Apartment Value Perspective

I

t’s a question we ask on an ongoing basis: Where are rental housing values headed? I put the question to economist, Dr. Al Gobar at a recent lunch. Gobar, a long time Fullerton resident, is renowned throughout southern California and across the nation for his uncanny ability to size up markets and forecast real estate trends. His current take on real estate as an investment: Bearish. Doesn’t like what he sees and has fully divested himself of all real estate holdings. At the heart of his analysis is a concern that interest rates are likely to continue to rise, which would increase cap rates for real estate and thus decrease property values. The benchmark US Treasury ten year yield has moved off its half century low of 1.43% in July 2012 to reach 2.86% as of this writing (1-10-14). The fifty year average is 6.67%. The 81 year old Gobar, who ten years ago was the largest shareholder of Whittier based Quaker City Bank before the institution sold out to become Banco Popular, is certainly not alone in his concern about interest rates. Like many, he feels that the accommodative policies of the Federal Reserve over the past several years — printing money in massive quantities to “prime the pump” of the US economy — will inevitably lead to steeper mortgage rates and that the resulting higher carrying costs for property ownership

will dampen enthusiasm to hold it, leading to lower valuations. Interestingly, Gobar’s five decades of storied success in advising clients where and when to buy and develop real estate has always centered around demographics, while the foundation for his current position is more macro in nature and grounded in classic economic theory that excessive government intervention in markets leads to bubbles. The onetime Beckman engineer turned economist (his PhD is from USC), along with then partner Dr. Richard Darley, pioneered development of mathematically-based models to simulate absorption and use of all types of developed real estate as a function of population, employment, and other economic and demographic time series data during the 1960s. They were the first to really mine US census data to forecast how real estate would perform in a specific location or region. Of course, Dr. Gobar himself will tell you that no economist is right 100% of the time. And he goes on to make the point that if you are a long term holder of investment real estate for the purpose of deriving an income stream, then a drop in value in the near term doesn’t really affect your return if you don’t sell. Furthermore, in a raising interest rate environment, rents would also be likely to increase, which offsets some of the problems that higher rates create.

I would never bet against Gobar. His track record is too good. But my own view is that Orange County real estate, in particular multifamily, is going to be an excellent asset class to be holding a decade from now — regardless of what happens over the next few years. Speaking of value Now let’s talk about a strategy that some multifamily owners and managers are pursuing to increase value. It won’t work for all owners, but for those that have the logistical flexibility, the addition of interior washerdryer interior hook-ups can generate handsome returns. Sufficient space, as well as venting and plumbing issues can be problematic. Where viable though, the upside is a hefty rent premium tenants will incur for the luxury of stay at home laundering. Two property managers I spoke to in January referenced higher rent potential ranging from $50 to $150 per month. Average installation cost was estimated at $3,000 per unit, including about $600 for the appliances themselves. Aging baby boomers moving out of homes and into rentals are among the tenants willing to pony up for the added convenience. For those reading this at home that don’t have to use laundromats or laundry rooms, you get that.

representative (who is likely a twentysomething, who has always rented), you notice something very, very odd… it is almost as if they are speaking a different language. And you say to yourself: “Is this really government by the people?” Well there is some good news. There is a way to break through the political wall. There is language they understand. There is a way to talk to a politician. The Law of Unintended Consequence According to Sir Isaac Newton’s Third law of motion, for every action, there is an equal and opposite reaction. The same can be applied to politics. But for some reason, politicians rarely foresee, forecast, or anticipate the reactions. This deficiency often times leads to votes that enact certain city ordinances. While intended for the common good, the result is unintended consequences that do adversely affect our business.

But rather than launch your “I’m a citizen, a taxpayer, and I pay your salary”, nuclear warhead on how this proposed ordinance is so crazy, so unfair, illegal, unconstitutional, yea un-American!... (a strategy, by the way, that will surely leave you emotionally and politically dismissed and relegated to “the crazies” file.) Take the high road, soft sell, it’s your best approach. Here are some words that work: “Councilmember, I am really interested in your proposed ordinance. Like you, I too am interested in making our city the best it can be. I thank you for this opportunity to chat before the issue is before you for a vote. I am sure you agree that through public participation and industry collaboration, we can reach the best solution to this problem. In the interest of being helpful, I would like to bring to your attention some consequences that I foresee arising as a result of this proposed ordinance. I am sure you would not want to act in any way that would result in consequences

that you never intended and have negative impact on good business in our fair city.” As you can see, the tone is supportive, eager, and collaborative… with just a smidgen of suggested course correction. It’s the old honey vs. vinegar recipe and it works. So, now that you know their language, don’t hesitate to make a courtesy call on your own city hall, or the city hall in which your property is located. Get to know your elected officials and their staff. Make sure they know you and your business. Most importantly, let them know you are a member of the Apartment Association of Orange County…and you vote!

