One more soldier, militant killed toll reaches 8
Srinagar, August 25: One more army soldier was killed and another sustained injuries on Monday in a fresh firing incident as the twin encounters enters second day at Lolab and Keran forests in north Kashmir’s Kupwara district. Since Saturday night, four militants and two soldiers have been killed and three army men were injured in the encounters at Kalaroos and Keran in the district. Official sources told GNS that army’s 18 RR and 28 RR had jointly cordoned the routes connecting the Nunwani Kalaroos forest area after 2 or 3 militants managed to escape from the Nunwani encounter site.
“Today morning the joint team of forces intercepted the militant group at Zoita Top near Bara Gali in between Nunwani and Gagel forest areas”, they said. Once the joint army party chased the militants, they opened heavy-fire upon the forces resulting in injuries to two army men, they said. The injured army men were identified as Ghulam Ahmad (rifle man -160 TA) and Dhanjay (lance naik -28 RR). Srinagar, Aug 25 : Srinagar police solved a hit and run case and arrested the Sumo driver who knocked a school girl to death in Srinagar last year. After a relentless investigation, Srinagar police tracked a Sumo and its driver who knocked a school girl Khushboo Posh daughter of Mohammad Aslam Posh resident of Batwara, Srinagar near JK Bose crossing when she along with her friends were returning back from the BOSE office on 16th November, last year. The girl after being hit by the Sumo was shifted to JVC hospital by her friends in the same Sumo which hit her. On seeing the critical condition of the injured girl the erring driver had fled away from the hospital leaving the injured girl at the mercy of fellow girls. The girls
could not note the registration number of the involved Sumo. Later the injured girl succumbed to her injuries in Soura hospital. A case FIR number 334/2013 under section 279, 304 RPC was registered in Police Station Parimpora in this regard and investigation was taken up. During the course of investigation a number of Sumo’s including those which were moving as per the tower locations on the same date around the time of occurrence were brought and their drivers put to sustained questioning. Police continued the efforts and succeeded to get a clue and identified the Sumo vehicle bearing registration number JK15/3017. Keeping in view the apprehensions of fresh infiltration army has been advised to launch combing operation in the respective areas.” The official further said that the Northern Army Commander Lt Gen DS Hooda commended the troops for the sustained operations against the militancy and paid rich tributes to soldier Dhananjay Kumar for his courage displayed by him in the line of duty. “Our hearts reach out to the family of the martyr and we pray to the Almighty to give them courage to bear this irreparable loss with fortitude,” the General said. Man falls from slab: dies
Srinagar, Aug 25 (KNS): A deaf and dumb person slipped and fell to death from a slab in Ompora Housing colony, Budgam. Police has started investigation in this regard. 58 year old deaf and dumb person Ali Mohammad son of Ghulam Ahmed resident of Chankhana, Sopore at present Housing Colony Ompora fell from slab of a house belonging to Farooq Ahmed Malik at Ompora Housing Colony Budgam and got injured. He was shifted to District Hospital, Budgam for treatment where he succumbed to his injuries. After completing all medico-legal formalities, the body was handed over to his legal heirs for last rites. Police has started investigation under section 174 CrPC to ascertain the cause of the death. Army reaches out to village Tsaka
Srinagar, Aug 25 (KNS): A Medical, Dental and Veterinary Camp was organised today at village Tsaka of Chushul Block, Sub Division Nyoma for the local populace. The Medical Camp provided facilities of free medical checkup and treatment, dental treatment and veterinary treatment of the cattle. A team comprising three Army Doctors treated the patients and also distributed free medicines to the villagers. A team of Veterinary Doctors and Assistants examined the cattle and provided the locals with free medicines. The Camp was well received by the villagers and a large number of villagers and many a cattle were examined and treated. The locals were also educated on the aspects of hygiene and sanitation in the village to prevent the outbreak of diseases. The local populace appreciated the services rendered at the camp and applauded the dedicated and selfless services by the Army in the far flung and remote areas of Eastern Ladakh. (KNS)
