AAR ruling could offer advantages to e-commerce logistic platforms

M U M B A I : I n a r e c e n t development, the GST Authority for Advance Rulings (AAR) in Karnataka has ruled that Juspay Technologies, the company operating the ridehailing app ‘Namma Yatri,’ qualifies as an e-commerce operator under GST regulations. However, the AAR has clarified that the Bengalurubased firm is not obligated to collect and remit GST on transportation fares because the supply of passenger transportation does not occur “through” their platform, as reported.

According to Section 9(5) of the GST Act, e-commerce operators are mandated to collect and remit GST for specific “notified” services The AAR’s decision underscored that the

services provided by auto drivers to their passengers are not categorized as a supply by JustPay Technologies.

It’s crucial to bear in mind that AAR rulings do not establish legal precedents but can exert an influence on similar cases. Harpreet Singh, an indirect tax partner at KPMG-India, explained, “According to this ruling, if an entity merely connects service providers and end customers without a c t i v e l y p a r t i c i p a t i n g i n t h e transaction or exerting control over the service provision, it would not be considered a supply of service ‘through’ the entity Consequently, entities facilitating notified services would not be liable for GST collection and payment.”

This ruling may have implications for the GST liability of e-commerce operators offering services covered under section 9(5), such as passenger t r a n s p o r t a t i o n , r e s t a u r a n t s , h o u s e k e e p i n g , a n d h o t e l accommodation.

India services exports rise 8.4% to $28.72 billion in August

Data released by the government last month showed services exports were $26.39 billion in August, while imports were $13.86 billion.

Railways levies 10% Busy Season Haulage Surcharge on Container Train Operators

In this regard, Association of Container Train Operators wish to bring the following issues to attention:

Container Haulage has always been exempted from levy of busy season surcharge as container movements (which are mostly driven by Export-Import cycles) are not impacted directly by the Indian Railways seasonal freight cycles. Ever since the privatization of container traffic in 2006, this is the first time that busy season surcharge has been imposed on this traffic. Railways need provide stable policy environment for container train operators to attract more private investment in the sector Such policy changes will affect the investment in the sector

In the original circular it is mentioned that busy season surcharge was not applicable to certain traffic including automobiles (both railway and private rakes) and also containers. By now including containers under BSS, a selective discrimination has been made against the container sector. It is our contention that the container sector will continue to provide the maximum long term potential for cargo migration from road to rail, but such discriminatory and cost escalatory initiatives will only work to drive traffic away from rail.

There has been a period of relative stability in container haulage in the past few years, which has resulted in steady growth in business. Also, with the increase in rail capacity brought in by the DFCCs, it has been expected in the trade that there will eventually be a reduction in costs and an increase in the Railways modal share. A sudden unplanned increase in costs by 10% will have an immediate impact on the health of the business. Road sector does not face any seasonal surcharges (if at all, it often benefits from off season discounts). At a time when road costs have been dropping and service quality getting better due to improved road conditions, this increase in cost will lead to the rail sector becoming uncompetitive.

Implementing such a heavy cost increase also on empty running will further compound the impact on the business. As empty movement’s dry up, there will be increased equipment imbalances, leading to further

increase in costs. Efforts to develop domestic circuits where some extent of empty moves are built into the business will also be severely impacted.

CTOs have been requesting for a rationalisation in the haulage structure for some time in order to attract more light cargo, permit operationally required empty moves at reasonable costs and in general address the issue of price competition with road more effectively This current change will effectively negate our efforts and push back the sector to a situation of extreme economic pressure.

At a time where the government’s effort is to work toward a reduction in the logistics cost and to make Indian Exports more competitive in global markets, this increase will work at cross-purposes with these clearly defined national objectives.

The MCA itself specifies at least a 15 day notice to be issued for levy of any changes in haulage charges, and as a sector it has been a long-standing demand that any changes in price need to be notified in advance so that the sector is able to inform our customers, re-negotiate existing contracts etc. Generally, an advance notice period of at least 3 months is needed for such commercial activity, and to be notified on the last working day of a month of an increase that goes into effect within 24 hours will create a serious negative financial impact on the sector as the entire haulage increase will have to be borne by the CTOs.

