The Property Management Component

H

ow important is it? Loaded question. Obviously, property management is vital to apartment ownership and directly and significantly impacts return. This applies to small and large properties, whether self-managed or fee managed. We’re talking about the operational/ business side of a rental housing investment: The interface with the tenant, the maintenance of the property, the bill paying and bookkeeping, the regulatory compliance, the vendor relationships, the market research, etc. Strong and savvy management skills are difference makers in good as well as leaner periods. That said, we note, of course, that there are certain cash flow impacting matters, such as market rents, that are beyond the control of property management. Compare Orange County apartment rents in the two holding periods below (per RealFacts, in buildings of 100 units or more). Sure makes management easier if you catch the right time within a cycle, as the above charts demonstrate. The great recession of 2008–2009

(and its effects through 2010) humbled virtually all investors. Thank goodness 2011–2013 came along and made us all look smart again as rent increases returned. So where can property management actually affect a property’s income and expense and potentially enhance cash flows? AAOC board member and current treasurer, Nicholas Dunlap, deals with this question every day. He manages eight properties in three western states totaling about 3,000 units for Ann Arbor, Michigan based McKinley, Inc. Some areas he sees where management skills can be a factor:

Management perspective can be key; sometimes apartment owners become overly risk averse based on emotion (versus financial analysis) or fall into a rut regarding their properties; management that oversees a broad range of properties may have the perspective to spot and effectuate more profitable strategies for a property in an evolving marketplace;

Some larger managers bring economies of scale to product and service costs due to volume orders; this may translate to somewhat lower operational costs for properties managed;

According to NAA Statistics, more than 100 million Americans rent and up to half of all new households formed this decade could live in rental housing. Everything that happens on Capitol Hill can impact our ability to meet this demand for apartments, so it’s critical that Congress understands and appreciates the apartment industry’s unique needs when it comes to housing finance reform, tax reform or any number of policies under consideration. At AAOC, our focus in Washington DC was thoughtful housing finance reform, smart immigration reform, and changes in fair housing interpretations. With the help of NAA’s Greg Brown, who’s monthly column Federal Focus appears here in Apartment News Magazine, we were able to meet with many members of our own Orange County Congressional Delegation. In our meetings with lawmakers, we talked about plans to develop housing finance reform legislation that ensures capital is available in all markets at all

times and includes a federal guarantee for multifamily mortgages, whether or not Fannie Mae and Freddie Mac are maintained. According to the National Apartment Association research, the bursting of the housing bubble exposed serious flaws in our nation’s housing financial system. Those shortcomings however were mostly confined to the residential home mortgage sector (that certainly was the case in Orange County). Fannie Mae and Freddie Mac and their multifamily programs were not part of the meltdown. According to recent data, those multi family programs generated over $14 billion in net profits to the U.S. Treasury since placed into government conservatorship. Immigration reform is a national issue but nowhere is the negative impact of the absence of reform felt more than in Orange County. We urged our federal representatives to enact step by step immigration reform to address the current patchwork of state and local laws that impose N E W S

additional responsibility on apartment firms to verify the immigration status of employees and apartment residents beyond federal requirements. The issue of Fair Housing rule interpretation will be discussed in later columns, at issue for Orange County apartment owners and managers is that under the current HUD rule, neutral and common business policies such as occupancy limitations, background screening, and Section 8 policies could trigger discrimination claims despite no intention. This needs some attention and a common sense solution. The apartment industry contributes substantially to the housing market and the economy at large. We strengthen communities and grow local businesses. In fact, apartments and our residents support more than 25 million jobs across the country. That is a great message to send to our federal lawmakers. And, I believe hand delivered by your AAOC LEG Team, that message was well received. n

N

otwithstanding the perils and obvious shortcomings of reporting accurately on future events before their occurrence, one may at least speculate about a probable scenario that illustrates significant societal and political differences. As you read this article on or about May 1, consider what that date has meant in past and likely future events. Who can forget the awesome display of arms marching and rolling in Red Square versus the civics lessons learned in Law Day events held throughout the United States? May Day means different things to different societies. International law is much in the news these days, just as is the constant ebb and flow of legal and policy differences that permeate our own representative democracy. From city councils to legislative chambers throughout the country the debate regarding the appropriate line to draw between competing interests is the

