SC to examine CAA’s constitutional validity JCPI, tribal hohos & CSOs reject CAA

Court issues notice to Centre; hearing on 60 petitions in Jan

NEW DELHI, DEC 18 (PTI): Supreme Court on Wednesday decided to examine the constitutional validity of the amended Citizenship Act, but refused to stay its operation. CAA provides citizenship rights to non-Muslim migrants of Pakistan, Bangladesh and Afghanistan. The top court issued notice to the Centre on a batch of pleas challenging the Citizenship (Amendment) Act. A bench comprising Chief Justice S A Bobde and justices B R Gavai and Surya Kant fixed 59 petitions, including those filed by the Indian Union Muslim League and Congress leader Jairam Ramesh, for hearing on January 22, next year. The bench also agreed to the submission of lawyer Ashwini Upadhyay that common people should be made aware about the aim, objects and the contents of the CAA and asked Attorney General K K Venugopal, representing the Centre,

US House meet to impeach Trump WASHINGTON, DEC 18 (PTI): Donald Trump, set to become the third US president to be impeached, has attacked House Speaker Nancy Pelosi and accused the Democrats of an “unprecedented and unconstitutional” abuse of power. Lawmakers opened debate on Wednesday and were poised to approve two impeachment charges against Trump, according to US media outlets. Ahead of a lengthy debate in the House and the vote on the articles of impeachment against the 45th US president, Trump wrote to Pelosi that the Democrats would regret their efforts when voters cast ballots next year. After hours of acrimonious debate, the House Judiciary Committee approved two charges against Trump last week. The first is abuse of power. It accuses Trump of trying to pressure Ukraine to smear Joe Biden. The second charge is obstructing Congress. Trump is scheduled to face a trial in the Senate next month, but the lower chamber is controlled by the Republicans. Thus, Trump is sure that Democrats will not have the support from twothirds of senators to vote that he should be removed from office.

to consider using audiovisual medium to make citizens aware. During the hearing, some of the lawyers, appearing for some petitioners, sought a stay on the operation of the newly enacted law. The Attorney General opposed the submission and said there are as many as four judgements which have held that a law cannot be stayed after being notified. “We are not going to grant a stay,” the bench said, adding arguments on granting stay can be advanced on January 22, the next date of hearing. Senior advocate Rajeev Dhavan, who represented one of the parties, said there was no need to seek the stay on the operation of CAA as

it has not come into force as several things like framing of rules under the law are yet to be done. Indian Union Muslim League (IUML), said in its plea that CAA violates the fundamental Right to Equality and intends to grant citizenship to section of illegal immigrants by making an exclusion on the basis of religion. IUML sought an interim stay on the operation of CAB and Foreigner Amendment (Order), 2015 and Passport (Entry Into Rules), Amenment Rules, 2015. The petition alleged that the government’s CAB was against the basic structure of the Constitution and intended to explicitly discriminate against Muslims

as the Act extended benefits only to Hindus, Sikhs, Buddhists, Jains, Parsis and Christians. The plea filed by Congress leader Jairam Ramesh, has said that the Act is a “brazen attack” on core fundamental rights envisaged under the Constitution and treats “equals as unequal”. In his petition, Ramesh said: “The impugned Act creates two classifications, viz, classification on basis of religion and the classification on the basis of geography and both the classifications are completely unreasonable and share no rational nexus to the object of the impugned Act i.e., to provide shelter, safety and citizenship to communities

progress, Ravi stressed on the need to have proper health facilities, quality education, better connectivity and improved human development in the region. The Governor also greeted the people of Tuensang on the occasion and called upon the gathering to strive for peace and development. Khiamniungan Tribal Council president, L. who in their native country are facing persecution on grounds of religion,” the plea has said. Others like RJD leader Manoj Jha, Trinamool Congress MP Mahua Moitra, AIMIM leader Asaduddin Owaisi, Muslim body Jamiat Ulama-i-Hind, All Assam Students Union (AASU), Peace Party, NGOs ‘Rihai Manch’ and Citizens Against Hate, advocate M L Sharma, law students have also approached the apex court challenging the Act. Con says, Misinformation being spread on SC’s CAA order: Congress on Wednesday said it did not seek an interim stay by the Supreme Court on the amended citizenship law and alleged “misinformation” was being spread, while asserting that the legislation goes against India’s global obligations. Congress leaders Abhishek Singhvi said: “The main petition in the court today was ours, filed by Jairam Ramesh. I want to clarify that none of the petitioners had asked for an interim stay. We did not seek an interim stay. We only sought a show cause notice to be issued.”

