Shipping Corp of India edging closer to a VSA with USWC carrier

MUMBAI: With its privatisation planinlimbo,ShippingCorporationof India (SCI) is making a renewed pitch to pump up its sagging container profile in the long-haul trades, according to industry sources. The national carrier – of which the governmentowns63.75%–wasputon the block in 2019 as part of a larger government divestment programme, but the process has been painfully slow because of regulatory and due diligence hiccups. And there are no definite indications when it will be completed. The uncertainty seems to have prompted SCI to redraw its business strategies. Sources believe that the carrier is close to striking a vessel-sharing deal with one of the premier networks on the India-US east coast trades, such as ONE’s upcomingstandaloneWINservice,or the Indamex consortium, led by Hapag-LloydandCMACGM.

“Discussions are at an advanced stage,” an informed source said. “We expect an announcement in a month or so.” The move comes after SCI

received Government approval to upgrade its fleet by way of secondhand ship acquisitions, including a containership of some 10,000 TEU capacity. With an ownership change on the horizon for some time, the companyhadbeenhesitanttoacquire new tonnage to replenish its aging fleet of mostly crude and bulk carriers. Due to begin in May, ONE’s weekly WIN will perform a rotation of Karachi, Hazira, Nhava Sheva, Mundra, Damietta, Algeciras, New York, Savannah, Jacksonville, Charleston, Norfolk , Damietta, JeddahandKarachi.

Notably, the public carrier was a juniorpartnerintheoriginalIndamex consortium that took shape in 2000, with CP Ships (acquired by HapagLloydin2006) andCMACGM thelead vesselprovidersatthetime.

According to available information, the only long-haul presence for SCI is through some slot arrangements with MSC on the Himalaya Express (HEX), between WestIndiaandEurope.

SCI has reported strong results in recentyears,poweredinlargepartby itslineractivity,albeitbeingrelegated to a shortsea or feeder vessel operator, as container freight rates moved up, thanks to pent-up demand during Covid and, more recently, the RedSeacrisis.

Ironically, local exporters, upset over soaring costs, have been pressing the government to actively consider establishing a home-grown container line to aid the trade now dominatedbyforeigncarriers.

“A 25% share by the Indian shippinglinecansave$5bnannually,” said the Federation of Indian Export Organisations recently. “The Indian private sector may be engaged to develop such shipping lines, and this will reduce arm-twisting by foreign shipping lines, particularly of our microsmall-to-mediumenterprises.”

SCI’s reported interest is another sign that carriers are generally looking to capitalise on expected Indiatradegrowthdrivenbysourcing shiftsfromdiversifyingsupplychains.

Warehouse developers bet on India as companies look beyond China

CHENNAI: Land is getting hard to find in a sprawling industrial park in southern India where workers are scrambling to build modern new warehouses and factories for companies betting on the country’s economic boom or diversifying their supply chains beyond China, reports Reuters.

“It is one of the most wanted places in India for European and American companies,” said S. Raghuraman, an official of the Greenbase industrial park, near plants run by Apple supplier Foxconn andtruckmakerDaimler.

Avendus Capital estimates China has three times more than India’s 412 million sq ft (38 million sq m) of the “Grade A” warehouses, fitted with automated storage and retrieval systems, that industries from e-commercetoengineeringfavour.

By comparison, Blackstone says the United States has 13 billion square feet (1.2billionsqm)ofwarehousingstock.

Govt allows urea imports by state-owned fertiliser companies till March' 25

NEW DELHI: The government Monday allowed the import of urea through India Potash Ltd (IPL), Rashtriya Chemicals & Fertilizers Ltd (RCF), and National Fertilizers Ltd (NFL) for another year untill March 31, 2025.

The Directorate General of

Foreign Trade (DGFT) in a notification, said that import of urea (for agriculture purpose) on government account shall be allowed either by designated state trading enterprises (STE) itself, or other entities authorised by the fertilizers department.

“Import of urea (for agriculture purpose) on government account shall be allowed either by designated STEs itself, or through any entity/entities (fertilizer marketing entities) so authorised by the Department of Fertilizers from time to time, for filing BEsatIndiaports,”DGFTsaid.

DP World accelerates growth in South Korea with US$ 50 million investment in Busan New Port

BUSAN: DP World has announced a US$50 million (approximately Rs. 66 billion) investment to develop a new logistics centre in Busan New Port, strengthening the port’s position as a logistics hub for Northeast Asia and reinforcing the global standing of the wider Busan-Jinhae Free Economic Zone(BJFEZ)inbusinessandlogistics.

