‘OFTEN REPEAT OFFENDERS’: 109 PAROLEES IN OVERSTRAND ALONE

Burglaries on the increase ‘because of parolees’ JANINE VD RIET­NEETHLING In the last two months there has been an increase in house-breaking and theft out of motor vehicles reported in Onrus, Sandbaai, Westcliff and Hawston. According to Sergeant Mbongeni Mazuthu from the Hermanus Police, one of the reasons for this increase is that prisoners are being released from prison prior to the expiry of his or her entire sentence of imprisonment, to serve the remainder of the sentence outside of prison, subject to specific conditions that must be complied with. According to Mazuthu, many of these parolees are repeat offenders.

There are currently 109 prisoners out on parole in the Overstrand. Although the police cannot yet give exact figures until the annual police statistics have been released by the provincial commissioner, a definite increase can be seen, confirms Mazuthu. The latest statistics (April 2014 to March 2015) are expected to be released shortly. Previous statistics, from April 2013 to March 2014, indicate that in this time frame there were 171 cases of theft out of motor vehicles reported in Hermanus. This does not include Onrus, Vermont or any other suburb in the Overstrand. In the same time frame, 527 residential burglaries were reported, with 102 robberies with aggravating circumstances.

Some security companies in the Overstrand have also sent out warnings per SMS to inform residents to be vigilant and cautious as burglaries are on the increase. During one incident on 9 April, goods to the value of R2 300 were stolen out of a car in Bond Street in Onrus. The doors were locked and the windows closed, but it seems the suspect had tampered with the lock. In another incident, in the morning hours of 10 April, a burglar gained access to a house in Cliff Road, Westcliff and stole a laptop with charger and bag, a Canon camera and media players. It is alleged that the suspect had forced the sliding door open to gain entry.

The complainant’s son saw the suspect, who then grabbed the bag with goods and fled the scene. Mazuthu said the police would like to sensitise the communities so that they will report any suspicious-looking people in their areas. They also encourage communities to become involved in the neighbourhood watches, block watch and street committees to prevent crime. Adrian Good, general manager for ADT Security in the Western Cape, said they advise residents, especially in Northcliff and Eastcliff, to always take precautions to minimise the risk of their property being targeted by burglars. JAN­HENDRIK COETZER “Sedert ek Sprokkelster-teater sowat drie jaar gelede begin het, spook ek nog net om hierdie onderneming se deure oop te hou. Niemand het ooit gesê jy mag nie eintlik ’n teater hier bedryf nie.” So verduidelik Louise van Zyl, eienaar van Sprokkelster, nadat van die inwoners van die Seebries-woonstelblok in Onrus gekla het oor te veel geraas in die aand en dit onder Overstrand-munisipaliteit se aandag gebring het. “In die amper drie jaar is dit die eerste klagte wat ek van inwoners ontvang het. Gedurende die hoogseisoentyd was daar meer optredes as gewoonlik, en as gevolg van die hitte moes ek die sydeur aan Seebries se kant oopmaak. “Net soos enige ander kuierplek of restaurant in Onrus is dit waar mense bymekaarkom en saamkuier. En by die teater is ons nie eens tot baie laat aan die gang nie. Deur die res van die jaar het ons slegs een optrede per week.” Stephen Müller, direkteur: infrastruktuur en beplanning by Overstrand-munisipaliteit, het bevestig dat klagtes ontvang is oor die klankreikwydte van Sprokkelster en die uitwerking daarvan op die inwoners van die woonstelblok. “Daar is bevind dat die Sprokkelster-teater buite die goedkeuringsvoorwaardes bedryf word. Dit sluit in dat slegs spesifieke dele van die gebou gebruik mag word en dat geraasvlakke beperk moet word. Die grondeienaar is daarvan in kennis gestel waarna daar toe ook vasgestel is dat die eiendom van hande verwissel het. Die een goedkeuringsvoorwaarde is dat die grondgebruikregte verval indien die eienaarskap verander, en dus is die grondeienaar ook versoek om weer ’n aansoek in te dien om die verandering van eienaarskap aan te spreek. “Daar moet ook daarop gelet word dat Sprokkelster destyds aansoek gedoen het om ’n onwettige gerief te wettig, en ’n tydelike afwyking is goedgekeur wat beperk is tot vyf jaar.” Van Zyl sê sy was glad nie bewus daarvan of destyds ingelig dat haar afwykingsaansoek tot niet verklaar word as die eienaarskap van die gebou verander nie. “Daai aansoek het my destyds R37 000 gekos. Ek was ook nie eens bewus van die nuwe eienaarskap nie. Toe die vorige eienaar verkoop, het hulle my bloot ingelig dat ek die huur nou in ’n ander rekening moet oorbetaal.” Van Zyl noem sy is intussen besig om veranderinge by die teater aan te bring. “Die tuingedeelte waar mense buite gestaan en kuier het gedurende pouse, en waaroor die klagte gaan, gaan nie meer gebruik word nie. Die deur aan die kroeg se kant sal toe bly wat die klank na buite aansienlik gaan verminder. Dan gaan ek ook die gedeelte binne, wat tans ’n ateljee is, oopbreek sodat teatergangers gedurende pouse ’n vrye vloei deur die teater kan hê. In die somermaande sal ek nog ’n lugreëlaar insit en die deure toe hou.” Van Zyl stel egter die vraag oor hoekom ander kroeë en restaurante nie oor dieselfde kam geskeer word nie. “Kroeë kan rumoer tot in die vroeë oggendure en sekere restaurante kan hordes mense huisves, al het hulle net drie parkeerplekke beskikbaar. Waar is die sogenaamde reëls en regulasies dan vir hulle?” In reaksie daarop het Müller gesê dat geriewe nie met mekaar vergelyk kan word nie. “Van die kroeë en restaurante in Onrus is historiese ondernemings wat bedryf word onder hul primêre regte. By Sprokkelster is dit ’n bykomende gebruiksreg en nie ’n primêre reg nie.” Van Zyl se huurkontrak verval einde Julie met die opsie om te hernu. “Ek sal maar moet wag en sien wat gebeur.” “Soveel kunstenaars landwyd wil hier kom optree. En dis nie ‘klein’ kunstenaars wat optree nie; binnekort is byvoorbeeld Amanda Strydom, Anton Goosen, Daniele Pascal en Wendy Oldfield hier. Mense bel my weekliks van oor die land en wil hoor wie optree. “Niemand anders behalwe die een of twee mense wat gekla het, is negatief oor die teater nie. Inteendeel, feitlik almal het al aangedui dat hulle sover sal gaan om ’n petisie op te stel indien Sprokkelster sy deure moet toemaak. “Ek probeer slegs gehalte-teater na die Overstrand bring. Dit moet tog sekerlik ’n aanwins vir die area wees.”

