ORMOC CITY --- Department of Science and Technology (DOST) is partnering with the Ormoc City Chamber of Commerce and Industry (OrCham) in highlighting a trade exhibit in the upcoming 25th Visayas Area Business Conference on September 14-16, 2016, here. After the historic occasion of the first DOST Technology Transfer Day held last April 27, 2016 at Sofitel Philippine Plaza Manila, another one will take place, as part of the business conference. It will be held next month,

Superdome lessee complains against bidding committee ORMOC CITY --- One lessee at Ormoc City Superdome has sought the review of the bidding procedures in conducting bidding for stall renters. The request was passed on to the Committee on Laws and Ordinances and the Committee on Public Properties

headed by the Sangguniang Panlungsod (SP) member Benjamin S. Pongos Jr. Due to the request, a special committee meeting was conducted last August 15 for the purpose of addressing the said problem.

Dengue cases in the region is increasing TACLOBAN CITY --- Cases of dengue fever in the whole Eastern Visayas is alarming. This was revealed recently by the regional office of the Department of Health. According to report, dengue fever cases continue to rise and had now killed 16 victims and bothered almost three thousand people. According to Mr. Roderick Boyd Cerro, chief of the DOH regional epidemiology and surveillance unit, total record afflicted residents is now 2,869 from January until recently, and that it continues to rise. It is very alarming, Cerro stressed. He also said that it has already hit a more

than 200 percent increase if compared to the record last year. Report says that dengue fever is high in the following places: Baybay City, Capoocan, Palo, Sta. Fe, Tacloban City, and Tolosa in the province of Leyte; Guiuan and Lawaan in ESamar; Lavezares in NSamar; Naval in Biliran; and Padre Burgos in Southern Leyte. In Ormoc, it is not quite alarming but hospital records show at least one dengue patient a week is being admitted. Cerro urged those who are suffering symptoms such as high fever, severe headache, pain behind the eyes, and pains in muscles and joints, to immediately consult a doctor. ATT

Improvement of ‘dangerous’ saddle road in Southern Leyte is now on PINTUYAN, SLeyte - The saddle road leading to Benit port in San Ricardo town is currently the region’s most dangerous road section, but soon this will change as improvement project is now being implemented. The Department of Public Works and Highways Southern Leyte District Engineering Office (DPWH-SLDEO) is halfway done with the P48 million road realignment concreting project. “The ongoing works is part of three-year activity designed to prevent road accidents in the area,” said District Engineer Ma. Margarita C. Junia. The saddle road, within the boundary of Son-ok and Manglit villages in Pintuyan town, forms part of Liloan-San Ricardo Road. It leads to Benit port, one of the major exit points to Mindanao from Visayas. The road earned the tag as the “region’s most dangerous” after several road accidents killed and injured drivers, passengers, and pedestrians. Consolidated report from the local police showed that from 2010 to 2014 alone, four people have been killed and 20 other were seriously injured in saddle road accidents. The P48 million outlay for this year covers road concreting activities, construction of slope protection works, installation of line canal and metal guardrails. In 2014, the central government has allocated P20 million for the 560-meter alternative road opening works. The

budget rose to P50 million in 2015 for the opening, widening and lowering of grades. About half of the 1.6-kilometer critical sections will be transformed into four-lane road by doubling its existing 6.10-meter width to 12.2 meters. Blasting of rocks is ongoing to complement widening projects. Junia is optimistic to complete all improvement projects for saddle road within the year. The highway is tagged as a vital link that connects Eastern Visayas to Mindanao. The DPWH observed that more buses and rolling cargoes use the Benit port in San Ricardo town instead of nearby Liloan port considering the former’s proximity to Surigao. The route is being serviced by Montenegro Shipping Lines Inc. using a roll-on rolloff vessel, which makes four round trips daily. Sea travel from San Ricardo to Lipata port in Surigao del Norte takes an hour, way shorter compared to more than three hours of travel time through Liloan port. San Ricardo is about 40 kilometers away from Liloan town, traversing a paved road. Although Benit port is closer to Surigao, some motorists prefer to take the Liloan port despite irregular trips, considering the difficulty in maneuvering along the saddle road in Pintuyan town. The road steep incline and blind curves besides deep cliff make the road section the most dangerous in Eastern Visayas. RCD

This quota is intended only for regular enlistment, no quota for special enlistment and composed of 5%

