WAGESRIGHTS
Theamountofmoneyyouhavetoearn asaH-2Aworkeris$16.23perhour, effectivedateDecember30,2024.If youarenotreceivingthecorrectsalary, contactanattorney.FRLSprovidesfree legalassistancetoFloridafarmworkers. Youremployercannotdeductanything fromyourwagesifitisnotdescribedin thecontract.
Youhavetoreceiveapaystubwith yourcheckwiththedescriptionofthe hours,hourlyrate,andanydeduction fromyourpayment.
CONTRACTUALRIGHTS
Youremployerhastogiveyouacopy ofyourcontractatthebeginningof youremployment.
The¾guaranteeforH-2Aguest workersrequiresemployerstooffer employmentforatotalnumberof hoursequaltoatleast75%ofthe workdaysinthecontractperiod. Youhavetherighttoa¾guaranteedof yourcontract.Forexample:Iftheyoffer you1,000hoursofworkduringthe season,youshouldworkatleast750 hours.
Iftheemployerdoesnotofferenough hoursofworkforyoutoreachthetotal amountrequiredtomeetthe¾ guarantee,theemployermustpayyou theamountyouwouldhaveearned hadyouactuallyworkedforthe guaranteednumberofhoursofwork.
TRAVELCOMPENSATION
Youremployermustpayyouforany inboundtransportationanddaily mealstotheplaceofemployment onceyoucompletehalfofthework contract.
Onceyoucompletetheworkcontract, youremployermustprovideorpayfor yourreturntransportationanddaily meals.
EMPLOYMENTBENEFITS
Safeandcleanfreehousing.For example:youshouldhavecoldwater, hotwater,aheater,andbathroomsin goodcondition.
Youremployershouldprovide3daily mealsatafairpriceorafree,working kitchen.
Ifyougethurtatyourjob,youhavethe righttoobtainworker’scompensation foryourmedicalexpensesandwages. Askyouremployerstotakeyoutothe doctor!
RETALIATIONFREEWORKPLACE
AsanH-2Aworker,youremployer cannotretaliateagainstyouifyou reportanyviolationtoyourrights.Itis aviolationofthelaw.

Ustedtienederechoaquesegaranticen las¾partesdesucontrato.Porejemplo: Sileofrecen1000horasdetrabajo durantelatemporada,usteddebería trabajaralmenos750. Sielempleadornoleofrecesuficientes horasdetrabajoparaquesecumplael montoquerepresentalagarantíade¾,el empleadordebepagarleeldineroque hubierarecibidosihubieratrabajadolas horasdetrabajogarantizadas.
COMPENSACIÓNPORVIAJES
