Governor George Deukmejian 1928 – 2018 Former Governor Deukmejian died May 8 at his home in Long Beach. We offer our condolences to Deukmejian’s family and friends. Deukmejian was the 35th Governor of California serving two terms from 1983 to 1991. He was a friend of Orange County and AAOC as you can see from the accompanying photo with George H.W. Bush and our own Ray Maggi. Deukmejian once explained that his fundamental principle was “a common-sense approach to running government.” To that point, California could certainly use more leaders like George Deukmejian.

PRESIDENT’S MESSAGE

Because You Can Doesn’t Mean You Should

Y

ou might not agree with what I am about to say and that’s fine.

I will preface my viewpoint with the following truths: I am a property rights advocate and I both believe in and support the free market. I also try to do things right and treat people how I want to be treated. Oh, and in case you are wondering, none of the examples outlined below are in reference to AAOC members. So try, if you will, to maintain perspective as this is an important issue that is having a devastating impact on our industry and could ultimately present us with new and extreme compliance costs, severe regulatory burden and losses in income and value to the tune of billions of dollars.

The Dilemma

Through my leadership role with AAOC, I’ve been contacted on 4 or more occasions this year by City Councilmembers, Assembly members and even Congressmen in relation to rent increases and typically the story goes something like this: a constituent of theirs, usually a long-time resident of an apartment community and paying well-below market rent receives a sizable increase that brings their rents current to market rates. With nothing more than a sixty-day notice, residents were informed of rent increases ranging from $400 to $800 more per month with minimal to no upgrades scheduled to be completed (not a requirement, I know) and just two months to quantify whether it makes sense to stay put or

move elsewhere. Owners who have “banked” or “saved” increases up over extended periods of time actually end up doing more of a disservice to residents who have come to rely on artificially low rental rates. Note to owners: your residents are not setting money aside for the day these increases finally come to fruition; ultimately, none of these residents were able to stay in their apartment homes.

Kindhearted Capitalism Exists

Now, I can’t tell you how to run your business and I know that there are no laws preventing you from increasing your rents from below to at or above market rates. But I can tell you that the people who live in your apartment homes are just like you and me. They work for a living to provide for and support their families and rely on us to provide a quality place to live.

Unexpected increases in rental amounts such as these can stir panic and send families into a frenzy, especially for those in traditional workforce housing and earning at or below 60% of the Area Median Income where most folks live paycheck to paycheck. Would it have been too difficult to break that increase up over 2 or 3 increments or with the additional notice period of 90 days? Would it have been appropriate to evaluate the interior of their apartment homes to identify what if any improvements might be nice or necessary ahead of a potential increase?

the impending rent increase, they can certainly help to remind your residents to be grateful they live someplace where the property owner cares and continuously reinvests in the property.

Your Own Worst Enemy

In my 15 plus years in the business and 10,000 + units of experience, I’ve never seen rent increases like the aforementioned and my guess is that you haven’t either. So when you read about the threat of Rent Control in Santa Ana and the Costa Hawkins repeal at the State level, you should understand that these increases, though mostly anecdotal and not the norm, are happening.

And the fact that they are happening in the increase ranges of 20% to 40% makes it more likely that we could one day be stuck by law with just CPI (currently 2.5% per WSJ) and that wouldn’t even keep up with the growth rates of most operating expenses.

While I advocate for our members and our industry, I am advocating for those who do things the right way. It is my sincere belief that our members here at AAOC do things right. Always be mindful that your residents depend on the shelter you provide and think through the potential impact of rent increases. Remember: just because you can, doesn’t mean you should.

t may seem odd that a column in an apartment provider magazine is titled — “Homelessness”, but please stay with me. Since February, AAOC has partnered with others and the Orange County United Way (UW) to create a program to attack homelessness in our county. Nick Lieberman and I are on the Leadership Council as well as the Rental Housing Working Group.

in late February by inviting leaders from Orlando, Florida to address around 100 OC business leaders. Why Orlando?

Orlando has similar demographics compared to OC as well as a similar homeless population. In a nutshell, the following groups united to attack the problem: business and apartment, faith and social services along with the philanthropic and municipal communities.

These groups worked together and implemented a plan that led to a 60% drop in homelessness with over 3,000 placed in apartments.

