HUDD TRUST: RELIEF AS CHAIRPERSON GOES; MILLIONS INVOLVED

Kidbrooke kingpin dethroned by Court KERRY VAN RENSBURG “When I stood up to him, my life became a misery and a living hell. He was very abusive towards me, both verbally and emotionally. It is such a relief to hear that he has been removed.” This was the emotional reaction from Sandra Orji (nee Hudd), the only child of the late Norman and Doris Hudd, when she heard that Norman Anthony Walton, chairperson of the Hudd Trust since its inception in the early 1980s, was removed from office by order of the Cape High Court. After a lengthy court battle between the Kidbrooke Place Management Association and the trustees of the Hudd Trust, judgement was handed down by the Honourable Justice Ashley Binns-Ward on Wednesday 25 March.

Walton was found to be in breach of his fiduciary duty as a trustee and the following order was made: “The first respondent (Norman Walton) is hereby removed from office as a trustee of the Hudd Trust (Master’s Office reference T618/87). “The fifth respondent (Master of the High Court) is directed to take the appropriate steps to give effect to the provisions of paragraph 1 of this order. “The first respondent (Norman Walton) shall be liable for the applicants’ (Kidbrooke Management Association’s) costs of suit, including the costs incurred as a result of the postponements of the application on the scale as between party and party.” The judge declared that Walton was to pay the costs in his personal capacity. In a notice to the Life Right holders (cottage

owners) of Kidbrooke Place dated 20 March 2015, the elected members of the Kidbrooke Place management committee, led by Linda Harris, summarised the case: “At a special general meeting held on 23 March 2012, the Kidbrooke Place Management Association mandated legal action against the trustees for not having acted in the best interests of the Life Right holders, as set out in the agenda papers and minutes of the aforementioned meeting. “The special general meeting and resultant legal action followed only after unsuccessful attempts by the elected representatives at the time in persuading the trustees to rectify certain matters. “On 2 October 2012 the Kidbrooke Management Association’s motion was lodged with the Master of the Supreme Court for the removal of Norman Walton as trustee of the Hudd Trust. “Papers were served on trustee Norman Walton as First Respondent together with Messrs John Martin and Allan Powell. “Mr Robert van Zyl was also named as a respondent as Mr Walton had announced his intention to appoint Mr Van Zyl as a trustee. “ To date the Master has not confirmed this appointment. “The hearing took place in the Cape Town High Court on 4, 5 and 6 November 2014 before Judge Ashley Binns-Ward.” Looking back into the history of Kidbrooke, The Times of Hermanus of 19 October 1989 reported that an R18 million contract had been awarded to Murray and Roberts to build a retirement village called Kidbrooke Place, and the clearing of the 74 acre site had begun. According to news reports, this project was the culmination of eight years of negotiation started in 1981 when the ground, previously Kidbrooke Flower Farm, owned by Norman and Doris Hudd, was donated by the Hudds for the development of a retirement village. Geliefde man dood en vrou in hospitaal na huis brand JANINE VD RIET­NEETHLING ’n Hermanus-inwoner is Sondagoggend dood ná ’n brand in hul kombuis ontstaan het. Awie du Plessis (56) is na verneem word, dood as gevolg van rookinaseming en sy vrou Christa is na die Hermanus Provinsiale Hospitaal geneem waar sy vir brandwonde behandel is.

Dit is nog nie duidelik hoe die brand om 05:00 in hul kombuis in Balfourstraat, Westdene, ontstaan het nie. Volgens konstabel Mbongeni Mazuthu, word die oorsaak van die brand ondersoek. Geen ander eiendom is deur die brand beskadig nie. “Die huis het nie afgebrand nie, maar wel ’n gedeelte van die kombuis, met baie rookskade,”

Ook Ian Basson van Fisherhaven kon nie gered word nadat sy huis aan die begin van Maart vanjaar in ’n vlammehel ontaard het nie. Sy vriendin kon betyds uit die huis vlug en het hulp gaan soek, maar toe die brandweer opdaag, was dit reeds te laat. Omstanders van albei brande beweer dat die brandweermanne eers die vuur ten volle blus, voordat hulle in die huis gaan om ’n persoon te probeer red. Hulle voel meer kan gedoen word om die mense te red. Lester Smith, hoof van Brandweerdienste en Rampbestuur in die Overstrand, sê die brandweerdiens het ’n standaardprosedure hoe voorvalle gehanteer word en dit is noodsaaklik dat lede dit moet nakom om sodoende hul veiligheid te verseker en ook ’n doeltreffende diens aan die gemeenskap te lewer. “Ek wil ook bevestig dat omstanders wat aantygings maak hul feite moet regkry. Brandweerdienste se hooffunksie is die beskerming van lewe en eiendom. “Ons prioriteit is dus om eerstens ’n lewe te red voor ons die brand blus. Ongelukkig kom die brandweer soms op die toneel waar

Geen beskermende klere kan ’n brandbestryder 100 persent beskerm nie aangesien sekere brande hitte opwek van meer as duisende grade Celsius. “Daar is geen manier dat enige lewende wese hierdie hitte kan weerstaan nie. “Ons asemhalingsapparate (Self-contained Breathing Apparatus), met spesifieke verwysing na ons maskers, word ook vervaardig van ’n spesiale plastiek en rubber wat steeds slegs ’n sekere brandbestandheidsgraad het,” sê Smith.