Notice of Prescribe Burns; Overstrand Municipality 2014/2015 Notice number 53/2015 01 March 2014 - 30 June 2015 Chapters 4 and 5 of the National Veld and Forest Fire Act, 1998 (Act No. 101 of 1998) Overstrand Municipality hereby notifies Interested and Affected Parties of the intention to burn ageing and overgrown vegetation as indicated in table 1. In an effort to reduce the impact of veld fires, Overstrand Fire and Disaster Management in cooperation with Overstrand Environmental Services, embark on a programme to reduce fuels loads (aged /overgrown vegetation) with the aim of better managing out of control veld fires. The identified prescribed block burn is dependent on season and weather conditions which are conducive for the burning of firebreaks or blocks. Fire safety is of utmost importance and the programme will be adapted in order to maintain safe burning conditions. This means that each prescribed burn will be carefully assessed by a committee consisting of Overstrand Fire and Disaster, Overstrand Environmental Services, Cape Nature and Overberg Fire Protection Association. A Strict criteria will be followed to ensure a safe and successful burn, should some of these identified block burns not take place it will stand over to the following year. Beyers-Cronjé sê hulle is nog opsoek na ’n matras vir die familie en sy gaan ook ’n oudioloog nader vir ’n gehoorapparaat vir die dogtertjie. Die oorsaak van die brand is nog nie vasgestel nie.

Dit blyk dat die brand in die houthuisie begin het en dié huisie het tot op die grond afgebrand. Die vlamme het vinnig na die huis versprei en die huis se struktuur beskadig. Cecilia Geswind, wie in die huis langsaan bly, sê sy het haar ma hoor gil. “Ek het my dogter gestuur na my ma om uit te vind wat aangaan. Sy het teruggehardloop en gesê die huis brand, ek moet kom help. Ons het die vlamme met emmers water natgegooi tot die brandweer opgedaag het.” Die besittings van die vyf mense wat in die houthuis gebly het en die ses mense wat in die huis gebly het, is verwoes. Benewens al die besittings wat in die brand vernietig is, het een van die kinders wat in die houthuis gebly het en doofstom is, ook haar gehoorapparaat in die brand verloor. Intussen kan Geswind se ma, Diana, nie in die huis aanbly nie as gevolg van al die skade binne die huis. Sy, sowel as die ander mense wat in die houthuis en huis gebly het, het intussen alternatiewe verblyf gekry. Geswind het vier mense Inwoners staar in ongeloof na die brandende huise.

