En estas líneas, de manera general, se suelen denunciar mejoras y proyectos necesarios para el crecimiento comunitario y el desarrollo intermunicipal de todo el entorno. En esta ocasión, como eventualidad puntual, nos complace centrar la lupa y el foco concretamente en Torreguadiaro, una de las barriadas referentes para el municipio de San Roque y parte principal y protagonista del escenario turístico en el litoral local. Llama poderosamente la atención, entre otros, la falta de una oficina o sucursal bancaria en Torreguadiaro. Cierto es que han podido instalarse hasta dos cajeros automáticos al inicio de la Av. Mar del Sur, junto a la Farmacia, pero que no suman más de dos años en activo y dicho sea de paso, haciendo justicia, no siempre están en funcionamiento y al servicio del ciudadano. Para una de las barriadas de mayor potencial turístico y sobrepoblada en los meses de verano, se

antoja al menos difícil de imaginar que en otros lugares no se estableciese alguna entidad bancaria como sí ocurre en los casos de las vecinas: Guadiaro, San Enrique, Pueblo Nuevo o incluso el Puerto Deportivo de Sotogrande que cuenta con varias. Una cuestión que mejoraría los trámites financieros para sus residentes y visitantes y que además conectaría con el límite provincial con Málaga que emplaza sus primeras oficinas en Manilva. La compra de los terrenos del antiguo cuartel, en actual uso de estacionamiento para vehículos, se espera que reponga algunas de las demandas locales como son las necesarias mejoras en Alcaldía, Servicio de Atención Médico o espacios municipales para más talleres y actividades o incluso el incremento de locales comerciales. Algo que se agradecerá para al ampliar en algo más que a la Av. Mar del Sur, la ofer-

For one of the neighbourhoods

with the most tourism potential and that is most overpopulated during the months of summer, it is difficult to imagine that a bank has not been opened, as is the case in the neighbouring areas: Guadiaro, San Enrique, Pueblo Nuevo and even Sotogrande Marina which has several. This is a matter that would improve financial dealings for residents and visitors and it would also connect the provincial border with Malaga, which has its first offices in Manilva. The purchase of land used by the old barracks, currently used for car parking, is expected to satisfy some of the local demands such as the necessary improvements to the Mayoral office, Medical Assistance Service and municipal services for more workshops and activities or even increase the number of commercial premises. This is something that would be appreciated as it would somewhat increase

the tourism, shopping and restaurant range on Avenida Mar del Sur for visitors. While regaining the distinction of the Blue Flags, granted by ADEAC, along the San Roque coastline (Mediterranean) is positive, it would be good to make the most of the situation in order to increase the quality of the beach services and life-saving. A greater presence on all the beaches, more furnishings and services than the current ones (showers, foot washers, walkways, parasols for shared use on the shore, activities, etc.). This is something that happens in other leading tourist points, such as Tarifa, it is substantially covered with the contributions of the concession of a beach bar or kiosk on the beach. This is something that already happens in the area but it could be improved. Una Comarca muy diferente a la promocionada en Fitur Nada más lejos, tristemente, de la “realidad informativa”. Antagonistas, polos opuestos y fuerzas encontradas. Es complicado y hasta costoso tratar de dar dos imágenes tan diferenciadas y asimétricas como las ejemplarizadas para perjuicio de todas las capas y estratos sociales (cívicos, 1 José Luis García empresariales y demás), Editor/Director que las representadas en jlgarcia@grupohcp.com los últimos días en medios de España y toda Europa sobre la “realidad informativa” en el Campo de Gibraltar. Lejos, muy lejos, parece ya aquel eslogan de “Un Campo de Gibraltar para comérselo” con el que todos presumíamos de las bondades, valores y atractivos en el pasillo que conectaba los pabellones 3 y 5 de IFEMA, en Madrid, con motivo de la Feria Internacional de Turismo FITUR. Los reiterados incidentes de los últimos meses, especialmente pronunciados en las semanas más cercanas, poco o muy poco representan la realidad social que se vive en la Comarca campogibraltareña pero que inevitablemente se ve salpicada y contaminada por la imagen y “realidad informativa” mostrada al resto por los mismo medios

de comunicación nacionales, muy presentes estos días en la zona. Obvio es que no representa el conjunto. Obvio es que esta fructífera y potencial área de servicios, industria y turismo cuenta con todo lo necesario para no precisar relación ninguna, ni lejana ni vecinal, con esos intereses pocos recomendados de un porcentaje ínfimo de la población. Pero así es y el trabajo deberá ser doble, especialmente, desde las balconadas orientadas a la promoción y difusión del perfil turístico. Por desgracia, no siempre es fácil separar el grano de la paja; lo ilícito y delincuente de lo útil y próspero. Pero esas son las cartas repartidas y el deber de todas las partes, incluido el nuestro, luchar y romper esas conjeturas y perjuicios formados a través de tópicos y suposiciones fáciles. Ondear la bandera de esta Comarca y en particular la de Sotogrande por medio mundo ha sido uno de los grandes objetivos de esta casa y por supuesto, en el 20 aniversario de este periódico, lo haremos con más fuerza. Flying the flag for this Province, and in particular for Sotogrande around the world has been one of the main aims of this publisher and of course, on the 20th anniversary of this newspaper, we will do so in an impactful way. Por otro lado, no se pierdan en el informe con todas las inversiones de esta temporada en la urbanización, destaca ese más de millón de euros dedicado a las mejoras en seguridad y el curioso reportaje sobre la “vida política en internet”, algo aletargada y que con la cuenta atrás de un año para nuevos comicios locales veremos como se reactiva y los tenemos “hasta en la sopa” mientras nos acercamos a la cita electoral del futuro mayo de 2019. Mientras tanto, disfruten de este inicio de temporada, más para los de aquí, para los de todo el año, con la tranquilidad de no haber desembarcado aún la gran masa de ‘ilustres visitantes’. Y si quieren darse una vuelta, tomar algo y deleitarse con buen polo y mejor ambiente, no se pierdan la VII edición del Torneo La Quinta. El litoral local contará este verano con hastra tres playas distinguidas con banderas azules, al haberse recuperado la de Alcaidesa-Faro (Torrecarbonera), a la que hay que sumar las de Torreguadiaro y Cala Sardina que se mantuvieron el año pasado. Así

lo publicaba la Asociación de Educación Ambiental y del Consumidor (Adeac), que concede estos galardones. Puerto Sotogrande, por su parte, mantiene también su bandera azul aunque se trata de una instalación de titularidad privada.

El alcalde, Juan Carlos Ruiz Boix, destacó la importancia de volver a contar “con las tres playas con bandera azul, ya que el año pasado se perdió la de Alcaidesa por unos vertidos en la zona linense”. “Es muy importante esta distinción, porque supone un reclamo para los turistas y también un reconocimiento al esfuerzo del Ayuntamiento en materia de playas. Un esfuerzo que también realiza Puerto Sotogrande SA, y que quiero agradecer porque redunda positivamente en la imagen de todo el municipio”, apuntó. Por su parte, el teniente de alcalde delegado de Playas, José Antonio Rojas, explicó que “es una grata noticia saber que recuperamos estén verano la bandera azul de Torrecarbonera, en cuya pérdida no tuvimos ninguna res-

ponsabilidad. Estoy seguro de que el esfuerzo que se realizó el verano pasado en dicha playa ha tenido su reﬂejo en la evaluación realizada por Adeac, y por eso se ha recuperado”. Hay que recordar que, además de las enseñas que se han concedido a San Roque, Adeac tan sólo ha distinguido con bandera azul

en el Campo de Gibraltar a otra playa y a un puerto deportivo, situados en sendos municipios. En toda la provincia de Cádiz han sido distinguidas un total de 30 playas y cinco puertos.