Sacramento Report BY JON SMOC K

T

he state’s recent and projected weather conditions—record low levels of precipitation, bare to nonexistent Sierra snowpack, barren reservoirs and groundwater depletion —prompt a reminder of the precarious state of California’s most precious resource: water. Not gold, nor tourism, nor high-tech gadgetry, but water, as has been the case since even before the state was founded in 1849. At this writing in early January the hydrologists at the state’s Water Resources Board report our being on track to meet or exceed the driest years ever. The water level at Shasta, the state’s largest dam, may soon dip below the level of its intake pipes. And managers of Folsom dam in Sacramento are reported to have just warned its users that they may

receive only 5% of their anticipated 2014 allotment. The American River flow from that dam is noticeably reduced. The classic water wars of the Old West as depicted in stereotypical Hollywood style reverberate today in various modern settings, including courtrooms and legislative chambers. Former Senator and later Associate Justice Gordon Cologne was one of the modern public servants who truly embraced the intricacies involved in sorting out the various competing interests in the formation of state water policies. All branches of state government have had a crack at it at one time or another. The enduring nature of at least some of the conflict is reflected today in Governor Jerry

Brown’s effort to build twin tunnels beneath a large swath of southern Sacramento County to siphon water from the Sacramento River for delivery to the massive pumping stations south and east of the sensitive Delta region, there to continue the journey southward through his father’s canal system. This endeavor rekindles many of the same interest groups and persons who successfully fought a bruising peripheral canal project many years earlier. The legislative forum also has been repeatedly involved in water issues over the years. In more recent times, the emphasis appears to have been focused on conservation through various mandates that vividly bring home to users the personal cost of water use. It starts with mandated water meters in areas

that had for years enjoyed flat rate water service. Surprise, potable water costs a lot of money. It is not surprising that domestic water use dropped dramaticly as this fact was brought home to the consumer through the pocketbook. Efforts to carry this concept into multifamily properties through water submeter legislation have thus far proved largely ineffective for a variety of reasons, including their abnormally high error rates. But another approach was successfully enacted in 2009 with several delayed operative dates, including January 1, 2014, which brings us to the main topic of this report. Senate Bill 407, enacted as Chapter 587 of the Statutes of 2009, added several sections to the state’s Civil Code dealing with changing out plumbing fixtures in older properties. In sum, it requires replacement of all “noncompliant” plumbing fixtures on a graduated scale commencing January 1, 2014, so that all properties in the entire state are covered by January 1, 2019. Long time readers of this Sacramento Report will recall numerous references to this legislation as it was being considered by the Legislature 2009 because AAOC and its allied property interests were deeply involved in its fashioning. Because it has now reached its first major implementation period, here is a repeat of the most pertinent text

affecting owners of rental properties. References are to the Civil Code. 1101.2. Except as provided in Section 1101.7, this article shall apply to residential and commercial real property built and available for use on or before January 1, 1994. 1101.3. For the purposes of this article: (a) “Commercial real property ”means any real property that is improved with, or consisting of, a building that is intended for commercial use, including hotels and motels, that is not a single-family residential real property or a multifamily residential real property. (b) “Multifamily residential real property” means any real property that is improved with, or consisting of, a building containing more than one unit that is intended for human habitation, or any mixed residentialcommercial buildings or portions thereof that are intended for human habitation. Multifamily residential real property includes residential hotels but does not include hotels and motels that are not residential hotels. (c) “Noncompliant plumbing fixture” means any of the following: (1) Any toilet manufactured to use more than 1.6 gallons of water per flush. (2) Any urinal manufactured to use more than one gallon of water per flush.

