‘Uy’ skweyul Quw’utsun Mustimuhw,

We have many important initiatives going on in our community that are taking back our ability to govern our people. I want to draw your attention to our Child and Family Wellness Legislation that has been under development in consultation with our citizens over many years. An important milestone has been reached and the Law is now available for community to review and participate in a ratification vote later this Fall. The Law is administered in accordance with our snuw’uyulh, and is guided by nine principles. You can review the law here: http://ourchildlaw.cowichantribes.com/law or use the QR code below for the link. A list of upcoming events, both on and off-reserve (in Victoria and Nanaimo), where you can learn more and provide your feedback, is included in this newsletter. If you have questions or would like any additional information about the Child and Family Wellness Legislation, please contact ourchildlaw@cowichantribes.com or call (250) 746-1002.

As the hot, dry weather continues, I know that we are all concerned about the health of our watersheds. Last month, we experienced a devastating die off of salmon fry and trout in the Cowichan River. This loss prompted a strong response from our staff at Lulumexun in collaboration with the Cowichan Watershed Board, Department of Fisheries and Oceans and many others, to determine the cause.

In June, I sent a letter to BC Minister of Forests, Hon. Bruce Ralston, and Hon. Nathan Cullen, Minister of Water, Land, and Resource Stewardship regarding extremely low water levels in the Cowichan River jeopardizing the survival of wild salmon fry. In the letter, I reiterated our call for the Province to come to the table to support a new, higher Cowichan Weir so that the river and salmon do not face these dire circumstances in the future.

Lastly, I enjoyed connecting with so many people at the recent Modular Housing Grand Opening Community Celebration on Boys Road. Huy tseep q’u to all the hands that got the project over the finish line, creating 32 brand new homes for Quw’utsun Mustimuhw. There are a variety of units, including studios, one bedrooms, and two bedrooms to accommodate families, elders and young people. Sixteen units are dedicated for housing department rentals and 16 one-bedroom units are for Lalum'utul' Smun'eem to support young moms and youth as they age out of care. There is also a multi-purpose space with a kitchen, as well as a playground, sport court, and public washroom facilities with a water fountain. We know that many more homes are needed for our people. Our Council and our staff are working very hard to get more housing projects in the works.

Huy tseep q’u, Xtli’li ye’ Chief Lydia Hwitsum

‘Uy’ skweyul,

I would like to update our community that Acting Chief Administrative Officer Cindy Daniels has extended her leave until the end of August to follow the guidance of our snuw’uy’ulh by continuing to take care of her health and prioritize her healing. In her absence, I will continue to fulfill the responsibilities of A/CAO. Melissa Bellamy has also agreed to continue to provide support as Acting Director of Administration, in addition to her role as Treaty Manager.

Please mark your calendars! The dates of the Ratification Vote for our Custom Election Code have been confirmed. Online voting will start on August 30th and the in-person voting day is Friday, September 15th . Three outdoor pop up information sessions were held at our big houses in July. Additional information sessions will be held in August before the vote. The dates and locations of the events and information about how we will select our leaders are available in following pages. The Draft Custom Election Code is posted on our website: https://cowichantribes.com/election-code and available by contacting Keisha Sampson at election.code@cowichantribes.com or (250) 748-3196 ext. 1511.

We have a number of important votes coming up this fall and winter. We need current contact information from our citizens in order to send you details about these opportunities to cast your vote. If your contact information has changed over the past few years, please contact the Citizenship Department (250.748.3196 or membership@cowichantribes.com) to update your mailing address, email address and/or phone number.

I would like to take this time to introduce our new Education Director, Roxanne Harris, B.Ed., M.Ed. Roxanne is from Stz'uminus First Nation, and she has connections to Cowichan through her late grandfather, Bernard George. Roxanne started with us on July 10th and brings with her extensive experience working within the Education field and at top executive positions, which will serve our community well as we develop our Education Law. Please join me in welcoming Roxanne.

