Message from Chief Lydia Hwitsum In early November, I attended the BC Cabinet and First Nations Leaders Gathering in Vancouver to speak with Premier Eby and his provincial ministers about the challenges our community and our lands and waters are experiencing. We met to discuss housing needs, the impact of drought on our watersheds and a higher Cowichan Weir, as well as opportunities for a land reconciliation agreement. I was pleased to bring with me a youth representative from Cowichan to build their skills and experience in making the case for change on behalf of our people. Angelina Rice did a wonderful job representing our next generation and I am very proud of her.

Canada’s child welfare system has long discriminated against our children and youth. But on November 24th, our citizens have voted in favour of the Snuw’uy’ulhtst tu Quw’utsun Mustimuhw u’ tu Shhw’a’luqwa’a’ i’ Smun’eem (Laws of the Cowichan People for Families and Children). This successful vote means full jurisdiction over Child and Family Services will return to our nation.

Implementation will begin in 2024, with a phased-in approach over the course of two years.

This vote is a defining moment in our history, an opportunity to chart a happy, healthy, and culturally-rich future for our smun’eem, our children. Voting yes to ratify our child law means keeping our families together and caring for our children in a way that reflects our snuw’uy’ulh (our teachings) and our ways of being, by using a lens of compassion and tl’l’tul tst (love). Message from A/ Chief Administrative Officer

‘Uy’ skweyul, With many people gathering over the holidays and COVID-19, flu and Respiratory Syncytial Virus (RSV) continuing to circulate, we need to protect ourselves, our families and our Elders. COVID-19 test kits are available at Ts’weulhtun Health Centre and local pharmacies. If you test positive for COVID-19, Paxlovid treatment can help reduce the severity of symptoms if you are treated within five days. Talk to your doctor or call 1-888-268-4139 to see if you are a good candidate for this treatment.

Please stay home and do not attend community and family gatherings if you are feeling unwell or have COVID symptoms (fever, chills, sore throat, cough, and loss of sense of taste/smell). If you were not able to attend one of our Fall vaccine clinics, Ts’ewulhtun Health Centre can still provide Flu vaccine. To book a COVID-19 vaccine, please call 1-833-838-2323.

The 2023 Tobacco Tax distribution date is December 6th. If you have not submitted your Tobacco Tax application, you can still apply for our January 19 distribution if you submit by January 12, 2024. You can apply online here: https://cowichantribes.com/member-services/tobacco-tax or in person at the Tobacco Tax Office.

I would also like to share that there are no changes to the process or calculation for the tobacco tax distribution. It is based on the tobacco tax collected on the sale of tobacco products sold on reserve and the number of eligible registered citizens. 37.5% of the tobacco tax collected is allocated to the distribution to the citizens based on the community vote many years ago. The number of registered and eligible citizens increased by 149 this year (2023: 4,932 and 2022: 4,783) and that is why the 2023 tobacco tax per eligible citizen decreased slightly compared to last year ($7.76).

Once again, we are providing Christmas hampers to Elders and those in need in our community.

As we look ahead to the New Year, we are preparing for our 2024 Chief and Council election.

First Nations Drinking Water Settlement

For Quw'utsun Mustimuhw who have already applied for the First Nations Drinking Water Settlement, the majority of applications are in the final stages of processing and claimants should be getting their approval letters shortly. If you receive a letter, and you are missing information, you have 90 days from the date on your letter to submit it.

Josephine Charlie is available to help anyone who requires assistance after receiving their letter, as well as those who have not yet made a claim. She is available for in-person support at the Administration Building lobby during business hours (Monday Friday, 8:30 am - 12:00 pm and 1:00 pm - 4:30 pm) or you can all her at (250) 748-3196 extension 1013. If you have not yet submitted a claim for the First Nations Drinking Water Settlement, the deadline is March 7, 2024. Quw'utsun Mustimuhw who resided on the following reserves: Cowichan IR No. 1, Est-Patrolas IR No. 4, and Tzart-Lam IR No.5, between 2001 and 2021 may be eligible for compensation. (Please bring your I.D. and birth certificate for children when applying). Please be sure to bring a Direct Deposit Form.

