HOME BUYING EXPLAINED ARRANGING YOUR MORTGAGE Before you begin the search for your ideal property, it is recommended that you get your finances in order. Bannerman Burke Properties recommend leading mortgage advisors in the area who can research a wide range of available mortgages to find the best deal for you. This will determine how much you can afford, which will influence your property search. DEFINE YOUR PROPERTY CRITERIA Decide what you are looking for in a property – whether you need parking and a garden, how many bedrooms you need, if it’s a flat and pick an area on which to focus your search. Consider what you want out of the location – are local schools, transport links and shops important to you? REGISTER YOUR INTEREST Register your interest with Bannerman Burke Properties. Once we have a clear understanding of your requirements we will provide a shortlist of suitable properties that match your criteria. We can also keep you constantly up-to-date via our online mailing system when the latest properties become available. VIEW SUITABLE PROPERTIES The most important part of the house hunting process is a property viewing. You are unlikely to find the home you want straight away so don’t despair and don’t be tempted into edging over your budget. This is probably going to be your biggest financial outlay, so it is worth waiting until you find the right place. Once you have viewed a property, if you believe the property has potential, arrange for a second viewing to see how it feels the second time around. There will be a home report survey available for all properties. Make sure you request this from the agents and inspect the document in order to satisfy yourself with the property’s overall condition. MAKE AN OFFER Once you have identified a suitable property, we will put forward your offer to the vendor (seller) both verbally and in writing. You may need to demonstrate, if requested, that you are able to proceed (e.g. provide evidence of your mortgage agreed in principle and proof of funds for the deposit).

INSTRUCT A SOLICITOR The successful purchase of a property can be reliant on the instruction of an efficient and experienced solicitor. It is a good idea to use a solicitor who specialises in conveyancing. Bannerman Burke Law are tried and tested local solicitors that are experts in conveyancing, who operate at competitive rates and who we would be happy to recommend. ACCEPTANCE OF YOUR OFFER Once your offer is accepted we will prepare a Memorandum of Sale which is sent to all parties including your solicitor and the vendors solicitor confirming the agreed price and any special conditions. You will now need to instruct your solicitor to proceed with the conveyancing process and your mortgage advisor to proceed with your mortgage application. MORTGAGE OFFER A refreshed Home Report survey may be required by the bank if the original home report is more than 12 weeks old. This will identify any problems or value changes in this time. The cost of this is usually met by the seller. SIGNING OF CONTRACTS (MISSIVES) After your solicitor or conveyancer has completed all the necessary checks you’ll be asked to sign a contract, legally committing you to the purchase. At this point you will usually agree a date to complete the sale. COMPLETION This is when the property finally becomes yours. When your solicitor tells you that the sale is completed we will arrange for you to pick up the keys. Finally you can move in.

Meeting all of your legal needs and at every stage of your life

Help with buying and selling your property Buying or selling a property is recognised as one of life’s more stressful occasions. Don’t panic. At Bannerman Burke, our aim is to remove as much of the hassle and stress from the process as possible. We always put the interests of our clients first and you can rely on us to ensure the smoothest possible transition to your new home. Basics of a property transaction In Scotland, properties are bought and sold based on a written contract known as ‘missives’. Your solicitor enters into the contract on your behalf. Over the years, Scots Law has developed some standard types of missives clauses but they don’t always suit every transaction. Buying a flat in the centre of a town has different challenges to buying a cottage in the country. There can be issues over shared access rights, common repairs, even car parking. That’s why it is important that your solicitor is able to examine the title deeds that relate to the property as we spot any unusual issues and advise you how to resolve them. Making sure you get the property you think you are getting, and paying for, is the most important task for a property solicitor. Buying a property If you want to buy a house, you start by instructing your solicitor to make an Offer on your behalf. This is the start of the process of negotiating missives which form the contract. Sometimes missives can be concluded quite far in advance of the date of entry, but there are other times where the missives conclude right before the transaction is due to settle, particularly if there have been issues to resolve. These can range from ensuring proper consents are in place for alterations, to enquiries into dampness, or wood treatment. We will always make sure you are kept fully informed all the way through a transaction and if at any time you have a query, we will respond as quickly as we can to assist you. Selling a property When you put your property on the market with our Estate Agents at Bannerman Burke Properties Limited, you can be sure that you are getting a first-class service. We know the local market intimately and can advise you on the best options for selling your property. When we receive an offer, our conveyancing team will commence the work needed to ensure your sale proceeds efficiently. We will meet with you to discuss the offer so we can issue a Qualified Acceptance on your behalf. This is the next stage in the negotiation of missives as there will be things in the offer that we might want to change or ‘qualify’. The negotiation process can go back and forward a little but eventually we will have concluded missives and that is the final formation of the contract binding the parties into the transaction. Relax We appreciate this can all sound a bit daunting but the advantage you have in dealing with us is that we are long established, experienced professionals in the Scottish Borders. When you instruct Bannerman Burke, you know that you are in good hands and can relax in the knowledge that as our client, you are our priority. We will ensure that your property transaction is progressed to your satisfaction and you will be able to enjoy your new home stress-free. Other services Don’t forget that as a ‘full-service’ legal firm, Bannerman Burke Law can also look after all your other legal needs for you and your family. We can help you with Wills and Powers of Attorneys, family issues, debt matters and more. So no matter what life throws at you, you can be safe in the knowledge that we can help you navigate your way through to a satisfactory conclusion.

GLOSSARY OF TERMINOLOGY ADDITIONAL DWELLING SUPPLEMENT (A.D.S.)

BUILDING SURVEY (FORMERLY FULL STRUCTURAL SURVEY)

ANNUAL PERCENTAGE RATE (APR)

BUY-TO-LET MORTGAGE

An additional LBTT supplement on purchases of additional residential properties in Scotland (such as buy-to-let properties and second homes) of £40,000 or more.

The APR is a compound interest rate figure used to compare different mortgages. The APR shows the true cost of borrowing over the entire term and should appear on all mortgage illustrations.

SHARE TRANSFER

The concept of ownership of a share transfer property does not mean that you own a property. When you buy a flat or unit by share transfer, you are in fact purchasing shares in a company.