Understanding the homeless — Currently OC has nearly 5,000 homeless. According to a UCI study, the OC homeless are mainly long-term OC residents with 68% living in the county for 10 years or longer. They are predominately US born (90%) and 52% are 50 and older. The major factors precipitating homelessness are: lack of jobs/ sustainable wages (40%), lack of affordable housing or evictions or foreclosures (36%), family issues/dysfunction (28%), mental health (17%), physical health (13%) and release from jail (7%). It was estimated that approximately $299 million was spent to address homelessness in OC by governmental and non-governmental entities in 12 months encompassing 2014/15.

So why is AAOC involved with this effort? The biggest obstacle is available housing; with land scarce and vacancy rates at historic lows, finding housing for qualified homeless is a huge challenge.

For instance, it’s estimated there are 183

homeless individuals — including 27 veterans — who already have the necessary paperwork and rental vouchers who can’t find a place to live.

OC apartment owners have the opportunity to play a vital role in solving this problem. The reason Nick and I are at the table is to insure that the final program that’s crafted and implemented will be a success for all parties.

Some of the program features we think necessary to optimize appeal for AAOC members and drive maximum participation in the program are: 1) revenue neutral for owner (market rent paid), 2) rental agreement is a master lease with UW as lessee/guarantor, 3) Support services coordinated through UW available 24/7 to landlords and community managers, 4) occupants have a history of at least one year in a UW facility and deemed stabilized by UW, 5) eliminate the UD process, instead have the ability to remove an occupant in a short time frame (7-days) if landlord determines, after consulting with case manager and support services, that occupant should move out, 6) insurance paid by the U2EH program to cover any and all damages caused by occupants to the unit or building, 7) recognition of apartment owner participants.

The program is still in development but AAOC, as a participant, will have a voice in formulating the eventual final format.

ake a bow, members. Your support of our lobby efforts resulted in a big win for rental property owners.

In the closing days for getting bills out of their house of origin, the top four antirental housing industry bills we lobbied against this year were voted down or substantially amended. TenantsTogether leader Dean Preston described it best in his just released announcement of the defeat: “It was a Bloodbath.”

The four bills are the very same four we lobbied against at this year’s Legislative Day: AB 2925 (Bonta), which would have established statewide “just cause” eviction mandates, resulting in a wild west free-for-all before the courts when tenants began to challenge every reason we would state in our 30- and 60-day notices to terminate; AB 2618 (Bonta), which would have required all rental property owners to take landlord education classes every two years through a new state administered department; AB 2343 (Chiu) which sought to extend the 3-day notice to pay, cure, or quit periods

and the 5-day unlawful detainer tenant answer period to 10 days, proposed to give tenants grace periods to find a new place to rent and require property owners to provide “reasonable accommodation” should a tenant need additional time to relocate; and AB 2364 (Bloom), an attack on the Ellis Act requiring units to be rent-controlled for 10 years after being taken off the market.

While all of the bills initially made it out of their initial committee, none moved past the next stage. Mr. Bonta’s “just cause” bill, which was heard on the Assembly Floor received just 16 votes of the necessary 41 to pass, while his landlord education bill died in the Assembly Appropriations Committee. Mr. Chiu’s bill was gutted and amended to remove the most egregious new changes in the unlawful detainer process in favor of simply excluding weekends and holidays in tabulating the 3-day notice periods and the 5-day answer period. Bloom’s bill attacking the Ellis Act only received 27 votes of the 41 needed to pass.

The fight is not over though. Every year legislators find new and creative ways to attack the rental housing industry. The attacks are more extreme in nature and are coming at a pace unseen in recent years. Tenant causes may also be gaining momentum across the state as California continues to struggle to provide affordable housing. Then there is the big Costa Hawkins repeal statewide ballot proposition organized by Michael Weinstein which is headed to the November 2018 ballot.

Our recent victory is tribute to the hard work of members who came out on Legislative Day, and when asked via RED ALERTS, made calls to their legislators asking the Assembly Member to vote NO. Take a bow, members.

When our message is clear and focused, and when rental property owners use their collective voices to be heard, our industry can win. Let’s continue fighting for the rights and health of our industry as new challenges arise.

