El Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (Senera) descartó que los daños que sufrió el dique de Nosara, tras el paso de la tormenta Nate, tuvieran que ver con la calidad del cemento chino.

De acuerdo con el director de ingeniería del Senara, Marvin Coto, el dique de Nosara se construyó en dos etapas, la primera con cemento nacional y la segunda con material procedente de china, y ambos diques tuvieron un comportamiento similar.

“Los daños responden a una crecida de agua extraordinaria. Con una situación como esta, la afectación en el dique, a nuestro juicio, fue normal”, comentó Coto.

En la primer etapa del dique la zona afectada fue en el sector del aeropuerto, mientras que en la segunda los puntos más golpeados fueron el cruce de Santa Marta y el sector de Rancho Tico.

Coto explicó que durante la tormenta, el dique recibió un caudal de 763 metros cúbicos por segundo; sin embargo, la obra fue diseñada para soportar 426 metros cúbicos por segundo, en su capacidad máxima.

El reporte indica que, preliminarmente, la reparación del dique podría tener un costo de ¢400 millones.

Según el jefe de ingenieros de la Comisión Nacional de Emergencias, Orlando Marín, la Municipalidad de Nicoya deberá reportar el daño existente en el dique de Nosara ante la CNE para que se incluya en el Plan General de la Emergencia y con esto se logre reparar los daños por medio del Fondo Nacional de Emergencias.

Tanto el Senara como la estación del Minae en Ostional, confirmaron a La Voz de Guanacaste que no se ha hecho una evaluación sobre los escombros que podrían llegar al océano.

Aunque en alguno tramos el agua del río rebasó el dique, el jefe de ingenieros de la CNE explicó que la principal función de ese tipo de obras es mitigar el impacto.

“Los diques lo que hacen es bajar la incidencia de las afectaciones, no hay ninguna obra que tenga un riesgo cero”, dijo Marín.

Por su parte, tanto el presidente de la Asociación de Desarrollo Integral de Nosara, Marcos Ávila, como el presidente del Comité Local de Emergencias, Juan Luis Ramírez, coincidieron que el dique ayuda a que la emergencia en Nosara no fuera mayor.

“Si el dique no hubiera estado, Nosara hubiera desaparecido”, comentó Ávila.

Según la Comisión de Emergencias de Nosara, en el distrito nosareño 160 personas se refugiaron en distintos albergues. Ya todas regresaron a sus casas.

Las comunidades nosareñas más afectadas fueron Santa Marta, Hollywood, Santa Teresita, el sector de la ribera norte del río Nosara, la Casona, y el sector cerca a la bomba.

The National Service of Underground Waters, Irrigation and Drainage (Senara) ruled out the possibility that the damages that the Nosara dike suffered after Nate passed over have to do with the quality of Chinese cement.

According to Marvin Coto, director of engineering at Senara, the Nosara dike was built in two phases, the first with national cement and the second with material from China, and both had a similar reaction.

“The damages respond to an extraordinary rising of water,” Coto said. “With a situation like

this the impact on the dike, in our opinion, was normal.”

During the first phase of the dike the affected zone was in the area around the airport, while in the second hardest-hit parts were the crossing of Santa Marta and the Rancho Tico sector.

Coto explained that during the storm, the dike took on a water flow of 763 cubic meters per second, but it was only designed to handle 426 cubic meters per second at maximum capacity.

The report indicates that, preliminarily, repairing the dike could cost ¢400 million ($714,286.00).

existing damage of the Nosara dike to the CNE so that it can be included in the general emergency plan and its damages are repaired with money from the National Emergency Fund.

Senara and the Minae station in Ostional confirmed to The Voice of Guanacaste that no evaluation has been done of the garbage that could reach the ocean.

Did the dike work?

While at some points the river water overflowed the dike, the chief of engineers from CNE explained that the main function of a construction of this type is to mitigate the impact.

“What dikes do is decrease the impact. There is no construction that has zero risk,” he said.

Marcos Ávila, president of the Nosara Integral Development Association, and Juan Luis Ramírez, president of the local emergency committee, agree that the dike helped limit the impact of the emergency in Nosara.

“If the dike weren’t there, Nosara would have disappeared,” Ávila said.

According to the Nosara Emergency Commission, 160 people in the Nosara district took refuge in various shelters. They have all returned home.

The most affected communities in Nosara were Santa Marta, Hollywood, Santa Teresita, the north bank of the Nosara River, Casona, and the area near the gas station.

• Tributación encontró anomalías en declaraciones de renta de Fifco relacionadas con sociedades en Gran Caimán

La corporación costarricense Florida Ice & Farm (Fifco) y la fundación estadounidense Schwan controlaron muchas de sus inversiones millonarias sobre el Polo Turístico Golfo de Papagayo desde una red de compañías de papel creadas en paraísos fiscales.

Las empresas refugiaron sus préstamos, ganancias y transacciones en países como Bahamas, Islas Vírgenes Británicas y Gran Caimán, que no solo están fuera del alcance del control fiscal de Costa Rica sino que no cobran impuestos por este tipo de actividades.

Esos tres países otorgan grandes privilegios a quienes tienen el poder económico para crear redes de compañías y llevar allá sus fortunas.

Aunque no siempre las operaciones que se llevan a cabo allí son fraudulentas (algunas veces aprovechan vacíos en las leyes y son legales), suelen ser utilizadas para eludir y evadir el pago de impuestos.

Desde allá se orquestaron los primeros desarrollos como el hotel Four Seasons y la Marina ubicados en Papagayo, una tierra que le pertenece a todos los costarricenses y que el Instituto Costarricense de Turismo (ICT) concesiona para generar desarrollo y traer empleos a Guanacaste. (Vea nota “Los 7 mandamientos…”).

Una de las compañías utilizadas por Fifco para administrar sus operaciones en la península fue London Overseas, registrada en Gran Caimán.

La Dirección General de Tributación (DGT) de Costa Rica encontró anomalías en declaraciones de renta de Fifco en las que le enviaba dinero a esa sociedad.

En los periodos 2005-2006 y 2009-2010 Tributación encontró que ese dinero había sido reportado por Fifco como “aportes de capital”.

Sin embargo, la DGT consideró que más bien eran préstamos y que pudo haber recibido intereses sobre los cuales no estaba pagando impuestos. Como resultado, le cobró una multa total de ¢2.428 millones.

la Bolsa Nacional de Valores, y en los reportes de Schwan ante el fisco de Estados Unidos (el IRS) con los que se corroboraron los nombres de las sociedades que se mencionan en esta investigación y las relaciones entre ellas.

Consultada por La Voz de Guanacaste, Fifco aseguró que sus actuaciones “estuvieron siempre apegadas al marco legal vigente” y que nunca les generaron un beneficio fiscal. Sus directivos declinaron brindar una entrevista en persona para ampliar detalles y no contestaron puntualmente a varias de las preguntas enviadas al correo electrónico de su departamento de prensa, pero enviaron una declaración general vía email.

Los registros del IRS, en conjunto con los Paradise Papers, se utilizaron para conocer a la fundación Schwan (The Marvin M. Schwan Charitable Foundation), cuyas inversiones en islas del Caribe y en Costa Rica los condujeron a un camino de pérdidas de casi $500 millones.

Durante tres meses, este medio investigó los correos electrónicos, transacciones, inversiones e intercambios de acciones entre las compañías controladoras de Papagayo, documentos que se filtraron a la prensa internacional desde los bufetes Mossack & Fonseca y Applebay-Estera.

Estas filtraciones son hoy parte de los Panama Papers y Paradise Papers, dos proyectos periodísticos mundiales liderados por el ganador del premio Púlitzer Consorcio Internacional de Periodistas de Investigación (ICIJ por sus siglas en inglés).

Fifco y la fundación Schwan fueron —hasta el 2012 y el 2016 respectivamente— los socios mayoritarios de Ecodesarrollo Papagayo, que era la empresa que ellos utilizaban en Costa Rica para canalizar las inversiones que venían desde paraísos fiscales en el polo turístico. De hecho, es la mayor concesionaria del polo: hasta el 2012 tuvo el 41% de sus tierras.

Ecodesarrollo tiene el resort Península de Papagayo, dentro del cual se construyó el Four

Seasons, la marina y un centenar de residencias privadas lujosas.

En vez de invertir directamente en Ecodesarrollo, Fifco utilizó dos sociedades offshore creadas en Gran Caimán como sus subsidiarias para hacer negocios con Schwan durante al menos ocho años: London Caribbean Incorporated y London Overseas Incorporated.

La fundación estadounidense Schwan, a su vez, utilizó dos filiales en Estados Unidos (llamadas Wings of Papagayo y The Kings Foundation Investment Papagayo) para dirigir desde allí sus inversiones.

Por medio de esas compañías, crearon ocho corporaciones de papel más entre el 2000 y el 2012 que fueron naciendo en este orden: Hobart Management Limited, Desarrollo Papagayo Corporation, Península Papagayo Ventures, Península Papagayo Group Corp., Marina Papagayo Holding, Península Papagayo Clubs Inc. Para finalizar su relación Península Papagayo Principal Holdings. (Vea mapa “Nombres y apellidos” ).

Por cada línea de negocio nueva en Costa Rica, abrían una sociedad de papel en algún paraíso entre Bahamas e Islas Vírgenes con casi siempre los mismos miembros en sus juntas directivas. Ecodesarrollo Papagayo S. A. expresó vía correo electrónico que la compañía desconoce por qué sus ex accionistas escogieron una jurisdicción diferente a la costarricense para llevar a cabo sus negociaciones. ¿Por qué utilizaban este método? “Si usted tiene hambre y hay un restaurante en la esquina, usted cruza la calle y se sienta a comer”, explica el periodista estadounidense especializado en sociedades offshore y consultado para este artículo, David Marchant. “Lo que hacen estas compañías es tomar un taxi, llegar al aeropuerto, subirse a un avión por 20 horas, bajarse, tomar un bus, volver a tomar un avión, hacer todo el camino de regreso y entrar por la puerta de la cocina para por fin sentarse a comer”, continúa.

