AN APPEAL, led by former Fraser Coast Councillors Sue Brooks and David Lewis, is progressing with momentum, seeking to have the height of the recently approved 18 storey Torquay development that would house the proposed Sheraton Hervey Bay Resort, reduced or thrown out.

This project, which has been a subject of debate within the community for the past 12 months, now appears to be entering a new phase, as the opposition exhausts all available legal avenues in an effort to impede its progress.

The appellants seek to have the Queensland Planning and Environment Court mandate a reduction in height for the approved development.

Their primary objective is to ensure that the development conforms with the applicable Planning Scheme, despite its prior approval by the Fraser Coast Regional Council.

Former Councillor David Lewis has confirmed that legal counsel has been retained to advise on the matter and to prepare a formal Notice of Appeal, which is a requisite preliminary step in pursuing the appeal.

He anticipates that the appeal will be lodged imminently and expressed confidence in the strength of their legal arguments.

The group, operating under the name Torquay Towers Appeal Fund – Hervey Bay, believes they have strong grounds for challenging the decision.

However, Mr Lewis prudently acknowledged that should legal advice indicate otherwise, the group would take the responsible course of action by discontinuing the appeal.

Donors have been apprised of this possibility and have expressed their continued support for the process.

At time of writing, the ‘Go Fund Me’ campaign supporting the appeal had raised in excess of $11,000 from 147 contributors, with donations ranging from $1,000 to more modest sums of $5 and $10.

Torquay Towers Appeal Fund has also made assurances that should the appeal not proceed, all donations will be refunded to the contributors.

A pertinent question has arisen regarding the legal expenses already incurred: if the law firm involved concludes that the appeal is not viable after dedicating time and resources to its evaluation, will the costs incurred be refunded to the Torquay Towers Appeal Fund for distribution back to the donors, in line with the Fund’s promise?

In this context, former Councillor Brooks has emphasized that she has maintained direct communication with all donors, who remain supportive of the actions being undertaken to advance a robust appeal.

Additionally, Ms Brooks has indicated that a formal request has been submitted to the Minister for Housing, Local Government and Planning, and the Minister for Public Works, the Hon. Meaghan Scanlon MP, to intervene in the matter by calling in the application.

A Queensland Government E-Petition, along with a complementary hard copy petition, has garnered approximately 2,700 signatures in support.

At this juncture, the dual-pronged approach of the Torquay Towers Appeal Fund comes into clear focus.

The first element is the legal appeal to the Planning and Environment Court. However, it is evident that the $11,000 raised to date will likely prove insufficient should legal counsel advise that there is a viable path to success, as the costs could potentially rise into the hundreds of thousands of dollars.

The question of where the additional funding will come from remains unresolved.

The developers of the project, Sunny Land, would be expected to participate as a respondent in any proceedings.

It is reasonable to anticipate that they will seek to expedite the legal process to prevent any delays or obstructions by the Torquay Towers Appeal Fund.

Given the strong internal recommendations from the Fraser Coast Regional Council, substantial public support, and the favourable outcome of the Council vote, it is not unreasonable to surmise that the developers are

confident in their position.

The second element of the appeal involves the formal request to Minister Meaghan Scanlon MP to call in the development application on behalf of the state.

Petitioners are urging the Queensland Parliament to compel the Minister to invoke the powers under the Planning Act to either reject the application or amend it to comply with the Fraser Coast Regional Planning Scheme.

Minister Scanlon, elected in 2020 with a margin of 7.8%, faces potential political headwinds, with recent by-elections showing an 18% to 19% swing away from Labor to the Liberal National Party (LNP).

This raises questions about her political future, especially with the Queensland State General Election scheduled for October 26, 2024.

Furthermore, the Labor State Member for Hervey Bay, Adrian Tantari, who holds a slim 2% margin, may seek to avoid controversy in his own backyard, surrounding this issue in the lead-up to the election.

Many media outlets are predicting a significant defeat for the Labor Party in the upcoming Queensland State Election, with the potential loss of a substantial number of seats and overall control of the government. Should these forecasts prove accurate, any current appeal to the Minister may become moot.

The Fraser Coast Regional Council, which ultimately represents the interests of ratepayers, may be facing a protracted and costly appeal process to defend the position it has already adopted. This raises pertinent questions regarding the potential financial burden on the community and ratepayers.

