Apartment Renovation as a Tool in a Pricey Marketplace

I

nvestors seeking apartment assets in the rarefied air of Orange County often confront seemingly daunting cap rates. Of course, as oft mentioned in this space, one must consider that OC is at or near the very top of the food chain in terms of the most desirable multifamily markets in the nation. A large and diverse economy offering well paying jobs, an infrastructure of attractive cultural, recreational and educational opportunities, outstanding weather and the fact that we are wedged between two other economic powerhouses — L.A. and San Diego — are among the many factors that make it so. These attributes breed confidence that apartment revenues will remain strong in OC and that the risk of cash flow disruption is low relative to other regions, which leads us to conclude that high apartment prices in OC compared to other markets has rational underpinnings. That acknowledged, one might ask whether there is a way to mitigate the high entry costs to acquire OC apartment property. On this topic I spoke with Jim Stoneman, a principal in Newport Beach based, The Management Works, which owns/manages 580 units, mostly in Orange County. They search for apartments that can be renovated or otherwise “transformed” into higher yielding real estate. Stoneman is constantly surveying 4

the marketplace for property that has been neglected or allowed to fall into disrepair. Price discount due to non “turnkey” condition may lead to a healthy boost in return on investment after renovation work is done. Some of the things he watches for: • Graffiti on the subject or surrounding properties is a red flag; • Upgraded retail in the surrounding area (e.g. strip malls) is a positive since it means other investors are deploying capital into the area; conversely, surrounding retail with substantial deferred maintenance suggests caution; • A fairly high mix of single family homes in the area is a plus versus neighborhoods characterized with a high concentration of similar looking apartment properties; renovations tend to impact less where properties up and down the street are similar; spruce ups get more bang for the buck where they can be positioned to stand out more; • Buildings with long term tenants, say 10 years +, often feature rents that have languished below market and ownership that may have overly avoided turnover and allowed deferred maintenance; this suggests a buy opportunity; Stoneman points out that renovation work must be properly integrated. He recently saw a building with new

kitchen cabinets and granite countertops, but popcorn ceilings left intact. The property continued to look dated due to the ceilings and rent value was blunted accordingly. While unit interiors are where his company spends the bulk of renovation dollars (they feel that interior amenities are the most important consideration for the resident), exterior appearance/ “curb appeal” is still important to maximizing rents. Stoneman pays attention to building entries, which he thinks set the tone for the overall feel of a property. He has added columns and raised façade heights at the front of buildings to improve aesthetics and cost effectively update appearance. And if a parking area must be redone, include a modicum of landscaping, he adds. Small touches like this in renovation inject character that the property would otherwise lack, which in turn translate to investor return over time. Stoneman also likes pavers to border walkways — again, a relatively small expense that noticeably beautifies the property. If you buy with a renovation plan in mind, Stoneman tends to factor in an eighteen months for design, permitting, construction and resident turnover. Not everyone has the time, capital, skills and patience to take on apartment renovation, but those that do will extract premium return. O C T O B E R

Readers of this column know well enough the economics of rent control, but from time to time it can be helpful to have a good preacher remind the choir of the lyrics of the hymn. Rent control might sound great, but it is wrong headed. Rent control offers a seemingly short term fix with disastrous long term consequences. Rent control, by pricing housing units below market prices through government fiat, creates a shortage of affordable housing. Rent control establishes a financial disincentive to improve existing properties. Finally rent control, and the distortion it creates, depresses property values in the cities where it is enacted. It was comforting to read the support the Orange County Register Editorial Board offered. “Rent control may be well intentioned, but it carries far too many negative and unintended consequences,” the editorial board opined. “H.B. council right to keep rent control off ballot,” the Orange County Register Editorial headline read. Fast forward to Monday August

With mounting pressure from the Manufactured Housing industry, the press, renters, as well as supportive actions from industry partners — the multi-family rental housing community, the realtors, the builders, and other individuals who support, embrace, and defend private property rights — the Huntington Beach City Council saw the light. A special meeting was called to re-agendize the matter. Following a late Monday night of emotional comments from both the podium and the dais, two member of the Huntington Beach City

Council reversed course on their original vote. The City Council voted 4–3 to kill the rent control ballot measure. This was a tremendous victory. A victory for advocates of property rights, foes of the ill-conceived notion of government price fixing (often called rent control), and a victory for those who would dare to challenge the conventional wisdom… You can fight City Hall.

