Law panel to frame govt poll plan

NEW DELHI, AUG 28 (AGENCIES): Law Commission will this week recommend a tough legal framework, which includes changes in the Constitution and election law, to hold Lok Sabha and assembly polls together, highly placed sources on the panel said. The commission would recommend amendments to the Constitution and the Representation of the People Act (RPA) to ensure simultaneous polls, they said, adding that without these changes the mammoth exercise cannot be held. The recommendations of the panel are not binding on the government, but the report will allow an informed debate among political parties and stakeholders. Simultaneous polls to Lok Sabha and state Assemblies can be held in two phases beginning in 2019, provided at least two provisions of the Constitution are amended and ratified by majority of the states, a Law Commission study paper said in April. Petrol crosses Rs 78, diesel rates at new high New Delhi, Aug 28 (PTI): Petrol prices Tuesday crossed the Rs 78 per litre mark in Delhi for the first time in more than twoand-half-months, while diesel continued to scale new highs. Petrol price was hiked by 14 paise and diesel by 15 paise, according to price notification of state-owned fuel retailers. The increase pushed up the petrol price past Rs 78 for the first time since June 3. It now costs Rs 78.05 a litre in Delhi. In Mumbai, it is at Rs 85.47. Diesel rates scaled a new high of Rs 69.61 per litre. In Mumbai, it costs Rs 73.90. Fuel prices in Delhi are the cheapest in all metros and most of state capitals due to lower sales tax or VAT. Diesel prices hit their highest level, crossing the previous peak of Rs 69.31 a litre reached on May 29.

To recommend amendments to Constitution & Representation of the People Act be elected prime minister or chief minister by the entire House (Lok Sabha or state Assembly) to ensure stability of the government as well as the Lok Sabha or the Assembly. The document proposed amending the Constitution (Articles 83(2) and 172(1) dealing with tenures of Lok Sabha and state Assemblies) and the Representation of the People Act to extend the terms of state legislative assemblies to effect the move. It suggested that in case a government fell midterm, the term of the new government would be for the remaining period “and not for a fresh five-year term”. NDA government may convene a special session of Parliament to move a consti-

tutional amendment bill on simultaneous elections or do so in the coming winter session, a Telangana BJP leader claimed on Tuesday. Telangana BJP spokesperson Krishna Saagar Rao said there is a possibility of the government moving a constitutional amendment bill for the RPA in the winter session or convening a special session for the purpose. “BJP is for simultaneous elections; we are still pursuing and we have not given up on that,” Rao told PTI. While the poll panel exhorted a five-judge constitution bench headed by Chief Justice Dipak Misra to issue directions on issues such as disqualification of lawmakers even before conviction, the Centre, through Attorney General K K Venugopal, asked the court to keep off. Senior advocate Meenakshi Arora, appearing for the poll panel, referred to the reports of the EC and the Law Commission on decriminalisation of politics and said these were out way back in 1998 and 1999 respectively, but no action was taken by the government. “It is very clear that political parties are fielding candidates with criminal antecedents and the court should pass directions,” the lawyer said, adding, “if Parliament is stonewalling this, then the court has to step in”. The poll panel, in its report, had referred to section 8 of the Representation of the People Act and said it dealt with disqualification of lawmakers on conviction for certain offences. Arora exhorted the court to issue direction in the matter besides asking

Parliament to make the suitable law. “We cannot comment on Parliament,” the bench said while reserving the verdict on the PILs filed by NGO ‘Public Interest Foundation’ and BJP leader Ashwini Upadhyay. On the other hand, Venugopal opposed the observation of the bench that poll panel can be asked to direct political parties to ensure that tainted persons do not contest elections on their ticket and symbols. He said judiciary should not venture into the legislative arena by creating a pre-condition which would adversely affect the right to contest of the candidates. “The intention of the Lordships is laudable. But the question is whether the court can do it. The answer is ‘no’,” he said. He was responding to the suggestion of the bench that the persons, facing criminal charges, would be free to contest, but they cannot do so on party ticket using party’s election symbol. The top court is dealing with the question whether a legislator facing criminal trial can be disqualified at the stage framing of charges in a case.

