Welcome to Officer By Daniel SAHYOUN BULAHDELAH Police have welcomed Senior Constable Ashley Ray to the area after taking up a position at the station last week. Senior Constable Ray has worked with the Police Force for the past decade with previous appointments in Liverpool, Bankstown and most recently in Tenterfield. Sn Constable Ray said his experience in both city and rural locations will serve him well for his work in the local area. “My experience has given me an all-rounded set of skills and I’m willing to take on any challenge,” he said. “I enjoy working in the Police Force because of the variety, and you get to be there for people when they need it.” Ashley recently moved to the area with his wife and three young children and said the town was a “hidden

treasure.” “This is a beautiful town and a great place to have a family,” Ashley told News Of The Area.

Meeting last week at the old Library in Hawks Nest, this intersection along with other road works, were discussed by the Hawks Nest Tea Gardens Progress Association. It was noted at the meeting that the Association’s plan for a temporary roundabout was submitted to Council some time ago but, to date, no response has been received. Councillor Len Roberts was present at the meeting and undertook the issue to pursue further, but admitted with the new merger restrictions, a successful outcome may be affected.

Speaking with News Of The Area, Mr Roberts said, “There have been some studies done by councils Traffic Committee, but the area and location doesn’t appear to warrant a roundabout.” “We’ve had to fight long and hard before just to have a safety refuge installed, also with the councils merger restrictions this may make the reality of this roundabout coming into fruition a harder project to get approved,” he said. News Of The Area contacted Ron Hartley from Mid Coast Council who stated, “The original Crighton’s plan for the development of this area included two large roundabouts to access the shops and residential area.” “This provided for roads substantially larger than the current

Seriously injured

A 77-year-old man was driving in a car park off Little Street, Forster when, as the he attempted to collect his 81-year-old wife, the vehicle accelerated, skidding on the gravel surface of the car park. The car struck the woman and carried her for several metres until it slowed where she fell onto a steel concrete drain. After emergency services were contacted, the woman was treated at the scene and conveyed to John Hunter Hospital, with serious head and arm injuries.

It is common practice in family law matters for a Subpoena to be issued to third parties seeking copies of their notes or personal documents. This creates a conflict between the rights of the third party to confidentiality of their information, and the rights of justice to the litigant. This issue was recently considered by the Full Court of the Family Court in circumstances where the husband to family law proceedings sought the production by the wife’s mother and brothers of details of the wife’s late father’s estate, including the will and list of assets and liabilities of the estate. The family argued that the Court could not guarantee that their private information would not be leaked into the public domain as a result of their compliance with the Subpoena.

family, the Court held the view that the law had developed, as best it could, various ways to protect a third party’s information (both under legislation and case law), and it would be a

very rare case in which documents relevant to proceedings would be entirely protected from production due to concerns about the effect of possible dissemination of the information. The family were required to produce the estate documents pursuant to the Subpoena. In practice, steps are regularly taken to impose safeguards to ensure that information of third parties remains protected, and used only for the proceedings, including restraints on copying information, restraints on who can view information, and if necessary, permission to redact documents produced. If you are issued with a Subpoena, and you are concerned about your privacy, obtain legal advice as to options available to you to object to the production of all, or some, of the documents requested or how appropriate safeguards may be put in place. Be aware, however, that the Subpoena is issued by the Court and cannot be ignored. If a Subpoena is not complied with, the Court has the power to issue a warrant for the arrest of the non-complying Subpoena recipient.

GREENS Candidate for Lyne Julie Lyford, visited Tea Gardens last Saturday taking the opportunity to meet with local residents at Myall Quays Market Day. Mrs Lyford said the local people were very warm and receptive and interested in what the Greens were standing for. Local residents discussed many issues with the Greens Candidate including the Council Amalgamation, Taxation, funding for Health and Education and Coal Seam Gas. Mrs Lyford said the National Disability Insurance Scheme and Small Business were also important topics discussed during the morning. “Small business is the backbone of the Australian economy and we need to look after them,” Mrs Lyford told News Of The Area. “We need to build sustainable, liveable communities with clean energy for climate, jobs and the economy,” she said. Sport clubs get grants SPORTING Clubs in the Myall Coast area will be able to upgrade facilities and purchase much needed equipment with almost $20,000 in funding allocated through the NSW Governments Local Sporting Grants program. Member for Port Stephens Kate Washington announced last week that Karuah Rugby League Football Club and Myall Coast Little Athletics Centre had been successful in their funding applications. Karuah Rugby League Club will take home $17,703 for the installation of seating, field fencing and improvements to the clubhouse at Lionel Morten Oval. Club Secretary/Treasurer Sonja Evans said club members were very happy to receive the funding which will be used to make much needed improvements. “The facilities desperately need a huge upgrade, everything needs fixing, from the gutters on the change rooms to the banks around the field that eroded away as a result of the storm last year,” she said. “The funding will allow us

