DIMAPUR, FEB 20 (NPN): The Kohima Bench of Gauhati High Court (HC) has barred the State government from implementing the Nagaland Petroleum & Natural Gas Rules, 2012, besides suspending all orders and actions the government had taken under the rules. This followed the court registering a case suo motu after Lotha Hoho had filed a Public Interest Litigation (PIL) over the rules and later withdrew. However, considering the legality and constitutional validity involved in framing of the Nagaland Petroleum & Natural Gas Rules (NP&NGR), the court directed the registry to register a case suo motu, even as the petitioners were allowed to absolve themselves from the case. A two-judge Bench comprising Justice MR Pathak and Justice Manish Choudhury also suspended the permit granted to New Delhi-based Metropolitan Oil & Gas Private Ltd (MOGPL) for exploration, extraction, production, refining and bottling of petroleum and natural gas
in Wokha district on April 28, 2014. The permit was granted by Nagaland Petroleum & Gas Board that was constituted in pursuant to the Nagaland Petroleum and Natural Gas Rules, 2012. Listing the matter for hearing before the next available Division Bench, the court made senior counsel CT Jamir as amicus curiae in the case, along with counsel Akito Zhimoni. Further, the Central government represented by secretary of Union petroleum & natural gas ministry, State government represented by chief secretary and member secretary of Ministerial Group, Nagaland Petroleum and Gas Board, chief minister and chairman of Ministerial Group, Nagaland Petroleum & Gas Board, chairman of Nagaland Petroleum & Gas Board, member secretary of Nagaland Petroleum & Gas Board, secretary of geology & mining department, director of geology & mining and Metropolitan Oil & Gas Private Ltd have been made respondents in the case. The Nagaland Petroleum & Natural Gas Rules,
2012 was framed by the State government after the Nagaland Legislative Assembly unanimously passed a resolution on July 26, 2010 rendering all Acts of Parliament governing petroleum and natural gas inapplicable in the State. It may be recalled that the court in its order dated October 8, 2015 passed in the PIL No. 4(K) 2015 observed that “Article 246 of the Constitution of India deals with subject matters of laws to be made by Parliament and by the Legislatures of States.” It observed that in terms of Art. 246, the seventh schedule envisages three lists covering different subjects— List I is the Union List, List-II is the state List and List-III is the Concurrent List. It said that Entry 53 of List-I deals with regulation and development of oil fields and mineral oil resources, petroleum and petroleum products, other liquids and substance declared by the Parliament by law to be dangerously flammable. Prima facie, the court was of the view that explo-
ration of oil and natural gas is a subject which is covered by Entry 53 of Union List, which meant that “it is the Parliament which has the legislative competence to enact laws on this subject.” On the other hand, the court observed that Art. 371-A deals with special provision with respect to the state of Nagaland. Clause (1) of Art. 371-A provides that no Act of Parliament in respect of- i. religious or social practices of the Nagas, ii. Naga customary law and procedure, iii. administration of civil and criminal justice involving decisions according to Naga customary law, iv. ownership and transfer of land and its resources, shall apply to the state of Nagaland unless the Legislative Assembly of Nagaland by a resolution so decides. The court stated: “It does not in our tentative view confer further competence on the Legislative Assembly of Nagaland to legislate on a subject which is within the exclusive domain of Indian Parliament.” However, the court noted that it was an
aspect which would require further deliberation on the Court. After a series of meetings and the most recent being held on June 6, 2018 in the conference hall of the chief secretary, the two sides (state government and Lotha Hoho) along with other tribe stake holders– Ao Senden, Chakhro Public Organisation, Konyak Union, Phom People’s Council, Rengma Hoho, Western Sumi Hoho and Zeliangrong Baudi- agreed that the NPNG Regulations and Rules 2012 will be amended by the state government. Thus, a Memorandum of Understanding (MoU) was signed on November 20, 2018 between Lotha Hoho and Nagaland government represented by the NPNG board with certain terms and conditions to amend the Nagaland Petroleum and Natural Gas (NPNG) Regulations & Rules, 2012. As per the NPNG Regulations and Rules 2012, the state government set up the NPNG Board to monitor all activities related to oil and natural gas mining.

SHILLONG, FEB 20: The United Democratic Party (UDP), Meghalaya’s main regional political party, Wednesday announced that it has snapped ties with the BJP-led North East Democratic Alliance over the controversial Citizenship Bill. The announcement came days after BJP President Amit Shah said that his party will make the Bill part of the party manifesto for the coming Lok Sabha elections and pass it if it returns to power. “We have snapped ties with the BJP-led NEDA over the controversial Bill, besides the insensitivity of the BJP leadership towards indigenous Meghalayans in particular and in the Northeast as a whole,” UDP vice president Allantry Franklin Dkhar told the media here. “In fact, our the decision was taken a couple of days after 11 regional political parties from across the NE states met in Guwahati on January 29 which unanimously agreed to oppose the Bill,” Dkhar added. The UDP, which has nine members, including two associate members in the 60-member state Assembly, is supporting the NPP)led MDA government.

