Total refunds of almost $2 million!

Just days after the summer break, participating members of the ARQ’s Programme d’achats Privilège Plu$ (PAPP) were given refunds for their purchases made during the second quarter of 2023 (April-June 2023). More than 2000 members shared total refunds of $1,992,237, for an average of $855 each! And 621 participating

members each received cheques of more than $1000, with the highest being $9916!

Sustainable development a key strategy

The Alliance de l’industrie touristique du Québec (Alliance) and Tourisme durable Québec (TDQ) announced last month a new partnership to make Quebec a leader in sustainable tourism development. The goal is to better serve the collective interests of the industry and ensure a collaborative leadership within the network of associations.

In addition to creating new synergies, the partnership will especially draw on individual strengths to distinguish our destination within Canada and internationally. The agreement’s objectives are to:

• Identify the relevant means and subjects for making tourism companies and associations aware of the actions that can ensure the transition toward sustainable tourism;

• Facilitate the development, application, and funding of collective tools that foster the transition toward sustainable tourism;

• Guide, equip, and motivate tourism companies and associations in sustainable development.

A first collaboration between the Alliance and TDQ took place earlier this year with the Alliance’s financial contribution to the publication of a Lexique du tourisme durable. The guide aims to enable actors within the industry to use a common language, to create a shared understanding of terms, and to start or pursue the sustainable transition in a consistent way for everyone.

The restaurant industry in search of the right formula

In the restaurant industry, attracting and retaining staff is a constant challenge. However, innovative human resources techniques are now emerging to ensure staff retention, help build employee loyalty and create a more attractive working environment.

In the heart of Québec City, Louise Taverne & Bar à Vin is the first restaurant to display the Concilivi Seal. Awarded in January by Le Réseau pour un Québec Famille, this seal recognises good practice in family-work balance in the workplace. According to this organization, 76% of people with family responsibilities say that the fact that an employer holds a seal of recognition for family-work balance would encourage them to apply for a job in a certified company. Nearly four out of five would also like to hold a job there for as long as possible.

COPING WITH THE SHORTAGE

Louise Taverne & Bar à Vin, which has 43 employees, began adapting to the new reality of the job market a few years ago. The owners, for example, have turned to international recruitment to deal with the labour shortage. The arrival of these employees is not without its challenges. Not everyone arrives with the same notion of family-work balance. “We’ve been with Go RH for two years. They’re the ones who told us about the Concilivi Seal. We already had a few measures in place, but the firm showed us some new ones, as well as ways of making everything clearer to the team,” explains Nikolas Couture, chef and co-owner of Louise Taverne & Bar à Vin. Management has drawn up a guide to standardize the resources and initiatives offered – a key element in attracting and retaining employees. Training was also

provided to raise staff awareness. This was a must, because out of 15 kitchen staff, three are from Québec. “I hope that more and more restaurants will be awarded this seal, and we hope to inspire others. It may seem complex, but on the contrary, once it’s in place, it makes life a lot easier for managers,” says Marianne

CONCILIVI SEAL

The Concilivi Seal is a family-work balance award that recognizes an organization and the importance it places on the employer-employees relationship. Nearly 140 organizations in Québec hold the seal, including just one in the restaurant industry.

LISTENING AND ADAPTING

“You also have to be realistic: being in the restaurant business is difficult; the hours are atypical and it’s demanding. But it’s important to take care of our teams and our employees and to find a balance,” says Mr Couture, who has introduced a new measure: a schedule of four consecutive shifts (five during busy periods), followed by three days off. An extra week’s paid holiday is also given to a new parent. “It’s little things like that that help the team to stick together, reduce irritation and give us stability,” he says. It’s important for the Québec city restaurant to listen to its employees. That’s why, every year, management adapts the measures based on feedback from the team and repeats a satisfaction survey.