“We have earned our places through sheer determination, but now it seems “other people also want a chance,” says a stall holder, who has been part of the market since the beginning. Market Square tenants moved into the under cover stalls in December 2009. The rent per stall was about R1 300 per month, plus two months’ deposit and electricity. At present the rental rate is R2 145 plus R170 for basic services. Stall tenants have a solution for the OM: Let the newcomers first test their products at the existing open markets at Lemm’s corner, the farmers market, or perhaps new stalls that the municipality can build for them. “Why make families destitute by ripping their living out from under them. Let those “other people” start something else and leave the market well alone – it works!” Another stall holder asks what the process will be for deciding who is “worthy” of a stall. “The highest bidder? Existing shop owners keen for another outlet? Someone else who wants to copy an existing successful business already there? “How is this town and this country then, going to encourage entrepreneurs to build up a business, just to have to lose it every few years to a new tender. Why bother?”

A new tender process will be followed and current traders may have to vacate by the end of June. Before, rental leases were renewed on a yearly basis. “Why toss out successful businesses that are sought out year after year by returning tourists who love the market,” exclaimed one of the traders. Stephen Müller, director: infrastructure and planning at the Overstrand Municipality, says the tender process has not yet been advertised, but he confirmed that the tenants’ contracts will not be renewed. “The specific requirements in the tender document can not yet be revealed until the tender is advertised in the local newspaper and on our website. The tenants have been informed.” He says in terms of the council’s policy, the municipality must follow a competitive process. “This process is being followed, specifically to ensure that the renting out of municipal ground is based on fairness, is reasonable, and in line with legislation. “The policy stipulates that if more than one person or entity is interested in the renting of municipal ground, the renting of the grounds must be through a competitive process.” The current market stall holders at Market Square say the market is a viable and successful tourist attraction, thanks to the businesses that have built the market. “What is to become of the traders whose tenders are not successful?” a stall holder asked. The stall holders whom the Hermanus Times spoke to, wish to remain anonymous. “We are the people who have been there for the past 10 to 35 years, struggling to set up outdoors in the wind and rain, year after year. After years of waiting and begging, the Overstrand Municipality finally built covered stalls for this tourist market.

around a clubhouse. The homes will be sold under life tenure terms. Any profit on the resale of cottages will be ploughed back into the Trust and used in the maintenance and running of the village, to keep levies down.” But it seems that Walton and his co-trustee JC (Koos) Badenhorst who served with Walton from 1992 to 2008, profited through the establishment of a company called Hudd Management Services (HMS). They as the trustees, sold 13 freehold erven adjacent to the retirement village, and 32 ha of farmland (owned by the trust) to themselves (in their personal capacity) as owners of HMS, and sold them for a profit, in order, they claimed, to pay off a R1,74 M overdraft settlement amount to FNB. In his verdict delivered last week, the Cape High Court judge said: “It follows that the respondent and Badenhorst were effectively contracting with themselves in concluding the sale of the properties by the Trust, to their company.” Judge Binns-Ward pointed out that if a trustee wants to purchase immovable property from a trust, it must be sanctioned by a court. This was not done, and according to the judge, their fiduciary duty as trustees behoved them to have made full disclosure to the management committee of the precise nature of the personal interest and gain they stood to realise before embarking on the undertaking. According to the judge, they should not have proceeded with these transactions in the name of HMS, without the informed consent of the beneficiaries. The other main complaint against Walton was the commission earned on the sale of life rights in the development by a close corporation, Codé Design CC. Walton and his wife are the only members of this CC. It was alleged that this company was paid over R5,8 million in commission and administration fees by the Trust between 2001 and 2011.

The judge said that in this matter, “Walton’s conduct points to an inadequate appreciation of the nature of his fiduciary duties with the result that he failed to properly distinguish the proprietary affairs of the Trust from his own.” The judgement further states: “The respondent gives no indication of being astute to how his conduct deviated from that expected of a trustee. I am of the view that the income generated through Codé Design CC was probably seen by him as affording reasonable recompense for his exertions on behalf of the Trust and the Kidbrooke Place development. “Walton’s ‘profound misappreciation’ of his duties and obligations signifies a risk that he may act in breach of his fiduciary duty in other respects should he remain in office.” Harris said she is very satisfied with the judgement. Fernando Smith De Sousa, a resident since 1991, who in his personal capacity contributed R120 000 towards the court case, said. “I never believed in Walton and Badenhorst. They acted in bad faith towards the Life Right holders. I have no faith in the trustees who have now been appointed by Walton. They used Trust money to pay for his defence.” As of 26 March 2015, residents were informed that Allan Powell had succeeded Walton as chairman of the Hudd Trust (see p 5). Sandra Orji (nee Hudd) said: “I, as the daughter of the late Mr and Mrs Hudd, want to congratulate the Kidbrooke Management Committee and am delighted at the news. I was behind the committee who set up the court case.” She said that when her parents signed over the farm to Walton, she felt then that they had given him too much power. “He is shrewd and a master manipulator. What he did to the people in Kidbrooke makes me angry beyond words. There are millions of rand involved. I am grateful for my parents sake he has been removed. My mom can finally rest in peace.”