(3) Any showerhead manufactured to have a flow capacity of more than 2.5 gallons of water per minute. (4) Any interior faucet that emits more than 2.2 gallons of water per minute. (d) “Single-family residential real property ”means any real property that is improved with, or consisting of, a building containing not more than one unit that is intended for human habitation. (e) “Water-conserving plumbing fixture” means any fixture that is in compliance with current building standards applicable to a newly constructed real property of the same type. (f) “Sale or transfer” means the sale or transfer of an entire real property estate or the fee interest in that real property estate and does not include the sale or transfer of a partial interest, including a leasehold. 1101.4. (a) On and after January 1, 2014, for all building alterations or improvements to single-family residential real property, as a condition for issuance of a certificate of final completion and occupancy or final permit approval by the local building department, the permit applicant shall replace all noncompliant plumbing fixtures with water-conserving plumbing fixtures. Smock — continued from page 9 (b) On or before January 1, 2017, noncompliant plumbing fixtures in any single-family residential real property shall be replaced by the property owner with water-conserving plumbing fixtures. (c) On and after January 1, 2017, a seller or transferor of single-family residential real property shall disclose in writing to the prospective purchaser or transferee the requirements of subdivision (b) and whether the real property includes any noncompliant plumbing fixtures. 1101.5. (a) On or before January 1, 2019, all noncompliant plumbing fixtures in any multifamily residential real property and in any commercial real property shall be replaced with water-conserving plumbing fixtures. (b) An owner or the owner’s agent may enter the owner’s property for the purpose of installing, repairing, testing, and maintaining water-conserving plumbing fixtures required by this section, consistent with notice requirements of Section 1954. (c) On and after January1,2019, the water-conserving plumbing fixtures required by this section shall be operating at the manufacturer’s rated water consumption at the time that the tenant takes possession. A tenant shall be responsible for notifying the owner or owner’s agent if the tenant becomes aware that a water-conserving plumbing fixture within his or her unit is not

operating at the manufacturer’s rated water consumption. The owner or owner’s agent shall correct an inoperability in a water-conserving plumbing fixture upon notice by the tenant or if detected by the owner or the owner’s agent. (d) (1) On and after January 1, 2014, all noncompliant plumbing fixtures in any multifamily residential real property and any commercial residential real property shall be replaced with water-conserving plumbing fixtures in the following circumstances: (A) For building additions in which the sum of concurrent building permits by the same permit applicant would increase the floor area of the space in a building by more than 10 percent, the building permit applicant shall replace all noncompliant plumbing fixtures in the building. (B) For building alterations or improvements in which the total construction cost estimated in the building permit is greater than one hundred fifty thousand dollars ($150,000), the building permit applicant shall replace all noncompliant plumbing fixtures that service the specific area of the improvement. (C) Notwithstanding subparagraph (A) or (B), for any alterations or improvements to a room in a building that require a building permit and that room contains any noncompliant plumbing fixtures, the building permit applicant shall replace all noncompliant plumbing fixtures in that room.

(2) Replacement of all noncompliant plumbing fixtures with waterconserving plumbing fixtures, as described in paragraph (1), shall be a condition for issuance of a certificate of final completion and occupancy or final permit approval by the local building department. (e) On and after January 1, 2019, a seller or transferor of multifamily residential real property or of commercial real property shall disclose to the prospective purchaser or transferee, in writing, the requirements of subdivision (a) and whether the property includes any noncompliant plumbing fixtures. This disclosure may be included in other transactional documents. 1101.6. The duty of an owner or building permit applicant to comply with the requirements of this article shall be postponed for one year from the date of issuance of a demolition permit for the building. If the building is demolished within the one-year postponement, the requirements of this article shall not apply. If the building is not demolished after the expiration of one year, the provisions of this article shall apply, subject to appeal to the local building department, even though the demolition permit is still in effect or a new demolition permit has been issued. 1101.7. This article shall not apply to any of the following: (a) Registered historical sites. (b) Real property for which a licensed plumber certifies that, due

to the age or configuration of the property or its plumbing, installation of water-conserving plumbing fixtures is not technically feasible. (c) A building for which water service is permanently disconnected. 1101.8. A city, county, or city and county, or a retail water supplier may do either of the following: (a) Enact local ordinances or establish policies that promote compliance with this article. (b) Enact local ordinances or establish policies that will result in a greater amount of water savings than those provided for in this article. 1101.9. Any city, county, or city and county that has adopted an ordinance requiring retrofit of noncompliant plumbing fixtures prior to July 1, 2009, shall be exempt from the requirements of this article so long as the ordinance remains in effect. SEC. 2. Section 1102.155 is added to the Civil Code, to read: 1102.155. (a) (1) The seller of residential real property subject to this article shall disclose, in writing, that Section 1101.4 of the Civil Code requires that California single-family residences be equipped with waterconserving plumbing fixtures on or before January 1, 2017, and shall disclose whether the property includes any noncompliant plumbing fixtures. (2) The seller shall affirm that this representation is that of the seller and not a representation of any agent, and that this disclosure is not intended to be part of any contract between the buyer and the seller. The seller shall further affirm that this disclosure is not a warranty of any kind by the seller or any agent representing any principal in the transaction and is not a substitute for any inspections that or warranties any principal may wish to obtain. (b) This section shall become operative on January 1, 2017.

eems like my residents just keep paying their rent later and later each month. I usually try and work with them; I don’t even begin to nag them until about the tenth of the month. I’ll start with a phone call, and then when they don’t call back, I send them a reminder note. Often the rents don’t come in until after I serve a notice to pay or quit, usually after the twentieth of the month. My lender doesn’t seem to

care if I’m late with the mortgage; they still want their payment of the first. How can I change this pattern?