I

t’s always something with one particular tenant of mine. When he first moved in three months ago, he deducted about one hundred dollars from the rent because he said he had to fix a few things in the unit. I didn’t say anything at the time, I needed the unit rented, and I didn’t want to upset my new tenant. Since then, he has been able to find something wrong each and every month, deducting a little bit each month. I told him I didn’t think that was right, but he did it again this month. He says he is entitled to, that California law says he can “repair and deduct” for anything wrong in his apartment. Is this true?

No. California law, specifically California Civil Code Section 1941.2, provides that a residential tenant may make repairs and deduct the cost from the rent only under certain circumstances. These

certain circumstances require the tenant to give the landlord notice of the dilapidation before using the repair and deduct remedy. After giving notice, the landlord has a “reasonable time” to make the repairs, before the resident can unilaterally “repair and deduct.” Only defects that render the premises uninhabitable will qualify for this remedy.

Tenants may only invoke this remedy twice in any twelve-month period, and each time the remedy is utilized, the tenant cannot exceed one month’s rent.

In your situation, it appears that the tenant is abusing a privilege only available to tenants with serious dilapidations in their apartments. Without providing notice to you of the defect, and an opportunity for you to correct any serious defect, the tenant is not entitled to deduct anything from his

rent. Provided you haven’t condoned his conduct or waived your rights to accept the full amount of rent, you may demand that the tenant pay all amounts previously deducted and become current.

My tenants and I seem to be able to work out our differences quite easily, but there are times when we disagree as to just who is responsible for making certain repairs to the apartment. Can you give me some guidelines that will help me decide if the repairs are my responsibility or the responsibility of the tenant?

Residential rental units must be “habitable.” In legal terms, “habitable” means the rental unit is fit for persons to live in and that it substantially complies with state and local building and health

codes that materially affect a tenant’s health and safety. The law makes both landlords and tenants responsible for certain repairs, but you are ultimately responsible to ensure the unit is habitable. You are not responsible under the “implied warranty of habitability” for repairing damage caused by the tenant, his guests or his pets. You are responsible to take care of the habitability items, but your rental agreement can determine who takes care of the minor repairs. California law lists several items that are required to maintain a habitable unit, these are effective water proofing and weather protection, including unbroken windows and doors; plumbing in good working order, including hot and cold running water connected to a sewage disposal system; gas facilities, heating, and electrical in good working order; clean and sanitary buildings and grounds; adequate trash receptacles; floors, stairways and railings in good repair.

Additionally, each rental unit must have a working toilet, washbasin and a bathtub or shower, operable dead bolts on the main entry doors, window locks, and smoke detectors. A landlord is also responsible for the installation and maintenance of the inside wiring for one telephone jack. Tenants must take reasonable care of the rental unit and the common areas. Tenants are responsible for repair of all damage resulting from their neglect, abuse, or acts by their family, guests or pets. Tenants must do all of the following: keep the premises “clean and sanitary,” use and operate gas, electrical and plumbing fixtures properly; dispose of trash and garbage properly, not destroy, damage or deface the property, not remove any part of the structure, dwelling, facilities or equipment, must use the premises as a place to live, and use the rooms for their intended purpose, and notify the landlord when dead bolts and window locks don’t operate properly.

I have a problem in one of my rental properties. The property has parking below the complex for the residents. Apparently, due to the rains, a leak occurred in the ceiling of the garage. The water collected in one of the ducts, becoming quite dirty and rusty.

This water then leaked down onto a resident’s car. As it turns out, the car’s rear passenger window was cracked open and the water leaked onto several of the tenant’s personal belongings. Needless to say, the tenant threw a tantrum in the management office the next day. I apologized profusely and offered to have her car washed and detailed. She accepted.

However, the next month, this tenant’s rent was $175.00 dollars short. Along with the rent, the tenant included a letter stating that she had deducted the cost of the damage to her personal belongings. Can the tenant do this?

No. A leak onto the automobile of a tenant has nothing to do with the tenant’s obligation to pay rent. As such, the tenant may not deduct these items from her rent. You would be within your rights to serve the tenant with a 3-Day Notice to Pay Rent or Quit for the $175.00 difference. As far as the damage to her personal property, the landlord is generally not liable for the tenant’s personal property unless the landlord was somehow negligent.

I am an owner of several complexes. All of the on-site managers have different “theories” on what to do with a tenant’s personal property when the tenant vacates. I know that there is a duty to safeguard the personal property but could you please tell me the procedure and duration of my duty to store a former tenant’s personal property?

