Development site believed to be an IGA By Dave BRAZIER AFTER many months of speculation and following the demolition of the old shops on the corner of Tuloa Avenue and Booner St Hawks Nest, contractors have been busy over the last week or so preparing for the construction of the new shopping precinct. The area which is next to Hawks Nest Sports Store, had been cleared earlier in the year with residents wishing for a new supermarket store to be constructed to allow more localised shopping of groceries for

the immediate residents to save them the drive to Myall Quays Shopping Centre at Tea Gardens. A development application for a supermarket, delicatessen or café, and office space was lodged to Great Lakes Council and approval given in August of this year. Speaking with Myall Coast News, contractors from Myall Plumbing Service believe the Supermarket will be an IGA Franchise and it’s anticipated opening will be mid year 2016 depending on the weather.

q ALONE BUT TOGETHER: Great Lakes Cr Jim Morwitch, Mayor Jan McWilliams, Deputy Mayor Len Roberts and General Manager Glenn Handford were jubilant at the decision that Great Lakes Council will continue to stand alone.

The Great Lakes AN early Christmas present for the Great Lakes

Council (GLC) has been very welcomed by staff,

management and councillors last week. An announcement from the NSW Government has stated GLC will be allowed to continue to stand-alone

in order to best deliver local government services to the Great Lakes region into the future.

THE Bulahdelah Playgroup held a Christmas Party for its young members on 17 December where gingerbread was eaten, presents were shared and music was played. This year the Bulahdelah Playgroup has had a regular

gathering of approximately twelve children and their mums in the Bulahdelah Uniting Church Hall. It has been a relaxed atmosphere where the toddlers and babies can have the opportunity to do outside play or inside play with a range of toys and to do crafts.

The mums attend playgroup to socialise and interact with the children. The recent Christmas Party was a celebration to end a fun year and each child received a book as their Christmas gift. The Playgroup have accommodated children from 1 week old to 5 years of age.

AT about 9pm Thursday 17 December 2015, police were called to a Tea Gardens licenced bar, where eight males who were staying in the attached accommodation were refused service. The males who are employed at a concreting firm and working on building blocks in the Tea Gardens Palms Lakes Resort were residing at the motel for the week. Senior constable Dave Coyle told Myall Coast News it is believed the males, who were well intoxicated, had not been drinking on site but instead in their rooms when they have then gone to the Tea Gardens Public

Wharf. “Three of the group have stripped naked and jumped into the river.” “Upon leaving the river they have redressed and entered the hotel where they have been refused service.” “At this point the group have become extremely aggressive and abusive with a male member of staff being threatened with serious assault.” Police attended and spoke with the men. All denied any wrong doing despite CCTV to the contrary. The men were to be dealt with for wilful and obscene exposure, offensive language, failure to quit a

licenced premise and intimidation and assault of staff members. It is to be noted the hotel and staff did everything asked of them. It is a timely reminder yet again coming up to the holiday period, that this type of behaviour will not be tolerated by staff in any licenced premise in the Tea Gardens / Hawks Nest area or police. Any one who finds themselves removed or barred from one licenced premise will find themselves barred from all. “At the very minimum if you fail to leave when asked you will be infringed $550,” said Officer Coyle.

What is Probate and is it needed when I die?

By Lana Black

In order for Probate to be granted, the executor named in the Will of a deceased person must apply to the Supreme Court on NSW. This application requires the executor to prove a number of things including that the deceased person is deceased, the Will is the last will of the deceased person and the executor is the executor named in the Will. The executor Appointments Fridays 2pm-6pm must also provide additional 191 Myall Street details such as details of the Tea Gardens beneficiaries of the Estate and the www.mullanelindsay.com.au assets of the Estate.

of its neighbours,” he said. “We now accept that this is not the case and we are focused on where to from here.” Mr McIntosh said that the Port Stephens Council looks forward to the challenge this change also presents and we are up for it. “We know we have the great staff, the runs on the board, and any opportunity to contribute positively to the improved delivery of local government services in the region we welcome,” he said. Mr McIntosh said, “I appreciate this is an uncertain time. But can I assure you of one thing – Port Stephens Council as it stands today will continue to ensure we are doing our very best to deliver for the people of Port Stephens.”

02 4928 7300

The process of applying for Probate can be quite complex and requires careful consideration of the law and its application to the Will of the deceased person.

Probate will be required in any deceased estate where there is real estate which is an asset of the Estate. It will also usually be required where any individual asset of the Estate (for example a bank account) has a value of approximately $15,000 or more. Without a grant of Probate, the executor will not have the power to administer the Estate and the assets of the Estate will not be released.

A CHANCE conversation between a Lions Club member and a member of the public has revealed that not every member of the Tea Gardens community will be able to celebrate Christmas in the same manner that most of us will. As a result of this conversation the Tea Gardens Lions Club approved the donation of two Christmas Hampers to be passed on to two families in the Tea Gardens/Hawks Nest area. Doug Allen from Tea Gardens Lions Club said, “The St Vincent de Paul Society was contacted and were requested to identify two families who were in need of assistance.” “Two hampers containing hams, Christmas Cakes, puddings and other festive fare were prepared and handed over to Kevin Maher, President of the St Vincent de Paul Society for delivery on Wednesday,” Mr Allen told Myall Coast News.