End of Session Remnants

T

he good news is that every session must end, sometime. Often raucous, always entertaining, the last days tend to try the patience of participants and onlookers alike. The rush to get something done, anything, that had been hanging fire for a year, or even more. Or, unlike their brethren that have met innumerable cut-off deadlines and committee hearings, these are the coming out days of the “mushroom bills” that are conceived in the dark, nurtured with something sometimes called money, and see the light of day only in the closing moments of a session, bypassing all the rules and regular order of procedure. The halls around the Senate and Assembly chambers are filled with lobbyists and their employers ready to deal, to strike a bargain, albeit not unlike a Turkish Bazaar. And it’s not just the little minutia of legislative trivia, most of which has already been acted

upon, but major issues of the day are often relegated to this cacophony. So it was this year, again. While cruising toward a reasonably uneventful session ending, watching several bills of particular interest that were awaiting final legislative approval, up popped a most distasteful dose of a regurgitated proposal that had been badly trounced exactly one year earlier. Barely more than a week before the close of the session, SB 411 was gutted and amended to become one of this session’s most anti-landlord bills of the year. A 2-page labeling bill to increase from 75% to 85% the amount of olive oil originating from particular geographical wine-growing regions suddenly became the 16-page anti-landlord bill from Hell. Sponsored and supported by tenant groups and some fellow travellers, including a few utility billing services like American Utility Management, the bill imposed a severe

challenge on the limited resources of most of the NAA affiliated regional apartment associations. But AAOC, AACSC, the San Diego association and others rose to the challenge, rallied forces and beat back this midnight assault with the unwavering and useful assistance of others, including the Nation’s and this state’s largest utility services company, National Water and Power. What might have been but was severely trashed were a litany of tenant wishes now gone South. Tight billing standards and timelines, with no margin for error; limits on service cost recovery; special rules regarding notice and repair, including a remarkable provision that prohibited interruption of water service for any reason whatever. Huh? How do you repair a broken water line or replace a faulty submeter without shutting off the water? The list went on and on to result cumulatively in a procedurally and substantively

unworkable bill. Thanks to all who participated in helping to defeat this unwelcome late bloomer. A year-end roundup of all the bills considered in this session will be forthcoming in a later edition. For now, however, with an election just around the corner, it is time to take an early look at the ballot propositions before the mail and media storm begins. As reported in these pages over the last several months, the Legislature has wrestled with competing water bond measures to replace a previously approved $11.14 billion measure already scheduled for November as Proposition 43. Agreement was finally reached on a substitute $7.12 billion water bond, which by special legislative direction will appear as Proposition 1 in a supplemental voter’s guide in lieu of the larger bond measure. And a Budget Stabilization measure, that earlier had been designated as Proposition 44, will appear as Proposition 2. This measure requires an annual transfer of a fixed percentage of state general fund revenue to a budget stabilization account to be used for debt retirement and budget deficits or emergencies. The odd numbering sequence will surely cause some voter confusion as the normal sequence resumes with Proposition 45. Proposition 45 is an initiative measure sponsored by the State Insurance Commissioner to give that office jurisdiction over health insurance rates similar to the oversight now exercised by that office for auto and property insurance rates. This measure faces uncertain fate as rates and conditions of health service providers are now largely negotiated through Covered California, the state-directed insurance exchange operated under the auspices of the Affordable Care Act. Proposition 46 will no doubt engender intense debate regarding its true purpose. It requires drug testing of doctors and review of a statewide database before prescribing certain controlled substances. It also increases the $250,000 pain and suffering cap in

medical negligence lawsuits to account for inflation. That would put the cap at about $1.1 million with annual adjustments thereafter. This will likely be ground zero for all out war among doctors, lawyers and insurance companies. Fiscal impact on local governments will likely be substantial, to say nothing of the overall financial impact on malpractice insurance rates which were largely stabilized after the 1987 truce pact. Proposition 47 is an initiative measure to require a misdemeanor sentence instead of felony for certain lower level drug and property offenses. Proposition 48 is a referendum on certain Indian Gaming compacts, with a “Yes” vote approving and a “No” vote rejecting the negotiated agreements. Perhaps the most interesting proposition is the one that will not appear on the ballot. What had been designated as Proposition 49 was ordered removed by the California Supreme Court following a challenge to its legality. This legislative measure (SB 1272) would have placed the advisory question whether the United States Congress and California Legislature should approve an amendment to the federal Constitution overturning the United States Supreme Court decision in Citizens United v. Federal Election Commission. The Citizens United case held that laws placing certain limits on political spending by corporations and unions are unconstitutional. In throwing what would have been Proposition 49 off the ballot, the California Supreme Court found that advisory voting was impermissible because it lacked any legal status, i.e., it did not enact enforceable law. A byproduct of this decision was to cut the legs off another advisory voting bill then pending in the Legislature relating to immigration. The history of this issue makes interesting reading. This is from the Senate staff Analysis of SB 1272: “While statewide advisory elections are uncommon, in at least two other instances in California’s history, one or