If, however, the tenant vacated following the enforcement of a writ of possession, you must allow your tenant fifteen (15) days to claim the property. The property must be kept in a reasonably safe place but does not have to be stored in the leased premises. If the property left behind is less than $700.00 you may dispose of it after the above required time periods. However, if the abandoned property is worth more than $700.00 in fair market value, you must sell the property through a public sale.

This requires you to publish the date and time of the sale in a newspaper of general circulation once a week for two consecutive weeks, with the sale the following week. If the tenant returns to claim the property, you must return it, but you can charge reasonable storage fees. Be aware that you may not hold the property as ransom for the rent owed, even if you have a judgment.

Dear Maintenance Men:

I have just repaired another slab leak.

Turns out the problem was the hot water recirculation line. I’m trying to decide if I should just abandon the line and remove the circulation pump and be done with it. What harm can it do? Do I really need a hot water return line for my residential units? John

Dear John:

First, let us demystify what a return line really is. Simply, it is a dedicated hot water line which loops from the water heater to the furthest unit, and back to the cold water heater inlet. Its purpose is to maintain hot water at each tap by assistance from the circulation pump.

The circulation pump constantly delivers hot water through the return line or loop.

A slab leak is a water line break under the concrete floor of a building. A water pipe under a concrete floor can leak for a long time before it is noticed or it can bubble up through cracks in the con-

crete depending on soil conditions. The most reported type of slab leak is on the hot water side of the plumbing and along the return line of the recirculating system. The reason for the return line being the most popular leak point is because the water never stops moving and it wears away and corrodes the pipe.

We do not recommend canceling the return line and removing the pump. This will cause other unintended consequence such as a slow delivery of hot water to many of the units in the building. The lack of a pump will waste water while the residents wait for hot water to come out of the tap; which in turn will make the water heater work harder. Not only will this annoy the residents, it will cause the water heating bill to go up.

As for repair of the return line, there are a number of solutions. If the return line has chronic leaks, it is best to run a new line outside the slab. The old return is canceled at the pump and

the furthest plumbing fixture in the building and the new line installed and routed back to the water heater.

Another solution after the pipe is repaired is to limit the incoming water pressure with a pressure regulator and put a timer on the recirculation pump to operate only at peak demand times such as morning and evening. Installing a water softener system will also help keep both the hot water heater and water lines from corroding as quickly.

This is why a second opinion is always encouraged or necessary. My multi-unit property has washer and dryer hookups in each unit. One of my residents has installed a new fancy front-loading washing machine and now the pipes are banging. This did not happen with the regular top loading machines. Not only is the noise annoying, but also, I am worried this might cause a water line break. Maintenance — continued from 13 I don’t want to tear into the walls, so what can I do to remedy the pipe banging issue? Victor

Dear Victor:

The reason for the pipe hammering is because of a rapid opening and closing of a water valve. Most washing machines and dishwashers use a fast acting solenoid to control the water valve. The water starts and stops very suddenly causing the pipes to move. The new popular front loading washing machines also use a solenoid to control its water valves, but they open and close many times during the cleaning cycle, so the hammering is more noticeable and damaging. The simplest and least expensive remedy is to install what is called a “Mini-Rester” laundry hammer arrester. The “Mini Rester” is installed either at the washing machine’s hot and cold valves, or directly to the

back of the machine’s inlet nipples. The job can be done in the time it takes to un-screw the hose from the hose bib or machine and reinstall the hose back onto the machine or hose bib with the Mini Rester in between. These hammer arresters can be found at any hardware store and should be about $20.00 each.

You will need one for the hot-water side and one for the cold-water side.

The “Mini Rester” is designed as a single fixture remedy. If the problem continues, a larger water hammer arrester will need to be installed.

New Regulations Require Disclosure of Energy Use in Certain Buildings

O

n March 7, 2018, the California Energy Commission (CEC) implemented the regulations behind California Assembly Bill 802 (AB 802). AB 802 directed the CEC to create a statewide building energy use benchmarking and public disclosure program for buildings larger than 50,000 square feet. The following is what you need to know about the new regulations.

What is a disclosable building?

• Any commercial building over 50,000 square feet, or • Any residential building over 50,000 square feet that has more than 17 residential utility accounts

What are the exceptions to the disclosure requirements?

