Property owner receives $8000 on the spot fine for ILLEGAL CLEARING

By Dave BRAZIER FINES recently issued by Great Lakes Council in regards to illegal clearing of trees resulting in polluting and blocking Nanabah Creek by a property developer at Bundabah, have reportedly been met with remorse by the owner, Tea Gardens Farms, who complied with Councils direction to stop works immediately once the infringement had been noticed. Tree’s had been illegally cleared and pushed into Nanabah Creek, blocking the creek system. Great Lakes Council investigations and prosecutions coordinator Greg Pevitt said, “Council was concerned about the tree clearing, however a quick resolution averted any ongoing impact.”

“Trees were pushed into the creek. Subsequently work was stopped, the owner complied and an investigation proceeded,” he said. Mr Pevitt added, “The creek had been completely severed by the trees being put in the creek and compounded.” “There were a lot of earthworks either side of the banks, and I requested that the owner immediately put up sediment erosion control fences, and that was done within the hour of my request,” he said. This was the second recent fine for the developer, who was also fined another $8000 on 15 October 2015 for excessive clearing of land at 101 Bundabah Road, Bundabah. CONTINUED Page 3

Speaking with Myall Coast News, Tea Gardens Men’s Shed member John Adkins introduced me to the team working away at several projects mostly destined to be utilised by the Tea Gardens and Hawks Nest Communities for many years to come.

WITH the distinctive and pleasant aroma of hardwood sawdust in the air, I called in to say ‘G’day’ to the gentlemen who were hard at work last week at the Tea Gardens Men’s Shed. This would be my first visit to the ‘old Tip Shop’ which has been revamped into a mini-industrial workshop housing both woodworking and steel work stations. I can probably say it won’t be my last visit to see

ON the afternoon of Saturday 31 October, police conducted two maritime breath tests on vessels on the Myall River at Tea Gardens. A 67 year old male was attempting to skipper his Riviera Motor Cruiser from Tea Gardens to Lemon Tree Passage. He stopped for a breath test. The test returned a positive reading. He was placed under

arrest and conveyed to Tea Gardens Police Station for a breath analysis. The analysis was conducted and showed a reading of 0.056. He was charged with skipper vessel with low range PCA to appear before Raymond Terrace Local Court. The second vessel saw a 59 year old attempting to skipper his 7m runabout to Nelson Bay. For Lease

AT About 1:30am on Sunday 8 November, police were called to a Hawks Nest motel in relation to an assault. There was a group of person/s staying at the location for the night. All were affected by alcohol when a fight has erupted amongst the group. A 49 year old male who was not associated with group has opened

his rooms front door to investigate the commotion when he has been grabbed around the throat and threatened. A second male with the group has stopped his friend and moved him away. He is described as male, cucasian appearance, dark hair, 170cm, approximately 20 year old, possible wearing a necklace.

Speaking with Myall, Coast News, Mr Griffith said, “If the average Joe like you or I did what this developer has done, without the proper approvals or consent from Council we’d get hammered for it.” “The fine issued to the owner is a joke,” he said. “They (the owner) has previously applied to develop

an Eco-Resort here at Fame Cove, which was rejected by Council previously in 2005.” “They have also been previously fined after sediment polluted water flowed into North Arm Cove in 2009, in that case the Land and Environment Court prosecuted them for $200,000.” “It would appear they just keep doing what they want,” he said. Mr Griffith concerns also extend to the fact that as the land is now cleared, despite no environmental impact studies being carried out, that Council may choose to re-zone the land. “I’m feeling like my hands are tied, because if Council do re-zone the land there really isn’t much I can do about anything else that proceeds on the land owned by Tea Gardens Farms,’” he said.

The amendments also change the focus of consent for a child travel document from consent to a ‘child travelling internationally’ to consent to a child ‘having an Australian travel document’; clarify some of the special circumstances in which an Australian travel document may be issued to a child without full consent or a court order, and enable disclosure of information to and by the Minister to verify the currency and validity of court orders; and confirmation that there are no further orders or proceedings pending in relation to a child travel document. This will be important in protecting children from international parental child abduction and in safeguarding the rights of persons with parenting responsibility.