Construction of the facility in the 75,000-sqm land is set to commence at the end of 2024, with operations expected to start by the second quarter of 2026. The DP World Busan Logistics Centre (BLC) will have capacity to process nearly 80,000 TEUs of cargo per year by 2028 and offer comprehensive value-added logistics services suchasassembly,processing,andpackagingtolocaland regionalcustomers.

Question: In our recent Export to a customer in Africa, we are anticipating a delay in payments, could you guide what steps need to be taken in case of delay? Also, actions in case the export payment is not received.

SOLUTION:Thanks for asking an important question most of the time people ensure compliance with the Customs Act and FTP but overlook FEMA and RBI Guidelineswhichareequallyimportant

First, let us understand the applicable timelines for receivingexportproceeds.

Export guidelines mandate 9 months from the date of export for the exporters to realize and repatriate theexportproceeds.

In case of delay in realization beyond 9 months, the exporter must seek approval from an Authorized Dealer (Bank). Banks can extend the period for realizationupto6monthsatonetime.

Twoimportantconditions mustbemet.

Sr. Condition

1 Bank is convinced that the delay is for reasons beyond the control of the exporter

2 Exporter submits declaration that the export proceedswillberealizedduringextendedperiod.

Banks must ensure that the total export outstanding oftheexporterdoesnotexceedeither:

a) USD1million

b) 10% of average export realizations during the preceding3financialyears;whicheverishigher

Any other case that may exceed the above banks will havetorefertoRBIforapproval.

Now let us consider a scenario if you fail to realize export proceeds and wish to write off the same as bad debt.

3. The exporter has been a regular customer of the bank for at least 6 months, is fully compliant with KYC guidelines, and the Bank is satisfied with the bonafideofthetransaction.

4. Transaction must fall within 7 eligible categories asgivenbelow

Overseas buyer has been declared insolvent Overseas buyer not traceable despite best efforts.

Goods have been auctioned/destroyed by port/customs/health authorities

Amount represents balances due in a case settled through the Indian embassy, foreign Chamber of Commerce, etc

The amount represents balance less than 10% of the value of the export bills, unrealised despite inspite of best efforts.

Cost of legal action would be prohibitively expensive and disproportionate to Invoice amount

Write-offs will not be allowed in the following cases.

i. E x p o r t s a r e m a d e to c o u n t r i e s w i t h

Amount represents 1) difference between value and actual export value

2) Provisional and actual freight charges and remains unrealised.

Note: In case of write-off exporter must return benefits as per FTP such as AA, Drawback & RoDTEP withinterestontheunrealizedexportamount

In case of self-write-off, the AD will demand the Exporter to submit a certificate from a Chartered Accountant indicating the export realization in the preceding calendar year and details of the amount of write-off, if any, already availed of during the current calendar year along with the requisite details of the ExportBillunderthewrite-offrequest Thiscertificate shall also indicate that the export benefits, if any, availedbytheexporterhavebeensurrendered.

Exporters seeking to avail duty concessions on shipments to UK, to follow new British rules : DGFT

In a trade notice, the Directorate General of Foreign Trade said that the United Kingdom (UK) has replaced its existing origin declaration process under Generalized Scheme of Preferences (GSP) with the UK DCTS effectivefromJune19,2023.

Thetransitionperiodforthischange was extended until December 31, 2023. “Starting from January 1, 2024, onwards,IndianexporterstotheUKare required to adhere to the new rules under DCTS to avail concessions on their exports to the UK,” the trade noticetotheexporterscommunitysaid.

ItaddedthatgoodsthatmeettheUK DCTS Rules of Origin (RoO) requirements would be eligible to claim a concessional rate of import duty for exportstotheUK.

“Consequently, the origin criteria necessary for satisfying the Rules of Origin to avail tariff concessions on exports from India to the UK must be filled in through self-certification,” it added. Accordingly, it said, Indian exporters are directed to use origin declaration wording under DCTS scheme, in place of origin declaration wordingunderGSP.

Certain labour-intensive sectors such

as leather, carpets, chemicals, iron amd steel and textiles were the major beneficiariesoftheGSPscheme.

The US, European Union (EU), Australia, Japan and many other developed countries grant unilateral import duty concessions to developing countriesundertheirGSPschemes.

As per estimates, India’s exports worth USD 2.5 billion were entitled for theGSPbenefitintheUK.Indiaandthe UK have been negotiating a free trade agreement since January 13, 2021. As many as 14 rounds of talks have been completed & both sides are aiming to concludethenegotiationsattheearliest.