Para quienes recibimos un salario todas las quincenas como nuestro único insumo para vivir, puede resultar así de extraño que una empresa cree una subsidiaria a miles de kilómetros de distancia para que controle desde allá todas sus inversiones. Es confuso

Paradise Papers precisamente porque está hecho para eso: para marear.

Juegos del hambre Es bastante común que compañías del tamaño de Fifco inviertan altas sumas en reconocidos bufetes o incluso tengan departamentos enteros para hacer su “planificación fiscal”, que es el término más políticamente correcto para denominar al uso de vacíos legales que le permite a los grandes contribuyentes contribuir lo menos posible. Es decir, pagar la menor cantidad de impuestos que se pueda.

Si es ético o no y, sobre todo, si es dañino o no para los países, es una discusión que está encendida en todo el mundo y también en Costa Rica, donde la ineficiencia de Tributación (admitida por el mismo Ministerio de Hacienda) y las todavía muy laxas leyes de impuestos permiten que los más ricos tengan alternativas para sacarse algunos tributos de encima mientras que a la clase media no le queda más que pagarlos porque la retención es automática en el salario o en los productos que compramos cuando vamos al súper. (VER Cómic) “Conforme menos paguen las grandes empresas, más le tocará sostener este país a los consumidores y a los asalariados, con lo que se deteriora la clase media”, explica el especialista del Instituto Centroamericano de Estudios Fiscales, Abelardo Medina.

“Que un país permita que la gente no pague impuestos obliga a la Administración a aumentar los impuestos al consumo para hacerle frente al gasto, y ahí es cuando todos los contribuyentes se ven afectados”, dice Medina.

El juego de los paraísos fiscales es también un juego del hambre.

Un mal cálculo En los periodos 2005-2006 y 2009-2010, la Dirección General de Tributación (DGT, ente encargado en Costa Rica de la recaudación fiscal) encontró un pago menor de impuesto de renta por una declaración errónea de la operación realizada por Fifco con su subsidiaria en Gran Caimán, London Overseas.

Según la DGT, un supuesto aporte de dinero para fortalecer el capital de la compañía en Gran Caimán era en realidad un préstamo sobre el cual Fifco pudo haber recibido intereses y que sobre ellos tenía que pagar impuestos, pero no lo hizo.

Aunque la compañía elevó el caso al Tribunal Contencioso Administrativo, insistiendo en que este impago es “a lo sumo una diferencia de interpretación”, prefirió pagarle una de las multas a Tributación, por la cual desembolsó ¢1.681 millones.

En el periodo 2009-2010, Tributación volvió a encontrar la misma “diferencia” en el pago de la renta de Fifco. Esta vez, le cobró ¢747 millones de multa que, hasta el último informe del 2017, aún estaba en apelación ante el Tribunal Fiscal Administrativo.

Al cierre de edición, la compañía no había enviado las respuestas relacionadas con este tema.

¿Para qué utilizaba Fifco sociedades en paraísos fiscales?

Antes del 2012, los Papeles de Panamá evidencian que Fifco tenía inversiones de $14,8 millones en Península de Papagayo Ventures y por $6,8 millones en PP Holdings.

Pese a que Fifco era accionista directa de Ecodesarrollo Papagayo S. A., desde el 2005 no hizo ninguna inversión sobre ella directamente, sino que se limitaba a enviar el dinero a las offshore y desde allá gestionaba las inversiones.

Los estados financieros de Fifco evidencian que la compañía también utilizaba a sus offshore para garantizar préstamos con el Scotiabank de Gran Caimán a favor de Ecodesarrollo.

Asi nos afecta la elusion de impuestos Cuando se utilizan paraísos fiscales para pagar menos impuestos, todos los costarricenses nos perjudicamos. Esa plata que deja de recibir el Gobierno -que es utilizada para desarrollar el país- lo obliga a subir el precio de la mayoría de bienes que consumimos.

Rodolfo Jiménez Borbón y Ramón Mendiola son parte de los directivos de Fifco que firmaban las transacciones de acciones que hacían las offshore relacionadas con Papagayo.

A la lista de miembros de juntas directivas se suman Thomas Alvarado, Arturo Alexis Loría y Wilhem Steinvorth, también de Fifco.

La corporación costarricense dejó de hacer negocios con la fundación estadounidense en el 2012, cuando acordó traspasar todas sus acciones sobre las sociedades que controlaban a Ecodesarrollo Papagayo a otra compañía y, a cambio, obtuvo 311 hectáreas sin construir en el sector norte de la Península y dos residencias construidas en la parte sur, donde ya ha anunciado grandes desarrollos.

En una declaración hecha al diario La Nación en abril del año pasado, Rodolfo Jiménez Borbón explicó que formaron sociedades en paraísos fiscales porque el socio mayoritario (la fundación Schwan) quería hacer los negocios en un “territorio neutral”.

Sin embargo, sus estados financieros revelan que las compañías no se cerraron luego del 2012. Hasta el 2016, London Caribbean y London Overseas seguían apareciendo como subsidiarias de la compañía.

Mientras tanto los guanacastecos, y sobre todo los liberianos siguen preguntándose quién le sacó provecho realmente a Papagayo.

La respuesta está en otro paraíso, a miles de kilómetros de aquí.

ASÍ SE MOVÍAN LAS INVERSIONES SOBRE PAPAGAYO DESDE LOS PARAÍSOS FISCALES ¿Alguna vez se ha detenido a observar el intrincado trabajo que tiene una tela de araña? Imagine que en cada nudo de la red hay un nombre. Cada nombre representa una corporación y tres o cuatro hilos más se desprenden de él con otros nombres al final.

Nombres de personas y de corporaciones.

Luego amplíe el foco para ver cuántos nombres se repiten en cada nodo y en cada corporación y transporte la red a El Caribe: ubíquela sobre Bahamas, Gran Caimán y las Islas Vírgenes Británicas y verá a la red de offshores más delicadas y elaboradas de Guanacaste.

Istmo de Papagayo, una sociedad creada en Costa Rica para levantar el hotel Four Seasons.

Esa red es la que sostuvo el desarrollo inmobiliario de la concesionaria más grande sobre la Península de Papagayo, Ecodesarrollo Papagayo, durante al menos 15 años.

Luego de la construcción del Four Seasons siguió la de la Marina, para la cual también se creó una subsidiaria offshore en el 2006, llamada Marina Papagayo Holding Limited, que controlaba sus acciones. Después se constituyeron otras más para otros desarrollos y servicios.

El 21 de setiembre del 2000, un abogado de Mossack & Fonseca en Islas Vírgenes Británicas comienza a tejer este entramado de redes.

Ecodesarrollo Papagayo y la fundación Schwan fueron los primeros accionistas de una nueva sociedad que inscribió ese día el abogado en Islas Vírgenes Británicas. Se llamaba Desarrollo Papagayo Corporation.

La formalizaron con pocas acciones registradas y, dos años más tarde, le inyectaron capital para que desde allí se desprendieran los fondos para el desarrollo del hotel Four Seasons en la Península de Papagayo, según consta en el acuerdo de accionistas filtrado en los Panama Papers y fechado el 1° de noviembre del 2002.

Para hacerlo, Ecodesarrollo aportó un capital de $21 millones y Schwan de $12,6 millones.

Schwan también le haría un préstamo a esta nueva sociedad por otros $8 millones que pagaría un tercer socio llamado Four Seasons Hotels, inscrito en Barbados (que es otro paraíso fiscal).

Desarrollo Papagayo Corporation debería utilizar todas estas inyecciones de capital únicamente en comprar las acciones de Grupo

En el 2002, tanto Schwan como Ecodesarrollo dejan de aparecer como accionistas de Desarrollo Papagayo Corporation y el resto de las compañías para siempre. En su lugar sus subsidiarias son las que toman decisiones, aunque los directivos que las firman siguen siendo los mismos. A veces aparecen como apoderados y otras veces como presidentes, pero sus nombres se repiten infinitamente en todos los documentos.

En buena parte de las sociedades creadas figuraba el nombre del CEO de Ecodesarrollo, Allan Kelso Machado, como apoderado general o generalísimo sin límite de suma. Mediante un correo electrónico enviado a través del vicepresidente senior de la empresa, Manuel Ardón, sus abogados contestaron que estas transacciones nunca fueron relevantes para Ecodesarrollo “desde el punto de vista operativo, fiscal o regulatorio”.

Fifco dejó de ser socio de Ecodesarrollo en Costa Rica en el 2012. Al mismo tiempo, en Islas Vírgenes Británicas, le cedió todas sus acciones sobre las compañías que controlaban a Ecodesarrollo a Wings of Papagayo (subsidiaria de Schwan) mediante la creación de una nueva offshore, Península Papagayo Principal Holding.

En el 2016, Gencom, una poderosa firma que se dedica a la hotelería en todo el mundo, compró todas las acciones de Schwan sobre Ecodesarrollo. Ahora, por todas partes hay hombres trabajando en el mejoramiento de las vías dentro del desarrollo.

CONOZCA LA HISTORIA DEL QUE FUE EL MAYOR INVERSOR DE PAPAGAYO

El mayor inversionista del proyecto Polo Turístico Golfo de Papagayo, la fundación sin fines de lucro estadounidense The Marvin M. Schwan Charitable Foundation, perdió al menos $391 millones en sus inversiones inmobiliarias en las islas del Caribe. Varios documentos, incluida una demanda en Estados Unidos en contra de la fundación, también indican que perdió hasta $205 millones en Papagayo.