In light of this, ACTO has requested the following considerations to be taken by Indian Railways to help resolve this matter as early and amicably as possible:

1. The current decision to implement an increase be held back for at least a period of 3 months.

2. A meeting be called with Container Train Operators to discuss both pricing as well as related Container sector issues – ACTO will be happy to submit an agenda in advance, and work toward a consensus approach to resolving issues and working toward further growth in the container sector 3. ACTO specifically seeks to develop a transparent, fair, and predictable haulage charge regime so that all such instances of changes in future do not result in sudden shocks and loss of business.

Declining box trades more attractive to car industry

SINGAPORE: Capacity and congestion in the car carrier sector have driven some freight forwarders and manufacturers to move cars in containers rather than delay exports until space becomes available.

Soaring freight rates, congestion and a lack of roro capacity have seen delays of up to three months or more in the shipment of cars as sky-high demand adds to the sector’s problems.

One freight forwarder who specialises in the handling of cars said, “The cost of moving cars in

containers is on a par with roro because although the freight is cheaper the cost of loading and unloading containers is greater.”

Although the costs are similar from one sector to the other, the forwarder pointed out that most roro companies only operate monthly services to key markets, whereas container services are weekly, offering a more frequent and larger capacity

Shipping lines can also benefit from the movement of finished cars in a period the freight levels have diminished.

National Investment and Infrastructure Fund (NIIF) launches $600 million

India-Japan Fund (IJF) with India and JBIC as anchor investors

NEW DELHI: The National Investment and Infrastructure Fund (NIIF) has entered into a collaboration with the Japan Bank for International Cooperation (JBIC) to launch a $600 million India-Japan Fund (IJF) with JBIC and Government of India (GoI) as anchor investors. This joint initiative signals a key dimension of collaboration between the two countries in an area that is a shared priority viz. climate and environment.

The announcement marks NIIF’s first bi-lateral fund, with the GoI contributing 49% of the target corpus and the remaining 51% contributed by JBIC. The Fund will be

Unifeeder invests in Four New Methanol Powered Vessels

Unifeeder Group plans to deploy the new vessels on its European network, where the new vessels will give a significant contribuon to lower the emissions of the network.

AARHUS: Unifeeder Group has signed a long-term time-charter agreement for two new methanolcapable container feeder vessels and has an option for additional two similar vessels.

German-based ship owning group Elbdeich Reederei will build and manage the 1250 twenty-foot equivalent unit (TEU) vessels which will be delivered in 2026.

Unifeeder Group plans to deploy the new vessels on its European network, where the new vessels will give a significant contribution to lower the emissions of the network.

Alongside parent company, DP World, Unifeeder is workingwithpartnersacrosstheindustrytofindsolutionsto the challenge of renewable-methanol supply, which needs off-take commitments to build production at the scale that theindustryneedstoreplaceconventionalfossilfuels

In parallel to the delivery of the methanol capable vessels, Unifeeder will continue to improve the fuel efficiency of the entire fleet deployed and increase the use of biofuels on the conventional vessels in the fleet.

JSW Infra has huge potential to grow its business : Sajjan Jindal

MUMBAI: Commercial ports operator JSW Infrastructure, which got listed on the bourses on Tuesday, said it has a huge potential to grow its business and aims to become a global company, JSW Group Chairman Sajjan Jindal has said.

Speaking at the listing event, Jindal cited the example of Singapore and said that it is a City-State and handles more cargo than all of India. “We can also create such ports which handle not just our own cargo but also of the countries around us,” he said.

“We cannot think only India centric, we have to think global and we have to really build ourselves as a global company. So we have to really think at those levels,” he said.

Jindal further said that India has a large coastline and logistics cost in the country is among the highest in the world. “The cost of transporting goods in India is the highest, So JSW Infra has a huge potential to grow its business to create what the government has created, CONCOR,” Jindal said A Public Sector Undertaking, CONCOR (Container Corporation of India) provides total

The Initial Public Offering (IPO) of JSW Infrastructure was subscribed 37.37 times on the last day of bidding on Wednesday The Rs 2,800-crore IPO had a price range of Rs 113-119 per share. The public issue was entirely a fresh issue of equity shares.