Lastly, I would like to recognize our team from Embracing Life and Youth Services for the fantastic programming they have been offering our community this summer. They have hosted multiple movie nights for families and arranged many fun activities for our youth, including kick boxing, skateboarding, and scuba diving. On August 29th-31st, they will host the Stsielhstuhw Thun Suli’ Honour Your Life Youth Forum, facilitated by Earl Lambert, a Cree/Metis motivational speaker and life coach. This will be a safe and judgment-free space for youth to learn and talk about suicide prevention and addiction awareness. Registration information can be found in the following pages. Cowichan Tribes

Cowichan Tribes is changing how we choose our leaders. We have been working on this community-led project since 2006. Here are some important issues we reviewed as a community through open houses, surveys, face-to-face discussions and with a citizen working group. All changes are documented in our Cowichan Tribes Election Code (available at cowichantribes.com/election-code, election.code@cowichantribes.com, or paper copies available at the front desk of Administration Office).

Are there any important changes to our Council (who can be on Council, how long they will

serve)?

In general our Council will look the same as before, with some important recommended changes.

$ $

COUNCIL WILL:

 Still have 12 Councilors and one Chief (Section 3.1).

NO CHANGE

 Serve for four years opposed to two years (Section 3.9).

 Still include Youth and Elders on committees where appropriate (Cowichan Declaration).

NO CHANGE

IF THE CHIEF CANNOT FINISH THEIR TERM, Council will choose a Deputy Chief to do the job of Chief

TO BE COUNCIL, YOU:

 Must still be Quw’utsun Mustimuhw and 18 years or older. (Section 5.21). NO CHANGE

 Cannot be an employee of Cowichan Tribes or have another job with Cowichan Tribes (Section 5.21(c), Section 5.22).

 Must not have done a serious crime in the last 10 years, or a minor crime in the last 2 years before the election (Section 5.21(c), Section 5.22).

 Cannot have been removed from their seat on Council before, unless Council gives specific approval.

TO RUN FOR COUNCIL, you will be required to pay a small non-refundable fee of $100 to run for Chief, or $50 to run for Councillor (Section 5.16(b)). These fees can be helpful because they:

 Encourage only serious candidates to run

 Show support for candidates (e.g. many people can make small contributions to the fee).

 Can be used to benefit Cowichan Tribes (e.g. to pay for election expenses).

IF A COUNCILLOR CANNOT FINISH THEIR TERM, Council may choose not to replace them if it won’t affect quorum (the minimum number of councilors needed to make an official decision) (Section 3.21). If Council decides to fill the vacant position, the person who got the most votes in the last election (but did not win) will be asked (Section 3.23).

Are there any changes to what the election process looks like?

In general the election process will look the same as before, with some important recommended changes.

AN ELECTORAL OFFICER (the neutral person who runs elections by preparing materials, making sure everything is fair, helping people vote, and counting the votes) will still run elections. NO CHANGE

WE DECIDED THE ELECTORAL OFFICER must be 18 years or older and cannot be Quw’utsun Mustimuhw, work for Cowichan Tribes or have personal or business relationships with Cowichan Tribes members. They must be fair and knowledgeable about elections (Section 4.3).

COUNCIL CAN DECIDE whether to have advance polls (so members can vote before the election day) (Section 14/6(d)) and/or electronic voting (Section 6.2, Section 6.16-23).

THE COWICHAN TRIBES COMPLAINTS AND APPEALS

BOARD will now handle problems with the election process and with Council members not doing their job right. (Note: The Minister of Indigenous Services Canada used to handle these problems, if they arose). The Complaints and Appeals Board will have:

 A Cowichan Tribes Elder.

 A Cowichan Tribes member (18+).

 Someone (18+) who isn’t a member, but knows about law, conflict resolution, and/or elections. They can’t work for Cowichan Tribes or be part of the election.

 The Complaints and Appeals Board will ask for help from lawyers or other professionals if they need it.

IF YOU THINK A CHIEF OR COUNCILLOR SHOULD BE REMOVED, you must write a complaint with proof to the Complaints and Appeals Board, submit a petition signed by at least 25% of all voters (or 2/3+ of Council can submit a signed resolution) and pay a non-refundable fee of $100 within 3 months of when the problem happened (Section 11.5).