to have more seating, upgrade the change rooms and toilets and the fencing will improve safety around the ground.” The Myall Coast Little Athletics Centre was also successful in their application securing $1,695 for the purchase of a storage container for equipment at the Myall Park Complex. Melisa Brown, Secretary of Myall Coast Little Athletics Centre said, “This grant means our local Little athletics Centre can keep our equipment up to date and kept in appropriate storage.” “One of our current containers is in disrepair, so the purchase of a new one will be immensely beneficial as we house a lot of equipment in Athletics.” Ms Brown told News Of The Area, “We are very thankful to the NSW Gov Local Sporting Grants for their assistance.” Other Port Stephens clubs to receive grants through funding program include Nelson Bay Netball Club and Raymond Terrace Athletics Centre. SMITHS LAKE - Patsys Flat Road: Drainage improvements were undertaken on a steep section of road to an easement between the upper and lower sections of Patsys Flat Road. The work involved the construction of a drainage line through the easement to convey any run-off through the easement. Work is complete. STROUD HILL ROAD: Heavy patching was undertaken about 10km from The Bucketts Way. Work is complete.

MIDCOAST Council, Midwaste and the NSW Environment Protection Authority (EPA) are working together to provide local residents with a free, safe and easy disposal method for any unwanted or out-of-date household chemicals. For residents in the Great Lakes region, the collection will be held on Friday 3 June from 1pm to 4pm at the Tuncurry Waste Management Centre located on Tip Road, Tuncurry. Residents in the Manning Valley will have their collection on Sunday 5 June from 9am to 12noon at the Bucketts Way Landfill, located at 6843 The Bucketts Way, Tinonee. This service is for

domestic quantities of household hazardous chemicals only, with the first 20kg/litres able to be disposed free of charge. Hazardous household chemicals eligible for this free collection include items such as pesticides, paint, garden chemicals (e.g. weed killers), solvents (e.g. paint stripper), household cleaners and chemicals (e.g. bleach and detergents), smoke detectors, fluorescent light globes and tubes, household batteries, old gas bottles, pharmaceuticals and fire extinguishers. Mr Alley said Labor announced a new policy each day of the tour with health funding the hot topic as the bus travelled through the Federal seat of Lyne. “The main focus today is on Medicare and tomorrow we will be making a major announcement on healthcare,” Mr Alley told News Of The Area. “We need a Government that will stand and defend Medicare and one who will ensure that bulk-billing will continue for pathology and diagnostic services, and only a Labor Government will ensure that,” he said. Health and Education are campaign priorities for Mr Alley who said Labor is committed to “implementing the Gonski School funding reforms in full for the entire six years.” Mr Alley boarded the bus to tour the Lyne Electorate with Mr Shorten and Labor Senators hopping on and off at various stages throughout the journey. No road trip would be complete without taking a couple of ‘selfies’ along the way with Mr Alley snapping himself with local supporters inside the campaign bus. Peter Alley returned to Tea Gardens last Saturday taking the opportunity to speak with local residents at the Myall Quays Market Day. Mr Alley said he would be continuing his regular visits to the area in the coming weeks.

THE inevitable happened. The 3 way merger between Great Lakes Gloucester and Taree Councils was proclaimed at 12.30pm on Thursday 11 May. The proclamation in merging the 3 councils into the newly constituted Mid Coast Council (MCC) dissolved the former councils which meant all existing councillors no longer had roles as councillors. John was the long serving former Member for Myall Lakes and has great knowledge of the 3 shires as well as the Local Government Act. Glenn was the General Manager of the former Great

lakes and is universally acknowledged as one of the top General Managers in NSW. I congratulate them both on their well-deserved appointment. Whilst the Administrator assumes the responsibility of the mayors and councilors in the new entity, the proclamation also included the formation of a Local Representation Committee (LRC) to advise the Administrator. The LRC will comprise some of the former councilors that served on the previous councils. They will provide advice to the administrator and input to operational plans, community engagement, vision and priorities. It will operate similarly to a council. All former councilors last week were asked by the Administrator to apply to be on the LRC. The Administrator will determine who is on the LRC. It is generally expected that the number on the committee will be the same as the number of the councilors to be elected at the next election. In our case that number is likely to be 11. [I have waited many, many years to be asked to join the MCC. I hope we get blazers and ties as I only wore tourist gear the last time I was at Lords.]

