I

hope that everyone enjoyed a joyous and Happy New Year. The Association Staff and members of various Board Committees have prepared and planed for an exciting year of events, seminars and educational programs. I fondly recall the days, after graduating from U.C. Berkeley, of all the educational programs and seminars I attended at the Apartment Association of Orange County. I learned more about Property Management at the Association

than I did during four years at the University. I was extremely fortunate to have taken many courses taught by the late Dorothy Gourley, the Margaret Thatcher and Grand Dame of our industry. I encourage those new to industry, or even those who have been owners for a while, to take advantage of our extraordinary educational programs tailored for those who want to excel in our chosen profession.

It is hard to believe that this year will be our 48th Annual Trade Show and Conference. Thank you in advance to those Product Service Council Members and vendors who have already reserved spots at the Show. This year’s Conference line-up offering includes dynamic and insightful speakers such as Toni Blake and the ever-popular Stephen C. Duringer, Esq. The AAOC PAC raises funds to support candidates who support issues and legislation that protect property and business rights and the rental housing industry. These PACs allow us to have a strong voice that resonates when working with the many local and state elected officials as well as their teams to protect those rights. This is the area of industry advocacy where those with a vested interest in the rental housing industry can organize our resources, raise more, and effect political action so our collective voices are heard. Last year you stepped up big and donated money that helped thwart Santa Ana rent control and Proposition 10. You also stepped up by answering our requests to call your legislators to voice your opinions about pending legislation. As we move forward in another very important year for the rental housing industry, I urge you to get involved with your political action, your energy and your PAC contributions. As always, stay tuned for updates from AAOC and information on RED ALERTS and other Calls for Action.

California’s New Housing Accommodation Laws for Support Animals

R

esidential rental property owners and managers with “no pet” policies have been under a duty to allow or make reasonable accommodations for tenants with disabilities to live with their service OR support animal (support animals are also often referred to as “emotional support animals” or “comfort animals”). While support animals provide emotional support and necessary assistance to tenants with mental health disabilities, they have gained notoriety in recent years as disabled airline passengers have made headlines attempting to board flights with all kinds of strange animals, including peacocks, pigs, turkeys, large spiders, and penguins to name a few.

Although California has not previously adopted explicit laws or regulations requiring rental property owners to provide accommodations for support animals, the duty has been interpreted to exist under Cal. Govt. Code § 12927, 12955, 12955.1, and under the federal Fair Housing Act.1 Starting January 1, 2019, however, California will officially have express regulations governing reasonable accommodations in the residential rental housing context that specifically covers support animals and other types of assistance animals.

Does that mean rental property owners will be required to allow disabled tenants to reside with any type of animal? While the new regulations do

not place limits on the breed, size, weight or number of animals, there are limits based on health, safety, nuisance, property maintenance and damage, and financial burdens.

To help residential rental property owners and managers understand the new regulations on support animals, CalStrategic offers this question and answer article as part of its ongoing Q & A series. In it, property owners and managers will find helpful information and tips to ensure compliance. This article focuses primarily on rental owner and manager duties regarding support animals. It should be noted, however, that because support animals are part of a broader category of “assistance animals” (which includes service animals), the regulations discussed herein generally also apply, with some exceptions, to all assistance animals.

First, some definitions: • Disability: In California, the term “disability” is broadly construed to include conditions that limit a major life activity, including physical and mental disorders, as well as medical conditions. (Gov. Code § 129262; 2 CCR § 11065.) “Mental disability” includes, but is not limited to, any mental or psychological disorder or condition, such as intellectual disability, organic brain syndrome, emotional or mental illness, or specific learning disabilities, that limits

a major life activity, which includes physical, mental, and social activities and working. A mental or psychological disorder or condition limits a major life activity if it makes the achievement of the major life activity difficult. (Gov. Code § 12926.)