In my opinion, when you consider the timing of the appeal, the prevailing political landscape, and the expert opinions that supported the project’s approval by the Fraser Coast Regional Council, the likelihood of success for the Torquay Towers Appeal Fund appears to be limited. What do you think?

Mayor George Seymour’s recommendation that small children not be allowed to roam on all parts of K’gari is the height of common sense.

There is no shortage of beautiful sandy beaches or islands for recreation in Queensland besides K’gari. Surely one island - which is a National Park - can be regarded as a place where dingoes can be spared the temptation of small wallaby sized humans playing in front of them - possibly unsupervised by an adult.

Some folk are understandably in love with beautiful K’gari.

My husband went there with a group of men friends every year for 42 years!

But if a family takes small children to K’gari, vigilance would be needed 100% of the time.

This can hardly be relaxing for Mum and Dad.

International developers expect rural people to be naive hayseeds who will welcome any flashy confidence trick.

And so Hervey Bay residents were expected to fall for a gigantic 1930s Hollywoodstyle sparkling meringue with glittering windows, towering over the trees, birds, turtles and coral until only the meringue remained.

The pretence that the people of Hervey Bay gave their informed permission is contradicted by the thousands of protest signatures and donations.

Of course, we didn’t believe that “they” would do that to us.

It is a sad indictment of the state of Queensland Health and the HB Hospital when a three year old is rushed in vomiting, dehydrated and in pain, to be sent home with anti-nausea meds and fluids, only to be returned hours later worse, but again sent home… outcome??

Yet another trip to the hospital only to have to get the Emergency helicopter called to fly the child to Brisbane in a serious condition with pneumonia, lungs full of fluid in a serious condition.

No words! Just no words!!!

What a disastrous decision it was to introduce the European fox (Vulpes vulpes) into Australia, for recreational hunting in the mid-1800s!

Foxes quickly spread across the landscape and are now found in every state.

Despite many millions of dollars spent on control programs, foxes continue to threaten both wildlife and agriculture, making it one of our most significant invasive species.

Despite their relatively

small size (5-6kg) these opportunistic scavengers and predators are highly adaptable and will consume a wide variety of animals and plants from their environment.

Research estimates that foxes kill 300 million native animals in Australia each year (StoboWilson, Murphy & Legge, et al, Wildlife Research 2021).

These consist of native mammals, reptiles, frogs, birds and insects as well as bird and turtle eggs.

Fraser Coast ecosystems and wildlife are extremely vulnerable to the impacts of the European fox.

Turtle egg and hatchling predation threatens the breeding success of local turtle species, including critically endangered White-throated Snapping Turtle (Elseya albagula), Endangered Mary River Turtle (Elusor macrurus) and Loggerhead Turtles (Caretta caretta).

Local populations of small marsupials such as Planigales, Melomys and Dunnarts are also under threat from fox predation.

There are seven threatened species of small mammals and birds vunerable to fox predation on the Fraser Coast. Fox sightings (including dens and calls) can be logged on the free and easy-to-use FeralScan Pest mapping website or phone App.

A 16-STOREY residential apartment complex and a 10-storey hotel with a wellness centre and food and retail precinct have been proposed in the Hervey Bay City Centre across from Seafront Oval.

Regional Council CEO Gerard Carlyon said Council sought expressions of interest to buy and develop Council-owned land at 7-19 Hillyard Street in Pialba, and recently accepted a $5 million tender from HBC Build Australia, subject to conditions.

“Council bought land in Hillyard Street in Pialba in 2019 for $3.4 million as a potential site for a new administration centre but subsequently decided to colocate the new administration centre with a new library on the corner of Main Street and Torquay Road,” he said.

“The Hillyard Street land is in a strategically important location, which is why Council sought proposals for the site that would help revitalise the Hervey Bay City Centre, leverage the benefits that flow from the new Council building, and deliver on the 20-year master plan for the area.”

HBC Build Australia proposes building a 10-storey

Radisson Hotel with 152 rooms and a 16-storey Sunlife over 50s complex with 150 apartments, along with a wellness centre, multi-purpose conference room, restaurant and bar, and food and retail precinct.

