HC stay on Jagannath Rath Yatra breaks 142-year streak A SYMBOLIC YATRA WILL BE CONDUCTED WITHIN THE TEMPLE PREMISES ON TUESDAY First India Bureau Ahmedabad: The Gujarat High Court on Saturday stayed the Ahmedabad Jagannath Rath Yatra slated to take place on June 23. This is the first time in the procession’s 143-year history that the chariots of Lord Jagannath and his siblings will not pass through the streets of the city. However, the temple
trust will have a symbolic yatra within the premises on Tuesday. On June 18, a private citizen Hitesh Chavda moved a Public Interest Litigation through advocate Aum Kotwal. The petitioner’s prayer was how the Jagannath Rath Yatra coudl be allowed when all religious congregations had been was banned due to the COVID-19 pandemic. The petitioner had also pleaded for an urgent hearing.
The High Court held an urgent virtual hearing on Saturday evening. After hearing the petitioner and government, the court stayed the Rath Yatra and observed that allowing it could aid the spread of the novel coronavirus. Under the Disaster Management Act and the Epidemic Diseases Act, the state does not have the authority to grant permission for religious congregation. It was further argued that Clause-9 of the Ministry of Home Affairs order dated May 30 clearly states that the state shall

state government also released a standard operating procedure
in which it clearly mentions that religious congregation is not permitted. The Petitioner had also argued that Ahmedabad Municipal Corporation in April had declared six wards namely Jamalpur, Kalupur, Shahpur, Dariyapur, Danilimda and Behrampura as containment zones. Four of these are on the customary route of the Yatra. With lakhs of devotees eagerly waiting for the Rath Yatra to pass through the city, the procession could potentially become
disastrous and volatile, it was noted. The Court clarified that the stay was granted for the whole state. It has called for reports from the Ahmedabad Municipal Corporation, Home Secretary and Police Commissioner seeking their reasons for not making a decision on the application for permission submitted by the Jagannath Mandir Trust. The matter will be heard on July 6. Following the Supreme Court directions, no further activities relating to Rath Yatra is permitted to be carried out.