• Reasonable Accommodation: A “reasonable accommodation” is a change, exception, or adjustment to a rule, policy, practice, or service that may be necessary to afford a person with a disability an equal opportunity to use and enjoy a dwelling unit and public and common use areas, or an equal opportunity to obtain, use, or enjoy a housing opportunity unless providing the requested accommodation would constitute an undue financial or administrative burden or a fundamental alteration of its program, or if allowing an accommodation would constitute a direct threat to the health and safety of others (i.e. a significant risk of bodily harm) or would cause substantial physical damage to the property of others.

An assistance animal is not a pet.

It is an animal that works, provides assistance, or performs tasks for the benefit of an individual with a disability, or provides emotional support that alleviates one or more identified symptoms or effects of an individual’s disability. (2 CCR §12005) • Support Animal: “Support animals” are a type of “assistance animal” that provide emotional, cognitive, or other similar support to an individual with a disability. A support animal does not need to be trained or certified. Support animals are also known as comfort animals or “emotional support animals.”

(2 CCR §12005) • Service Animal: “Service animals” are animals that are trained to perform specific tasks to assist individuals with disabilities, including individuals with mental health disabilities. Service animals

do not need to be professionally trained or certified, but may be trained by the individual with a disability or another individual.

Service animals included guide dogs, signal dogs, service dogs, miniature horses, and service animals in training. (2 CCR §12005)

When must a rental property owner allow a tenant to live with a support animal?

Under the new California regulations, rental property owners and managers must make reasonable accommodations to allow tenants with a disability to live with their support animal when the tenant has a disability-related need for the support animal. Legally speaking, an accommodation must be made when it is “necessary to afford the tenant an equal opportunity to use and enjoy a dwelling, including public and common use areas, or housing opportunity.”

(2 CCR § 12176.)

How do rental property owners determine

whether a tenant has a disability and disability-related need for a support animal?

First, if the disability and the need for accommodation is apparent or known to the rental property owner or manager, then the owner or manager must make the accommodation without any further requests for additional information about the disability or need. (2 CCR § 12178(b).)

With support animal accommodation requests, however, the disability and need are often not readily apparent or known due to the fact that tenants who need support animals often have mental or psychological disabilities that are not always apparent. In such cases, owners or managers may request information from the tenant that: (1) Is necessary to establish that the individual has a disability; (2) Describes the needed accommodation; and Sacramento — continued on page 10

(3) Shows the relationship between the individual’s disability and the disability-related need for the accommodation.

Proof of disability and disability related need can be provided by a reliable third party who is in a position to know about the tenant’s disability and disability-related need for the accommodation, including:

(1) A medical professional;

Focusing just on the question of whether a tenant has a disability, tenants are allowed to prove they have a disability through self-certification, such as documentation of receipt of disability benefits, or a credible statement by the tenant. A credible statement by the individual is “one that a reasonable person would believe is true based on the available information.” (2 CCR § 12178(f).) While the “credible statement” definition is fairly vague and will likely be further defined and interpreted

by California courts in the future, a mere assertion by a tenant that he or she is disabled without more is likely not enough. There must be an articulated reason that the statement is credible.

(2) A health care provider, including the office of a medical practice or a nursing registry;

(3) A peer support group (further described in the regulation); (4) A non-medical service agency or person, including In-Home Supportive Services or Supported Living Services providers; or (5) Any other reliable third party who is in a position to know about the individual’s disability or disabilityrelated need for the accommodation.

How do owners determine whether information about a disability and accommodation need from a third-party source is reliable?

Under the new regulations, when a tenant requesting a support animal provides information from a third party to verify his or her disability and disability-related need for the accommodation, rental property owners may take into account: (1) Information establishing how the third party is familiar with the individual’s disability or the disabilityrelated need for the accommodation; (2) Information that specifies the functional limitations that underlie the request for an accommodation, but this information need not include specific medical information or terminology; or (3) Information providing a means to contact the third party to verify that the person identified did in

It should be noted a that a support animal certification from an online service that does not include an individualized assessment from a medical professional is presumptively considered unreliable. (2 CCR § 12185 (c)(2).) Also, animal vests, identification cards, or certificates are not in and of themselves documentation of either disability or the need for a reasonable accommodation.