There will also be formed an Implementation Advisory Group (IAG) with at least 2 from each former council. The Minister for Local Government Paul Toole stated, “The Implementation Advisory Group will play a key role in making the new council a success by bringing together expertise from the former councils to advise the administrator on how best to bring the council systems and staff together.” We should know within a week or so who has been appointed to the committees. I want to thank all those who contributed to the delegates hearing through oral and written submissions regarding the merger. I still find it amazing that most of the Gloucester councillors still don’t understand why the merge happened. They still held an antimerge meeting last week after the merge. Their minutes clearly show that they initiated the proposal. Go figure?

Control Unit meeting on Thursday 12 May, however the meeting was cancelled as a result of the announcement of the Council merger. The DA for the television tower is now expected to be discussed at the Mid Coast

Council meeting this week. Council have told News Of The Area, “Our Administrator John Turner will determine the application at the next Council meeting. The recommendation is still for approval.”

Bulahdelah Cricket Pitch

My last piece of good news I received as a councillor was that council was successful in obtaining a grant to reconstruct the synthetic cricket pitch at Bulahdelah which was damaged by a mower last year. Let’s hope that the pitch and practice nets are replaced soon.

The renovations to Myall Pharmacy - Tea Gardens will be starting on Monday 30th May 2016. The pharmacy will need to close for a period, while the electrical, plumbing and relocation of the dispensary are completed.

Dredge will start Corrie

MIDCOAST Council are dredging the Corrie navigation channel in the lower Myall River at Tea Gardens, to improve navigation and public safety. “The works will remove approximately 21,000 cubic metres of sand which is to be pumped to the current Winda Woppa sand stockpile site. From there it will be used for the future renourishment of Jimmys Beach and a section of eroding shoreline to the west of Barnes Rock,” said Council’s Assistant Environmental Officer (Great Lakes), Peter Goonan. The Corrie Channel is situated where the Lower Myall River meets the Port Stephens Estuary on the north-western side of Corrie Island. The dredge site itself is located approximately 2km from Tea Gardens. “The Corrie Channel is the designated (NSW Roads and Maritime Services) navigation route between Port Stephens and the Myall River and links Nelson Bay and the port of Tea Gardens,”

The total project cost is $450,000 said Mr Goonan. Corrie Channel also provides access to the Myall Lakes which during peak periods have a high level of recreational boating activity, particularly of cruisertype vessels. A bathymetric survey carried out in March 2016 indicates that the channel has in-filled some 21,000m³ since the previous 2010 dredging campaign. “The sand build-up q within the channel is now restricting access for larger vessels. Dredging of the channel is required to maintain navigation and ensure public safety and access between Port Stephens/ Tea Gardens,” said Mr Goonan. The former Great Lakes Council engaged Neumann Contractors to undertake the

WATERWAY: Corrie Island Channel at Winda Woppa. dredging works which will create a channel 20 metres wide and over 300 metres in length to a depth of 3.5 metres. Neumann’s began transporting plant equipment to the site this week. Establishment of the dredge pipeline and

dredge set-up is expected to take two weeks with actual dredging work to commence towards the end of May. The contractors will ensure that minimal disruption to navigation is maintained throughout the dredging works. Council’s Manager

of Natural Systems (Great Lakes), Mr Gerard Tuckerman said, “Council is pleased to deliver this important project for the community that will ensure safe navigation for recreational and commercial users of the Myall River and Port Stephens.”

The project has been made possible through Council’s Environmental and Dredging Levy and matching grant funding provided under phase three of the NSW Government’s Rescuing our Waterways Program. The total project cost is $450,000.

I AM not impressed by this forced mergers. Yes Handford has done a good job in the great lakes area and as said before a merger was on the cards. What gets me, is the total lack of respect for a democratic process and the urgency to push the merger through just before the elections no matter what. It was a done deal and Handford knew it as he had already applied for the job. It really leaves me with a bitter taste of it all and I have no respect, due to the consultation process. It was a joke.