New chairperson of Hudd Trust appointed KERRY VAN RENSBURG As of 26 March Allan Powell has taken over as chairman of the Hudd Trust. In response to the verdict handed down in the Cape High Court in the case between the Kidbrooke Place Management Association and the trustees of the Hudd Trust, Powell said: “The ruling by the High Court to remove Norman Walton as a trustee of the Hudd Trust has ended his work as chairman of the trust after over 20 years. As

the founder trustee, he had been instrumental in building up Kidbrooke Place after a donation of a farm and R100. During that time he had to improvise ways of getting things done, since this type of retirement village was a new concept in South Africa. “The trustees are studying the judgement and have already started taking steps to ensure the effective functioning of a secure, independent trust. As part of that process we have appointed Alan Marshall, Frances Maytham and Mike van Eyk as new trustees. They come with a

wealth of experience in the world of business and trusts. “The divisions and tensions created by this court action has had a debilitating effect on the atmosphere of Kidbrooke village, and one of the jobs of the new trustees will be to continue a process of healing with likeminded people of good will. “We have therefore been pleased by the expressions of support we have received from residents, and have pledged ourselves to carry on working for the benefit of the beneficiaries, as defined by the Trust Deed.”

Die prys van petrol aan die kus (95­oktaan) het met R1,60 per liter gestyg. Die prys van 93­oktaan het ook aan die kus met R1,54 gestyg. Photographic project launched KERRY VAN RENSBURG A group of 13 students from the Hermanus Youth Art Centre are participating in the pinhole photographic project which is under the mentorship of Lawrance Brennon and Jeandre Marinier. Lawrance, a printmaker and professional photographer, has been actively involved in pinhole photography for many years and has built a number of pinhole cameras. He says the pinhole cameras combine simple technology – a simple wooden box – with a lot of scientific elements. Artist Jeandre is an art teacher at the Hermanus Youth Art Centre. She has recruited the learners who will be part of this initiative. The learners will attend a three day workshop at the centre from 8 to 10 April where they will be taught how to construct the cameras, how to use them and how the images are processed. Each camera will be decorated and individualised by each participant. They will also learn how to write an artist’s statement. Lawrance says the aim is to have the participants and the cameras ready to take photos on what is know as International Pinhole Day on Sunday 26 April. Anyone, anywhere in the world, who makes

a pinhole photograph on the last Sunday in April, can scan and upload it, where it will become part of the annual Worldwide Pinhole Photography Day’s online gallery. The group’s pinhole photos and cameras will be framed and featured at an exhibition at the Hermanus Art Circle gallery during the FynArts Festival.

ARTISTIC COMPANY: Jeandre Marinier’s first solo exhibition was held at the Windsor Ho­ tel on Saturday evening, where she introduced a series of new canvasses exploring inks and oils. Graphic artist, Alexander Mitchley – one of Jeandre’s students, also exhibited his pencil sketches, Sensual Taste. Examples of work produced by the Hermanus Youth Art Centre were also on display. Die skool weet presies wie die ouens is, so hoekom kan hulle nie ’n interdik kry nie?” vra die hoogs ontstelde ouer. By navraag aan die Veilige Skole Projek, geloods deur die Wes-Kaapse onderwysdepartement, het hulle twee weke gelede die skool besoek en bevestig dat daar wel “elemente van buite op die skoolgronde aangetref is”. Volgens Jessica Shelver van die Veilige Skole Projek verkry hulle toegang tot die skoolterrein want die hoofhek word aanhoudend beskadig. “Die departement het al by verskeie geleenthede die hek laat herstel, maar tans is die hek se elektriese toestel ook gesteel.” Shelver sê die skool het veiligheidsmaatreëls in plek gestel. “Die skool het ’n veiligheidsrooster opgestel waarop enige insidente geïdentifiseer en aangeteken moet word. Skooluniforms word ook gemonitor sodat diegene wat nie op die skoolgrond hoort nie, uitgeken kan word. “Die skoolhoof maak ook gebruik van ’n metaalverklikker om te verhoed dat enige wapens die skool binnegebring word.” Volgens Shelver is verskeie maatreëls ook deur die skoolhoof ingestel. “Met behulp van