Kennisgewing van beheerde brande; Overstrand Munisipaliteit 2014/2015 Kennisgewingnommer 53/2015 01 Maart 2014 – 30 Junie 2015 Hoofstuk 4 en 5 van die Nasionale Veld en Bosbrand Wet(Wet 101 van 1998) Die Overstrand Munisipaliteit gee hiermee kennis aan alle geaffekteerde en belanghebbende partye van die beplanning van voorbrande (soos aangedui in tabel 1) om verouderde en oorgroeide plantegroei aan te spreek. Die Overstrand se Brandweer en Rampbestuur in samewerking met die Overstrand Munisipaliteit se Omgewingsbestuur, moet 'n program loods om brandlading (ou en oorgroeide plantegroei) te verminder om sodoende die impak van veldbrande te verminder en veldbrande beter te beheer. Elke geïdentifiseerde voorgeskrewe blokbrand is seisoengebonde en is afhanklik van weersomstandigehede wat gunstig is vir voorbrande. Brandveiligheid is van uiterste belang en die program sal aangepas word om veilige brandtoestande te verseker. Elke voorbrand sal geassesseer word deur 'n komitee wat uit lede van die Overstrand Munisipaliteit se Brandweer en Rampbestuur, Overstrand Munisipaliteit Omgewingsbestuur, Cape Nature en die Overberg Brandbeskermingsvereninging sal bestaan. Om 'n veilige en suksesvolle voorbrand te verseker, sal daar aan streng kriteria voeldoen word. Indien die beplande voorbrand vir 'n sekere blok nie kan plaasvind nie, sal dit oorstan tot die volgende jaar. Alle voertuie, grondspanne, toerusting en lugondersteuning sal onder beheer van die Insidentbevelvoerder by die Bevelsentrum wees. Die program sal aangepas word na aanleiding van die weersomstandighede om die veiligheid en gesondheid van amptenare en inwoners te verseker. Daar sal streng toegangsbeheer by alle omliggende paaie en strate wees tydens en vir 48 uur na die brand. Daar sal slegs aan inwoners van die geaffekteerde area toegang verleen word. Maatreëls sal in plek wees om te verseker dat voetangers envoertuie nie brandbestrydingseenhede in hul werk belemmer nie. Alle persone teenwoordigsal onder die beheer wees van die Hoof: Brandweerdienste en gedelegeerde DivisieBevelvoerders. Die besluite van die Hoof: Brandweerdienste is finaal. GAP HOUSING DEVELOPMENT IN GANSBAAI A ribbon-cutting ceremony will be held on 12 May in Gansbaai where an overview of the approved Gansbaai GAP Housing development will be given. This development is on Erf 210 which was purchased by the developer from the municipality. The name of the development went through a process of discussion with council supporting the name “Reënboog Park” (Rainbow Park), but the preferred name of the developer is Fountain Hill. All parties agreed on the street names which will be Prisma, Spectrum, Indigo, Violet and Korporasie Street (extension of existing street). Altogether 155 housing units will be built. FRANSKRAAL VENUE TO OFFER WEDDING FACILITY AND OUTDOOR ACTIVITIES: Consent has been given for an area near Franskraal to be used as a conference/wedding venue facility with guided tours on quad bikes, truck rides and horse rides. An application was received from Atlas town Planning on behalf of the Van Zabeth Linde Family trust. Farm Panorama 709 is currently devel-

oped with a farm cottage, outbuildings, storage facility and a restaurant. The existing storage facility is to be converted into a wedding venue. Objections were originally received from Franskraal Caravan Park and Klipskuur CC and Grootvlei Beleggings CC pertaining to noise pollution, land erosion and trespassing on private property. The owner of the property has undertaken to maintain the road and mitigate any further erosion. The owner furthermore will endeavour to ensure no trespassing takes place and activities are not a nuisance to guests or surrounding neighbours. Council recommended approval of the application but with conditions which includes: – that the wedding venue may only be used for weddings between 07:00 and 24:00, preparation of the venue may take place before the set times; – guided tours may only take place between 07:00 to 18:00 (weekdays) and Saturdays between 07:00 and 13:00. According to council the development is in line with the Overstrand Spatial Development Framework and can only contribute positively towards tourism activities in the greater Franskraal area.

Hermanus Hospital wins challenge JAN­HENDRIK COETZER

Oncology centre plans bring project to life KERRY VAN RENSBURG Construction of the new Medical Village, on the open erf near Huis Lettie Theron in Westcliff, is expected to commence within the next two months. This was confirmed at a presentation at the U3A open meeting on 9 April. Architectural plans for the Medical Village, which include, among other services, the Hermanus Oncology Centre, were presented by Dr Victor Litlhakanyane. Dr Litlhakanyane is a clinical oncologist and CEO of Ditau Health Management, which will manage the Hermanus Oncology Centre (HOC). The services that will be provided

at the facility include radiotherapy, chemotherapy, nuclear medicine, doctors’ rooms, a sub-acute hospital, a day hospital and assisted-living units. The building will be developed and owned by Annenprop. Dr Litlhakanyane said the HOC will serve the Overberg district with an estimated population of 260 000. In an overview of the project plans, he said the Department of Health (DOH) had approved the oncology unit licence in May 2014 and the plans were approved in October 2014. A contractor has been appointed, and they are awaiting final approval from the municipality. The Medical Village is scheduled for completion by 2016, and should be operational in 2017.