Protest rising against the shooting of an OFW who ran amok

PALOMPON, Leyte --- A public outcry over the death of an Overseas Filipino Worker (OFW) who ran amok recently and was shot to death by a responding cop. The victim who was reportedly gone wild, holding two sharp kitchen knife was shot by the police on his head. The question of the protesters, “why shoot him at the head? He was just holding knife.” Jason Coma, 33, single but has two children from a former live-in partner, and an OFW working in the government of Abu Dhabi in the Middle East, died on the spot after he was hit at his forehead. Based on the police record, certain Philchi Chu, has informed the police station about the incident in front of Green Apple bar near Brgy. Central III. The police then immediately sent a responding team. The team arrived and found the victim drunk, breaking bottles and was walking towards them. The police told the victim to stop and drop the knives but Coma just didn’t listen to them prompting one police officer PO2 Randy Cañamaque to shoot Coma in the left thigh. But Coma seemed not hurt and continued walking towards them. Because Coma just couldn’t listen to the police, Cañamaque shot him in the head. Coma fell to the ground and the police brought him to Manuel Veloso Memorial Hospital where he was declared dead. Coma’s mother Julieta, 56, condemned the police for shooting his son in the head

when he was only armed with knives. In an interview said that she could not believe that her son will die at the hands of the lawmen when they are supposed to protect the lives of the public. She said that prior to the incident her son drunk a bottle of Empirador Light in order to make him sleep but instead of sleeping, he ran amok. “Ako na lang gani giubanan ug inom para mabantayan kung makatug” “I joined to drink with him so I can guard him if he sleeps.” Julieta stressed. She said she felt bad to see the lifeless body of her son in the hospital and expressed disappointment over the unfair police action. Julieta said his son was good, kind and helpful. And that while working abroad, he was the one providing them of their daily needs. And in fact, her son never failed to help during them particularly during the devastation of Typhoon Yolanda in 2013 and even bought them a new motor boat for livelihood. However, she admitted that she has noticed her son acting strangely when he arrived last May. She also said that she had suggested him to visit a rehab center in Manila but her son disagreed. Meanwhile, PO3 Randy Cañamaque, in an interview explained that he was just doing his job and that that it was a judgement call for him when he shot Coma to the head after hitting him in his thigh for the purpose of neutralizing him. But Coma was just a meter away from threatening his lives. Cañamaque said he would welcome any investigation against him. RCD

Catbalogan No.2 in Drug Watch list fights for his life at the hospital CATBALOGAN CITY --- The city’s No.2 in the Drug Watch list, is fighting for his dear life at a hospital in Tacloban City. He was shot several times by unidentified suspects riding in tandem, in Purok 5, Brgy. Canlapwas, here. P/Supt. Edwin F. Barbosa, Catbalogan City, PNP chief identified the victim as Adonis Tan y Dacuro, 34, jobless, and a resident of the said place. Initial investigation conducted by the local police disclosed that the victim was seating on his parked single motorcycle, a black Honda Tmx 155 motorcycle while watching basketball game at the mini basketball court in the street. The small basketball court was in front of one of the residence of the area. Later, one of the two unidentified male persons wearing helmet riding in tandem on a motorcycle without plate number, shot the victim several time with the use of undetermined caliber of handgun that resulted him to fell from his motorcycle.

The committee discussed matters pertaining to the written complaint of Mr. Denni Dominic Lepon Sr. and his son Denni Junior, the owners of DenLep Unlimited Incorporated, about the previous bidding on Ormoc Superdome stalls conducted last June 14, 2016. The Lepons requested for a review of the said bidding, because according to them, the bidding was conducted hastily by the Special Bids and Awards Committee (SBAC). They alleged that they were given a very short notice for bidding barely few days before the new administration took over. And that due to the unfair procedure, they were not able to comply some requirements particularly the securing of the cash surety condition. They admitted,

They claimed that they have been occupying Stall 109 (corner of the Superdome) since 1999 and had been paying faithfully throughout those past years. Mr. Simon Albino Racaza, the Supervising Administrative Officer of Ormoc City Superdome was given a chance to air his side of the story. In his written explanation, he said his office has never failed to remind and update the complainants to comply the requirements on or before the deadline set by the bidding committee. MAASIN CITY — Duterte airport in this side of the country? That would be nice. Southern Leyte Representative, Cong. Roger G. Mercado wants to rename the newly completed Maasin Airport in Brgy. Panan-awan from its original name to “Duterte Airport.” The congressman said the move is for the purpose of giving honor to the President’s father, the late Vicente Gonzales Duterte. Mercado told that he has already filed a bill for this intent. Duterte was reportedly born in Barangay Laboon, Maasin, in March 28, 1945. His father Vicente was appointed as mayor of Danao in Cebu

Delima versus Duterte

President Duterte, even when he was still the mayor of Davao City, really doesn’t iniquitous attitude while working in the government. Delima’s failure as Justice Secretary is obvious. It was during her stint when the National Bilibid Prison became the center of the illegal drug trade. She can’t deny but she is entitled to deny it. Duterte finds it hard to pin down Delima because of her strong anchor and fortress. She has the backing of former President Aquino and former DILG Secretary and some individuals in the governments who have the same attribute. This conflict between Delima and Duterte is not simple. It is a clash between two Visayans. It might even get worse and might end up to bloody outcome. But of course, everybody knows that both of them doesn’t want this to happen.