die departement word die elektroniese toestel van die hek tans vervang. Die skoolhoof het ook bevestig om meer sigbaar op die skoolgronde te wees. Verder het die skool onderneem om ’n vergadering te belê met die beheerraad aangaande die aanstel van sekerheidswagte. “Saam met die skool is ons ook besig met ’n risiko-analise waarna ons sal kyk om ’n verdere veiligheidsplan op te trek om sodoende leerders se veiligheid te verseker.” Volgens Idy Adams, skoolhoof by Hawston Sekondêr, vergader hulle binnekort met die beheerraad. “Ons het ’n vergadering belê vir 9 April waartydens al die veiligheidsaspekte bespreek sal word. Op die vergadering sal die moontlike aanstel van sekerheidswagte ook onder die soeklig wees. “Ons is in die proses om die hek te laat herstel, met die hulp van die departement. Wat die opgradering van die heining om die skool betref, moet ons dit eers op die vergadering bespreek aangesien dit net weer beskadig gaan word as ons dit nou dadelik doen.” Shelver voeg by dat die departement nie aanspreeklik gehou kan word vir die leerders se veiligheid nie, veral nie as hulle hul buite die skoolterrein bevind nie. “Ons het ten alle tye die samewerking van wetstoepassing en veral die polisie nodig. Provinsiale regering sal ook voortgaan om nouer bande met die polisie te vorm wanneer dit kom by die verbetering van veiligheid in en om die skole. “Ouers speel ook hier ’n belangrike rol om hul kinders aan te sê om nie by geweldsituasies of bende-aktiwiteite betrokke te raak nie.” ) Die Veilige Skole Projek het ook nou ’n tolvrye nommer waar ’n klag gelê kan word. Groot ‘rave party’ by Paradise Park toe afgestel JAN­HENDRIK COETZER Die buitelug-musiekfees, of eerder ’n Rave/ Trans Party, aangebied deur Clubbers Campout en Good Hope FM, wat die naweek van 27 tot 29 Maart by Paradise Park sou plaasvind, is op die nippertjie gekanselleer toe die “regte kanale nie gevolg is nie”. Sowat 1 500 partytjiegangers en 30 platejoggies sou na verwagting op dié vakansieoord toegesak en deurnag musiek gemaak het. Volgens Danie Moolman, voorsitter van die Paradise Park Huiseienaarsvereniging, is hy ná ’n skrywe aan die Overstrandmunisipaliteit en Hermanus-polisie Vrydagoggend daarvan in kennis gestel dat die naweek gekanselleer is. “Daar was verskeie punte waaroor ons bekommerd was en waarom ons gevoel het dat so ’n geleentheid nie hier kan plaasvind nie. “Die park is nie omhein nie en enige mens of ongehoorde elemente kan toegang verkry tot persele van eienaars. Daar is ook nie genoegsaam was- en toiletgeriewe om so ’n skare mense te akkommodeer nie. “Daar kon ook heel moontlik ’n misbruik van drank en dwelms wees en daarmee gepaard gaan natuurlik moleste. Die onophoudelike musiek sou ook ’n geweldige rusverstoring veroorsaak het aangesien die oorgrote meerderheid van die inwoners bejaardes en pensioenarisse is.” Moolman sê alhoewel die naweek gekanselleer is, is daar wel ’n groep wat by die park oorgebly en musiek gemaak het. “Daar is Vrydag- en Saterdagaand klagtes van rusverstoring ontvang waarna hulle stilgemaak moes word. Ek is net bly die groot naweekplanne is gekanselleer en dat dit nie die hele groep clubbers was wat daar uitgekamp het nie. Mens kan jou net indink wat die impak sou wees op die omliggende areas ook.” Volgens Micky Nel van Paradise Park se

administratiewe kantoor was daar sowat 80 mense die naweek, maar het hulle nie regtig probleme ondervind nie. “Alles was skoon en netjies toe hulle weg is. Ek is regtig spyt dit is afgestel.” Stephen Müller, direkteur: infrastruktuur en beplanning by Overstrand-munisipaliteit, sê hulle het die organiseerders van die buitelug-musiekfees skriftelik daarvan in kennis gestel dat daar prosedures is wat gevolg moet word. “Ons het op 24 Maart aan hulle geskryf en ingelig dat ’n aansoek ingedien en na die betrokke munisipale en staatsdepartemente gesirkuleer moet word vir hulle kommentaar. “So ’n aansoek sal ook vooraf in die plaaslike media moet verskyn vir openbare deelname aangesien dit ’n impak kan hê op inwoners van Vermont en omliggende areas. “’n Beplanningsverslag sal ook opgetrek moet word en aan die burgemeesterskomitee voorgelê word. As jy hierdie in ag neem, sou dit nie gefinaliseer kon wees voor of op 26 Maart nie.” Volgens polisiewoordvoerder, konstabel Mbongeni Mazuthu, kon die naweek se verrigtinge nie voortgaan nie aangesien die organiseerders nie aan die nodige vereistes voldoen het nie. “Vanuit ’n veiligheidsoogpunt moet daar ’n voorlegging ingedien word, en as dit nie aan die vereistes voldoen nie, word dit gekanselleer. In die geval van Paradise Park is dit gekanselleer. “Indien die organiseerders sou voortgaan, sou hulle uit die aard van die saak aanspreeklik gehou word vir enige veiligheidverwante insidente.”

Add even more local fla­ vour to your weekend, and taste some of our award winning local wines. But, while it is wonderful to be in “holi­ day­mode”, do be careful, as criminals do not go on holiday. Instead, they bargain on holidaymak­ ers leaving their doors and windows open, walking around alone late at night, and leaving laptops and valuables in cars, visible to all and sundry. Unpaid rent, tenants flee Did you perhaps rent accommodation, towards the middle of March, to a well spoken middle-aged couple, both employed, with two small animals? Did you phone the reference given, and receive a glowing report? That same couple has been renting from us. After following eviction procedures, once the lease process had been followed, they took off in the middle of the night, just before the sheriff arrived to attach their assets. We have been left with a legal bill, unpaid rent, a huge water bill, and a house so disgustingly dirty, the cleaning service said they have, in 20 years, never seen anything like it. No one has phoned us for a reference. When the couple moved into our house it was also after midnight apparently, according to a neighbour. Seems like we were not the first to be caught this way by them, and possibly not the last either.