INNOVATIVE AND HUMAN TECHNIQUES

As human resources become increasingly important in the restaurant industry, other means are also being used to ensure staff retention. The ARQ Foundation set up a competition called, Le Collectif, two years ago. Its aim is to encourage and reward teams that are committed to implementing innovative and effective HR practices in order to develop and maintain a dynamic working climate within their establishments. Last spring, Ambre Bistro Bar in Québec City won one of the three $2 000 bursaries up for grabs. The establishment set itself apart by being transparent and listening to its staff. “Solidarity is really an important value for us, and it’s important for our team spirit. The managers are always open to improvements and suggestions from employees”, says Nathan, waiter and moral support at Ambre Bistro. Since then, the workers who receive tips have introduced a systeme of shared tips. It’s a simple solution that enhances team spirit and encourages mutual support.

Another competition winner: the Groupe des rôtisseries corporatives St-Hubert du Grand Montréal. It has adopted new measures for employee schedules. “We’ve developed new ways of implementing working hours to better adapt to new employees. It’s important to show that we

value work-life balance,” explains Gabriel Brault-Pilon, training manager at Groupe St-Hubert. There has also been a complete restructuring of the training department, with a follow-up to facilitate integration.

From a technological point of view, certain human resources measures can also be used. This is the case for Guillaume Ouimet, co-owner of Les Insulaires Microbrasseurs, third winner of the Le Collectif competition: “We use software (Agendrix) to draw up schedules, which makes things easier for management, but also for the employees. In the restaurant business, as we all know, a lot of people

work part-time, go to school, and so on. So this platform helps to take the stress away from the whole team and improves the quality of life in the restaurant.’’

ONE SOLUTION AT A TIME

If changing working hours and technology aren’t for you, there are other solutions that can help you and your team in terms of human resources.

1- You can offer training and professional development opportunities that will enable employees to acquire new skills, develop their careers and see a long-term future within the company.

2- Involving employees in decisions concerning the restaurant’s operations could strengthen their sense of belonging.

3- Set up regular recognition programs to celebrate employees’ achievements and contributions.

4- Offer competitive benefits such as free meals and medical insurance plans (safety group).

5- Investing in quality equipment could make the workplace more attractive and efficient.

By adopting these techniques, you can create a more positive working environment, provide opportunities for growth and strengthen the bond between employees and the company, which in turn will help to retain your workforce effectively. “When you consider that 56% of respondents to the survey would be prepared to change jobs in exchange for better measures to reconcile family and work, you realize that this could be a very good solution to the labour shortage in the sector,” exclaims Gabrielle Gouin, Concilivi Seal advisor for Réseau pour un Québec Famille.

While evening and weekend work are still major components of a restaurant job, it is still possible to reconcile family and work. Steps in this direction will always be welcomed by employees. The labour shortage will remain a major challenge for our industry over the next few years. We have to face up to it and adapt now. The Canadian Tourism Human Resource Council estimates that around 30 000 positions will go unfilled in the Québec restaurant industry in 2030. It is therefore essential to include human resources at the heart of your establishment’s management to ensure that your staff is recruited and, above all, retained.

BACK TO THE POLITICAL FRONT

Keep an eye on these issues

Each year, the end of August marks a return to politics in Quebec, with the National Assembly back at its legislative duties. This means that the ARQ also returns to the political front, defending your economic and policy interests. More specifically, during the last quarter of 2023, your Association will be focusing on the four following issues.

TOWARD THE RIGHT FOR COMPENSATION FROM NO-SHOWS

The ARQ will continue working to stop the problem of no-shows. Currently, under section 13 of the Consumer Protection Act, restaurants are not permitted to establish an advance fee for customers who fail to honour their reservation. Your Association believes that a legislative framework is necessary to enable restaurants to levy a symbolic penalty for no-shows, in order to change the offenders’ behaviour.

TIP SHARING: RESTAURANT OWNERS SHOULD CHOOSE

As you certainly know, it’s still prohibited for restaurant owners to impose, change, or revoke a tip-sharing agreement. However, at the ARQ, we believe establishment owners should be able to determine whether they want a tip-sharing agreement in their restaurant or not. To make the government aware of this problem, your Association has had several meetings with Labour Minister Jean Boulet (see page 14).