their staffs. The date chosen for this event coincided with committee hearings taking place on significant measures of particular interest. In fact, one of the major bills targeted for discussion (SB 1439) was scheduled for hearing on that same date. Results will be known and reported later if a hearing is in fact held. The fluid nature of the legislative process often results in last minute schedule changes, a reminder how quickly things may change. Legislators meet regularly with a variety of constituent groups to discuss many diverse issues throughout the year. The time made available for this activity in Sacramento is constrained by many other responsibilities involving committee membership and ongoing hearings on their own bills. Hence, a few minutes with each legislator to hit the high points on a few bills is about all one can expect. We commend our

fodder for endless discussion. Two bills highlighted in last month’s article (SB 1439 and AB 2405) set the stage for consideration of the extent to which government may regulate rental property ownership. If all goes as planned at this writing an AAOC leadership team will have met in Sacramento on April 8 and 9 with fellow leaders from other regional associations affiliated with NAA. The purpose of these meetings is to meet with their respective legislators on important bills affecting the rental housing industry. Led by AAOC President Nick Lieberman and Legislative Committee Chairman John Tomlinson, the group is expected to include AAOC Board Members Alan Dauger, Rick Roshan, Director Emeritus Ray Maggi, and newly installed Executive Director Lou Rossetti. Major bills of significant interest are the topics for discussion with legislators and

Orange County legislators and their staffs for being gracious with their time and attention to the positions articulated by the group. AAOC and other local associations oppose each of the two major bills (SB 1439 and AB 2405, both reported chosen for discussion at this event. Why these two? In relative terms, it is a choice of picking a few really, really awful bills from among several other bad bills that affect the housing industry. There also is the issue of scope, that is, are we targeted alone or just swept up in a larger universe? And, if we are the targets, how pervasive is the circumstance? Also, can our position be explained and easily understood without lengthy commentary? With these characteristics in mind, consider the two primary measures targeted for discussion this year. The juxtaposition of government control versus individual choice could hardly be more stark than that posed by San Francisco housing policies. As

once noted by U.S. Supreme Court Justice Felix Frankfurter, “On the question you ask depends the answer you get.” Former California Supreme Court Justice Stanley Mosk quoted that truism to begin his dissenting opinion in a landmark decision upholding the kind of stringent control now under consideration in Sacramento. Thus, he continues, “If the question is whether a municipality may exercise its police power to reasonably regulate the rental business, the answer is, generally it may do so. But if the question is whether a city may compel a landlord to remain in business against his will, and give him only the alternative of a forced sale, the answer is: not in a democratic society.” Suffice it to note that our representatives are armed with cogent reasons for opposing both measures that impose lasting obligations upon rental housing owners in San Francisco. Why should we care? As a matter of rock solid principle, no one should be forced to remain in business against

his or her will. Certainly, no other business is constrained with such obligation. Nor should government create unrealistic barriers to pursuit of alternative uses of one’s property, including personal occupancy. In short, if it can happen in San Francisco it can happen anywhere. Legal Corner — Questions & Answers BY ST E P H E N C . D U R I N G E R , E S Q .

I

own an eight-unit apartment building in Long Beach. Recently, I had to start an eviction of a tenant for not paying their rent. It was pretty unfortunate, because we had enjoyed a professional relationship for the past three years. Anyway, the tenant fell on hard times, and I had to get him out. My wife Cathy served him with a 3-Day Notice to Pay Rent or Quit on a Friday. Luckily, he moved out over that weekend. Everything seemed fine and dandy until I went down to the underground garage. Well he left a massive pile of old VW Van parts in the downstairs parking spot. The value of the property is approximately $500.00. Cathy says that the parts can just be thrown away, because he no longer lives at our building. Is she right?

Unfortunately, Cathy is mistaken. You are now faced with a situation of abandoned personal property. First, you need to send a Notice of Belief of Abandoned Personal Property to the last known address of the debtor. The Notice is a pre-printed form, and can be obtained from your Apartment Association. Then, you must store the property for a period of 18 days (15 days if you personally serve him with the notice), though not necessarily in the parking space. The tenant can reclaim the personal property by paying any storage fees, and picking up the property within the 18-day period. Since, the value is less than $700.00, you can throw the old parts away after waiting the proscribed 18 days. However, if the value was in excess of

$700.00, you must sell the old parts at a public auction. After the sale, you would deduct your expenses, and the remainder is deposited with the County Treasurer’s Office. In your case, you will be able to dispose of the property after 18 days. (No offense to VW aficionados).