(2 CCR § 12185 (d)(7).) But tenants are not required to have vests for their animals, ID cards, or certificates to prove they are disabled or need an accommodation. They need only provide reliable evidence that they are disabled and need an accommodation for their support animal.

In determining whether a tenant has a disability and disability-related need for a support animal, are there questions I am not allowed to ask the tenant?

Yes. Rental property owners and managers may not seek information about the following: (1) The particular diagnosis or medical condition; (2) the severity of the disability; (3) medical records, medical history; (4) other disability or medical issues unrelated to the request, or other disability or health related information beyond the information needed to establish that the tenant has a disability and disability related need for the support animal.

Are there any limits to breed, size, or weight of the support animals requested for accommodation?

For example, in Sacramento, a person may have no more than three dogs and seven cats;2 poultry and livestock are generally not permitted; chickens, pigs and horses are allowed in certain zoning districts and depending on the parcel’s size; domesticated animals kept for pleasure, in a cage, terrarium, aquarium or other confinement within the primary dwelling are not regulated as long as they are kept in a safe, healthy and nuisancefree condition.3 Moreover, California has laws restricting ownership of a variety of animals including hedgehogs, gerbils, degus, prairie dogs, sugar gliders, fur-ranch foxes, monkeys, and Quaker parakeets.4 Thus, while the new regulations do not place specific limits on number and type of support animal allowed, there are a variety of other local and state laws that do provide limitations.

Does a support animal need to be trained?

No. (2 CCR § 12005 (e)(2).) Unlike service dogs, which must be specifically trained, emotional support animals are not required to be trained.

Can a housing provider charge a pet deposit or other fee for a support animal?

No. (2 CCR § 12185 (d)(2).) A housing provider may not require a tenant with a support animal to pay any pet deposit, pet fee, additional rent, or other additional fee, including additional security deposit or liability insurance in connection with the assistance animal. The rule applies even if the property owner has a policy requiring the payment of a fee for pets.

When can property owners deny a request for support animal?

A reasonable accommodation for a support animal can be denied for the following reasons: (1) The individual on whose behalf the accommodation was requested is not an individual with a disability; (2) There is no disability-related need for the requested accommodation (in other words, there is no nexus between the disability and the requested accommodation); (3) The requested accommodation would constitute a fundamental alteration of the services or operations of the person who is asked to provide the accommodation; (4) The requested accommodation would impose an undue financial or administrative burden on the person who is asked to provide the accommodation; or (5) The requested accommodation would constitute a direct threat to the health or safety of others (i.e. a significant risk of bodily harm) or would cause substantial physical damage to the property of others, and such risks cannot be sufficiently mitigated or eliminated by another reasonable accommodation. port animal request;

Are there any limits to the number of support animals that a tenant may request?

There are not specific limits to the number of support animals that may be requested. However, the new rules specifically state that when a tenant requests an additional support animal, rental property owners may consider whether the cumulative impact of multiple animals in the same dwelling unit constitutes an undue burden or fundamental alteration. (2 CCR § 12185 (d) (4).)

Additionally, local municipalities often have ordinances restricting the number of pets and animals that a household may have at residence.

What qualifies as an “undue financial or administrative burden”?

Under the new regulations, undue hardships and burdens are to be assessed on a case-by-case basis taking into the consideration the following relevant factors: (1) The cost to accommodate the sup-

(2) The financial resources of the rental property owner; (3) The benefits that a proposed alternative accommodation would provide to the tenant with a disability; (4) The availability of alternative accommodations that would effectively meet the disability-related needs of the tenant; (5) For larger rental property entities, the structure and overall resources.

In general, a larger entity with greater resources would be expected to make accommodations requiring greater effort or expense than would be required of a smaller entity with fewer resources; and (2 CCR § 12179 (b).)

When would a support animal on the premises constitute “fundamental alteration”?

A request constituting a “fundamental alteration” is a request that would change the essential nature of the services or operations of the person being asked to provide the accommodation. (2 CCR §§ 12179(c).) In the context of rental housing, there are likely no arguments a rental property owner could make justifying a denial of a single support animal due to a fundamental alteration.