Reasons for the removal of a Chief or Councillor include (Section 11.2):

 Cannot do the work because they are sick or not able to for 6 months.

 Do not come to 3 Council meetings in a year without saying why.

 Should not have been chosen in the first place, e.g. if they are under 18, not a Quw’utsun Mustimuhw, an employee of Cowichan Tribes, or have committed a criminal offence (Section 5.21).

 Do not do their job right, according to the Chief and Council Oath of Office (Appendix “B”).

 Are bribed, cheat, lie or act dishonestly while

IF YOU THINK THE ELECTION WAS NOT FAIR, you must write a complaint with proof to the Complaints and Appeals Board and pay a nonrefundable fee of $100 within 30 days of the election (a signed petition is not required) (Section 12.4).

Reasons to challenge election results include (Section 12.3):

 Someone who won was not allowed to be a candidate.

 The election rules were not followed, and it may have changed who won.

 Someone did things that are dishonest and unfair and there is proof.

For questions or more information about the election code process please contact election.code@cowichantribes.com or Keisha Sampson at (250) 7483196 ext 1511

CAPITAL PROJECTS PROJECT UPDATE

Low Pressure Sewer STEP System

Construction is nearly complete for the Low Pressure Sewer Project – Zones 1, 2, 3, 4, 5-2. The Contractor is concluding mainline work along Koksilah Road (Zone 3) and once complete will focus their efforts on surface restoration and asphalt paving or patching in all Zones where tank installation is complete. Zones 1, 2 and 4 are now fully connected to the municipal sewer.

It is expected that all yards and/or driveways affected by construction will be restored by the end of July. The Contractor will be installing top soil and placing hydroseed in the yard areas disturbed by construction. The Contractor is responsible for placing and spreading the topsoil and for placing and watering the hydroseed. Residents do not need to maintain their freshly placed topsoil and hydroseed. Residents should expect to periodically see the Contractor review the topsoiled and hydroseeded areas. The Contractor will be installing sprinkler systems on timers and/or manually watering the grassed areas.

Please note that the Contractor will be under a one-year maintenance period for the installed works. Any issues related to your sewer service or with the project should be reported to the Capital Projects Department. The Capital Projects Department will notify the Contractor to rectify any issues in a timely manner. We appreciate your patience as we continue to work towards providing municipal sewer to our community.

Please contact James Ouellette in the Capital Projects Department at (250) 715-3302 for more information on this project.

SUSTAINABLE HOUSING

WILDFIRE SAFETY

THE FIRE TRIANGLE

There are three elements needed for a fire to start: Heat, Fuel and Oxygen

In order for a fire to start there must be some kind of material to burn - this is called the fuel.

 Papers

COMMON FUEL SOURCES

 Oil

 Wood

 Plastic

 Rubber

 Garbage/Debris

 Gas

 Fabrics

 Liquids

To help stop the spread of wildfires this summer, remove any unnecessary fuel sources from your property:

 Keep your grass mowed and landscaping trimmed and under control

 Keep any woodpiles on your property far away from possible heat sources

 Be extremely careful when using flammable materials; store and use in cool areas only

 Take any garbage, debris and unused items sitting around your yard to the dump

40% of BC wildfires are human-caused therefore preventable.

To report a wildfire, unattended campfire or open burning violation, call 1-800-663-5555 toll-free or *5555 on a cellphone.

For the latest information on current wildfire activity, burning restrictions, and air quality advisories, go to http://www.bcwildfire.ca

SUSTAINABLE HOUSING BEAT THE HEAT

Check out these quick tips for staying cool in the summer heat:

KEEPING YOUR HOME COOL

Keeping direct sunlight from streaming into your home is one of the best ways to keep temperatures down. Block out sunlight with curtains or blinds during the day and allow the cool breeze to circulate at night.

AIR CIRCULATION

If you choose to keep windows open, try to have the air moving through out your home. Do this by opening a window at both ends of the home to encourage cross ventilation.

