New Delhi: A forensic team of the All India Institute of Medical Sciences (AIIMS) has conducted viscera test from the reports of the late actor Sushant Singh Rajput to check for poisoning, the results of which will come within 10 days, said Dr Sudhir Gupta, AIIMS on Monday.

Ajmer/Jaipur: In what could be termed as perhaps the Anti Corruption Bureau’s (ACB) most daring and steadfast arrest in the recent times, on Monday evening, the Vice Chancellor of the Maharshi Dayanand Saraswati (MDS) university—Dr RP Singh was arrested—in Ajmer for bribery.

Further, the Bureau sleuths also nabbed a person known to be a close associate of the VC, identified as one

ED arrests ex-ICICI MD Kochar’s husband New Delhi: Enforcement Directorate (ED) has arrested Deepak Kochar, husband of former ICICI Bank MD and CEO Chanda Kochar in connection with the ICICI Bank-Videocon case, said officials on Monday.

In the letter to PM Modi, Gehlot has said that in the 41st meeting of the GST Council, it was suggested by the Central government that the reduction in GST compensation should be met through loans. ment many state taxes were included in the GST. “With this, it was said that compensation would be provided to the states in view of the revenue loss. Citing the meetings held earlier in the GST Council, Gehlot said that several decisions were taken in these meetings including giving 100% compensation on revenue loss. “This

includes the decision to extend it for a period of five years (2017-2022) in the event of a shortfall which is now the responsibility of the central government to pay the entire amount,” he said.

Gehlot said in the letter that instead of a predetermined 14 percent increase to states in the final year of the central government’s compensation, the idea of zero percent increase is unfair. “It is the responsibility of the central government to manage the

Indian economy, because when the tax collection is more, then the central government gets its profit. Therefore, if there is a decrease in GST collection in the economy, it should be taken up by the Central Government,” he said.

Gehlot wrote that the reduction in GST is being assessed by the central government assuming 10 percent growth rate as compared to the previous financial year.

Petrol pump owner shot dead in broad daylight in Jaipur Miscreants decamp with a bag of cash; cops suspect involvement of a known person Satyanaryan Sharma Jaipur: A petrol pump owner was shot dead in broad day light by unidentified miscreants who also snatched a bag containing cash and decamped.

The incident occurred in the parking of a commercial building where the victim Nikhil Gupta (36) had gone to deposit the collection amount in a bank on Sikar road.

“Three to four miscreants were there at the time of the incident.

One of them opened fire at Nikhil, leaving him dead on the spot. They took away the cash he was carrying with him,” police said.

The ordinance was promulgated by the centre in June which seeks to provide for barrier-free trade of farmers’ produce outside the markets notified under the various state agricultural produce market laws.

According to Sanganer police the security screening company’s personnel Surendra Singh registered a complaint along with the airport management that a baggage with id number 11001332 was being screened at level 2 when the security personnel noticed a cartridge like image. The

image was analysed on level 3 and still it appeared to be a cartridge.

When the baggage was opened two live and two used cartridges were found in a packet.

Sanganer police in coordination with the airport management while investigating found the baggage belonged to a retired army personnel.

The retired army personnel who was arrested by Sanganer police said that he had mistakenly kept the packet in the baggage.

Jaipur: High Court allowed private schools to charge 70% of total fees in three installments from parents.

The court of justice SP Sharma, passed the interim order on three petitions filed by Catholic education society, progressive education society and one other petition. Nearly 2,000 private schools had challenged state government’s orders issued on April 9 and July 7, to suspend fees recovery.

The counsels for private schools, Dinesh Yadav, Kamlakar Sharma, Alankrita Sharma and Shailesh Prakash Sharma, argued that private schools had started conducting online classes since April as CBSE’s directions.

Court allowed schools to charge 70 % of fees in three installments. The court also said that school may stop online class facility for a student in case fees is not deposited but the student shall not be debarred from school.

Now, the family members will be able to perform the last rites while following certain safety guidelines.

However, if the family members are not willing to take the body

then the arrangement of funeral/cremation will be looked after by the local bodies.

The state government took the sensitive

decision on Monday.

