Maersk’s new W&D facility in Douala will be spread over 16,000 sq. m., including more than 12,000 sq. m. covered space that provides more than 8,000 pallet positions. The facility will provide for dry warehousing and distribution with a focus on deconsolidation and fulfilment. Being a bonded facility, it will also provide for the storage of cargo in the customs clearance process. Maersk will also arrange value-added services at this facility, such as palletisation, packing and kitting.

The new facility by Maersk in Douala is no exception. 100% internal lighting will be done using lowconsumption LED lights, and all external lighting will be powered by solar energy All forklifts required in the W&D operations will be battery-operated and charged using solar energy At the beginning of operations, 15% of the site’s electricity requirements will be fulfilled by solar panels installed at the site itself, with a plan to scale up in the coming years.

Sub. : Implementation of Ex-Bond Shipping Bill in ICES 1.5 -reg.

Reference is drawn to Sections 68 and 69 of the Customs Act, 1962 which deal with clearance of warehoused goods for home consumption and for export respectively. A bill of entry (BE) format for home consumption clearance of such goods is already available in the ICES. Such ex-bond BE is linked in the System with the original warehousing (into-bond) BE through which these goods were warehoused at the time of import into India.

1.1 So far, there was no format for ex-bond shipping bill (SB) in the System to cover export of warehoused goods. Due to this, the ledger of warehoused goods was not complete as all transactions of removal of cargo were not captured.

2. Now, a format for ex-bond SB has been developed on ICES for processing of export of warehoused goods from a bonded warehouse. The design and workflow are as follows:

i While filing an ex-bond SB, the exporter needs to declare the warehouse code in the single window table, with following details, which will depict that it is a re-export case:

This warehouse code would reflect the warehouse, from where the goods are to be exported. It may or may not be the warehouse where the goods were originally warehoused at the time of import.

ii. Once the above details are provided, in the next screen item-wise details of bill of entry (BE_Site, BE_No, BE_Date, BE_Inv_SrNo, BE_Item no) will have to be entered.

iii. In one shipping bill, only one warehouse code can be captured which means that goods lying in only one warehouse can be exported in a single shipping bill and separate shipping bills are required to be filed for export of bonded cargo from more than one warehouse.

iv In ex-bond SB, for each item, details of into-bond BE i.e. BE No. and date, invoice no., sl. no. etc., shall be mandatory. For each item, only one into-bond BE can be captured. For example, if fifty units of the same item were warehoused under five different into-bond BE (ten units under each into-bond BE) and now the exporter wants to export these fifty items, he will have to declare these goods as five different items. Hence, the SB format will allow export of items imported under more than one into-bond BE under one ex-bond SB to address the requests of the trade that goods imported separately may be cleared under one document.

v. Once SB is filed, after successful verification, the system would debit the quantity exported in the ledger from the quantity imported. In case of cancellation of SB or purging of SB, the quantity would be re-credited automatically Any amendment in the SB quantity has also been linked with the ledger quantity so as to update the ledger accordingly.

2.1 This type of shipping bill can only be used for export of warehoused goods, and not for other goods. It is also not meant for the export of goods resulting from manufacturing or other operations under section 65 in a bonded warehouse. However, if the goods imported in a warehouse where permission has been granted under section 65, are exported as such then the abovementioned ex-bond SB can be filed.

2.2 No incentive such as Drawback, RoDTEP/RoSCTL benefit, advance authorisation/EPCG etc. shall be available for such cargo and the SB would be a free SB.

The proposed Indian Ports Bill, 2023, to replace the Indian Ports Act, 1908, seeks to empower the Maritime States Development Council (MSDC) and promote integrated planning between states and Centre with respect to port development, a top Government official said.

The new legislation will help better determine port tariff.

“The definition of port tariff is being proposed to be made inclusive a n d i t w i l l i n c l u d e m u l t i p l e components such as port duties Focus is on transparency and deregulation,” the official said.

Under the existing laws, major ports are governed by the Centre while non-major ones are under the control of the state This control structure has been maintained in the new bill. But the central government can direct any port to adopt a

mechanism for electronically integrating port related data with a centralised system as per the proposal.

This new amendment has taken a middle path by watering down contentious provisions that seemed to i m p i n g e u p o n r i g h t s o f s t a t e governments which were proposed in earlier iterations.

MSDC will consult with Central and State Governments while issuing guidelines for port tariff.

“The council has been empowered to issue guidelines, which are solely recommendatory,” said the official cited above Boards of major port authorities, and state maritime b o a r d s ( S M B s ) w i l l a l s o b e empowered to remit the whole or any portion of port tariff, the person said.