DIMAPUR, FEB 20 (NPN): A day after BJP leader Dr. Sanjay M. Ram Paswan claimed that the vexed Naga political issue would be settled after the ensuing Lok Sabha election, the Nagaland Pradesh Congress Committee (NPCC) Wednesday quickly mounted an attack on the saffron party, saying people have been “fooled once but will not allow twice.” In a press release, Nagaland Pradesh Congress Committee president K Therie said Dr.Paswan’s claim confirmed that “there will be no solution before election.” State Congress president said Dr. Paswan, who is a senior leader of the BJP, would have consulted top leaders of the BJP before coming to Nagaland. Alleging that RSS goal was “Uniform Civil Code
and Hindutva”, Therie said the Congress did not believe RSS has any solution for regional problems. Claiming that Congress had given solution in the past, the NPCC president said the party took a back seat as direct talks were ongoing. Stating that party appreciated the difficulties and realities of negotiations, Theire, however, asserted that 21 years of negotiations without solution was “unreasonable” as people cannot continue to suffer. “Therefore once again, Congress has adopted a policy ‘to endeavour; solve the political problem through peaceful and constitutional means’. We mean it and given opportunity, we will do it. We believe the welfare of people is the final solution,” said NPCC president, K. Therie.
DIMAPUR, FEB 20 (NPN): Justice Uma Nath Singh, the first Lokayukta of Nagaland, an anti-corruption ombudsman, would take oath of office on February 22, 2019. According to a Raj Bhavan statement, the Governor of Nagaland, PB Acharya, would administer the oath of office to Justice Uma, former Chief Justice of Meghalaya High Court, as the Lokayukta of Nagaland at Durbar Hall, Raj Bhavan Kohima at 6:30 pm. State government, in a notification dated January 31, 2019, appointed Justice U.N. Singh to be the Lokayukta of Nagaland. As per the notification, Justice Uma would hold office for the term of five years from which he enters upon his office or till he attains the age of 70 years whichever is earlier.

DIMAPUR, FEB 20 (NPN): Deputy National Security Advisor (NSA) and Government of India’s representative to Naga Peace Talks, R.N. Ravi is scheduled to arrive in Dimapur on February 26 on a two-day visit to Nagaland and is likely to brief the stakeholders on the “status of Naga Peace Process”. When contacted, Ravi said, “I am coming to meet the stakeholders, legislators, apex tribal bodies, civil society organisations on the status of Naga Peace Process”. Ravi also added, “I would expect a constructive discussion on this issue with all of them”. Ravi will arrive in Dimapur on February 26 and straightaway head to Kohima where he is expected to hold series of meetings. He will return to Dimapur on February 27 and leave for Delhi on February 28 afternoon. Ravi, after taking over as government of India’s representative to Naga Peace Talks in 2014, first arrived in Nagaland on May, 2015 and met Naga stakeholders.

In an exclusive interview with Nagaland Post after the meetings, Ravi had termed the interaction as “very positive and cooperative”. In the same interview, he had asked NSCN (K) to rethink their position of abrogating 14 years old cease-fire with government of India and “come back”. After the split of NSCN (K) in 2018, NSCN/GPRN (K) led by Khango Konyak expressed desire to restore the cease-fire and on January 29, 2019 formally joined the Working Committee of Naga National Political Groups (NNPGs) and subsequently joined the ongoing Naga Peace Process. Ravi in his tenure as the representative has managed to rope in seven Naga Political Groups (NPGs), apart
from NSCN (I-M) which was already into talks, into Naga Peace Process. On August 3, 2015, Ravi signed “Framework Agreement” with NSCN (I-M) in the presence of Prime Minister, Narendra Modi and Union Home Minister, Rajnath Singh. He then went on to sign another agreement with WC of NNPGs on November 17, 2107, which the latter has termed as an “agreed position” between the two entities. Despite opening the door to all NPGs and holding series of interactions with various sections of the Naga society, Ravi, who has maintained that there would be “only one peace process and one agreement” to the decades old Naga Political issue, is yet to sit together with NSCN (I-M) and WC of NNPGs. As the present tenure of BJP-led NDA government at the Centre comes to an end, probably, this May, it remains to be seen whether R.N. Ravi could bring together all the negotiating parties together and sign the highly anticipated “final agreement”.

DIMAPUR, FEB 20 (NPN): In a tragic road accident, a hired vehicle (Toyota Innova- NL01/H-6595) hit the side of the pavement on the road culvert at NH-36 in Hari Taro Gaon, Assam near an army camp Wednesday at around 6.20 a.m. killing three on the spot while the driver succumbed to injuries later. Those killed included joint director of veterinary department Dr. Asenuo Linyü (54) wife of Dr. Salang (residents of Fellowship Colony, Dimapur); Zekielhouvinuo Angami @ Donuo (53) wife of K. Aier (resident of Walford Colony, Dimapur) and Sakholie Zhutso (48) son of V. Zhutso (resident of NST Colony, Dimapur). ing when the mishap took place. Speaking to Nagaland, OC of Dokmoka police station, J.S. Khoboung said it was suspected that the mishap occurred either due to tyre burst or because the driver had dozed off momentarily and lost control of the vehicle. Interestingly, the OC also revealed that upon investigation of the badly damaged vehicle, it was found that there were no air bags in the dashboard of the vehicle. OC also said that his
team extended all necessary help to send the dead and injured to their relatives and also administered medical treatments to the injured. It was also reported that a combined memorial services will be held in the NCRC main church Dimapur Thursday morning at around 10 a.m. Meanwhile, the Citizen Believers’ Movement has expressed condolences to the members of the bereaved family and prayed for the departed souls to rest in peace.