EXPANDING THE DEPOSIT PROGRAM: COLLECTION SERVICE TAKES SHAPE

Expansion of the deposit system on containers is a major issue the ARQ is working on. Starting November 1, 2023, restaurants of 75 seats and more will benefit from a collection service exclusively for containers that currently have a deposit. As of March 1, 2025, all containers of at least 100 ml and at most 2 litres will become part of the deposit and refund system. In addition, also starting on that date, the collection service will be extended to all restaurants that have more than 20 seats. Restaurants with fewer than 20 seats will therefore be excluded.

Having succeeded in making this waste collection service free of charge for most of our industry, your Association will now work on negotiating the parameters of the new service with the Quebec Beverage Container Recycling Association.

GOVERNMENT LOANS: A DAMOCLES SWORD

Just three months remain before the deadline to repay loans from the Canada Emergency Business Account (CEBA). As of December 31, 2023, business owners who have not fully reimbursed their loan will lose their eligibility for the grant of up to $20,000. They will also have to pay interest on the remaining balance of their CEBA.

The ARQ, Restaurant Canada, and the Canadian Federation of Independent Business (CFIB) are working together to convince the federal government to postpone the CEBA deadline. The New Democratic Party, the Bloc Québécois, and the Green Party of Canada have all indicated their support for our initiative. Your Association also met at the beginning of the month with federal Transport Minister and Quebec Lieutenant Pablo Rodriguez.

More rules governing youth work

On September 1, a new component of the ActRespectingLabourStandards governing youth work came into effect. The number of hours worked by adolescents aged 14 to 16 is now limited. This new restriction adds to the rules against hiring youth under the age of 14 (except in certain cases), which themselves took effect last July 1.

WHAT ARE THE NEW LIMITATIONS?

- Youth who are under the age of 14 and authorized to work and those aged 14 to 16 can work a maximum of 17 hours per week and 10 hours from Monday to Friday. No restrictions are in place when school is out (e.g., during holidays and spring and summer breaks).

- Companies hiring workers aged 16 and under must also create a prevention program designed specifically to eliminate risks to their physical and mental health.

A reminder that, as previously, young employees must be able to be at their home between 11 p.m. and 6 a.m. They must therefore neither be on the job nor have to travel during those hours.

FINES ARE COSTLY

CNESST inspectors are currently verifying application of the rules and they can fine companies from $600 to $6000, or from $1200 to $12,000 for repeat offences.

Employers are responsible for setting the hours of young workers in their establishments.

Toward faster hiring of temporary foreign workers

On August 8, the federal Minister of Employment, Workforce Development and Official Languages, Randy Boissonnault, launched the Recognized Employer Pilot (REP) project within the Temporary Foreign Worker Program (TFWP). The three-year pilot project will help fill the labour gap, simplify hiring, and reduce employers’ administrative burden.

INDUSTRY REPRESENTATION

The ARQ considers this new pilot a step in the right direction because it gives restaurant operators who use the TFWP regularly an express process for future hiring.

ALMOST ALL RESTAURANT TRADES

More good news is the recognition of the vast majority of restaurant-industry trades: food-service supervisors, chefs, cooks, food

In recent weeks, your Association participated in a new meeting with Labour Minister Jean Boulet to promote our industry’s interests in terms of gratuity splitting, or tip sharing. All partners in the restaurant sector attended. At the same time, the ARQ was involved in Quebec’s consultation on immigration planning (Consultationsurlaplanificationde l’immigrationauQuébecpourlapériode 2024-2027) through its brief describing the restaurant industry’s interests regarding immigration and temporary foreign workers.

In August, your Association also met with the Minister of Economy to discuss productivity in the sector and request

that a financial assistance program be put in place to encourage innovation and performance in restaurants. An ARQ delegation also participated in a consultation by the Conseil du patronat du Québec on the next energy policy.

FEDERAL REPRESENTATION

Last July, following the Trudeau government’s cabinet shuffle, the ARQ sent a congratulatory letter to the new Minister of Tourism, Soraya Martinez Ferrada, reminding her of the various challenges facing the restaurant industry.