As explained above, however, an additional support animal might constitute a fundamental change. An owner or manager facing such a request should

consult an attorney.

Are there any reasonable conditions that a rental property owner may impose on the use of a support animal?

Yes! Reasonable conditions may be imposed on the use of an assistance animal to ensure it is under the control of the individual with a disability or an individual who may be assisting the individual with a disability. Restrictions or rules include: • A requirement that the tenant pay for cost of repairs for damage the animal causes to the premises, excluding ordinary wear and tear (2 CCR § 12185 (d)(3); • Control over waste disposal and animal behavior that may constitute a nuisance. (2 CCR § 12185 (6).)

Restrictions, however, may not interfere with the normal performance of the animal’s duties. For example, a leash requirement may interfere with the ability of a guide dog, signal dog, or service dog to assist an individual, in which case the animal may be under voice control or otherwise responsive.

Similarly, a “no noise” requirement may interfere with a dog’s job of barking to alert a blind individual to a danger or someone at the door; but incessant barking all night long or when the individual is not at home may violate reasonable restrictions relating to nuisance.

Any such conditions may not be more restrictive than those imposed upon other animals on the property. (2 CCR § 12185 (d)(6).)

Local Orange County Political Update

T

here is no longer such a thing as an “off-year” for an election cycle. As soon as one election is over, we have to prepare for the next. At the AAOC we have already started the process of vetting property-rights candidates for the 2020 local city elections.

Each election has a domino effect, including a few for this year as well.

On March 12th we will have a special election in the 3rd Supervisorial District to replace former Supervisor Todd Spitzer. Last November, Supervisor Todd Spitzer was elected as our new Orange County District Attorney, leaving a vacancy for his uncompleted term on the Orange County Board of Supervisors.

As soon as Spitzer was sworn in as the new District Attorney on January 7th, the Orange County Board of

Supervisors set a special election date on March 12th to fill the vacancy. The dominos continue.

The City of Seal Beach had a runoff election on January 20th for one of their city council seats. In Seal Beach if you don’t receive 50% + 1 of the vote on election day, there is a run-off slated between the top two candidates.

The domino effect also appears in Fullerton where former City Councilman Doug Chaffee won his campaign for Orange County Supervisor last November, leaving a vacancy on the Fullerton City Council. The remaining Fullerton City Council Members must now decide if they will fill the vacancy with by a city council appointment, or by calling for a special city election before the end of Spring.

There are no further anticipated elections in Orange County for 2019, but the key word is “anticipated.”

For 2020 the California Primary Election has been moved from the traditional month of June to March 3, 2020. This domino effect also moves the start of candidate filing process for the Primary Election to November 11th of this year. This affects the Orange County races for Congress, State Senate and State Assembly…as well as California’s Presidential Primary Election. The State of California will decide who they want as their party’s nominee for President of the United States only a year from now.

2019 definitely does not seem like an “off-year” for elections.

Questions & Answers I just closed escrow on a small building and I’m trying to figure out who’s who. I received the rental agreements, but the tenant information seems incomplete. The applications, the few that I’ve found so far, are old and outdated. I can’t seem to find any telephone numbers for the residents, and I’m not real sure that the names on the agreements are the same people who actually live in the units. I’ve read your articles before and I know the importance of reviewing the files and doing thorough due diligence before closing escrow, but this deal just happened too fast. Now that I’ve closed escrow, what can I do to clean up the records?

First things first, figure out what you know and what you don’t. Establish individual tenancy files, one per unit.

Based on the limited information you have, write down the names and ages of the occupants, the terms of the rental agreement, written or oral, lease or month to month, rental rate, deposit on file, date paid through. Compile whatever contact information you have, home phone number, work and cell number. Design a “tenant emergency information sheet” that includes spaces for the following: names of all occupants, home and cell phone numbers for each occupant, work phone numbers, email addresses and detailed vehicle information. Visit the building about dinner time, most residents will be home, and go door to door and meet briefly with the occupants of each apartment. Spend a few minutes confirming the information in your files

and gathering any missing information.

