State Cabinet sticks to stand on Citizenship Bill Insists that Art.371 (A) and ILP protects citizens of the state

DIMAPUR, JAN 20 (NPN): Against the backdrop of demand from the opposition NPF on the PDA government to oppose the Citizenship (Amendment) Bill (CAB) 2016 (already passed by the Lok Sabha and now to be decided in the Rajya Sabha), the Nagaland cabinet Sunday has categorically asserted that the CAB was not applicable to Nagaland as the state stood protected under provisions of Article 371 (A) and Inner Line Permit (ILP). According to a statement issued by the Chief Minister’s Office (CMO) media cell, the state cabinet took the decision at its meeting on January 18 after deliberating on the Bill and also re-iterated the earlier decisions adopted by the Cabinet on June 5, 2018 and January 7, 2019. JAC to monitor road upgrade work DIMAPUR, JAN 20 (NPN): Joint Action Committee (JAC) for Dhobinalla-Signal Angami-Thahekhu-Rangapahar Road has announced that it would monitor the ongoing work to upgrade the road from Dhobinalla to Diphu, Assam Road (8 km) via Thahekhu Rangapahar crossing and Sangtamtilla into a two-lane road. According to a press release issued by JAC convener KK Yepthomi, the road is being constructed under ISC scheme at a cost of Rs 17.72 crore approximately. Mentioning that the State government had taken up the road construction from Dhobinalla to Thahekhu gate under its pressure, JAC cautioned that fund for this particular road stretch (Dhobinalla to Thahekhu gate within Dhobinalla to Diphu Road project) should not be diverted to any other work. Demanding that the allocation already done for Dhobinalla to Diphu Road must be solely utilised for the project, the committee warned it would not tolerate any diversion of fund. As the road and drainage from Dhobinalla to Thahekhu gate were in need of repairs, it stressed that the allocated fund should be utilised purely for the project.

Mizoram adopting resolutions in opposing the bill, the PDA government has instead adopted a debatable stand that the Citizenship Bill, was not applicable to Nagaland as the state was protected under the provisions of Article 371 (A) and the Inner Line Permit (ILP) as per Bengal Eastern Frontier Regulation, (BEFR) of 1873, as affirmed under Clause 16 of the 16 Point Agreement. Even on this score, both NPF and other thinkers had maintained that the CAB cannot be dealt with by either Article 371(A) since it dealt with customary laws and traditional ownership and the BEFR dealt with movement of non-indigenous people into protected areas. CMO informed that the cabinet also decided to appeal to the Government of India (GoI) to have wider consultations with all NE states to ensure that rights of indigenous people were fully protected, besides referring the Bill to the Standing Committee on Art. 371 (A) under NLA to examine the issue in its entirety. CMO media cell said, after discussing the Bill, the cabinet reiterated the earlier decisions taken on June

5, 2018 and January 7, 2019 and decided to adopt a resolution reaffirming all provisions of Article 371 (A) and strengthen implementation of ILP as per BEFR, 1873 that will also be taken up in the next session of NLA. Meanwhile, as per the cabinet decision, chief minister Neiphiu Rio has written a letter to Union Home minister conveying the concern and apprehension of the people of Nagaland regarding the Bill. CMO media cell pointed out that the Bill, even if enacted, would not be applicable to Nagaland in view of the “constitutional ecosystem contained in Article 371 (A) of the Constitution of India” that guaranteed Nagas their way of life “uninterfered” by any Parliamentary enactment, unless NLA by a resolution so decides. The cabinet maintained that it was necessary to ensure that the historic and unique cultural traditions and customary practices of Nagas are protected and safeguarded for which special constitutional provisions under Art. 371(A) have also been incorporated in the Constitution, the letter is said to have pointed out.

PUNE, JAN 20 (AGENCIES): BJP-led NDA government has directed all educational institutes and universities to implement 10 per cent reservation for economically weak section (EWS) in general category in the upcoming educational year. Union HRD Minister Prakash Javadekar made the announcement while addressing a press conference today and said an official memorandum has been issued to implement the set quota. “Government has issued an office memorandum to implement 10 per cent reservation. We have issued orders yesterday to all institutes and universities to implement it in the upcoming educational year. We have also asked states to implement it,” ANI quoted Javadekar as saying. The Parliament had recently passed the Constitution (124th Amendment) Bill, 2019 in Parliament which grants 10 per cent reservation in education and government jobs to economically weaker individuals from the general category, across religions. The reservation is applicable to individuals who earn below Rs. 8 lakh per annum and possess less than 5 acres of agriculture land. On Saturday, Himachal Pradesh government became the fourth state to implement the 10 per cent quota for the EWS category. In a cabinet meeting chaired by Jai Ram Thakur, the government decided to implement reservation for Class 1, II, III and IV posts. While the BJP called 10 per cent quota a masterstroke few parties termed it a “preelection gimmick”.