More to subsistence fishing than meets the eye In response to the Hermanus resident who complained about the goings on during the mackerel run recently, I would like to make it clear that I agree with you whole heartedly with the regard to the littering, abusive language, urinating and consuming alcohol in public and general bad behaviour. Having said that, I find the writer to have a romanticised notion as to how a subsistence fishing community supports themselves and their families. Granted that the amount of people who rely solely on fishing to support their families these days is nowhere near what it used to be. Despite that being a fact, many people who share this community have their family roots originating in subsistence fishing. It’s what their families did for generation after generation. That is how they made their living. The images you witnessed would have been no different 30, 50, 80 years ago. The same could be said for any fishing community, whether it be in Simons Town, Hout Bay or Kalk Bay. When people aren’t simply fishing for “fun” but are doing so to provide for their families, it can be quite a cut throat and “barbaric” scene to witness, as is any fishing on a semi or commercial fishing boat. It all comes down to getting as much as possible while the going is good. It definitely doesn’t please me to see fish being ill-treated but I am a “sports angler”

and I’m not fishing to provide for my family. People born in a subsistence fishing community are not simply going to catch three days’ worth of food for their families and pack up for the day and go home. For generations, families were fed by the catch and the rest were sold to those who are unable to catch or bartered for goods or traded for services. That is how fishermen provide for their families. The suggestion of taking only a few for a meal, is far removed from the realities of the real world and a struggling community whose livelihood has been withered away for far too many reasons to try and put across in this letter. Would the writer rather have a large trawler scoop up the entire shoal and benefit just a few people because that is normally what happens or the latter, where hundreds of people benefit from the resource? I know where my sentiments lie. By the way, once caught, a snoek cannot be released. Once its scales and protective slime comes off during handling, they are doomed to die from infection. I’m not supporting those targeting them, not at all, but there were plenty caught as a by-catch. The maasbankers you mentioned weren’t wasted, they were in turn reused as bait.

AGM of Recycle Swop Shop to determine way forward This is to thank everyone who shared themselves and whatever they could to support the little idea to “help children help themselves through recycling” (The Recycle Swop Shop) in Hermanus since 2003. It is also to apologise and ask forgiveness for my many oversights, errors and shortcomings through the past years. The season (Ecclesiastes 3:1-8) for Marilyn van der Velden to be involved with the project has come to an end.

I commit its future into the hands of The Creator, the one who dropped the little seed into my heart and mind. Fire hazard on plot Following the recent, serious fires in the Overstrand and a power outage as a result of runaway fires, is it not time for the municipality to take action to prevent fires, rather than just following the regulations? Numerous complaints and visits to the municipality about the accumulation of inflammable brushwood on a neighbouring vacant plot, resulted in the same feedback:“Aletterwillbewrittentotheoffender and they will have 28 days to comply.” This was ignored by the offender, or worse, more cut wood was added to the pile. We were led to believe that the municipality was ultimately responsible for clearing plots and billing the owners. When pressed on this matter, the municipality replied that funds were not available. We then asked for the owner’s address for assuming responsibility in case of damages. This was refused however, as wasourrequesttohaveourletterforwarded to the owner, on the grounds of a breach of privacy.

The Cape Whale Coast shone at the awards stakes at the Cape Getaway Show by winning an award of excellence as the best local destination for 2015. The show was held at Lourensford Wine Estate on the weekend of 13 – 15 March and was attended by over 15 000 visitors. The criteria for the award was based on the beauty of the stand and images used – best showcasing all the area has to offer, the friendliness as well as depth of knowledge of the team who manned the stand, including the Hermanus Whale Crier concept. The Windsor Hotel and Fynbos trails were also singled out and won the second best accommodation award and an award of excellence /activity respectively.

Budget tabled and open for public comment COMPILED BY CILENE BEKKER The proposed 2015-’16 budget for the Overstrand was tabled in council on 25 March and is now open for public inspection until the end of April. The total budget is R1,072 billion of which R85,5 million is for capital expenditure, (notwithstanding that an estimated R100 million is required annually to sustain capital infrastructure), and R977 million is for operational expenditure. The total revenue is R908 million, of which R745 million is gained from property rates and services. The third largest revenue source is operational grants from national and provincial government. This translates into a budgeted deficit of R69,2 million (compared to R121,6 m for 2014-’15) which, according to the report, does not re-

flect the actual cash position. The asset value of property, plant and equipment (PPE), before depreciation is in excess of R6,1 billion, which relates to substantially high depreciation charges. Although accurately reflecting asset value, the cost of a substantial portion of these assets had been fully redeemed previously, but the useful life of assets were extended as well as ever-increasing assets funded by grants. The replacement thereof can thus not be recouped via current tariffs as this would lead to taxation in advance of need and no reserves may be established for these purposes. Anticipated borrowings to be managed down The capital budget of R85,5 million for 2015-’16 is 27,3% less compared to the 2014-’15 Adjustments Budget. The reduction is due to the available resources to fund the capital budget.

The capital programme increases to R94,6 million (and R103,6 million in the outer years), with anticipated borrowings being R90 million over the three-year period. The balance will be funded from internally-generated funds (3%) and capital grants (65%). The municipality had reached its prudential borrowing limit of 60% of operational revenue in 2012 and has embarked on a strategy to manage this rate down by at least 10%. At the current borrowing programme this rate will be managed down to 44% by 2017-’18. National Treasury has recommended an upper limit of 45%. Challenges include development backlogs and electricity increases Some of the challenges the Overstrand Municipality faces are an ever-increasing population (7th highest growth nationally as per the 2011 census), development

backlogs, increasing poverty levels and ever-aging water, roads, sewage and electricity infrastructure. Added to this is the increased cost of bulk electricity due to tariff increases by Eskom in excess of inflation. Direct Eskom users are now paying (as from 1 April) 12,69% more. The price at which the municipality buys bulk electricity from Eskom, goes up on 1 July with 14,24%. Council has budgeted R193,6 million for the bulk purchase of electricity. The report states that continuous high bulk tariff increases are not sustainable, as there will be a point where services will no longer be affordable. Other main challenges experienced during the compilation of this budget include: • Sustainable refuse disposal; • The need to reprioritise projects and expenditure within the existing resource envelope;