Mr Carlyon said Council would now seek to negotiate a development lease agreement with HBC Build, under which Council would still own the land until the contract conditions are met.

“This is the first of several steps before a land transfer can take place, and the hotel and apartment complex proposal will still need to go through the development application process and be assessed by Council,” he said.

“Council shortlisted three tenderers and HBC Build

Australia demonstrated a thorough understanding of the project and a capability and readiness to deliver.

“This is an important parcel of land, and we want it developed in a way that provides maximum social and economic benefits for the Fraser Coast.

“A revitalised city centre will ensure Hervey Bay has a flourishing local economy and can compete at a state and national level for new business and industry, tourism expenditure and skilled workers.

“A key objective of Council’s Corporate Plan is to encourage business and investment to grow a diversified economy, and that’s what we are looking to achieve with the sale of this land.”

wanting to help guide the development of the Mary to Bay Rail Trail can apply now to be part of an advisory committee to Council.

Mayor and Committee Chair George Seymour said the Mary to Bay Rail Trail Advisory Committee, first established in 2022, is seeking six community members and key user group representatives to provide recommendations on the trail’s development and management.

“The Mary to Bay Rail Trail, which stretches from Maryborough to the Urangan Pier, follows the now disused rail line that connected the coal mines and farms of Wide Bay Burnett to the Urangan Pier,” he said.

“Local residents and visitors can walk, run and ride through two distinct sections – the urban area of Hervey Bay, and the rural section through beautiful forest areas between Nikenbah and Maryborough, which is progressively being developed.

“Council endorsed the Mary to Bay Trail Development Plan in 2019 and has worked with Fraser Coast Bicycle User Group volunteers and the Queensland Government to refurbish sections of the trail with a new 11-kilometre stretch

opening around Takura last year.

“The advisory committee will provide a forum for the community and user groups to make recommendations to Council on opportunities relating to the development and management of the trail into the future.”

The advisory committee includes three Fraser Coast Regional Councillors: Cr Seymour (Chair), Cr Paul Truscott and Cr Lachlan Cosgrove.

The committee also includes Council staff, and representatives from the Department of Transport and Main Roads, and Fraser Coast

Tourism and Events.

Interested residents will need to fill in a short nomination form detailing their experience and reasons for wanting to take on the next two-year term.

A feasibility study conducted for Council found that developing the rail trail could inject $3.2 million into the local economy, providing a tourism drawcard and benefitting locals who want to explore the great outdoors by walking, cycling or riding a horse along the trail.

A DOG’S Day Out in Hervey Bay next month promises to be a fur-tastic day for local dogs and their owners, with a rescue dog catwalk, agility demonstrations, and a vet advice session among the highlights.

Fraser Coast Mayor George Seymour said the popular event was returning to Dayman Park, Urangan on Sunday October 13 from 8am to 12 noon, where Council will be looking for Hervey Bay’s bestdressed dog and celebrating responsible dog ownership.

“A Dog’s Day Out in Hervey Bay coincides with the annual dog registration renewal period with renewal notices being issued from late September and payments due by 31 October,” he said.

“At this year’s event, we are also offering dog owners the chance to win a $200 Fraser Coast Buy Local Gift Card if they renew their dog registrations at the event.

“This is a great incentive to renew registrations while socialising your dog and enjoying a fun day out with the whole family.

“Free microchipping will be available and our Customer Service team will be on hand to register pets FREE for the first time.

“In the Fraser Coast, it is compulsory for dogs to be registered with Council from 12 weeks of age and within 14 days of owners moving to the region.

“Ensuring your dog is registered and microchipped helps reduce the number of animals that end up at the animal facility and makes it easier for Council to reunite lost pets with their owners.”

Cr Seymour said if you’ve recently had your dog desexed and hold a Concession Card, you could be eligible for a $100 reimbursement, with desexing reimbursement forms available

at the event.

“The fun day will also feature market stalls showcasing pet products, demonstrations, pet advice, a rescue dog catwalk, and dog training tips and tricks,” he said.

“There will also be prizes for the best-dressed dog, best dog trick, and an owner look-alike competition.”

FRASER Coast community groups and not-for-profit organisations planning Christmas, New Year’s Eve or Australia Day events can now apply for Council grants.