ALL very well, but no commonsense from our State Government. Why an administrator who is a retired National Party pollie with no real experience at Council management level? Also the latest development - the summary dismissal last Friday of Ron Posselt from his position as assistant GM representing the now sacked GTCC council - leaves all residents in the former GTCC council area without any real voice in the administration of the new Mid Coast Council.

Hollows as homes program

ARE you a keen nature observer? Looking for a cool project for the kids to expand their observation and science skills? MidCoast Council is asking you to help provide NSW scientists with data from your observations as part of the “Hollows as Homes” program. “The University of Sydney, the Royal Botanic Garden and the Australian Museum are driving the community based program ‘Hollows as Homes’, recruiting people to take note of tree hollows that they see in their backyard, properties, bushland, golf courses - or anywhere” said Council’s Senior Ecologist (Great Lakes), Mr Mat Bell. “In NSW at least 46 mammals, 81 birds, 31 reptiles and 16 frogs use tree hollows as habitat.

Of these, 40 species are listed as threatened with extinction, so it’s important we try to find out more about the animals we have in our area and identify locations of hollows,” said Mr Bell. Hollows as Homes aims to increase the knowledge and understanding that we have about tree hollows; the distribution of tree hollows, the types of hollows available and how wildlife use tree hollows, including artificial hollows or nest boxes. Participants in Hollows as Homes will be providing valuable information on the number and distribution of hollows, distribution of different types of hollows and wildlife that is using the hollows and nest boxes. “Some of this information is still largely

unknown, for example the number of hollow-bearing trees that exist in people’s backyards and the existence of wildlife using trees in backyards,” said Mr Bell. The information collected will be used to add to the scientific literature, while councils will be better able to plan our suburbs and retain existing habitat that is important for wildlife. “And we will become better informed about the importance of tree hollows and understand exactly what is using our own backyard,” said Mr Bell. Club Major great game BOWLS Tea Gardens Men’s Bowls By The JAFFA

JUST for a change, Wednesday 18 May Nominated Triples was played today in cloudy, and cold conditions with no wind. Fifty-four bowlers participated with both greens in use. Apart from the change in the weather, there was another change. The team of; Henk Faber, Col Amos and David Rimmer did not win. Mind you they had a good score of +29 but they were beaten by; Graeme Watkins, Barry Drayton and Ron Webster who recorded a +32 and they were also beaten by a team of visitors;

Neil Moroney, Leon Pradiness and Roy Lewis who recorded a + 31. 20 May: Friday Jackpot Pairs was played today for a purse of $280.00. Only 12 bowlers turned up to contest the money. Very disappointing! Well obviously it’s not the money keeping players away. I’m sure the Match Committee would like to know the reason numbers are down each Friday. Pst! You can tell me! For the benefit of those players who were not afraid to turn-up. Bruce Everitt and Bob Weir won the money on a great score of +13. Bill Moon and Stewart Sturrock claimed second with +11. The jackpot was not won and will total $300.00 next week. You have to be in it to win it gentlemen!

21 May: The much awaited semifinals of the Club Major Pairs was played today with the team of Sean Mearrick and Richard Lee taking on Daryl Martin and Ron James and the team of Merv Mills and Ross Barry competing against Jeff Baker and Steve Pell. Sean and Richard opened up an early lead in their game and were never headed proving to be much too consistent. They clinched a place in the final with an impressive 23-7 victory. By way of contrast the other game was in doubt right up to the 21st end. Ross Barry and Merv Mills played way beyond themselves against their more fancied opponents. They were never out of the game and with only 4 ends to play, they had established a 6 shot lead leading 19-13 at the 17th end. The turning point came at the 18th and 19th ends when Jeff and Steve claimed a two and a four to see the scores locked at 19-19 with two ends to play. It was game on! Jeff and Steve snaffled a one the 20th to see them going into the lead with one end to play. Jeff Baker played two delightful opening bowls to claim the jack and with Steve they added to the pot at each change. Ross and Merv just could not manage a conversion and the game was over. The final score 25-19 to Jeff and Steve. Commiserations to Ross and Merv. THE Tea Gardens Hawks were defeated 36 points to 26 by the Cardiff Cobras on Sunday. Playing catch up football all game, the Hawks started a revival at 24 – 6 half time mark. Three quick tries got them back into the game trailing 28 to 24 with 7 minutes to go.