Great report card results for water A short film has been produced which gives an overview of the work and it can be viewed

GREAT Lakes Council says the whole community can take pride in this year’s Waterways Report Card results released this evening, with long term trends showing improvements in waterway health. Independent scientific research has revealed that six years since the Water Quality Improvement Plan was adopted, all sites across Wallis, Smiths and Myall Lakes are trending towards achieving and sustaining the interim targets set out in the plan (with room for improvement on algal levels at two locations). Dr Peter Scanes, the Senior Team Leader of Estuaries and Catchments Science at the NSW Department of Office Environment and Heritage led the research team who have collected the data from our waterways since 2007. Dr Scanes said, “The waterway management process used by Council, starting with research followed by implementing management options and then monitoring the results, is consistent with world’s best practice.” “It is a credit to Great Lakes Council that that this monitoring

has been ongoing. With six years of data we are now starting to see trends that we can confidently interpret as improvements in waterway health,” said Dr Scanes. In this year’s Report Card Council has introduced three local water quality champions, Tina Gogerly, Garry Smith and Anthony Sciacca. A short film has been produced which gives an overview of their work and can be viewed on the links below. “In their own ways, each of these people are making a fantastic contribution to our community and waterways, I urge you to watch the film to discover their inspiring stories,” said Mayor, Cr Jan McWilliams. “We are so proud of the results that for the first time they have been made instantly available to everyone on our website and facebook page,” said the Mayor. Out of Recycling Project becomes top fundraiser control AT 4.04 pm Saturday 7 November, police responded to a motor vehicle collision at the Browns Flat rest area on the Pacific Highway just south of Nerong. It was reported a vehicle had left the roadway and was now submerged in a roadside dam. Upon arrival at 4.28pm police observed deep constant tyre marks on the eastern side of the south bounds lanes which extended for 204 metres in a direct straight line across a grass verge and then located a blue Subaru WRX on the other side of the exit road and down an embankment. In speaking with the 32 year old male driver from the Central Coast it was evident he was suffering from a mental health condition. The male made threats to jump in front of traffic. He was physically restrained before being conveyed to Newcastle for a mental health assesment. In addition he was the holder of a P1 licence with certain restrictions. Those conditions included must drive an auto vehicle. The vehicle in mention was a high powered turbo charged manual transmission vehicle which played a role in him losing control and careering off the highway.

AT about 7.30pm Saturday 7 November, police responded to an assault at a local licenced premise. Upon arrival police located a 59 year old male was unconscious on the male toilet floor. He was treated by ambulance staff before being conveyed to the John Hunter for treatment. Police have since charged a 50 year old male with assault and he is set to appear in Raymond Terrace Local Court in December.

‘DAY for Daniel’ is a National Day of Action to raise awareness about child safety and protection and Bulahdelah

were organised for the students to participate in. The aim was to conduct child safety activities and empower them to recognise, react and report.

I encourage the community to demand that those nets be put back up and whoever is responsible for their removal to be severely reprimanded. I suppose they would rather all the young people doing something safe, like staying indoors and being on computer games in their spare time. FROM seeing the story “Taken Bat and Ball’ regarding the Bulahdelah cricket nets taken down. (Myall Coast News edition 5 November 2015). I endorse these above comments plus have a complaint about the children’s playground which was also removed the same day as the cricket nets, also without community consultation. I live in close vicinity to the Showground and over the many years I have lived in Bulahdelah, have observed the constant use of the limited facilities provided for children in this area. My grandchildren looked forward to using the playground whenever they visit, which was quite often, let alone the heaps of families that used the playground and nets frequently. I hope that both pieces of equipment are replaced for the convenience and enjoyment of our children as soon as possible.

MY grandson has just started playing Milo cricket at the Bulahdelah club. He and all his mates are so excited to have the chance to play at our local cricket club. The sudden removal of the practice nets at Jack Ireland sporting complex means the children will have no suitable place to practice to enhance their skills. Why the fuss? Dear News Of The Area, THE Pelicans seem to be getting out of hand, according to your article by David Brazier in last week’s NOTA. The lights on the bridge are for the roadway, not the river. They should be returned to shine over the road. Really, they should have the rubber spikes returned to stop pelicans from perching there. Comments are made of them being a “tourist attraction” etc but nobody seems to have mentioned the safety aspect of the weight of two pelicans sitting on a lamp arm and how it effects the strength of the arm – it could break and become a disaster. So keep the pelicans off. Having the arms outside the bridge roadway will not prevent the mess made by pelicans since there is invariably a wind that will blow from one

side of the bridge or the other so that pelican droppings may still be blown back on to the pedestrian walkway or the roadway. I live here so can see pelicans at many places in Tea Gardens and Hawks Nest – surely tourists do not literally stop all day on the bridge to admire them? And do they only come into Tea Gardens/Hawks Nest to see pelicans on the bridge? I doubt it. Peter Caunt Hawks Nest

The river tours organised by the Myall River Action Group to celebrate the rejuvenation of the lower Myall River were a huge success being extremely well patronised and enjoyed by all onboard. The wind and late rain cleared perfectly in time for the beautifully decorated Lantern Parade by Tea Gardens Public School and the spectacular Fireworks display to be enjoyed by a further 1000 people. Our new presenting partner sponsorship from Sheargold Property Developments enabled the Chamber to continue to provide free stall space for 12 local community organisations.