CONSCIOUS COOKING

Cooking inside can generate a lot of heat in your home. Consider cooking at cooler times of the day, especially baking items in the oven for longer periods of time. Take advantage of the warm weather and cook outside on your BBQ whenever possible.

APPLIANCE AWARENESS

Running your dryer generates a lot of heat. If possible, dry clothes in the early morning, later at night; or even better, hang clothes outside to dry using a drying rack or a clothesline. You can also be smart with your refrigerator. Keep the door closed as much as possible. While it might feel refreshing to bask in the cool air, this can be counterproductive as the fridge motor will have to work harder and winds up generating more heat.

FAN TIPS

One of the best ways to use your fan is to blow air out the window. A lot of homeowners don't realize this will actually push the hot air outside. If you use a ceiling fan set it to rotate counterclockwise. This method will help push warmth to the ceiling, helping you feel more cool.

ENERGY SAVING

Keep lights turned off whenever they are not in use. Use natural sunlight whenever possible. This method will not only keep the heat down in your home, but will help to save money on your hydro bill.

Kw’atl’kwa (Ocean) Updates

NAME CHANGE ALERT!

S-hwuhwa’us Thi’lut Kw’atl’kwa’s monthly newsletter feature has officially changed to Kw’atl’kwa (Ocean) Updates! S-hwuhwa’us Thi’lut Kw’atl’kwa will continue to bring monthly updates through the Quw’utsun Newsletter but under the new name: Kw’atl’kwa (Ocean) Updates, representing all Lulumexun Marine Programming.

Cowichan Tribes’ Hydrophone Array

Lulumexun successfully acquired funding to implement an array of 3 shore-based hydrophones within core marine territory. Hydrophones are underwater listening devices to hear what goes on acoustically underwater from marine mammals (IE. Killer Whales) to vessels like tugs or boats. The purpose of the hydrophone array is to build our understanding of the cumulative impacts of underwater vessel noise on the marine environment. Additionally, to develop a networked response to mitigate against those cumulative impacts and showcasing baseline data made available to researchers, policy makers, governments and NGOs to further research and management strategies.

These are what Cowichan Tribes’ hydrophones look like. The hydrophone and mounting structure are installed underwater and are attached to durable and strong cables that run to shore. The power source for the hydrophones are solar panels, batteries and other weather protected equipment that send data to a digital storage drive. The plan is to also transmit the data LIVE, so that you can listen in on your computer or device!

‘Uy’ skweyul Quw’utsun Mustimuhw,

My Xwelmuxw sne (traditional name) is Whool’wuletza’aat. My borrowed name is Roxanne Harris. I am from Stz’uminus First Nation. My parents are George and Sylvia Harris. I have family connections here in Cowichan as well. My mom’s late dad Bernard George was from Cowichan. He was a brother to the late Ben George.

I have two daughters Jasmine and Chelsea. I am excited that they have both graduated from high school and both are enrolled in University! I am already excited to think about their University graduation!

I am happy and excited to announce that I am the new Executive Director of the Quw’utsun Syuw’entst Lelum (Cowichan House of Learning). My first day of work was on July 10, 2023. I look forward to working hard for Cowichan Tribes.

In education it is very important to always keep the students in mind for their educational journey. Everyone has a dream of what they would like to do in their journey forward. It is our job in the Education Department to listen to those dreams and help our students make their dreams a reality! From the smallest baby that attends our daycare to the eldest elder who wants to return to school, we have to remember that education is a life long journey. We should be learning something new every day of our lives. Learning enriches and enhances all of us.

I look forward to working hard to ensure that we keep our Hul’q’umi’num’ language and culture alive. Ensure that we speak our language and practice our culture, we learn by doing.

I look forward to meeting everyone and getting to know what the needs are here in Cowichan Tribes.

My name is Holly Thomas and I am the Manager at Le’lum’uy’lh. I have been employed at Le’lum’uy’lh since 2008, I spent seven years in the infant and toddler room, a few years in the Pre-k program and a year with Strong Start. I started as the Manager in June of 2022.