I have the misfortune of a classic problem tenant. The noise, the parties, the trash… I don’t even know where to begin. Also, she’s paid her rent late for the past three months. The lease has a late fee provision that charges $50.00 if rent is not received by the 5th of the month. Because of this, she’s been paying both the rent and the late fee well into the second week of the month. Last month, the first of the month

fell on a holiday. So I served her a 3-Day Notice to Pay Rent or Quit on the 2nd or should I have waited until after the 5th to serve the Notice?

If rent is due on the first of the month, and the first of the month falls on a weekend or a holiday, the tenant has until the first business day of the month. The rent is considered late the following day. For example, if the first falls on a Saturday, the rent will actually be due on Monday the third, and will be late Tuesday the fourth. In most instances, the specific language of your lease will govern the issue of when late fees accrue. On one hand, some leases have clauses that define when rent is late. If your lease states that “rent is due on the 1st of the month, but will be considered late if not paid by the 5th,” then your lease defines when rent is late, and you may properly serve a 3-Day Notice to Pay Rent or Quit on the 6th day of the month. Conversely, other leases establish time periods before late fees kick in, but do not define when rent is late. For example, if your lease states “rent is due on or before the 1st of the month, and if not paid by the 5th will result in the imposition of a late fee of 6%….,” then the clause is merely establishing the time period for the imposition of a late fee. In this second scenario, you may serve a 3-Day Notice to Pay Rent or Quit on the 2nd of the month (provided the 1st falls on a business day).

I live in Redondo Beach, real close to the pier. I live in my dad’s building, and I guess you could call me the manager. When my surfing schedule allows, I collect rent, make repairs, and generally keep an eye on the place. Last month, I had to serve my first 3-Day Notice to Pay Rent or Quit. The April rent is $2,000.00, and the tenant only came up with $1,000.00. So, I served him a 3-Day Notice for $1,000.00, for rent due from April 16 to April 30. Luckily, he brought the keys in, and we haven’t heard from him since. I’m now talking to a new manager to take over the position. Could I have him sign an agreement that says he has to be out of the apartment within a week if he’s terminated?

Yes. As a general rule, monthly rent is a sum due for a whole month of tenancy. The remaining balance of $1,000.00 is due for the entire month, not a prorated portion. Any payment received should not be accounted or prorated to specific days, but should be applied toward the total monthly installment due. Thus, the remaining balance of $1,000.00 is for the period of April 1 through April 30. Although your notice is not technically defective, it infers that the rent is not due until April 16. In addition, errors are commonplace when you try to prorate the rent on a Notice. For these reasons, you’re much better off to serve a Notice for the $1,000.00 due for the entire month of April.

Agreements between owners and their on-sight managers should always be in writing specifying the terms of the relationship and the rights and responsibilities of the parties. Your agreement can thus provide the on-site manager with a short period of time to find a new residence if necessary, but that decision is yours to make. California law does not require that you allow the ex-employee to remain in the unit for any period of time following termination. Absent an agreement to the contrary, California law requires the employee to vacate immediately upon termination.

One of my former tenants took me to small claims court over her security deposit. She claims that I was unreasonable in spending all of it, because she claims she had a cleaning crew come through the place before she moved out.

A small claims appeal is basically a “do over.” It is a new trial, a trial de novo. By and large, the proceeding is essentially the same. However, on a small claims appeal, as opposed to the initial small claims proceeding, you may have an attorney represent you. In your situation, if you’re afraid that you might lose your temper again, call a lawyer who will talk about the case with you. Of course, there are times when it’s simply more cost effective to “go it alone,” when the amount you’re fighting

over is less than the cost of retaining counsel. If this is the case for you, and you really feel that you were not treated fairly in the small claims court, then appeal the decision. Just remember to take a deep breath out in the hallway.

Well I don’t know if she used a cleaning crew or a wrecking crew, because the place was trashed. Anyway, the Judge in the small claims court apparently liked her, and I guess I lost my temper at the hearing. When all the smoke had settled, the judge ordered me to pay her! The little paper says that I have time to appeal this decision if I want to. I basically wanted to know what happens in the event of an appeal, and whether or not I could have a lawyer handle it.