Committed Cobras defence prevailed, before they scored with a minute to go. For the Hawks, Jake Geraghty scored two tries, with Brooke Roach, Allen Fepuleai, and Itch Baker crossing for one each. Billy Greentree kicked 3 goals from 5 attempts. Best in defence was Luke Handsaker. Jake Geraghty was awarded best in attack. Billy Greentree won the Supporters vote, and the Referees Best and fairest points.

a final! Steve and Jeff were fast away and 5 ends had been played before Sean and Richard opened their account on the 6th end. At that stage Steve and Jeff had a handy 9-2 lead. They managed to consolidate this over the next 4 ends breaking away and to lead 15-3 at the 10th. I wonder how many spectators thought that with a 12 shot lead it would be game over. Not so. As is the case in many games of bowls there just about always two parts to any contest. Sean and Richard then proceeded to make a comeback and won 7 of the next 8 ends, tying the score at 16-16 at the 18th. Game on! With the momentum swinging their way, Sean and Richard were now a real chance of snatching victory from the jaws of defeat. Jeff and Steve still had some gas left in the tank though and they filched two singles at the 19th and 20th ends to have a two shot lead with one end to play. They managed a 3 on the last end to confirm their victory. A brilliant game of bowls with the game itself the clear winner. Congratulations to all the players and especially Jeff Baker and Steve Pell, Tea Gardens Bowling Club Major Pairs Champions for 2016. Many thanks to Umpire John Younghusband. The Stockton Travelling Bowlers joined with the Sunday Introduction to Bowls players today. It was good to see around 9 rinks in use with the grass green full and two games accommodated on the synthetic. I’m not sure who the winners were but with wonderful weather and great company, I know there will be about 54 players who had will be back for more.

however were forced to defend for most of the second Half. Muswellbrook took the lead by 26 points to 20 with minutes to go. Myall River scored under the post as the bell ran, to survive with a draw. Next week, the 15’s travel to singleton, the 13’s to Cessnock, and the 8’s to Newcastle Wests. The 11’s are at home to Cardiff.

THE Myall Coast Mudcrabs had a narrow loss 17 points to 12 to Manning River Ratz in round 5 of the lower mid north coast competition. This result gained The Mudcrabs one point as they finished less that 5 points behind Manning in a game that either team could have won. The Mudcrabs had a wealth of possession in the early part of the first half but failed to put any points on the board which cost them dearly as Manning capitalised on the little ball they had to score the first try from long range. Mudcrabs however hit back before half time with a solid try to Zac Weir which was not converted.The half time

   

Manning had the last say with a further try to bring the score to 17-12. The backs worked hard in both attack and defence led by Pat Laver, Jackson Page and Tristan Tansy who was rewarded with the 3 points for his game. Review of Environmental Factors Mungo Brush Road Relocation A Review of Environmental Factors (REF) has been prepared on behalf of NSW National Parks and Wildlife Service (NPWS) to address the environmental, social, economic and cultural impacts of the proposed relocation of a 3.2km section of Mungo Brush Road in Myall Lakes National Park. Mungo Brush Road is the main vehicle access into the southern area of the park, via Hawks Nest, and is expected to be impacted by the Dark Point sand dunes within two years. Realignment of the road is the preferred option for maintaining vehicle access into this area of the park. Teams from Tea Gardens, Karuah and BOWLS Bulahdelah

By Daniel SAHYOUN THE Princess of the Myall Bowls Competition was held last week in perfect weather conditions at Bulahdelah Bowling Club. The bowling greens were a hype of activity with 20 teams coming together for a day of friendship with a continuous wave of laughter present around the greens. Eight teams took part in the competition representing Tea Gardens, Karuah and Bulahdelah from the Myall Coast area and Harrington, Forster, Taree and Toronto from further afield. A sea of colourful uniforms

and bowls dominated the greens as the teams battled it out during the 30 end match. The title of Princess of the Myall was won by B. Dever, O. Daly and B. McCaig representing the Taree and Forster/Tuncurry Sports Clubs. In a close finish, R. McDonnell, T. Hartman and K. Mudford from Forster/ Tuncurry Sports Club were named runners-up. Third place was claimed by J. Gibson, F. McBlane and B. Mizon. The competition ran smoothly with the assistance of umpires George Jones and Rob Taylor and scorers Ken
