LS passes bill to give NIA more teeth Goal is to root out terror; won’t look at religion of accused: Shah NEW DELHI, JUL 15 (AGENCIES): After a heated debate between Union Home Minister Amit Shah and several Opposition MPs, the Lok Sabha on Monday passed a Bill to strengthen the National Investigation Agency (NIA) in probing cyber crimes and human trafficking cases. The Opposition accused the government of using central investigating agencies to target political opponents and minorities. Shah, on his part, said the government’s only objective is to combat terrorism ‘regardless of religion’. He targeted the Congress for repealing the Prevention of Terrorism Act (POTA) for ‘vote-bank purposes’. During the debate, Congress’ Manish Tiwari and Asaduddin Owaisi of the All India Majlis-e-Ittehadul Muslimeen (AIMIM) questioned the Constitutional

validity of the amendments with the latter accusing the Government of using the law selectively. “I would like to ask the government about the professionalism in the investigations carried out by the NIA. In the Samjhauta blast investigation, they could not even produce the CCTV footage of the railway station in the court. And why is the government not appealing in Malegaon blasts, Samjhauta blasts and Mecca Masjid blast cases?” asked Owaisi. Defending the bill, the government refuted the opposition’s claim that the NIA law was being “misused” to target members of a community and asserted that its only goal is to combat terrorism.
Amit Shah said the Parliament should speak in one voice in giving powers to the NIA; to send out a message to terrorists and the world. To the accusations of using tough laws and central investigating agencies to target a particular community, Shah said, “Let me make it clear that the Modi government has no such intention. Its only goal is to eradicate terrorism but we will also not look at the religion of the accused while taking an action.” Replying to the discussion, Minister of State for Home Affairs G Kishan Reddy said “This is a government run by chowkidar and will be at the forefront for the security of the country,” he said adding that
terrorism has no religion or caste or region. He said there are no issues of federal system with the NIA and it works in close coordination with States and their agencies. He added that NIA often writes to chief secretary and DGP of the State before initiating an investigation. He said that surgical and air strikes have shown that there are other means available with the government to deal with terrorism cases when it comes to Pakistan. “Things were not properly worked out during your (Congress) government. We are the ones fixing it.” He said NIA is investigating as many as 272 cases and has filed chargesheet in 199. The minister said that out of 272, the courts have already delivered their judgements in 51 cases, with convictions in 46 cases. “There is a 90 per cent conviction rate”. During the debate, Manish Tewari (Cong) accused the government of trying to turn India into a “police state”. However, Minister Reddy told the House, “We want to fight terrorism with zero tolerance and have brought this
bill in national interest. I pray to all of you for its passage.” Several opposition members, including N K Premachandran and Saugata Roy, even questioned the government’s decision to push for a discussion amid the ongoing budget-related debates, but Speaker Om Birla ruled that a debate can start. Danish Ali (BSP) too alleged that through this bill the Government is in a hurry to convert this state into “police state”. “The fundamental right of common man should not be violated,” Ali said. Supriya Sule (NCP) said the government should not make the issue of dealing with terrorist into a political one and sought to know what concrete plan it has to bring wanted terrorists back to India. L a t e r, A s a d u d d i n Owaisi sought a division when the bill came up for passage. Home Minister Amit Shah said the division should be taken up to show “who all are for or against terrorism”. While 278 members supported its consideration, only six opposed it. The bill was later passed by a voice vote.

