6 Espinosa men killed in an alleged clash with police ALBUERA, Leyte --- Six armed men, alleged hitmen of Mayor Rolando Espinosa Sr., and his son Rolando “Kerwin” Espinosa, were killed when they engaged themselves in a shooting with the local police last week in Sitio Tinago, Brgy Benolho, this town. Town police chief, P/CInsp Jovy Espinido, in an interview said that they were conducting a patrolling at the area when they chanced upon the armed men of the mayor outside his residence. The men reportedly were first to fire at the government troops. Espinido said that the first encounter happened outside the mayor’s house with the team that he led. He said that another encounter with

the other team and killed two armed men outside the house of the mayor’s son Rolando Espinosa Jr. One was killed in front of the gate and another at the concrete fence. He added that the other team likewise was able to kill two more armed men who reportedly came out from the first known house of the Espinosas, just 50 meters away from the barangay tennis court beside the Espinosa’s compound. Espinido said that he organized 3 teams for the said roving operation upon learning from an asset that a movement was happening at the house of the mayor. He said that he was informed that armed men are seen moving in and out of the mayor’s houses in that early

Jambiran denies protecting drug suspects

ORMOC CITY --- P/Supt. Ibrahim Hamadi Jambiran, the Chief of Police of Calbayog City was named by President Rodrigo Duterte as a drug protector, when the President revealed the list of drug protects in Zamboanga City and his name was mentioned. Jambiran said there was no truth in it, and that the President was just misinformed. He said that it might be a personal grudge with the former PDEA director in Region 9 and a family of

police officers who were graduates from the Philippine National Police Academy (Pnpa) might be the reason behind the inclusion of his name in the list. He revealed that years ago, in Zamboanga City, a drug personality, identified as Benhur Babol was reported missing until this time. He said that he was accused as the one behind it. Menesis hopes the mayor will resume duty ALBUERA, Leyte --- Vice Mayor Dra. Rosa Menesis, expressed hope that incumbent mayor Rolando Espinosa Sr., would return soon and continue to work as the duly elected mayor of the town. As of the presstime, the mayor was under the custody of PNP Chief DG Ronald Bato Dela Rosa in Camp Crame after the mayor surrendered to the PNP Chief. It was learned that based on Local Government Code of 1991, vice mayor would take over after the mayor made a three straight absences without appointing anybody in acting capacity. This is also the explanation of Municipal Administrator Daryl Menesis who stressed that the vice mayor can

assume the duty as mayor after the three consecutive absences of the mayor without appointing an “acting mayor”. Mayor Espinosa reportedly appointed the first councillor, the former Mayor Sixto Dela Victoria to assume as OIC while he is out of town, but Dela Victoria declined the appointment. No excitement Menesis, on the other hand said that she would assume the position as provided by the Code and that she would just ignore the threat by suspected drug trader Rolando “Kerwin” Espinosa Jr., the mayor’s son, that something bad might happened to anybody who may try to assume the post of his father. New building SHS inaugurated turned over, computers given away ORMOC CITY --- A Senior High School building in Genero B. Lureñana National High School in Barangay San Jose, this city, was inaugurated and turned over in simple turn-over ceremony last August 4. The building was built through the effort of the office of Congresswoman Lucy Marie Torres-Gomez with a computer package donated by the Rotary Club of Ormoc. The project was part of the program initiated by the club for schools in the province of Leyte which were affected by Super Typhoon Yolanda. It was learned through a statement made by Rotarian Anna Bumagat that the club applied for international grant. It was Mr Jan Degeest who was made instrumental for the realization of such partnership. The project was dubbed as “Rotary Foundation Global Grant #1419936” sponsored by District 1620 - RC Gent-Prinsenhof ( Belgium ) in partnership with Rotary Club of Ormoc which was represented by RC Ormoc

president Rtn. Sandra Fiel-Chiong. About P8 million worth of information technology gadgets, which included 304 computers units were given out for both for elementary and high schools. There were nine schools that were beneifed in two batches. The club also was reportedly grateful of the effort made by Past President Anna Louisa Abanes-Bumagat, who facilitated the processes for the release of the grant. The turn-over ceremony was attended by dynamic Ormoc City Mayor Richard Gomez, with members of the City Council Atty. Benneth Pongos and Vince Rama. The turn-over ceremony concluded with a ceremonial signing of deed of donation and Memo of Understanding. Albuera administrator hopes for fair trial ALBUERA, Leyte --- Municipal Administrator Darryl Menesis is hoping and praying that the municipal, Mayor Rolando “Onik” Espinosa Sr will be given a fair trial and due process will be followed after he gave himself in to the PNP Chief in Camp Crame. Menesis pointed out that with the absence of the mayor, he personally manages the day-to-day operation of the municipality being the administrator. He said that he expects that a in the 4th day of his absence failing to issue a leave and appointment for an acting mayor the DILG will use the power of assumption which would push the Vice Mayor to take over. Regarding to the daily operations, he revealed that everything is normal except the presence of the town mayor.