M

arch was a big month for two of the top federal legislative issues that could impact the apartment industry’s future – housing finance reform and tax reform. In each case, a long-anticipated legislative proposal was released by a committee chairman. Neither one has universal support at the moment and both have their critics. The outlook for one is much, much brighter than the other

but still faces significant hurdles. Regardless of the ultimate outcome for either one, they will both shape certain parts of the debate going forward this Congress or even into the next.

Ranking Member Mike Crapo (R-Idaho) (pronounced “cray-poe) introduced their version of housing finance reform legislation. Drawing heavily from advanced spadework by Sens. Mark Warner (D-Va.) and Bob Corker (R-Tenn.), this bipartisan legislation balances the universally held goal of ending Fannie Mae and Freddie Mac as we know them with maintaining the federal government’s appropriate role to ensure sufficient capital exists to finance multifamily (and single-family) housing. While there are still details to be worked out, we like the bill. It explicitly acknowledges the importance of a separate solution for multifamily versus single family and lays out a plan accordingly.

First, it has drawn the ire of civil rights groups like the National Council of La Raza, the National Fair Housing Alliance and the National Urban League for not providing enough access to credit for people of color and families with moderate to low incomes. Second, to have any chance of passing on the Senate floor, the bill needs a strong vote out of the Banking Committee —

not an easy lift when both progressives and conservatives on the committee have concerns with the bill. Finally, many of the conceptual underpinnings of the Johnson-Crapo legislation — eliminate Fannie and Freddie but maintain a federal backstop, implement a separate multifamily solution — are completely opposite from the approach that House Financial Services Committee Chairman Jeb Hensarling (R-Texas) took in his bill, the Protecting America’s Taxpayers and Homeowners (PATH)

Act. That could complicate HouseSenate negotiations significantly. Aside from the policy hurdles above, there are political speed bumps as well. With the GOP very close to taking control of the Senate, the incentives to try and pass the bill this year are weak when they could get a bill more to their liking with one of their own at the helm of the Banking Committee. By the same token, wouldn’t the House GOP prefer to negotiate with a Senate also controlled by Republicans? And, finally, while the housing market recovers, Fannie and Freddie continue to write billions in checks back to the taxpayer, paying off what they borrowed beginning in 2008. A steady stream of cash could weaken the resolve to do-away with these entities any time soon. Watch the tenor and pace of the debate in the coming months for signs that political winds are slowing down the process of reform.

Profiles in Tax Reform Courage Last month House Ways and Means Chairman Dave Camp (R-Mich.) released his long-awaited proposal on comprehensive tax reform. As you know, Camp worked for the past two years on a bicameral and bipartisan basis with Sen. Max Baucus (D-Mont.), chairman of the Senate Finance Committee, to come up with a proposal. Unfortunately, Baucus resigned just a few months ago to become the next U.S. Ambassador to China, so Camp lost his Democratic partner in the Senate. Undeterred, he moved forward anyway and introduced his bill. House GOP leadership and many members of the Republican caucus were not excited about Camp putting out his bill. Depending on its content, it could (a) expose Republicans to negative press and (b) take voters’ focus away from the many problems with the implementation of the Affordable Care Act, a topic that was doing wonders for GOP campaigning. In short, most everyone wanted politics to trump policy. Again, showing a lot of courage,

Camp released his “discussion draft” and while it may not have had the impact on the voters that worried Republicans, it definitely got the attention of the business community. Oil and gas interests, manufacturers and business overall thanked the chairman for starting the discussion while expressing great concerns with the approach in the bill — not surprisingly with specific aspects that negatively impact their industries. Single-family housing groups had strong reactions to proposals that simplify the tax code, but in their view dramatically undermine the utility of the mortgage interest deduction. Perhaps the strongest reaction came from the financial services sector who weren’t pleased with the inclusion in the discussion draft of a small tax on big lending institutions. In fact, they were so unhappy that they reportedly threatened to cancel GOP fundraisers. For multifamily, the legislation is a mixed bag. On the plus side the taxa-