Out of ten district hospitals across the province, Hermanus Provincial Hospital came out tops during the C²AIR² CLUB Challenge, which is a change management programme that was implemented by the Department of Health two years ago. Hermanus Provincial Hospital received a cheque of R60 000 for winning this challenge. The programme was launched mainly to improve the quality of health care services and especially patient care in terms of competence, accountability, integrity, responsiveness and respect. The Hermanus Provincial Hospital was deemed to be the facility showing the most improvement and best demonstrating these values. Natasha Peterson, communications officer for health in the Overberg District, says they focus on keeping their staff happy. “You can spend millions on infrastructure, but at the end of the day your staff’s attitude needs to be right. The staff must be happy to come to work.” After the handover of the cheque, the Hermanus Times was taken to meet a couple who had become proud parents of baby Bella on 29 March. Lee Ann Coetzee’s husband, Clinton, said he was very impressed with the hospital’s service. “The hospital is so clean and the nurses were all very friendly. They went out of their way to

Open day at Inn Afrika Fitness and Events JANINE VD RIET­NEETH­ LING Inn Afrika Fitness and Events in Sandbaai held an open day on Friday to launch the newly heated indoor pool. Inn Afrika is a small exclusive gym, fitness@hermanus, offering circuit training, core fitness, zumba, pilates and aqua fit classes. Cape Orca Swimming School also operates from the facility, teaching children and adults to swim. Visitors had the opportunity to try out the circuit and a

swimming class. Apart from introducing the facilities, Kathryn CelliersLouw from Inn Afrika and Corné van der Merwe from Orca also organised a tombola table and stalls (Camphill’s icecream, Rainbow Trust, Book Cottage, Jolene Piek’s One Sice clothing), from which contributions were made to HAWS. Inn Afrika at 1 Aloe Lane, off Bergsig Street, used to be a guest house, but now offers fitness activities. The venue is also available for weddings and conferences. Long live the Kingpin KOMMENTAAR Uitstel, afstel, diefstal Met ’n 109 veroordeelde misdadigers wat tans uit is op parool in die Overstrand, is daar rede tot kommer. Van daardie 109 oortreders, is, volgens die polisie, die meerderheid gewoontemisdadigers. Onlangs is ’n vrou deur twee verdagtes in Hermanus van haar selfoon beroof. Na wat verneem is, het dié verdagtes slegs enkele minute voor die diefstal uit die hof gestap, waar hulle verskyn het op aanklagte van diefstal. Die saak is egter uitgestel, hulle het uit die hofgebou geloop en die vrou se selfoon gesteel. Hierdie tipe diewe is herhaalde oortreders. Die 109 veroordeeldes wat tans in ons midde rondloop is dalk nie almal gewoontemisdadigers of herhaalde oortreders nie, maar ’n mens moet in gedagte hou hulle kom ná ’n paar maande of selfs jare, uit die tronk. Hulle is werkloos, moontlik haweloos, honger en desperaat vir geld. Sommige van hulle sal meen hulle het geen ander keuse as om te steel en te roof om aan die lewe te bly nie, want hulle het nie werk nie. Baie van die veroordeeldes wat wel gerehabiliteer is, kom dalk weer in aanraking met ou kennisse en makkers, en so word hulle weer betrek by die wêreld van diefstal, roof, geweld en soms, selfs moord.

Hidden agendas I live at Kidbrooke and find it most disconcerting that the two trustees that supported Mr Walton are still with us and one is now our new chairperson. Do they have no integrity? Do they also have a hidden agenda? These are only two of many questions being asked. Are we the next retirement village to go under? Help please from anyone who has expertise in these matters.

Trustees should ‘step down’ to show reconciliation With reference to the article in the Hermanus Times of the (02/04/2015) “Hudd Trust: and Kidbrooke kingpin dethroned by Court” Yes, the mills of justice grind slow, but true. It has taken many years for the Kidbrooke Management Association to reach the positive stage in which they are now, in the recent legal action against the Kidbrooke trustees, who are involved in this very disturbing matter. It is clear from reading the court judgement handed down to the trustees that one man did not act alone in his breach of his fiduciary duties, but was supported, backed and protected by the other members of the Hudd Trust for many years. These were men that many elderly Kidbrooke residents trusted to manage the financial affairs honestly and in the interests of the Kidbrooke retirement village. The new chairman should have stepped down as a trustee of the Hudd Trust to show reconciliation and solidarity in this contentious issue. He should have asked for nomina-

tions for new trustees from all the Life Right holders. This would have tested his credibility and that of the other new trustees that have been appointed by trustees who claim to serve all at Kidbrooke. This can be done without spending any more trust money on litigation and legal consultations. Thank you to Linda Harris and the members of the Kidbrooke Management Committee who worked so diligently and long to serve the Kidbrooke residents around this matter, which was so fervently and vehemently opposed by members of the Hudd Trust. It is hoped that the dethroned chairperson of the trust will pay all the costs as handed down by the Honourable Judge Ashley BinnsWard on 25 March, forthwith. An injection of this money back into funds will go well to serve the people and retirement village of Kidbrooke, if administered by a responsible, transparent and a new, acceptable Hudd Trust.