La Fundación Schwan fue creada por el empresario de Minnesota Marvin M. Schwan, quien hizo una fortuna con el negocio de la comida congelada. Cuando murió, en 1993, dejó bienes y dinero a nombre de la organización con el objetivo de promover la doctrina de la iglesia luterana.

Sin embargo, el patrimonio de la fundación se redujo a la mitad en 20 años, pasando de tener casi $1.000 millones de dólares en 1993 a $449 millones en el 2013, según sus reportes al fisco de Estados Unidos.

Es decir, el mayor concesionario del proyecto turístico más ambicioso de Costa Rica estaba en manos de una fundación con un historial de inversiones fallidas. (Vea nota “Los 7 mandamientos…”).

Para esta investigación no fue posible contar con las respuestas de los involucrados, quienes no contestaron luego de llamadas a su oficina y correos enviados a los administradores de la fundación.

Las pérdidas en Costa Rica Una denuncia presentada en el 2014 por dos de los hijos del fundador Marvin M. Schwan en contra de cuatro de los administradores de la fundación, —que eran los responsables de las inversiones inmobiliarias en Costa Rica—, asegura que las inversiones en Papagayo causaron pérdidas por $205 millones.

"Los administradores financiaron estas inversiones en el extranjero a través de una red elaborada de más de 100 sociedades offshore, filiales, asociaciones y otras organizaciones relacionadas con domicilios legales en las Islas Vírgenes Británicas, Bahamas, Costa Rica, Islas Caimán y Panamá”, señala la denuncia.

En los documentos del bufete ApplebyEstera, analizados por La Voz de Guanacaste, se puede ver a cuatro personas presentes en todas las compañías subsidiarias que realizaban las

inversiones en Bahamas, Gran Caimán y Costa Rica.

Todos eran hombres de confianza del difunto Marvin y fueron los responsables de administrar —y también de disminuir— la fortuna de la fundación Schwan. Sus nombres eran Alfred Schwan, quien murió en el 2011 y era administrador de la fundación; Lawrence Burgdorf, otro administrador que era amigo personal de Marvin y clérigo de la iglesia Luterana; Keith Boheim, el único de ellos con experiencia en negocios y Erick Burgdorf, director ejecutivo de la fundación e hijo de Lawrence.

Todos ellos tenían el poder de tomar decisiones financieras en la fundación y decidieron invertir en el mercado de bienes raíces, uno de los más especulativos y complejos del mundo, invirtiendo y otorgando préstamos a desarrollos basados en confianza y que constantemente presentaban algún problema económico. (Vea Recuadro “Fundación no quiso...”)

“Especulativas por su naturaleza, cada una de las inversiones en el exterior fracasó de manera espectacular, causando que la fundación sufriera pérdidas de cientos de millones de dólares", indica la denuncia.

En los reportes presentados entre 1997 y el 2015 al fisco de Estados Unidos por la fundación, se puede ver que Schwan había invertido al menos $211 millones en Papagayo y otorgado préstamos por $204.5 millones.

La fundación comenzó a invertir fuertemente en el Golfo de Papagayo entre 1999 y el año 2000, al comprar el 70% de las acciones de Ecodesarrollo Papagayo S. A., la mayor concesionaria de Papagayo, junto a la empresa costarricense Fifco, que tenía el 30% restante de las acciones.

Ambos inversores, Fifco y la Fundación, crearon sociedades offshore en las Islas Vírgenes Británicas, Gran Caimán y Bahamas para desarrollar el Hotel Four Seasons Papagayo (inaugurado en 2004), la Marina Papagayo (inaugurada en 2008), las residencias, el campo de golf y ceder algunos terrenos a terceros. (Vea nota “Mayores inversionistas…”)

La sociedad entre Fifco y la fundación sufrió un cambio drástico en el 2012, cuando la empresa costarricense le canjea todas sus acciones de Ecodesarrollo Papagayo S. A. a Schwan a cambio de quedarse con 311 hectáreas sin desarrollar ubicadas en el norte de la península. La compañía costarricense no confirmó a este medio cuáles fueron los motivos de su salida en aquel momento.

Según declaraciones dadas en la denuncia contra los administradores de la fundación por uno de los hijos de Schwan, en mayo del 2013 “(...) los administradores confirmaron que se proyectaba una pérdida adicional de $205

millones en sus inversiones en Costa Rica”.

Schwan continuó en Papagayo hasta agosto del 2016 cuando vendió todas sus offshores al grupo Gencom, empresa dedicada al desarrollo y administración de hoteles. El precio de la venta no trascendió aunque según reportes de la fundación en el fisco de Estados Unidos, su patrimonio en Costa Rica era de $152 millones.

El mismo año, los hermanos y los administradores de la fundación llegaron a un acuerdo en la corte de Dakota del Sur en el 2016.

Las pérdidas en Bahamas La primera pérdida económica de la fundación ocurre en el 2007, cuando Schwan era accionista mayoritaria de corporaciones que mantenían deudas a raíz de su participación en el hotel Four Seasons de Bahamas.

Paradise Papers Las deudas ascendían a los $142 millones, según consta en un reporte financiero del registro de Bahamas que aparece en la filtración del bufete Applebay-Estera. Ese mismo año el hotel cierra sus puertas.

Dos años más tarde, en el 2009, la cadena de hoteles Sandals compra el Four Seasons por un precio por debajo de su valor en el mercado que, según analistas de publicaciones financieras, era de $300 millones.

El turno de Gran Caimán En Gran Caimán se repitió la receta. En el 2012, el Hotel Ritz-Carlton es subastado debido al incumplimiento de pago por una deuda adquirida en el 2007 por $234 millones. Las deudoras eran compañías en la que, una vez más, Schwan figuraba como accionista y que administraban el hotel.

Además del préstamo, la fundación Schwan había invertido en ese hotel hasta $220 millones en 8 años (1999- 2007). La pérdida total para Schwan fue de $249 millones en Gran Caimán, según la declaración financiera ante el fisco de Estados Unidos.

“La organización en la que hemos invertido no pagó una serie de préstamos y la propiedad fue subastada. Durante ese proceso la organización tuvo una pérdida de más de $249 millones”, dice el reporte presentado por la fundación.

El Hotel Ritz Carlton fue subastado por $177 millones de dólares, un precio drásticamente inferior a su valor, que según el mercado de bienes raíces, era de $400 millones.

La historia de la fundación ha sido un cuento de pérdidas de la cual el golfo de Papagayo no aparenta ser la excepción.

FUNDACIÓN NO QUISO CONOCER ANTECEDENTES DE INCUMPLIMIENTOS DE CONTRATO DE SOCIO INVERSOR A la fundación The Marvin M. Schwan Charitable Foundation no le interesó investigar con quien invertía sus $220 millones en Gran Caimán, a pesar de que su socio, el desarrollador e inversor canadiense Michael Ryan, tenía antecedentes desfavorables por incumplimientos de contratos, incluyendo una denuncia en Costa Rica.

La inversión en el Hotel Ritz-Carlton terminó con grandes pérdidas para ambos inversores.

La empresa que compró la deuda del Hotel Ritz-Carlton encontró que Ryan supuestamente había estado usando el dinero para otros fines que los estipulados y lo demandó por “mal uso de fondos”.

Así se lee en los archivos del bufete ApplebyEstera, firma legal que usaba Michael Ryan para sus inversiones en Gran Caimán y cuyas filtraciones se utilizan ahora como base para este reportaje.

Antes de Gran Caimán, Ryan había invertido en Guanacaste durante la década del 90, momento en que prometió desarrollar el proyecto inmobiliario en Punta Cacique, entre Playa Hermosa y Playa Panamá.

Este proyecto también resultó un fracaso, luego de instalar los servicios básicos y vender algunos lotes a extranjeros, fue denunciado ante la comisión del consumidor por incumplimiento de contrato y la comisión le ordenó devolverle la plata que su cliente –el denunciante– gastó en la compra de lotes.

Mientras Ryan invertía en nuestro país, la empresa familiar de desarrollo que tenía

en Canadá junto a su padre también recibía denuncias por incumplimientos de contrato, según una carta escrita por Lawrence Burgdorf, administrador de la fundación.

En 1997, Ryan fue demandado por fraude y una corte en Canadá lo condenó a resarcir monetariamente a sus víctimas, indican documentos legales del sitio web www. offshorealerts.com Los emails filtrados de Appleby-Estera muestran que los directivos de Schwan sabían de los antecedentes negativos de Ryan pero en ningún momento dudaron en invertir con él.

Cuando en el 2007 el canadiense recurre a la aseguradora internacional Column Financial Inc-Credit Suisse en busca de un refinanciamiento de un préstamo para el hotel Ritz Carlton, Lawrence Burgdorf, uno de los administradores de los fondos de la fundación, escribe una carta a la aseguradora diciendo: “(…) tenemos un conocimiento general de las causas judiciales involucradas en el proyecto (del hotel Ritz Carlton) y a pesar de que no hemos hecho una investigación independiente, no creemos que vayan a tener un impacto material”.

Burgdorf, dice en la carta a favor de Michael Ryan: “En el transcurso de los años hemos invertido más de $220 millones en el proyecto y jamás hemos sido influenciado por estas disputas”.

Así, respaldan la solicitud de refinanciamiento de $234 millones para terminar la construcción del hotel Ritz-Carlton, millones de dólares que terminan perdiendo.

Desde acá nos señala el hotel Four Seasons y la marina de Papagayo, proyectos que se levantaron en una zona que Costa Rica imaginó desde los años 70 como un motor para la inversión en Guanacaste: el Polo Turístico Golfo de Papagayo (PTGP), hoy administrado por el Instituto Costarricense de Turismo (ICT). ¿Por qué prevalece esta desidia de los guanacastecos con el desarrollo de Papagayo?