Your residents pay their rent late because you have trained them to pay that way. Your rent collection techniques are lax, and your residents are all too aware of your procedures. Many residents live paycheck to paycheck, and will wait until the last possible moment to pay

their obligations. Your residents apparently know that you “try and work with them” and that you don’t even start looking for the rent until the tenth. Your phone calls and reminder notes are nice but not legally sufficient to ensure timely payment. Your residents know the drill, phone call, letter, and then the notice. Q&A — continued from page 12 absolutely have to in order to avoid being evicted. A tighter rent collection policy, coupled with a good rental agreement will eliminate your problem of late payments. Consider using an industry standard rental agreement that includes a properly drafted late charge provision. It is important to note that not all late charge provisions are enforceable. The language used in the agreement must characterize late charges as “liquidated damages,” that is, it must state that the damages sustained by the landlord as a result of tardy late rent payments are difficult or impossible to ascertain, and that the parties agree that a certain sum, the late fee, is the amount of compensation due the landlord. Your rental agreement will define when the late fee is incurred. Typically, the late fee is incurred if rent is not paid within three days of the rental due date. Remember, this clause does not provide a “grace period” to the resident; it

merely defines when the late charge is incurred. Late charges must not be punitive, but must reasonably relate to the costs incurred by late payments. Don’t charge a variable fee, one that increases by a certain amount each day the rent is late. Although the law is silent on the subject, courts generally allow late charges of 6% of the rental installment. Additionally, consider adding a clause in your rental agreement requiring the resident pay a “notice service fee” as additional rent in the event the landlord consults an attorney and serves a notice of default. Again the fee must be reasonable rather than punitive. If your primary goal is to just get the rent paid timely, you should send all of the residents a notice reminding them of their obligation to pay their rent on the first of the month, and they should budget accordingly. Let them know that you intend to strictly enforce the terms of the rental agreement. If you have allowed the late payments over a long

period of time, provide the residents at least thirty days warning of your intentions. Late rent payments in a rent-controlled unit are opportunities for vacancy decontrol. Rent controlled jurisdictions require aggressive rent collection techniques and strict enforcement of the terms of the rental agreement. If the rent is due on the first, and the first falls on a weekday, a three-day notice should be served on the second of the month. Failure to pay the rent in full by the expiration of the notice will support an eviction. Remember, you set the tone for your buildings. If you allow your residents to ignore the terms of your rental agreements, you can be assured that they will do just that.

Her son asked if I would take out the carpet, and install vinyl flooring throughout the unit so that her wheel chair could get around easier. He also requested that I install grab bars in the

shower and in the bathroom. He kind of implied that I must do it at my expense because of the ADA requirements, whatever they are. Now this resident is very sweet, but my husband and I are barely making it as it is. Do I have to pay to install vinyl flooring and grab bars in the apartment?

to allow the tenant full enjoyment of the apartment. The resident must pay for the modifications, and the modifications must be done in a workmanlike manner. You can require that the tenant signs an agreement obligating the resident to restore the premises to their original condition upon termination of the tenancy. Although you cannot require an additional security deposit in this situation, you can require that the tenant deposit sufficient money into an escrow account, to be held for the benefit of the landlord, in order to assure that the premises are returned to their original condition. The money that is deposited into escrow is not a security deposit, and is not limited by the two-month limitation.

Keep the provision as is. Do not strike it. Attorney fees provisions are important provisions and should be included in all rental agreements. The vast majority of litigation involves the filing of an unlawful detainer by the landlord against the tenant. Landlords prevail in 99.9% of all cases, and should be compensated for their attorney fees expended. Attorney fees for evictions rarely exceed $500, even in a contested matter. Remember, court costs are not attorney fees, are not capped, and get added to the judgment. Most courts in California calculate attorney fees in accordance with a court schedule, rather than actual fees incurred. Typically, courts allow $350 to $450 as recovery for attorney fees. The purpose of the cap is to dissuade tenant attorneys with too much time on their hands F E B R U A R Y

from demanding jury trials, and from filing frivolous lawsuits against landlords. If the potential for recovery is limited, the incentive to bring an action is greatly diminished. Also note that when judgment is entered in your favor, and the judgment includes an award of attorney fees, then all post judgment attorney fees are recoverable and can be added to the judgment during the entire period of time you

are attempting to collect. Not only does your judgment accrue interest at the rate of 10% per year, but all those collection fees can be recovered as well. I

t is quiet in the nation’s capital for the moment, but action resumes shortly as both houses of Congress return to work from their holiday recess. The President will make his annual and constitutionally required State of the Union Speech on January 28. As for what the President might say in his speech, we can safely assume he will want to say something positive about the re-direction of the Affordable Care