The following buildings are not subject to disclosure requirements: • A building in which more than half of the gross floor area is used for scientific experiments, manufacturing or industrial purposes; • A building that did not have a certificate of occupancy or temporary certificate of occupancy for more

than half of the calendar year for which reporting to the CEC is required; • A building scheduled to be demolished one year or less from the required reporting date; or • A building that complies with the applicable local energy disclosure program implemented by the local jurisdiction and approved by the CEC.

What must be reported to the CEC?

All owners of a disclosable building must establish an Energy Star Portfolio Manager account. The owner of a disclosable building with more than three active utility accounts must do the following: • Request energy use data for the building from the utility company and upload it to the owner’s Energy Star Portfolio Manager account (this will typically all be done through the Energy Star Portfolio Manager account interface); and • Complete the reporting steps in the Energy Star Portfolio Manager account interface.

Are there different rules for owners of buildings with fewer than three utility accounts?

Yes. Building owners must first receive the permission of each utility account customer before uploading and reporting the energy use data for the building. Permission may be granted through a provision in a lease or through any other written means, so long as it also permits public disclosure of the information. If any utility account customers do not provide the necessary permission, the building owner will be required to report energy use data according to a modified process that is outlined in the Energy Star Portfolio Manager, and the data will not be publicly reported. Building owners may also request that the executive director of the CEC determine that the building owner’s energy use data is proprietary information, if (i) a building owner owns a utility account within the building, (ii) the building has fewer than three active utility accounts, and (iii) the other utility account customers within the building consent to reporting the energy use data of the building.

If the executive director grants such request, the building owner will report

the building’s energy use data through a modified process and the data will not be publicly reported. If the executive director denies the request, the building owner will be required to report the building’s energy use data through the standard procedure and such data will be publicly reported.

How Does Your Laundry Operator Stack Up?

What must be reported to tenants?

Nothing must be reported to tenants.

What are the reporting deadlines?

Energy data must be requested by March 1 of each year. Energy data must be reported by June 1 of each year. Owners of commercial disclosable buildings will be required to report energy data to the CEC by June 1, 2018, and annually thereafter. Owners of residential disclosable buildings will be required to report energy data to the CEC by June 1, 2019, and annually thereafter.

What are the penalties for noncompliance?

The CEC may impose civil penalties if the offending party has not cured a violation after 30 days’ notice. The civil penalty will be at least $500, but no more than $2,000, for each category of data the person did not provide or fraudulently provided and for each day the violation has existed and continues to exist.

Opportunity Zones: A New Tax Incentive for Existing Capital Gains Deferral Investing in Opportunity Zones allows real estate investors to defer or eliminate short-term and/or long-term gains on the sale of real property or other similar investments.

T

he $1.5 trillion federal Tax Cuts and Jobs Act was enacted in December 2017, and an important but little-known provision was included that presents the potential for profitability for real estate investors, developers and professionals nationwide: the ability to designate certain census tracts as Opportunity Zones.

Under the new law, Governors from each state can designate up to 25 percent

of census tracts that either have poverty rates of at least 20 percent or median family incomes of no more than 80 percent of statewide or metropolitan area family income. There are 3,516 census tracts in 54 California counties that qualify under one or both of the criteria.

California’s Governor designated 879 tracts, and the U.S. Department of the Treasury certified all 879 of them.

These tracts are now designated as

Qualified Opportunity Zones under Internal Revenue Code (IRC) Section 1400Z-1(b)(1)(B).

This is great news, as Opportunity Zones are intended to incentivize growth in these underdeveloped, povertystricken neighborhoods through longterm equity-investment development.

Each of the designated locales is eligible for three tax benefits under the new law: • Permanent exclusion of taxable income on new gains. For investments held in an Opportunity Fund — the investment vehicle that makes investments in Opportunity Zones — for at least ten years, investors pay no taxes on capital gains produced through their investment. In other words, after ten years, the taxpayer’s basis is equal to the fair market value of the fund investment as of the date it is sold or exchanged.

• Basis step-up of capital gains invested. Capital gains placed in Opportunity Funds for specific, predetermined lengths of time deliver lucrative predefined increases to the investors’ basis; 10 percent for investments of at least five years, and 15 percent for investments of at least seven years.

• Temporary deferral of taxes on capital gains. Investors can place existing assets with accumulated capital gains into Opportunity Funds.