Teacher arrested for molesting a girl student Pattan, Aug 24,S: Police Monday lodged a formal case against a government teacher for allegedly trying to assault a 9th class girl student sexually in North Kashmir’s Pattan town of District Baramulla. Police sources told CNS that a Biology teacher posted at Government Higher Secondary School Sherabad Khor Pattan called a 9th class girl student (name withheld) to class when other students were enjoying break in the school premises. “The staff members and students were shocked when they heard screams of the girl student. They ran towards the class and found the girl student weeping and wailing,” a police official said adding that the girl student alleged that the teacher tried to
assault her sexually. Reports said that parents of the victim approached police station and lodged a formal case against the accused teacher. The accused teacher was reportedly thrashed by locals and taken to police station. “We have arrested the accused teacher and a case vide FIR number 198/2014 under section 354A has been registered against him,” a police official said identifying the culprit as Muhammad Irfan Khan son of Muhammad Afzal Khan. Teachers Forum Pattan Zone while condemning the action of accused teacher demanded stern action against him. The Forum said that such teachers are the source of disgrace for the sacred education institution. (CNS)
J&K would oppose war mongering: Mehbooba Calls for restraint, restoration of ceasefire
Srinagar, Aug 25 : Urging restoration of complete peace and ceasefire on the Line of Control (LoC) and International Border (IB) with Pakistan, Peoples Democratic Party (PDP) president, Mehbooba Mufti Monday said the two countries can’t ignore the yearning for peace in Jammu and Kashmir without pushing the region into more miseries. Addressing a number of roadside meetings in Dooru segment of her Anantnag parliamentary constituency, she said the PDP wants to make it clear to the national leadership and the government of Pakistan that the people of the state would resist through all democratic means the heightening of tension between the two countries. District president Peer Mohammad Hussain, Senior leader Party’s nominated candidate for Doru Syed Farooq Andrabi, Shameema Andrabi and others were also present on this occasion. Mehbooba said while temperatures are raised as a result of war room tactical games the only sufferers are the people of J&K. She said it is the life and property and sense of security of the people of J&K which are in the line of fire and her party would channelize and strongly register the opposition of the people of Jammu, Kashmir and Ladakh to war mongering and use of weapons across the LoC and IB. She said every bullet or a mortar shell fired hits only the residents of this state whether they are on this side or the other. Stressing the need for building a strong peace initiative from within the state she said more than a decade back the then Prime Minister, Vajpayee in an impressive display of statesmanship had opened a new chapter in the blood soaked history of India and Pakistan by responding to the urge for peace and dignified resolution during his historic visit to Srinagar. “The people of the state especially those living in border areas had experienced an entirely new found peace and environment of security after the 2003 ceasefire with Pakistan,” she said.Mehbooba said till then the only demand of the people living in these areas was about providing shelter and bunkers but post

She expressed her grief at the loss of life in recent escalation along the borders. Conveying her sympathy and solidarity to the families of victims of firing on borders, Mehbooba said there is no reason why the Prime Minister, Narendra Modi should not employ similar peace offensive as the one initiated by Vajpayee with Pakistan so that the hawks on both side are silenced and the people of J&K get a reprieve from constant war and threat of it. She Referring to the local problems Mehbooba said the people have brought to her notice the widespread complaints about non-availability of ration and water for irrigation and drinking purposes. She said there is an acute scarcity of food grains which needs to be immediately addressed. Similarly, she said the horticulture in the area needs a rescue act by providing irrigation as in other parts of the Valley. Mehbooba said the apparent impact of the National Highway tunnel which is under construction seems to be the possible closure of the toll post at Lower Munda. She said its closure would affect a large number of the people who are making some earnings out of small businesses. She said the government should ensure retaining the toll post at its present location.Mehbooba expressed concern at the reports of major geological changes taking place in the area as a result of the construction of railway tunnel. She was told that about a dozen springs had dried up after the construction of the tunnel. She said while development projects can’t be avoided the environment considerations must be kept in view so that Kashmir valley does not lose any of its valuable assets. (KNS)

Income Tax Ombudsman: Take his help to Redress Your Grievances
A
