As my tenure being the 2019 Board President comes to an end, I find myself reflecting on the numerous ways our local chapter has volunteered both time and energy in giving back not only to CAI, but also to the community. As we bring this year to a close, there’s no signs of this generosity slowing down. In November, we received an abundance of support for our Loots 4 Boots event. Together, our chapter donated 400 care packages for homeless veterans through the Homeless Veterans Service of Dallas. The giving continued during the annual legal update as nearly 250 members donated 1,200 pounds of canned food items for the North Texas Food Bank. December is quickly approaching as we get ready for our annual Toy Drive. The Dallas Forth/Worth Chapter members provide a level of graciousness and selflessness that I am so proud to be affiliated with. In 2020, I want to give back to our chapter members and provide you with the opportunity to be recognized not only for your volunteerism, but for your hard work day in and day out. Next year the Dallas Forth/ Worth Chapter will be hosting our first ever CAI Awards Gala. For the last month, local CAI members were given the ability to nominate other members for the following categories: Community of the Year Newcomer Community Manager of the Year Community Manager of the Year Lifestyle Director of the Year Business Manager of the Year Management Company of the Year Chapter Volunteer of the Year Chapter Rising Star Community Spirit Award Supporting Staff member of the Year I look forward seeing all of our nominees at the Awards Gala during the Awards Ceremony on March 14, 2020 at The Renaissance Addison! 11.5. Don’t be afraid to rely on residents to be an extra set of eyes and ears in spotting problem areas early in the season. Get them to report pooling water, cracks in walls or masonry, moisture seeping through drywall or ceilings, and condensation on windows - which is evidence of poor
4. Have your trees trimmed. Snow, ice, and high winds from winter storms can snap limbs and cause entire trees to fall. A quick trim now could prevent dire consequences later.

Understanding the basic laws and rights to legally tow from a private community allows you to actually enforce the terms for residents and visitors in your lease or POA CC&Rs. How many visitors are allowed per resident per week or month? How many nights is the visitor allowed to stay? Who’s allowed to park in reserved spaces? Once these questions are answered and enforced

The first catch is that the tow signs must follow a very specific TDLR format which regulates symbols, colors, information required, font, material, and placement. This means that a property owner or manager should not put up a sign merely stating that unauthorized vehicles will be towed. In this case the vehicle owner or operator who has been towed is justified in claiming a wrongful tow because the proper TDLR complaint tow sign was not posted. The second catch is that the tow sign must state who is allowed to park on the property and what is considered unauthorized parking. For example, the sign could state “Resident and Visitor Parking Only Visitors Must Have Appropriate Permit All Other Vehicles Prohibited”. It could also state “Vehicles Prohibited: For Sale Vehicles, Abandoned, Inoperable, On Jacks or Blocks, Flat Tires, Parking on Grass, Unauthorized Handicap Parking”. Things can get a little more complicated depending on the city in which your property is located. Some cities don’t have any additional towing laws, but some can limit how far away the vehicle storage facility can be from the property where the vehicle was towed. City towing laws can also place restrictions on the towing companies including increased insurance requirements, company permits, and truck inspections.

You should also ask questions about the tow company’s General Liability insurance status, security cameras on the tow truck, drug and background testing of the drivers, photographs taken of vehicles before tow, and notification to local law enforcement of each tow.

You may be looking for sub-letters or individuals living on your property who are not on a lease. Whatever the reason, you do have options and legal rights to control the situation, and it is possible to handle with integrity and class! First, it’s important to understand that all towing in the state of Texas is regulated by the Texas Department of Licensing and Regulation or TDLR (www.tdlr.texas.gov/ Thistowing/towing.htm).includesconsent as well as non-consent towing. Non-consent towing is the focus of this article and includes your right to remove abandoned or unauthorized vehicles from your property. TDLR states “A parking facility owner may, without the consent of the owner or operator of an unauthorized vehicle, cause the vehicle and any property on or in the vehicle to be removed and stored at a vehicle storage facility at the vehicle owner’s or operator’s expense if…” The “if” in the statement above requires that either 1) TDLR compliant tow signs are posted at the time of towing and for at least the preceding 24 hours or 2) TDLR compliant notice is provided to the vehicle owner or operator. Most properties choose to post the TDLR complaint tow signs which many tow companies can legally provide for you at no charge.

Associations with December 31st year ends make up a large share of annual audits. There is often intense pressure on managers, accounting departments and audit firms to complete accurate and complete audits in a timely fashion. Completing an efficient audit requires strong communication and sharing of information. Signed engagement letter CPA audit engagement letters should be approved by the Board for all audits. Signing the contract well before the association’s year end will provide more time for the CPA to plan and prepare for the audit, and more time for the client to assemble supporting reports and documents.

Under the cash basis of accounting, income reflects money received and expenses represent money spent. Assessments receivable and accounts payable are not presented on the balance sheet. As part of the audit, the CPA proposes adjusting journal entries including recording a bad debt allowance and any amounts payable to vendors for unpaid invoices. Modified accrual basis accounting generally records assessment revenue when assessments are billed (accrual basis). Expenses are generally accounted for on the cash basis (as above). Using the accrual basis, financial reports include assessment income when billed, and expenses using invoice dates rather than payment dates. Completeness of records for the audit Often, the success of an audit can be measured by the completeness, accuracy, and timeliness of the audit and audited financial statements. Efficiency requires full, complete and timely access to accounting records and documentation. Cash! Cash is one of the most critical audit areas. Cash, meaning all petty cash, bank accounts, and investment accounts. Together with the general ledger, bank and investment account statements can act as a roadmap of an association’s financial activity. For accounts where statements are not provided by the banking institution, an auditor will generally require an independent confirmation of the account balances as of the year end date. Responsibilities
Regardless of the size of your community’s common areas, or the dollar amount of your HOA’s landscape maintenance budget, a committee formed with the sole purpose of watching over your landscape (and your commercial landscape contractor) is a huge asset to your association. Structure Landscape maintenance committees are typically assembled as a “standing” committee, meaning that they will regularly meet to handle ongoing tasks. For a specific, landscaping-related project, especially one with a significant price tag attached to it, like a large-scale rejuvenation and replanting project, you may wish to consider forming a special “ad hoc” committee, which only exists for the duration of that project.

• Providing monthly summary updates to the Board on landscaping and grounds maintenance issues.

While landscape maintenance committees aren’t required to include a member of the elected HOA board, having an elected community leader in the group will create a more effective committee. Including a Board Member will help the committee stay within its defined responsibilities, and keep it from being pulled off task by other volunteer members coming to the group with their own agendas and aesthetic preferences. The size of the committee can vary widely, but for even the largest communities there is rarely a need for more than 5 members in a landscape maintenance committee. Members of the committee are free to contribute as much time as their schedules allow, but the most effective committees will hold formal meetings where they discuss their findings, outside of the monthly HOA Board meeting. If volunteers can’t commit the time that will be needed, it’s best to keep the group smaller and filled with only the most engaged members.
Your landscape maintenance committee should be created by your elected Board with an explicit purpose to execute a specific set of duties. Committees operate best when given a defined set of tasks for which they are responsible each month. While they don’t have the authority to act without the Board’s approval, they are still very important to the association, especially when you consider that for most community associations, landscaping and grounds maintenance is the largest annually budgeted expense.
And that’s exactly why it’s critically important that your HOA has an effective Landscape Maintenance Committee in place.

The longer dog doody stays on the ground, the greater a health risk it becomes. Bacteria, worms and other parasites thrive in unattended waste, eventually breaking down and entering the soil or washing into the water supply.