We are extremely saddened and appalled at the treatment of Mr Norman Walton who, in our opinion, will always remain the ‘Kingpin of Kidbrooke’. He surely developed this beautiful retirement village with much struggle to reach the level of perfection that is apparent to all around us, and which we are so blessed to live with. How could a village such as Kidbrooke not have been developed with many challenges and obstacles? A project of this magnitude must have been an enormous task on its own. Kidbrooke certainly has to be one of the most sought after retirement villages in South Africa. After 30 years in the making, one would expect Mr Walton to benefit somewhat. He rightfully deserves a lot more than he has been accredited for. Yes, he may have made some mistakes in the distant past, but why crucify such a humble, genuine person? Mr Walton surely had many other opportunities to enrich himself in the last three decades, but he chose not to. He could have enriched himself on a far bigger scale and he could have left Kidbrooke after a couple of years, but he didn’t. He committed himself purely for the benefit of Kidbrooke, which we are forever thankful for. At this stage of our lives – in a retirement village – one would hardly expect individuals to be in a power struggle. Now that Mr Walton has left Kidbrooke, it appears that certain members cannot find peace and refuse to engage as retirees should. It seems there is always something new on the agenda. Retirement is a time to enjoy the rest of time we are blessed with. We do not want to get involved in internal politics, which currently reflect so badly on Kidbrooke. People of our stature hardly want to deal with the stresses and strains of management disagreements. We are somewhat fragile at this stage of our lives and we are sickened by the nonsense that is currently prevalent in this lovely village. Many of us hardly leave the house due to the negativity surrounding us. The mere fact that a handful of selfish members can change the friendly environment we were all so accustomed to, is mind-blowing in itself. What has the committee done for us other than create isolation, depression and animosity between fellow villagers? Kidbrooke used to be a place of fun and social events. The mood was light-hearted and everyone got on. One could enjoy the golden years of our lives. We wish Kidbrooke could return to the fun of former years of social activities and cameraderie. It is expected that there will be a response to my letter and I emphasise that I will not take part in any wrangling and disputes that anyone tries to enter us into. Our opinions are our opinions and we will always be in support of our wonderful Mr Norman Walton. We reserve the right not to respond to any further comments on the matter.

The saddest of all, 24 hours later, no doctor had arrived to see the person. How does anyone get help before it’s too late? – DENEECE ) I phoned HT as I was desperate to contact the

new clinic, having tried from 07:00 until after 10:00. Traders to trade again?

CBD revamp meeting

I am surprised that certain members of the public do not make sure of the reasons why the traders have to re-apply for their existing rights to trade. Having been a councillor for the Stellenbosch municipality for about 10 years, I know from experience that every lease granted by the municipality on municipal property is by law required to be put out on tender as and when these specific periods of the leases expire. Most of the current lease holders will probably be granted the right to trade again. There is no sinister force behind such an act. I also know for a fact that a very well-known and wonderful restaurant on Onrus beachfront also had to re-apply for the lease to carry on their business and to date, after many months of waiting, are not sure if they will be granted the lease again to carry on their restaurant business. What will happen to them if their tender is not accepted? The traders at the stalls in question are however at a disadvantage in that there are so many traders duplicating exactly the same goods on sale from stall to stall. One would prefer a greater variety of items on sale to add excitement to the whole shopping experience.

Last year, in November, residents and business owners had the opportunity at a public participation meeting to voice their CBD concerns and ideas – a wish list of sorts. (HT 2014/12/04) Of the areas of concern raised were the stalls at Market Square (referred to as Blikkiesdorp and not representing enough of a local look and feel), the unsightly taxi rank, the under-utilisation of the Old Harbour, Hoy’s Koppie and Lemm’s Corner. Proceedings were overseen by representatives from Deca Engineering (previously ICE Boland) and Gapp Architects. On 30 April, Deca will discuss the findings of this discussion, together with recommendations for the revitalisation of the CBD at a Ward 3 committee meeting at the auditorium. Liezl du Plooy from Deca Engineering said the design concept for the north-south running section of Marine Drive includes proposals for a more seamless integration of the Market Square and Old Harbour areas. According to Riaan Kucher, senior manager: town planning and property administration, the recommendations will be open for public comment afterwards.

You’ll be guided in naked eye, binocular and telescope observations of what is visible in the sky at the moment: the planets Venus

and Jupiter with its four Galilean moons, the Big 5 (the Milky Way galaxy, the Omega Centauri globular cluster, the Southern Pleiades open cluster, the Coal Sack dark nebula and Eta Carinae bright nebula and megastar) in addition to other constellations and clusters of the night that are visible now. You will be assisted in reporting your observations of the Big 5 of the southern skies to the Astronomical Society of Southern Africa (ASSA) to have your name added to the ASSA Big 5 honour roll. He will be talking on how he set up an extremely functional and effective observatory at his home in Fisherhaven. The content will range from construc-

tions basics (the wendy house exterior, a 4x4 pulley to open and close the roll-off roof, a precisely turned wooden pier on which to mount the telescopes) through the calibration systems that he developed to facilitate astrophotography, using two telescopes to samples of the wide range of images that he has already recorded from his observatory.