DIMAPUR, AUG 28 (NPN): Public Action Committee (PAC) under the aegis of Naga Council Dimapur (NCD) has urged the deputy commissioner (DC) Dimapur to take appropriate measures to contain multiple taxation, syndicate and lease system operating in Dimapur. In a representation addressed to the DC Dimapur, PAC (NCD) convenor, Vekhosayi Nyekha, and co-convenor and NCD vice president, K Ghokheto Chophy, pointed out that rampant multiple taxation, syndicate and lease system operating in and around Dimapur district has compounded the uncontrolled inflation in all prices in the market affecting the consumers of the district and the state. Interacting with newsmen at a ‘Meet the Press’ event organised by the Indian Women Press Corps (IWPC) here, Dr Singh said that when the UPA government came to power in 2014, it faced the problem of huge exodus of students from the North Eastern region to cities like Delhi, Pune and Bengaluru... primarily for higher education and job placement. “We started working on that and started a separate department in Gauhati University, which invites scholars to deliver lecture like in the US. In Shillong, we started APJ Kalam Chair and Study Centre,” he said. “The government cannot offer jobs to everybody but it can help in creating jobs. In that direction we have added incentives and financial aid”.

Aug 23 Senapati declaration: 4-lane road project: NTC Ensure timely completion of 4-lane work: Zeliang Naga Hoho snubs its president concerned over threats DIMAPUR, AUG 28 (NPN): Naga Hoho (NH) through its general secretary, Mutsikhoyo Yhobuh and information and publicity secretary C. Daipao Tuesday clarified that joint declaration signed by NH president Chuba Ozukum along with the United Naga Council (UNC) on August 23 at Senapati, was a “unilateral decision” of Ozukum, without discussing with the executive council nor the Federal Assembly of Naga Hoho. NH said Nagas were well aware, that Chuba Ozukum has been requested to demit his office gracefully following the resolution passed on October 31, 2017 taking into cognizance the letter served by the Ao Senden of its dissociation from the Hoho and directing the president to resign from the post. Besides, four tribes i.e. Pochury Hoho, Rengma Hoho, Chakhesang Public Organisation and Angami Public Organisation have put a stricture on the functioning of the Naga Hoho and for which the executive had served a reminder

NH affirmed to continue “to uphold the solidarity and unity of the Nagas and defend the rights of the Nagas in politics for securing lasting peace in our land as enshrined in our Yezabo.” It however said that intimidation or ostracization of certain section of people as contained in the declaration were contrarian views of the Naga Hoho to achieve peace.

DIMAPUR, AUG 28 (NPN): Nagaland Tribes Council (NTC) has expressed concern over the report of some miscreants creating disturbance in the smooth progress of the ongoing four-lane works between Dimapur and Kohima NTC through its media cell said it has viewed the report with all seriousness and considered “as a threat to our basic life and development” since the highway was the only lifeline connecting Nagaland with the rest of the world. In this regard, NTC has urged the state government and the NHIDCL to immediately intervene and bring the culprits to book so the work would continue without hindrances. The council has also requested the public in the locality to extend all possible cooperation during this crucial period. Stating that all attention of the public was on the ongoing four-lane highway, NTC said “we cannot compromise with its quality workmanship and timely completion.” According to NTC, the NHIDCL executive director had assured that 25% of the work would be completed by the end of 2018 and the project would be accomplished by the end of 2019 and accordingly specific instructions have been given to the contractors at various intervals.

D I M A P U R , AU G 2 8 (NPN): Leader of opposition TR Zeliang has asked the PDA government to immediately initiate appropriate measures to ensure that four-lane works on NH-29 was completed on time without any hindrance. In a communiqué, the former chief minister pointed out that ongoing work to convert Dimapur-Kohima road into a four-lane was the first and among the most important national projects in Nagaland that would immensely benefit the citizens, including commuters from neighbouring States passing through Kohima and the State’s commercial hub Dimapur. He, however, noted that in recent times, harassment of workers and theft of machineries by anti-social elements had brought the construction works to a halt. According to him, this proved the stark reality of

lawlessness and mayhem in the State. Zeliang asked the State government to explain what problem and difficulty it was facing in initiating action to ensure safety of workers and machineries, even when land-owners and civil society groups were supporting successful implementation of the important project. Instead of remaining a mute spectator, he demanded that the government should immediately carry out investigations, book the culprits and initiate appropriate action against them. “The State should perform its bounden duty by instilling a sense of security in its citizens and not pay attention only on responsibilities where commissions and kick-backs exist,” he stressed. Zeliang alleged that construction of the four-lane NH-29 from Chathe Bridge (Patkai College junction) to Piphema came to a halt

