New location and higher level for Tackle shop

By Ann SCULLY PAUL Viera, owner of Marlin Marine and Tackle has been leasing premises in Tea Gardens but when the hardware store building became available, Paul decided to take his business venture to a higher level.

The new venue at 201 Myall Street, Tea Gardens, offers more space allowing additional stock to be displayed to suit the local market thus attracting locals to shop locally and keep the money flowing throughout our communities.

Myall Coast News spoke with Paul who said, “This is an opportunity to take my business to the next level of growth and I believe that I will have the support from the locals.”

Some of the many products available for sale at the new store include fishing tackle, bait, sporting equipment, wet weather gear, a brand new supplier for trailer parts and

accessories, marine chandlery as well as automotive equipment, camping gear and life jackets.

Michelle Carter who works at Marlin Marine and Tackle told Myall Coast News, “This is an exciting time for us as we are now in a great location with a view of the Myall River from our front door and now the visitors to our area from the ferry will be able to see us and call in to see our new store.”

Whilst the store has been open for trading all this week, the Grand Opening will be held on Saturday, 20 December 2014.

Baumann withdraws LAST week Craig Baumann decided to withdraw from his position as the Liberal candidate for Port Stephens for the upcoming 2015 State election.

Mr Baumann said that with the ICAC [Independent Commission Against Corruption] having announced it is deferring the final report on Operation Spicer until after

a High Court challenge in the Crown Prosecutor Margaret Cunneen affair, withdrawing is for the good of the current Government.

“It would be unusual for the High

Court challenge to occur before the election and I do not want the Premier to be in a position where he has to leave the future of Port Stephens in limbo,” Mr Baumann

said.

To Warsaw for a 2015 gap year THE Rotary Club of Myall Coast is sponsoring their first overseas Rotary Youth Exchange Program (YEP) student.

Cordel Murphy from the Bulahdelah Central School is off to Warsaw in Poland for a 12 month Rotary exchange.

Having just completed his HSC, Cordel is taking a gap-year before starting university in 2016 where he will study for a diploma in computer sciences.

The Rotary YEP is a worldwide international exchange and students have the opportunity to spend 12 months living in a foreign country and being hosted by Rotarian families from those countries.

The exchange is on an educational basis and the visiting students will be attending an educational institution during their stay.

Cordel has attended several Rotary Youth programs over the last year and this will be a continuation of a very happy

association with the local Rotary Club.

Departing in the middle of next January, he will travel via the UK to Warsaw to be met by his first host family.

During the year, he will have the opportunity to join several tours with fellow Exchange students and to experience many European countries.

He will also be learning the local language as a bonus to his year away.

Not having travelled out of Australia before, Cordel is full of enthusiasm and looking forward to the experience of a lifetime.

Students make lifelong friends on their exchange and contribute to the Rotary ethos of World Peace and Friendship.

There are many varied Rotary Youth Programs that do not necessarily involve overseas travel.

The Federal Court recently heard a claim by the ACCC, against Coles Supermarkets relating to particular phrases used by Coles to advertise bread. The phrases included words such as “baked today, sold today” w Buying & Selling Properties and “freshly baked in store”. The w Wills & Estate Planning evidence showed that at least some w Powers of Attorney & Guardianship of the bread advertised in this way was substantially prepared off site w Criminal Law w Family Law & Defacto Relations and was essentially re-heated on site.

The ACCC alleged Coles had engaged w Employment Law in misleading or deceptive conduct w Dispute Resolution & in breach of the Australian Consumer Law. The Court agreed.

The judgment is very detailed and cannot be adequately summarised in an article like this. However, one thing that emerges from the judgment is that whether or not a phrase or representation is misleading, will often be determined by the context in which it is made, and an assessment Appointments Fridays 2pm-6pm of what constitutes the ‘dominant message’ of the phrase. Whilst Coles has a dominant position in the grocery market, the principles considered in the case are equally applicable to smaller businesses. The decision shows that when advertising goods for sale, merchants need to consider both the context in which advertising representations are made, and also what a reasonable consumer might think was the ‘dominant purpose’ of the representations. A failure to take these matters into account might possibly lead to a claim that the merchant has breached the Australian Consumer law: ACCC v Coles Supermarkets Australia Pty Ltd [2014] FCA 634

The Poll Race is on for Port Stephens perhaps Ken Jordan, a popular Port Stephens councillor may look to run in the state election.