What the mayor said “Before I proceed with my address, I’d like to reaffirm that I proclaimed 2015 as Caring Year, a year that is all about making mutual respect the order of the day. I’d like to share the following motto with fellow-Overstranders: Before you assume, learn the facts. Before you judge, understand why. Before you hurt someone, feel. Before you speak, think. With this message, Mayor Nicolette Botha-Guthrie started her opening address on 25 March when the 2015-’16 draft budget and draft IDP review were tabled in council. “Council is all too aware that the rising cost of living and, for the foreseeable future at least, load shedding , as well as excessive electricity increases approved for Eskom have become a part of the lives of South Africans. “On its part, council will ensure that the capital budget is utilised

to the hilt, even if the resources at its disposal are rather limited most of the time. It goes without saying that productivity, service delivery and good governance will be addressed in earnest, while council promises not to budge from its zerotolerance attitude towards wasteful and fraudulent practices. “We also need to put in place measures to generate a more substantial surplus. To some extent, this has been achieved with the adjustments budget, and the allocation of a Municipal Disaster Recovery Grant of R1,27 million as announced on 31 December 2014, after an application was lodged following substantial damage due to the heavy rainfall and floods in November 2013. “We are mindful of the affordability of services for consumers. It is also a fact that municipal revenues and cash flows are expected to remain under pressure in 2015-’16. “To continue proper service de-

livery to our communities, we however once again had to budget for unfunded mandates to the amount of approximately R28,8 million, which include: ) R1,25 M for libraries; ) R12,27 M for fire brigade services; ) R5,59 M for housing administration and development; ) R2,74 M for tourism; and ) R6,94 M for environmental services. Cost cuts “We went out of our way to eliminate non-core spending and we have paid special attention to costcontaining measures. ) Only one Mayco member was appointed following the retirement of two Mayco members last year. This is in addition to the vacancy that already existed on the Mayco. ) In an independent financial assessment of the Overstrand Municipality undertaken by INCA Portfolio Managers in 2014, it was recommended that the municipality,

among others: - avoid excessive overtime and standby time costs by filling critical vacancies, - optimise the use of internal capacity and external service providers, and - explore more sharing of services with other municipalities. The municipality has subsequently approved participation in the appointment of a risk manager on a shared-service basis, which will benefit all municipalities in the Overberg District. The mayor concluded her address by referring to the clean audit status received for two consecutive years, and on being judged as the most productive local municipality by the Municipal IQ in December. “I also want to thank the community and all the role players of OMAF for their support and participation in the process to ensure accountability and good governance to all the people of Overstrand.

Upped from R1 210 to R1 932,30. ) For second offenders of tampering with, damaging or bypassing of the DSM hot water cylinder control unit, the fee goes up from R4 400 tot R6 461. ) Parking fees for buses, residents permits and season tickets for Grotto and Kleinmond beaches is also set to increase by 10% on average. ) Metered parking (excluding public holidays) - Monthly parking permit: 10% increase from R440 to R484 (VAT incl). - Parking fees to increase from R1 to R2 per quarter hour. The tariff for half an hour is R3, and R6 per hour. Self-dumping of builders rubble: The increase for self-dumping at transfer stations and dumping sites is on average 35%.

• Revenue recovery from cost-reflective core municipal services; • Wage increases for municipal staff that have exceeded headline consumer inflation in the past, as well as the need to restructure certain components for operational efficiencies; • Affordability of capital projects. Cost-saving measures applied The budgeted allocation for employee-related costs totals R291,6 million, which equals 29,8 % of the total operating expenditure and within the NT norm of 2540%. Cost-saving measures applied include: - Restructuring of the OM personnel corps in protection services and introduction of a shift system; - Abolishment of 23 posts; - Principle of 0% increase in noncore general expenses unless valid motivations dictate.

Public participation process Special public meetings in each of the 13 wards, where role players can interrogate the draft budget and draft IDP review documents, have been scheduled. Walking for a dream, in a tutu JANINE VD RIET­NEETHLING A group of people took it upon themselves to walk a gruelling 50 km from Bettysbay to Hermanus early on Monday morning as part of Walk for a Dream fundraiser for local singer Edian Barnard who was chosen to perform at this year’s KKNK in Oudtshoorn. Hermanus Staan Saam (HSS) decided to support the dreams of Barnard by initiating this fundraiser, says Tronel Meintjies, founder of HSS. The 50 km walk was the first step towards reaching Barnard’s goal and more events will follow. A percentage of funds raised will go to HSS to continue its support of local families and those in need. On Monday, members of HSS walked with Barnard and Miss T from Whale Coast FM as they started their journey at 05:00. By 12:00 they reached Hermanus, tired but satisfied with what they had accomplished. During their walk, they handed out Easter eggs to the homeless and people passing by. HSS would like to thank everyone who contributed, especially Roelien Lourens from Mega Brick.