Help Prevent Toxic Drug Death 1. Don’t use drugs alone! Buddy up if you can Most deaths happen when people use alone, and no one can call help for them.

Use the buddy system, and make sure someone is sober to watch you.

If you have to use alone, download and use the LifeGuard App on your phone.

2. Have Narcan (naloxone) and know how to use it Call the Outreach Team for free Narcan and training: 250-732-4326.

3. Start with a small dose, go slow Even if you have used a substance before, each batch can have different strengths.

Try a small amount first, and go slow with your use in case it has a delayed affect.

4. If there is an overdose: CALL 9-1-1 IMMEDIATELY, GIVE NARCAN, KEEP GIVING BREATHS Call 9-1-1 right away when there is an overdose. Police can NOT arrest you or anyone at the scene for simple drug possession or breach of conditions.

5. Use at the Overdose Prevention Site 5878 York Road. Open 7 days a week, 11 a.m. to 7 p.m. A safe and welcoming space.

About this Project

Welcome to the first newsletter of the Xwulqw’selu (Koksilah) Watershed Planning Project, a partnership between Cowichan Tribes First Nation and the Province of BC. Huy ch q’u (thank you) for reading!

The Xwulqw’selu (Koksilah) Watershed Planning process formally began in May (see timeline on p.2) to help Cowichan Tribes and the Province realize their vision and priorities for a healthy watershed, healthy communities, and climate-resilient future, as articulated in the S-xats-thut tst (“We Agree”) Agreement.

We plan to publish bi-monthly to share what the various planning and advisory teams are learning, exploring, struggling with, and eventually proposing as solutions.

We will highlight new resources, studies, and other information guiding the work. We will seek your input on specific questions, and we always welcome your feedback and concerns.

These newsletters will also be available at www.koksilahwater.ca.

S-xats-thut tst is a government-to-government agreement that commits Cowichan Tribes and BC to work together to create a whole-of-watershed plan, drawing on both provincial legislation and Cowichan Tribes’ laws and teachings. Lulumexun - Lands and Self-Governance

Kw’atl’kwa (Ocean) Updates Monitoring the impacts of tires in our watershed and coastal ecosystems Tires on beaches The S-hwuhwa'us Thi’lut Kw’atl’kwa have been tracking marine debris since 2021. Tires have been found throughout the monitoring area from Hatch Point to Chemainus to Porter Creek, and on Salt Spring Island. These tires are used as makeshift sea walls, concrete-filled boat tie-ups, bumpers on docks and also may be found buried in the sand and taking up space in the intertidal zone. The intertidal tires will be removed in the upcoming shoreline cleanup being hosted

by Rugged Coast Research Society (as mentioned in the September Cowichan Tribes newsletter). Tires have been shown to contribute micro and nano plastic particles, as well as chemical pollutants, zinc, lead, etc., to aquatic environments (read more here).

Impacts of tire particles in our watershed The biggest impact that tires have in our aquatic environments comes from the micro and nano particles shed by our tires onto our roadways. These tire particles end up on our storm drains, creeks, rivers and eventually the sea.

These particles leach chemicals, including one known as 6-PPD, which breaks down to 6-PPD quinone which is deadly to Coho salmon in, especially when concentrations are higher during a storm that follows a drought period (learn more here).

Cowichan Tribes biologist, Tim Kulchyski, in collaboration with the BC Conservation Foundation, is collecting water samples near a selected storm drain and creek. The samples are analyzed at a VIU lab for the presence of 6-PPD quinone. Preliminary results are showing sustained, high levels of the compound, giving a likely answer to why Coho have disappeared from the sample area. Sampling is ongoing, and we will continue to update you on the results.