Myall Coast News even heard that Port Stephens mayor Bruce Mackenzie has been discussing his thoughts.

No formal announcements have yet been made at the time of publishing.

Kate Washington, Labor Candidate for Port Stephens, was not surprised by Mr Baumanns announcement releasing a statement within hours of the Baumann announcement.

Ms Washington believes the communities do not want a Liberal government.

This being the case or not, it may have been far more ideal for Washington to run against Baumann, given all the ICAC ‘goings-on’, than for her to now compete against a fresh face/s.

Ms Washington said that it doesn’t matter who the Liberals put up as a candidate.

“Since Craig Baumann gave evidence at ICAC, I’ve spoken with many people in my community upset and disappointed by the activities disclosed,” said Ms Washington.

“The next Liberal candidate will just be another in the line who will put developer interests before the interests of our community,” she said.

By Angela HUTCHINS THE Newcastle Herald awards ceremony recently held at Hunter Stadium, brought over 90 hunter schools together to celebrate and congratulate a new generation of budding journalists.

But it was Stroud School that won two top awards.

The Primary School took out Best Overall entry and Best News story.

The Best News story included a National exclusive on Australia’s biggest unsolved civil aviation disaster.

The prestigious Best Overall Award won saw Stroud school receive a cheque for $2000.

Congratulations to Thomas Dew, Peter Raine, Alyssa Mudryk, Amy Klein, Sara Mudryk, Amity Carter and Emma Field.

The students volunteered their time to participate in the newspaper competition, proving that effort and hard

work does reap rewards.

The students and staff also wished to thank Tess Hilleard for her expertise and professionalism in guiding the students throughout the project.

When asked about the outcome Tess said she was thrilled, “Projects like this give kids a sense of what’s possible in the future, and who knows where it can take them.”

Tess and the kids would also like to thank Margaret Lang, Anne Frost, Margaret Francis, John Bowen, Melissa Bonney and Kevin Hutchins for sharing their stories with the wider community.

Thanks must also go to the teachers and Principal at Stroud Public School for making extra curricular activities such as this available to the students.

Stroud Principal Carolyn Bowman said she was extremely proud of the children and what they had achieved.

q COUNCIL RECOGNISED: Member for Myall Lakes, Mr Stephen Bromhead congratulates Mayor Cr Jan McWilliams, Council’s Community Services Coordinator Ms Lyndie Hepple and General Manager Mr Glenn Handford on the achievement of becoming a member of the WHO Global Network of Age-friendly Cities and Communities.

GREAT Lakes Council is now a member of the World Health Organisation’s (WHO) Global Network of Age-friendly Cities and Communities. Great Lakes is the second council in NSW to obtain membership and the ninth in Australia, with only 210 members worldwide.

The Network was established to foster the exchange of experience and mutual learning on age-friendly community development worldwide.

Cities and communities in the Network are of different sizes and are located in different parts of the world. Their efforts to become more age-friendly take place within very diverse cultural and socio-economic contexts.

What all members of the Network do have in common is the desire and commitment to promote healthy and active ageing and a good quality of life for their older residents.

“Council recognised some time ago that we need to plan for an ageing population and in 2012 resolved to become a Centre of Excellence for Ageing,” said Mayor Cr Jan McWilliams.

“We made the decision based on our demographics - the Great Lakes local government area has the oldest population in NSW and the third-oldest in Australia, so it’s important to plan for older people,” said the Mayor.

“In October this year, Council adopted the Great Lakes Active Ageing Strategy and membership of the Global Network was a

logical next step in achieving our goal,” said General Manager, Mr Glenn Handford.