Act (ACA) launch. And, in trying to move past the health care law debacle, he will turn the focus to other high priority issues such as immigration reform and gun control. This speech gives the President the opportunity to set the table for his agenda for the year, while the Republican response will of course challenge everything the President sets down. Predictions about what will take place in 2014 have changed a lot since the days immediately following the government shutdown in October — in what has to be one of the greatest turnarounds since Claus Von Bulow beat the rap in 1984. Immediately following the ill-advised game of chicken with the President, the GOP’s brand was in bad shape; irreparably harmed, some said. But then came the rollout of the Affordable Care Act and in the span of two months, the public had forgotten all about the shutdown. A recent poll

According to the CNN/ORC International poll, when voters were asked who they would vote for generically, Republicans or Democrats, the GOP had the lead of 49 to 44 percent. The same poll taken after the shutdown had Democrats ahead 50 to 42 percent. To maintain this advantage going into the fall 2014 elections, Republicans have to keep the focus on the ACA and not let other potentially nettlesome distractions get in the way. Exhibit A of this strategy is the surprisingly easy passage of the budget deal brokered by Paul Ryan (R-Wis.), House Republican Budget Committee Chairman and Patty Murray (D-Wash.), Senate Democrat Budget Committee Chair. While the usual conservative third-party groups howled, no one listened and the bill passed overwhelmingly in the House and Senate with plenty of Republican support. Speaker John Boehner

(R-Ohio) knows that another shut down would cede back to the President and Democrats all that has been won, thanks to the ACA rollout. This dynamic also presents some challenges to apartment industry priorities such as immigration reform. While many inside and outside of the GOP believe there is much to be gained by passage of some kind of comprehensive reform, the issue is not without its pitfalls. Immigration reform creates awkwardness for many Republicans in the House and Senate who might want to put the issue to bed and in the process win over some in the single largest emerging voting bloc in the country. But they have real and justified fear of the wrath of wellfunded third-party conservative groups opposed to immigration reform which often give rise to primary challenges. Still, we crack on despite these environmental challenges because (1) we have to, (2) the groundwork laid today becomes the text of laws tomorrow, and (3) there is a 50/50 chance that the pieces on the chess board in the House and Senate will stay as they are today. That means legislative proposals can literally be carried over to the new Congress in 2015. The odds that the House changes hands and the Democrats take over are very weak. While the Senate Republicans have their best chance in some time to retake control of the Senate, they have proven in the past to be adept at snatching defeat from the jaws of victory — not

to mention the fact that several of their own incumbents have primary challenges to worry about. In short, as dawn breaks on 2015, we could very well be looking at the same division of power we have today. With that in mind, let me finish with a plug for the NAA Capitol Conference coming up in March. One of the chief goals this year for 2014 NAA Chairman of the Board Brad Williams is to significantly increase NAA’s advocacy power and presence. There are innumerable legislative and regulatory issues faced by our industry — fair housing disparate impact, the future of Fannie Mae and Freddie Mac, taxes and many, many more. ear Maintenance Men: I have a large apartment complex that has become the nesting place for several groups of pigeons. I have used owls, the high pitch sound, and sticky feet; of course the entire place is covered with the metal spike strips. The pigeons walk through them and build their nest on top of the bent down spikes. I cannot buy poison corn anymore. What can I do to get rid of the pigeons?? Jill

Dear Jill: Thank you for a great question. Looks like you have tried most of the common antidotes for getting rid of unwanted pigeons. The key is to make them as uncomfortable as possible and not stopping until they are gone. First thing

to do is clean the area with bleach to remove any pigeon nesting smells and spraying any stubborn pigeons with a water hose over and over. If the area lends itself to be closed off, put up netting to keep the birds from entering the area. If the spikes are broken, replace with stronger ones. Check at your local farm supply or the internet for stronger better quality spike strips. Getting rid of pigeons is a war of wills. If you give up, they will return. The area most be monitored constantly until the birds have found a new nesting area. Dear Maintenance Men: The wood fence patios on my property are not very old, yet the posts appear to be rotting out in the ground. I feel they should have lasted much longer.

