opinion of Election Commission of India (given to the President of India) dated January 19, 2018, is vitiated and bad in law for failure to comply with principles of natural justice,” the court said. DIMAPUR, MAR 23 (NPN): Nagaland chief minister, Neiphiu Rio on Friday appointed six party functionaries of NDPP, BJP and NPP as chairmen of various public sector undertakings (PSUs)/mission mode programme (MMP). They include state BJP unit president Visasolie Lhoungu, former CM and BJP member K.L. Chishi; former state BJP president, Dr. M Chuba Ao; NDPP-- former MLA, Dr. Neiphrezo Keditsu, NDPP vice president Miathou Krose and state NPP president, Ato Yepthomi. According to the notification issue by cabinet secretary, Temjen Toy, the respective departments (see table) have been asked to issue the formal notification of appointments.

DIMAPUR, MAR 23 (NPN): NLA Speaker, Vikho-o Yhoshu, has fixed March 26, 2018 as the date for holding the election of the deputy speaker by the members of the assembly. NLA secretariat has informed that the date of filing nomination was till 12 noon on March 24, and date of withdrawal from 1 p.m. to 4 p.m. the same day.
Finance deptt releases PMS
KOHIMA, MAR 23 (NPN): Finance department has released an amount of Rs. 771.73 lakh for payment of post matric scholarship (PMS) scheme under Centrally Sponsored Schemes (CSS) as final instalment inclusive of 10% state share. Sources told Nagaland Post that an amount of Rs. 694.56 lakh as Central share and Rs.77.17 lakh as state share was released on March 22, 2018. Sources said that the Centre was yet to release its share, but with the proposal submitted by the department anticipating the release of fourth instalment by Centre during this financial year the payment of PMS was released. The department has been asked to get the money from Centre within this financial year.

DIMAPUR, MAR 23 (NPN): Just a day after one non-Naga businessman was shot at in Dimapur, another nonNaga business woman was shot at by an unidentified armed assailant at Midland colony here on Friday. Police sources said that the woman has been identified as Rekha Das, who owned a dhaba near Nepali Basti junction. According to police sources, the incident took place at around 6 a.m., when the assailant had gone to a shop and sought tax from a shopkeeper. The victim, who happened to run her business next to it, intervened which was followed by a verbal argument between them. In the process, the assailant shot her in the abdomen and fled from the scene in an autorickshaw. She was rushed to a private hospital and her condition was stated to be out of danger, police said. In both the cases the assailants arrived in an autorickshaws, police source said. Meanwhile, as a sign to protest, all the business establishments within the Midland colony downed the shutters for the day. (Condemnations on p-11)
Deputy chief minister, Y Patton, who also holds home portfolio, has vehemently condemned the recent series of criminal activities taken place in the state and urged the state police and the district administrative heads, to take note of the recent incidents and remain vigilant in order to ensure peace. In a press statement, Patton stated that the law and order situation would be strengthened by involving the law and order enforcing agency and administrative agencies throughout the state. He also assured that “no crime will be left unturned” and every criminal would be dealt accordingly to their crime through the law. With regard to the brutal murder of Lunkholal Singson, veterinary field assistant, Patton said the two accused identified as Puloka Awomi (24) and Vikato Shohe (22) were already arrested by the state police. He assured that law would take its own course of action. While condemning the murder, the deputy chief minister expressed his solidarity and sadness with the bereaved family. Meanwhile, the deputy chief minister also vehemently condemned the shooting and injury of one businessman Joy Chandra, on March 22, 2018, and the shooting of Rekha Das, also a businesswoman on March 23, 2018 in Dimapur. Patton stated that the investigations into both the incidents were being undertaken by the district police. He said police were on the manhunt to book the persons involved in the incidents.