Childcare and the pandemic, what a challenging few years it has been. I assure you we are not alone, the whole world is in need of early childhood educators. I encourage anyone who is passionate about working with young children to consider the Early Childhood Education (ECEC) program with Vancouver Island University; it is a 2 year program. I would also like to thank our team here at Le’lum’uy’lh for their ongoing commitment and dedication to our children and families. I look forward to the upcoming 2023 2024 school year.

Caring for the Quw'utsun (Cowichan) River

“The Quw’utsun River ('the River') and watershed touches the lives of all in the valley region…..my intent is that, after all the Quw’utsun River has given, I will be able to give something back.” Dr. Shannon Waters, Cowichan Watershed Board Member

For those of us, like Shannon, who are supported by the river through our work, play, or simply walking along its banks to find solace, it’s time to give a little back at the 13th annual Lower Quw'utsun (Cowichan) River Cleanup!

This soul-satisfying annual event removes truck-loads of garbage from about 15 km of the iconic Cowichan River every year before the fall rains return and wash it all downstream. Think of it as welcoming the salmon home!

The Lower River Cleanup is a day of community, connection and doing our part for the beloved heart of our community the river where, sadly, waste and garbage are threatening the health of the river.

I am continually inspired by the incredible number of people and organizations who are working hard year-round to safeguard our shared waters. However, as we face low flows throughout the heat of summer we need the whole community to chip in, join together and care for the river.

What I love about attending events like these in the Cowichan Valley, is getting to know the community of water stewards. This goes beyond any one organization, government, volunteer group, or sports club, it is a community with a deep sense of camaraderie and a welcoming environment. It is a community that cares, not only about the health of the river, but about the whole watershed - the people, livelihoods, land, fish, and wildlife.

Welcomed and guided by Cowichan Tribes, who have taken care of the river in a reciprocal relationship since time immemorial, we are a community learning and working together. Please join us for a few hours to make our rivers a bit safer and healthier, get to know your neighbours and enjoy a free BBQ lunch!

All are welcome! No experience needed.

The Cowichan Watershed Board is a partnership between Cowichan Tribes First Nation, and the Cowichan Valley Regional District. It exists to provide leadership for sustainable water management and to protect and enhance environmental quality and the quality of life in the Cowichan and Koksilah watersheds and adjoining areas.

UPDATES FROM OUR TEAM

As the final stages of civil construction approach for the groundbreaking National Centre for Indigenous Law (NCIL) at the University of Victoria, excitement is building among contributors and stakeholders. The NCIL aims to serve as a centre for the sharing and preservation of Indigenous legal traditions, whilst fostering an inclusive learning environment. Notably, the NCIL will house the Faculty of Law’s JD/JID program, making it the world’s first law program to combine the study of both Indigenous and non-Indigenous legal systems.

Among the proud contributors to this ambitious project are KDC, Jon Co, Raven Stone Construction, Porlier Pass, HGX, Grant Williams, Fran Williams, and Lemo Smith. These organizations and individuals have played a crucial role in the civil site servicing, ensuring the successful development of the NCIL’s infrastructure. The dedication, skill, and professionalism of the more than 20 Cowichan Tribes members to this scope of work, has set the project up for success.

Throughout the course of the project, KDC has spearheaded the civil site servicing, collaborating closely with other contractors involved. In light of the imminent conclusion of their work, KDC expresses gratitude to the Roundtable group of contractors, Houle Electric, and Chandos, as well, the University of Victoria. The positive collaboration and supportive atmosphere provided by these entities have been instrumental in bring the NCIL to life.

The NCIL hold great significant not only for the University of Victoria but also for the wider community. Its establishment marks a significant step toward acknowledging and embracing Indigenous legal systems and practices. The NCIL will offer students a unique opportunity to learn from Indigenous legal experts, scholars, and Elders. This innovative approach to legal education will empower future lawyers to navigate complex legal landscapes while fostering respect and appreciation for Indigenous legal systems.