“Our Active Ageing Strategy outlines a three-year action plan. Being part of this global network enables us to learn from the experiences of other like-minded communities around the world, and we’re looking forward to networking with those organisations,” said Mr Handford.

Community Services Coordinator, Ms Lyndie Hepple said, “this is not an accreditation, but rather a commitment to a continuing improvement process.

“We’ve worked closely with COTA NSW (formerly NSW Council on the Ageing), and have adopted their philosophy - that if an environment suits an older person, it will suit everybody.

“We’re trying to shift the way society thinks about ageing, from a clinical model of incapacity, illness and care, to a social model of inclusion, participation and contribution.

There are huge benefits for people and the general community if people are engaged in their local community. This is what we will be working to improve.”

Council is currently calling for expressions of interest for community members to become part of its Community Reference Group. Members of the community who are interested in being part of rolling out the Active Ageing Strategy are encouraged to apply.

Application forms for the Community Reference Group are available on Council’s website.

THE Myall Coast Rotary Club, in conjunction with the Tea Gardens Library will be conducting their giant two day book sale in January.

There will be a large selection of hard back and paper backs available.

Well known authors and titles will available for the community to purchase.

Also available will be a selection of things for children.

Expected to be popular will be the many back issues of magazines.

The book sale is expected to have it all in term of selections: sport, gardening, craft, music, hobbies, cars, aircraft, you name it.

Signing on Council?

Dear MCNOTA,

TODAY I received a press release from Hunter Business Chamber in regards to a State Government initiative to make councils more small business friendly.

To my disappointment I did not see Great Lakes Council as being one of the participating councils who have signed on to the program.

Great Lakes Council, can you let us know if you intend to sign on to this program which further improves how

you go about dealing with local businesses within Great Lakes.

I note on the Press Release that nearby councils like Greater Taree, Port Stephens, City of Newcastle and Port Macquarie-Hastings have signed on, so I was wondering what is holding up our local council in joining in on this opportunity.

Erosion!

Dear MCNOTA,

PHOTO’S are taken a day apart at Jimmies Beach, on 12th and 13th December. Erosion is now past the trigger point. What is next move?

A reasonably small low bought large seas to Jimmies Beach.

The resulting wave action has

resulted in further erosion at the southern end of The Boulevarde and the photograph shows that the Council endorsed “trigger “point has been breached, meaning sand replenishment is to be called for.

The question arises as to where this sand will now come from, a question that need not be answered immediately as luckily the low departed.

The erosion has resulted in a cliff

like structure along Jimmies Beach and with the approaching holiday season, we believe it prudent for all parents to be aware of the potential danger of collapsing sand and their children should be discouraged from playing in the immediate area.

We do hope the Great Lakes Council will address the problem.

Cherry Festival Trip Great dental experience Dear MCNOTA,

Dear MCNOTA,

5th to 7th of December, a trip to The Young and Cherry Festival was most enjoyed by these ladies from North Arm Cove, Karuah and Tea Gardens.

Paul Burgess (Driver) Judy Staples, Tania Hackett, Jenni Robbins, Norma Schneider and Dawn Lyall, all had a wonderful time.

They are all cherried out.

I HAVE had problems with my teeth for a long time (a good 10 years), and have been to many dentists only to be charged a fortune and the problem not fixed.

I decided to try Drs. Gulatis in Tea Gardens and they not only identified and fixed my problem they actually explained what was going on.

More recently I needed a filling replaced and when I went to pay they didn’t charge me as it was ‘under warranty’, now firstly I didn’t know there was a warranty on an 11 month old filling let alone the fact that I wouldn’t have remembered that that was that tooth.

“The work greatly improves the appearance of Meade Street, a location which is frequented by tourists and Pacific Highway motorists visiting the Bulahdelah Town Centre and the popular Wade Park area,” said Mr Hartley.

“Linemarking will be undertaken in the street in 2015 to better formalise parking,” said Mr Fish.

Council has also recently completed work to rehabilitate a 540 metre length of Willina Road to the west of Coloongolook.

