Councillor says motorists should be reimbursed after revealing ANPR cameras were installed without planning permission

A BOROUGH councillor is calling for car parking fines issued to drivers at the Concourse shopping centre in Skelmersdale and Burscough's Ringtail Retail Park on the basis of Automatic Number Plate Recognition (ANPR) to be suspended immediately after revealing that the cameras, equipment and signage at both sites were installed without planning permission. Skelmersdale North councillor, Neil Furey also wants all previous fines issued at the Concourse by the Smart Parking company to be reimbursed to motorists without delay. At ANPR-controlled sites a camera detects when a vehicle enters and leaves by recording its number plate. If a vehicle is parked illegally a charge notice is sent to its registered keeper. Demands Cllr. Furey said: “I expect motorists will be angry to learn that the Concourse shopping centre didn't bother to obtain planning permission for its Smart Parking ANPR cameras and signage.

“Over the last 12 months I have received a number of complaints about incorrect £100 parking charges notices being issued by Smart Parking, with motorists being accused of overstaying or even staying overnight when they have done nothing of the sort. “Motorists have then faced further demands and

threats of court action. In some cases drivers have even produced their own video footage to challenge the parking charges notices. “Smart Parking has consistently failed to accurately record images of vehicles entering and leaving the site or recognise that motorists have made two trips to the car parks but had done so within the advertised restrictions.” Cllr. Furey also claimed that Burscough Ringtail Retail Park hadn’t obtained planning permission for its new ANPR equipment and signage run by the Parking Eye company. Advertised

“I will also be calling for ANPR car parking enforcement to be suspended immediately at Ringtail Retail Park and for Parking Eye to refund any parking fines issued to motorists without delay.” A spokesperson for London and Cambridge Properties which owns and manages the Concourse shopping centre, said: ““A car park management sys-

tem has been in operation for many years. Prior to Smart Parking taking over its management in 2016, the site had already been used and advertised as a maximum stay car park. “On February 12, 2018, planning condition 5 was discharged by West Lancashire Council concerning car park management strategy as part of Planning Permission 2014/0952/COU. In paragraph 3.2.3, it specifically states that an Automatic Number Plate Recognition system would be used with cameras located at all entry and exit points.” A spokesperson for Parking Eye commented: “The land owner engaged Parking Eye’s services at Ringtail Retail Park to ensure parking remains available for the vast majority of motorists who are genuine users of the site, following increasing levels of abuse and overstay by those not entitled to park there. “The presence or not of appropriate permissions does not affect the validity of the parking contract that a motorist enters into when remaining on site. However, Parking Eye is working closely with West Lancashire Borough Council’s planning authority to help ensure compliance. “Motorists at Ringtail Retail Park are also reminded to keep to the terms and conditions of parking displayed on the signage throughout the site, to avoid receiving a parking charge notice.” Smart Parking has been contacted for comment.