Ask the residents to complete the “tenant emergency information sheet” while you are there in case of emergency. You will find that the vast majority of your residents will co-operate fully and provide the requested information. Residents are generally eager to please, and since the relationship is still new, there should be no animosity or distrust.

This is also a good opportunity to find out the condition of each unit, simply ask the residents if there are any issues that need addressing, better to find out now and have an opportunity to address the needed issues than to allow conditions to worsen, and your relationship with the residents as well. This is also an opportune time to prepare new month to month rental agreements for signatures. You don’t know the players yet, so you certainly don’t want to do fixed term leases. The few residents who are less than co-operative will be quickly identified as your “problem residents” and can be handled individually. Names and contact information of the uncooperative ones can generally be gathered from the other residents, or from public records. If the property is non-rent control, and a month to month tenancy, the rental rate and term can be set with either a thirty or a sixty-day notice of change of terms, depending on the extent of the change.

Some of my leases are coming up for renewal in the next few months. One of

these leases is for a resident who has been a thorn in my side since the day he moved in. If I don’t want to renew him, do I need to provide him a reason? Also, do I need to serve any particular type of notice?

Provided your property is not located in a rent or eviction-controlled area, then you do not have to provide a ‘reason’ for non-renewal. Provided your desire is not based upon illegal discrimination and is not in retaliation for the resident exercising a protected right, then you are free to ‘not renew’ the lease. Generally, a fixed term lease expires on a certain day. Provided there is no language in the lease that “automatically” converts the lease to a month to month tenancy, then the resident is required to vacate on or before the lease expiration date.

Neither the tenant nor the landlord is required to serve any prior notice.

However, most industry lease agreements used by landlords include an automatic conversion provision that states that the tenancy automatically converts to a month to month tenancy unless a written notice of termination was served by either the landlord or the tenant. In this event, a written notice of termination would have to be served to terminate the resident’s tenancy.

Never got around to installing the CO (Carbon Monoxide) detectors in my apartments, I know it was required as of January 1, but just didn’t have the time to install.

Any rush?

Yes, a violation of the statute is an infraction punishable by a fine of up to $200 per offense. Before a fine is levied, the property owner must receive a thirtyday notice to comply. The greater risk is in the event of a CO poisoning inside your apartments causes a death, or worse severe brain damage in a child or other resident. Your failure to comply with the statute, negligence per se, will support a very large jury award against you. An intentional non-compliance with the statutory requirement can be very problematic for you and may actually provide grounds for your insurance carrier to deny your coverage. Best to get the required CO detectors installed as soon as possible.

My new tenants just moved in a month and a half ago. The lease requires that the tenant pays for all utilities, and must put the utilities in their own name prior to moving in. Well, I just received the electric bill, and it’s still in my name. I’m thinking about not paying it, just letting it get shut off. Maybe when the lights go out, they’ll take care of it. Can I do that?

No, can’t let the utilities be shut off.

Your tenant’s actions are a breach of the rental agreement and must be addressed in compliance with California law. You should immediately prepare and serve a Notice to Perform or Quit — Breach of Covenant notice. The notice should identify the specific breaches, the failure to place the electric utility in their own name, and their failure to pay the utility charges incurred since taking possession. The notice should be specific as to how they must cure the breach, namely, they must put the utilities in their name, and reimburse you for the amount of utility changes that have been billed and incurred post tenancy.

