Government announces proposal to withdraw nutrient neutrality restriction for new homes
The Government has announced plans to remove the requirement for new housing developments to demonstrate nutrient neutrality prior to planning permission being granted. This will be enabled through an amendment to the Levelling Up and Regeneration Bill, which is currently working its way through Parliament.
Currently, laws on nutrient neutrality are blocking the delivery of new homes within the Somerset Levels and Moors, River Axe and other catchment areas. It has been estimated that over 18,000no. homes across Somerset are currently stuck in the planning process, with parts of Devon, Dorset and Cornwall also affected.
Nutrients entering the environment are a real problem, but it is well known that the contribution made by new homes is very small. The majority of nutrient pollution in rivers and wetlands comes from farming and from existing homes, with existing water treatment infrastructure currently unable to effectively remove the harmful nutrients. The Government has indicated it plans to tackle these issues at source.
Grant aid will assist farmers to reduce run-off, improve slurry storage and spreading procedures and better manage plant and soil nutrients. The Government will pass laws to require water companies to upgrade wastewater treatment works and funding will be made available for restoration of affected environments and habitats. Meanwhile, further consultation will take place on new requirements for developers to implement Sustainable Drainage Solutions, which will reduce pressure on storm overflows from new homes.
The Secretary of State for Levelling Up, Housing and Communities, Michael Gove MP said: “These changes will provide a multibillion pound boost for the UK economy and see us build more than 100,000no. new homes. Protecting the environment is paramount which is why the measures we are announcing today will allow us to go further to protect and restore our precious waterways whilst still building the much-needed homes this country needs.”
The announcement has been widely welcomed by house builders, who feel they have been disproportionately impacted by the nutrient neutrality issue. However, there has also been a negative reaction to the announcement from some parties, including environmental charities and those seeking to establish nutrient credit markets.
Subject to approval in the House of Lords, and provided that there are no legal challenges, the proposed changes could come into effect within the next few months but the timeline remains uncertain. Until then the requirement to demonstrate nutrient neutrality in the affected areas will remain in place.

THE CARBON FOOTPRINT OF HOUSES
The Building Regulations were introduced in 1964 to guarantee minimum standards in new buildings; to ensure that they were safe for the occupants, stood up, minimised the risks of fire, kept the wind and rain out, provided adequate foul drainage and potable water, had sufficient ventilation and readily useable staircases. Since 1964, there have been a whole series of updates and revisions most notably in the necessary levels of insulation.
Originally levels of insulation were mandated based on the thermal transmittance of various parts of the house. These are expressed as U-Values which are a measure of how much heat is lost, consequently the smaller the number the better the level of insulation. These standards were raised a number of times before being comprehensively revised in 1994 when the Standard Assessment Procedure (SAP) was introduced. This process not only took into account levels of insulation, but also included a section covering the amount of carbon dioxide (CO2) produced. The SAP calculations provided the basis for a home’s Energy Performance Certificate (EPC.) The EPC works in much the same way as the energy rating system for domestic appliances with an A rating being better than a B rating and is based on a fictional house located somewhere near Nottingham.
The Building Regulations still stipulates the minimum levels of insulation needed for the walls, roofs, floors, doors and windows in a house. Unfortunately, this has introduced some confusion. It implies that there is a rule of thumb for the amount of insulation needed. Meeting the minimum standards for the individual parts of the building is not enough to pass the SAP process. It is necessary to adjust the levels of insulation to take into account a whole range of factors from the amount of renewable energy that the house generates to the kind of fuel used to heat it and provide hot water. It is worth noting that the rules relating to house extensions and Listed Buildings are different as are those for major renovations.
In practice, what does this mean for the amount of insulation needed? In most instances (roofs being an exception) foil faced foamed insulation board (PIR) is generally the most efficient option. Assuming a typical brick and concrete block wall at least 90mm of insulation would be needed and for floors around 100mm but this depends on a number of other factors. If the house has a loft space glass or mineral fibre insulation becomes an option with roughly 350mm needed. For ceilings following the line of the roof PIR insulation becomes the preferred option with 130mm of board between the rafters and 50-60mm below them.
The present system for Energy Performance Assessment is intended to offer more flexibility than a simple proscriptive standard for the levels of insulation. In practice, the algorithm that the software for calculating SAP scores uses, is heavily skewed in favour of very low ventilation rates and air source/ground source heat pumps. As a result, it has become nearly impossible to meet the SAP standard using an oil-fired boiler and only slightly less difficult for those running on gas.
Currently houses are responsible for around 26% of the UK’s CO2 emissions and the reduction of this figure is a key element in the Government’s push towards net zero. This is apparent in the recent introduction of a minimum EPC standard of E for rented properties, which will rise to C in 2025. There are a number of approaches to achieving the net zero house Passivhaus being the most well known. Passivhaus relies on three key elements, very high levels of insulation, exploiting solar energy through carefully controlled windows, photovoltaic panels and solar panels whilst reducing the amount of air leakage to almost nothing. There are a number of implications in adopting this approach. A significant increase in insulation means that walls for example will need to be much thicker. To make the most of the available sunlight houses will need to face in a southerly direction. Space will also need to be found for heat pumps, battery banks etc. It seems that the most problematic area is that of airtightness and what impact this will have on indoor air quality. Windows should not open and a powered ventilation system with heat recovery will be needed to support this strategy as will a very rigorous approach to sealing every gap in the house. This frequently involves lining the external walls with plastic sheeting and joining the sheets with adhesive tape, the life expectancy of this is unlikely to be that great.
Given current technology it seems unlikely that the net zero houses can become the norm in the near future and some of the likely consequences of this as an approach seem undesirable. That said a continuing push to reduce domestic energy consumption will continue and levels of insulation will continue to increase.