more statewide advisory measures have appeared on the ballot. At a statewide special election in June 1933, voters rejected Propositions 9 and 10, which asked the voters whether the Legislature should divert gasoline tax revenues to the general fund to pay off highway bonds. These two measures were put on the ballot by the Legislature. Additionally, at the November 1982 Statewide General Election, voters approved Proposition 12, a measure that urged the United States government to propose to the Soviet Union that both countries agree to immediately halt the testing, production and further deployment of all nuclear weapons, missiles and delivery systems in a way that could be checked and verified by both sides. Unlike this bill, however, the advisory question decided by the voters in 1982 was placed on the ballot by initiative. Subsequent to the voters’ approval of Proposition 12 in 1982, the California Smock — continued on page 18

oke up last night to the sound of my neighbor’s tree crashing through the roof of my garage. Not the whole tree, but sure seemed like it at three in the morning! A giant branch broke off his oak tree, came crashing down, and took out the fence and half of my garage. I think there is more to come; this oak tree is very old, and has lots of branches that seem to all grow my way, many are thirty feet or more in the air, and extend twenty to thirty feet into my property. What are my rights? Can I make him cut down the tree?

Overhanging tree branches are considered a nuisance and can be abated. Your neighbor, if the tree is his, will be responsible for the damage caused by the falling tree branch. Additionally,

you have certain limited rights to use ‘self-help’ to prevent further damage or injury. The courts recognize your right to cut the tree branches that extend beyond the property line, provided that such self-help does not adversely affect the health of the tree. i.e. you can trim, but you can’t kill it! Alternatively, you could file a civil action for recovery of your damages and to abate the nuisance by requesting the court to order the neighbor to “abate the nuisance” by trimming the tree. You cannot require your neighbor to ‘cut down the tree’ nor can you require him to trim beyond the property line. One issue to check before you get too upset with your neighbor is to see where the trunk of the tree sits. If the entire trunk originates entirely on your neighbor’s property, then it is

his tree, and he bears the responsibility for any damage it may cause. If the tree ‘straddles’ the property line, then you and your neighbor own the tree as tenants in common. In that case, it doesn’t matter how much is on his or your side, you own it equally, and are equally responsible. In that case, neither property owner may remove the tree without the adjoining neighbor’s permission. You may trim the branches that extend in your direction, but may not destroy the tree. My folks are getting on in years, have limited income and are considering renting out one of the bedrooms of their house to a local college student. They could use the extra income, and it might

I’m not sure it’s a good idea though; I’m afraid that if there is a problem, and the kid doesn’t leave peacefully, that my folks will have to go through a full blown eviction. Not sure if that is worth the time, expense and emotional aggravation! Your thoughts?

The good news is that provided your folks own the home, and it is a single family residence, and they only rent a part of it to one person, the ‘lodger,’ then there is an little known exception to the requirement of filing an unlawful detainer action to remove him or her. Upon expiration of the termination notice, 7 days if week to week, thirty days if month to month, then the uncooperative lodger can be physically removed pursuant to California Penal Code Section 602.3 as a trespasser. No civil action is necessary and your folks will not have to file and prosecute an unlawful detainer action. The lodger will be guilty of an infraction and may be arrested by either your folks, you as their agent, or the local gendarmes (police/sheriff). I understand that the Thirty Day and Sixty Day Notices to Vacate have been changed to comply with changes in the law. What changed?