“We all get involved in disputes at some time or another. That is part of life. This is the reason why we have courts of law. However, anyone who has been involved in court litigation can testify to the loss of time, money, productivity, and the frustration and emotional upheaval caused by such litigation.” So says Henning Viljoen, an Hermanus attorney, adding that often in such court battles the legal costs eventually exceed the capital amount originally in dispute. “This has led to another way of solving disputes, namely Alternative Dispute Resolution (ADR), which involves arbitration or mediation. Lawyers in this country are familiar with arbitration as a means of solving

Mediation can save on costly litigation disputes. What arbitration has in common with court litigation is that the presiding officer ultimately has to make a finding on who is right and who is wrong. Arbitration has an advantage over court litigation in that it is lessformal,isaquickerroutetosolvedisputes and consequently costs less. The parties have to pay the arbitrator or arbiter. “Another way of solving disputes is through mediation, which is also part of ADR, but mediation differs fundamentally from both court litigation and arbitration. Mediation is a voluntary process engaged in by the disputing parties with the object of coming to a possible settlement of the dispute through mutual agreement. This process is confidential and “without prejudice”. The mediator acts as a facilitator in guiding and helping the opposing parties to come to a settlement, instead of making a finding on who is right and who is wrong. “The fundamental difference between court litigation and arbitration on the one hand, and mediation on the other, is that in the first instance, the court or arbiter has to enforce legal rights and obligations and make a finding of right or wrong. With mediation, however, the mediator considers the needs of the parties involved and guides them in achieving a settlement of the dispute. No finding of right or wrong is made and there is no winner or loser at the end of the process. “As far as the time spent to come to a solution, mediation should take even less time than arbitration. Although the parties engagedinmediationalsohavetopaythemediator, the costs should be less than in arbitration, because parties do not have to fight for their rights thus incurring enormous legal costs in the process. Talking about lawyers – they have become familiar with the process of mediation since 1995 with the passing of the Labour Relations Act, which created the Commission for Con-

ciliation, Mediation and Arbitration (CCMA). In terms of this Act, before proceeding to arbitration, the parties involved in a dispute regarding unfair dismissal or unfair labour practice must go through a process of conciliation, which is similar to mediation. The difference, however, is that this conciliation is compulsory, whereas mediation is voluntary. “The success of the CCMA in solving disputes and the increasing disillusionment of the population with drawn-out and expensive court litigation, have moved government to legislate rules providing for so-called magistrate court annexed mediation, which came into operation in December 2014. “One of the objects of these rules is “ to provide litigants or potential litigants with solutions to the dispute, which are beyond the scope and powers of judicial officers.” The process itself is still voluntary, but in some countries, like Canada, it is compulsory for litigants to first engage in mediation. Only if mediation has failed, are they allowed to proceed with court action. Mediation demands some courage from the striving parties. Parties who want to get at each other’s throats must be prepared to face each other in a process that is controlled by the mediator but in which they must seek solutions to their dispute. “Dispute” in this context means any kind of dispute, whether between employers and employees, married couples, as well as civil disputes involving individuals or companies. Plans to establish an Energy Cooperative Representatives from various local organisations met in Stanford on 19 March for the first of a series of workshops planned in the Overberg, to discuss the energy crisis. According to workshop co-ordinator Piet Human from the Bantamsklip Organisation, “The continued load shedding combined with the rising costs of electricity affects us all.” It is estimated that load shedding results in losses to the South African economy of between R20 billion to R80 billion per month. The aim of Bantamsklip Organisation is to facilitate the energy transition of the Overberg, says Human. “But we should not lose sight of our origins – that is, we are the voice of resistance against the building of a nuclear power station at Bantamsklip, an area which, in reality, is a centre of unique endemic vegetation situated next to a marine sanctuary. “Our strategy regarding the promotion of renewable energy is to show that nuclear energy is outdated and superfluous and not worth the sacrifice of this World Heritage Site, which is helping to drive our sustainable tourism industry.” According to Human, the trends driving renewable energy, are, in a nutshell, the rising costs of fossil fuel and nuclearbased electricity generation combined with its damaging effects on our climate and health. “At the same time, the rapid development of renewable energy technology has driven prices down dramatically over the past five years. South Africa is already a top investor in renewable energy. The Renewables 2014 Global Status Report places the country in eighth positionintermsoftotalamountinvested (US$ 4.9 billion) in 2013. “Our national and provincial governments have a comprehensive framework for greening the economy. This picture is repeated at municipal level. “Large renewable energy companies are being formed, attracting money from investors. Our universities and research institutions have seen enormous growth in the area of renewable energy. In short, our policies support renewable energy, the technologies exists and the banks and investors are ready to invest – so what is stopping us from doing it? The Energy Cooperative “Since renewable energy is predominantly decentralised in its production, local communities are important fields of action,” says Human. The majority of emerging energy cooperatives (such as in Europe and the United States) have a special focus on local renewable energy production. They have an open membership approach and democratic decision-taking structure. Built on the idea of achieving goals with joint force, cooperatives empower single players to realise projects that they would not be able to realise by themselves. “Moreover, project sites offer an unusually intense business focus on rural areas. which would otherwise have little potential to attract investment.” Human states that Stanford could become a “model” for others in the region to follow. “In summary, it appears that the general sentiment among participants at the workshop was that Bantamsklip Organisation should proceed to facilitate the establishment of an energy cooperative in Stanford. “To achieve this, we will have to investigate the viability of such a course of action. This includes the present electricity needs of the community, an assessment of the available energy resources (sun, wind, biomass, hydro, geothermal, etc.) as well as the most appropriate renewable energy technology. “We then need to establish the economic viability of such a plan and develop the most appropriate organisational format. “We will work with all the stakeholders, locally, provincially and nationally. Once we have all the stakeholders in place, we will meet for the establishment of the Stanford Energy Cooperative”. FINMONITOR Beware the pitfalls of investment Economic turbulence, technological progress, social and lifestyle changes, uncertain political scenarios, statutory interventions, ingenious tax regimes – all of these constantly intertwine to create a complex investment environment. Add human greed and fear, ruthless operators offering no-good propositions and investor gullibility: clearly, the road to successful investment is littered with numerous potholes and demands expert navigation. Yet, do-it-yourself investors abound. They seemtofavoursavingfeesandforegoingexpert advice above risking capital loss due to lack of skills, inappropriate information, inadequate understanding of relevant variables, poor understanding of risk versus reward and experienced judgment. Only a small percentage of people who are serious about investment are sufficiently competent to be successful on their own. A surprising number of investors fall into the trap of over-diversification, either spreading investable funds over too many unit trusts or shares or doing business with too many service providers. To spread an investment amount of R1 million over 8 unit trusts or 20 shares hardly ever makes sense; to spread one’s investments over 2 or 3 service providers more often than not results in a lack of a well-conceived and professionally managed investment plan. Beingwithoutaninvestmentplanislikesailing one’s boat without a rudder on the wide ocean. Over-diversification can increase rather than reduce risk. The absence of an investment strategy and plan based on sensible analysis of one’s risk “appetite” or “tolerance” is a pitfall to be avoided at all cost. When the going gets tough in turbulent mar-