with this legislation, Camp gets a lot of credit for spending literally years taking input, talking with the other side of the aisle and putting together an honest proposal to reduce the corporate tax rate (one of his chief objectives) and simplify the tax code, regardless of the reaction from the taxed. Compared side-by-side, I give housing finance reform a better chance by far than tax reform of seeing the President’s desk this year. That advantage is more about the low odds for tax reform than high odds for housing finance reform. Even if neither legislative proposal sees the finish line, they have made their marks on the debate, for good or bad, and the apartment industry will have to consider them if and when the debate resumes on these issues. On the negative side, future depreciation recapture is taxed at ordinary income rates, depreciation schedules are extended for multifamily and 1031 exchanges are eliminated on a prospective basis, respectively. It is generally conceded the Camp discussion draft will not see any vote on the floor of the House this year. Further, the new Senate Finance Committee Chairman, Ron Wyden (D-Ore.), is less interested in starting with a comprehensive reform bill and more focused on dealing with tax “extenders,” the annually expiring tax provisions in the code. Reform writ large is off the table for this year. Setting aside the apartment industry’s concerns

should be connected with a dovetail or other positive lock construction. Drawers that are held together by nails will not hold up to tenant abuse, nor will particle board constructed cabinets. On a side note; if you are gutting the kitchen or bathroom, use this time to relocate and add more electrical outlets and under cabinet lighting.

In order to appeal to a larger segment of the population, try to keep the interior color scheme to neutral earth tones. Cabinetry quality varies greatly. Don’t let the cabinet fronts fool you. Manufacturers designed their cabinets to look good at first glance. Keep in mind, being in a rental environment, the cabinets also need to hold up to abuse. Look at the actual construction of the cabinet box or frame. There is no need to use custom cabinets to fit your existing layout. The use of prefabricated modular cabinetry can greatly reduce the time and cost to have a finished kitchen or bathroom. Using real wood cabinet fronts with 3/8” plywood sides is essential for durability. The drawer fronts and sides

of a “moisture-controlled” process and steam cleaning does not use steam, it is a process of hot water under high pressure. Carpet dry cleaning methods use chemical cleaning solutions to extract dirt. There are three methods: Dry Foam: The foam is applied to the carpet and allowed to dry, then vacuumed up along with the dirt. Dry Chemical: A cleaning solution is applied to the carpet and a machine spins a large bonnet from side to side to absorb the dirt from the carpet. Dry Compound: An absorbent mixture resembling wet sawdust is spread over the carpet. A machine brushes the mixture into the carpet to absorb the dirt. When the mixture dries, it is vacuumed out, taking the dirt with it. The dry method does not get as much of the deep dirt out, but is very effective at cleaning the visible portion of the carpet and the carpet may be ready for traffic within an hour. The wet carpet cleaning method uses hot water extraction to force a hot water based cleaning solution into the carpet under high pressure and then sucks it back out of the carpet along with the dirt. There are two water extraction methods: Portable Extraction: The carpet is cleaned by a small machine using

Dear Jim: The water heater may need a bit of maintenance. The first thing to do is clean out the sediment at the bottom of the tank. This will require a shutdown of the heater for a couple of hours and some hands and knees work. Most 100-gallon gas water heaters have a clean-out port at the front of the tank. The port is either round or oval. Be sure to get a new clean-out port gasket before starting this job. Once the water is drained and the port opened, remove all the sediment from the tank. You can expect to haul out one to two buckets of calcium buildup. (Sediment removal should be done once a year.) Removing the sediment will greatly improve the heating efficiency the water heater. Because of the age of the tank; while

Truck Mounted Extraction: This uses a large cleaning machine mounted on a truck or van. The water is heated to a higher temperature and is shot into the carpet at a higher velocity than is possible in portable machines. Out of all the methods listed above, we recommend the Truck Mounted Extraction method. We believe it is the most effective way to clean, mostly because the heat kills bacteria and the extra power separates dirt. These powerful machines also pull most of the water back out of carpets, leaving them damp but not wet. The carpet may be ready for traffic within a few hours or more. One a side note: Most major carpet manufactures listed on the Carpet and Rug Institute (CRI) website (A nonprofit trade association), recommend the use of hot water extraction systems to clean carpets.

If the anode rod is corroded, replace it by pulling it out from the top of the tank and inserting a new one. The anode rod is a sacrificial zinc rod that helps keep the tank from corroding. The second item to check is the coldwater inlet dip tube. Cold water entering the heater is routed to the bottom of the tank by the dip tube. If the tube is corroded, broken or missing, the tank will develop hot and cold areas, leading to complaints about short-term hot water. The dip tube is located inside the cold-water inlet pipe. Replacements for both the anode rod and dip tube

Lastly, have your leasing teams share with their residents a written summary of exactly what they will be doing as a result of these resident surveys. Remember, surveys are a great way to get feedback, but these residents will want to know what your leasing teams are going to do with their responses.