In another significant proposal, the central and state governments can notify new ports and alter the limits of existing ones. Further, these

governments have been empowered to take action to make ports or their parts non-operational on specified grounds. Besides this, the Central Government can de-notify a port if it has not been operating for a decade. Further, a port can be made nonoperational in the interest of national security

A three-tier dispute resolution mechanism has been proposed to address conflicts between two or more State Maritime Boards.

“The SMB would adjudicate disputes within a State The State Governments can review orders passed by SMB within a specified time. Appeals against these orders can also be filed with the appellate tribunal (adjudicatory board under Major Ports Authority Act),” the official said.

To contain pollution, each port needs to prepare a waste reception and handling plan.

Major Port cargo rises by 4% in August

M U M B A I : O w i n g t o g l o b a l headwinds and a shift in industrial supply chains away from Government Ports, Major Ports recorded a slow 4.2 per cent growth in cargo traffic in August.

During the previous month, cargo handled at India’s Major Ports reached 65 19 million tonnes (mt) The overseas cargo handled at Major Ports increased by 6 per cent to 50.92 mt in August, according to provisional data from the Ministry of Ports, Shipping and Waterways.

So far, in 2023–24 (Fy24), cargo growth at Major Ports has been sluggish, with a just a 2.8 per cent increase.

“A combination of factors has played into this; coastal cargo movement for major ports has significantly decreased Deendayal, Goa, and Ennore have experienced muted growth, with Deendayal even showing negative overseas growth,” said Jagannarayan Padmanabhan, senior director and global head of consulting — transport, logistics, and

m o b i l i t y a t C R I S I L M a r k e t Intelligence & Analytics.

Padmanabhan added that the ban on the export of non-basmati rice has also affected overall growth, although its contribution to the overall cargo mix is limited.

Meanwhile, cargo handled at NonMajor Ports in August reached 58.55 mt, showing an increase of 15.9 per cent compared to 50 52 mt the previous year

While coastal shipping supply chains have significantly favoured Non-Major or Private Ports, data shows that overseas cargo handled at Non-Major Ports in August also increased by 11.1 per cent to 46.84 mt, which is much higher than the growth of cargo at Major Ports.

So far in 2023-24, traffic growth for Non-Major Ports has been 6 8 per cent. The data reflects the concerns raised in the past about Governmentowned Ports losing out to private ports despite capacity expansion efforts under programmes like Sagarmala.

“JSW Steel Dolvi Works production capacity increased from 5 million tonnes per annum (mtpa) to 10 mtpa last year. The inward movement of coking coal, thermal coal, and iron ore at Dharamtar Port in Maharashtra has increased, as evident from the coastal traffic of Maharashtra Maritime Board, with a year-on-year increase of 29 per cent during April–August,” Padmanabhansaid

He added, “Some of Tamil Nadu electricity board’s thermal coal cargo seems to have shifted from Vizag port to Gangavaram in Andhra Pradesh. This has contributed to a 55.2 per cent increase in coastal traffic at the Andhra Pradesh Maritime Board in FY24 compared to the previous year.”

Traffic at Major Ports in 2022-23 witnessed near-double-digit growth for most of the financial year

An analyst at ICRA stated that the ratings and research firm expects cargo handling in FY24 to grow by 5-7 per cent CRISIL expects cargo growth to be 6.5 per cent in FY24, according to Padmanabhan.

The company would use its IPO proceeds to repay debt of Rs 880 crore, investment for an LPG terminal project (Rs 865.75 crore) and for setting up an electric sub-station (Rs 59.4 crore). Further, Rs 103.88 crore would be used for installation of a dredger and Rs 151.04 crore for the expansion at Mangalore Container Terminal, for its greenfield expansion p l a n s a n d g e n e r a l c o r p o r a t e purposes.

JSW Infrastructure expects to raise Rs 1,260 crore from anchor investors on September 22. Following the IPO, JSW Infrastructure would be the third port company to be listed after Adani Ports and Special Economic Zone and Gujarat Pipavav Port.

“On the green projects, Utkal, which is on the east coast is being developed by JSW Steel, and one on the west coast, Keni in Karnataka, the bidding has been completed and government clearances are awaited,” he said.

FFFAI and Logistics Sector Skill Council host webinar on sensitizing Apprenticeship Programme; Non-compliance under Act to invite penalty for Organisations

MUMBAI: Federation of Freight Forwarders Associations in India (FFFAI) and Logistics Sector Skill Council (LSC) jointly organized a webinar “Awareness Workshop on Apprenticeship Training” for creating an awareness amongst the member organizations of FFFAI on 12th September 2023.

Mr. Shankar Shinde, Chairman, FFFAI chaired the webinar. The Panellists of the Webinar were Mr. Sudhir Agarwal, Hony Treasurer and OB In charge Skill Development Committee, FFFAI; Mr. Dushyant Mulani, Chairman Elect – FFFAI; Mr. Tej Contractor, President, IIFF; Dr T.C. Saravanabava, Head – Apprenticeship, LSC and Mr. Anthony Coelho, Vice President – LSC. A large number of FFFAI Member organisations from across the country participated in the webinar The core objective of the webinar was for implementation of Apprenticeship training in the FFFAI member organizations.