A strictly regulated service

Despite the crushing domination of cardbased payments, some establishments offer their customers automatic tellers to withdraw cash. This service is highly regulated and closely monitored by Revenue Quebec. To avoid any unpleasant surprises, including nasty fines as high as $200,000 for non-compliance, be sure to abide by the current regulations.

SQ CERTIFICATION AND PERMIT

The Money-Services Businesses Act requires teller operators in particular, who themselves supply their cash machine, to acquire an annual licence for each teller in their establishment. Each licence costs $252. You must also provide, when applying for a licence,

and beverage servers, counter hands, kitchen helpers, and related support staff. The restaurant sector will be eligible in January 2024.

OTHER MEETINGS

During the summer, your Association participated in the Association Committee of ÉcoEntrepriseQuébec to discuss issues and orientations related to recycling strategies. Within the group of some 15 professional and sector-based associations, the ARQ expressed our industry’s specific concerns about recuperation and recovery. Finally, ARQ representatives also participated in a Quebec Ministry of Agriculture and food-processing industry committee for healthy food (Comitédel’industriedela transformation alimentaire et du MAPAQ : l’offre alimentaire santé). Its goal is to improve the nutritional quality of food sold in Quebec.

ARQ’S 85 TH ANNIVERSARY GALA

You will soon be able to register on our Web site for the AGM and for our 85th anniversary celebrations, which will take place on the evening of November 21 at the Grands Ballets Canadiens, Wilder Building, Place des Festivals, in Montreal. Caution and prevention when using conveyor belts

Last February 21, a worker was seriously injured in an accident in a Montreal bar when using a motorized conveyor belt. When using the equipment, the employee nearly strangled when their scarf got caught between the motorized conveyor and the belt.

Following its investigation, the Commission desnormes,del’équité,delasantéetde la sécurité du travail (CNESST) made recommendations to avoid such accidents, which the ARQ would like to share with the industry.

In cooperation with the CNESST, the ARQ would like to remind you that to preventative

measures must be communicated when equipment is used in order to prevent accidents.

HOW TO AVOID SUCH AN ACCIDENT

There are ways to prevent accidents with motorized conveyor belts, such as:

- Install protectors or protective devices to make the machine’s danger areas inaccessible during operation;

- Wear tight-fitting clothing and tie up long hair.

Accident prevention requires teamwork. The ARQ reminds you that employees

must work as a team with employers to make note of dangers and implement and respect the measures to control or eliminate them.

ALCOHOL CONSUMPTION

Restaurants’ civil liability

Can a bar or restaurant operator with a liquor permit be held civilly liable for the behaviour of an intoxicated customer who was served alcohol in the establishment?

The answer is yes. The owner of a commercial establishment with a permit must work to protect patrons against the foreseeable consequences of the dangerous behaviour of someone under the influence of alcohol, and the owner may be held in part civilly liable.

An establishment with a liquor permit has a double responsibility for prudence in regards to its clientele.

First, bar and restaurant owners must ensure that alcohol is not served in a

quantity that will render a customer drunk or worsen their state of drunkenness; and, second, they must take positive measures to protect such a customer and others from the dangers caused by drunkenness.

OBLIGATIONS

The courts thus impose on restaurant and bar operators an obligation of diligence for the three following reasons:

1. Establishments with liquor permits have the advantage of being able to monitor their customers’ alcohol consumption;

2. Legislation related to the sale of alcohol (such as the Act Respecting Liquor Permits) imposes particular responsibilities on those who profit from it;

3. The contractual nature of the trade and sale of alcohol justifies imposing an oversight obligation.

Evidently, for this liability to apply to a restaurant or bar, it must be established that it tolerated a customer in a state of intoxication, affecting their safety and that of other customers, which led to a harmful event.

Finally, while a drunken customer remains the principal person liable for their actions, to avoid liability a restaurant or bar must stop selling alcohol to the customer.