Sheargold’s ongoing support creates exciting opportunities to enhance both the range of activities at and the reach of promotion for future festivals. Councillor puts pelicans in perspective By Cr Len ROBERTS Deputy Mayor Great Lakes Council THE has been much discussion in the media and the community regarding the pelicans on the bridge. Much of the argument for has been centred on “this is what the community wants” and “it is a great tourist attraction.” Those against have centred their argument on safety, health, mess and a great tourist turnoff. It would seem that all recognise there is a problem with the pelicans on the bridge but some suggest there are possibilities, such as turning the lights over the water would solve the problem. Based on feedback, I have repeatedly stated that, it appears to me the overwhelming majority want the pelicans away from the bridge. On the other hand some who argue for the pelicans on the bridge believe that they are the majority and in a democracy the majority win. Whilst we may like to believe such a proposition is true, is it really the case and should it be the case? Before addressing that question it is helpful to look at the facts surrounding the introduction of the spikes on the bridge to deter the pelicans. In 2004 following a number of incidents and subsequent complaints in regard to Pelican droppings on the Singing Bridge, devices were fixed to the light poles to deter pelicans from roosting in this location. The placement of the devices resulted in

a number of complaints about cruelty to the pelicans and a petition bearing approximately 600 signatures was collected seeking removal of the devices. The petition was tabled at the Council meeting on 13 July 2004 and Council resolved to request a report on the matter. The subsequent report to council in August stated, “Following numerous complaints to the staff of the Tea Gardens District Office and the Deport staff about the pelican droppings it was agreed that action needed to be taken to remove the pelicans from this location. The complaints started seriously during the Christmas school holidays and were mostly from visitors to the area, but were also from a number of residents. The petition in fact confirms that the droppings have hit many pedestrians. Investigation into options available resulted in the purchase and installation of the ‘bird spikes’. These are purpose manufactured devices which are quoted as “environmentally friendly and non-lethal”. The devices are purpose manufactured, are flexible to prevent injury to the pelicans and are able to be seen by the pelicans. There have been no reported incidents of pelicans coming into contact with the spikes and it is apparent that the pelicans have simply found an alternate roosting site. The fact is that these animals only moved into the area over the last 11/2 to 2 years, so there is no history of recognition of the bridge with the pelicans. They still gather around people cleaning fish at the boat ramps and interact with residents and tourists in the same way they always have. Council subsequently resolved in

association with the Police and other government agencies not to remove the spikes. It must be noted the pelicans roosting on the bridge was not something that occurred with the erection of the bridge but a new phenomenon that appeared to be a result of plastic cones being placed on poles and moorings to stop the pelicans roosting. The spikes have been in place for 10 years and were removed with the replacement of lights last year as a result of damage in the storms. Essential Energy always intended to replace the spikes as it was an agreed safety measure between council, police and other agencies. As the possibility of turning the lights was raised by the Progress Association it was taken to council for investigation as the idea had merit. However, council would need compelling evidence to overturn an agreed and established safety practice. An assessment of lighting was conducted by Essential Energy and it found that the lighting would be adequate but the rotating of the lights would be at council’s risk. The next step in the decision making process is to determine whether the turning of the lights would alleviate the safety and hygiene concerns. Council took the unanimous view that it probably would not and decided further investigations into the matter were not required. After all the spikes had already proven their worth over 10 years. It seemed good to the council to adhere to the status quo. Since the council decision some intractable vocal opposition has continued. Advice from the Police was sought last week.

The Sergeant covering our area from Ports Stephens Command advised council that: “People drive where they look and if distracted tend to wander.” “The bridge is a blackspot.” “The bridge has poor sight distance.” “There is no stopping on the bridge and people are breaking the law and placing themselves and others in danger by stopping and taking photos.” “Tourist attractions should not be placed on or near bridges or roads that would cause a distraction for drivers.” “Increasing distractions near a blackspot is dangerous.” “The bridge is well used not only by cars but pedestrians and pedestrian safety is paramount.” “Bicycle riders are encouraged not to ride across the bridge but walk. This is part of the police education program to the school children.” In summary leaving aside the mess; pelicans, the singing bridge, pedestrians, cars and bicycles are not a good mix and is a recipe for a lethal accident. Hawks Nest Golf Club Social Darts

AFTER rain washed out any play on the Nominated Triples this week, a good field of 24 took to the green to participate in the Friday Jackpot Pairs. The synthetic green was used with 6 rinks in use. The lowest winning margin was used to determine the winner and with 4 teams recording a draw the winners were decided on a countback. The winners were Vick Garlick and Bob Weir closely

followed by Stewart Sturrock and George Winter. Both Jackpots were not won. Player wanting some Christmas spending money would be well advised to turn up in the coming weeks as both jackpots, now standing at $200.00 and $120.00 respectively, will not be carried over to next year. There are a few important bowling functions coming up to round off the rest of the year. The not to be missed Dolphin Day will be held on Friday 27 November.