APSEZ prepone capacity expansion of Vizhinjam Port to settle dispute with Kerala Government

KOCHI: Adani Ports and Special Economic Zone Ltd (APSEZ) has agreed to expand capacity of the under construction international container transhipment port at Vizhinjam in Kerala by 2028, much earlier than the timeline set by the concession agreement, in return for consenting to

settle arbitration proceedings initiated againstthestategovernmentoverdelay in completing the first phase of the new port and to get a five-year extension in theconcessionperiodtill2060.

The capacity expansion will allow Vizhinjam Port to handle 3 million twenty-footequivalentunits(TEU’s)from

a2km-longberth.Onitspart,theKerala Govthasagreedtocondonethedelayby APSEZ in completing the first phase of theVizhinjamPort(withaquayorberth lengthof800metreshavingacapacityto load8lakhtwenty-footequivalentunits) by five years from the earlier stipulated 3December2019to3December2024.

Global Tank Container Fleet nears 850,000 units: ITCO Annual Survey

LONDON: The International Tank Container Organisation (ITCO) has published its 12th Annual Tank ContainerFleetSurvey.

This year’s Survey estimates that, on 1 January 2024, the global tank container fleet had reached 848,400 unitsworldwide,comparedto801,800on 1January2023,ayear-on-yeargrowthof 5.81%.

Reflecting continued strong demand for new equipment, approximately 56,600 new tank containers were built, compared to 67,865 new units in the previous year –and 53,285 in 2022. However, with an increase in the number of tanks being scrapped,orsoldoutoftheindustry,the overall growth in the global fleet is 46,600units.

The Survey shows how, numerically, the industry continues to be dominated (on a global level) by a relatively small number of major tank container operators and leasing companies. The top10tankcontaineroperatorsaccount for over 297,000 tanks, representing over 50% of the global tank container

operators’ fleet. The top 10 leasing companies account for 317,740 tanks, representing about 85% of the total leasingfleet.

Commenting on the results of the Survey, Paul Gooch ITCO President, notes: "The global tank container fleet continues to grow, although at a slightly slower rate in 2023 compared with previous years. This was to be expected, considering the variety of economic and geo-political headwinds being experienced by the chemical industry, andtheweaknessinglobalGDPgrowth. We also had to reckon with a correction after the record year in 2022, which had been fed by the supply chain disruption resultingfromtheCovid-19pandemic."

He continues: “Our 2023 Report noted the ramping up of production to meet short-term demand was likely to result in an over-supply of tanks, and an adjustment in production rates in 2023. The latest report appears to, at least in part, bear out that prediction, although the adjustment may not have been as severe as expected. However, as was already evident in early 2023, chemical

companies were returning tanks as supply chain bottlenecks eased and the need to hold ‘just-in-case’ inventories declined.Operatorswerealsoadjusting their fleet levels and taking tanks offlease.”

Looking ahead to ITCO’s activities inthecomingyear,PaulGoochconfirms that ITCO’s aim continues to be to ensure that its initiatives, projects, and events are designed to serve the needs of the members, and deliver tangible value.

“ITCO will continue to drive initiatives supporting safe working practices, environmental best practice, and efficiency improvements through global standards and digitalization”, he says. “But we will be more diverse and inclusive in our approach. We will also focus on expanding our geographical footprint - recognizing the need to be more present and active in the Americas, India, and Asia Pacific. The location of our events and agenda content will also reflect this geographical diversity, and the need to leveragetechnologyadvances.”

Consignee expecting import cargoes on the captioned vessel are requested to present the ORIGINAL BILLS OF LADING duly discharged and obtain delivery orders. In the event of Mumbai Port Trust directing the shifting of the cargo from quay to a storage area within the docks, the same will be undertaken by the vessel agents at the consignees risks and costs.

"Stamp duty" is payable as per the directive of the Superintendent of stamps.

Consignees will please note that the carrier and/or their agents are not bound to send individual notification regarding the arrival of the vessel or their cargo.

Consignees are requested to arrange for clearance of the cargo at the earliest on presentation of the PACKING LIST to our attending surveyors, as it is noticed that the cargo is arriving without proper Marks & Numbers and the same is also not indicated in the Bills of Lading for which the Vessel/Owners/Agents will not be held responsible for consequences arising thereof.

In view of the customs notification in respect to the amendments to the manifest, the consignees are requested to contact the vessel agents office atleast 2 working days prior vessels arrival to verify and confirm that the declarations in the manifest to be filed are in conformity with the bills of lading issued and in possession of the consignees.

In the event of the consignees fail to present their documents for verification and confirm the correctness of the manifest prior filing of the same, the onus of any amendment that will be required after the filing of the manifest with the customs will be on the consignee/receivers who will be responsible for all risk, costs and consequences that may arise.