Investigamos con esta pregunta en mente y encontramos que, 46 años después de su creación, el Polo arrastra y crea “mandamientos” que le impiden rendir los frutos esperados con su creación.

1. Crearás leyes y reglamentos sobre todas las cosas Al principio, el ICT disponía de unas 2.000 hectáreas para que inversionistas nacionales y extranjeros desarrollaran sus proyectos. El Estado concesionaría sus tierras, pero no tenía claro cómo.

La creación del Polo requirió de leyes, reglamentos a las leyes, planes maestros, reglamentos a los planes maestros y contratos de concesión, entre otros documentos.

El país creó al menos tres leyes solo para darle forma al desarrollo y la ejecución del proyecto entre 1975 y 1982. Por aparte definió las condiciones en las que debería operar el Polo y las obligaciones de los interesados. Para ello estableció, 16 años después (en 1996), un reglamento a la última ley emitida, la N°6758.

“Esto es de los ricos ahora. Yo hago viajes en lancha para llevar a los turistas a ver caballitos de mar. Salgo de allá, de playa Blanca, que es de un hotel. Imagínese que para llegar a esa playa hicieron puras gradas, solo para quitarle a uno las ganas de ir”, nos dice el guía turístico Jaime Pozuelo en Playa Panamá.

Además, desarrolló un Plan Maestro para poder visualizar con claridad cómo tendría que verse el Polo y qué obras debía contener.

Ese Plan lo corrigió en cuatro ocasiones, hasta llegar a su texto más claro en el 2008.

Cada documento nuevo era más importante que el otro y cada uno trataba de solventar algún vacío que el otro dejaba al descubierto.

El Plan Maestro tampoco era suficiente: requería de un reglamento para terminar de girar instrucciones. El más reciente fue emitido en el 2012, tras múltiples cambios en sus

artículos. Para entonces, ya habían pasado casi dos décadas.

Como si fuera poco, se suman contratos de concesión entre los interesados en desarrollar las obras y el Estado, y modificaciones (adendas) a cada uno de esos contratos.

Para el Centro para el Turismo Responsable (CREST por sus siglas en inglés), una organización de investigación enfocada en analizar el turismo a nivel internacional, las constantes reformas, modificaciones, adiciones y derogaciones de decretos solo dejaron en evidencia la falta de previsión de las autoridades y, sobre todo, la improvisación en la toma de decisiones.

2. No conocerás a los concesionarios Mientras el marco legal del proyecto tomaba forma, el ICT otorgaba sus primeras concesiones entre el 91 y el 98. Entre ellas, la del único concesionario “maestro” o “gran concesionario” del proyecto: Ecodesarrollo Papagayo S.A., acreedor de 851 hectáreas, un 41% del total del área del Polo. (VEA línea del tiempo) Incluido Ecodesarrollo, hoy ya suman 40 las empresas a las que el ICT les ha concesionado terrenos, pero ¿cuánto conoce el Estado a los dueños temporales de sus propios terrenos?

Según establece el reglamento de la Ley, los concesionarios deberán presentar únicamente una declaración jurada para dar fe de que cuentan con la capacidad económica para la ejecución de los proyectos. El otro documento es un certificado que demuestre que no tiene antecedentes penales.

“Nosotros nos preguntamos ¿es oportuno, es conveniente? si eso se responde, entonces se da la concesión. Para efectos nuestros, lo importante es que el proyecto se desarrolle”, sostuvo el director de la oficina ejecutora del proyecto en el ICT, Henry Wong.

Un concesionario, además, tiene el derecho de cederle una parte de su concesión a un tercero. Una vez más, lo que el Estado solicita de ese nuevo inquilino es mínimo: que el concesionario notifique con anticipación al ICT del movimiento y declarar que tiene capacidad económica para desarrollar las obras.

“Nosotros tenemos certeza de que las empresas tienen recursos cuando asumen una concesión, pero hasta ahí llegamos nosotros. Lo que las empresas pacten entre sí es a lo interno de ellas y el Instituto no se mete”, explicó Wong.

Así, el camino está abierto para todos, para cualquiera.

3. No desarrollarás lo que te propones Si bien el ICT asegura que un 97% del área total del Polo se encuentra concesionada, esto no es sinónimo de éxito, pues sus dueños temporales no terminan de desarrollar las obras, pese a que la mayoría de las concesiones tienen más de 10 años de haber sido entregadas.

Paradise Papers De las 40 concesiones que tiene el polo, solo 12 reportan sus proyectos como finalizados.

Otra gran promesa sin cumplir es la de levantar “un pueblo turístico” en Playa Panamá, que estaba contemplado desde la primera ley.

Una parte de esa tarea la asumió Ecodesarrollo en su contrato de concesión y, en una de sus adendas, la empresa aseguró que presentó los planos, pero no hay ningún documento que detalle cómo será ese pueblo.

“Existe una obligación de construirlo… podría tener una plaza de toros, iglesia, locales comerciales, parques, pero no existe una definición especifica de qué tipo de pueblo (sería)”, reconoció Wong, quien no toma las decisiones Lo mismo sucede con la obligación que la ley le da al ICT de construir un centro recreativo para los adultos mayores de las comunidades del Polo, otro proyecto que nunca empezó y que el Instituto desconoce cuándo se cumplirá.

4 Todo será culpa del agua Varias son las justificaciones que da el ICT para que sus concesionarios no cumplan con sus objetivos. Una de ellas, y la más importante, es el faltante de agua en la provincia.

Según el Instituto, al menos 13 concesionarios tienen proyectos paralizados por falta de recurso hídrico. Tampoco están otorgando nuevas concesiones hasta solucionar ese problema.

Entonces, ¿la escasez de agua limita a al Polo desde los 90´s cuando se dieron las primeras concesiones?

“Sí sí ustedes tienen razón, el tema del agua no ha estado presente siempre, es correcto. Pero bueno también vino la crisis internacional y los inversionistas no pudieron continuar con sus proyectos...”, justifica Wong.

El ICT deposita sus esperanzas en el nuevo acueducto en Papagayo Sur conocido como las Trancas, que tendrá un costo aproximado de ¢3.500 millones aportados con la mayoría de lo que ha cobrado el ICT como canon por concesionar las tierras. En el pasado, el Instituto solo invirtió un 10% de ese dinero en obras para la comunidad.

5. Repetirás los mismos errores una y otra vez Al menos dos estudios de las mismas instituciones del Estado critican fuertemente la labor del ICT en el Polo. En el 2008, la Contraloría General de la República (CGR) criticó, en su informe N° DFOE-ED-5-2008, la falta de fiscalización del Instituto sobre las concesiones ya otorgadas y apuntó otra serie de debilidades en la ejecución.

“Se carece de un eficiente sistema de planificación (…) que permita conocer cuándo se terminarán de concesionar los lotes libres del proyecto, cuándo se espera se finalicen las obras pendientes por parte del ICT y cuándo efectivamente los concesionarios actuales finalizarán los proyectos turísticos a que se comprometieron”, indicaba una de sus conclusiones.

El ente contralor dio por acatadas sus recomendaciones en el 2012. Sin embargo, en el 2016, una Auditoría Interna del ICT vuelve a señalar los mismos errores.

De acuerdo con el documento, la institución no cuenta con cronogramas actualizados de los proyectos de infraestructura, no posee sistemas de gestión automatizada que aseguren la eficiencia y seguridad de la información, y tampoco cuenta con evidencia de inspección en

beneficios y privilegios la totalidad de las concesiones. “¿Cómo pretende el ICT ejecutar un proyecto de esta envergadura sino se cuenta con una hoja de ruta clara a seguir?”, sostuvo en una intervención en el plenario la diputada Maureen Clarke, del Partido Liberación Nacional (PLN), cuyo despacho se ha dedicado a investigar al proyecto.

6. Beneficiarás a quienes no lo necesiten El objetivo principal del ambicioso proyecto que imaginaron los políticos en los 70’s prometía beneficiar sobre todas las cosas a la comunidad. Pese a la generación de empleo en la zona y los programas de responsabilidad social empresarial de algunos hoteles, el dinero que logra recoger el ICT y las comunidades para su propia planificación está en duda.

Por ejemplo, los concesionarios pagan el canon de concesión una única vez por un monto de ¢1.800 por metro cuadrado ($3.04). Para el exlegislador José María Villalta, quien critica los verdaderos beneficios del Polo, se trata de un valor muy por debajo de lo que realmente valen.

“Estamos dando beneficios y privilegios a concesionarios que no lo necesitan, ahí no hay pequeñas empresas, son megaproyectos y deberían pagar por el uso de esa tierra el valor real”, sostuvo.

Tanto el exdiputado como el CREST y la Contraloría indican que las afectaciones también impactan a las municipalidades de Carrillo y Liberia, administraciones sobre las que se construyen las obras del Polo.

El ICT se ampara en que, fuera del pago de concesión, los inquilinos deben de pagar igual que cualquier otro empresario que desarrolle un proyecto a nivel nacional. Aunque la realidad es otra.

A los gobiernos locales les corresponde recaudar, entre otros impuestos, un canon anual por el uso de la zona marítimo terrestre. Este canon sustituye el impuesto territorial que se cobra en áreas de propiedad privada.

Sin embargo, la Administración de Oscar Arias en el 2010 redujo la base de cálculo de esos ingresos para las municipalidades de $3.04 a $1, según consta en el Decreto Ejecutivo N°35962 MP-TUR. “La nueva reglamentación del canon de Papagayo causa una pérdida de más de ¢600 millones anuales a los municipios. Hay un proyecto de ley que busca modificar esto (el N°18.072) porque estamos tratando con montos ridículos y que se calculan diferente que para el resto del país”, continuó Villalta.