Since January 1, 2013, all Notices to Terminate Tenancy, whether thirty day or sixty days, must include specific

language on the face of the notice in order to be valid. The necessary language is as follows: “State law permits former tenants to reclaim abandoned personal property left at the former address of the tenant, subject to certain conditions. You may or may not be able to reclaim property without incurring additional costs, depending on the cost of storing the property and the length of time before it is reclaimed. In general, these costs will be lower the sooner you contact your former landlord after being notified that property belonging to you was left behind after you moved out.” You should ensure that the notices that you are using contain the required language. In the event you have any recent notices that have been served and not yet expired, you should ensure that they contain the correct language. In the event you or your attorney proceeds with an unlawful detainer action based on a notice that does not include the required language, then the court can rule in the tenants favor and require you to start over. I am one of three on-sight managers for a large complex. Recently, I had a couple enter the manager’s office and request an application to rent a unit. I had several vacancies, but the prospective tenants looked as if they had not bathed in a week. Also, as they drove up to the manager’s office, their Ford Fairmont looked like it was on its last leg, and filled the parking lot with smoke. I imagined that

You spent time, resources and patience organizing tours of apartment communities with elected officials, including members of Congress, candidates for the House of Representatives and even state legislators. The reports were overwhelmingly

positive as these current and potential policymakers learned some things they did not know about our industry while building relationships with their constituents. At the same time, our case for reauthorizing the Terrorism Risk Insurance Act and stopping EPA’s proposed clean water act rule was made. A hat-trick of grassroots advocacy wins. Nice work, team! As summer yields to fall, all eyes

in the political world are turning to the handful of Senate races which will determine whether Republicans take over management from Democrats. For a state-bystate breakdown of these races, I refer you to www.cookpolitical.com and Charlie Cook, one of the best prognosticators in the business and with whom we partner to brief NAAPAC donors on campaigns and elections. I would sum up the state of play by saying that most if not all of the Senate battleground races are still toss-ups. This is much to everyone’s surprise based upon how these races looked on paper six months ago. Republicans are not pulling ahead as was anticipated so these races will go down to — and in the case of Louisiana potentially past — the wire. There is even a scenario where we end up with a 50–50 tie. Who would be the tie-breaker? Vice President Joe Biden! Being that many of you are probably working on your budgets for next year or at the very least plotting out travel on your calendars, I am going to make

an early pitch for the 2015 Capitol Conference, which takes place on Tuesday, March 17 and Wednesday, March 18. More of you participated in the conference this year than ever before and we are committed to drawing even more next year. We’re enhancing the content for this conference with more advocacy education and even better speakers. Perhaps most importantly, doing your part to help the apartment industry only takes two days and nights out of your schedule. There will be a new Congress and as always lots of issues to discuss with the members of the House and Senate. More information will follow soon. I hope you will make it a priority. I’ll close with a request (please keep reading…I promise you it’s mostly painless). Everyone in the multifamily industry knows the value of information and rarely proceeds on any transaction without having as much as they can. NAA believes this as well and seeks to fill in some gaps with our annual

Income and Expense Survey which provides a wealth of information on property operation expenses and revenue. We’re now working to expand the resources devoted to research that will benefit you and your business. Certainly, we in government affairs have a long list of policy issues into which we would like to dive deeper. But we won’t go into this assuming we know what research would serve you best — we need you to tell us that. ear Maintenance Men: I understand moving in a new resident from the management’s point of view. What do you recommend as a move-in procedure from a maintenance background? I always worry about handing over a set of keys to a new resident who will now have control of a very expensive rental unit. What should I be thinking about maintenance wise for this new

move-in? Tom Dear Tom: Interesting question! It’s true we sometimes think the move-in procedure is complete once the resident passes all the background checks, pays their money, signs all the paperwork and is given the keys to the unit. We believe that the move-in procedure is far from complete if the new resident is not “Checked-out”

on the operation of the rental unit. A major source of maintenance issues and costs come from a new resident not knowing how to safely operate the moving parts of their unit. A short list of items that a resident may or may not know how to operate are as follows: 1: Garbage disposal unit. 2: Vertical and horizontal blinds. 3: Dishwashing machine.