North Arm Update

By Cr Len ROBERTS

q

THE various social and user groups of North Arm Cove have come together to produce a guiding plan for a community hub around the community hall. The plan not only sets out the existing facilities but outlines future possibilities including a village green. The need for the plan arose out of the hall being identified by council and the Rural Fire Service (RFS) as a refuge of last resort for bushfires and other emergencies. In identifying the requirements for a refuge it was discovered that some the user groups were developing their requirements without consultation with other groups. They would obtain grant funding for a particular project only to find that where they proposed to locate, it would interfere with operations of other groups. For instance, it is a requirement for a safety refuge that water tanks for firefighting are needed. However, tanks are pointless if they cannot be accessed by the fire trucks

Donating funds back into the community By Max BISMIRE THE Parish Council of St Andrew’s Anglican Church decided that the proceeds of their Stall at the River Festival

and the Toy Fayre at the Op Shop should be distributed within the community. As a result we had $3,000 to give away and the recipients were the Hawks Nest Surf Life Saving Club, Hawks Nest

Pre-School, and the fund created to support Nurse Karen and family from the Medical Centre. Cheques were presented at a Service on 13 December by Rector’s Warden, Ross Weightman.

if say picnic tables are in the way. In some way this is a similar problem council faces from time to time when community groups source funding for a well needed project without reference to council. Council is obligated to set out its community plan well in advance and has not budgeted for or consulted with the community about an unexpected project. A classic example has been the community funding of a swimming pool. No one questions the need, it is a worthwhile project. The community receives source funding through private and federal grants to build it, but council suddenly has to adjust its budget and approved community plan to cater for substantial, unexpected, ongoing maintenance costs. This means that another well needed project that has been given high priority in the community plan may miss out. Council greatly appreciates the forward planning and cooperation by the user groups at North Arm Cove. It really is an efficient and strategic approach.

FORSTER: Alex Gourley, Stephen Bromhead and Jan Milles.

Public dialysis unit available PUBLIC dialysis patients living in Great Lakes can now receive life-saving treatment closer to home, with the opening of a new dialysis unit at Forster Private Hospital. Member for Myall Lakes Stephen Bromhead said Hunter New England Health is now operating six chairs from the new custom-built renal unit. “I congratulate HNE Health, Pulse Health, who

operates Forster Private Hospital and the owner of the facility, Cape Hawke Community Hospital and Health Association, for working together to open public dialysis chairs in Forster,” Mr Bromhead said. “Dialysis is a lifeline for people with renal disease but the treatment alone can be exhausting. This new service is life-changing for the patients who were travelling three times per week for

treatment and their families. “By eliminating the burden of travel for those patients in the Forster area, I hope the burden of dialysis treatment will be just that little bit easier.” Mr Bromhead said that Hunter New England Health is planning to extend the service in 2016, including private renal patients. “The expansion of services will depend on having more appropriately trained renal nurses available to take on these additional patients.” Hunter New England Health chief executive Michael DiRienzo said it is an exciting time for renal patients. “Six Forster-based patients receiving dialysis treatment in Taree may now receive their treatment much closer to home,” Mr DiRienzo said. The new ground-floor unit at Forster Private Hospital is spacious and easy to access. It has been fitted out with all new equipment, including new chairs and personal televisions. The new unit also features an isolation room, for use by patients who may be prone to infections. Cape Hawke Community Hospital and Health Association chairman Roger Lynch said the Association will provide the purpose-built space rent free for the dialysis service, to be run by HNE Health. “All three groups have worked hard to reach an arrangement that ensures our local public patients get the services they need close to home, I am pleased that we are able to offer this service here,” Mr Lynch said.

and after the blaze. Police believe the fire to be deliberately lit. Any who has any information of the 2 4WD’s are encouraged to contact Tea Gardens Police on 49970244

A second vehicle was destroyed by fire about an hour later. The vehicle was abandoned on Gorrengi Road at Bulga Creek for a number of days being set alight. Police suspect both incidents are connected.

Smiths Lake concern GREAT Lakes Council and Marine Park officers need your help this summer to prevent illegal driving of vehicles on the delicate exposed bed of Smiths Lake by reporting any illegal acts you observe. Smiths Lake is an “Intermittently Closed and Open Coastal Lagoon” (ICOLL) and was opened to the ocean in September this year. The Lake is part of the Port Stephens - Great Lakes Marine Park and is valued highly by our local community and visitors for its high ecological value. “After the Lake is opened significant areas of the lake bed are exposed, particularly in Wamwarra Bay and near the Lake opening at Symes Bay. Unfortunately these areas and other foreshore areas are being heavily impacted by cars driving on the lake bed,” said Council’s Manager of Natural Systems, Mr Gerard Tuckerman.