CM likely to inaugurate metro’s new route between Sept 18-20 First India Bureau Jaipur: The government will inaugurate the metro service on a 2-km stretch from Chandpole to Badi Chaupar.

Metro have been allowed by the centre to resume services from September 7 under unlock-4 guidelines but in Jaipur, they would resume from the third week and with this, the service from Chandpole to Badi Chaupar will also be inaugurated.

A Constitution – the Bible of a nation - has to complement the individualities of the sovereign people who bring it into being. Hence, in the then temporal frame, our Constitution devised a new contrivance to meet the special requirements of Indian society

ecently, an article in a leading English national daily made a thesis that the outbreak of Covid-19 pandemic has led to our country being governed in a unitary manner, even though our constitution has laid down a federal structure of the government. There was a cavil in the article that this unitary functioning required to be looked into and scrutinised by the Hon’ble Apex Court as being violative of our federal character. It is relevant to point out the Central Government’s directives to all the States and Union Territories emanated under the Epidemic Diseases Act, 1897, a law which was first enacted to tackle bubonic plague in Mumbai (formerly Bombay) in former British India and Disaster Management Act, 2005.

These law are meant for controlling epidemics and national disasters by providing special powers that are required for the implementation of containment measures to prevent the spread of the disease or to manage the situation arising due to any disaster. The Epidemic Diseases Act, 1897 has been routinely and continuously used to contain various diseases in India such as swine flu, cholera, malaria, and dengue in 2009, 2015 and in 2018.

Starting in March 2020, the Act has been enforced across India in order to prevent the spread of Covid-19 pandemic in India. Similarly, the Disaster Management Act, 2005, has also been used to control all kinds of disasters across the country.

A ‘doubting Thomas’ might question the propriety of invoking these Acts so as to curb freedom of States and UTs in tackling this pandemic and thereby diluting our federal structure. In order to ensure uniformity in the measures to be adopted by various States and UTs, as well as their implementation,

the National Disaster Management Authority (NDMA), in the exercise of the powers under section 6(2)(i) of the Disaster Management Act, 2005, issued successive orders directing the Ministries / Departments of Government of India, and the State / Union Territory Governments and State / Union Territory Authorities to take uniform and effective measures to prevent the spread of COVID-19 in the country. In compliance with the orders of NDMA, Ministry of Home Affairs (MHA), GoI, also issued orders under Section 10 (2) (l) of the Disaster Management Act, 2005, also reiterated these directives proclaiming lockdown across the country which remained in force throughout the country for definite periods.

The central theme of this article is whether Centre’s enforcing uniform guidelines in the States / UTs in the wake of Covid-19 pandemic is, in any manner, tantamount to the infringing federal structure of our country. The word ‘federal’ is derived from a Latin word ‘foeder’ meaning a compact or a league. Black’s Law Dictionary defines ‘federal’ as “a

system of associated governments into national and regional components having different responsibilities.”

Likewise, a ‘federation’ denotes “a league or union of states….united under a strong central authority but retaining limited regional sovereignty.” (Emphasis added).

In the light of these connotations, an attempt is made to reconnoiter our federal structure. Normally, a federation comes into being with States parting with their sovereignty in favour of a central authority with a mandate that powers given to them shall not be taken away without

their concurrence. Unlike in the US and Australia, States in India did not have their own constitutions.

They were governed by the Government of India Act, 1935, which was framed, broadly with a federal structure for the country.

Later, our Constitution was enacted with all the main ingredients of a federation to continue the legacy of the Government of India Act, 1935, keeping in mind the then needs and certain particularities of Indian polity. Dr. Ambedkar said in his Constituent Assembly speech that “there is nothing to be ashamed of in borrowing.

Nobody holds any patent in the fundamental ideas of a Constitution.”

In the wake of our diversity, plurality, and the historical perspectives and the fact, that there were more than 560 princely states having subsidiary alliance with the British Raj at the time of British withdrawal, the country needed a unifying basic law to bind the whole country into one. The functioning of various federal systems manifested that there was a need to mitigate the rigidity and legalism of a federal constitution by adopt-

ing the modus vivendi of distribution of powers and certain other methods. Dr. Ambedkar said these provisions made the Indian Constitution “both unitary as well as federal according to the requirements of time and circumstances.” Framers of the Constitution incorporated salient features of a federation to make the Indian Constitution federal in form, albeit with certain unitary components, and enshrined special provisions to alleviate the rigidity of federalism.

