SC asks top telecom firms to pay Rs.1.47 L crore by Jan 27
NEW DELHI, JAN 16 (PTI): The Supreme Court Thursday dismissed review petitions of top telecom firms including Bharti Airtel and Vodafone Idea seeking review of its earlier order asking them to pay Rs 1.47 lakh crore in past statutory dues by January 23 saying it did not find any “justifiable reason” to entertain them. The apex court had on October 24 ruled that the statutory dues need to be calculated by including nontelecom revenues in what is known as adjusted gross revenues (AGR) of telcos. A bench comprising Justices Arun Mishra, S A Nazeer and M R Shah in-chamber hearing did not find merit in the review plea and dismissed it. The telecom companies had sought an open court hearing on their review petition but the Supreme Court decided to stick to its convention of doing an in-chamber hearing. “Applications for hearing in open Court/oral hearing are rejected. Having perused the Review Petitions
and the connected papers with meticulous care, we do not find any justifiable reason to entertain the review petitions. The Review Petitions are, accordingly, dismissed,” the bench said. The apex court had on October 24 last year upheld the AGR definition formulated by the DoT and termed as “frivolous” the nature of objections raised by telecom service providers. Bharti Airtel, in its plea, had sought review of the directions on aspects of levy of interest, penalty and interest on penalty relating to AGR. Telecom Minister Ravi Shankar Prasad had told Parliament in November that Bharti Airtel, Vodafone Idea and other telecom companies owe the government as much as Rs 1.47 lakh crore in past statutory dues. He had added that there is no proposal at present to waive interest and penalties on such dues. In replies to separate questions in the Lok Sabha, Prasad had said telecom
companies owe the government Rs 92,642 crore in unpaid licence fee, and another Rs 55,054 crore in outstanding spectrum usage charges. In an affidavit filed earlier in the top court, the DoT said Airtel owed Rs 21,682.13 crore as licence fee to the government and dues from Vodafone totalled Rs 19,823.71 crore, while Reliance Communications owed Rs 16,456.47 crore. BSNL owed Rs 2,098.72 crore, and MTNL Rs 2,537.48 crore. Holding that interest and penalty have rightly been levied on the telecom companies, the apex court had made it clear that there would be no further litigation on the issue and it would fix a time-frame for calculation and payment of dues by the telecom companies. Meanwhile, Telecom industry association COAI said the review dismissal by the Supreme Court was like the last straw on the back of the financially stressed sector.
Pulse polio immunization drive on Jan 19 DIMAPUR, JAN 16 (NPN): Along with the rest of the country, Nagaland would launch Intensive Pulse Polio Immunization programme on January 19, 2020 (Sunday). In a press release, state immunization officer, directorate of health & family welfare (H&FW), Dr.Ritu Thurr, said that the department was all geared up to administer Polio drops to all eligible children from 0-5 years throughout the state in 2274 polio booths to be manned by 9096 health personnel and 441 supervisors along with vaccines and other logistics. Dr.Thurr said special focus would be given to migrant population with an aim to prevent importation of Polio cases. Meanwhile, the department has appealed to all sections of the society, agencies (government and non government including the security forces and police), organizations, churches and community leaders and especially parents of children below 5 years of age to come forward and ensure that all eligible children receive the “Two Drops of Life” (Polio Drops) on Jan 19, 2020.
Narrow escape as IndiGo jet A-320 engine stalls New Delhi: Jan 16 (AGENCIES): One hundred and seventy six passengers, including three infants, were aboard IndiGO flight 6E-6129, a flight between Pune and Jaipur, when the pilot declared a full emergency because of an engine stall after which, the plane was diverted to Mumbai. According to reports, the incident was the latest engine-related incident to plague IndiGo, India’s largest, and 21st such case since 2018. GoAir, which also operates the same engine on its substantially smaller fleet of A-320 NEOs, also has had three such engine failures. Thursday’s incident comes just days after India’s aviation regulator, the Directorate General of Civil Aviation (DGCA), gave the airline an extension till May 31,2020 to replace or modify all problematic engines across its fleet of Airbus A-320 and A-321 NEO aircraft. At the beginning of this month, IndiGo operated 106 such aircraft. Though the process of modifying or replacing all problematic engines is on, it is understood that IndiGo
continues to operate dozens of flights with at least one unmodified engine. The engine, which failed on today’s flight, was one such unit and is believed to have suffered damage to the third stage blades of its Low Pressure Turbine (LPT), a recurring problem across the fleet. Despite repeated queries by media, IndiGo has refused to provide information on the number of A-320 NEO or A-321 NEO aircraft it presently operates with one unmodified engine. I n N ove m b e r, t h e DGCA had war ned of catastrophic consequences if problematic third stage blades in the engines of A-320 NEOs being operated were not replaced. ‘’These conditions, if
not addressed, could result in uncontained release of the LPT 3rd stage blades, failure of one of more engines, loss of thrust control and loss of aircraft,” it had said. Despite this, the regulator extended its own January 31,2020 deadline for the airline to modify all its engines. The Directorate General of Civil Aviation (DGCA) has extended the deadline to IndiGo for replacement of older Pratt & Whitney engines onAirbus 320 (neos) with newer ones till May 31, 2020. The DGCA has been worried at the prospect of dozens of IndiGo flights being grounded if the ban was enforced as per the original deadline, a move that would
have impacted innumerable passengers across the country. It was learnt that one of the two engines on the Airbus A-320 NEO jetliner, which stalled this morning, also developed high vibrations while crossing an altitude of 36,000 feet. The pilot reduced thrust (power) on the malfunctioning engine, bringing it to idle before landing at Chhatrapati Shivaji International Airport in Mumbai. The damaged engine had flown a total of 3,373 hours and was last inspected on 9 December. In a press release, IndiGo has said: ‘’During the flight, the pilot observed an engine vibration message and followed the laid [down] standard operating procedures. The flight landed in Mumbai. The aircraft is currently under inspection at Mumbai.’’ NEO stands for New Engine Option - Airbus, the manufacturer of the A-320 series aircraft, had offered options to airlines to fit aircraft being inducted with a new generation of engines which were 15 per cent more fuel efficient, more environmentally friendly and significantly quieter.
GoI should not backtrack on NGBF urges Ravi to Framework Agreement: NH settle Naga issue early DIMAPUR, JAN 16 (NPN): Naga Hoho said the inconclusive Naga peace process is a reflection of insincerity and lack of political will on the part of Government of India (GoI), which had committed to resolve the Naga political issue within a short period of time. NH president HK Zhimomi and general secretary K Elu Ndang, noted that there was no obstacle to signing the agreement as the government of India had decided not to retract and stick to its commitment and on agreed principles ever since the beginning of the political negotiations. NH has demanded that New Delhi must not backtrack or misinterpret the Framework Agreement which must be the basis of solution or agreement. It asserted that all intricacies must be resolved on the basis of the agreement.
NH said it needs to be ensured that signing of the final agreement be inclusive of all Naga political groups so as to fulfil the desire of the people at large. It further observed that Naga people had entered into another new year without any sign of resolving the long-pending political impasse. NH said it has been more than two decades of peace parleys which was pretty long enough and the Naga people were anxious to see a new dawn. It regretted that the October 31, 2019 announcement that the formal talks had concluded had not brought about any progress. NH also said it was unfortunate that Nagas were not united as some groups were demanding separate solution for Nagaland State, while others were trying to settle the issue for entire Nagas.