Espinosa reportedly have become worried when the new Albuera Chief of Police P/CInsp. Jovy Espinido assumed office last July 19. Menesis said that Espinosa did not pay a courtesy visit to the mayor and it was the later that asked him to meet in his office at the police station. He said that it was a discourteous act on the part of the policeman. Menesis added that what made the mayor afraid was the declaration of the police chief that he will shoot the mayor and his son Kerwin whenever and wherever he sees them. For his part, Espinido said that he was just following orders. He said that he gave the mayor and his family to voluntarily surrender themselves because shabu was reportedly became a family enterprise for them. RCD

Former PDEA employee busted for selling shabu

CATBALOGAN CITY --- Another drug personality fell on the hands of the Philippine Drug Enforcement Agency Regional Office VIII (PDEA RO8), Samar PPO-PIB, Samar PPO-PAIDSOTG, Samar PPSC and Catbalogan City Police Station during the conduct of buy-bust operation, recently. In a report submitted to PDEA Director General Isidro S. Lapeña, joint elements of PDEA Regional Office 8 under Director Edgar T. Jubay, Samar PPO-PIB, Samar PPO-PAIDSOTG, Samar PPSC and Catbalogan City Police Station, conducted a buy-bust operation at Brgy. Canlapwas, Catbalogan City, which resulted to the arrest of Jaime Jonathan Mabesa y Osal, former PDEA Admin Personnel, male, 40, married, resident of Brgy. Bliss, Canlapwas Catbalogan, Samar. Purchased and seized from the suspect were one (1) pc. heat-sealed plastic sachet containing suspected shabu weighing MOL 0.06 grams, with an estimated market value of P500, one (1) unit of Cal. 22 Revolver model LLAMA chamber loaded with one (1) ammunition with inserted magazine loaded with five (5) ammunition and

one piece of P500 bill used as buy-bust money. Subsequently, the same antidrug operatives implemented a Search Warrant against Mabesa in his residence locate at Brgy. Canlapwas, Catbalogan City. Confiscated during the operation were one (1) pc. Double mint metal container containing five (5) pcs. plastic sachet of suspected shabu and two (2) pcs. strips aluminum foil, one (1) pc. Aluminum box containing six (6) pcs. plastic sachet of suspected shabu residue, one (1) pc. Transparent plastic zip lock cellophane with traces of suspected marijuana leaves, one (1) unit of revolver marked CROSNAM ARMS FAIRPOT N.Y. USA 38C 177 Cal PELLGUN PAT NO. 3212489, one (1) pc. Cal 22 Magnum loaded with eight (8) pcs live ammunition and several drug paraphernalia. Cases for violation of Section 5 (Sale of Dangerous Drugs), Section 11 (Possession of Dangerous Drugs), and Section 12 (Possession of Drug Paraphernalia), Article II of Republic Act 9165 will be charged against the suspect. The arrested suspect is temporarily detained at Catbalogan City Police Station Detention Facility. RCD

Public schools classes suspended due to reported shoot out incident ALBUER, Leyte --The Department of Education Leyte Division suspended the classes of 10 elementary schools under the Albuera North District last Thursday and Friday due to the clash between policemen and the alleged hitmen of town Mayor Rolando Espinosa Sr., The cancelation affected 3,892 elementary pupils and 126 teachers. The order came from Leyte Division Superintendent Dr. Ronelo Al K. Firmo. The main reason was

the security of the children and the teachers. The schools were located around the residence of the Espinosas. Dionesia Verano, principal of Benolho Elementary School, her school is far from the area of the encounter but she would adhere to the instruction of DepEd Leyte Division. In North District Office, only the office of the District Supervisor Victoria Wagas was opened. But the rest of the school classrooms were closed. RCD

The minor suspect was immediately brought to the drop in center of the City Social Welfare and Development along the government center while charges are being prepared for violation of RA 9165, the Anti-Illegal Drugs Act of 2002 against Dagatan who is still at large. Well done, Filipino Athletes! ONLY one got one. A Silver medal courtesy of the physical strength of Hidilyn Diaz. Only one but it is the pride of everybody. And every athlete who competed at Rio Olympics summer games deserves appreciation and a congratulation. Hidilyn Diaz, a Philippine Air Force soldier has made her country very proud, ending the 20 year drought of Olympic medal after three appearances in that summer games. The last one was that of Mansueto “Onyok” Velasco at 1996 Atlanta Olympics.

Dias who made her Olympic debut during the Bejing summer games in 2008, record 88kg in the snatch and 112kg in the clean and jerk for a combined total of 200kg. It was just good for the second place behind a controversial male-looking Taiwan’s Hsu Shu-Ching. Korean Yoon Jin Hee got the bronze medal. Other Filipino athletes failed in their attempt at their respective events but their failures were all overshadowed by the success of Diaz. Because of this silver medal of Diaz, all those failures of the other athletes would be easy to forget.

On record is a Motion for Reconsideration and With Leave of Court of the Order dated January 16, 2015 filed by the Plaintiff through counsel Atty. Erwin V. Belleza. Clearly, Section 15 of Rule 14 of the Rules of Court provides: “A defendant who is a non-resident and is not found in the country may be served with summons by extraterritorial service

in four instances; (1) when the action affects the personal status of the plaintiff; (2) when the action relates to, or the subject of which is property within the Philippines, in which the defendant has or claims a lien or interest, actual or contingent; (3) when the relief demanded consists, wholly or in part, in excluding the defendant from any interest in properly located in the Philippines; or (4) when the property of the defendant has been attached within the Philippines. “ Considering the applicability of the abovecited Rules, the Court finds it fitting to find procedural guidance in the ruling of the Supreme Court in the case of MargaritaRomualdez-Licaros vs. Abelardo Licaros. GR No. 150656. April 29. 2003), finding this wise: “ In these instances, extraterritorial service of summons may be effected under any of three modes: (1) by personal service out of the country, with leave of court: (2) by publication and sending a copy of the summons and order of the court by registered mail to the defendant’s last know address, also with leave of court; or (3) by any other means the judge may consider sufficient. Applying the foregoing rule, the trial court required extraterritorial service of summons to be effected on Margarita in the following manner: x x x, service of Summons by way of publication in a newspaper of general circulation once a week for three (3) consecutive weeks, at the same time, furnishing respondent copy of this Order as well as the corresponding Summons and copy of the petition at her given address at No. 96 Mulberry Lane, Atherton, California, U.S.A., thru the Department of Foreign Affairs, all at the expense of petitioner.