Cr Michelle Govers said applications for Council’s Festive Fraser Coast Events, Australia Day Events and Small Township Festive Decorations grants were now open at www.frasercoast.qld.gov.au/ grants, with applications closing on 9 October 2024.

“Council’s vision is to build better communities together, and through these grants, we assist local community groups and townships to come together to celebrate over the festive season and on Australia Day,” she said.

“Grants of between $500 and $2,000 per application are available for community groups to plan and host a Christmas or New Year’s

Eve community event between 15 November 2024 and 1 January 2025.

“Examples of events supported last year include the Howard Community Christmas Twilight Markets, the Toogoom Christmas Fair and the Burrum Heads Carols By Candlelight, to name just a few.”

Cr Phil Truscott said grants of between $500 and $2,000 were also available for festive decorations in small towns on the Fraser Coast.

“Grants are available for community groups and organisations to buy and install festive decorations such as lighting, Christmas trees, feature decorations, signage and banners in outdoor locations,” he said.

“This grants program is open to Fraser Coast community groups in towns with a population of less than 10,000 people, which includes Bauple, Boonooroo, Brooweena,

Burrum Heads, Glenwood, Gundiah, Howard, Maaroom, Poona, River Heads, Tiaro, Toogoom and Torbanlea.

“The Christmas- New Year period is a wonderful time of year, and Council encourages local community groups to make the most of the funding available to assist with projects, events and decorations to celebrate the festive season.”

Cr Govers said community groups and organisations planning events for Australia Day on Sunday 26 January 2025 could also apply for grants of between $500 and $2,000.

“Australia Day is an opportunity to come together to reflect, respect and celebrate. Australia Day is a day that reminds us of the common bond we share as Australians, connected by a desire for unity, and the promise of safety, stability and prosperity,” she said.

Council are encouraging residents to take advantage of FREE green waste disposal at local waste facilities, when cleaning up their gardens this Spring.

Spokesperson Michelle Byrne said with the arrival of Spring, now is the perfect time to start cleaning up your yard.

“Residents can drop off up to four cubic metres or one tonne of clean green waste for free at every waste facility across the Fraser Coast, with the exception of Aramara Transfer Station,” she said.

“Green waste includes items such as lawn clippings, mulch, branches (under 1.2 metres long and 40 centimetres wide), weeds, leaves, unwanted plants, tree trunks, seeds and fruits.

“By cleaning up your garden and disposing of green waste

at Council’s waste facilities instead of the red lid bin, you’ll not only have a tidier yard, you’ll also be helping the environment by reducing the amount of methane gas produced when food scraps and garden waste decomposes in landfill.

“At the Maryborough Landfill, methane gas is captured through special pipes and converted into energy, powering about 35% of homes in Maryborough. Whist most of the methane gas is captured some methane gas still escapes to the environment.

To minimise this and keep green waste like grass clippings and branches out of landfill, Council offers free green waste disposal at most facilities.

“This green waste is turned into mulch, which helps save landfill space, reduce

greenhouse gas emissions and promote a circular economy.”

Cr Byrne said this highquality mulch, which can be purchased at the Nikenbah and Maryborough waste facilities, can be used in gardens to promote healthier plants and support a sustainable economy.

"Council is committed to supporting a greener Fraser Coast by implementing initiatives that reduce waste, promote recycling, and encourage sustainable practices across the community,” she said.

“It’s all about building better communities together.”

PROPOSAL FOR 5G UPGRADES TO MOBILE PHONE BASE STATIONS AT EXISTING TELECOMMUNICATIONS SITES IN TORQUAY AND PIALBA

1. The site at which this works is being undertaken is located at 539 Boat Harbour Drive, Torquay QLD 4655 (Lot 2 RP155588). The proposed works include the installation of new 4G and 5G equipment and associated works at the existing 35m monopole. The proposed works comprise of:

• Replacement of three (3) existing panel antennas with three (3) new panel antennas (each antenna no longer than 2.8m in height) on existing antenna mounts on existing structure,

• Installation and reconfguration of associated ancillary equipment including but not limited to the replacement of nine (9) remote radio units (RRUs) for nine (9) RRUs on the existing mounts and the installation of one (1) GPS antenna on the existing equipment shelter to ensure proper functioning of the facility.