Costas anuncia la rehabilitación de la playa de Sotogrande El delegado del Gobierno en Andalucía anuncia la aprobación de un aporte de arena para el litoral y diferentes actuaciones para la reparación de la playa a causa de los desperfectos ocasionados por los distintos temporales del invierno ✑ M. Demarcación de Costas, institución perteneciente al Ministerio de Medio Ambiente, anunció un importante la aprobación de una actuación para aportar arena en las playas de Guadalquitón y Sotogrande y así reparar los daños de recientes temporales. Por su parte, el alcalde de San Roque, Juan Carlos Ruiz Boix aprovechó la oportunidad para demandar un aporte “suﬁciente” y reclamó la compensación del mobiliario urbano perdido. El delegado del Gobierno Central en Andalucía, Antonio Sanz, anunció que las playas de Sotogrande y Guadalquitón se incluirán entre los tramos de litoral donde se realizarán trabajos de reparación de daños causados por los recientes temporales. El Ministerio de Medio Ambiente va a destinar más de 35 millones

de euros a este tipo de actuaciones en toda la costa andaluza, si bien la provincia de Cádiz se llevará la mayor parte del presupuesto, unos 20 millones. El alcalde recordó que “debemos hacer una valoración positiva de que se vaya a aportar arena en las playas de Sotogrande y Guadalquitón, como se ha

anunciado por parte del delegado del Gobierno. Espero que se haga una aportación suﬁciente, la necesaria para mantener la seguridad de las viviendas que existen en esa línea de playa, y para que todos podamos disfrutar de las playas del municipio, que son propiedad pública. Por lo tanto, que no sea un cubito de

Por eso demandamos que dentro de la regeneración del litoral, San Roque también se beneﬁcie con la recuperación de estos materiales”. La Resolución de la Secretaría de Estado de Medio Ambiente presentada por el delegado Antonio Sanz contempla obras destinadas a reparar los daños producidos por el viento, el fuerte oleaje, las lluvias y las escorrentías. En el caso de Sotogrande, se hace referencia a que el remonte del oleaje sobre la escollera atacó incluso a casas y jardines. Según el delegado, se van a ejecutar todas las actuaciones incluidas en el informe de evaluación de daños que elaboró la Demarcación de Costas.

Más espacios para perros en Sotogrande. Un grupo de vecinos y residentes de Sotogrande, cada vez más numeroso, lleva varios meses demandando la falta de un proyecto basado en la creación de un espacio habilitado para perros en el perímetro de la urbanización. Un amplio y cómodo parque canino, como ocurre en otros destinos y zonas residenciales, en el que poder disfrutar con el animal de una manera más liberada y amena, además de

sociabilizar a los mismos en compañía de otros perros; según explican los interesados. En la actualidad, en la zona del Valle del Guadiaro, ya se encuentra un espacio de este tipo, concretamente en Guadiaro; aunque desde la voz vecinal se reclama la posibilidad de contar también con uno en el interior de la urbanización sin tener que desplazarse a otros puntos cercanos y que además cuenta [Sotogrande] con suficientes zonas verdes

para su instalación sin ocasionar demasiados problemas. Resaltar que en el caso de Guadiaro, en el recinto ferial en la parcela más cercana a la depuradora y tras la actual remodelación del terreno, se encuentra un parque de estas características aunque ello no debería suponer, según defienden estos vecinos, un impedimento para que Sotogrande también cuente con su propio parque canino en la urbanización.

Primavera económica

Hay dos errores de percepción del ciclo económico relacionados entre sí. El primero es no percibir la duración de sus fases. En España se cree que hemos dejado atrás la crisis hace poco, cuando llevamos creciendo desde 2013. Más aún, en 2015, 2016 y 2017, el crecimiento del PIB superó el 3 %. En el primer trimestre de 2018 la variación anual fue del 2,9 % es decir, una pequeña moderación, y los datos del segundo trimestre no sugieren que esa desaceleración se haya acentuado. El segundo error, que cometemos porque la verdad puede ser contra-intuitiva, es no darnos cuenta de que las semillas de la expansión se siembran en la recesión, y al revés. Un poco de reﬂexión nos permite comprender que esto es así, porque si no lo

fuera caeríamos en explicaciones mágicas, simplistas o conspirativas de la evolución económica. Lo conveniente, entonces, en una fase expansiva del ciclo como en la que estamos desde hace varios años, es agudizar los sentidos para intentar averiguar dónde están las señales que pueden avisarnos del posible final de la fiesta. Y recordemos que son señales siempre difíciles de detectar durante la fiesta. Una señal son las tensiones financieras en el mundo, que sugieren que puede terminar la coincidencia que hemos vivido en los últimos años, donde todo el mundo crecía a la vez —esto influye sobre una actividad importante para Sotogrande: el turismo. En ese sentido, ya hemos advertido aquí sobre

el riesgo de entrar en una fase de menor crecimiento con una deuda considerable. A esto hay que sumar la subida de los precios de los activos y las materias primas, que hay que mirar con cuidado ante cualquier cosa que se parezca a una burbuja. Por ﬁn, la política, que puede ser un peligro económico, por su propensión a subir el gasto público, lo que repercute en los impuestos, el déﬁcit y la deuda. Y si encima nos toca un horizonte electoral, esa propensión se acentúa, como hemos visto en las últimas semanas. En suma, seguimos en una primavera económica, también aquí en Sotogrande. Y no vamos a insistir en la melancólica evidencia de que ninguna primavera dura para siempre.

20 AÑOS COMPROMETIDOS CON LA INFORMACIÓN EN SOTOGRANDE

Economic Spring There are two errors in how the economic cycle is perceived and they are linked with one another. The first is not perceiving the duration of its phases. In Spain there is the belief that we left the economic crisis behind a short time ago, when we have been growing since 2013. Moreover, in 2015, 2016 and 2017, growth in GDP surpassed 3%. Thus, in a phase of expansion of the cycle such as that which we have seen for several years, it is advisable to sharpen the senses in order to try to sense where the signs are that could warn us of the possible end of the party. And we should remember that the signs are always difficult to detect during the party. One sign are the financial tensions around the world, which suggest that the coincidence enjoyed over the last few years with everyone growing at the same time could end. This has an influence on an important activity for Sotogrande: tourism. In this regard, we have already warned here about the risk of entering a phase of less growth with considerable debt. In addition to this there is the rise in prices of assets and raw materials, which needs to be considered carefully in the face of anything that could resemble a bubble. Lastly, there is politics, which can be an economic danger, due to the tendency to increase public spending, which has an impact on taxes, the deficit and debt. If on top of that we have an election on the horizon, that tendency is exacerbated, as we have seen in recent weeks. In short, here too in Sotogrande, we continue in an economic spring. And we are not going to stress the sad evidence that no spring lasts forever.

Cuenta atrás de un año para las Elecciones Municipales de 2019

La política local “abandona” Internet Los grupos de la Corporación sanroqueña abordan la actualidad únicamente a través de sus cuentas, institucionales y privadas, en Redes Sociales. El uso de páginas webs, blogs y plataformas similares, inexistente desde las últimas Elecciones Municipales en 2015

Internet: sólo para elecciones. Los principales grupos políticos de San Roque centran su actividad diaria de promoción, crítica y oposición al nivel más popular a través de sus cuentas y perfiles personales en las más conocidas Redes Sociales del mundo digital (además de las clásicas circulares en correo electrónico). Una circunstancia que deja “huérfanas” las tradicionales páginas webs, más que colmadas de informaciones, durante la etapa más latente de actividad política: la campaña electoral. El Periódico de Sotogrande aprovecha que comienza la cuenta atrás de un año hacia nuevos comicios, para realizar un breve repaso por los portales digitales, tradicionales núcleos de la información de los partidos, entre los principales grupos que en la actualidad forman el mosaico de iniciativas en la Corporación

sanroqueño. Primera escala, en la página web del PSOE de San Roque. La última actualización en cuanto a noticias y nuevas entradas data, nada menos que de octubre del 2014 con el nombramiento de Juan Carlos Ruiz Boix como candidato socialista en los comicios municipales que se celebrarían en 2015 (pese a la reciente renovación de cargos en los distritos y barriadas). Datos que contrastan con la mayor actividad que tanto en los perfiles de Facebook y Twitter (algo menos) se lleva a cabo (tónica general en los últimos años). Destacar en este sentido la alta participación del primer edil, Ruiz Boix, desde su cuenta personal en ambos canales que también utiliza para la difusión de información. También, diferentes miembros del equipo de gobierno usan estas herramientas además de estar in-