Those capital gains will not be taxed until the end of 2026, or on the date when the asset is disposed.

Together, these tax benefits create immense opportunity for future real estate investment. At least 90 percent of an Opportunity Fund must be invested in a qualified Opportunity Zone, and Opportunity Funds can finance a variety of endeavors (with a few exceptions) including commercial and industrial real estate, multifamily properties, housing, infrastructure and current or start-up businesses. For a real estate project to qualify, the investment must simply ensure that ‘substantial improvements’ are made to the property, such as upgrading existing facilities or building on available land.

The benefits of the Opportunity Zones section of the new law also present the potential for tax-free treatment of future real estate appreciation, specifically affording opportunities for infrastructure and finance projects. If an

investment of existing capital gains is held in an Opportunity Fund for ten years or more, for example, the appreciation on the initial investment would not be subject to taxation upon disposition or sale of the Opportunity Fund interest. This means that, if a multifamily developer invested $20 million in an Opportunity Fund that invests in a qualified Opportunity Zone property and the investment appreciates to $35 million over a ten-year investment horizon, the $15 million of capital gains would be tax free.

To take the best advantage of the situation, investors will benefit when the underlying assets, real property or business investments are subject to rapid ten-year appreciation. Because of this, utilization of Opportunity Zone financing with structured leverage may result in substantial tax-advantaged appreciation concerning traditional real estate investment models.

While these incentives could become the nation’s largest economic develop-

ment program, their potential for positive impact first depends on the decisions of America’s Governors.

Among all the low income population census tracts designated eligible for the program, state leaders are able to choose 25 percent — or 25 tracts in states with fewer than 100 tracts that qualify — of them as Opportunity Zones. Though many states received several extensions, the original deadline for zone designation was March 21, and the process is slowly wrapping up nationwide.

• How the signing of the deed is executed may also vary. Some states require a witness and/or the attendance of a notary. Be sure that you know and understand the requirements before you start signing.

• Recording the deed with the local county clerk is another important, yet often overlooked, step. Check the local county recorder’s office website for information on how to record the deed and what fees must be paid.

And, when in doubt, call the county recorder’s office and ask questions.

• There may be additional compliance requirements regarding consideration paid or acknowledgement in order for a deed to be deemed legally binding. Again, consult with an attorney licensed to practice in the state and/or municipality where the property is located.

outine maintenance is anything but routine! Our May General Membership Meeting offered attendees a chance to learn just that, from a panel of experts in the field of maintenance.

Our evening began with President, Nicholas Dunlap thanking our sponsors for the evening, Chase Commercial Multifamily Lending — Team Schweer, represented by Cooper Dodd; McCarthy Roofing represented by John McCarthy; PRC Restoration, represented by Freddy Rodriguez; and last but not least,

He also mentioned there is a new rubberized membrane underlayment that has revolutionized the industry and replace the 30# paper of yesteryear.

Jaime Dabbs-Ball spoke on the topic of a management company perspective.

She said that sometimes it is hard to deal with vendors that are not doing a great job and how you should handle the entire situation. She said it is important to look for certain attributes in a vendor and always consider 3 in any job. If you stay current on new maintenance products and services, it will possibly save you money, so always be researching new ideas, every chance you get! She also gave some tips on how

to make sure you don’t exceed your monthly or yearly maintenance budget numbers by being involved and maintenance savvy.

The panel was applauded for their detailed explanation of their respective fields, as well as providing excellent tips and tricks for owners and landlords.

There were some lucky winners in attendance too! Each one holding a raffle ticket, Frankie called them to claim their prizes. Freddy with PRC Restoration gave away an Amazon Echo! As always, we thank our PSC members for attending and providing some of the best prizes!

How to Plan a Retirement Timeline

R

etirement planning can be challenging, but creating a timeline can help ensure your savings stay on track. Here are some expert tips for helping to ensure your retirement plans are on schedule at every stage.

Set an income goal—and know that it could change. For younger workers, it can be difficult to determine how much income will be needed in retirement and how much their income will increase over their lifetime. Many people start out looking at an income replacement ratio of around 80%. That said, when you’re younger, 80% of your income is not going to be close to 80% of your income at retirement. That will change over time.

It’s important to set goals early in your retirement planning process. But be prepared to revisit them frequently as you get closer to retirement—and work with your financial advisor to make your goals as realistic as possible.