Volgens Von Wageningen is hulle tans 92 dae agter die oorspronklike tydskedule, “maar daar is reeds 87 dae goedgekeurde tydverlenging weens slegte weer en vroeëre vloedskade”. Die kontrak is volgens hom dus eintlik slegs vyf dae agter skedule. Die twee stilhou-en-ry-stelsels behoort nog tot ná die winter in gebruik te wees.

Six suspects, four males and females aged between 25 and 35 were arrested in Kleinmond on Saturday 28 March while in possession of a stolen grey BMW. The vehicle was stolen during a housebreaking in Sharpie Street, Fisherhaven on 26 March. This arrest came after Hermanus Police shared the information to all neighbouring stations and vigilance of the Kleinmond Police who spotted the vehicle in their area. They requested backup from Hermanus Police to pull the vehicle off. Meanwhile, the suspects are linked with several cases, including a robbery which took place in High Street, Hermanus where a person was attacked, a robbery case at Prawn Flats, Hermanus where the suspects used the BMW, and at a housebreaking in Long Street, Hawston where the same vehicle was spotted on the scene. The vehicle was also spotted at a theft case in Sharpie Street, Fisherhaven. Police also recovered the driver’s licence, bank cards and clothing from the suspects. All the suspects appeared in Caledon court on Monday 30 March and the case was postponed for a formal bail application. These suspects will be further charged for the cases that are linked to Hermanus. Station Commander Colonel Nomana Adonis commended the members who were involved in apprehending the suspects.

COPPER COINS GALORE: There are cur­ rently more than 100 businesses supporting the Hermanus Animal Welfare Society’s (HAWS) Copper Coin Collection project since it launched last month. Every month, HAWS will collect the copper coins and the Hermanus Times will report as to what businesses/ retailers are in the lead with the most coins collected. This project runs for six months. U3A hosts talk about the new oncology centre In view of the comprehensive private oncology centre planned for Hermanus, the U3A has invited Dr Victor Litlhakanyane, a clinical oncologist, and the CEO of Ditau Health Management (Pty) Ltd which will be managing the centre, as the guest speaker at their open meeting on Thursday 9 April. The oncology centre will be known as the Medical Village and will offer these services: radiotherapy, chemotherapy, nuclear medicine, doctors’ rooms, sub-acute hospital, day hospital and assisted-living units. Dr Litlhakanyane is experienced in the management and operations of private health facilities generally and oncology units in particular. He obtained his MB Ch B from the University of KwaZulu-Natal, a Masters degree in Medicine (Radiotherapy) and a Masters degree in Business Administration in Health Care from the University of Free State. He was a board member of the Hospital Association of South Africa. Dr Litlhakanyane was appointed chief director for health service in the Free State province in 1995. He became the head of the department of health in the Free State in 2001, and managed 30 hospitals and more than 100 primary health clinics with a staff complement of about 16 000. ) The meeting is scheduled for 17:30 at the Overstrand Auditorium.

FynArts: Last Night of the Proms One of the highlights for FynArts 2015 is a rendition of Last Night of the Proms – a musical extravaganza that will take place on Sunday 7 June at 15:00 and at 19:00. It is an integrated orchestral and choir event with a history spanning some 120 years, and will be conducted by Richard Cock, who was responsible for the hugely popular events Songs of Praise and Lloyd WebberandFriendsatlastyear’sFynArts. The first Proms concert took place on 10 August 1895 and was the brainchild of the impresario Robert Newman, manager of the then newly built Queen’s Hall in London. The main aim is to present the widest possible range of music, performed to the highest standards, to large audiences. Last Night of the Proms at Hermanus FynArts promises nothing less. As is tradition, it will finish with Land of Hope and Glory. Leading up to that the Cape Town Festival Orchestra will be joined by massed choirs from all over the Western Cape and by two stunning soloists who will help to give the whole thing an Italian twist by singing opera excerpts, film music by Enio Morriconi, The Mission, the famous Slaves Chorus by Verdi, the Hallelujah Chorus from Händel’s Messiah and many more favourites. The Proms will round off the first weekend of FynArts 2015, which opens with a musical concert on Friday 5 June by the Cape Town baroque ensemble Camerata Tinta Barocca and sister and brother Avigail (violinist) and Ammiel (pianist) Bushakevitz, from Germany. The music programme will close on Tuesday 16 June at 14:00 with a special Youth Day Concert in the Thusong Hall in Hawston. In between there will be daily lunch time concerts once again, as well as a wide variety of evening concerts with jazz, classical and other light music performed by orchestras, choirs and ensembles. JAN­HENDRIK COETZER Na die vlaag rugbybeserings tydens die Nowan Cornelius Rugbytoernooi op 20 en 21 Maart by Hoërskool Hermanus, het dit weereens gewys hoe ’n belangrike rol die skool se noodhulp speel. Tydens dié toernooi was daar meer as 20 spelers wat vir beserings behandel is. Volgens Maritza du Plooy, bestuurder van die skool se noodhulpspan, was van die ernstiger gevalle ’n gebreekte arm, oop vinger fraktuur, ’n nekbesering, ’n gewrig fraktuur en twee spelers wat moes steke kry. “Dit is maar ongelukkig so dat spelers van enige sport die kans staan om beseer te word. Dit is hoekom ek glo dit baie belangrik is om opgeleide noodhulp te hê, en mense soos Dr. Nico Abel en Garry Whitson op bystand te hê vir die ernstiger gevalle.” Een van die jongste gevalle is toe Gerhard Kruger, o.19A linkervleuel, op Donderdag 25 Maart sy enkel tydens ’n oefening gebreek het. “Ons kon sy been stabiliseer en hom bietjie gemakliker maak totdat sy pa hom kom haal en hospitaal toe geneem het,” sê du Plooy. Volgens Dr. Abel is gebreekte bene redelik dramaties en traumaties vir die beseerde asook die omstanders. “Oor die laaste vyf jaar het ons drie gebreekte onderste ledemate gehad asook sowat 4 kinders met geskeurde anterior kruisligamente van die knie. In Gerhard se geval sal hy sowat drie maande buite aksie wees. “Geskeurde kruisligamente is nie so dramaties soos byvoorbeeld ’n gebreekte been nie, maar eintlik ’n baie meer ernstige be-