volucrados en diferentes grupos en los que se publican demandas ciudadanas y quejas (algo que ocurre con ediles de casi todos los grupos políticos). En circunstancias parecidas se encuentra la página web de los Populares sanroqueños. Algo más cercana en el tiempo su última actualización, en mayo del pasado año, pero igualmente caduco en mensajes como el resto. La página principal de la web recibe a los visitantes con un saludo de Marina García, candidata popular en 2015, animando a los vecinos a que apoyen su candidatura. Al igual que los socialistas, sus páginas de Facebook y Twitter si son bastante más activas, principalmente animadas por vídeos y denuncias. Algo que protagonizan destacadamente, también desde sus cuentas privadas, tanto Marina García como Ramón Aranda, dos destacados miembros del actual panorama popular en San Roque. La tercera fuerza más votada en 2015, San Roque sí se puede, no cuenta con página web como tal y difunde la mayoría de sus mensajes a través de su página de Facebook. No es una de las cuentas más activas aunque realiza algunas entradas mensuales. El siguiente grupo las últimas Municipales, el Partido Andalucista, ya no mantiene su actividad como tal tras su cese en 2015 (aunque su blog no se actualiza desde 2011); y aunque “Andalucistas San Roque” sí actualiza

con más/menos asiduidad su página de web con las actividades de su representante en la Corporación, Juan Serván (que ingresó en el equipo de gobierno de Ruiz Boix), aún no cuenta con página web. El PIVG es la última de las fuerzas con representación en el Consistorio sanroqueño. El grupo del Valle del Guadiaro cuenta con una página web en desuso, la cual no se actualiza desde las Elecciones Municipales de 2011 y carece de perfil en Twitter (el cual eliminó tras los últimos comicios). Sin embargo, su mayor actividad se centra en la página web de Facebook del partido y especialmente en la cuenta persona de su representante en la

Corporación, Jesús Mayoral. El portavoz publica y hace llegar a los medios, casi de manera semanal, diferentes informaciones y argumentos que publica también a través de esta red social. La incógnita, que no es tal realmente porque la respuesta se puede imaginar, es si terminarán de perderse la habitual actividad en Internet a través de sus webs los diferentes partidos políticos o ésta se retomará una vez se inicia la época pre-electoral a las Municipales del próximo año 2019. La aparición de un modelo emergente como el de San Roque 100x100 o la delegación del crecimiento Ciudadanos, es otra de las incógnitas cara a los próximos comicios.

One-year countdown until the 2019 Municipal Election

Local politics “abandons” internet Groups of the San Roque corporation solely tackle current affairs through their accounts, both institutional and private, on Social Networks. The use of websites, blogs and similar platforms has been non-existent since the last Municipal Elections in 2015. Internet: only for elections. The main political groups in San Roque focus their daily activity on promotion, criticism and opposition at the most popular level through their personal accounts and profiles on the most well-known Social Networks in the digital world (as well as with classic email newsletters). This situation has left the traditional websites “orphaned”, they were once really packed with information, during the most intense period of political activity; the electoral campaign. El Periódico de Sotogrande is making the most of the start of the oneyear countdown until new elections are held, in order to offer a brief review of the digital sites, traditional hubs of information for the parties, among the main groups that currently comprise the mosaic of different initiatives in the San Roque corporation. First stop, the website of the PSOE in San Roque. The last update in terms of news and new entries, dates back to no less than October 2014 with the designation of Juan Carlos Ruiz Boix as a socialist candidate in the municipal elections that would take place in 2015 (despite the recent renewal of roles in districts and neighbourhoods). This data contrast with the greater amount of activity on both Facebook and Twitter (somewhat less) profiles (the general trend in recent years). In

this sense, it is worth highlighting the high participation level of the mayor Ruiz Boix, from his personal account which he also uses to disseminate information. Also, diﬀerent members of the government team also use these tools to be involved in diﬀerent groups on which civic demands and complaints are published (this is the case with councillors from almost all the political groups). The website of t h e

PP in San R o q u e ﬁnds itself in a similar situation. It has been updated more recently, last May, but is equally obsolete in terms of messages like the rest. The website home page welcomes visitors with a greeting from Marina García, the PP candidate in 2015, encouraging residents to support her candidacy. Just as with the socialists, the PP´s Facebook and Twitter pages are quite a lot more active, mainly accompanied by videos and complaints. This is something that Marina García and Ramón two prominent members of the PP in San Roque at present, also notably play leading roles in from their private accounts. The party that received the third largest share of the vote in 2015, San Roque sí se puede, does not have a website and disseminates the majority of its messages through its Facebook page. It is not one of the most active accounts but they do make some

monthly entries. The following group in the last municipal elections, the Partido Andalucista no longer maintains activity itself following a cease of activity in 2015 (however its blog has not been updated since 2011); and although “Andalucistas San Roque” does update its website on a more or less frequent basis with the activities of its representative in the Corporation, Juan Serván (who joined the government team of Ruiz Boix), still does not have a website. The PIVG is the last of the forces to have representation in the San Roque council. The Valle del Guadiaro group has a disused website, which has not been updated since the Municipal Elections of 2011 and it lacks a Twitter profile (which it deleted after the last elections). However, most of the activity is focused on the party´s Facebook web page and especially on the personal account of its representative in the Corporation, Jesús Mayoral. The spokesperson publishes and sends the media, almost on a weekly basis, different information and arguments that he also publishes through this social network. The uncertainty, which is not really one as the answer can be imagined, is if the websites of the different political parties will lose their standard activity or if this will start up again once the pre-electoral season begins for the Municipal elections in 2019. The emergence of an emerging model such as that of San Roque 100x100 or the growing Ciudadanos delegation, is another of the unknown factors ahead of the upcoming elections.

Concluyen los trabajos de remodelación y rehabilitación del puente de Sotogrande (entre la Marina y la zona costera), con la instalación de un nuevo sistema de juntas de dilatación. La actuación, en su totalidad, roza los 25.000 euros. Se invierten, por parte de la EUC, más de un millón de euros en mejorar los sistemas de seguridad en todo el perímetro. Sustitución y actualización de más de mil luminarias de la urbanización por una nueva tecnología LED. La adquisición de más de mil contenedores vertebra un nuevo plan para la recogida de residuos verdes en Sotogrande.

Más que uno, se podrían contabilizar hasta tres pasos de nivel cualitativo y cuantitativo hacia la proyección de una urbanización más moderna, actual y en especial, más segura. Un importante serial de mejoras y novedades ven la luz al inicio de esta campaña estival en Sotogrande que elevan el status y nivel del destino y además suponen encontrar respuesta a varias de las demandas más cíclicas en la zona y esperadas por los vecinos, tales como un incremento en la efectividad de los servicios de seguridad, iluminación, recogida de podas o la playa. Como aspecto destacado (que no principal), por su carácter de urgencia, resaltar la actuación de emergencia que se tuvo que realizar en el Puente de Sotogrande (principal y única conexión que enlaza la zona de Sotogrande Costa con toda la Marina y el Puerto Deportivo, sin necesidad de tener que abandonar la urbanización y tomar la circunvalación de la A-7). te pronunciamiento de las juntas de dilatación (una cuestión denunciada desde hace años, entre otros, por este periódico), que motivó la decisión por parte de la Policía Local de San Roque de cortar temporalmente el tránsito, rodado y peatonal, el 18 de marzo hasta certificar la seguridad y viabilidad de paso por el puente. En estas circunstancias, el informe elaborado por una empresa especializada en este tipo de valoraciones, determinaba en líneas

generales las buenas condiciones del puente (cimentación y demás), a excepción de la necesidad de “actualizar y modernizar” el sistema de juntas de dilatación. Tras un plazo de algo más de un mes, las partes implicadas (con el informe encima de la mesa) acordaron acometer su rehabilitación y reparación, siendo en este caso financiada por la Entidad Urbanística de Conservación Parques de Sotogrande y Sotogrande S.A. (en cierta medida el reparto de las dos partes más involucradas, además del Consistorio, teniendo en cuenta las competencias de una y otra orilla del puente). La actuación se llevó a cabo en dos fases y con un coste aproximado entre los 23.000 y 25.000 euros. La primera, con la instalación de seis de las doce juntas de dilatación a sustituir, se acometió en la última semana de abril para poder abrir de nuevo el tránsito para el puente de primero de mayo. El resto de juntas (6) se instalaron antes de la quincena de mayo con el corte del puente