kets, an investment plan can help investors navigate safely through the storm to more tranquil seas. In most cases where investors don’t have a plan or discard their plan, emotional knee-jerk action is common, which destroys value in no time. Abiding by a tested investment process and plan that is appropriate for your particular needs and objectives is the foundation of a rewarding long-term investment experience. A pitfall to be avoided at all costs is the promise of returns way out of line with what can reasonably be expected – the ‘too good to be true’ offering, mostly by ruthless marketeers earning hideous commissions. Examples of these are notorious property syndications, so-called Ponzi schemes such as those of the King brothers, the Blouberg Radisson hotel scheme and Fidentia, to mention a few. When approached by the purveyors of such seductive schemes, ask for evidence of a license issued by the Financial Services Board, confirmation of commissions earned and details of track record. Quality of management, track record of the business, appropriateness of strategy and corporate reputation are key considerations before committing one’s funds to a specific investment. Hence, exciting accounts over a beer or braai of spectacular gains to be derived almost overnight from rumoured winners need to be regarded as potentially spectacular opportunities for capital loss. Successful investors do their homework thoroughly and steer clear of this pothole. In recent years the spectre of an ongoing fall in the Rand’s exchange rate against major currencies has prompted many investors to stampede offshore with significant portions of their investments. This can hardly be justified. Investing off-

shore is an essential part of a strategy of risk diversification. But first and foremost the offshorehavenshouldqualifyonthebasisofoffering acceptable value, tolerable risk, reliable prospects of return and it should comply with one’s investment plan. A declining exchange rate can sweeten returns but to elevate that as the major driving force for investing offshore is a pothole rather to be avoided. Finally: is cash really risk free? If the purpose of your investment is to provide you or your beneficiaries with a regular income, overexposure to cash is a risk that needs to be avoided. To persist with cash as the preferred asset class is risky because it cannot generate longterm, after-tax returns that beat inflation. It will lead to erosion of capital and reduce one’s future earnings base. A reputable investment adviser can help investors to identify and avoid these pitfalls. Golden Harvest gee erkenning vir uitsonderlike diens Die Golden Harvest Aftree-oord het op 9 April by ’n spesiale funksie erkenning gegee aan personeel vir uitsonderlike diens. Driekwart van die oord se personeel het ’n diensrekord van vyf jaar en langer, en die helfte van hulle het tien jaar en langer diens. Recycle Swop Shop doing well

JANINE VD RIET­NEETHLING Despite a few vandalism incidents, the Zwelihle Recycling Swop Shop (RSS) has grown in the past year. So said Jan van der Velden during his chairperson’s report on Thursday evening at the RSS annual general meeting held at the HouMoed Centre in Zwelihle. The meeting was attended by a few members of RSS, as well as some of the children who are part of the programme, where they earn points by collecting and sorting recycled items. With the points earned, the kids can buy items at the shop from second-hand clothing to school supplies, soap and toothpaste. This happens on Wednesdays, and afterwards the kids are treated with a healthy snack, a sandwich and a fruit. Van der Velden said the past year started slowly, but the number of children participating grew to a total of 3 553 child visits, with the highest number being 170 children on one day. He said the greatest credit must go to Narina Howard, the operations manager, for her dedication and support. She was also elected as

the new chairperson of the RSS at the meeting. The founder of the Zwelihle RSS, Marilyn van der Velden, resigned from the committee earlier this month and thanked everyone for their trust in her, and their assistance. Marilyn started this project in 2003 with the aim of helping children help themselves through recycling.