BJP govt opts against ordinance on CAB NSCN (K) warns of ‘problems’ NEW DELHI, FEB 20 (IANS): Facing stiff opposition from its own allies in the northeast, the Modi government has opted against an ordinance on the Citizenship Amendment Bill even as it approved four other ordinances at a meeting of the Union Cabinet on Tuesday. There was speculation that the government may decide on promulgating the ordinance on the Citizenship Amendment Bill, 2016 which was not passed by Parliament in the Budget session of Parliament, the last session before the Lok Sabha polls. The bill was passed in the Lok Sabha but not in Rajya Sabha where the Modi government lacks a majority. Though Bharatiya Janata Party leaders, including Prime Minister Modi, are eager to pass the bill which seeks to provide citizenship to non-Muslim minorities from Bangladesh, Pakistan and Afghanistan, the Asom Gana Parishad (AGP), its ally in Assam, had left the alliance over
the bill and several other allies in the northeast had also strongly opposed the bill. BJP’s Chief Minister in Manipur N. Biren Singh had also called for a review of the bill. He had met Home Minister Rajnath Singh along with his party counterpart from Arunachal Pradesh Pema Khandu earlier this month to apprise him of the situation in their states in the wake of opposition to the bill and urged the Centre not to go ahead with it. However, BJP chief Amit Shah had said in Guwhati on Sunday that the party will make the Citizenship Bill part of its manifesto for the next elections and pass it on return to power this year. It remains to be seen if the BJP will tie-up with the AGP for the Lok Sabha polls since the latter had said it had broken with the BJP now over this bill but did not emphatically rule out an alliance “in the future”.
Amit Shah’s CAB remark irks state NPP DIMAPUR, FEB 20 (NPN): National People’s Party (NPP) Nagaland state unit has expressed its displeasure over BJP president Amit Shah’s recent statement in Guwahati, where he promised to re-introduce and implement the Citizenship (Amendment) Bill if voted back to power in 2019. In a press release, NPP Nagaland general secretary--IPR, Ricky Ozukum, appealed to the BJP leadership to be sensitive to the aspirations and welfare of the region considering the united voice of the indigenous people of the Northeast against the CAB. NPP reiterated its stand against the introduction of CAB and any other issues that would be regressive for the Northeast region. Further, highlighting the promise made by BJP in its election manifesto for Nagaland concerning the solution for the Naga peace talks, the NPP appealed to the central BJP leadership to be sincere in their commitment and expedite the Naga peace accord at the earliest and “not miss this golden opportunity since it has the required number in the Parliament”.
MON STATE (MYANMAR), FEB 20 (AGENCIES): NSCN (K) faction led by Aung Yung has alleged that the Myanmar military (Tatmadaw) has continued pressuring the group not to provide any shelter or support for ethnic Kathe rebels from India, who have crossed the border into western Sagaing Region. “They kept pressuring us to stay away from the Kathe. They even told us that they will continue to search for Kathe in our area,” U Kyaw Wan Sein, a member of the NSCN (K)’s central executive committee, told The Irrawaddy on Wednesday. NSCN (K) has asked the military to stop the searches in areas the NSCN (K) controls in order to preserve the peace. “We asked them to stop the military operations they launched in our areas and to withdraw. But they have not stopped,” U Kyaw Wan Sein said, warning that continued pressure could lead to fighting. “We are human. We do not know when we will not be able to control our minds. Our region will have problems if they do not stop their military operations in our area,” he said. State media on Tuesday reported that the military arrested four insurgents during operations in the Naga Self-Administered Zone of Sagaing Region between Feb. 8 and 19, captured a camp and recovered 53 weapons and ammunition. U Kyaw Wan Sein said the NSCN (K) has asked the government and military to return its headquarters.
KIPHIRE, FEB 20 (NPN): Kiphire district, which was declared as one of the aspirational district of India by Centre in November 2017, has not received “even a single paise” till date to carry forward the programme. This was informed by ADC Kiphire, Reny Wilfred during the District Planning and Development Board (DPDB) meeting on February 20 The issue came up when the members were discussing an agenda put up by United Sangtam Likhum Pumji on the current status of the ‘Aspirational District’. The ADC, who is also the nodal officer, said that since the aspirational programme was a convergence of various funds and projects, the district was yet to get funds for the financial year 2018-19. Due to this, the district administration, tasked with coordinating flagships schemes, has not made any progress due to lack of funds. Taking part in the discussion, the R&B and RD departments also stated that they had also not received any funding under PMGSY, NERGA and PMAY for the year 2018-19. K Y M C