Nirbhaya case: Apex Court confirms death sentence NEW DELHI, DEC 18 (PTI): Supreme Court Wednesday “confirmed” the capital punishment awarded to one of the four convicts in the gruesome Nirbhaya gang rape-and-murder case by dismissing his plea which sought review of its 2017 judgement upholding his death penalty. With this verdict on the plea of convict Akshay Kumar Singh, the review petitions of all the four death row convicts in the case stand dismissed by the apex court. The convicts are yet to file curative petition which is the last legal recourse available to a person and it is generally considered in-chamber by the top court. On July 9 last year, SC dismissed the review pleas filed by other three convicts-- Mukesh (32), Pawan Gupta (25) and Vinay Sharma (26)-- , saying no grounds have been made out by them for the review. Dismissing the plea of Akshay, who was the cleaner of the bus in which the incident took place, a 3-judge bench headed by Justice R Banumathi said there was no “error apparent on the face of the record” and none of the grounds raised by him call for review of the 2017 judg(See full story on p-5) ment.

of the day. While extending solidarity with all antiCAA movements across the North-East and other parts of India, the meeting condemned the killings perpetrated upon indigenous protestors by the Assam Police and by the immigrants in Tripura. The house decided to cooperate with other states under the aegis of NEFIP on the issue of CAA. On the other hand, the members were firm against having two cut-off dates with regard to coverage of ILP over Dimapur. It pointed out that BEFR 1873 had come along with creation of statehood on December 1,1963. Since Indigenous Certificate

were being issued on the basis of December 1, 1963, the house asserted that it (Dec 1, 1963) should be the same cut-off date and year for ILP, which was non-negotiable. Further, the house also served an ultimatum on the government to submit the final report of the RIIN commission before January 31, 2020 and the final notification to be issued latest by February 29, 2020. At the meeting, the house also condemned the memorandum submitted “by some vested interest non-local groups to the state government”, requesting it not to bring Dimapur under ILP coverage. The house maintained that the appeal was a misrepresentation of facts and a mischievous attempt to sow strife and division among different communities. JCPI said it had in the past consulted non-Naga communities and considered them as fellow- stakeholders in the demand for ILP coverage in Dimapur. Therefore, JCPI said it was ever ready to reason and sort out any genuine grievances or doubts with any communities in Dimapur.

DIMAPUR, DEC 18 (NPN): Joint Committee on Prevention of Illegal Immigrants (JCPI) said it has rejected outright the concept of Citizenship (Amendment) Act for all time to come. This was among several resolutions adopted at a joint meeting with all tribal apex bodies and civil society organizations, at Hotel Tourist Lodge, Dimapur on December 18. In a press note, JCPI convenor, K Ghokheto Chopi and secretary Tia Longchar said the house opined that once the CAA is imposed in the neighbouring states, protective clauses like the Inner Line Permit and Article 371 A will not protect the state of Nagaland even though it has been exempted under CAA. The house demanded the state political parties-NDPP and NPF to come out with a clear-cut stand, as to why the Lok Sabha and Rajya Sabha MPs representing the citizens of Nagaland, voted for in favour of CAA. They warned that the MPs would be held responsible, should the future of Naga people be put to jeopardy at the end

DIMAPUR, DEC 18 (NPN): Tenants’ Association of Naga Shopping Arcade (TANSA) has expressed strong resentment that the Naga Shopping Arcade (Super Market area) Dimapur has been left neglected decades despite several appeals made to the Development Authority of Nagaland (DAN). Highlighting the issues faced by the tenants during

the press conference held on Wednesday at Press Point, TANSA office bearers pointed out that there has been no renovation/maintenance, whitewashing of buildings, maintenance of roads and drainages in the area etc.. They said, TANSA along with tenants had been carrying out basic maintenance work at their own cost, without any aid of whatsoever from the office of DAN. Despite all this, TANSA said the authority

made an abnormal increase of rent from Rs.5 per square feet to Rs.9.50 per square feet for ground floor and for the first floor from Rs.4.50 psft to Rs.7.60 psft, in the month of April, 2019. It was unfair on the part of DAN to hike the rent, when no developmental activities were initiated for the tenants, said TANSA, adding they were compelled to take the matter to the Court. What infuriated them more was the imposition of

15% service charge besides monthly rental without undertaking any maintenance work, TANSA stated. They also highlighted about abnormal power bills, claiming it was much higher compared to other commercial buildings. They pointed out that meter reading in some areas were not possible as the meter-box were located in basements that were inundated for years, due to lack of proper drainage sys(Cont’d on p-7) tem.

DIMAPUR, DEC 18 (NPN): Minister of Higher & Technical Education and Tribal Affairs, Temjen Imna Along, Wednesday stressed the importance of promoting indigenous products and asserted that the real freedom of Nagas lay in showcasing the products that have been produced within their land. Speaking as guest of honour Working Woman Expo which commenced at Dimapur Government College grounds here Wednesday, the minister said “if your freedom is at bondage and dependent only on others than you can never be free”. The three-day expo is being organised by the Working Woman Project, a non-profit endeavour established with the aim to create self reliance among women from low income

households in Dimapur. The minister lamented that Nagas today have lost their culture of hard work and indigenous farming practices and have started importing everything. Along, however, was optimistic that one day through the initiative of self help groups (SHGs) indigenous products from Nagaland would be exported and make the economy of the state sustainable. Emphasising the importance of supporting lo-

cal business and promoting indigenous culture, he said “Let us buy our own people’s products, our own organic foods and promote our own traditional clothes and our way of life and not the way of life of others,” he said. “Today we are Indians but also we are Nagas, we have to know how to correlate to live together with the right balance of mindset towards each other and not by undermining each other,” Along added.