4: HVAC system or heating and cooling systems. 5: And anything else that could break or be a safety issue. Many of you might be saying to yourselves; “Who does not know how to operate any of those items.” You would be surprised! Top of the list of most abused items are garbage disposal units and blinds. Dear Maintenance Men: I have heard the terms “Proactive and Reactive” in connection with property maintenance. Can you explain the difference as it relates to apartment maintenance? Richard

Residents, who live in a community that practices proactive maintenance stay longer, pay higher rent and take better care of their units and grounds. With a proactive maintenance policy in place, residents are more likely to report problems before they become emergencies. here are many, many ways to sabotage your business. And, chances are, your staff is doing some of these now on the phone and in person. And worse yet, you’ve probably even heard some of this yourself (ouch!). That’s the bad news. The good news is we’re able to bring to you the top five sabotage practices and then show you how to neutralize the effects. So get ready. It’s a sure sign that the employee has not been shown how to explain something to the customer. This phrase is used as something to say when the employee doesn’t know what to say. When the customer hears “I have no idea” they immediately respond (usually silently) with, “you gotta be

you need.” This is far more effective than telling someone it’s not your department. And please don’t say, “You have the wrong department.” Take full responsibility with the “I” statement. 3. I Wasn’t Here That Day (or I was on vacation when that happened) This one really makes me laugh. Does that excuse the company? I don’t remember asking them if they were there that day. Do you really think the customer cares if you weren’t there when their problem happened? Honestly, they don’t, so that’s not even an issue to discuss. Just tackle the problem head on. Apologize without telling them where you were…or weren’t. Remember, you ARE the company whether you were at work or on vacation when the issue occurred. 4. I’m New So? Okay, you’re new. Now what? Does being ‘new’ allow you to be anything but super to the customer? When

the customer hears this sabotaging statement, do you really think they say, “Oh, so you’re new? So that’s why I’m getting bad service? Well, then that’s okay…you’re new. Now I understand.” Yes, even if you are new, the customer honestly believes you should know everything about your job. Here’s the Telephone Doctor answer on this one. Tell the customer, “Please bear with me, I’ve only been here a few weeks.” That will buy you time. And a bit of sympathy. For whatever reason, hearing the short length of time you are with the company means more to the customer than, “I’m new.” Again, I’m new is more of an “excuse.” Remember to state the length of time. It’s a creditability enhancement. “I’m new” is a creditability buster. 5. Silence on the Phone or a Blank Stare in Person I called the doctor’s office the other day and asked to change my appointment. It went down like this:

Congressman Royce met several representatives of our Rental Industry and AAOC Board members at McFadden Village Apartments in Tustin. McFadden Village is owned by Santa Fe Management, a member of AAOC. AAOC Executive Director Lou

Penrose, Legislative Committee Chairman and Vice President Legislative Council, John Tomlinson, Board Member Julia Araiza, and Education Committee Member Jessie Childers represented AAOC. Jessie is also the Property Supervisor for Santa Fe Management, which hosted the meeting. JoAnna Baker, Director, Emil and Irina Cioban, Resident Managers, and Carlos Aguirre, Maintenance Tech, represented Mc Fadden Village. Also present was Congressional Aide Tyler

Thompson and guest Dr. James Rosenthal. Coping With Caregiver Costs BY JASON SHERR

ore Americans are facing rising caregiver costs. The financial challenge of caring for an aging parent can also create caregiver stress. Don’t allow caring for an aging parent or spouse to become a crisis. Nearly 10 million adults over the age of 50 provide care or financial support for aging parents. Their ranks have swelled significantly over the last decade and will continue to grow,

according to a study on caregivers by MetLife.* The cost of providing care for a loved one — whether an ailing spouse or elderly parent — can be daunting. Beyond medical expenses, such as inhouse or nursing home care, it can also include lost income due to the large time commitment. The MetLife study estimates caregiver responsibilities for the average person age 50 and older can result in

a total of more than $300,000 in lost wages and benefits. There is some good news. There may be ways to provide for an aging parent or loved one without jeopardizing your finances now or in the future. Here are some strategies to consider. Discussing the situation with your employer as soon as possible may help create a better position for yourself. For example, you may be able to negotiate flexible work hours that allow you to take time away for doctor appointments. Your employer may also be willing to allow telecommuting options. Working from home might allow you to stay productive while meeting the needs of your ailing spouse or parent. Review Your Parent’s Finances While your parent is still healthy, sit down to discuss his or her financial situation. Talk about everything from retirement savings and monthly Social Security benefits to current health care premiums and housing costs. These discussions can give you a better handle on just how much finan-

cial support you may be expected to provide. Your Financial Advisor can help you weigh your options, and may be able to serve as a neutral third party during conversations with your parent about financial matters. Your parent’s financial situation may even make her eligible for certain benefits. One example is income. If your parent’s annual income is relatively low, you may be able to claim him or her as a dependent on your tax return. This may defray the cost of care. Talk with your tax advisor before doing this to see if your situation qualifies. Make sure your parent has an upto-date estate plan. Be sure to review financial powers of attorney and health care proxies. You should understand what is included in these documents. Is an appropriate person named who has the authority to make critical financial or health care decisions if your parent becomes incapacitated? These meetings should make your