El informe del CREST señala que es difícil evaluar el impacto de las empresas concesionarias, pues ni el propio ICT tiene estudios acerca de cómo han contribuido, por ejemplo, los incentivos fiscales al desarrollo integral y sostenible del país.

El ministerio de Hacienda tampoco provee esta información sobre grandes contribuyentes,, pues lo tiene prohibido por ley.

Es justamente ese desconocimiento general el que crea incertidumbre y alimenta sentimientos como el de don Jaime en playa Panamá, que siente que estas tierras ya no le pertenecen.

The company’s executives declined to grant an in-person interview to The Voice of Guanacaste seeking further details and they didn’t respond with specifics to several of the questions sent via email to their press department. Rather, they sent a general statement via email.

The directors of the Schwan Foundation didn’t answer questions sent via email and to their office.

For three months this newspaper investigated emails, transactions, investments and trading of shares among companies that controlled Ecodesarrollo Papagayo, documents leaked to the international press from law firms Mossack Fonseca and Applebay-Estera.

Fifco and the Schwan Foundation were - up until 2012 and 2016 respectively - the largest shareholders of Ecodesarrollo Papagayo, the company they used in Costa Rica to channel investment funds from tax havens into the tourism development. In fact, it’s the largest licensee in the development. Through 2012, it owned 41% of the land.

These three countries grant major privileges to those who have the financial power to create webs of companies and deposit their fortunes there. While not all the operations that take place are fraudulent (sometimes they take advantage of legal loopholes built into laws), they are often used to avoid or evade taxes: No one asks anything there.

One of the companies used by Fifco to administer its operations in the peninsula was London Overseas, registered in the Cayman Islands. Costa Rica’s tax revenue service, the General Taxation Department (DGT), found anomalies in Fifco’s income tax returns in which they sent money to this company.

In 2005-2006 and 2009-2010 the tax revenue service found that this money had been reported by Fifco as “capital contributions.” But the DGT considered these loans and that Fifco could have earned interest from these loans that they weren’t paying taxes on. As a result, they charged Fifco a ¢2.43 million colon fine ($4.3 million).

Why did they use this method? “If you are hungry and there is a restaurant on the corner, you are going to cross the street, sit down and eat,” explained David Marchant, a U.S. journalist who specializes in offshore companies and who was consulted for this article. “What these companies do is take a taxi, go to the airport, get on a plane for 20 hours, get off, take a bus, take another plane, then do the entire return trip and enter through the kitchen door before finally sitting down to eat,” he continued.

For those of us that are paid every 15 days as our only means of living, it might sound strange that a company would create a subsidiary thousands of miles away to control, from there, its investments. It’s confusing precisely because it’s supposed to be; the strategy is to make some people dizzy while making things easy for others.

Companies stashed their loans, earnings, and transactions in countries like the Bahamas, British Virgin Islands and the Cayman Islands that are not only out of reach to Costa Rica tax authorities, but also they are not charged taxes on these types of activities.

From there, the first developments were orchestrated, such as the Four Seasons hotel and the Marina located in Papagayo, a land that belongs to all Costa Ricans and which the Costa Rican Tourism Institute (ICT) licenses to generate development and bring jobs to Guanacaste. (See note "The 7 commandments ...").

directors. Ecodesarrollo Papagayo S. A. claimed via email that the company does not know why its former shareholders chose a jurisdiction outside of Costa Rica to carry out its business.

It’s very common for companies the size of Fifco to invest large sums of money in well-known law firms, or even have entire departments to do their “fiscal planning,” which is the most politically correct way to call the exhaustive use of legal loopholes that allow large taxpayers to pay as little as possible. In other words, pay the lowest amount of taxes that they can. and the Paradise Papers, two global journalism projects led by the Pulitzer prize-winning International Consortium of Investigative Journalists (ICIJ).

The investigation was also based on Fifco’s financial statement reports, which are public because Fifco is a publicly-traded company on Costa Rica’s stock market the Bolsa Nacional de Valores, and on Schwan’s U.S. tax returns filed with the Internal Revenue Service (IRS). With this information we were able to corroborate the names of the companies that are mentioned in this investigation and those related to them.

The IRS records, in conjunction with the Paradise Papers, were used to uncover the main shareholder of Ecodesarrollo - the Schwan Foundation, whose investments in the Caribbean islands and in Costa Rica resulted in losses of almost $500 million. (Read Story: Meet the Largest Investor).

Fifco’s documents and the Panama Papers were used to develop this story.

Papagayo, Fifco used two offshore companies created in the Cayman Islands as subsidiaries to do business with Schwan for at least eight years. Those companies were London Caribbean Incorporated and London Overseas Incorporated.

The U.S.-based Schwan Foundation, in turn, used two affiliates in the U.S. called Wings of Papagayo and The Kings Foundation Investment Papagayo to channel its investments.

Through these companies, they created eight shell companies between 2000 and 2012 that were born in this order: Hobart Manage Limited, Desarrollo Papagayo Corporation, Península Papagayo Ventures, Península Papagayo Group Corp, Marina Papagayo Holding, Península Papagayo Clubs Inc and, to end its relationship, Península Papagayo Principal Holdings (See Chart “Names and Surnames”).

Whether or not it’s ethical and, above all, whether it’s damaging or not for the countries is a discussion that has been sparked across the globe, including in Costa Rica. In fact, inefficiencies in tax collection (which the Finance Ministry admits to) and existing lax tax laws allow the richest to find alternatives that let them pay fewer taxes while the middle class has no other choice but to pay them because they are automatically withheld from paychecks or added into the price we pay for products we buy when we go to the store. (**SEE COMIC that explains this**) “The less that big companies pay, the more consumers and salaried employees will have to sustain this country, which deteriorates the middle class,” explains Abelardo Medina, specialist from the Central American Institute of Fiscal Studies. “For a country to allow people to not pay taxes requires the administration to raise taxes on consumption in order to cover expenditures, and it’s at that point when all taxpayers are affected,” Medina said.

The game of tax havens is also a hunger game.

In 2005-2006 and 2009-2010, the General Department of Taxation (DGT, entity in Costa Rica in charge of collecting taxes) found a smaller income tax payment than was owed because of an erroneous tax return filed by Fifco with its subsidiary in the Cayman Islands, London Overseas.

Fifco’s financial statements also show that the company also used its offshores to back loans from Scotiabank Cayman Islands to Ecodesarrollo.

According to the DGT, a supposed monetary contribution to strengthen the capital of the company in the Cayman Islands was, in reality, a loan upon which Fifco could have received interest payments that they should have paid taxes on, but they didn’t.

What’s the problem here? Costa Rica has an income tax system in which you report only what you made within the country and therefore these kind of activities can be used to elude or hide operations that, in appearance, were done in other countries.

What was Fifco Using Companies in Tax Havens for?

Before 2012, the Panama Papers show that Fifco had at least $14.8 million worth of shares invested in the offshore company Península de Papagayo Ventures and another $6.8 million in another one called PP Holdings.

Despite the fact that Fifco was a direct shareholder in Ecodesarrollo Papagayo S. A. it hasn’t made a single direct investment in the company since 2005. It directed all the investments through its offshore companies shared with Schwan in tax havens, according to

Fifco quit doing business with the U.S. foundation in 2012 when it agreed to transfer all its shares in the companies that Ecodesarrollo Papagayo controlled to another company and, in exchange, received 311 undeveloped hectares (768 acres) in the northern part of the Peninsula, where they have already announced large developments.

In a statement made to the newspaper La Nacion in April last year, Rodolfo Jimenez Borbon explained that they formed the companies in tax havens because the main partner, the Schwan Foundation, wanted to do business in “neutral territory.”

Nevertheless, their financial statements reveal that this wasn’t the only aim. Until 2016, London Caribbean and London Overseas continued to appear as subsidiaries of the company.

Meanwhile, Guanacastecans and, above all, residents of Liberia continue wondering who really gained from Papagayo. The answer is in another paradise, thousands of miles from here.

The Guaco is a complex that creates jobs for residents in the communities of Sardinal, Coco, San Blas, La Libertad and Playa Panamá. This initiative currently generates 142 direct and indirect jobs.

How does it work? The Guaco links up

projects or organizations that work in tourism, culture and agriculture. It benefits 1,482 people directly and indirectly who receive tourists and coordinate cultural and agricultural activities.

“No only do we support initiatives of buying and handing over land, we also believe in rescuing cultural tranditioins and gastronomy that defines the Guanacastecan,” Inder’s Executive President Ricardo Rodríguez said.

“We bought the land and are still accompanying this unique initiative in the country.”

El Guaco was planned in three parts. The first phase started in 2016 and the final part is

expected to end in 2020. The first phase which is underway includes the construction of the gastronomic module, which consists of a restaurant and a tortilla stand, public restrooms and improvements to the landscape. Inder supported this phase with ₡690 million ($1.23 million).

For the second phase, Dinadeco gave ₡96.543.855 ($172,399.00) for the construction of a new arena and ₡73.791.839 ($131,771.141) to purchase equipment and furniture for the restaurant and the offices.

The third phase will include an amphitheatre

for large events and livestock activities.

Guaco is also working with the Zone Union of Integral Development Associations (Uzadis), Dinadeco, the Labor Ministry and the Social Security Institute, Funes-OIT, Banco Popular, the Costa Rican Tourism Institute and the Agriculture and Ranching Ministry.

Uzadis has invested ₡65 million ($116,071) while Banco Pupular has put in ₡111 million ($198,214). The project has received more than ₡1 billion in investment.

This is How Investments in Papagayo were Moved Via Tax Havens Have you ever stopped to observe the intricate work of a spider web? Imagine that in each knot of the web there is a name. Each name represents a corporation and three or four more threads spin out of it with other names at the end, names of people and corporations.