sering. Een van die ergste beserings laasjaar was ’n kind van Worcester Gimnasium toe hy sy onderbeen gebreek het met redelike grillerige nagevolge waarna die wedstryd toe ook gestop is.” Dr. Abel sê dat Hoërskool Hermanus van die beste noodhulpspanne het en dat hulle vir geen ander skool hoef terug te staan nie. “Ons het regtig wonderlike en entoesiastiese kinders wat betrokke is by die noodhulp. Die noodhulp by die skool is ook ’n integrale deel van die sport en die kinders word elke jaar vereer by die sportdinee. “ Ook, 20% van die inkomste wat elke jaar deur die Nowen Cornelius Rugbytoernooi gemaak word, maak dit moontlik om sekere dienste aan te bied vir enige behoeftige kind van enige skool wat by ons op ’n sportdag seerkry. “Die fonds is nog klein maar baie groot dinge begin mos maar klein.” Volgens Dr. Abel het hulle tans 30 kinders betrokke by noodhulp en word die kursus sowat twee keer per jaar aangebied. “Die aantal kere wat die kursus aangebied word, hang af van getalle en watter vlak kursus aangebied word. Einde verlede jaar het 40 kinders die basiese noodhulpkursus gedoen.” Dr. Abel sê verder dat ’n mens se liggaam fiks moet wees om gesond te wees, en daarom is dit belangrik dat jy ’n sport beoefen. “Alle sportsoorte gaan met sekere risiko’s gepaard. “Schumacher het jare lank in ’n baie gevaarlike sportsoort teen ’n vreeslike spoed gejaag en toe doen hy ’n ernstige besering op toe hy ski. “Kontaksport het sy risiko’s, maar administrasie doen baie om dit veiliger te maak.”

Walker Bay Xtreme ­ a dream come true The launch of the maiden event will fulfill one of the life-long dreams of Sparks Esterhuysen, founder of the See-and-Sand Institute and one of Hermanus’ most colourful personalities. The Walker Bay Xtreme sports festival will take place in Hermanus from 1- 3 May. Esterhuysen has for some years been toying with the idea of using Hermanus’ unique characteristics as the ultimate one-stop venue for sport extremists who want to challenge themselves and one another on sea, land and in the air. “Combine that with the beauty and infrastructure of our town which will enable urban real-time spectator facilities, and we have an absolute winner. “I have no doubt that with all these attributes, Walker Bay Xtreme will in years to come grow into an inter-

national exclusive sport and spectator event that will do Hermanus proud”, he says. In 2013 Esterhuysen first presented his ideas to a number of interested local individuals and in 2014, the Hermanus Business Chamber and Sea-and-Sand joined forces to establish an organising committee for the first event. The sports festival is also endorsed by the Overstrand Municipality. Extreme items on the programme for the first sport festival include swimming, cliff path running, urban cycling, triathlon, marathon, paragliding, stand-up sea paddling, cross fit challenge, strong man competition, foot-up trails as well as kids challenges and live music entertainment. Mervyn Milner, president of the Hermanus Business Chamber says that the Chamber is pleased to be a

partner in realising the dream of Sparks. “We supported the idea since his very first presentation in 2013 and it is satisfying that the project has also met with so much enthusiasm from various others. “Apart from giving recognition and exposure to our town as an enviable sports venue, it will also stimulate business over a quiet period of the year, he said.” The Chamber has two members on the organising committee for the first Walker Bay Xtreme. 1, 2 en 3 vir Hermanus Verskeie rolbalspanne vanuit verskillende buiteklubs en plaaslike klubs het die jaarlikse Hermanus Apteke-toernooi op 26 Maart weereens sterk ondersteun. Die toernooi is geopen met ’n boodskap en gebed deur ds. Christo Alheit wat die spelers met ’n goeie gees die spel laat begin het. Na twee rondes van 12 koppe elk, het meeste van die spelers die ruskansie van middagete verwelkom. Met die aanvang van die

laaste ronde van 15 koppe was dit weereens ’n kwaai meedinging onder die spelers. ’n Span van Hermanus onder leiding van Elsie McGeoch, het as wenners uit die stryd getree met ’n algehele telling van 27 plus 33. Die naas- wenners was Elsa Carstens en span Hermanus met ’n telling van 24 plus 16. Hoërskool Hermanus het Saterdag 28 Maart teen Hoërskool Hugenote op Wellington meegeding in rugby, hokkie, netbal asook skaak. Dit is ’n paar jaar sedert dié twee skole teen mekaar te staan gekom het en hoop om dit weer ’n jaarlikse instelling te maak.