Note that some jurisdictions may require that you include a statement identifying a witness who observed the breach, as well as the date and time of the breach. In such jurisdiction, you or your manager would suffice as the wit

I was cleaning the kitchen stove in one of my vacant units and noticed the free standing stove tipped forward when I put a bit of weight on the open oven door. It looked a bit dangerous and was wondering how I can fix this issue. Rick

Dear Rick:

You are very lucky it was you and not one of your resident’s children that

found out about the dangers of a tipping oven. First let us explain what a tipping oven is: Most stoves with an oven are free standing appliances. The stove is placed in the kitchen, gas or electrical lines are installed and it is ready for use, very simple. The issue arises when a resident is using the stove and they or a child opens the oven door and puts weight on the open door. This causes a cantilever effect which may pitch the whole stove forward causing the stove top pots or pans to fly off the stove and onto the person or child in front of the stove. Best case scenario is this causes a mess in the kitchen and worse case is a resident or child is badly burned or disfigured. It is not uncommon to hear about a small child wanting to see what Mommy is cooking by using the oven door as a stepping stool or even more common, removing a turkey, roast or other large item from the oven and placing it on the open door. The extra weight is enough to tip the stove forward.

The solution is an “anti-tip bracket” installed behind the stove. An anti-tip bracket is “L” shaped and usually installed on the floor and against the wall (towards the back of the stove) for one of the rear legs to slide into.

Replacement parts are available at any hardware or home center stores, however, if not installed, there is a good chance, it is still in the plastic bag tied to the back of the stove. Shut off the circuit breaker or gas line feeding the stove, carefully slide the stove away from the wall, ensure a bracket isn’t

installed (the last time the stove was slid against the wall it may have simply missed the bracket) and if not installed, search around for the original plastic bag. Hopefully, the instructions and template is still in the bag.

Keep in mind installing an anti-tipping bracket is both a resident safety issues as well as an owner liability issue.

This is a $10.00 part and a ten minute install that will keep both you and your resident out of hot water.

Dear Maintenance Men:

I am replacing a number of rotted pressure-treated 4x4 fence posts on my property. Why do some posts rot and others do not. I cannot see any rhyme or reason for one post to be good the other bad. How can I avoid this trouble in the future? Kent

Dear Kent:

The issue of the rotting posts lies in the Tree Growth Rings and their location.

The rotting posts may have centered growth rings. If you look at the 4x4 post end, the growth rings will be either centered or not centered. A centered growth ring is common in post made from a peeler core. The tight centered growth rings of the peeler core will not accept pressure treatment as well as a post with off-centered growth rings. Chances are the fence you are repairing may have a mixture of peeler core posts and offcenter growth ring posts. A Peeler core is the by-product of plywood manufacturing. A log is turned on a lathe to produce plywood veneer and the center that remains is called a peeler-core.

When buying pressure treated post, look for off-center growth rings.

Dear Robert:

It does seem bathrooms are sometimes designed as an afterthought. Sink, toilet,

bath and that is it. A modern bathroom will take into consideration the need for storage, electrical devises, personal hygiene etc. The first item that comes to mind is installing a bath sink cabinet.

An old style cabinet might only have a set of doors under the sink. We find this is not adequate and a cabinet should have drawers along with access to under the sink. The drawers can store hair dryers, and all manner of personal bath items. A unique system we like utilizes the space between the studs in

the wall. Cabinet doors or mirrors can be used to cover storage in the walls.

The wall storage is perfect for toilet paper, rolled up towels, tooth brushes, and most other small items. Install multiple towel racks on the back of the bathroom door for additional towel storage. The space above the toilet can easily accommodate an overhead cabinet for larger items. Reversing the swing of the bathroom door from inward to outward will greatly increase the usable room and make the bathroom appear larger.

The regulations do not specifically limit the kinds of information an owner or manager can request about a support animal. Thus, an owner or manager is likely allowed to seek reasonable information to ensure the animal does not pose a threat to health or safety.

Information includes evidence of current vaccination, name, picture, and name and contact information of veterinarian (if known by the tenant). Owners and managers should also request that the tenant provide any evidence of the animal’s current or prior history of dangerous conduct. This evidence is specifically allowed to be requested under 2 CCR § 12185 (d)(9)(D) so that the owner or manager can ensure the animal is not a threat to others. But remember, because support animals do not need to be trained, an owner or manager likely cannot request informa-

tion related to whether or to what extent the animal is trained.

May owners and managers deny a reasonable accommodation if they fear the type of animal.