2. The site at which this works is being undertaken is located at 1C Hillyard Street, Pialba QLD 4655 (Lot 2 RP98096). The proposed works include the installation of new 4G and 5G equipment and associated works at the existing 30.5m lattice tower. The proposed works comprise of:

• Replacement of three (3) existing panel antennas with three (3) new panel antennas (each antenna no longer than 2.8m in height) on existing antenna mounts on existing structure,

• Installation and reconfguration of associated ancillary equipment including but not limited to the replacement of twelve (12) remote radio units (RRUs) for nine (9) RRUs on the existing mounts and the replacement of one (1) GPS antenna with one (1) GPS antenna on the existing cable ladder to ensure proper functioning of the facility.

3. Optus regards the proposed works as a low-impact facilities under the Telecommunications (Low-impact Facilities) Determination 2018 based on the descriptions above.

FRASER Coast Regional Council will provide $290,000 to the Rural Fire Brigades and LifeFlight to assist them in continuing to provide vital emergency services to the local community.

Mayor George Seymour said both organisations had a crucial role in safeguarding Fraser Coast residents, and the Council was providing a financial contribution to support them using funds collected from the Disaster Management Levy.

“The Rural Fire Brigades provide invaluable fire prevention and mitigation activities such as hazard reduction burns and community education, in addition to responding to bushfires and other emergency incidents,” he said.

“The brigades are powered by volunteers and rely on financial contributions from Council and other sponsors to maintain their operations and provide effective emergency services.

“LifeFlight is a lifeline in emergency situations, offering rapidresponse aeromedical services that can be the difference between life and death.

“They are crucial in rural and regional areas, delivering advanced medical care and facilitating emergency evacuations during disaster events.

“The safety and well-being of our community is a top priority, and these funds from Council will help ensure that the Rural Fire Brigades and LifeFlight have the resources they need to respond swiftly and effectively in emergencies.

“Council’s support reflects our deep appreciation and gratitude for the tireless work of both organisations in keeping our community safe.”

At a meeting on 28 August, Council resolved to allocate $260,000 in funding for the 2024/25 financial year to the Queensland

Fire Department on behalf of the 28 Rural Fire Brigades operating in the Fraser Coast region.

An additional $30,000 in funding was also approved for LifeFlight for the 2024/25 financial year.

LifeFlight Wide-Bay Burnett Regional Advisory Committee chair Neil McPhillips said:

“LifeFlight is proud to help communities in the Fraser Coast region and beyond. We’re extremely grateful for the support of the Fraser Coast Regional Council for LifeFlight’s services.”

LifeFlight aeromedical crews airlifted over 300 people in the Fraser Coast region in the past financial year. The rescue chopper crews were tasked with 57 primary missions, which included oceanbased search and rescues, motor vehicle accidents and jellyfish stings on K’gari.

THE FRASER Coast Cheer and Dance studio’s Open Hip Hop Dance Team has achieved a major milestone, clinching 1st place and Novice Grand Champions at the recent Aussie Gold Internationals on the Gold Coast.

Competing against over 60 novice teams from Queensland and beyond, the team emerged with the highest score across all styles of dance, marking a significant accomplishment for the local studio.

This outstanding victory has earned the team an invitation to the National Championships in Adelaide this November. This prestigious opportunity will allow them to represent Hervey Bay on a national stage and be an incredible experience of a lifetime.

Founded in October 2022, Fraser Coast Cheer and Dance has rapidly expanded, now boasting 14 teams.

The studio, located in Hervey Bay, next to the PCYC, offers a range of competitive and recreational cheer and dance classes for ages 2 and up, fostering a welcoming and inclusive environment.

The victorious Hip Hop team, known as "White Heat," comprises six dedicated athletes aged 14 to 39. Julie, the oldest team member, has rekindled her passion for dance only recently, with the guidance from coach Del, seeking a fulfilling hobby outside of her work and family life. She is eager to represent Fraser Coast at the Nationals before turning 40 next year.

Del, the team’s passionate coach, has been instrumental in their success. Her dedication and enthusiasm for dance have driven the team to excel, and she is immensely proud of their achievement. Del’s commitment to

making each routine shine on stage reflects her deep passion for the sport and her unwavering support for her dancers.