Fair Housing: Fixing a Mess of our own Making BY JANET M. EASTMAN, CPM®, SANTA BARBARA RENTAL PROPERTY ASSOCIATION

W

hy do we have Fair Housing and where did it come from? We may all be familiar with the protected classes designated by fair housing laws. In fact, they may be so familiar that we just take them for granted. I was fortunate to have to squarely ponder their origins this year as preparation for presenting a Fair Housing overview at an April meeting in honor of Fair Housing Month. What follows is a very brief and cursory overview of some of the reasons behind the need for the fair housing legislation and laws that have so shaped and which are so vital to rental housing practices today.

The War ended on April 9, 1865, and in December of that year, the Thirteenth Amendment of the U.S. Constitution was adopted, outlawing slavery in the U.S. by stating that “Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.”

The Root of the Problem When a Dutch trading ship brought 20 Africans to the British colony of Jamestown, Virginia as indentured servants in 1619, the shameful practice of what would become slavery took hold in the new world and didn’t end until 1865, when millions of African slaves were freed by the Emancipation Proclamation at the end of the Civil War. In the intervening 250 years, an untold number of Africans were brought to the U.S. to help build the economic foundations that have made our country what it is today. As slaves they endured unspeakable treatment and were deprived of the most basic human rights. President Lincoln’s executive order on January 1, 1863, proclaiming the freedom of slaves in the ten states that were in rebellion, was actually only the

The Civil Rights Act of 1866 The Civil Rights Act of 1866 was enacted as a means to enforce the Thirteenth Amendment. The clause of the Act relating to housing discrimination that can now be found at Title 42 U.S. Code § 1982 — (Property rights of citizens) reads “All citizens of the United States shall have the same right, in every State and Territory, as is enjoyed by white citizens thereof to inherit, purchase, lease, sell, hold, and convey real and personal property.” The century that followed this first civil rights act is full of heartbreak and broken promises and not only an inability on the part of the government to end inequality but its active participation in and promotion of racial segregation. Black Codes and Jim Crow laws designed to restrict the rights and liberties of African Americans perpetuated their separate status in the South. Urban crowding and competition with waves of European immigrants for industrial work resulted in a less explicit atmosphere of racial segregation and

discrimination in the northern cities to which millions of African Americans fled. Violent protest against racial discrimination began as early as 1919, and the struggle for racial equality proved to be our country’s greatest challenge. Redlining As part of President Roosevelt’s “New Deal” efforts to pull the nation out of the Great Depression, and because of a need for banking and home loan reform in the 1930s, the Federal Housing Administration (FHA) was created in 1935 to regulate the rate of interest and the terms of mortgages that it insured. As part of this effort, the Federal Home Loan Bank Board (FHLBB) asked Home Owners’ Loan Corporation (HOLC) to look at 239 cities and create “residential security maps” to indicate the level of security for real-estate investments in each surveyed city. Many minority neighborhoods in cities were outlined or shaded in red and labeled as risky for mortgage support and ineligible to receive financing. The maps were based on assumptions about the community, not assessments of the ability of the individuals’ or households’ there to satisfy standard lending criteria. Fair Housing — continued from page 38 Latinos, Asians, and Jews—could not secure mortgage loans at all. The assumptions in redlining increased residential racial segregation and fostered urban decay. Despite Supreme Court decisions in the 1940s and 1950s that ended the exclusion of minorities from certain sections of cities and rulings in favor of desegregation in other areas such as education and public transportation, race-based housing patterns continued into the 1960s. Minorities who served in the armed forces had trouble renting or purchasing homes in certain residential areas because of their race or national origin, and many organizations lobbied for new fair housing legislation. During the 1960s, civil rights activists cried out for countermeasures to undo the damage done by redlining and social policies of separate but equal that perpetuated inequality. With more and more frequent race rioting in major cities, where minorities had been forced to live in increasing numbers as white citizens fled to the suburbs, it became clear that something had to give. The need for fair housing measures became apparent, and these efforts began early on. Executive Order 11063 President Kennedy tried to address the problem with Executive Order 11063 on November 21, 1962 entitled “Equal Opportunity in Housing” that

Johnson was dismayed at the failure of the government to pass fair housing legislation year after year, and the matter became a political hot potato. In desperation, he looked to a young senator from Minnesota named Walter Mondale to again sponsor a fair Housing bill in1967. In part due to a tragic turn of historical events, Mondale succeeded where others had failed.