sidentes y visitante en Sotogrande este verano será una importantísima inversión, más de un millón de euros, que ha llevado a cabo la EUC Parques de Sotogrande en materia de seguridad. Se trata de un proyecto en el que lleva trabajando más de dos años y que se vio demorado por diferentes trámites administrativos y legales. Afortunadamente, ya se encuentra en fase de ejecución y estará totalmente en funcionamiento a lo largo del verano (presumiblemente para final de julio). Se pueden dividir en tres estas actualizaciones. Por un lado, destacar enormemente la exponencial mejora en el control de matrículas. Se instalarán en el interior de la urbanización hasta un total de 40 puntos de control lo que acota y parcela con muchísima más precisión y agilidad la posición de un vehículo en el interior de Sotogrande con muchísima rapidez y decisión. Esto conlleva un enorme paso hacia delante a nivel preceptivo pero también desde el

punto de vista correctivo en caso de ser necesario. Una mejora de este calibre permitirá además de controlar los vehículos que acceden a la urbanización poder localizarlos con muchísima mayor pericia y precisión en caso de ser necesario. Sin duda, un factible y aconsejado avance en vanguardia de seguridad. En esta línea, como segundo punto, resaltar el importante incremento en un vallado de alta seguridad en diferentes puntos de la urbanización más alejados o sensibles en los que prestar especial interés. En determinados segmentos de la urbanización, especialmente en las lindes, se instalará más de un kilómetro de vallado de alta seguridad con un entramado de mayor densidad, anti-trepa y otras muchas características que multiplica hasta por

que además, según resalta la propia EUC, cumple con todos los parámetros y autorizaciones pertinentes respecto a las leyes de seguridad y de protección de datos. Una iluminación más actual y sostenible Una mejora también palpable y que hasta ahora, más que críticas, ha despertado elogios por parte de numerosos vecinos y residentes de Sotogrande, se trata de la sustitución de la tradicional iluminación de las calles por nueva tecnología LED. En total, más de mil luminarias han sido mejoradas con una inversión de más de 350.000 euros para su ejecución. Tema en ocasiones controvertidos ya que a menudo, entre residentes, se escuchan opiniones muy contrarias respecto al tipo de iluminación que debería predominar en la urbanización. En este caso, manteniendo la característica de una luz cálida y adaptando el mismo farol para no alterar su estética; simplemente se ha mejorado la iluminación, con una potencia pertinente y con una mayor claridad y ahorro energético, a la vez de sostenible, al utilizar tecnología LED. Una medida que también se abraza con elementos de seguridad al permitir una mejora de localizaciones que se presentaban algo más opacas.

Nueva estrategia de recogida de residuos verdes Otro de los puntales que siempre sale a relucir en asambleas vecinales es la “mala apariencia estética” que tradicionalmente sugiere la presencia de los contenedores de recogida de residuos

Con esta medida se trata de conseguir, y así se le hace saber a los residentes, de que cada propiedad contará con uno contenedor para que éste permanezca en el interior de sus parcelas y sea presentado en la calle el día de recogida (uno a la semana), según el sector asignado. Es decir, se ha reforzado el sistema de recogida de residuos vegetales a un total de seis jornadas, repartidas en los diferentes sectores de la urbanización. Una estrategia que por información, contagio y compromiso cívi-

A more modern and secure Sotogrande • Remodelling and refurbishing work concludes on Sotogrande bridge (between the Marina and the coastal area), with the installation of a new expansion joints system. The work amounts to a total of 25,000 Euros. • The UCE is investing more than one million Euros to improving the security systems around the entire perimeter. • Replacement and updating of more than one thousand lights in the resort with new LED technology. • The acquisition of more than one thousand containers is the main pillar of a new plan for green waste collection in Sotogrande. More than one, indeed there are three qualitative and quantitative steps towards projecting a more modern, contemporary, and notably, more secure resort. This is an important series of improvements and new additions that are going ahead at the start of this summer campaign in Sotogrande. They raise the status and level of the destination and also provide solutions to several of the most repeated, and eagerly awaited demands by residents, such as an increase in the effectiveness of the security services, lighting, collection of prunings and the beach. As a notable aspect (but not the main one), due to its urgency, it is worth highlighting the emergency work that had to be carried out on Sotogrande Bridge (the main and only connection that links the Sotogrande Coast area

To offer a little context, following a difficult start to the year in terms of weather, the latest of the most powerful storms (in the fortnight of March), there was a significant exacerbation of the expansion joints (an issues that has been reported for years, among others, by this newspaper). This resulted in the Local Police of San Roque taking the decision to temporarily cut both vehicle and pedestrian traffic on 18 March, until the safety and viability of traffic on the bridge had been certified. Under these circumstances, the report produced by a company that specialises in these types of assessments, determined that on a general level the bridge was in good condition (foundations and other aspects), aside from the need to “update and modernise”

An improvement of this calibre will also make it possible to control the vehicles that enter the resort in order to locate them with a lot more expertise and precision if necessary. Undoubtedly, this is a feasible and recommended step forward at the cutting-edge of security. In this regard, as a second point, it is worth highlighting the significant increase in high-security fencing in different areas of the resort that are more remote or sensitive, where special interest should be paid. In specific areas of the resort, especially on the boundaries, more than a kilometre of high-security fencing will be installed with a stretch of greater density, anti-climbing and many other characteristics that multiply its value and effectiveness by up to four times. the installation, in several locations of the perimeter of the resort, which are also more sensitive, of heat cameras which will make it possible to perceive and detect movements or situations, that could be of interest to the surveillance and security services in the resort, which are suspected to involve criminal activity. Undoubtedly, this is a modern, ambitious, complete and very interesting project towards the substantial improvement of security in the resort, a matter that is of utmost importance to residents, and that as the UCE itself has highlighted, complies with all the relevant parameters and authorisations relating to security and data protection laws. More modern and sustainable lighting This is also a noticeable improvement, and up until now, more than criticism it has led to praise from several neighbours and residents, we are talking about the replacement of traditional street lights with new LED technology. In total, more than one thousand lights have been improved with an investment of more than 350,000 in its implementation. This is an issue that is sometimes controversial, as often among residents there are very oppos-

ble waste collection system has been strengthened to a total of six days, spread around the different sectors of the resort. This is a strategy that could have a fantastic result due to information, the contagion effect and the civic commitment among residents, benefitting everyone and Sotogrande as a unique, excluing views in relation to the type of lighting that should prevail in the resort. In this case, maintaining the characteristic of warm light and adapting the street light itself in order not to change its aesthetic; the lighting has simply been improved, with a relevant power and greater clarity and energy savings, while being sustainable as it uses LED technology. This is a measure that is also linked to security as it enables greater visibility of locations that were previously darker. New green waste collection strategy Another of the points that always comes up at neighbour meetings is the “poor aesthetic appearance” normally offered by the presence of green (vegetable)

waste collection containers in the different streets of the resort. This is a problem that has been getting worse for years and finally, after studying measures in other luxury residential complexes, a decision has been taken to try and eradicate it with a new action plan. This will begin with the UCE for the Parks of Sotogrande purchasing between one and two thousand containers which will be made available to residents with the ultimate aim of each property having one for individual use. The aim of this measurement, as residents have been informed, is for each property to have a container and for it to remain inside their plots and then be presented on collection day (one day a week) according to the assigned sector. On one hand, without confirmation of the dates, accord-

ing to the Coastal Demarcation department (Ministry of the Environment), the coming weeks should see the launch of the plan to rehabilitate and provide sand to the Sotogrande beach from the mouth of the Guadiaro river. This is a necessary step, which would involve the movement of around 20,000 cubic metres of sand, and make it possible to enjoy a beach in magnificent condition this summer, and it help to make progress on the medium-term project to regenerate Sotogrande beach. On the other hand, it is worth highlighting the proper functioning during quite a rainy winter of the improvements to pipes and strengthening of the resort’s network capacity. While this was an issue that was quite a concern during 2017 during the notable cyclogenesis of last year, the close to 500 litres (approximately) per square metre over the recent months of February and March were assimilated without great difficulty by the current pipes. Lastly, it is worth highlighting the launch of the campaign (as residents have been notified) for the cleaning and clearing of plots ahead of the summer season as a preventive measure against fires, which is mostly being adhered to, without major consequences.