CAPITAL PROJECTS Low Pressure Sewer STEP System Construction is substantially complete for the Low Pressure Sewer Project – Zones 1,2,3,4,5-2 with only minor deficiencies remaining. Zone 1 (Shmaqwathut Road), Zone 2 (Glenora Road), Zones 3 (Koksilah Road), and Zone 4 (Boys Road Area) have all been successfully connected to municipal sewer and are fully operational.

Since the end of October a 1 year warranty period is in effect for this project. If you have been provided a low pressure sewer connection, please contact the Capital Projects Department if you have any issues or concerns with your low pressure sewer connection so they can be corrected within the 1 year warranty period. We appreciate your patience as we look to complete this project.

CAPITAL PROJECTS Upcoming projects With the YTT Replacement Project wrapped up and not many other active projects underway at the moment work is continuing behind the scenes on other projects. We currently have 11 infrastructure project applications and one building expansion project submitted to Indigenous Services Canada (ISC) awaiting funding for either feasibility or design. Infrastructure means either water or sewer projects.

We are also working on feasibility studies for a number of community buildings including a Health Centre, a Youth Centre, and a Recreation Centre. A feasibility study is a preliminary study that looks at how a potential building will interact with the land in terms of location of the infrastructure; stormwater drainage; archaeologically sensitive areas; and types of soils.

We are also working on obtaining consultant proposals for other projects to start design work or feasibility work. Lots of exciting projects coming up so stay tuned!

Candle Safety

Burning Candles Candles can be a serious fire hazard if not used properly. Every year in Canada, human error is responsible for starting a number of candle fires. During the years between 1999 and 2008 an average of nearly 800 fires were started by candles in each year. Common mistakes made while burning candles include: leaving candle burning with no one in the room, or falling asleep or leaving the house; burning candles too close to things that can catch fire such as cabinetry, curtains, bedding and mattresses, furniture, clothing and decorations; and leaving candles within reach of children or pets.

Candles bring healing and protection to our spirit and our homes, let’s ensure we burn them safely to keep that purpose within our community.

To minimize your risk of fire while burning candles please follow these simple steps: 

Follow any instructions for burning printed on the label.



Trim candle wicks to a height of 5-7mm (1/4 inch) before lighting your candle and continue to trim the wick every 2-3 hours to prevent high flames.



Take extra care when burning candles with more than one wick. Avoid those with multiple wicks that are close together.



Use well ventilated candle holders that are sturdy and will not tip over. Avoid those that are made of wood or plastic. Be extra careful with glass holders as they can break if they get too hot.



Never drop objects into candles such as matches.



Keep burning candles away from things that can catch fire and from children and pets.



Do not burn candles when no one is in the room and extinguish all candles before you go to sleep or leave your home.

I want to take this time to thank our community members for taking the time to visit our children at Quw’utsun Smuneem School.

It is often said our children are important but I truly want to thank community members/ organizations for putting these words into action.

Donations:  Fields—(Lake Cowichan) donated $200 worth of items to our students.  Tracy Sylvester purchased rain boots and craft items for the school.

.com UPDATES FROM OUR TEAM The 222 Cowichan Way Demolition project has made significant strides since salvage operations commenced in October. The coordinated efforts of various teams and individuals have played a pivotal role in the smooth execution of the project, with special thanks extended to Lemo Smith for exceptional coordination. Salvage operations were successfully completed on November 4th. Duncan Christian School, Sacred Cedar Centre, Camp Cowichan, Camp Imadene, Somena Long House, Quamichan Long House, Canoe Club, ClemClem Long House, and Shaker Church received bathroom fixtures, educational equipment, kitchen equipment, outdoor equipment, and mechanical equipment. The demolition is set to conclude by the end of November. Key contributors to the project, Lemo Smith, coordination, HGX grubbing and clearing, Ravenstone for manpower, safety, and equipment, and JonCo for their heavy equipment. The demolition phase nears its completion and new design progresses for 222 Cowichan Way project stands as a testament to the dedication and expertise of all!