parent’s wishes clear. Get (Free) Help If your parent lives with you and needs periodic care during the day, hiring an in-home nurse can be expensive. It is likely not covered by Medicare. Check on alternatives in your community. Many religious groups and local social service agencies provide free or low-cost care or companionship for elderly adults. These can help reduce your out-of-pocket caregiver costs. Also check with your family. Other members may be able to participate in your loved one’s care and provide scheduled breaks for the primary caregivers. To avoid surprises and reduce stress, talk to your loved ones about their wishes well in advance. Buying, Selling or Exchanging Income Properties... Is Now the Time for You? BY R AN DY COM BS

I

think most of us would agree that Rental Income properties have been one of the best investments someone could make. The key to any investment in Real Estate is understanding the true value of the property as it relates to other investment options and when you purchased in the 18 year real estate cycle. Appraised price is mathematical, but value is tough to measure and unique to each person. One person’s inherent valuation is different than another. Why? The level of risk tolerance and length of time to hold the property are factors in determining if the asset fits your goals. New owners should also consider how the property will fit within their current portfolio (location, management, etc). Once you determine income property is right for you, consider where we are in the real estate cycle. Look carefully at metrics to gauge if you are buying in a high or low market. Common metrics investors use are; Capitalization Rates (or Cap Rates), Gross Rent Multipliers (GRMs), Price per Door, Internal Rate of Return (IRR), and many others. Which one is the correct measure? The short answer is — all of them and none of them. It depends on your unique circumstances (hold period, down payment, cash flow needs, and desired return). They should be used together to determine the right investment return and sales prices to yield that return. Lastly, don’t forget your “gut”. Instincts are a powerful tool

to help with determining your next step. “Risk versus Reward” When an investor is purchasing an apartment building — they are buying a stream of cash flows and return on their initial investment. If there is debt on the asset, the cash flow will be reduced and your risk increased. On the flip side, leverage and appreciation are the keys to long term wealth. So the right amount of debt is key to maximize your returns! The higher your down payment, the greater you cash flow and less risk of losing the property if the market takes a dive. How much should you put down? It depends on where the market is at, the amount of working capital for the property and alternate source of cash flow. Let’s consider this scenario. An investor has recently come into $1,000,000 dollars in cash and wants to maximize his return on this money with investments that best fit him. He has an average risk tolerance and has a 10–15 year time horizon. Mr. Investor considers the following options. 1. Keep the money in the Bank — savings account, IRA, or other interest bearing account. 2. Equity and Bond Markets. Purchase established company stock, bonds, etc. 3. Purchase 4 unit apartment.

typical in today’s market. They are the traditional “safe” routes that most investors have as part of their portfolio. As our investors already have these buckets covered, they are interested in option #3, income real estate. This option comes with increased risk, but also the potential for much higher returns. Property ownership differs from other options as you can add value by upgrading the property, increasing rents, adding additional revenue streams and reducing expenses. Owning multiple properties diversifies your portfolio and increases your potential return, but it comes with more time requirements and higher risk. Ultimately, it will depend on the classic “risk versus return” scenario. Which investment choice seems to be a better option? The answer is unique to each investor and varies based on your investment risk and overall portfolio. However, a good option for Mr. Investor could be a 40% equity position in a property within a stable long term area with upsides for improvements and rents. This allows for remaining cash for working capital and future upgrades if needed. Again, the financial measures need to make sense and the property must fit within your goals. If you are fortunate to be the owner of multiple income properties — you are in a great position with investment options. The key to purchasing real

Up to 25 percent of residents are charging rent to their credit cards and an increasing number pay electronically in communities with the highest penetration, says Julie Smith, President, Bozzuto Management Co., a midAtlantic company that manages approximately 25,000 apartments. Credit card payment benefits

ith many credit card companies touting free airline miles, points or cash back with purchases, pulling out a platinum card at the cash register can have credit card users dreaming of freebies. But if swiping a credit card during a quick trip to the grocery store is the slow, steady way to earn a free flight, using the credit card to pay rent will have renters vacationing in no time. Community managers say more apartment communities are offering