María tiene 16 años, está en primero de Bachillerato y sus notas han caído en picado a raíz del reciente divorcio de sus padres. Siempre había sido buena estudiante pero tras lo ocurrido le cueste una barbaridad concentrarse. In their mediation agreement, the parents and child made it clear, with the help of the mediator, that their shared objective was to prevent the family changes from harming Maria. They decided to collaborate, as much as possible, in order to turn obstacles into learning opportunities. They promised to keep Maria out of their divorce process, and in an individual session they reflected on how to do it and offer their daughter the support she needs. Finally, in writing they agreed to an action plan, outlining motivations, limits, timetables, prizes and ways of overcoming the obstacles. The entire process lasted 3 weeks.

El alcalde calificó de encuentro cordial la reunión con los nuevos responsables de la dirección de San Roque Club, de la empresa Asahi Kamko, que tiene la propiedad de un campo de golf y la concesión administrativa del segundo campo de golf de propiedad municipal,

que gestionan por un periodo de 50 años. “Hemos realizado un balance de estos primeros 15 años, viendo las dificultades que atraviesan algunas empresas, que en este caso se agravan en el caso del San Roque Club por el cierre, hace unos meses, de un hotel en las inmediaciones”, indicó el alcalde. Reconoce Ruiz Boix que “hay muchas personas que utilizan los “greenfees”, que lo que vienen es a pasar el fin de semana y que requieren de un hotel próximo, cercano al Campo de golf y que al no existir suponen una merma en los ingresos”.

Recordó el alcalde que “esta empresa lleva ya más de dos décadas asentada en San Roque y queremos que continúe con nosotros, y queremos que se siga desarrollando todos y cada uno de los compromisos que asumimos”. Ruiz Boix adelantó que “vamos a valorar alguna de las peticiones que nos realizan, entre ellas vamos a valorar y estudiar el desequilibrio económico que según ellos se viene realizando en la gestión del segundo Campo de golf municipal, donde los costes del canon no pueden ser asumidos por el número de “greenfees” que se venden”.

Luto en el golf sotograndino. Emma Villacieros, la que fuese presidenta del Real Club de Golf Sotogrande entre 1979 /1989 y de la Real Federación Española de Golf 1988/2008, falleció en Madrid a la edad de 86 años. Villacieros fue una figura imprescindible en el desarrollo del golf en España, deporte al que dedicó toda su vida, encaminando todos sus esfuerzos para conseguir lo que hoy en día es una realidad: popularizar el golf en la sociedad española.

Nacida en San Sebastián el 1 de enero de 1932, Emma Villacieros pilotó la conversión de una actividad deportiva que porcentualmente creció como ninguna otra en España durante sus sucesivos mandatos, con poco más de 45.000 federados cuando accedió por primera vez a la Presidencia, en noviembre de 1988, hasta los más de 330.000 cuando la abandonó veinte años después. La creación y consolidación de una Escuela Nacional de Golf –primero en El Escorial, posteriormente

en Madrid– constituyó también una de sus primeras actuaciones con el objetivo de cimentar las bases de este. Y por supuesto, la celebración de Ryder Cup en 1997 en el Real Club Valderrama, en Sotogrande, como punto álgido dentro del ámbito profesional Emma Villacieros trabajó también con ahínco en el progresivo cambio de mentalidad de las distintas Administraciones Públicas con respecto al golf y los beneficios deportivos, sociales, económicos,

La Guardia Civil desarticula una organización de ‘narcos’ con base en Sotogrande Detienen a los 17 integrantes de la organización e intervienen 5 embarcaciones, 6 armas, 1.734 kilos de hachís y más 3.400 litros de combustible 1 Manuel Gil

La Guardia Civil, en el marco de la Operación Wadi-Nasa, detuvo a los 17 integrantes de una organización de narcotraficantes que operaba en la zona de La Línea de la Concepción, San Roque, Los Barrios y Algeciras. La investigación se inició en septiembre de 2017, cuando la Guardia Civil detectó una organización de narcotraficantes que estaba operando en la zona de Sotogrande, donde el cabecilla poseía un inmueble desde el que dirigía y controlaba los alijos. Para que estos alijos llegasen a consumarse disponían de dos viviendas en Palmones (Los Barrios), en primera línea de playa, desde donde botaban embarcaciones, que habían sido previamente modificadas, para asegu-

rar el interior y permitir la rápida entrada y salida de las mismas. Además habían instalado sofisticados sistemas de seguridad perimetrales y de zona, con el objeto de detectar la presencia de fuerzas policiales en las inmediaciones. También contaban con varias naves industriales en el Polígono de Palmones de Los Barrios, que usaban como base logística y que habían adecuado para guardar vehículos, embarcaciones, motores, tractores, combustibles y remolques. Durante los meses de investigación los guardias civiles frustraron varios alijos, debido a la presión policial. En uno de los operativos establecidos se intervinieron más de 1.700 kilos de

hachís . Se realizaron 13 registros en domicilios y naves en los que se han intervenido 11 vehículos de alta gama, 5 motocicletas, 2 tractores, 5 embarcaciones semirrígidas,1 semirremolque de camión, 2 remolques de embarcaciones, 3 escopetas, 3 pistolas simuladas, 1.010 cajetillas de tabaco de contrabando, 3.427 litros de combustible y 152.450 euros. La operación logra desmantelar la base logística de la organización establecida en dos viviendas y en varias naves ubicadas en Palmones y permite la detención de los 17 integrantes de la organización, todos españoles, a excepción de un gibraltareño. Además otras 4 personas han sido investigadas.

Algo más de medio centenar de socias y familiares compartieron el acto, en el que también se celebraban los quince años de este colectivo, uno de los más activos del Valle del Guadiaro. El alcalde, Juan Carlos Ruiz Boix, asistió a la inauguración junto al teniente de alcalde del Valle del Guadiaro, Óscar Ledesma, y los concejales María Teresa Benítez, David Ramos y Belén Jiménez. El primer edil pidió disculpas a la asociación por haber estado unos cuatro meses sin sede por problemas con el alquiler del anterior inmueble, pero se felicitó porque se había encontrado un local luminoso y situado en pleno centro de la barriada. La tesorera del colectivo femenino, Aurelia Ojeda, agradeció al Ayuntamiento su trabajo para lograr en tan poco tiempo esta nueva sede, y comentó que durante estos cuatro meses los talleres y otras actividades se habían realizado en distintos edificios de la barriada. Explicó que aunque las socias habían tenido que suspender la Cruz de Mayo porque tuvieron que volcarse en la nueva sede, ya tienen previstas otros actos para los próximos meses, como la popular Feria de la Tapa de agosto.

The operation managed to dismantle the logistical base of the organisation set up in two properties and in several warehouses located in Palmones and it enabled the arrest of the 17 members of the organisation, all Spaniards, except for one person from Gibraltar. Operarios contratados por Emadesa para los trabajos de temporada están realizando una limpieza a fondo de diversos puntos de Torreguadiaro para dejar esta zona en buenas condiciones antes de la llegada masiva de los turistas de verano, explicaron desde el Consistorio sanroqueño. A continuación, estas actuaciones seguirán por San Enrique, para luego centrarse en la limpieza de Guadiaro y Pueblo Nuevo. A group of municipal operators carried out a series of improvements and actions to improve the two floors of parking overlooking Torreguadiaro beach. Asfaltan el tramo de la A-7 a la entrada de Torreguadiaro La Demarcación de Carreteras de Cádiz realizó una actuación en la zona de Torreguadiaro, colindante a la gasolinera Montilla, zona en la que sin embargo aún se esperan los permisos para poder realizar una actuación de rehabilitación en las vías de servicio. En concreto, unos trabajos de asfaltado en los cuatro carriles de esta vía, actuación que potencia la mejor seguridad para los vehículos que transitan por esta zona, de entrada al municipio y al Campo de Gibraltar desde la Costa del Sol.