North Island College Student Housing component of the project has seen bulk excavation and detailed excavation completed on schedule. Backfilling has commenced and we are scheduled to be complete 1st week of December. Special acknowledgement is due to Jon Coleman for his leadership and heavy equipment contributions, which have significantly contributed to the successful execution of this scope of work. Trucking at the Cowichan Regional Hospital Project is ongoing, thanks to Lemo Smith’s excellent leadership and dispatch expertise ensuring the seamless transportation of materials and showcasing the importance of KDC and the Roundtable to this exciting project.

The collaborative efforts of these teams and individuals highlight the significance of teamwork in the successful execution of complex construction projects.

Fire season has ended. It was a bad fire season with so many large fires all over the province, but that meant a great fire season for KFS and their firefighters. The weather has changed to cooler and wetter weather, so we went from firefighting straight into pile burning for Mosaic.

We have several crews out conducting brushing, cone removal and we started the Elders’ Firewood program. We have delivered at least one load to everyone on our list. Any new elders wishing to participate must register with Alexis at 250 7464555 and provide your name, address and phone number. We will accept new elders that live off reserve as well as those that live on reserve.

For those who have been keeping up with Khowutzun Freegro Treeshelter projects we are pleased to announce that we have successfully completed our largest order to date. The Down to Earth 100,000-unit order will be shipped to Quebec to protect their sugar maple trees.

Our next order will be for Mosaic who are purchasing 10,000-units of tree shelters.

KFS will commence logging approximately 4000 m3 or 96 logging truck loads from our community forest in late November.

Two Cowichan youth, Louie Johnnie and Dorian Seward, had the opportunity to attend the Indigenous Youth Entrepreneur Summit and Job Fair at the River Rock Casino Resort in Richmond, fully sponsored. The youth forum was from October 16 –19, 2023. The youth did a lot of team building with youth from different nations such as the Yukon and Saskatchewan. Louie and Dorian were networking and gaining valuable connections. They were asked to create a mock business from scratch and best team took home a $10,000 prize to help launch their business ventures.

Although our youth did not take home the prize, they gained connections with people who have the means to support Louie with becoming a one-on-one youth worker for children in care and Dorian to begin his landscaping business. We have two entrepreneurs on the rise. We wish Dorian and Louie all the best.

This support is made possible by KDC and partners: Urban One and Kinetic. We raise our hands to Urban One and Kinetic for their generous contributions. Urban One made a $5,000 donation and a booth at the conference. Kinetic has generously donated $1,500. These donations provided the opportunity for First Nation members to attend this event for free.

Next month we will have information on new opportunities for members to build skills and try different trades . Be sure to watch for updates.

Feature Retail Financial Growth: Costa Canna has prepared a comparative financial report for the fiscal years of 2021/2022 and 2022/2023. Across our four stores we recognized a 16% profitability increase. Compared to the rest of the retail industry, this puts the Costa Canna Brand within the top 10% of Provincial store growth.

United Greeneries Fiscal Year End Delays: We experienced delays this year and last year. The delays came from three distinct issues. The first delay was a result of the Biological Assets Valuation. This is a process in which we must determine the value of the plants at all stages of growth. The second was due to communications challenges with the auditor. The third was related to the valuation of plant, property and equipment. There were several items that were undervalued by the auditors. We respectfully apologize for these delays and will do our utmost to ensure this does not continue into the future.

Kristopher Alphonse started with Khowutzun Development Corporation on June 28, 2020 as the Data Entry and Filing Clerk. The team was quite small at the time, but he learned a lot about the Khowutzun companies by organizing each file for everyone of our four companies.

A little over a year later Kris got the opportunity to work in Finance as the Finance Administrator, which has been both a challenge and a great experience. He has now been with KDC for over 3 years and has grown alongside this company as it has expanded into new territories.

Kris has gained a great amount of knowledge and experience and is a great asset to the team. We are excited to watch him continue to flourish.