renters in a variety of ways, making it an important amenity for apartment communities to offer. But it also carries costly fees that are causing some companies to think twice. Swiping Rent — continued from page 40 Dynamics, High Point, N.C. “It’s just a great convenience.” Plus, she says, “If I pay by credit card, I get whatever rewards my credit card offers.” Residents also can use the option if they are traveling and forgot to pay before they leave, says Diana Pittro, Executive Vice President of RMK Management Corp., a company that manages 8,000 apartments in the Chicago area and allows residents to pay with a credit card through a Web portal for an added fee. “If someone is paying with a credit card, it’s because they’re out of town and forgot to pay or they’re really trying to rack up miles.” Even with the convenience of electronic payments, some residents still walk in on the first of the month to hand in the rent. “They want to talk to you, they want to have a cookie or they want to have coffee,” Pittro says. “Nothing replaces human interaction.”

Financing Rent Residents appreciate having an alternate option of how to pay rent, says Cindy Clare, CPM, President of Kettler Management, a regional firm with 13,000 apartments in the Washington, D.C., area. “It gives you a unique marketing position,” she says, which can lead to higher resident retention and can entice residents to choose one of the company’s communities. Credit cards also encourage more prompt rent payments, Gwyn says. If a community’s late payment deadline is on the 11th, but the resident’s payday is on the 15th, they can temporarily finance their rent. The amenity also helps during the leasing process. “If somebody comes in to rent an apartment, and all they have is cash or a credit card and you don’t take either, or if they didn’t plan to rent and they only have a credit card, they may never make it back to the office,” Gwyn says. Accepting credit card payments

electronically can save time for office staff, says Trevor Bert, Controller at Westdale Asset Management, a Dallasbased investment and management company with properties in the South. The company recently rolled out a platform called PropertyBridge to accept electronic rent payments; Westdale used to accept credit cards only at machines in the office. “That was a very inefficient process for us, mostly in terms of interruptions in the office,” he says. “In going to more electronic and online payments, it brings more convenience to renters and it has really cut our costs.” Mounting Costs Like any amenity, offering credit card payment comes at a cost. Owners must pay a 1.95 percent fee on charges with American Express and an average of more than 2 percent for Visa and MasterCard, says Kettler’s Clare. At a Swiping Rent — continued on page 44

Paying those high fees can still be worthwhile for some owners. “In an environment where rents are not going up, you need to justify it with higher occupancy, higher rents or higher retention,” says Bozzuto’s Smith. “While certain communities are able to justify it, others cannot quantify the return and, as a result, owners are backing away.” Some companies have developed strategies to reduce those costs. Credit card fees are higher if residents pay by phone or do not include their 3-digit security numbers, so Gwyn says some communities are encouraging residents to come to the office and swipe their credit cards. E-Options Several third-party Web sites allow residents to pay with credit cards online

Craving Convenience Among the top reasons for the consumer shift to electronic payments are the increased convenience and security of payment card transactions and consumers’ abilities to earn rewards. MasterCard research studied why consumers sign up for electronic payments and discovered the following: • 69 percent sign up because they help prevent missing payment due dates. • 42 percent sign up to save time by not having to mail a monthly payment. • 38 percent sign up to earn ongoing rewards. • 34 percent sign up to receive incentives or bonuses. • 30 percent sign up to save on postage. Not surprisingly, usage drops significantly if residents must pay the fee, and residents may be unhappy at losing the option. “If you’ve been absorbing the charges and residents have gotten used to it, there could be some pushback,”

Smith says. “It’s one of those things like any other amenity--a concierge or free breakfast. It becomes something to which residents feel accustomed or entitled. New California Law Entitles Employees to Paid Sick Leave BY CHRISTINE D. BARAN, ESQ., FISHER & PHILLIPS, LLC

n September 10, 2014, Governor Jerry Brown signed into law AB 1522, the “Healthy Workplaces, Healthy Families Act of 2014.” This law will require California employers to grant employees, including some part-time and temporary employees, at least 3 paid sick days each year. Accrual of Sick Leave Beginning July 1, 2015, employees who have worked 30 or more days in California within a year of their employment will accrue paid sick leave. Paid sick days must accrue at a rate of one hour for every 30 hours worked beginning upon the commencement of employment or on the effective date of the statute. Employers may limit employees to using 24 hours (or three 8-hour work days) of paid sick leave per year, and employers may cap total accrual of paid sick days at 48 hours (or six 8-hour work days). Employees can begin to use their accrued sick leave on the 90th day of their employment. Employees may decide the amount of leave they need to use, however employers may set a reasonable minimum increment of two hours. Accrued, but unused, sick days must carry over into the following year subject to the 48 hour/six-day accrual cap. An employee is not entitled to be paid for accrued but unused sick days upon resignation or termination of employment. However, if an employer re-hires an employee within a year of his or her separation, the employer must reinstate any unused sick leave that was previously accrued.