The fence now leans and is a danger. I will be replacing all the posts soon and want to know how to stop the posts from rotting in the concrete footings. Do you have a suggestion? Mark Dear Mark: Your problem is most likely poor drainage. The posts rot away because of excessive moisture. For a long-term installation, use either redwood or pressure treated lumber. Dig your posthole at least 6 inches deeper than normal. Fill the bottom six inches of the hole with ½â€? sized gravel. Then set your post in place, level it and pour in another 2 or 3 inches of gravel. Fill the balance of the hole with Ready-Mix or Post-Mix concrete. Taper the top of

the wet concrete at a slight angle to the post; that will help drain water away from the post. For added protection, you may want to consider water proofing your post with Thompson’s Water Seal or roofing tar. That should help keep your post healthy for much longer. Dear Maintenance Men: I am starting my planning for a major kitchen cabinet remodeling project in my rental units. However, I am having a difficult time making material and design decisions. What recommendations can you give? Allen Dear Allen, When doing a kitchen or bath material selection, cohesive and functional design is important. Kitchen and bath rehabs are some of the most expensive work you can do in an apartment unit and proper planning is a must. In order to appeal to a larger segment of the population, try to keep the interior color scheme to neutral earth tones. Cabinetry quality varies greatly. Don’t let the cabinet fronts fool you. Manufacturers designed their cabinets to look good at first glance. Keep in

mind, being in a rental environment, the cabinets also need to hold up to abuse. Look at the actual construction of the cabinet box or frame. Keep in mind you do not need to use custom cabinets to fit your existing layout. The use of prefabricated modular cabinetry can greatly reduce the time and cost to have a finished kitchen or bathroom. Using real wood cabinet fronts with 3/8” plywood sides is essential for durability. The drawer fronts and sides should be connected with a dovetail or other positive lock construction. Drawers that are held together by nails or cabinets built with particle board will not hold up to tenant abuse. On a side note; if you are gutting the kitchen or bathroom, use this time to relocate and add more electrical outlets and under cabinet lighting. QUESTIONS? QUESTIONS? QUESTIONS? W

hen we answer the phone at PHD Insurance Brokers, we use the tag line, “Your Educated Agency.” We do this because our job is to constantly inform our clients of the changes taking place in the marketplace. We must advise them of the correct coverage limits, make sure the coverage is understood, and explain whether or not they need higher deductibles to save money. The one thing we don’t do is tell people to take the lowest premium unless they totally

understand what they are giving up. Our employees understand that they must keep up-to-date on their education and must constantly educate our clients. Whether it is us advising our client, or you advising your client about your rules & regulations, each of us is responsible to continue to educate ourselves and our clients. As I tell my people, you have to keep telling the client no matter how often they ask a question because they don’t get up thinking about insurance or an apart-

ment owner’s rules & regulations. The client gets up and thinks about their job and the need to educate their clients. How does the revenue fit into the picture? When we are working with the client and they buy an additional policy because we uncover a need for an insurance product, the new policy brings revenue to the agency. When you inform your renter of the rules and/or procedures, it cuts down on your losses, whether physical or monetary. Prevention is good for every business

and it prevents bad things from happening. When bad things don’t happen you avoid losses and avoid spending money that shouldn’t need to be spent because of a renter’s lack of knowing the rules and regulations. I’m sure you have been solicited by an insurance agent where the sales pitch is saving money. How can they save you money when your current agent, if they are knowledgeable, is out getting competitive premiums before they even place the renewal for you. Here is what that soliciting agent probably has done. They have just been appointed with a new insurance company that has just recently entered the marketplace. Immediately the new company tries to establish themselves by offering lower premiums and average coverage. Many times the insurance company will take a loss just to get established. However, losses will occur and then what happens? Once the losses start coming in, they have two alternatives, first, raise

their prices, second, take away coverage. Unless you are extremely familiar with an insurance contract and how coverage works, it is my opinion that you need to have an “educated agency” that will work for you. The insurance company that I’m describing came into our marketplace a few years ago and had very low premium and mediocre coverage. Now they are experiencing losses and find that they must increase their rates and/or reduce coverage. For example, this company stopped issuing an endorsement that broadens the coverage. They stripped their basic policy coverage and have tightened up on their risk acceptance. This company has sent a notice to the agent through email and many agents don’t read every single email or review a new form that was attached thereto. Many agents just don’t keep up their education and depend on lower premiums to be their sales motivator. They are renewing their client’s policy without advising them about the coverage changes or the reduction in their coverage because many don’t even know that things have changed. Many agents just turn the client over to the Customer Service Representative and trust them to process the renewal. Many of the CSRs just routinely renew a policy and just know that they have a stack of work they need to finish. Do they know you? Do they really care about you? It was once said that an employee worries about their job. A good employee worries about the client, and the relationship they have with them. From my experience, through many years of dealing with employees, more and more employees only worry about their job. The social media is now their focus, and many do spend more time at work doing social media than worrying about the client. Perhaps you have seen that with your employees. As an apartment owner, you too need to constantly upgrade your education, and your employee’s education. If you don’t, you need to find and use an “educated insurance agency.” Either

your agent or you need to educate your clients, the renters, on their need for insurance to cover their personal effects and liability exposure and why knowing and following your rules and regulations are important. Your agent can’t educate your renters on your rules and regulations, as that is your responsibility. As you start 2014 you need to make a decision on what you want to do and then do it. You Can Successfully Defend Disability Lawsuits BY THOMAS B. CUMMINGS, ATTORNEY