IMPHAL, Jan 20: Amid massive public outcry against the controversial Citizenship (Amendment) Bill (CAB) 2016, six students’ bodies spearheading the antiCitizenship (Amendment) Bill 2016 Sunday demanded Manipur government to convene a special Manipur Legislative Assembly session on or before January 30 to oppose the Bill. During the public convention held at the centenary hall of the Manipur University, hosted by six student bodies– AMSU, MSF, DESAM, SUK, KSA and AIMS, the organizations also resolved to appeal to all members of the Rajya Sabha, particularly from NE to oppose the Bill. The students’ bodies also called for a united struggle for a mass-civil resistance movement among the political parties, civil society organizations and people of Manipur as well as the region until the CAB was withdrawn. DIMAPUR, JAN 20 (NPN): While welcoming any developmental activities undertaken in Kiphire district and offering all cooperation in this regard, Citizens’ Welfare Society (CWS), Kiphire has expressed dismay at the lay-

ing of underground optical fibre cable (OFC) for Jio and Airtel along a stretch of NH-202 just 12 or 18 cm deep, and that too on the upper side of the road by blocking and damaging the drainage system. In a release issued by its media cell, CWS said it observed while on a visit to the working site that the width to lay OFC cable was not adequate and people residing below the highway on the side would be at risk during rainy seasons. Fearing that the 2018 natural calamity could recur, it warned “This time it will be manmade disaster, if corrective measures are not taken up at the earliest.” The organisation questioned how and under what circumstances PWD (NH/R&B) allowed the company to block and damage the drainage system, which was being look after by the department. It also

questioned the contractors/ companies concerned under what guidelines they were carrying out the work of laying OFC cable and who would bear the responsibility, if the lifeline was destroyed. Mentioning that the damage was preventable, the society alleged that the authorities concerned were remaining mute spectators despite the activities going on right in front of them. CWS cautioned that, if the department or contractor or company concerned failed to take corrective measures as per the guidelines and conditions at the earliest, it would be forced to escalate the matter “before the ongoing work costs our lifeline”. The society further warned that if any mishap occurred on the NH-202 stretch due to the negligence of the department concerned, the latter would be held fully responsible.

Fuel prices hiked for 4th day straight NEW DELHI, JAN 20 (AGENCIES): Petrol and diesel price continued to go up on Sunday as well. After today’s price revision petrol prices went up by 21-23 paise while diesel prices went up by 29-31 paise across major cities in the country. Petrol price in the national capital touched Rs 70.95 per litre while diesel rate in Delhi went up to Rs 65.45 per litre after a 29 paise hike. In Mumbai, petrol price was hiked 23 paise to Rs 76.58 per litre. Meanwhile, diesel price in the economic capital went up to Rs 68.53 per litre after a 31 paise rise on Sunday. It may be noted that Petrol and diesel prices have been increasing since January 7, 2019, due to depreciating rupee and increasing global crude oil prices.

PDA’s stand on CAB will reflect collective public view: NDPP DIMAPUR, JAN 20 (NPN): Appreciating all sections of people who have expressed concern over the Citizenship (Amendment) Bill (CAB), 2016 as rights, safeguards and protection of “our people is a common concern for all of us”, NDPP said the PDA government’s stand will be based on the collective view of the people. In keeping with this approach, the party pointed out that the State cabinet had taken the decision to call a consultative meet of all sections, including tribal hohos, civil society groups, NGOs, political parties, prominent citizens and all stakeholders to ascertain the views, opinions and suggestions of all sections of the Naga society. And the consensus arrived at the meeting would naturally become the stand of the State government and presented before GoI, it added.

NDPP said the State cabinet had also referred the matter to the Standing Committee on Article 371 (A) of Nagaland Legislative Assembly, which includes members representing all political parties, to study the issue and submit its report to the House so that measures could be taken up collectively to further protect and safeguard “our people”. Regarding the report of ILP Committee, constituted to look into BEFR/ILP, NDPP said the latter would submit its final report and recommendations only after it gathered opinions and suggestions from all sections in a transparent and democratic manner. Therefore, it appealed to all concerned to come forward and give their recommendations through written submissions and also by participating in the consultative meet.

As the matter was of utmost importance and would have far-reaching repercussions, the party called for addressing the issue in a patient and sensible manner. And as a government that represented will of the people, NDPP assured all sections that the recommendations of the ILP Committee and the stand of the State government would well and truly reflect the will and desire of the people. “Naga society is a very open and democratic society. Therefore, in keeping with this tradition of ours, let us all come forward and participate in a positive and democratic manner, while avoiding all forms of negativity, with the sole intension of protecting and safeguarding the rights of our people for now and for generations to come,” the party exhorted.

DIMAPUR, JAN 20 (NPN): A teenaged-boy has taken up begging by walking up to people, offering them sweets and when they eat them, he would ask for his birthday gift. On Thursday, reports were received that the boy had tricked many unsuspecting shoppers who were in various stores, to part with their money with the same modus operandi-offer them sweets and telling them that it was his birthday. The boy was well dressed, fair complexioned, well groomed hair but outwardly exhibiting a shy and pleasing demeanour. The favourite hunting places were food corners in the busy Circular road area. On Saturday, the boy was seen at a popular sweet shop and an ice cream parlour. The boy even offered this reporter sweets claiming it was his birthday and begged for some money as birthday gift. While most people tended to

fall for the trick some reportedly threw back the sweets with warnings. A senior citizen who felt sorry gave the boy Rs.100 while on another occasion, an elderly couple gave him Rs.200.The boy continues to operate in a blatant manner in the Circular Road area and it is up to the authorities to check the menace from the juvenile. So far there was no definite information about the boy and where he came from but it was clear, that Circular Road was definitely his beat. The activities of the boy do certainly pose a nuisance and is a constant menace to the innocent people. If left unchecked such activities could spread and the consequences of which would be a high price to pay. There are also reports of many teenagers involved in minor offences throughout the city and society has to wake up to reform and rehabilitate such juvenile delinquents. K Y M C