No. (2 CCR § 12185 (d)(9)(B).)

General fear of dogs for example cannot be basis for denying a reasonable accommodation. Fearing a so-called “dangerous breed of dog” like a pit bull, is also prohibited. Owners and managers may not stereotype animals or their breed in making their decisions.

Assessing dangerousness must be based on actual evidence of danger.

Should owners and manager update their current lease or rental contracts?

Yes. Owners and managers should update or revise their leases to ensure they are consistent with the new regulations. It is especially important that that leases contain provisions ensuring tenants are responsible for repairs and damage caused by their support ani-

mals, cleaning any part of the property or premises where animal waste has occurred, and ensuring their animal is controlled when on the premises at all times.

Are You Prepared for the 2019 New Year?

I

t’s a New Year and 2018 is behind us. How do we prepare to navigate the bureaucratic and litigious environment we face on a daily basis when conducting business in California? We all know living and doing business in California is anything but easy. The rules of engagement constantly change.

What are some of the potential pitfalls that lie ahead in 2019 and how can we better prepare ourselves to help achieve positive results to our bottom line? The following three topics may be something to consider that may help to assist you navigating some of California’s choppy waters in 2019.

Topic #1 Dynamex Decision

One of those significant changes in the way we do business will be impacted by the Dynamex Operations West v.

Superior Court of Los Angeles; Charles Lee Decision, Filed: April 30, 2018. The Decision set aside nearly 30 years of precedent based upon the 1989 California Supreme Court’s decision that addressed the worker’s employment status (Borello & Sons case). The Dynamex ruling now imposes the “ABC Test”. To qualify as an Independent Contractor: All three must apply.

A) The worker is free from the control and direction of the hirer in connection with the performance of the work, both under the contract for the performance of the work and in fact; and

B) The worker performs work that is outside of the usual course of the hiring entity’s business; and C) The worker is customarily engaged in an independently established trade, occupation, or business of the same nature as that involved in the work performed.

A lot has been written about the Dynamex Decision and you may be aware of the challenges imposed with the “ABC Test”. We recommend that if you have not pursued clarification on how this ruling can affect your business, please reach out and review with your H/R labor specialist and your insurance broker for potential coverage under your Employment Practices Liability insurance policy.

Topic #2 Hiring the Right Contractor

Hiring the right General Contractor or Subcontractor can be challenging.

The Federal Trade Commission — Consumer Information and the California Contractor State Licensing Board offer helpful guidelines for hiring a contractor. Important items when considering a contractor may include: • Making Sure the Contractor is Licensed (verify on the CSLB Website. www.cslb.ca.gov) • Making Sure the Contractor is Insured — Workers’ Compensation and General Liability (request a

certificate of liability insurance naming you or your company as an “additional insured” under the General Liability policy and include a “waiver of subrogation” under the workers’ compensation). Without these endorsements, a certificate only indicates coverage and does not allow coverage for you without the endorsements.

• Making Sure the Contractor has a License Bond (CSLB Website) • Shop Around for the Right Licensed Contractor • Obtain Referrals from Your Friends, Neighbors, Co-Workers Who’ve Used a Contractor • Request a List of References • Other Considerations: Get a Written Contract, Do You Need a Permit?, Don’t Pay Cash, Try to Limit Your Down Payment, Make Progress Payments, Keep Records and Report a Problem.

Doing your homework and the requisite footwork up front can save you a lot of time, expense and headache.

Topic #3 Time

Time is a precious commodity for a lot of us. How do we spend it wisely and make our efforts profitable? One of the areas we spend a good deal of time is the purchasing of goods and services.

This can be essential in protecting your bottom line. What are some of the best practices for buying goods and services?

• Develop strategic partnerships with experienced and established suppliers • Investigate and prepare a spending analysis for effective procurement • Negotiate the best available terms on an annual basis with your preferred suppliers • Verify that your vendors are meeting their contractual obligations • Evaluate your suppliers at least on an annual basis • Management oversight to insure that everyone in your organization understands your purchasing best practices

Is a Will or Trust Right for You?

f you have a will, there’s a question you should be asking yourself: “Do I also need a trust?” You might be surprised. A revocable living trust can be a useful estate-planning tool for people at all income levels, not just the very rich, says Lisa Montano, an Estate Planning Strategist for Wells Fargo Advisors.