I

n 1990, the United States Congress enacted the American’s with Disabilities Act (ADA), intending to require places of public accommodation to provide accessible facilities for disabled Americans. Congress hoped to provide equal access for people with disabilities concerning various “architectural barriers” that disabled people could encounter. California law follows the Federal law through the Unruh Act. Conditions included parking in passenger loading zones, curb ramps, stairs, elevators, drinking fountains, toilets, handrails and grab bars, signage, telephones and counter heights, among other subjects. Unfortunately, a small group of disabled persons, and a small group of lawyers, have filed multitudes of lawsuits against small businesses under questionable circumstances. Some disabled people, and some lawyers, may aggressively file lawsuits where they perceive some “architectural barrier” to a disabled person even if the disabled person was not impeded in any way by the claimed condition. Some disabled people appear to spend their time looking for potential violations of the ADA, and upon locating such a potential condition; they will photograph the condition and then promptly notify an attorney to file a lawsuit. Current popular subject matters of lawsuits are parking spaces, bathrooms and stairways. Typically, a disabled person who files a lawsuit under the ADA has suffered no actual damages. The 2 4

disabled person and attorney attempt to negotiate early settlements for somewhere between $4,000.00 and possibly $15,000.00. The California law establishes a guideline for damages if there is a violation, with damages to be three times the handicapped person’s “actual damages”, but no less than $4,000.00 minimum. The bigger exposure in defending ADA suit is a claim that the attorneys can make for attorney fees under the California Civil Code. Attorney fees often can be in the area of $20,000.00, even where there is no claim for actual damages sustained but the disabled person. As business owners, you might be sued by a disabled person, even where you are in compliance with the ADA or if the buildings were constructed before the passage of the ADA. The plaintiff in such case and the attorney will use the threat of an award of attorney fees against your business to attempt to negotiate an early settlement in the $4,000.00 to $15,000.00 range. Defense of ADA Lawsuits There is good news regarding the defense of ADA lawsuits. These cases can be successfully defended if your business is in compliance with the ADA. If a person’s claim is not valid, juries in Orange County will not be sympathetic with the plaintiff, even if the plaintiff is disabled. Juries typically come up with the right decision, and bizarre jury verdicts such as in the O.J. Simpson case are

the rare exception, rather than the rule. If you are sued by a disabled person on an ADA claim, if your business is in compliance and there are no architectural barriers, you can send a message to that person and the attorney that you will defend the case aggressively. If the case is defended successfully, the law may allow you to collect all of your attorney fees back from the person and the attorney who brings the nonmeritorious lawsuit, if a judge determines the lawsuit was frivolous. There is even the possibility you can recover a penalty of sanctions from the disabled person and the attorney. If the claim brought against your business in non-meritorious, and a jury rules in your favor, you can not only recover your attorney fees and costs from the opposing party, but the jury verdict also sends a message to other persons and other attorneys that they should not be filing lawsuits that have no merit. The successful defense of one lawsuit may prevent the filing of other suits. Should you be sued by a disabled person on an ADA claim, fully investigate that claim to determine whether it has merit, or whether it is meritless. If the claim is meritless, you should consider an aggressive defense and stand up for your rights. You can successfully defend such a lawsuit, and hopefully discourage other people from pursuing other lawsuits against you and your colleagues. Disability — continued on page 30 F E B R U A R Y

Your People Are Your Brand! Are They Ready? BY ROMMEL ANACAN

U

ntil they merged with United Airlines I made a decision that I would never again fly Continental Airlines. Ever. This was all because of one bad experience I had with a member of the Continental flight crew while traveling. After this experience whenever I saw a commercial or marketing piece for Continental, I thought of this crew member and how she treated me. No amount of colorful airline livery or fancy marketing would ever replace the fact that to me that flight attendant was Continental Airlines. And since I didn’t like my experience with her, I didn’t like the company. Period. End of story. What does this have to do with your company? I don’t care if your CEO has degrees from Harvard, Yale and Oxford; if your executives have every certification given in the multi-family universe; if your regional managers are the most intelligent and articulate groups of regionals the industry has ever seen… to the average customer, they are not your ‘brand.’ The people sitting behind the leasing desks are your brand. The people answering the phones at your community, responding to emails, monitoring your social media spaces and taking clients on tour are your company to the average customer. Remember your first day? My very first property was an ultra-luxury community in Newport