JSW Infrastructure, which became the third public entity within the JSW group after JSW Steel and JSW Energy, is not the last IPO, he said. “We have many companies coming up (like) JSW Cement, JSW Paints, JSW One, and hopefully there will be more companies which will get listed in the years to come,” Jindal said.

JSW Infrastructure, a port-related infrastructure company, provides maritime-related services, including cargo handling, storage solutions, logistics services and other value-added services to its customers.

It operates seven port terminals and two ports in India besides two port terminals under operations and maintenance agreements in Fujairah Terminal and Dibba Port in the UAE with a cumulative cargo handling capacity of 41 MTPA as of June 30, 2023.

Eastern-DFC : Electric Loco trial successfully conducted on 94-Km-long last leg of freight corridor

MUMBAI: The Dedicated Freight Cor ridor Corporation (DFCC) has successfully conducted electric locomotive trial on New Khatauli-New Pilakhani section, the last leg of the Eastern dedicated freight corridor (DFC).

The loco trial run on the 94-km-long section of Eastern-DFC was carried out by the Meerut unit and with this, the 1,337-km-long Eastern-DFC witnessed the long awaited completion of the exclusive goods corridor.

The successful trial marks the completion of the main line section of the corridor

“We conducted successful trial of electric loco run on New Khatauli-New Pilkhani Section section. It is the last leg of New Khurja-New Pilkhani section and also missing link of the complete EDFC route from Sonnagar in Bihar to Sahnewal in Punjab,” DFCC maintained.

With this, the entire 1,337 km Eastern-DFC route, from Sonnagar in Bihar to Ludhiana in Punjab, has been completed.

Eastern corridor is meant to cater to a number of traffic streams — coal for the power plants in the northern region of Uttar Pradesh, Delhi, Haryana, Punjab and parts of Rajasthan — from the eastern coal fields, finished steel,

food grains, cement, fertilisers, lime stone from Rajasthan to steel plants in the east and general goods.

An operations control centre has been built at Prayagraj which, which will monitor the movement of freight movement on the Eastern-DFC. Also known as command and control centre, it will also power supply systems besides goods trains.

The DFC aims to decongest the existing Indian Railways’ network for passenger trains, while at the same time the average speed of goods trains could be increased from existing 25 to 70 kmph.

The Eastern-DFC would run heavy haul trains with higher axle load.

A large logistic hub is also proposed in Meerut, since the city is a suitable major hub due to its well connectivity and proximity with expressways like Delhi Meerut Expressway, Ganga Expressway, Delhi Mumbai Expressway, Yamuna Expressway and Meerut Haridwar Expressway

The further construction of the 371-km-long Sonnagar to Andal section, would be constructed by the Railways itself, as the national transporter has abandoned its plan for making it in public-private partnership model.

APM Terminals Pipavav hosts trade meet, showcasing excellence in port operations

PIPAVAV: APM Terminals Pipavav, One of India's leading port operators, hosted esteemed members of the Ahmedabad Custom Brokers Association (ACBA), shipping lines and CFSs at the port. The meet was organised to increase the awareness of the port infrastructure, provide an overview of various processes involved at the port right from jetty to yard to the gate via comprehensive tour of the port. It provided an immersive experience and understanding of port operations and services synonymous with APM Terminals Pipavav.

The cross functional teams at the port engaged with the customers to address their queries and discussions on the latest developments on infrastructure, road / rail and coastal connectivity, main line container services, provision of CFS/warehousing infrastructure and services in the evolving ecosystem in and around Pipavav The customers were happy to witness the live operations at the jetty and appreciated the customer friendly processes, flexible operations, low TAT at the port.

Trade expects increase in Agri exports and sharper

increase in consolidation business to be catered via port Pipavav all backed on good monsoon that favours export volume growth in these sectors, especially to Asian, Middle East and European Ports.

The trade meet concluded on a high note with all dignitaries being treated to an enchanting excursion to the picturesque island of Diu. This event symbolizes APM Terminals Pipavav's dedication to building strong partnerships, facilitating discussions on industry trends, and promoting the vibrant maritime ecosystem in Gujarat.