not due to activities of antisocials alone, but also due to negligence of the State government in creating a conducive atmosphere, besides its failure in coming up with concrete measures to curb such a menace. Else, he wondered what explained the failure in recovering vehicles despite filing of FIRs. Did it not portray the ineffectiveness of government machinery, he asked. Zeliang said, if the government of the day failed to protect workers of such major projects, how citizens could expect to have sustainable roads in other parts of the State. According to Zeliang, not only was it the bounden duty of the State government to check quality of work of contractors and timely completion of the project as per contractual agreement, but providing safety and security as and when required was also equally important.

NDPP rebuffs NPF criticism of CM’s I-Day speech ECS volunteers to restore road D I M A P U R , AU G 2 8 (NPN): NDPP has reacted sharply to the criticism of chief minister Neiphiu Rio’s Independence Day speech by NPF spokesperson Achumbemo Kikon. In a statement issued by its media & communication committee, the ruling party asserted that NPF had no moral authority to raise the issue of transparency, accountability and VIP culture as it became epitome of corruption, manipulation and deceit during its rule. It alleged that NPF leaders and party office-bearers crisscrossed roads with VIP lights, designation plates, escorts and bodyguards with no regard for common citizens and conducted themselves as super VIPs, instead of serving the people. Stating that the changed scenario now was there for everybody to see and experience and did not require any elaboration, NDPP reiterat-

ed that the PDA government was against VIP culture and that it would continue to take steps in removing symbols and habits of VIP culture in every possible way. Reacting to the criticism of not doing enough for the victims of natural calamity in Nagaland, the ruling party claimed that the PDA government had left no stone unturned in its endeavour to carry out relief, rehabilitation and providing logistical support. Emergency services, disaster management teams, relief operations and humanitarian aid had been activated like never before, it added. The party claimed that all members of displaced families had been given relief and financial aid for 30 days as per NDMA guidelines and that the NSDMA was carrying out assessment of damaged properties for onward submission to the higher authorities.

It asked NPF to appreciate that all PDA elected members and party officials had contributed one month’s salary towards Chief Minister’s Relief Fund. Also, rank and file of party organisations of the PDA coalition partners generously contributed towards relief operations, along with members of the PDA coordination committee, who contributed generously and even carried out relief distribution activities, besides reaching out to impacted sections to gather firsthand reports of the response of government agencies. NDPP clarified that it did not want to publicise its charitable activities, but added that as NPF had made it an issue, it also asked the opposition party to make public what humanitarian activities it had undertaken to ease the lives of those who were suffering. Reacting to NPF’s criticism over roads,

the ruling party pointed out that on the first day of being sworn in, the PDA government had taken a decision to begin repair and renovation of roads in district headquarters within 60 days. It claimed that the exercise began on a war footing and was progressing very well, before the model code of conduct for the Lok Sabha by-election came into effect for more than a month, followed by heavy rains that stopped all repair and renovation works as government agencies and machineries were directed towards emergency and relief operations all over the State. Assuring the PDA government’s commitment of providing good roads, the party, however, said it was only appropriate that the natural calamity should be tackled first and wait for the rains to subside, else it would be wasteful effort and expenditure. D I M A P U R , AU G 2 8 (NPN): Along with rest of the State, Tuensang, Mon and Longleng districts were also severely hit by the unprecedented rains that occurred on July 28 that washed away many major road. Two major highways – Tuensang to Tobu and Tobu to Mon – were also damaged at multiple locations, cutting off 21 villages with a population of over 45,000. Many farmlands along river banks were also damaged by flash floods. With suppor t from Hindustan Computers Ltd (HCL) Noida, Eleutheros Christian Society (ECS) undertook restoration work on the road below Hakchang village connecting Tuensang and Tobu. Meanwhile, ECS also provided soya bean seeds as livelihood alternatives to farmers across nine villages whose crops were damaged by the floods. Soya bean is feasible crop that can be cul-

tivated in damaged areas and help farmers recover some of the losses in a short period of time. The society also offered farmers to buyback the produce after the harvest.