The work involved widening the road, addition of gravel to increase pavement thickness and lime stabilization of the road pavement.

Work was completed with the application of a bitumen seal.

“The work links with rehabilitation projects undertaken of the past few years along Willina Road and further improves the safety of the road,” said Mr Hartley.

The work was undertaken under Council’s Rural Road Construction Program at a cost of $150,000.

COUNCIL’S Director of Engineering, Mr Ron Hartley said, “Reconstruction work was undertaken along Meade Street between Stroud Street and Crawford Street at a cost of $270,000 under Council’s Urban Rehabilitation Program.”

The roadwork involved replacing kerb and gutter that was in poor condition and reconstruction of the road pavement.

“This section of Meade Street was in poor condition requiring regular maintenance as there was minimal pavement thickness and poor quality gravel in the existing road,” said Mr Hartley.

“The existing road pavement was removed by excavation and a new gravel pavement placed,” said Mr Robert Fish, Council’s Operations Manager.

“As there was poor ground conditions at the site a geotextile and geogrid layer was placed at the base of the excavation to provide increased support for the new gravel pavement,” said Mr Fish.

“An asphalt surfacing has now been placed to complete the project.”

Great times for Social Club Hawks Nest Golf Club Social Club

THE Christmas party for the Hawks Nest Social Club was a treat for all which included a banquet luncheon, plenty of toasts for the Christmas festivities and a game of quoits.

Most of the current members were seen celebrating and even a director.

The day wouldn’t have been complete without a quoits team round robin that only Graeme Stuart and Paul Hunt had the skills to win.

Congratulations!

Thursday social golf was a washout!

Darts still soldiered on with Darren Rapley taking out the evening

as outright winner very closely followed for the runner up was Bob Ibbotson.

The winner of the ladies highest score competition with a score of 135 was Grace Oldfield.

The mens highest score division winner, Graham Lawler,scored 112.

A six week break for the social clubs fishing outings has started while the Christmas celebrations are on.

Leaving previous weekend the last chance for a social angling competition to be held.

Extra large seas made for a tough start on Friday afternoon but the weather showed mercy to provide us all with a beautiful sunny Sunday weigh in.

With more than half the seasons events successfully completed Luke Boyd now has taken the yearly lead narrowly in front of Andrew Sharp.

The yearly points score competition is going to be close for all the rest of the current season.

The ladies yearly points score is also anyone’s for the taking ,with Jessica Slow leading from Karen Glynn.

The aim of the planning proposal is to amend existing areas and identify additional areas affected by flooding in the Great Lakes Local Government Area.

The additional and amended flood planning areas have been identified by the following studies that are also on public exhibition: 1. The Draft Nabiac Floodplain Risk Management Strategy and Wallamba River Flood Study; 2. The Draft Lower Myall River and Myall Lakes Flood Study; and 3. The Draft Smiths Lake Floodplain Risk Management Study; and 4. The First Pass Rural Flood Study.

Council is also exhibiting Draft Amendments to the Great Lakes Development Control (DCP). The aim of the amendments is to provide clear controls for subdivision and development on Flood Prone Land.

Christmas/New Year Closure All Great Lakes Council offices, libraries and depots will close during the Christmas and New Year period. Closure details are as follows: • Forster Administration Building and Tea Gardens District Office will be closed from 1.00pm and Stroud District Office will be closed from 12pm Wednesday 24 December 2014. Council offices will reopen Monday 5 January 2015.

• Tuncurry, Tea Gardens and Stroud Depots will close from close of business Wednesday 24 December and Bulahdelah Depot will close from close of business Tuesday 23 December.

Minimal staff will be operating for maintenance activities during this time. All Depots will reopen on Monday 5 January 2015.

• Forster and all branch Libraries will be closed from 1.00pm Wednesday 24 December 2014 and will resume operating under normal business hours from Monday 5 January 2015.

Extra lending limits and longer borrowing periods will apply during the closure.