Importantly, these provisions include, inter alia, a) single Constitution for the Union and the States (special status of J&K has since been abolished in 2019); b) Constitution attains unitary character during emergencies under Part XVIII of the Constitution (Articles 352-360); c) single citizenship (state citizenship for J&K has been abrogated in 2019) for the whole of India; d) a strong central authority with residuary powers over whole of the country and powers over the States under certain circumstances (Articles 246, 248, 249, 250 252); e) Central Government can reorganize the boundaries of the States and change their

Steeped in corruption: Nadda on Soren govt New Delhi: BJP president JP Nadda launched a blistering attack on the Hemant Soren government in Jharkhand on Monday, alleging it was “steeped in corruption”.

Addressing the state BJP executive committee meeting digitally from New Delhi, he said the previous BJP government led by Raghubar Das had “almost eliminated” naxlism, which has been resurrected under the Soren dispensation.

New Delhi: The SC on Monday deferred till September 15 hearing on a petition seeking to fill vacancies in various tribunals, after it was informed that Attorney General KK Venugopal, who was to argue for the Centre, is in self-quarantine.

A Bench of Justices L Nageswara Rao and Hemant Gupta posted the hearing in the matter on next Tuesday pertaining to filling up of vacancies in various tribunals across the country.

Additional Solicitor General SV Raju sought an adjournment in the matter saying Attorney General, who was to represent the Central government, is in self-quarantine. Solicitor General Tushar Mehta clarified that one of his colleagues had tested positive for COVID-19.

“AG is in self-isolation as a precaution.

REPLIES FROM STATES New Delhi: The Supreme Court granted another four weeks time to states, which have not yet filed affidavits on a plea seeking directions to provide masks and sanitisers to the elderly amid the COVID-19 pandemic, to file their responses.

The matter came up for hearing before a bench headed by Justice Ashok Bhushan which had on August 4

5 STATES CONTRIBUTE 60 PC New Delhi: Five states including Maharashtra, Andhra Pradesh, Tamil Nadu, Karnataka and Uttar Pradesh, contribute over 60 per cent of total COVID-19 cases, 62 per cent of active cases and 70 per cent of overall fatality reported due to the virus in India, the Union Health Ministry informed on Monday.

Maharashtra is at the top with 21.6 per cent, followed by Andhra Pradesh (11.8 per cent), Tamil Nadu (11per cent), Karnataka (9.5 per cent) and Uttar Pradesh at 6.3 per cent.

According to the Union Health Ministry, Maharashtra has 26.76 per cent of the active cases in the country, followed by Andhra Pradesh (11.30 per cent), Karnataka (11.25 per cent), Uttar Pradesh (6.98 per cent ) and Tamil Nadu (5.83 per cent).

In the last 24 hours, Andhra Pradesh has recorded the highest recoveries with 11,915 newly recovered cases.

Karnataka and Maharashtra saw 9575 and 7826 recoveries respectively while Tamil Nadu and Uttar Pradesh witnessed 5820 and 4779 new recoveries, respectively. These 5 States together contributed 57 per cent of the recoveries in the last 24 hours.

ver the weekend, the World Health Organisation made an announcement you might have missed.

It recommended children aged 12-year-old and beyond should wear masks, and that masks should be considered for those aged between 6-yearold and 11-year-old.

The German Society for Virology went further, recommending masks be worn by all children attending school.

This seems at odds with what we assumed about kids and Covid-19 at the start of the pandemic. Indeed, one positive in this pandemic so far has been that children who contract the virus typically experience mild illness. Most children don’t require hospitalisation and very few die from the disease.

However, some children can develop a severe inflammatory syndrome similar to Kawasaki disease, although this is thankfully rare.

This generally mild picture has contributed to cases in children being overlooked.

But emerging evidence suggests children might play a bigger role in transmission than originally thought. They may be equally as infectious as adults based on the amount of viral genetic material found in swabs, and we have seen large school clusters emerge in Australia and around the world.

HOW OFTEN DO CHILDREN TRANSMIT THE VIRUS?