Federal Fair Housing Amendments Act (known as the Fair Housing Act) of 1968 Intended as a follow up to the Civil Rights Act of 1964, Title VIII of the Civil Rights Act expanded the original goal of federal protection to address racial discrimination in housing. Title VIII was known as the Fair Housing Act, (which was later used as a shorthand description for the entire bill), and it prohibited discrimination concerning the sale, rental and financing of housing based on race, religion, national origin and sex. Before its passage, Senator Edward Brooke of Massachusetts—the first African American ever to be elected to the Senate by popular vote—spoke personally of his return from World War II and inability to provide a home of his choice for his family because of his race. In early April 1968, the bill passed the Senate by a slim margin, thanks to the support of the Senate Republican leader, Everett Dirksen, who

defeated a southern filibuster. It then went to the House of Representatives, from which it was expected to emerge significantly weakened. On April 4th—the day of the Senate vote—civil rights leader Dr. Martin Luther King, Jr. was assassinated in Memphis, Tennessee. Amid a wave of emotion—including riots, burning and looting in more than 100 cities around the country—President Johnson increased pressure on Congress to pass the new civil rights legislation. King had participated in marches in Chicago in 1966 calling for open housing in that city and was associated with the fight for fair housing. Johnson argued that the bill would be a fitting testament to the man and his legacy, and he wanted it passed prior to King’s funeral in Atlanta. After a limited debate, the House passed the Fair Housing Act on April 10th, and President Johnson signed it into law the following day. The last section of the Fair Housing Act prohibits the willful or attempted injury, intimidation of, or interference with any person who is selling, purchasing, renting, financing, occupying, contracting, or negotiating for the sale, purchase, rental, financing, occupying, contracting, or negotiating for the sale, purchase, rental, financing, or occupation of any housing, because of that person’s race, color, religion, national origin, sex, disability, or familial status. This law also protects individuals who apply for or participate in any activity, service, organization, or facility that is in the business of selling or renting housing, as well as individuals who encourage others to participate in such activities and services. Those who break this law can be fined, imprisoned for up to one year or both. If bodily injury results from such unlawful acts, or if the acts involve the use or attempted use of a dangerous weapon, the prison sentence may be as long as ten years. The Fair Housing Act covers almost every kind of housing, public and private. There are, however, several

Owner occupied housing with 4 or fewer units: Single family houses sold or rented by an owner, as long as the owner doesn’t own at least a part of more than three homes, has not sold a house in the last 24 months, does not use an agent or broker, and does not use discriminatory advertising.

• Religious organizations and private clubs are allowed to limit the sale, rental, or occupancy of their housing to individuals of the same religion or members or to give preference to such individuals, as long as membership is not limited to persons of a certain race, color, or national origin. Affirmative Furthering With the passage of the Fair Housing Act, HUD was tasked with “affirmatively furthering” the cause of fair housing—a somewhat vague mandate. With the FHA now a part of HUD, the very institution that had created much of the mess in housing practices was now tasked with reversing the damage it had done, essentially fixing a mess partly of its own making. In 1969, the newly elected president Richard Nixon appointed George Romney, the governor of Michigan and former mayor of Detroit as the U. S. Secretary of HUD. Romney had studied the rioting and violence in his own and other cities to try to find the cause of the unrest. He concluded that it was in large part due to housing issues, and that the white man had created the ghetto and therefore must disassemble it. Romney used the mandate to “affirmatively further” fair housing to pressure predominantly white communities to build more affordable housing and end discriminatory zoning practices. He created an initiative he called “Open 4 2

Communities” whereby he proposed withholding federal funding for water, sewer and highway projects from cities whose local policies fostered segregated housing. The program began to take hold and see results, but constituents who had supported Nixon complained, and when Nixon got wind of the Open Communities initiative, he shut it down and subsequently forced Romney out. While Nixon acknowledged the need to end racial segregation, he did not believe in forced integration. For a brief time, at its inception, then, HUD did actively promote fair housing, but with Nixon’s retreat, the cause lost momentum; and so the struggle for meaningful change in housing practices continued on in the decades after Fair Housing was born.

rental property owners today, who must navigate ever narrower interpretations of them for greater numbers of protected classes, Fair Housing laws were created for good reasons that must be remembered. When faced with having to accommodate marijuana smokers and seemingly healthy individuals with “support” animals, let us pause and think of how far we have come. Perhaps the pendulum has swung too far, but it may swing back again to the point of reason at some point soon; May it never swing back to the terrible and unfair housing practices our nation saw up until relatively recently. Let us remember the very valid reasons that Fair Housing laws were created, the long and valiant struggle for civil rights for those of all races and beliefs. Remember April, which is designated as Fair Housing Month in honor of the passage of the Fair Housing Act in that same month of 1968, let us also acknowledge and celebrate the success these guidelines have had in ending arbitrary and bad business practices that denied some persons the full enjoyment of their rights as human beings.