Plan to increase your savings rate.

If you’re 20 years old, a savings goal of 10% of your current salary per year is a

good start. By age 30 you should be putting away at least 15% per year.

If you have access to a qualified employer-sponsored retirement plan (QRP), such as a 401(k) or 403(b), start there. If your employer offers matching contributions, consider contributing at least as much as the match. This is free money you don’t want to pass up, and it can help you get to the right percentage.

At the same time, consider a Roth IRA or, if available, the designated Roth account option in your 401(k) for their potential tax-free distributions.

Your savings rate should increase as you age; at the same time, you should explore additional investment options so you’re getting the most benefit now and when you’re in retirement.

Sketch out how long you could be in retirement. When creating a retirement timeline, one of the most difficult factors is estimating how long you can expect to be in retirement. We suggest planning for 20 to 30 years but strongly recommend a contingency plan in case something forces you into an unexpected

early retirement, such as health problems, perhaps, or an unforeseen layoff.

One way of thinking that can help you get there: Plan to retire at age 55.

This will allow you to be prepared for unanticipated events, and any money you make by working past that age will be a bonus.

Set the steps to reach your goals. If you’ve gotten a late start on retirement planning, or if you’re rethinking your timeline around a plan to retire at age 55, there are effective actions you can take now to help pursue your goals.

Keeping a budget is essential. As part of that budgeting, be sure to look at your discretionary spending. If you’ve been supporting children through college, once they become independent, it might be tempting to reallocate that money to exotic travel or home renovations—but it’s your retirement fund that should get the first deposit.

Temptation in the Marketplace

Q

uestion to Mr. and Mrs. OC Apartment Owner: If you could sell your property today for 16.11 times annual gross scheduled income would you give it serious consideration?

I know, you’ve already had six brokers call this month asking a similar question, some suggesting perhaps even grander GRM’s might be achievable (and they might be right!).

The 16.11 Gross Rent Multiplier serves as a decent ballpark value gauge at this time because, as reported by CoStar (see attached chart), that is the most recent quarterly countywide average GRM for 5+ unit apartment sales, marking another record GRM for the county. OC’s previous record for a quarterly GRM had been 15.66, set a quarter earlier—Q4 2017, which itself broke the previous record of 15.47 set the quarter before that (Q3 2017).

The March to Higher OC GRMs

The post-recession aggressive growth in OC GRMs looks like this, as reflected in Q1 results from 2010 through 2018:

The numbers show a 52% spike in the value of the OC rental housing dollar from 2010 to 2018. And that, coupled with steady growth in rent levels in that eight-year span explains why your apartment is now about double its 2010 value (the low point for post-recession property values).

To be clear, of course, this remarkable post “Great Recession” run up in multifamily values is by no means exclusively a local phenomenon. OC is merely one piece of a larger nationwide mosaic of surging rental housing values.

Though it should be pointed out that Orange County units have always traded at a significant “GRM premium” over the national GRM average. OC averaged a 12.93 GRM for Q1’s from 2010 thru 2018 versus a 11.18 GRM average for the nation as a whole.

But getting back to the original question, given the tremendous buildup of equity in rental housing property, is this in fact a propitious time to take chips off the table, i.e. sell?

Some will simply elect to cash out their considerable apartment equity and pay their taxes.

But, most investors contemplating sale ultimately need to determine if reinvested sale proceeds will beat the monthly income they’re now getting.

Otherwise, why sell?

If a larger monthly check is projected from the next investment, does it come with any risks? Is the investment tied up, or illiquid for any particular period of time? And what amount of time is required, if any, to manage the next investment?

So far, the fabulous prices being paid for apartments have not led to selling stampedes. OC apartments sales have averaged ~200 per year since 2014, above the moribund recession years when sales languished in the low 100’s per year, but still well below the full throttle years from 2000–2005 when roughly 400 apartments traded hands annually.

For many OC multifamily owners, it’s hard to find a better asset than the one they have now. The economy is good, unemployment is low, affordable housing is in short supply and a bit more inflation, government blessed this time, may even be in the offing, all of which would seem bullish for residential income property values in the short term, and all of which, also, is baked into those 16.11 GRM’s.

However, selling OC units now to acquire units elsewhere, perhaps even outside California, could make sense for those with a taste for more adventure. Such a maneuver may have more potential upside, and more risk as well.