KOHIMA, JUL 15 (NPN): Annoyed by the silence of the State government to address its issue, Nagaland State Planning Machinery Service Association (NSPMSA) announced its first phase of agitation in the form of “pen down strike” from July 16 to 18, after which the association will decide the next phase. Addressing a press conference here on Monday, NSPMSA president Imlikokba Longkumer said the association had submitted representation to the State government demanding removal/expunging the post of OSD (skill development) from the cadre post appearing in schedules I and II of the Nagaland Planning Machinery Service Rule, 2019. However, he said the government till date had not responded to its representation, adding the association wants a written assurance. Longkumer said the association members were aggrieved by the decision of the State cabinet as it did not maintain the Gauhati High Court orders of
2013, 2016 and 2017 that mentioned that OSD (SD) and additional development commissioner (ADC) were two separate cadres with different duties and functions and that this was not transferable. He said the court had ruled that I Sino Phom’s appointment did not affect promotional avenues of the petitioners and that the members did not suffer as the duties and responsibilities was different. The NSPMSA president alleged that despite the court order, the cabinet during its meeting on September 12, 2017 decided that the post of OSD (SD) would be treated as a regular post in the rank and pay of ADC and included it in the proposed draft service rules of the State planning machinery in planning and coordination department. DIMAPUR, JUL 15 (NPN): Viewing the formation of Lotha Public Organisation (LPO) headed by former MLA Sulanthung Humtsoe as a violation of Naga customary practice, Lotha Hoho (LH) has asserted that Lotha community represented by it did not recognise the organisation. LH also cautioned all authorities concerned against recognising the new organisation. According to a statement issued by its general secretary S Aben Ngullie, LH held an executive council meeting at Wokha on Sunday in this regard. LPO was formed at Bhandari the previous day by the former legislator. The meeting viewed the formation of the new organisation as violation of the Naga customary practice, adding that the Lotha Naga customary practice of deciding on civil and criminal justice was an age-old custom as also enshrined in Article 371(A) of the Indian constitution. Mentioning that Humtsoe had been disassociated from LH for 10 years (vide notice no.LH/WKA/ PR/2019, dated Wokha 10th July 2019), the statement emphasised that formation of any organisation within Lotha jurisdiction required the approval of the apex Lotha tribal organisation. Adding that the same terms and conditions would apply in all such cases in future, LH warned that anyone defying its diktat would be solely responsible for any consequence that might arise thereof, and for which the Lotha community would not be responsible.

LPO formed DIMAPUR, JUL 15 (NPN): Lotha Middle and Lower Range People Coordination Committee (LMLRPCC) during its meeting held on July 13 at Bhandari Town Hall, unanimously approved to form an interim body known as Lotha Public Organisation (LPO) headed by former MLA, Sulanthung Humtsoe as chairman and Zaremo Kikon as general secretary. In a press note, LPO chairman Sulanthung Humtsoe stated that the meeting was called to “review the lackadaisical attitude” shown by Lotha Hoho (LH) on the written letter given by LMLRPCC on December 15, 2018 to reconsider and rectify their new team to follow the guidelines of the Lotha Hoho within a specific time of one month period. ZB(N) accused the government of trying to divide Nagas particularly the Zeliangrongs as a people by diverting from the main issue of implementation of ILP in Dimapur to RIIN. In such a situation, ZB(N) felt that RIIN be kept in abeyance till proper modalities or guidelines were worked out for implementation and instead focus on strict implementation of ILP in Dimapur. ZB (N) also suggested that while working on modalities for RIIN, there should be partial consideration on the government notification of 1977 which made 1963 as the cut-off date to either 1971 or 1981 because till 1964 there was underground movement under NNC which totally opposed Indian census and electoral roll enumeration in Nagaland which led to many genuine names being excluded in the 1961 census and 1963 electoral roll.
DIMAPUR, JUL 15 (NPN): Several more organizations have expressed resentment against being excluded and uninvited to the July 17 consultative meeting on Register of Indigenous Inhabitants of Nagaland(RIIN) by the state government. KIN: Kuki Inpi Nagaland (KIN), in a statement issued by its president L.L.Kuki has expressed anguish at the “deliberate omission” of KIN by the state home commissioner at such an important public consultation. Stressing on the role of the community in Naga politics, he recalled that late Pu Lenjang Kuki was one of the founder members of the Naga Club-the first Naga political platform. He said late Lenjang was one of the Naga representatives who was a signatory to the first Memorandum on Naga self determination submitted to the Indian Statutory Commission under the chairmanship of Sir John Simon on January 10,1926. To substantiate further, L.L.Kuki cited the accounts of the then Naga Hills by British scholar B.C.Allen in his book ‘Naga Hills and Manipur
in 1874-75 (vide page 33) in which the number of Kuki villages was recorded as 26 with a census of 123 people. He said in the current proposal for RIIN was for wide coverage, there was no justification to keep the Kuki inhabitants “out in the dark” adding the KIN is also a constituent member of the Joint Committee on Prevention of Immigrants(JCPI). MKPON: Mech Kachari Public Organisation of Nagaland(MKPON) has also expressed anguish Kachari Tribal Council(KTC) the apex body of Kacharis from being left out of the July 17 meeting on RIIN exercise. MKPON general secretary Dharma Dhaj Sonowal said MPON requests the state government not to sideline the Kachari tribe to such meetings as consultations were related to the existence of the Kacharis in Nagaland. MKPON said the state government was well aware that the Kacharis (Mech Kachari & Dimasa Kachari) have been living in the different parts of Dimapur district since time immemorial and are also Indigenous Inhabitants of Nagaland.