Beach. Rents for a one-bedroom home started at $1,860 and went all the way up to over $4,000 per month. Now how much time and effort do you think was spent preparing me to be the face of this mega-multi-million dollar community and of the company’s brand before I met with my first client? About, one hour. On my first day I was given the tour, handed the keys to the model and golf cart, showed where my desk was and given the book of 23 floorplans and a site map. I shadowed the business manager on one tour and then was then let loose to help customers and become the face of this iconic community. How good do you think I was in my first 30 days? Not very. And listen, I was a pretty good performer in my previous jobs. I managed a multi-million dollar retail operation-and had been in some type of supervisory or management role since I was 20 years old! It wasn’t as if I was a stranger to sales! Yet the adjustment to the property management industry was tougher than I expected. I just wasn’t a very good leasing agent in my early days. Our office was very busy, with everyone having numerous things on their plates, so I was really expected to figure things out on my own, or by watching the senior leasing consultant, until I received my formal training a month later. When I got the chance to manage my own community I didn’t want my people to go through what I went

through. I didn’t want someone to become the face of my community and company (and me!) without preparing them for the role. Here is what I did: 1. I developed a leasing on-boarding program. I walked my new hires through a comprehensive training program — giving them all of the tools, techniques and secrets that I learned during my career. (Eventually my company adopted some of these ideas and created an on-boarding program for all associates.) 2. I didn’t allow my new hires to help clients until they went through the program and felt they were ready. This period lasted anywhere from one week to two weeks, depending on the person. 3. I personally worked with and trained my new team members because I wanted to be the dominant influence in the early stages of their careers. I’m not going to lie, doing these things meant more work for me! There were times that I thought I was nuts to do all of this. But when the first shops came in at 90% or above, I knew it was worth it! When my leasing agents achieved things in their first couple of months that took me much longer, I knew it was worth it. n spite of the continued woes of the economy, small business owners are showing increased optimism about the next 12 months, according to a recent Wells Fargo/Gallup Small Business Index survey*. How Much Should You Keep in Rental Reserves? BY ATTORNEY WILLIAM BRONCHICK

“Cash is King”, so they say, and investor would be wise to keep an adequate cash reserve for things that can go wrong in real estate, particularly rentals. It is easy to buy real estate with no money down, but it’s difficult to survive when you have no cash set aside for a rainy day. There’s no magic formula you can use to determine how much you should keep in reserve in the real estate business. When I have rental properties, the four key factors I consider are strength of the local rental market, eviction time line and cost, the age of the property, and the type of neighborhood. Strength of the Local Rental Market The lower the vacancy rates in your area, the fewer reserves you’ll need for

vacancies. Your local newspaper or your city’s housing department may have articles or statistics on vacancy rates. You should, at a minimum, have enough cash reserves to pay for one month of vacancy per unit, which is only an 8-percent vacancy rate. Even in a good market, you’ll deal with problem tenants who may stop paying rent and require an eviction. Good tenant screening will help solve this problem. If you plan to rent properties, you should always,without exception, do a rigorous background check on tenants. This includes reviewing credit reports, employment verification, references, and calling current and previous landlords. Eviction Time Line and Cost The length of time it takes to evict a tenant is relative to your cash reserves. In pro-tenant states like New York and Massachusetts, it could take months and thousands of dollars in legal fees to evict a tenant—all while you’re paying the mortgage. In addition, in our experience, collecting back rents or damages from tenants who’ve been evicted can be futile. Age of the Property With newer and recently renovated properties, you won’t need to anticipate many repairs in the first few years. As noted earlier, we recommend that you always hire a professional property inspector before you buy. Inspectors will go through the property with a fine-tooth comb, which helps ensure

you’ll have no surprises later on. Another thing to keep in mind is that many utility companies offer a fixed monthly payment option so you don’t experience payment swings each season if you’re paying for heating, water, or other utilities as the landlord. Type of Neighborhood If you’re renting properties in lowincome neighborhoods, you can expect the turnover to be much higher than in high-income areas. In addition, multiunit buildings with small units and one-bedroom condos will attract more single people who tend to move more often than families. Cash flow management is the bedrock of survival in any business, with real estate being no exception. Investors must be careful not to run out of cash or they will be soon out of business. NAA Community Site & Online Resource Center now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible. Beta testers found the site to be exciting and informative. “I am a new manager and enjoy learning from others; hearing the first hand experiences, etc. I like finding so much information in one place,” said one beta tester.