Fair Housing Amendments Act of 1988 In 1988, Congress passed the Fair Housing Amendments Act, which expanded the law to prohibit discrimination in housing based on disability or on family status (pregnant women or the presence of children under 18). These amendments brought the enforcement of the Fair Housing Act even more squarely under the control of HUD, which sends complaints regarding housing discrimination to be investigated by its Office of Fair Housing and Equal Opportunity (FHEO).

Three Keys for Helping Leave Children a Solid Legacy BY JASON SHERR

state planning conversations are never easy, but they’re crucial for helping create a secure future for your family. In particular, estate planning tools such as wills and trusts can help ensure that your children will be taken care of if you — or you and your spouse — are no longer there for them. Executing an estate plan lets parents determine who will raise their children and how their finances will be managed,” says Deborah Lauer, Vice President of Estate Planning for Wells Fargo Advisors. “It typically helps the parents gain comfort.” Your plan should account for a number of factors, including the size of your estate, who will raise your children, and how assets will be managed and distributed to your heirs. Pay particular attention to the following three items.

For example: A revocable living trust is a trust executed and funded while you are still alive. It benefits you while you are alive and then distributes your assets (outright and/or in trust) to your beneficiaries upon your death. A testamentary trust is funded upon your death and stipulates when and how your assets will be transferred to your heirs.

1) The Distribution Structure You might assume that naming guardians in a will is a comprehensive estate plan, but it’s really just the beginning. You also need to determine how assets will be managed for your children and when the assets will be distributed to them. Rather than simply bequeathing assets directly to your children, talk to your estate planning attorney about establishing a trust to distribute the property. In that way, you can control when your children receive those assets and even how the money is used. Depending on your specific priorities, you can structure a trust to extend well into adulthood or dissolve when your child reaches the age of majority for your state. “Parents have to try to extrapolate what they think their child’s level of maturity would be at age 18, 21, or perhaps a more mature

who already has a close relationship with the child and, ideally, lives nearby to limit the disruption in the child’s life. “When choosing a guardian, also consider such details as the guardian’s religious beliefs, financial means, and connection with your extended family,” she says. Lauer suggests naming alternative guardians in case your chosen guardian dies or is otherwise unable to fulfill the duties laid out in your will. She also recommends revisiting this list every three to five years and updating it as necessary. 3) The Rationale Many children will find estate planning discussions uncomfortable, but some decisions, such as whom to name as guardian, can benefit from your children’s input. Other details will depend on your family situation and financial means. Many parents are reluctant to fully disclose their financial position to their children, which is fine,

says Lauer. But parents should at least explain the rationale behind their estate planning decisions. Doing so may help avoid hurt feelings or misunderstandings in the future. “When assets are left in trust, children may think it’s because their parents didn’t trust them,” Lauer says. In truth, you may have set up a trust to avoid probate, minimize estate taxes, or to protect the assets for future generations. If so, make that clear to your kids. It can be easy to put off these important preparations, particularly when day-to-day financial decisions seem more pressing. But these matters have a direct bearing on your family’s future. “It’s important that children know that their parents are looking out for them and planning for their long-term needs,” Lauer says. “And for parents, it’s about taking control and having a plan in place to help ensure their children are taken care of in a manner of their choosing.”

Some make it; some don’t. Customers go out of their way looking for companies that give great customer service. Some find it; some don’t. We have tried so very hard to explain to both sides. It’s not rocket science; it’s not brain surgery. It’s plain old common sense. But you and I know common sense is not out there. There is a mass of grey average out there. You don’t wanna be in it. Rise above

NAA Community Site & Online Resource Center now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible. Beta testers found the site to be exciting and informative. “I am a new manager and enjoy learning from others; hearing the first hand experiences, etc. I like finding so much information in one place,” said one beta tester.