Employers with existing sick leave or paid time off (PTO) policies do not have to provide additional leave, as long as their policies: (1) satisfy the AB 1522 accrual, usage, and carry over requirements; and (2) provide no less than 24 hours of paid sick leave annually. Qualified Use for Leave Paid sick days may be used for the diagnosis, care, or treatment of an existing health condition for, or the preventative care of, an employee, or an employee’s immediate family member. Covered family members include spouses, registered domestic partners, children (regardless of age), parents (including step-parents and parentsin-law), grandparents and siblings. Paid sick days are also available for employees who are the victims of domestic violence, sexual assault, or stalking. Employees must provide “reasonable advance notification” of their need to use the leave as soon as practicable. The law specifically permits these requests to be made orally or in writing. Notice and Recordkeeping Requirements Employers must provide employees with written notice of their available amount of paid sick leave or PTO leave provided in lieu of sick leave. This notice must be either on the employee’s itemized wage statement or in a separate writing provided on the employee’s pay date at the time wages are paid. AB 1522 also imposes new record retention requirements. Employee usage and

accrual must be documented and retained for at least three years. These records must be made available for employee inspection within 21 days of a written or oral request. If an employer fails to keep adequate records, it will be presumed that the affected employee is entitled to the maximum number of accruable hours under the law. At the time of hiring, new employees must be provided, as part of the Wage Theft Prevention Act notice, notice of their entitlement to paid sick leave and their right to file a complaint with the Labor Commissioner where violations occur. Employers will also be required to post a workplace notice from the Labor Commissioner regarding this new law. Applicability of AB 1522 This law will not apply to individuals who provide in-home supportive services, certain air carrier employees such as flight deck or cabin crew members subject to the federal Railway Labor Act, or employees covered by a valid collective bargaining agreement that expressly provides for paid sick days. However, unlike other California leave laws, there is no exemption for small employers. Part-time and temporary employees are covered as well. NAA Community Site & Online Resource Center Now Live NAA launched the NAA Community Site & Online Resource Center in November, and all members can log into the site to take advantage of the newest NAA member benefit. The new Web site is an online network for professionals in the apartment industry. NAA members can become engaged and interact with other NAA members and staff through virtual interest group communities and share their experiences and seek opinions or advice in online discussion forums. Through the Online Resource Center, users will be able to quickly access a huge and ever growing collection of apartment-specific resources. The site is easy to use, and features a number of video tutorials on how to use the site’s different features, as well as a list of FAQ to help NAA members navigate the site as easily as possible. Beta testers found the site to be exciting and informative. “I am a new manager and enjoy learning from others; hearing the first hand experiences, etc. I like finding so much information in one place,” said one beta tester. Paid Sick Leave — continued from page 47 action occurring within 30 days of an employee engaging in certain protected activity. Protected activity is broadly defined as: (1) filing a complaint with the Labor Commissioner for violations under this law, (2) cooperating with an investigation or prosecution of a violation of this law, or (3) opposing an employer’s policy, practice, or act that violates this law. This presumption of retaliation is an unprecedented addition to California leave laws. The Labor Commissioner is charged with authority to enforce and regulate AB 1522. Upon finding a violation of the law occurred, the Labor Commissioner may order “any appropriate relief ” including reinstatement, backpay, payment of unlawfully withheld sick days, administrative penalties, and enforce

ment fines payable to the state. The law also authorizes the Labor Commissioner or the Attorney General to institute a civil action, on behalf of aggrieved employees, to seek as reinstatement, backpay, administrative penalties, liquidated damages, and reasonable attorney’s fees.

Employers should also consider revising their employee handbook to account for these changes, as handbook language regarding sick leave that is not compliant with this new law might be used in an attempt to establish a violation of this new law.

Preparing for this Law In anticipation of these sweeping new changes, California employers should update their sick leave and record retention policies to ensure compliance. Managers and supervisors need to be informed of the company’s new policy changes and advised of their added responsibilities. Employers must also ensure that their employee wage statements for California employees comply with the new notice requirements under AB 1522.