With the completion of the civil site servicing, the path is clear for the NCIL to take its rightful place as a beacon of Indigenous legal education, fostering understanding, collaborative learning, and unity.

FOREST SERVICES

It has been a very hot and dry June and July. The Northeast and Cariboo fire centres are experiencing their worst fire season ever. KFS had 4 Type III 5 packs (20 firefighters) sent to Fort St John in northern BC in June and now we have just sent another Type III 5 pack there again. We also have a Type III 5 pack in Burns Lake and one in Quesnel. Our highly trained specialty Type II 8-pack crew has been deployed on 3 fire on northern Vancouver Island and will be sent to Hope to battle several fires there. Due to the highly trained and experienced KFS firefighters we are being deployed to some of the most severe fires in the province.

KFS is once again wanting to support community organizations and members. In 2022/23 fiscal year KFS supported the community by contributing approximately $285,000 to fund charities. Call Alexis at 250 746-455 to see if your charity qualifies. KFS wants to support more youth camps and elders’ functions in 2023.

Khowutzun Freego Tree Shelter is pleased to welcome back two returning staff members: Geneva Sylvester and Jace George. We would also like to introduce Priscilla Johnny who has recently joined our KFT team.

Over the next few weeks, we will be completing our 100,000 unit order to Down to Earth Carbon. This has been our largest order to date. Once complete we will be sending this order to Quebec to protect their sugar maple trees. Our next order will be for Mosaic who are purchasing 30,000 units of treeshelters.

If you or anyone you know is looking for employment, please drop by at Quw’utsun Cultural and Conference Centre. Or you can call the office at 250-746-8350.

On July 14, 2023, we successfully completed a 4-week training program on carpentry and formwork. Despite initial challenges, six participants persevered and completed the program. Notably, two of these successful participants were women, demonstrating the power of determination and hard work.

We would like to thank BC Infrastructure Benefits Inc for contributing to this program, supplying the work boots, work clothing, a day rate for the participants to attend, the food everyday and best of all a job offer at the end of the training. We would like to thank the Carpenters' Regional Council

B.C. & Yukon and Tim Boulderson the wonderful trainer, for making this opportunity happen. For putting on this training and building our members’ knowledge and opportunities I understand Tim is a great instructor, and I thank him for his time and commitment to our Program. Ellis Don, we would like to thank you for stepping up and contributing to the facility rental and this wonderful graduation ceremony. Without your kind gesture, we would not have been able to make this happen. I would like to express our gratitude to the Ts'ewulhtun Health Centre for providing us with tents to provide shade during the hot summer weeks. Thank you so much for your generosity.

INTRODUCTION TO CARPENTRY AND FRAMEWORK PROGRAM

United Greeneries Launches in German market: The team at United Greeneries has launched 3 strains into the German market under the Costa Canna brand. Thus far we have seen great reception by the consumer as all lots have sold out. We have since completed our third shipment and are preparing for a 4th shipment to leave our facility before the end of July 2023. We will continue to advance new and exciting products into the German Market with our next round of genetics.

Australian White Label brands: As a follow up to last months newsletter, we hosted our Australian partners at the United Greeneries facility during the week of June 19th. During this series of meetings our Australian partners selected 9 strains for immediate production and distribution under 3 white label brands. The sample shipment that left our facility on June 23rd cleared customs and is currently being marketed to prepare for our first full shipment of ~60kgs slated to shipped in Mid-August. “This is the beginning of a long-term partnership into the Australian market” said Phil Floucault, President of United Greeneries. “We have executed a two year contract with aspirations, on both sides of the table, to develop a broader 5 year partnership that will incorporate a consortium of local producers to fulfill the growing demand for United Greeneries products”.

We began with a group of eight members on July all of whom are indigenous. Two of these members are women, and two are Cowichan Tribes Citizens. Cowichan Tribes Citizens: Beverly Joe and Robert Gray. Two members are from Stz’uminus: Albee Bruce and William Seymour. We have one member from Malahat Melissa Harry and one from Penelakut August James. Six members have completed the program.