To achieve this, the team is seeking support from the local community. They are reaching out to businesses for sponsorship to cover travel and accommodation expenses. Sponsors will not only help the team reach Adelaide but will also gain valuable exposure through logo placements, social media mentions, and marketing materials.

Z-PAC Theatre has two intriguing one-act plays that showcase the diverse range of the human experience.

Dunn praised the cast for their creativity, "This play has simply built itself."

HERVEY Bay Regional Gallery will welcome works by some of Australia’s leading 20th century artists, as part of the Albanese Labor Government’s Sharing the National Collection program.

Four works of art will travel to the Fraser Coast region for a period of two years where they will be presented in conversation with pieces from the gallery’s own collection.

The works will feature as part of ‘National Interests: Australian Arts in the 20th century’ an exciting new exhibition opening this month.

Minister for the Arts, Tony Burke, said the loan created an opportunity for locals to connect with pieces of national significance.

“Sharing the National Collection gives Australians a chance to see some incredible pieces of art up close and personal - not just in Canberra but at local galleries right across the country.

“At any point in time 98 per cent of the National Galley’s collection is in storage. We don’t buy art so it can live in storage, we buy it so it can be seen and it’s fantastic that these works will make their way out of storage to picturesque Hervey Bay.”

AT JUST 25, Amy Snyders life has already been filled with rich experiences, bold moves, and big dreams.

Born in Durban, South Africa, Amy’s early years were shaped by her mother’s creative textile printing business and her father’s role as an accountant.

In 2007, when Amy was just eight, her family made the life-changing move to Australia, settling in Ferny Grove, Brisbane.

The decision was driven by the desire for a safer environment and better opportunities, given the crime and corruption in South Africa at the time.

While her memories of her early years in South Africa are faint, Amy’s life in Australia soon took centre stage.

She excelled in her studies at school and ultimately found her passion for

Academy of Creative Industries.

There, Amy focused on visual arts and design technology, driven by a strong work ethic instilled by her South African upbringing.

Her mother’s mantra, “Nothing comes easy, you have to work for it,” is one Amy continues to live by today.

At fourteen, Amy landed her first job at McDonald’s, working her way up to a shift manager by the time she left five years later.

This early taste of responsibility and leadership set the foundation for what was to come. After completing her Bachelor of Architecture at the University of Queensland, Amy made the bold decision to spend her final year of study abroad in Germany, an experience that would profoundly shape her worldview.

Her love for creativity and problem-solving naturally led her

solution-based brain,” Amy explains.

“Architecture felt like the perfect blend of creativity and logic.”

Now, with a completed master’s degree in architecture under her belt, she’s on the path to becoming a registered architect – a process that involves rigorous self-driven study, logbooks, and exams.

For Amy, the journey toward registration is another step toward her goal of contributing to the community in meaningful ways through her designs.

In 2020, as the world grappled with the impacts of COVID-19, Amy moved to Hervey Bay for a job at Keystone Architects.

It wasn’t part of her original plan – she thought she’d only stay for 18 months – but three years later, Amy is still here and thriving.

“Working regionally has given me such a broad range of experience,”

from schools to commercial buildings, learning how each space is used differently but always for the people who inhabit them.”

Amy is deeply passionate about shaping the future of her community and has ambitious dreams ahead.

While her ultimate goal is to run her own architecture firm, for now, she’s fully embracing every opportunity to learn and grow.

With each new project, Amy is soaking up valuable experiences that will help pave the way for her bright future.

On a personal level, one of her dreams is to contribute to the development of the Esplanade. She envisions higher-density buildings that cater to young professionals, as well as creating a more vibrant nightlife and transforming parts of the Esplanade into pedestrian-friendly

These ideas, Amy admits, are still just that – ideas – but she hopes they’ll come to fruition one day. Beyond her career, Amy is deeply involved with the Hervey Bay Surf Lifesaving Club. She joined to meet people her age, but it quickly became a key part of her life. As a volunteer, Amy runs development camps and programs, contributing at both the local and state levels. Surf lifesaving, for Amy, is not just about keeping the beach safe – it’s another way to connect with her community.

Amy looks forward to life’s challenges. Whether she’s training for a triathlon, writing leadership programs, or working on her architecture registration, Amy’s commitment to pushing herself forward is clear. With big dreams and a heart for her community, there’s no doubt Amy’s story is only just