Los alumnos de la Sotogrande International School están entusiasmados porque el viernes 1 de junio de 2018 serán los anﬁtriones de la primera cena benéﬁca de The Kindred Project, que se celebrará en el Club de playa y tenis El Octógono de Sotogrande. El objetivo de la velada es celebrar y compartir con la comunidad, algunas de las iniciativas que The Kindred Project ha llevado a cabo y evidenciar el impacto positivo que la colaboración de los alumnos ha tenido en organizaciones como Nuevo Hogar Betania (La Línea, España), la Asociación Twizi (Marruecos), el Nabugabo Community Learning Centre (Uganda) y la Fundación Yanapuma (Ecuador). En SIS creemos que los jóvenes responsables y proactivos son la clave para superar los problemas del mundo, y por ello debemos

Impuesto sobre Sociedades 2017 El Impuesto sobre Sociedades es una de las principales figuras impositivas del sistema tributario español, tratándose de un impuesto personal y directo que grava la obtención de renta por parte de las personas jurídicas que residan en territorio español, entre las que se encuentran desde 2016 las sociedades civiles. Este impuesto se basa en el resultado contable de la sociedad, siendo el mismo el punto de partida para la determinación de la base imponible y la cuota a ingresar. Además, se debe tener en cuenta que la base imponible puede minorarse compensando las bases imponibles negativas de períodos impositivos anteriores. La base imponible se puede calcular por diferentes métodos: • Estimación directa. La base imponible se calculará, corrigiendo el resultado contable, mediante la aplicación de los preceptos es-

tablecidos en la ley del impuesto. • Estimación objetiva. Se podrá aplicar cuando la ley del Impuesto sobre Sociedades (LIS) determine su aplicación. La base imponible se determina total o parcialmente mediante la aplicación de los signos, índices o módulos a los sectores de actividad que determine la ley del impuesto. • Estimación indirecta. Es un método subsidiario aplicable según lo dispuesto en la Ley General Tributaria. Tras la determinación de la base imponible, se debe calcular la cuota a ingresar, teniendo en cuenta el tipo impositivo a aplicar. Lo aplicarán las Entidades de Crédito y las Entidades dedicadas a exploración, investigación y explotación de yacimientos de hidrocarburos y otras actividades reguladas en Ley 34/1998. En cuanto al plazo de presentación del impuesto cabe mencionar que no tiene un plazo de presentación único para todos los contribuyentes, ya que cada sujeto pasivo tiene su propio plazo en función de la fecha en que concluya su período impositivo. La presentación del modelo 200, o modelo 220 para los grupos de consolidación fiscal, se realizará dentro de los 25 días naturales siguientes a los seis meses posteriores a la conclusión del período impositivo. With regard to the deadline for declaring the tax, it is worth mentioning that there is no single deadline

for declaring the tax for all tax players, as each taxpayer has their own deadline according to the date that their tax period ends on. The submission of form 200, or form 220 for consolidated tax groups will be carried out within 25 calendar days following the six months subsequent to the end of the taxation period. Thus, in cases where the tax period coincides with the calendar year, the presentation period will end on 25 July of the year immediately following the end of the taxation period, except when the last day of the voluntary presentation period is a Saturday or holiday, in which case taxpayers can submit the declaration of the first following working day.

Caducidad y prescripción Queremos hoy explicar dos conceptos que nos pueden servir de gran ayuda en nuestras relaciones con las Administraciones Públicas, incluidas las fiscales. Hablamos del instituto de la caducidad y de la prescripción que, puede o no, llevar aparejada la primera. 1 Luis Babiano Como todos ustedes Abogados / Lawyers saben, la prescripción Sotogrande opera cuando ha transcurrido el plazo previsto en la ley y no se ha ejercitado una acción o derecho. Así, por ejemplo, prescribe el derecho de Hacienda sino procede a liquidar un impuesto dentro del plazo previsto que normalmente es el de cuatro años. Pero también prescribe el derecho del acreedor hipotecario a ejecutar la hipoteca si no lo hace dentro de los veinte años. Cada acción o derecho tiene normalmente establecido en la ley su plazo de prescripción y opera en todos los ámbitos del derecho (civil, mercantil, laboral, social, fiscal, etcétera) Lo importante en este caso es que, producida la prescripción, se extingue el derecho o acción no ejercitado durante el plazo legal. Operada la prescripción el derecho ya no existe y no puede ser exigido. Sin embargo, el caso de la caducidad es diferente, aunque en el presente artículo únicamente nos vamos a referir a la misma en el ámbito administrativo. La Ley del Procedimiento Administrativo Común de las Administraciones Públicas regula la caducidad en su artículo 25 al establecer que en los procedimientos en que se ejerciten potestades sancionadoras o, en general, de intervención, susceptibles de producir efectos desfavorables o de

gravamen se producirá la caducidad si el plazo de la tramitación del procedimiento supera el establecido en la ley. Por ejemplo, las actuaciones de comprobación por parte de la Inspección de Hacienda deben finalizarse en el plazo de seis meses, aunque hay otros preceptos que establecen periodos de caducidad incluso más cortos. La declaración de caducidad del expediente supone que el mismo se tenga por no realizado y que, entre otras cosas, no interrumpa la prescripción. Pero deja a salvo el derecho de la Administración de reiniciar el expediente desde el principio siempre y cuando esté dentro de plazo. Es decir, siempre y cuando no haya transcurrido el período de prescripción porque entonces, como hemos señalado anteriormente, el derecho de la Administración se habría extinguido. Pero si no ha transcurrido el plazo de la prescripción, el expediente se puede volver a tramitar sin ningún inconveniente legal. Esta teoría en principio sencilla y fácil de entender conlleva, como en casi todas las facetas del derecho, inconvenientes en su aplicación práctica sobre todo en materia fiscal que es de la que vamos a hablar a continuación. En principio, el art. 104.5 de la Ley General Tributaria, suprime todos los efectos jurídicos que eventualmente pudieran dimanar de un procedimiento caducado, salvaguardando el derecho sustantivo del órgano administrativo a liquidar si no ha transcurrido el plazo de prescripción. Por tanto, en cuanto a la interrupción de la prescripción es claro que los procedimientos caducados no interrumpen el plazo de prescripción. Pero, por otro lado, el artículo 68 de la misma Ley General Tributaria establece que la interposición de un recurso por parte del sujeto pasivo interrumpe la prescripción ¿qué pasa entonces cuando el sujeto pasivo interpone un recurso mediante el cual se obtiene la declaración de caducidad del expediente? Es muy posible que al finalizar la tramitación del recurso en el que se declare la caducidad se haya sobrepasado el plazo de prescripción ¿Se ha interrumpido o no la prescripción? Si aplicáramos a rajatabla el artículo 68 la prescripción se

habría interrumpido durante todo el período que durara la tramitación del recurso por lo que en principio la Administración podría reiniciar de nuevo el expediente pero esto dejaría sin efecto la obligación de Hacienda de finalizar el procedimiento dentro del plazo legalmente establecido. El tema ha sido resuelto por la jurisprudencia del Tribunal Supremo (Sala de lo Contencioso-Administrativo) en base a la idea de que el precepto nada dice sobre los eventuales recursos del contribuyente destinados a obtener una declaración de caducidad cuando la Administración ha incumplido su obligación de declarar la caducidad de oficio y de archivar el expediente, o sobre los casos, en que recurrida la liquidación por razones de fondo la resolución advierte y declara la caducidad del procedimiento, con la consiguiente anulación de la liquidación. Manifiesta el Tribunal Supremo que se impone, por tanto, una interpretación conjunta del art. 104.5 con el artículo 68. 1 b) de la Ley General Tributaria, por lo que el reconocimiento de efecto interruptivo a la interposición de cualquier clase del art. 68. 1 b) no puede interpretarse en términos absolutamente literales, como viene reconociéndolo a las reclamaciones o recursos instados contra actos nulos de pleno derecho, debiendo admitirse también la excepción respecto a los recursos que permiten obtener la declaración de caducidad. Es decir, cuando exista una norma que diga que la interposición de un recurso por parte del contribuyente interrumpe la prescripción del impuesto, dicha norma no se aplica cuando el objeto del recurso interpuesto por parte del contribuyente es precisamente obtener la declaración de caducidad del expediente pues en este caso no se interrumpe la prescripción. La doctrina del Tribunal Supremo es lógica porque de no entenderse así el artículo 104 de la Ley General Tributaria, no serviría de nada la norma que impone la duración máxima de las actuaciones ya que a Hacienda le bastaría con notificar la liquidación aun estando el expediente caducado y esperar el recurso del contribuyente para dejar sin efecto este plazo máximo.

