NHRC not competent to term AFSPA ‘unlawful’: Justice Kumar

SHILLONG, DEC 15: National Human Rights Commission (NHRC) Wednesday said it is not competent to term the controversial Armed Forces Special Powers Act (AFSPA) as “unlawful,” but will definitely take action if excesses are committed while implementing the Act. “NHRC would not be competent to say that this law (AFSPA) is unlawful. It is framed by the legislature. Yes, if there are excesses committed while implementing this law, certainly we are competent,” NHRC member, Justice Mahesh Mittal Kumar, told reporters. “An Act can be challenged before the court of law only if it violates basic structure of the constitution, and if the legislature was not competent to frame a law,” he said, adding that NHRC is body which makes recommendation.
Panel to discuss border issue DIMAPUR, DEC 15 (NPN): Chairman of the Sub-Committee to Examine the Nagaland-Assam border issue, Mhathung Yanthan, has convened a sitting of the sub-committee on December 20, 2021, in the Committee Hall of the Nagaland Legislative Assembly Secretariat, Kohima. The meeting would be held 15 minutes after the Assembly Session is adjourned on that day, All the members of the sub-committee have been requested to attend the meeting.
State records zero Covid cases, deaths
DIMAPUR, DEC 15 (NPN): Nagaland on Wednesday recorded zero Covid-19 cases and nil deaths during the day. The total caseload remained at 32161. Meanwhile, apropos the news published on December 15, the death toll should be read as “700 deaths (including 16 nonCovid deaths but with positivity) and not as published. Stating that several laws have been declared as ultra vires of the constitution by the High Courts and the Supreme Court, Justice Kumar felt the AFSPA didn’t fall under these two crucial criteria under which the Act could be challenged before the courts. “The NHRC may not be able to tell the legislature to repeal this act. A writ of certiorari cannot be issued to the legislature. Legislatures have their own privileges,” he added. Moreover, he said that the Commission cannot summon the records of the legislature as the judiciary has to function within its own boundary. “State legislature or union legislature has to act within its own limitation. One cannot interfere. They are free to frame law but judiciary can strike it down on the ground that it violates the basic structure or the legislature was not competent with its impinging upon the

Justice Kumar, however said the NHRC would take action if any human rights are violated while implementing the Act. “NHRC has taken suo motu notice also, like in Nagaland where the civilians have been killed recently. We take notice. It is not that we turn a blind eye to the glaring cases where excesses are committed. Whenever cases of these nature come before the commission the NHRC come heavily on the authorities we do not spare them,” the NHRC member said. “If any excesses are committed under the AFSPA it may be brought before the notice of the commission. KOHIMA, DEC 15 (NPN): Naga Students' Federation (NSF) Wednesday announced plans to hold a mega rally in Kohima on December 17, 2021 to demand the repeal of Armed Forces (Special Powers) Act (AFSPA), 1958, from Naga inhabited areas. The rally would begin
at Old MLA hostel junction, Kohima at 11 a.m. and after a short programme, the rallyists would proceed to Raj Bhavan and plans to submit a memorandum to the president and prime minister through the governor. Announcing this during a press conference at hotel Japfü here, NSF president Kegwayhun Tep said the
rally was being organised to confront the issues that were affecting the Nagas. He said the federation was expecting Kohimabased civil society organisations, unions and the general population to take part in the rally. He said NSF would continue to fight till AFSPA was repealed. (Cont’d on p-8)
Cabinet clears bill on electoral reforms NEW DELHI, DEC 15 (AGENCIES): Union Cabinet on Wednesday approved a bill on electoral reforms, allowing linking of Aadhaar to voter ID cards– one of the key reforms pushed by the Election Commission of India (ECI). Those exercising their franchise for the first time will get as many as four turns to register in a year. At present, those turning 18 on or before January 1 of every year are only allowed to register as voters once. According to the bill, the electoral law will be made “gender-neutral” for service voters. Another provision of
the bill will allow new voters to enrol on four different dates every year. As of now, those turning 18 on or before January 1 of every year are only allowed to register as voters. EC had earlier written to the Centre pushing for several electoral reforms, including making paid news an offence and increasing the punishment for filing a false affidavit to two years of imprisonment. In June this year, ECI wrote to Law ministry requesting it to urgently take up these pending reforms, which also included allowing firsttime voters to have multiple registration attempts in a year.
Reports said that there were around 40 electoral proposals pending with the government. The new voting reforms come at a time when assembly polls are due in several states next year, including Uttar Pradesh and Punjab. ECI had in August 2019 proposed wide-ranging electoral reforms, which included remote voting for NRIs and migrant workers, and eliminating duplication of voters. Earlier this year, EC had started a research project for enabling remote voting in consultation with IIT Madras and eminent technologists from IITs and other leading institutions. K Y M C