News/Legal Notices Top drug personality couple in Kananga arrested KANANGA, Leyte --- The couple who are the No. 2 and 3 Top personality in the drugs watch list of this town was arrested in Sitio Riverside, Brgy. Poblacion, this town. P/CInsp. Ricky Reli, identified the suspects as certain Sarah Tan, the No.2 in drug watch list in PNP and her husband Ernesto who is ranked No. 3. in the same watch list. The raiding team led by Reli and deputy chief P/SInsp. Chirstopher Pangue were armed with a Search Warrant NR 322O16 sigend by Executive Judge Ephraim Abando of RTC Branch 18, Hilongos, Leyte issued on August 12 for Violation of RA 9165 the Comprehensive Law against Anti-Illegal Drugs of 2002. Recovered from the couple were nine pieces of small plastic sachets containing white substance suspected to be shabu, small amount of money and drug paraphernalia. However, the suspects denied the accusation and said that evidences were just planted by the raiding team. The said that they had already stopped their illegal trade after they voluntarily

The suspect when ask why he allowed his house to become a drug den told media that he did not know that allowing people to sniff shabu inside one’s house is a violation of the law. The three High Valued Targets of illegal drugs were charged of Violating RA 9165 and presently languishing at the Kananga detention cell. RCD

In the case at bar, herein Defendant per Sheriff Return of Summons dated July 14, 2014 was served summons and copies of the Petition in the given address at Brgy. 110, Utap, Tacloban City, but was informed that said Defendant already left for the United States of America sometime in June 2014. It must be stressed that the Rules provides remedies whenever a Defendant cannot be personality served with summons. Substituted service or summons by publication is made available thereto, provided that in summons by publication, leave of court must first be secured. Clearly, Section 15 of Rule 14 of the Rules of Court provides: “A defendant who is a non-resident and is not found in the country may be served with summons by extraterritorial service

in four instances; (1) when the action affects the personal status of the plaintiff; (2) when the action relates to, or the subject of which is property within the Philippines, in which the defendant has or claims a lien or interest, actual or contingent; (3) when the relief demanded consists, wholly or in part, in excluding the defendant from any interest in properly located in the Philippines; or (4) when the property of the defendant has been attached within the Philippines. “ Considering the applicability of the abovecited Rules, the Court finds it fitting to find procedural guidance in the ruling of the Supreme Court in the case of MargaritaRomualdez-Licaros vs. Abelardo Licaros. GR No. 150656. April 29. 2003), finding this wise: “ In these instances, extraterritorial service of summons may be effected under any of three modes: (1) by personal service out of the country, with leave of court: (2) by publication and sending a copy of the summons and order of the court by registered mail to the defendant’s last know address, also with leave of court; or (3) by any other means the judge may consider sufficient. Applying the foregoing rule, the trial court required extraterritorial service of summons to be effected on Margarita in the following manner: x x x, service of Summons by way of publication in a newspaper of general circulation once a week for three (3) consecutive weeks, at the same time, furnishing respondent copy of this Order as well as the corresponding Summons and copy of the petition at her given address at No. 96 Mulberry Lane, Atherton, California, U.S.A., thru the Department of Foreign Affairs, all at the expense of petitioner. (15) (Emphasis ours) The trial court’s prescribed made of extraterritorial service does not fall under the first or second mode specified in Section 15 of Rule 14, but under the third mode. This refers to “ any other means that the judge may consider sufficient. “ Thus, the Court finding the Motion clothed with merit, the same is hereby GRANTED. WHEREFORE, let the Court Order dated January 16, 2015 be set aside and order that this case be re-instated in the active dockets of the Court. AMLC asked to investigate recovered checks from Espinosa’s residence

ALBUERA, Leyte --- The Anti-Money Laundering Council has received the request of the Albuera police to conduct an investigation of the 8 bank accounts of the Espinosas in connection with hundreds of returned checks recovered by the police near the residence of the Espinosas last week. The checks were found inside a brown envelope left at the back of the chapel near the residence of the Espinosa in Sitio Tinago, Brgy. Benolho, this town. Albuera PNP Chief P/CInsp. Jove Espenido, in a telephone interview explained that AMLC’s investigation is essential in order to to determine the ownership of the recovered checks worth more than P500 Million. Espenido said that they already sent to AMLC, the documents along with affidavits and testimonies. It was learned that from the returned checks, it shows that the suspected drug trader has issued money to some of the police officers and politicians since 2014 up to 2016. The amount ranges from P400,000 to P20 million. Espenido also urged those people who received vehicles from the Espinosa to start turning over them to Albuera Police. RCD