Expand your viewpoint and you will see how many names are repeated in each node and in each corporation. Then, transport that web to the Caribbean, locate it in the Bahamas, the Cayman Islands and the British Virgin Islands and you will see the most delicate and elaborate web of offshore companies in Guanacaste.

That web is what sustained the real estate development of the largest licensee on the Papagayo peninsula, Ecodesarrollo Papagayo, for at least 15 years.

On September 21, 2000, a lawyer from Mossack Fonseca in the British Virgin Islands started to weave the fabric of this network.

Ecodesarrollo Papagayo and the Schwan Foundation were the first shareholders of a new company that that same lawyer registered that day in the British Virgin Islands. It was called Desarrollo Papagayo Corporation.

They formalized it with few registered shares and, two years later, they injected it with capital so that they could dispense funds from there for the development of the Four Seasons Hotel on the Papagayo peninsula, according to a shareholder agreement leaked in the Panama Papers and dated November 1, 2002.

In order to do this, Ecodesarrollo contributed $21 million in capital and Schwan pitched in $12.6 million. Schwan would also grant a loan to this new company for an additional $8 million to be paid by a third partner called Four Seasons Hotel, registered in Barbados (another tax haven).

Desarrollo Papagayo Corporation should use all these capital injections strictly for buying shares from Grupo Istmo de Papagayo, a company created in Costa Rica to build the Four

Seasons Hotel.

In 2002, Schwan and Ecodesarrollo stopped appearing as shareholders of Desarrollo Papagayo Corporation as well as the rest of the companies. In its place its subsidiaries are the ones that make the decisions, although the executives that sign off on the decisions are still the same people. Sometimes they appear as having power of attorney and other times as presidents, but their names repeat infinitely in all the documents.

After the construction of the Four Seasons Hotel, the marina followed. For the marina an offshore company was also created in 2006 called Marina Papagayo Holding Limited, which controlled the shares. Later, they created others for other developments and services.

In large part, the companies that were created bare the name of Ecodesarrollo’s CEO, Alan Kelso Machado, as having general power of attorney or unlimited general power of attorney.

Via email sent through the company's Senior Vice-President Manuel Ardon, his lawyers responded that these transactions were never relevant for Ecodesarrollo “from the operational, fiscal or regulatory point of view.”

Fifco quit being a partner of Ecodesarrollo in Costa Rica in 2012. At the same time, in the British Virgin Islands, it transferred all its shares in the companies that controlled Ecodesarrollo to Wings of Papagayo (Schwan’s subsidiary) through the creation of a new offshore, Peninsula Papagayo Principal Holding.

In 2016, Gencom, a powerful, global firm in the hotel industry, bought all of Schwan’s shares in Ecodesarrollo. A walk by its land shows the impact that the acquisition had on the tourism complex: there are men everywhere working to improve the roads and the Four Seasons has been closed for months for remodeling, as well as the Hyatt and other developments that Gencom bought.

LEARN THE STORY BEHIND PAPAGAYO’S LARGEST INVESTOR • A foundation in the United States may have lost $500 million in the Four Seasons Hotel Papagayo, the Ritz-Carlton Grand Cayman and the Four Seasons Hotel in the Bahamas.

The largest investor in the Gulf of Papagayo Tourism Development, The Marvin M. Schwan Charitable Foundation, a U.S. foundation, lost at least $391 million on its real estate investments in the Caribbean islands. Several documents, including a lawsuit in the U.S. against the foundation, also show that it lost as much as $205 million in Papagayo.

The Schwan Foundation was created by Minnesota business magnate Marvin M. Schwan, who made his fortune in the frozen food business. When he died in 1993 he left property and money in the name of the foundation

with the goal of promoting the doctrine of the Lutheran church. The initial capital at the time of it’s creation was close to $1 billion.

Nevertheless, the foundation’s net assets were cut in half in 20 years, falling from $1 billion in 1993 to $449 million in 2013, according to its U.S. tax returns filed with the Internal Revenue Service (IRS).

In other words, the largest licensee of Costa Rica’s most ambitious tourism project was in the hands of a foundation with a history of failed investments. (See story The Seven Commandments.)

For this investigation, we were unable to obtain responses from those involved. They didn’t answer calls at the office nor emails sent to the foundation’s managers.

Losses in Costa Rica A complaint filed in 2014 by two sons of founder Marvin M. Schwan against the foundation’s managers — who were responsible

for the real estate investments in Costa Rica — claims that the investments in Costa Rica caused losses of $205 million.

"The trustees funded these offshore investments through an elaborate network of over 100 holding companies, subsidiaries, partnerships, and other related organizations with legal domiciles in the British Virgin Islands, the Bahamas, Costa Rica, the Cayman Islands, and Panama”, the complaint says.

In documents found inside ApplebyEstera law firm and analyzed by The Voice of Guanacaste we found four people present in all the companies related to the investments in the Bahamas, the Cayman Islands and Costa Rica responsible for administering and diminishing Schwan’s fortune.

The magnate’s closest confidantes were his brother Alfred Schwan, who died in 2011 and one of the foundation’s manager; Lawrence Burgdorf, another manager that was a personal friend of Schwan and a clergyman in the

Lutheran church; Keith Boheim, the only one of the four with business experience, and Erick Burgdorf, son of Lawrence and the foundation’s executive director.

All of them had the power to make financial decisions in the foundation and decided to invest in the real estate market, one of the most speculative and complex in the world. They invested in that market and granted loans to developments based on trust and that were constantly having economic problems. (See Graph The Foundation Didn’t Want…)

“Speculative by their very nature, each of the trustees’ offshore investments failed in spectacular fashion, causing the foundation to suffer losses of hundreds of millions of dollars,” the document continues.

Tax returns sent to the IRS between 1997 and 2015 show that Schwan had invested at least $211 million in Papagayo and granted loans for $204.5 million.

Panama Papers Paradise Papers 1999 and 2000 when it bought 70% of the shares of Ecodesarrollo Papagayo S. A, the largest licensee in Papagayo, along with the Costa Rican Company Fifco (Cervecería de Costa Rica) which held the remaining 30% of the shares.

Both investors created offshore companies in the British Virgin Islands, the Cayman Islands and the Bahamas to develop the Four Seasons Resort in Papagayo, the Papagayo marina, residences, the golf course and to transfer some of the land to third parties.

The company formed between Fifco and the foundation suffered a drastic change in 2012 when Fifco traded all its shares in Ecodesarrollo Papagayo S.A. to Schwan in exchange for 311 undeveloped hectares (790 acres) located in the northern part of the peninsula. Fifco did not confirm to this newspaper its reasons for exiting at that particular moment.

According to statements made by one of Schwan’s sons in the complaint against the foundation’s managers, in May 2013 “the managers confirmed that they projected an additional loss of $205 million in its investments in Costa Rica.”

Schwan continued in Papagayo until 2016 when it sold all its offshore companies to Gencom Group, a company devoted to developing and administering hotels.

The sale price wasn’t leaked, but according to the foundation’s U.S. tax returns its investment in Costa Rica was $152 million.

Losses in the Bahamas The foundation’s first economic loss occurred

The hotel closed its doors after the insurance company that lent it funds filed a complaint because the debtor corporations, of which the foundation was the largest shareholder, broke payment terms.

"IRR Limited (corporation) in whom the organization had invested, defaulted on a series of loans and the property was auctioned off by creditors. During the course of these events, the organization realized losses of over $249,000,000,” the foundation's report says.

In 2012, the Ritz-Carlton Hotel was sold at auction due to its failure to pay $234 million in debt it acquired in 2007. The debtors were companies in which Schwan was a shareholder and administered the hotel.

Besides the loan, the Schwan Foundation had invested as much as $220 million in the hotel over the course of eight years (1999-2007). The total loss for Schwan totalled $249 million in

The Schwan Foundation Didn’t Want to Know its Investment Partner’s Breach of Contract History The Marvin M. Schwan Charitable Foundation wasn’t interested in researching who it was investing $220 million on Grand Cayman with, despite the fact that its partner, Canadian developer and investor Michael Ryan, had an unfavorable record of breaching contracts and even had a complaint filed against him in Costa Rica.

Canada with his father was reported for breach of contract, according to a letter written by Lawrence Burgdof found in the leaked emails.

The investment in the Ritz-Carlton Hotel in Caiman ended up in large losses for both investors. The company that bought the Ritz-Carlton’s debt discovered that Ryan had supposedly been using the money for purposes other than those stipulated and sued him for misuse of funds.

Leaked emails from Appleby-Estera show that the directors of Schwan were aware of Ryan’s negative history, but they never doubted investing in him.

That’s how the archives read from the law firm Appleby-Estera read, a law firm that MIchael Ryan used for his investments on Grand Cayman Island and whose leaked documents are the basis for this report.

Before the Cayman Islands, Ryan had invested in Guanacaste in the 1990s when he promised to develop a real estate project in Punta Cacique, between Playa Hermosa and Playa Panamá.

This project was also a failure. After installing basic services and selling some lots to foreigners, he was reported to the consumer protection bureau for breach of contract and the bureau ordered him to return the money that the customer —the plaintiff— spent on the purchase of the lots.

In 2007 when the Canadian turned to Column Financial INC-Credit Suisse seeking to refinance a loan for the Ritz-Carlton, Lawrence Burgdorf, one of the managers of the foundation’s money, wrote a letter to the bank saying: “We are generally aware of this ongoing litigation involving the project (RitzCarlton Hotel) and although we have made no independent investigations of these allegations or lawsuits we do not believe they will have any material impact on the project."

Burgdorf, said in a letter supporting Michael Ryan that “over the years we have invested well over $220 million dollars in the project and we have never been influenced in our decisions by these disputes.”

With that, Burgdorf backed the request for refinancing $234 million to finish construction of the Ritz-Carlton Hotel and millions of dollars end up lost.