Expiration and prescription Today we want to explain two concepts that can be very useful in our relationships with Public Administrations, including the tax ones. We are talking about the concepts of expiration and prescription, and the latter may or may not go hand in hand with the former. As you all know, prescription comes into play when, the period provided for in law has passed and an action or law has not been exercised. Thus, for example, the right of the Tax Authority lapses if you do not settle a tax within the outlined period, which is normally four years. As does the right of the mortgage creditor to implement the mortgage if they do not do it within twenty years. Each action or right normally has established in law its prescription period and this operates in all areas of law (civil, trade, labour, social, tax, etc.) What is important in this case is that, when prescription occurs, the right or action not exercised during the legal period ceases. When prescription has been implemented, the right no longer exists and cannot be exercised. However, the case of expiration is different, although in this article we are only going to refer to it within the administrative realm. The Law on Common Administrative Procedure of the Public Administrations regulates limitation in its article 25 by establishing that in the procedures where sanctioning powers are exercised, or in general powers of intervention, that are susceptible to producing unfavourable effects or burdens, then limitation will come into effect if the period for processing the procedure surpasses that which is established in law . For example, checks by the Tax Authority Inspectors must be completed within a period of six months, however there are other provisions that establish even shorter limitation periods.

The declaration of expiration of the dossier means that it is deemed not to have been implemented and that, among other things, prescription is not interrupted. However, it preserves the Administration´s right to reopen the dossier from the beginning provided that it falls under the period. That is to say, provided that the prescription period has not passed because then, as we have previously outlined, the right of the Administration will have lapsed. However, if the prescription period has not elapsed, the dossier can be processed again without any legal obstacles. In principle, this theory is simple and easy to understand, but as with almost all aspect of law, it entails drawbacks in its practical application, above all in tax matters, which is what we are now going to talk about. In principle, article 104.5 of the General Tax Law, removes all the legal effects that could possible derive from an expired procedure, safeguarding the substantive right of the administrative body to settle if the prescription period has not elapsed. Therefore, with regard to the interruption of the prescription it is clear that the expired procedures do not interrupt the prescription period. But, on the other hand, article 68 of the same General Tax Law establishes that the lodging of an appeal by the taxpayer interrupts prescription. What then happens when the taxpayer lodges an appeal through which they obtain the declaration of expiration of the dossier? It is very possible that at the end of the appeal process in which expiration is declared, the prescription period will have elapsed. Has prescription been interrupted or not? If we were to strictly apply article 68, prescription has been interrupted during the entire duration of the appeal, therefore in principle the Administration could reopen the dossier

but this would invalidate the Tax Authority´s Obligation to conclude the procedure within the legally established period. The issue has been resolved through the jurisprudence of the Supreme Court (Administrative Chamber) based on the idea that the provision says nothing about the possible appeals of the taxpayer aimed at obtaining a declaration of expiration when the Administration has not fulfilled its obligation to declare the expiration ex officio and to archive the dossier, or in cases, where having appealed the settlement for substantial reasons, the ruling notifies and declares the expiration of the procedure, with the subsequent cancellation of the settlement. The Supreme Court therefore shows that a joint interpretation of article 104.5 with article 68. 1 b) of the General Tax Law is imposed, therefore recognition of the interruptive effect of the lodging of any kind of art. 68. 1 b) cannot be interpreted in absolutely literal terms, as has been acknowledged in claims or appeals brought against void acts enforced by law, and it is also necessary to allow the exception in relation to the appeals that make it possible to obtain the declaration of expiration. That is to say, when there is a rule that says that the lodging of an appeal by the taxpayer interrupts the prescription of the tax, this rule is not applied when the purpose of the appeal lodged by the taxpayer is indeed to obtain a declaration of expiration of the dossier as in this case the prescription is not interrupted. The doctrine of the Supreme Court is logical because if article 104 of the General Tax Law is not understood in that way, the regulation imposing the maximum duration of the actions would have no point, as the Tax Authority would simply have to notify the settlement with the dossier still expired and wait for the appeal of the taxpayer in order to revoke this maximum period.

El guadiareño Álvaro Quirós selló una sobresaliente participación en el clásico Trofeo Hassan II, del European Tour, al finalizar segunda plaza después de comenzar el día como líder en solitario del torneo. Quirós arrancó con una magnífica vuelta de 67 golpes a la que siguieron otras dos de 70 y 72 para -7 al total, un resultado ligeramente mejor que el -6 de un cuarteto formado por el francés Alexander Levy (que acabaría llevándose la victoria), el finlandés Mikko Ilonen y los sudafricanos Erik van Rooyen y Cristiaan Bezuidenhout. Con esa premisa, la octava victoria de Álvaro Quirós en el European

Tour era una posibilidad muy cercana. En esta ronda final Álvaro Quirós comenzó de un modo irregular, cediendo el liderato en los primeros hoyos. Sin embargo, dos birdies en los dos últimos hoyos le permitieron ascender a la segunda plaza en solitario, a un solo golpe del citado Alexander Levy. Por detrás, Adrián Otaegui (-1), Ignacio Elvira (par) y Pedro Oriol (+1), todos ellos firmantes de un gran papel en el Centro Nacional de Golf la semana pasada, han completado igualmente una buena semana en Marruecos.

El equipo femenino español finalizó en la tercera posición su paso por la prestigiosa Copa Real Club de Golf de Sotogrande, Campeonato Europeo de Naciones, que cerró una nueva edición con los triunfos de Francia, en la prueba femenina, y de Inglaterra, en la masculina. Por su parte, el equipo masculino, clasificó en la quinta plaza final, empatado con Francia. Las cicas computaron las rondas de 78 golpes de Blanca Fernández y Marina Escobar, no así la de Natalia Aseguinolaza, de 79. La donostiarra, sexta, fue sin embargo la mejor de las españolas en el plano individual. España compartió esa tercera posición con el equipo de Alemania y ha finalizó a tres golpes del de Dinamarca,

segunda, y a 17 del de Francia, imparable de principio a fin. Por su parte, los chicos subieron un puesto en la última jornada y ocuparon en la quinta plaza final, empatado con Francia. Los 71 golpes de Adrián Mata y Jorge Maicas, en combinación con los 72 de Ángel Hidalgo –la ronda descartada fue la de Víctor Pastor-, dieron como resultado la mejor tarjeta acumulada del equipo en toda la semana. Las instalaciones de polo, de la zona de Los Pinos, de Santa María Polo Club acogieron el IV Encuentro Interescolar de Rugby Tag San Roque 2018. Con la participación de cerca de medio millar de alumnos de 15 centros educativos del municipio, el encuentro estuvo organizado por el Club Rugby del Estrecho y por la Delegación Municipal de Deportes.

Tag rugby (o rugby tag) es un deporte sin contacto, cualquier forma de contacto intencionado está prohibido y puede ser sancionado con una tarjeta amarilla o roja (el jugador tiene que abandonar el campo de juego). Cualquier forma de contacto no intencionada puede ser sancionada con un golpe de castigo o cambio de posesión. Participaron los diez colegios públicos del

municipio; los institutos Mar del Sur, Sierra Almenara, Castilla del Pino y José Cadalso, y el Colegio Internacional de Sotogrande. El patrocinio corresponde a numerosas empresas y entidades de todo el Campo de Gibraltar, así como la Junta de Andalucía y la Diputación de Cádiz. Van a participar niños de 9 a 12 años de los Colegios del Municipio, y niños de 13 a 16 de los IES.