Dr T.C. Saravanabava highlighted that Apprenticeship Training is one of the most efficient ways to develop skilled manpower for the country It provides for an industry led, practice oriented and efficient mode of formal training.

The National Apprenticeship Act was enforced in the year 1959 at first on the voluntary cause. The bill was presented before the parliament during 1961 and was enforced from 1st January 1963. The act was amended twice in 1973 and 1986.

There are 38 sections and one schedule. The schedule is in regard to the adjustments in Workmen’s Compensation Act, 1923 with reference to its application to students under the Apprentices Act, 1961.

For the administration of Apprentices Act, 1961 in relation to trade apprentices under Central Government and Department lies with the Central Apprenticeship Advisor/ Director of Apprenticeship Training in the DGE&T, Ministry of Labour and Employment with the help of six Regional Directorate of Apprenticeship Training (RDATs).

The main objective of the Apprentices Act, 1961 was to meet the rising need for a proficient craftsman. To provide experimental training to the people whore specialized in their crafts is the main objective of the act. As per the announcement of the central government, any industry or any area these provisions are applicable. The act clarifies the connection between the various employers and apprentices. The apprentices are not dealt in the same way as employees. The act aims to make provisions for health, protection welfare, and many others for apprentices. It also includes the dispute management arising out of the agreement between the employers and the apprentices.

Act explains apprentices to be the ones who receive apprenticeship or practical training under an apprenticeship scheme for a specified duration. The person undergoing the training must be of 14 years of age, and in case of special safety requirement, the minimum age requirement is 18 years Other than the aforementioned qualification, extra qualifications may be prescribed for special trades and special categories of apprentices.

Government brought comprehensive amendments in the Act and made it more attractive for both industry and the youth. The government brought the service sector under the ambit of apprenticeship and introduced optional trades for engaging apprentices in the service sector To promote apprenticeship training and to increase the engagement of apprentices in the service sector the government of India had introduced the National Apprenticeship Promotion Scheme (NAPS). The scheme is for sharing of 25% of prescribed stipend subject to a maximum of INR 1500/- per month per apprentice to all apprentices with the employers.

Eligible employers shall engage apprentices in a band of 2 5% to 15% of the total strength of the establishment including contractual workers.

No month the number of apprentices should be less than 2% and more than 18% in a financial year.

Choice of selecting the candidates is free to the employers. There is an apprentice portal of the government also where the employers can be registered to get candidates. Otherwise they can also select through internal circular and put it in the portal as well. Both employers as well as

apprentices should be registered in the portal.

Employer shall disclose the intention of engagement of apprentices on portal sites every quarter

Employers should engage apprentices to fulfil mandatory requirements. They should utilize the opportunities available and engage the apprentice to the maximum extent of 15% and avail the benefits of NAPS. Employer should conduct assessment to the apprentices at the end of their apprenticeship training and certify them jointly with LSC.

As per the Section 30 of the Act, if any employer contravenes the provision of the Act relating to the number of apprentices which he is required to engage under the provisions, shall be given a notice. In case the employer fails to reply or authority is not satisfied with the reason given by the employer, he shall be punishable with a fine of Rs 500 per month per apprentice for the first three months. Thereafter Rs 1000 per month per apprentice till such number of seats are filled.

LSC, which is established by the Ministry of Skill development, Government of India, has been constantly advocating and promoting Apprenticeships across all stakeholders. The Government of India nominated LSC’s CEO as the Joint apprenticeship advisor for implementation of apprenticeship training in the logistics sector LSC has developed 42 Optional Trades that encompass all its sub sectors including Export Import and is made available for the apprenticeship training.

Shedding light on the critical role being played by LSC and tie up of FFFAI with this organization Mr Shinde reiterated full support to the apprenticeship programme through sensitizing its 6500 members represented by 31 Members associations across the country. He pointed out that when a significant number of apprentices are engaging themselves in apprenticeship, the number of skilled and trained individuals would eventually increase. As a result of which employers are getting skilled employers which prove out to be beneficial for the company with a minimum training cost incurred by the company He also emphasized on the compliance side that needs to be taken care of by the employers to fulfill the objectives of this great initiative. The FFFAI Chairman invited the members to register on the apprenticeship portal, implement apprenticeship training in their establishment and avail benefits under the scheme.

Proposing vote of thanks, Mr. Sudhir Agarwal said that India needs effective efforts to fill the gap of trained manpower The government’s initiatives through LSC in this regard are very commendable. This is beneficial especially for the non-metro cities There should be many more programmes to make the apprenticeship/training exercise a grand success to cater to the requirements of the logistics industry