Join the History Society The Hermanus History Society has been very active since its inception in 2012, with the sole purpose being to bring history alive to the residents of greater Hermanus. They have a number of projects on the go but are seeking assistance from those willing to get involved. Some of these activities are: ) Editing and publishing a book containing the memoirs of Joey van Rhyn Luyt who, with her husband, developed and ran the Marine Hotel between 1915 and 1947. The first printing of 250 copies sold out within a month and a second printing of 50 is almost sold out as well. ) Translating from Afrikaans into English the only existing history of Hawston and producing 100 copies that have also all been sold. ) Producing 100 additional copies of the Afrikaans original of the same book and selling all these. ) Creating 6 audio-visual presentations on aspects of Hermanus history and presenting them to over 500 members of other organisations. ) Identifying 14 practical projects of which five are completed and a further seven are active. ) Re-organising and cataloguing the archives of the Marine Hotel. ) With other organisations working on the upgrading of Swallow Park. ) Working with the Overstrand Municipality designing and erecting 8 history plaques in 4 locations. ) Creating and erecting two History Boards along the Cliff Path, informing readers of key events in Hermanus’s history. ) Setting up a website (www.hermanus-history-society.co.za) which receives an average of 5 000-6 000 hits each month. ) Publishing informative articles in each edition of the magazine Whale Talk. Hulle het die blomme gebruik vir die maak van rangskikkings by die Ysterman Afrika­kam­ pioenskap. Hulle het 24 ruikers gemaak wat by ver­ skeie geleenthede gebruik is, asook 12 bosse blomme wat hulle, namens Interflora, aan die wenners by die wenpaal en gala­prysuitdeling oorhandig het. Louis en Jeff staan by ‘n reuserangskikking wat hulle vir een van hierdie geleenthede moes maak. Hulle het ook al die blomme by die Ysterman­kompetisie in Oos­Londen aan die einde van Januarie gerangskik.

Golf roundup with Julian Shaw I think the Masters must have inspired some of the players as there were some fantastic scores last week. Ladies day: 30 women played the dreaded monthly medal, where every shot counts. Coming out on top in the silver division was Elise Nykamp with a terrific nett 67, and collecting the best gross in the division was Lynne Behagg on a gross 76. The bronze division winner was Marge White with a super nett 71 and best gross in this division was Pippa Meyer with 96. Our best putter was the ever-young Lee Musgrove with 29 putts. Men’s day: Wednesday saw 120 players enjoying a super day, and the format was a betterball stableford. This really was superb golf and the best bogey plus score I can remember in the 10 years I have been at Hermanus Golf Club. Their personal scores were nett 65, 70, 65 and 65 respectively. Brilliant! There were 11 two clubs and ball pool paid to +18. The greens: As most players at the club are aware we have been battling with the greens due to a nasty outbreak of anthracnose. The green keeping staff are doing everything in their power to get it back to where it should be. We look forward to super greens again in the not too distant future. Spelers het in die oggende afrigting gekry waarna die spanne in die middae wedstryde gespeel het. Die o.16-seuns het drie wedstryde verloor en een gelykop gespeel. Volgens die sportorganiseerder, Carina van der Merwe, het min o.16-spanne ingeskryf en moes hulle meestal teen ouer spanne speel. “Die spelers het baie verbeter tydens die hokkiekamp en hulle het op die laaste dag gelykop gespeel teen die o.18-span van Hoërskool Stellenbosch.” Jeremy Verdoodt is aangewys as die junior seunspeler van die toernooi. Die o.16-meisies het drie gewen (teen Hoërskool Stellenbosch, Helpmekaar Kollege en

Top golf amateurs to battle it out at Boland Open The Hermanus Golf Club is hosting the Boland Amateur Open Championship from 27-29 April. The tournament is open to any male amateur who is a life, full or junior member of a club, affiliated to a union recognised by SAGA, and who at the time of submitting his entry, shall have a handicap of 5 or less, assessed in terms of the SAGA course rating and handicap system, or an equivalent handicap assessed under an alternative system acceptable to SAGA. The competition will be played over 54 holes stroke play, and the field is limited to 120 players, who will play 18 holes on Monday and Tuesday, 27 and 28 April. The final 18 holes will be played on Wednesday 29 April, and the field for the final day will be limited to the 72 leading gross scores and ties after the first 36 holes. O.15A NETBALSPAN WEN TOERNOOI : Die o.15 en o.16A netbalspanne van Hoërskool Hermanus het vanaf 7­11 April aan die Paarl Elite Netbalkliniek in die Paarl gaan deelneem. Die o.16A­span het sewe wedstryde gespeel waarvan hulle vier gewen het. Twee van die wedstryde was gespeel teen o.19­spanne. Die o.15A­span het op hulle beurt agt wedstryde gespeel en sewe daarvan gewen. In die finaal het hulle die o.16A­span van Hoërskool Stellenberg geklop en was hulle as die kampioen van die toernooi aangewys.