“The impact of cars driving on the foreshore on the Marine Park has long term impacts on fish and macroinvertebrate habitat. Of concern to us is that saltmarsh communities are being destroyed and these are endangered ecological communities in NSW,” said Mr Tuckerman It is a serious offence to drive on the Lake and people will be up for significant fines up to $22,000 as they are in breach of numerous pieces of legislation. Infringement notices of $500 can also be issued under the Fisheries Management Act and Marine Estate Management Act. If you see people undertaking this prohibited activity please assist Council and Marine Parks with this campaign by collecting details of the offence, timing, number plate and location and call Council rangers on (02) 6591 7222.

Council’s Library Manager, Mr Chris Jones. “But we knew that we needed to come up with something different so that people who were simply too far away could still become literacy tutors. The last thing we wanted was for this to be seen as Forster-centric.” Seeing this as a challenge rather than a barrier, and having no other examples to draw from, the Library and North Coast TAFE developed a unique solution – an online training course for literacy tutors. The launch of this course, combined with an orientation morning, was held on Thursday 3 December for 14 volunteer tutors at Tea Gardens Library. On completion of the course these volunteers will have the skills to enable them to assist the community with improving their reading. Donna Guiver of Mid North Coast TAFE provided support material and a general overview of the program to the eager tutors. “It is anticipated that the tutors will become available to the community q NEW LITERACY TUTORS: (Front) Ann Scully, Wilma Drake, Florence Beatty, Cheryl Jensen, Jan Peters, Chris Shelly and (Back) Donna Guiver, by mid-February 2016,” said Mr Geoff Scully, Di Vercoe, Sue Ghobrial, Ros Jones, Gloria Ballard, Carol Johnson, Judy Quarrell, Jenelle Bailey and Gina Houghton. By Dave BRAZIER ALL year round members from the Tea Gardens – Hawks Nest Mens Shed have been building and repairing many items for the community and some local businesses, and Christmas time is no different. Recognising the Ice Cream Shack at Tea Gardens as a contributor to the community, and upon hearing of a wish to give the signage outside a little bit of a facelift, TGHNMS member Victor Logie thought he could add something specialised to the exterior and help attract potential clientele. Victor designed and made ‘timber spirals’ out of an idea that just popped into his head one day. Speaking with Myall Coast News, Victor said, “There are 40 individual pieces of timber in each spiral. It took me a while to get my head around

what I wanted to make and how I was going to make it.” Also benefiting from the TGMS Members, the pathway outside the shops in Hawks Nest have been given an uplifting make-over with the installation of several plant boxes and plant box. Men’s Shed member John Sells said, “We were commissioned by the local Progress Association to construct these planter boxes and seats. They’ve taken about 100 man hours to build from mostly recycled timber.” Seven community groups have worked together so the Tuloa Avenue shops in Hawks Nest would be more interesting. The Holiday Coast Credit Union grant became available for the HN/TG Progress Association to install the planter boxes and plants. Leigh Allen from the

Progress Association said, “The shop owner, John Cameron, wanted to do something along this line so a combine application was made to, Council.” “After discussions with the shop keepers and sorting out the best placements for the boxes, Tea Gardens/Hawks Nest Men’s Shed constructed and installed the planter boxes,” said Ms Allen. “Jenny Woodward also provided and planted hybrid plants of locally found natives,” said Ms Allen. Member for Port Stephens Kate Washington MP was also spotted enjoying the seats and planter boxes recently, telling Myall Coast News, “These are just fantastic, the Tea Gardens Mens Shed members provide excellent services like these all the time, and they should be applauded for their time and skills.”

Right of way is not practical

Dear News Of The Area,

HOPE everything is going well for you and your family!! Besides all my normal monthly reports (which I’m sure are a little tedious to read at times) I decided to send you all and all the Myall Coast News readers a wonderful and joyous Christmas. Below is a photo from Poland Rotary which I will translate for you in a minute. Hopefully we will have a white Christmas here as the temps are hovering around 0-4 normally (The forecast for Christmas Day is a lovely -2 (yes that’s minus two) to a high of 4 and showers - at the moment). Anyway the message below is (rough translate without google) “Polish Rotarians wish a beautiful and magical Christmas and may all your dreams come true in q SANTA’S KNEE: Kaz Qvr ordering her prezzies from Santa. 2016”. So to you, your family and everyone a Merry Christmas, a safe New Year and greetings from Poland. thoroughly enjoy bringing you the local news each and every week. We hope you have a wonderful day tomorrow with loved ones. Take care. From all the TEAM at Myall Coast News Of The Area (the NOTA)

I HAVE a place in the amazing place of Hawks Nest and have been coming here for many years, soon to live permanently. Every time I drive in off the Singing Bridge and stop at the end of Kingfisher Ave, I can’t help but wonder why we don’t have the right of way. I think that given there is less traffic coming south from Mungo Brush there should be a better solution. Either a round about or a give way sign for the cars coming from Mungo Brush should make the traffic flow better given the number of cars that turn into And out of Hawks Nest. Surely many others have thought the same thing? Frank Carabetta Hawks Nest