As if that weren’t enough, add to it the license contracts, contracts between those interested in developing the development and the state, and modifications (addendums) to each one of those contracts.

While the project’s legal framework was taking shape, the ICT issued its first licenses between 1991-1998. Among them was the project’s “master” licensee, or the “big licensee:” Ecodesarrollo Papagayo S.A, which received 851 hectares (2,102 acres), or 41% of the development’s total area (SEE timeline)

Why does this apathy for the Papagayo development exist among Guanacastecans?

We investigated with this question in mind and we found that 46 years after its creation, the development drags on and creates “commandments” that impede its ability to bear the fruits that were expected with its creation.

Including Ecodesarrollo, there are 40 companies that the ICT has licensed out land to, but how much does the state know about the temporary owners of its own land?

1. You will create laws and regulations about everything At its beginning, the ICT made 2,000 hectares (4,942 acres) available to national and foreign investors to develop their projects. The state would license out the land, but it wasn’t clear how.

The creation of the development required laws, regulations for those laws, master plans, regulations for the master plans, contracts for licenses and other documents.

The country created at least three laws between 1975 and 1982 just to create the development and execute the project. It also defined the conditions that the development must operate within and the requirements for those interested. For that, it established a regulation 16 years later (in 1996) for the last law that was passed, law No. 6758

required a set of regulations to give instructions.

The most recent was published in 2012 after multiple changes to its articles. By then, almost two decades had already passed.

It also developed a master plan to be able to clearly visualize what the development would look like and what buildings and works it should have. That plan was corrected on four occasions, until the most clear version of the text was passed in 2008.

Each new document was more important than the previous one and each one tried to fill a void that the previous document left open.

According to the law’s regulations, the licensees must present a sworn affidavit testifying that they have the economic capacity to build the projects. The other document is a certificate that shows that they have no criminal history.

“We ask ourselves, is this opportune, is this convenient? If that is answered, the licenses are granted,” said Henry Wang, director of the project’s office for implementation. “For our purposes, the important thing is that the project is developed.”

A licensee also has the right to transfer a part of their license to a third party. What the state requests of this new tenant is minimal. The licensee must notify the ICT ahead of time and declare that the third party has the economic capacity to develop its plans.

“We have the certainty that companies have the resources when they receive a license, but that’s as far as we go,” Wong said. “What the companies agree to among themselves, or internally, or with the institute [the ICT], we don’t get involved in that. That way the path is open for all, for anyone.”

3. You won’t develop what you propose While ICT assures that 97% of the total area of the development is licensed out, this isn’t synonymous with success since the temporary owners often don’t finish developing their projects even though the majority of licenses were issued more than 10 years ago.

Another big promise that hasn’t been fulfilled is the construction of a “tourist town” in Playa Panamá that has been under consideration since the first law was passed. Ecodesarrollo assumed a part of that task in its license contract and, in one of its addendums, the company assured that it presented the plans, but there is no document that details what that town will look like.

“There’s an obligation to build it,” Wong said.

“It could have a bull ring, a church, retail spaces, parks, but there is not a specific definition of what kind of town” it would be, recognized Wong, who doesn’t make the decisions.

The same thing is happening with the law’s requirement that the ICT build a recreation center for the elderly from the communities within the development, another project that never began and that the institute does not know when it will be complete.

The ICT places its hopes in the new aqueduct in Papagayo Sur known as Trancas, which would cost approximately ¢3.5 billion ($6.25 million), largely paid for by what the ICT has charged in fees for licensing out the land. In the past, the institute only invested 10% of this money in works for the community.

5. You will make the same mistakes over and over again At least two studies by state institutions strongly criticize the ICT’s job at the development. In 2008, Costa Rica’s Comptroller’s Office (CGR) in report No. DFOE-ED-5-2008 criticized the institution’s lack of oversight of the licenses that had been granted and pointed out another series of weaknesses in the execution.

There are various justifications that the ICT provides as to why the licensees don’t meet their goals. One of them, and the most important, is the lack of water in the province.

“It lacks an efficient planning system (...) that would allow us to know when the licensing of open lots at the project would be done, when the ICT would finish pending works and when the current licensees would finish the tourism projects that they committed to,” the report indicated in its conclusions.

According to the institute, at least 13 licensees have their projects paralyzed over a lack of water. They aren’t issuing new licenses until this problem is solved.

The Comptroller’s Office said in 2012 that its recommendations had been fulfilled. But in 2016, an internal audit of the ICT points out the same mistakes again.

So, have water shortages limited the development ever since the 1990s when the first licenses were issued?

According to the document, the institution doesn’t have updated timelines for infrastructure projects, it doesn’t have automated management systems that ensure efficiency and security of information, nor does it have evidence of

“How does the ICT plan to execute a project of this size if it doesn’t have a roadmap to follow?” said National Liberation Party congresswoman Maureen Clarke during a plenary session speech. Her office has been investigating the project.

The local governments are in charge of collecting taxes and an annual fee for the use of the maritime-land zone. This fee substitutes the property tax that is charged on private properties.

6.You will cut deals for those who do not need it The objective of the ambitious project that politicians imagined in the 1970s was to benefit the community above all else. Despite the creation of jobs in the zone and the social responsibility programs that some hotels have implemented, the money that the ICT and communities collect for their own planning is in doubt.

For example, the licensees pay a one-time fee of ¢1,800 ($3.04) per square meter. For former lawmaker José María Villalta, who criticizes the development’s true benefits, that amount is way below what it’s really worth.

“We are giving benefits and privileges to licensees that don’t need it,” he said. “There are no small business there. There are mega-projects and they should pay a real value for the use of that land.”

The former lawmaker, CREST and the Comptroller’s Office indicate that the effects of the development also impact the towns of Carrillo and Liberia, administrations upon which the development’s works are built.

The ICT shields itself with the argument that, outside of the license fee, tenants must pay the same as any other business owner that develops a project anywhere in the country. But the reality

Nevertheless, the administration of former President Oscar Arias in 2010 reduced the rate for this tax for local governments from $3.04 to $1, according to Executive Decree No. 35962 MP-TUR. “The new regulation for the fee in Papagayo causes losses of more than ¢600 million ($1.07 million) annually for local governments,” Villalta said. “There is a bill that seeks to change this (bill No. 18.072) because we are talking about ridiculously low amounts that are calculated differently than they are in the rest of the country.”

7.You will not know the impact of your actions Other than a private investigations done by a few lawmakers, there is no way to officially know what the development’s social and financial impact will be on Guanacaste and on Costa Rica.

The CREST report points out that it’s difficult to evaluate the impact of businesses that received licenses, and not even the ICT has studies on how tax breaks for integral and sustainable developments in the country have contributed.

This general lack of knowledge is what creates uncertainty and feeds sentiments like that of Jaime in Playa Panamá, who feels that these lands no longer belong to anyone except the rich.

Dice la empresa que nos pone las cervezas bien frías sobre la mesa de la cantina, Fifco, que su presencia en paraísos fiscales era una visita ocasional alimentada por la insistencia de la fundación Schwan, que era su amiga en el proyecto de mayor envergadura de Papagayo: Ecodesarrollo. “¿Y si Schwan le dice que se tire de un puente, usted lo hace?”, le preguntaría la mamá.

Pero como Fifco no tiene mamá, los especialistas en el campo se lo dicen: nadie (o muy pocos, para no pecar de absolutistas) se toma el trabajo de sacar miles de millones de dólares de Costa Rica, crear siete, ocho, nueve sociedades de papel en paraísos fiscales, pagarle a cuatro o cinco bufetes de abogados distintos por esas transacciones para, al final de cuentas, terminar invirtiendo en un proyecto que tiene en Costa Rica, si no está escondiendo algo.

En ese terreno, bien plano pero también muy cuestionado, decidieron jugar Fifco, Schwan y otros cientos de empresarios del mundo.

Llegado este punto debemos aclarar algo: nada de esto nos importaría si no fuera porque esos hoteles y casas y campos de golf lujosísimos de Ecodesarrollo están construidos sobre una tierra que le pertenece al Estado. Es decir, una tierra que, lo quieran o no, le pertenece a los guanacastecos, a todos los costarricenses.

Siendo justos, diremos que esconder dinero no significa hacer algo ilegal, pero en el fondo esta no es una discusión de lo que es legal o ilegal (ni siquiera de lo que es moral o inmoral) sino de lo que permanece en secreto, lejos del ojo de Tributación y lejos del entendimiento de los ticos (que vamos a repetir, son los dueños de esa tierra).

Fíjese que para entender este embrollo en el que estaba metido Fifco —que no es poco común entre cualquiera que tenga más plata que todos los guanacastecos de clase media juntos—, este medio de comunicación se sumergió en miles de expedientes que permanecían ocultos en Islas Vírgenes Británicas y Bahamas y que solo salieron a la luz pública junto a otros millones de documentos porque en algún momento, alguien que tenía acceso a esta cantidad de secretos decidió contarlos de una vez por todas.

Quizás no descubrimos aquí un escándalo de corrupción al mejor estilo del cementazo, pero sabemos algo que también queremos que usted sepa: los más ricos tienen la posibilidad de llevarse su dinero a otros países que no cobran impuestos y dejar de pagarlos aquí, donde otros como nosotros, los de la clase media tirando a media pobre seguimos pagando lo que nos toca (aunque sea porque no nos queda de otra).

Nunca estará mejor empleada la frase “pagan justos por pecadores”.

Como pasa con algunos secretos, uno podría pensar que sería mejor permanecer en la absoluta ignorancia a saber algo que solo le va a regar las bilis sin poder hacer nada, pero ese es el primer error: siempre se puede hacer algo. Sobre todo ahora, de cara a las elecciones presidenciales.