Acharya who stated that “my government has come back to power” by reminding that there was a previous government on three terms under the nomenclature DAN. It may be recalled that in his inaugural speech to the 13th Nagaland Legislative Assembly, on March 22, Acharya had stated “my government has come back to power with people’s mandate on the promise of bringing change to Nagaland as a common vision of the political parties forming an alliance”. Hitting out on the issue during the debate on the motion of thanks to governor’s address, NPF legislator Imkong L Imchen recalled that the DAN government was in power from 2003 to February 2018 while the People’s Democratic Alliance
NBA calls for review of certain laws DIMAPUR, MAR 23 (NPN): Nagaland Bar Association (NBA) has suggested review of application of personal laws in the State, saying the applications of several Central Acts pertaining to personal laws were badly contradictory and opposed to Naga social customs and practices. In a four-point memorandum addressed to chief minister, NBA president, Tali Ao, and secretary, V Hukavi Zhimomi, pointed out that the legislative power in matters of personal law was vested with the state legislature apart from provisions of Article 371A of the Constitution. NBA, therefore, suggested that the laws contradictory and inconsistent with Naga social customs and practices such as Indian Succession Act, 1925; Special Marriage Act, 1954; Indian Divorce Act, 1869; Births, Deaths and Marriages Registration Act, 1886; Guardians and Wards Act, 1890, and Family Courts Act 1984, were required to be substituted by State’s own
Acts or Amendments. Further, NBA suggested the Rules for Administration of Justice and Police in Nagaland, 1937 be amended suiting to State’s own as against the provisions of the Code of Civil Procedure, 1908 and the Code of Criminal Procedure, 1973 the application of the provisions which stumbles the proceedings of the Courts for speedy justice. Legislative Cell: Further, the association suggested creation of a Legislative Cell in the Department of Law & Justice so as to assist the government in formulation of legislative bills and rule making matters. Bar pointed out that bills on legislation, be it either new or amendments and rule makings, were to be generated and drafted in the legislative cell of the Department of Law & Justice to be manned by legal experts well conversant on various matters including social customs and practices of the Nagas. NBA reiterated that reckless application of Central Acts and Rules
as ready reckoner in the state, particularly in application of personal laws, may be avoided for smooth administration of justice and for social harmony. Advocate general: NBA also suggested appointment of Advocate General from among the members of the State Bar having sufficient legal expertise and social standing. It contended that Nagaland being a tribal state, tribal and intertribal affairs dominate the realm of social affairs of the state. Since commercial, scientific and cyber laws were within the competence of the Parliament, NBA said the State was more or less concerned with the local laws, and the role of the Advocate General as the pivotal authority in those matters were unquestionably the highest consultant authority. Meanwhile, the Bar also suggested that policy making and executive authority of the Department of Law & Justice be continued to be held by the chief minister or in any case by a cabinet minister and no others.

Imchen further questioned the deduction of one day’s wage from government employees for Chief Secretary’s Welfare Fund and declared that no one had the right to deduct someone’s hard-earned money in the name of transparency and accountability. Stating that deducting by force was tantamount to criminal act, he asked the chief minister to look into the issue, adding that there
were already many deductions being made from the salaries of State government employees. On Naga political issue, Imchen said so far the Nagas had avoided defining what constituted honourable, acceptable and sustainable settlement. He said the governor’s address was not appreciative. On his part, Kuzholuzo (Azo) Nienu said it was premature to criticise the PDA government. He, however, added that the government was moving in the wrong direction. Criticizing governor’s speech, Azo said how could the highest office in the State commit such an error and reminded the House that DAN government had ruled the State for the last three consecutive terms. He asked the bureaucrats and those officials responsible in drafting the speech to be more careful, adding that such mistakes misled the people. NEW DELHI, MAR 23 (PTI): Supreme Court on Friday asked the chief secretaries of 12 states including Nagaland to specify why they have not appointed a Lokayukta. A bench of Justices Ranjan Gogoi and R Banumathi also asked the chief secretary of Odisha to apprise the court about the status of the Lokayukta in state and said the apex court has no information whether it has an anti-corruption ombudsman or not. The 12 states, which have been asked to give reasons for not appointing a Lokayukta, are Nagaland, Jammu and Kashmir, Manipur, Meghalaya, Mizoram, Puducherry, Tamil Nadu, Telangana, Tripura, Arunachal Pradesh, Delhi and West Bengal. KOHIMA, MAR 23 (NPN): State chief minister, Neiphiu Rio asserted that his government was committed to making special interventions to address continuing issues of imbalance in development of Eastern Nagaland areas with special focus on creating key infrastructural facilities as well as capacity building to bring them on a par with rest of the State. In his budget speech, Rio said the People’s Democratic Alliance (PDA) government would especially focus on ensuring connectivity to all block headquarters, provision for broadband connectivity and ensuring availability of doctors in hospitals to ensure that ENPO areas had better social and physical infrastructure. He said every department would be asked to give focused attention on implementation of schemes in Eastern Nagaland areas. Section 63 of the Lokpal and Lokayuktas Act, 2013, states that every state shall establish a body to be known as the Lokayukta. The apex court was hearing a PIL, which also sought a direction to the states to provide adequate budgetary allocation and essential infrastructure for effective functioning of Lokayuktas. According to the PIL, filed by advocate and Delhi BJP leader Ashwini Kumar Upadhyay, the Lokpal and Lokayuktas Act, 2013, received presidential assent on January 1, 2014 and came into force from January 16, 2014 but the executive has not established a Lokpal yet. According to the petitioner, many state governments are “deliberately weakening” the Lokayukta by not providing adequate infrastructure, sufficient budget and workforce. K Y M C