Tag rugby is a non-contract sport, any form of deliberate contact is forbidden and can be punished with a yellow or red card (the player has to leave the playing field). Any form of unintended contact can be

punished with a penalty shot or change of possession. The ten public schools in the municipality participated along with the schools Mar del Sur, Sierra Almenara, Castilla del Pino and José Cadalso, and Sotogrande International School. Sponsorship was provided by several companies and entities from all over Campo de Gibraltar, as well as the Regional Government of Andalusia and Regional Council of Cadiz. Children aged between 9-12 from Schools in the Municipality participated, along with children aged 13-16 from Secondary Schools.

Nuevo éxito de convocatoria del Club Municipal de Golf La Cañada, nueva gran jornada golfística en el Valle del Guadiaro. La celebración del torneo social de primavera en La Cañada reunió a nada menos que 124 participantes divididos entre dos categorías masculinas y una femenina. Tras una brillante mañana deportiva, como es habitual, le torneo siguió con el clásico almuerzo,

entrega de premios y sorteo de regalos para los participantes. Recordar que la competición puntuaba para el ranking local del club. Respecto a los ganadores, José María Sánchez se impuso en Primera Cat. Caballeros seguido de Francisco Mena y Pedro Sarria. En Segunda Cat. Caballeros el triunfador fue Francisco Gavira, acompañado en el podio por

Daniel Cabeza y José Montero, segundo y tercero de manera respectiva. Y en Damas, María Jesús López Cortijo fue la ganadora, seguida por Julia Chacón y Dolores Ruiz; también tuvo premio especial Thomas Gerand, en el trofeo Scratch.

El V Descenso del rio Guadiaro en kayak, todo un éxito Más de un centenar de personas participaron en la quinta edición del Descenso en kayak por el río Guadiaro, una actividad que organiza la empresa Andalucía Activities con la colaboración del Ayuntamiento. El director de Andalucía Activities, Pedro Melero, señaló que es ya el quinto descenso por el Guadiaro, una actividad que siempre cuenta con una aﬂuencia masiva de interesados en realizarla. “Esta vez son unos 120 participantes que además de disfrutar de un descenso singular, han gozado de una magnífica meteorología, en unas condiciones adecuadas de seguridad, ya que hay monitores a lo largo del río en caso de que fueran necesarios”. Melero reconoció que “la infraestructura es compleja, por lo que se hace un entrenamiento previo, ya que hay muchos participantes que nunca lo han realizado, aunque la tónica es contar con muchos repetidores que les encanta bajar en kayak”, aclaró. Melero finalizó recordando que este año Andalucía Activities está incluyendo como nueva actividad el “paddle surf”. “Está teniendo una aceptación bastante importante por lo que estamos comenzando a hacer rutas en esta modalidad”, reconoció.

El impresionante trazado del Real Club Sevilla Golf mostró la mejor versión posible para acoger la prueba inicial del VI Circuito Golf Sotogrande. Más de 120 jugadores inscritos en la prueba que desafiaron a los 18 hoyos, a un altísimo nivel preparados por el staff del campo, y disfrutaron de una redonda y completa jornada deportiva y social, gracias al desembarco del circuito sotograndino en la capital hispalense; el tercer año consecutivo que la competición tiene parada en tierras sevillanas. Con salidas consecutivas desde primera de la mañana, el más de centenar de golfistas pudieron agradecer la ‘amable’ temperatura en la capital andaluza, pese al amenazante calor que finalmente no se

Seville offers a truly royal start to the Circuit The sixth edition of the Sotogrande Golf Circuit got underway in Seville, at one of the most competitive courses in the south of Spain, with more than 120 participants The impressive course at Real Club Sevilla Golf offered its best possible version as it hosted the opening event of the 6th Sotogrande Golf Circuit. There were more than 120 players registered who took on the 18-holes, prepared to an extremely high-level by the course staff, and they enjoyed a well-rounded and complete social and sporting day, thanks to the arrival of the Sotogrande circuit in Seville; the third consecutive year that the competition has travelled to Seville. With consecutive outings from first thing in the morning, the more than one-hundred golfers were able to thank the “friendly” temperature in the Andalusian capital, despite the threatening heat which finally did not occur, and

which made it possible to enjoy a magnificent day at the prestigious Seville club. Following the event, it was time for tributes, congratulations, distinctions and prizes. Following the intense, competitive and closely-fought day of golf at the magnificent Real Club Sevilla Golf, the traditional cocktail party took place, with a tasting of top-range drinks and of course, the awards ceremony and prize draw. El barco Urban Arkimedes se impuso en la penúltima convocatoria del VII Circuito Marina de Sotogrande/Land Rover celebrada en aguas de Sotogrande. El equipo liderado por John Bassadone conducido esta vez por el tres veces campeón del mundo, Rayco Tabares, era el claro dominador del fin de semana aunque tenía que esperar al segundo día y el descarte de un fuera de línea para lucir los cinco primeros con los que cerraba esta nueva convocatoria. Le escoltaron en los puestos de honor el Marbella Team de Pepequín Orbaneja y Juan Luis Páez, y el PAS Team de Caine Federico y Pablo Villar, segundo y tercero, respectivamente, conformando un podio final que poco se parecía al resultante tras la primera jornada. A falta de una única convocatoria más para poner fin a esta nueva edición del circuito, la contundente victoria del Urban Arkimedes no supone sin embargo ningún peligro para el Marbella Team en lo que a su liderato provisional se refiere habida cuenta de la amplia renta

El Club Municipal de Golf La Cañada hizo pública la rescisión del contrato por parte de los servicios de restauración que prestaba en la Casa Club el conocido hostelero local Juan Moncayo, actualmente. Sin otros motivos y de mutuo acuerdo, el hasta ahora responsable de la restauración del club decidió libremente resolver su compromiso por causas personales y familiares, sin que medio ningún tipo de conflicto entre las partes. Con la fórmula más amistosa, se comunicó también a los socios y usuarios del club que el servicio de restauración continuará en funcionamiento sin ningún tipo de alteración, como es costumbre, hasta que se concierte un nuevo restaurador. Desde la Junta Directiva de La Cañada se lamentó la decisión y pese al interés por que continuase en la gestión, ante la firmeza de la decisión, agradeció a Juan Moncayo y todo su equipo la colaboración y servicios prestados durante estos meses al frente de la hostelería del club.

La Cañada Municipal Golf Club has announced the termination of the contract for the restaurant services currently provided at the Club House by the well-known restaurateur Juan Moncayo. With no other motives and by mutual agreement, the current head of restaurants at the club freely decided to terminate his commitment for personal and family reasons, without any other kind of conflict between the parties. In the friendliest way, it was also announced to partners and users of the club that the restaurant service will continue to operate without any type of changes, as it normally does, until a new restaurateur is arranged. The Management Board at La Cañada regretted the decision and despite interest for him to stay in management, faced with the resolve of the decision, they thanked Juan Moncayo and all of his team for the collaboration and services provided over the course of these months in charge of the club’s catering.

Centenares de niños y niñas de Primaria de colegios del municipio, Tesorillo y Secadero disfrutaron de unas actividades con las que se fomenta el ejercicio físico y, a la vez, se estrechan lazos de amistad. Participaron los colegios Gloria Fuertes (Guadiaro), Barbésula (San Enrique), José Luis Sánchez (San Martín del Tesorillo), Los Almendros (El Secadero), así como un colegio del resto del municipio de San Roque invitado cada día, correspondiendo hoy al Maestro Apolinar (Casco). Los estudiantes disfrutaron desarrollado actividades de saltos, lanzamientos, giros, carreras de sacos... Con todas ellas ejercitan la motricidad y también salen de la rutina diaria del colegio. Hundreds of Primary school boys and girls from schools in the municipality, Tesorillo and Secadero enjoyed activities aimed at encouraging physical exercise, while strengthening the bonds of friendship. El castellonense y el sanroqueño derrotaron en la ﬁnal por el bronce a los letones Samoilovs y Smedins, pasa subir por primera vez al podio de un torneo esta temporada. Los representantes españoles no pudieron luchar por el oro tras una intensa semiﬁnal

ante los brasileños Evandro y André. Los nacionales fueron por detrás en el marcador durante todo el partido y pese a una sensacional reacción del segundo set, salvando tres bolas de partido para tener su oportunidad que no podrían aprovechar (21-19/24-22) para evitar el pase brasileño a la ﬁnal.