S

everal studies show children and adults have similar amounts of viral RNA in their nose and throat. This suggests children and adults are equally infectious, although it’s possible children transmit the virus slightly less often than adults in practice. Because children are physically smaller and generally have more mild symptoms, they might release less of the virus.

In Italy, researchers looked at what happened to people who’d been in contact with infected children and found the contacts of children were more likely to be infected than the contacts of adults with the virus.

Teenagers are of course closer to adults, and it’s possible younger children might be less likely to transmit the virus than older children. However, reports of outbreaks in childcare centres and primary schools suggest there’s still some risk.

HOW LIKELY ARE CHILDREN TO BE INFECTED?

W

orking out how susceptible children are has been difficult. Pre-emptive school closures occurred in many countries, removing opportunities for the virus to circulate in younger age groups.

Children have also missed out on testing because they typically have mild symptoms. In Australia, testing criteria were initially very restrictive. People had to have a fever or a cough to be tested, which children don’t always have.

This hindered our ability to detect cases in children, and created a perception that children weren’t commonly infected. One way to address this issue is

through antibody testing, which can detect evidence of past infection. A study of over 60,000 people in Spain found 3.4% of children and teenagers had antibodies to the virus, compared with 4.4% to 6.0% of adults. But Spain’s schools were also closed, which likely reduced children’s exposure.

Another method is to look at what happens to

people living in the same household as a known case. The results of these studies are mixed. Some have suggested a lower risk for children, while others have suggested children and adults are at equal risk.

Children might have some protection compared to adults, because they have less of the enzyme which the virus

uses to enter the body.

So, given the same short exposure, a child might be less likely to be infected than an adult.

But prolonged contact probably makes any such advantage moot.

The way in which children and adults interact in the household might explain the differences seen in some studies. This is supported by a new study conducted by the Centers for Disease Control and Prevention. Children and partners of a known case were more likely to be infected than other people living in the same house. This suggests the amount of close, prolonged contact may ultimately be the deciding factor.

SCHOOLS SHOULD SWITCH TO DISTANCE LEARNING

T

his evidence means we need to take a precautionary approach.

When community transmission is low, face-toface teaching is probably low-risk. But schools should switch to distance learning during periods of sustained community transmission. If we fail to address the risk of school outbreaks, they can spread into the wider community.

While most children won’t become severely ill if they contract the virus, the same cannot be said for their adult fami-

Importantly, the outbreak there has been linked to other clusters in Melbourne, including a major outbreak in the city’s public housing towers.

Gram panchayat polls from Sept 28 45K units of blood collected First India Bureau Jaipur: The State Election Commission of Rajasthan on Monday, announced the election of Panch and Sarpanches to be conducted in four phases in the remaining 3, 848 gram panchayats. The code of conduct has come into the force with the announcement of the election schedule.

The election process will begin on September 16 and the first phase of voting will take place on September 28. Voting will be held on September 28, October 3, October 6 and October 10 in a total of 35,968 wards in 3848 gram panchayats, according to the program released by the Commission.

EVM machines will be used for the polling of sarpanch elections.

In view of coronavirus infection, the Commission has decided to keep 900 voters in place of 1,100 in every polling station so that social distancing protocol could be followed. The polling time has also been extended by one hour so that voters are able to vote from 7.30 am to 5.30 pm while maintaining social distancing.

Commission said that in compliance with the directions of SC, the Commission has decided to conduct elections in four remaining phases.

he makers of Ishaan Khatter and Ananya Panday starrer upcoming film ‘Khaali Peeli’ announced on Monday that the movie will be released over online streaming platform- Zeeplex on October 2.

The streaming platform put out an interesting poster of the film and tweeted, “Saare check-naake todkar, aa reli hai ek mad ride, bole toh #KhaaliPeeli, 2nd October ko, exclusively on @ZeeplexOfficial!.”

The poster features the ‘Student Of The Year’ actor sitting on the bonnet of Mumbai’s famous Kaali Peeli taxi with Ishaan Khatter in the driver’s seat. A duffle bag full of jewellery and cash is atop the taxi and a pop-up one-liner reads, “Lafda bole toh alag level ka!!!.”