Antes de que se enoje porque le vamos a hablar de política, sepa que no, que solo le vamos a decir esto: póngale atención a los candidatos que le hablen de impuesto sobre la renta, de lucha contra el fraude fiscal, de transparencia y de leyes fiscales en general… esos —y no los que le mienten diciendo que ese tema no hace falta porque es muy complicado— son los verdaderos valientes de nuestros tiempos.

Since Fifco doesn’t have a mom, field specialists say it to them: no one (or very few to avoid absolutes) takes the time to take billions of dollars out of Costa Rica, create seven, eight, nine shell companies in tax havens, pay four or five different law firms for those transactions so at the end of the day it can invest in a project that it has in Costa Rica, if it has nothing to hide.

On that very flat, but very disputed land, Fifco, Schwan and several hundred other business owners decided to play.

At this point we must clear something up: None of this would matter to us if it weren’t the case that those luxurious hotels and houses and golf courses of Ecodesarrollo’s were built on land that belonged to the state. In other words, land that, like it or not, belongs to Guancastecans and all Costa Ricans.

Being fair, we must say that hiding something doesn’t equate to doing something illegal, but at its core this isn’t a discussion about what’s legal or illegal, nor about what’s moral or immoral.

Rather, it’s about what stays secret and out of the reach of tax authorities and Ticos who, we repeat, are the owners of this land.

This is a discussion about transparency, about what we have the right to know but never would know if it weren’t for the leaked dossiers that we had access to: Panama Papers and Paradise

In order to understand the mess that Fifco got itself into - which isn’t uncommon among those who have more money than all of Guanacaste’s middle class members combined - this newspaper submerged itself in thousands of files that were hidden in the British Virgin Islands and the Bahamas and that only came to light publicly along with millions of other documents because, at some point, someone who had access to these secrets decided once and for all to share them.

Perhaps we didn’t uncover a corruption scandal here like that of the imported Chinese cement, but we know something that we want you to know too, and that’s that the richest people are able to take their money to other countries that don’t charge taxes in order to avoid paying them here, where others like us in the middle class continue paying our fair share, even though it may be just because we have no other choice. Never will the phrase “paying for the sins of others” be better employed.

As it sometimes happens with secrets, one could think that it would be better to stay completely ignorant rather than to know something that is only going to ruffle your feathers without having the ability to do anything about it, but that’s the first mistake.

Something can always be done, above all now with presidential elections just around the corner.

Before you get mad because you think we are going to talk to you about politics, we aren’t. We are just going to say this to you: Pay attention to the candidates that talk about income taxes, the fight against tax fraud, transparency and tax laws in general. Those candidates - and not the ones that lie and say it’s not necessary to discuss this topic because it’s very complicated - are the truly brave of our time.

Ana Vargas ayuda a su madre Ángela Jiménez a levantarse de una colchoneta para que vaya al baño. Hace cinco días que esta espuma sobre el suelo es la cama en la que la mujer, de 48 años, convalece de fiebre y dolor de cuerpo causados por una infección respiratoria. Ángela y toda su familia se refugian aquí, en la Escuela Mixta de Bolsón, desde hace trece días, cuando la emergencia de Nate alzó la alerta roja en toda Guanacaste.

Aunque era una tormenta, Nate dejó estragos más importantes que el huracán Otto en la provincia. La familia Vargas Jiménez es prueba de ello: no solo pertenece al grupo de 11.000 personas desplazadas por la emergencia en todo el país, sino que todavía hoy, 16 de octubre, tiene que permanecer albergada en la escuela. Ángela tiene dos nietos con asma (Samanta, de cuatro años y Antonio, de nueve), quienes podrían empeorar si regresan a lo que antes era su casa y que ahora es apenas un cascarón

húmedo que amenaza con derrumbarse sobre sus cabezas. Ángela cuenta que la trabajadora social ha insistido en que no deben volver, pero cuando los estragos de la tormenta comienzan a mermar, la comunidad también empieza a presionar para que se reanuden las clases en la escuela, donde no podrán permanecer por mucho más tiempo.

“La llena” Llegar a Bolsón, al menos desde Filadelfia, sigue siendo complicado: hay que manejar media hora por una calle de lastre entre campos de arroz y caña destruidos por las inundaciones y todavía hay árboles que bloquean el camino y zopilotes que devoran los cadáveres de animales arrastrados por el agua.

Bolsón fue una de las comunidades más afectadas por Nate porque está rodeada de tres ríos que se desbordaron. “La llena”, como le llaman sus habitantes a las inundaciones, los dejó incomunicados durante cuatro días.

El nivel del agua llegó a tal punto que tapó las casas, obligó a las personas a recorrer sus calles en lancha y llegó apenas a dos cuadras de la escuela, una pequeña casa verde de madera

que albergó a 29 vecinos de la comunidad, 13 personas menos que el total de sus estudiantes.

De vuelta a casa El viernes 20 de octubre, los Vargas Jiménez salen de escuela hacia un rancho que el esposo de Ángela y uno de sus yernos construyeron en apenas cuatro días. Aún sin luz ni agua potable, la mayor parte de la familia se instala en la nueva vivienda.

Ana, la hija de Ángela, y su esposo Diego Rodríguez decidieron volver con sus dos hijos a su antigua casa a pesar de todo.

“Aquí casi no hay casas donde alquilar, las que hay no son muy diferentes a esta. Cobran ₡50.000 de alquiler y además hay que pagar agua y luz”, dice Diego, quien puede llegar a ganar hasta ₡230.000 mensuales como jornalero y con eso mantiene la casa y los niños.

Como acá tampoco tienen agua potable (nunca han tenido), un vecino suyo, “don Miguel”, les hace el favor de traerles la que usan para cocinar y beber desde la comunidad de Ortega, una vez por semana. La que usan para lavar ropa y bañarse, la saca Diego de un pozo contaminado por la inundación.

Diego tiene un trabajo informal en el que no le pagan seguro, pero esta semana ha tenido que volver temprano a la casa varias veces porque está con dolor de huesos y calentura.

Bolsón es un pueblo habitado por gente con muy pocas posibilidades económicas. Quienes no tienen trabajo fijo, esperan al verano para migrar a las playas y a los distritos donde se corta caña.

“Si uno trabaja en el verano vive durante el invierno”, explica Lineth Jiménez, vicepresidenta de la Asociación de Desarrollo Integral de Bolsón. “En ésta época del año, los que se quedan, viven de los ahorros que produjeron de diciembre a julio”.

Han pasado algunos días desde que regresaron a la casa vieja y Antonio, hijo de Diego y Ana, juega con la pelota. Su padre intenta descansar pero los bolazos de Antonio lo despiertan y entonces sale resignado a limpiar el lote, apilando junto al estero, todas las cosas que el agua le arruinó.

“Espero poder trabajar toda esta semana, pero no podemos cantar victoria todavía” , dice Diego mientras le prende fuego a la ropa dañada de su familia.

• Flooding from Nate took even the windows from the home of the Vargas Jiménez family. For some people, the storm wasn’t just a red alert, it was one more prolongation of their extreme scarcities.

Ana Vargas helps her mother Ángela Jiménez, 48, get up from her mattress to go to the bathroom. For five days she has been lying in the bed on the ground as she recovers from a fever and body aches caused by a respiratory infection. Ángela and her entire family have been sheltered here in the Escuela Mixta de Bolsón school for 13 days, ever since Nate triggered a red alert in all of Guanacaste.

While it hit Costa Rica as a tropical storm, Nate left greater damage in the province than Hurricane Otto. The Vargas Jiménez family is proof of that. Not only are they part of the group of 11,000 people who were displaced by the emergency across the country, on October 16 they were still in the shelter at the school.

The family has two children with asthma (Samanta, 4, and Antonio, 9) who could get worse if they return to what was once their home, but what is now merely a humid shell that threatens to collapse on their heads. Ángela says that the social worker has insisted that they don’t return, but when the damages from the storm begin to diminish the community will start pressuring to resume classes at the school and they won’t be able to stay much longer.

“The Filling” Getting to Bolsón from Filadelfia is still complicated. It’s a half-hour drive on a dirt road between sugar plantations and rice fields that were destroyed by flooding. There are still downed trees that block the way and vultures eating cadavers of animals that were swept away by the water.

Bolsón was one of the communities most affected by Nate because it is surrounded by three rivers that all overflowed. ‘The filling,’ as resident called the floods, left them cut off for four days.

Water levels rose to the point that it covered houses, forcing people to travel the streets in motorboats. Floodwaters stopped two blocks away from the school, a small, green, wooden building that housed 29 members of the community, 13 fewer than the total number of students.

Back Home On Friday, October 20 the Vargas Jiménez family left the school and moved to a shanty that Ángela’s husband and one of her sons-in-law built in just four days.

“Here there are almost no homes to rent and the ones that are available aren’t that different from this one,” said Diego, who can make up to $410 per month as a day laborer worker, enough to pay for the house and the kids.

Since they never have had drinking water here, one of his neighbours, Mr. Miguel, brings them water once a week from the Ortega community so they can use it to cook and drink.

Diego has an informal job but this week he has had to come home early several times because he has a fever and body aches.

Bolsón is a town inhabited by people with very few economic opportunities. Those who don’t have a full time job wait for dry season to migrate to the beaches and the areas where sugarcane needs to be cut.

“If you work in the dry season you get by in rainy season,” said Lineth Jiménez, Vice-

President of the Bolsón Integral Development Association. “This time of year, those who stay around live off the savings that they generated from December through July.”

It’s been several days since they returned to their old house and Antonio, Diego and Ana’s son, is playing with a ball. His father tries to rest but Antonio wakes him up with the ball so he begins to clean the lot, piling up all the things that the water ruined.

“I hope to work this whole week, but we can’t sing a victory tune yet,” Diego said as he set fire to the families damaged clothes.