Knowing the basics. “It depends on your individual circumstances, but most people should at least consider a revocable living trust,” Montano says.

You set up the trust and then transfer your property and other assets into it.

Most people name themselves as trustee—the person who manages the assets within the trust—but you can

also choose someone else or an institution. If you are serving as trustee, you’ll need to name a successor trustee to distribute your assets at your death.

However, if you have a revocable living trust, it is still advisable to have a POA. A successor trustee has power to manage only trust assets.

Other benefits. Here are three other advantages of trusts: • Avoid probate. Probate is the process the court system uses to distribute your assets according to the terms of your will. If you have a trust, you avoid the fees and delays associated with probate.

• Privacy protection. Because probate is a public process, anyone can go to the courthouse and see the details of your will, Montano says.

A living trust will keep the terms of your estate secret.

• Built-in incapacity planning. If you have a financial durable power of attorney (POA), you have already named someone to take over your affairs in case you become incapac-

One final note: If you decide to create a revocable living trust, make sure you discuss with your attorney how to put assets into the trust, otherwise those assets may still be subjected to the probate process.

What’s Your Perspective When Making those Buy/ Hold/Sell Decisions?

here is a definite mindset shift required when you move from buying or selling a property for personal use versus doing so for investment purposes.

Most individuals purchase investment properties as a way to grow their personal wealth. However, by the very nature of income properties, these same individuals — whether they were aware of it or not — are also buying a business.

All too often, as my father and I have seen in working with so many clients over the years — the business function

overshadows the investment purpose.

Clients tend to focus on the cash flow aspects and they rarely take the steps needed to quantify the true return of their investment in that property.

Some clients have further turned their properties into their life’s work.

Yes, there is satisfaction to be found in making your own repairs and managing your own properties. However, unless you are including the cost value of your time in your expense calculations, you are deluding yourself as to your actual return and cash flow.

So, not only may your property not really be providing the cash flow that you think, your return on investment might actually be diminishing. As my father loves to state: Compounding is the eighth wonder of the world. And, when you don’t take advantage of compounding — i.e. putting those premium dollars back to work by reinvesting them — you are stagnating and reducing the value of your investment.

In his book, Cash In on the Myths of Real Estate, my dad addresses what he sees happening.

Popular Belief: Your choice of options regarding a particular investment property are basically limited to buy, sell, or hold – especially when talking with a real estate agent.

Bill’s Truth: Real estate agents represent buyers and sellers, so their focus is on those transactional aspects.

However, as an investor, your perspective has to take into account not just the transaction itself, but how the action that you take is going to impact your wealth building goals.

Ideally, you want to be working with an agent who is willing to go beyond the transactional basics and really delve into all of your options. A full review should take into account not just the choice of buy/sell or hold, but also look at the ramifications of selling versus exchanging, as well as how a particular investment decision might further diversify your portfolio and/or provide a means to implement a possible gift or exit strategy.

A good advisor should understand the specific objectives of the transaction under consideration and then, on your behalf, clearly outline all of your options as well as quantify how each action would impact your long-term financial goals.

Think about and run the numbers on ALL of your options.

Even if you are no longer focusing growing the value of your real estate investments, there are a lot of other aspects to consider.

Every property has a job to do. It may be serving as a depreciation vehicle or providing a steady cash flow.

Perhaps this property is the foundation of the legacy that you want to leave behind for your heirs.

Whatever the role a particular property is fulfilling, the first and foremost task is to determine if that property is still performing that function. If not, thought needs to be given to making a change.

Should you decide that a change is needed, then be sure to check out all of your options. You need to do your homework and look beyond the choices of buy, sell or hold. As you know, a short-term gain can lead to a long-term headache. Make sure that the decision you are making fits with your overall plan and goals.