Tea Gardens Waste Transfer Station Operating Times During the Christmas Holiday Period Tea Gardens Waste Transfer Station will be open an additional day being each Saturday from 8am to 12pm commencing 20 December 2014 to 24 January 2015 inclusive.

Normal operating times are: Monday 12pm – 4pm Tuesday 8am – 12pm Wednesday 12pm – 4pm Thursday 8am – 12pm Friday 8am – 12pm Sunday 12pm – 4pm All Landfills and Waste Transfer Stations in the Great Lakes area will be closed on Thursday 25 December 2014 (Christmas Day). December 9: A good turnout of 27 bowlers played in the usual Tuesday Social Bowls competition, always a good time to enjoy some fun and laughter. The winners were decided with the team winning the most ends.

These were the fours team of; Carol Hayden, Sandra Leisemann, Olive McKeown and Merle Sargeant.

Players were looking forward to their Christmas breakup party later in the week.

December 11: After a wild night of storms, the day turned out to be a washout as far as playing bowls was concerned, but the weather did little to dampen the spirit of Christmas at the annual Christmas Party.

Our ladies turned up in festive apparel determined to enjoy the day.

The Christmas tree was laden with gifts of various shapes and sizes, the tables burdened with delicious food in preparation for the feast that followed.

All that remained was for the fun to begin.

There were “lucky door” prizes, raffles and gifts, and our very own “Christmas Cracker” entertained us with her very original and hilarious “Happy Christmas Cracker” song.

That started the jokes, (clean of course!), and a great time was had by all.

Our special thanks to the Social Committee for all they do for our members all year through and to all those who work behind the scene to ensure the sooth working of our Club.

On a personal note, I would like to thank Ann and her team at the Myall Coast News for their wonderful support of our Club throughout the year. It is really appreciated.

A very happy and safe festive season to all.

ANOTHER good field of 46 bowlers turned out on December 10th to contest the usual Wednesday bowls competition.

To accommodate the field, there was a mixture of 3-bowl triples and 3-bowl pairs played over one game of 18 ends.

The winners, on a great score of +14 were; Ross Barry, Brian Emmett and Ron Green.

Runners–up was the pairs team of; John Yabsley and Dave Rimmer.

Not to be outdone, in a lucky draw for third, were; Dennis Wilberforce, Steve Hicks and Tom Short.

Following the completion of the mornings play the deferred final of the Club Mixed Fours Competition was played between the team of; John Slater, Lily Smith, George INFORMATION FOR MEMBERS AND THEIR GUESTS

Winter and Dale Winter, taking on; Robyn Webster, Olive McKeown, Dennis Ashbridge and Ron Webster (Dennis was substituting for John Bilby).

The match was to prove to be a marathon, lasting 4- 1/2 hours.

At the 12th end the match was evenly balanced with the Ron Webster combination leading by 4 shots at 11-7.

It all fell apart for the Dale Winter side on the 13th end when, although having a multiple count in the head, a speculative onshot netted Ron Webster 4 shots.

This was closely followed by another 4 shots dropped on the 14th end and the match was all but over.

To their credit Dale Winter’s team won the next three ends, but could not bridge the gap.

Weather conditions on December 12th caused the Friday Jackpot Pairs competition to be cancelled.

With a tantalising Jackpot now up for grabs, it is hoped that play will be possible on Friday, 19 December with a good field competing.

THE Hawks are “steady as you go” after a successful Annual General Meeting results.

The Myall River Juniors Committee will remain largely the same.

2014 coaches and players have indicated that they will take part in next year’s campaign.

Expressions of interest for new players will be made early in the new year, in a bid to form teams in additional age groups.

The Tea Gardens Hawks Committee was reelected the same.

Brooke Roach was appointed Club Coach for an unprecedented 7th season.

The player body will remain similar, with some new faces expected to turn out.

The Hawks members Christmas party will be held at Anzac Park on Saturday 30th to close out the season.

The Hawks tipping competition will continue in 2015, with books available in mid January.

The Committee and members of both Clubs wish all who support the Hawks a Merry Christmas & Happy New Year.