s a taxpayer, you may have some very legitimate grievances relating to your income-tax matters of settlement of your claims. You may, for example, feel that the Income Tax Department owes you a certain refund of tax but it is not doing enough to hear your grievance of complaint nor taking action to redress it. You may also be aggrieved about the rude behaviour of officials or their failure to follow instructions and circulars of the Board. In all such cases, you can approach your Income tax Ombudsman. Before you do so, however, you have to ensure that certain conditions are fulfilled. The Ombudsman is governed by, and has to act within, the framework of the Income Tax Ombudsman Guidelines, 2006. The institution of Ombudsman is of Scandinavian origin. The Ombudsman enquires into grievances or complaints against the functioning of a public authority. In our own country, the Income tax Ombudsman is appointed by the Central Government. He is usually a person with vast experience in tax administration, but functions independently of it. At present, the Government has appointed Ombudsman at New Delhi, Mumbai, Chennai, Kanpur, Chandigarh, Pune, Bhopal, Kochi, Kolkata, Hyderabad, Bangalore and Ahmedabad. What Grievances can you take to the Ombudsman
indicate/provide: a) The name, address and PAN of the complainant; b) The name and designation of the official who is being complained against (this should invariably be the junior most officer who has given rise to the grievance, not below the rank of an Income Tax Officer)’ c) The facts giving rise to the complaint; d) Supporting documents; and e) The relief sought from the Ombudsman. iii. The Ombudsman will accept complaints filed through the electronic media if they are otherwise in order, but the print out of such a complaint has to be signed by the complainant at the earliest. After he does so, the complaint would relate back to the date on which it was first received electronically. A complaint shall not lie to the Ombudsman unless in the first instance, the complainant had also made a written representation to the superior authority of the officer complained against. Also, a complainant can complain only if he has received no reply and more than one month has passed since he submitted his representation. Alternatively, he can also complain if he has received a reply but he is not satisfied with it, or if his representation has been rejected. No complaint can be made: i. 12 months after the reply was received from the superior
You can complain to the Ombudsman about your grievances relating to delays in disposal or settlement of claims connected with: a. Issue of refunds; b. Interest waiver petitions; c. Appeal effects; d. Rectification applications; e. Release of seized books of accounts and assets; f. Allotment of PANs/ issue of PAN Cards. You can also complain of such matters as failure to:a. Give credit for taxes paid, including tax deducted at source; b. Maintain transparency in selection of cases for scrutiny; c. Follow the guidelines, circulars and instructions of the Central Board of Direct Taxes; d. Observe proper working hours by Income-tax officials; e. Acknowledge letters and documents forwarded by the assessee; f. Maintain or update records and registers leading to harassment. “A person can also complain about any unwarranted rude behavior of Income Tax officials with assesses.” Etc., For further details, please refer to clause 9 of the Guidelines.

Remember, the Ombudsman will not take cognizance of the complaint if it has been the subject matter of : a. an earlier settlement made by the OmbudsmanOR b. an appeal, revision, reference or writ before any Income-tax authority or a court of law. On receiving a complaint, the Ombudsman shall forward it to the officer complained against and shall endeavour to settle it by an agreement through either conciliation or mediation. If the officer cannot settle the grievance by agreement with the complainant within a period of one month, or such further time as the Ombudsman may allow, the Ombudsman will mediate and try to bring about an agreement. If he still does not succeed, he can make an ‘award’.
Procedure to be Followed
On receiving complaint, the Ombudsman will examine it to see if certain basic conditions laid down in the guidelines have been fulfilled or not. He cannot take notice of the complaint unless these conditions are fulfilled. These conditions are: i. The complaint should have been signed by the complainant as well as his authorized representative, in case the complainant is represented by such an authorized representative. ii. Powers The Ombudsman has the following powers:
i) He can receive complaints on matters indicated in clause 9 of the Guidelines. ii) He can consider these complaints and settle them either by agreement through conciliation and mediation or by passing an appropriate award. iii) He can require the Income-tax authority concerned to provide any information or furnish certified copies of relevant documents required by him. iv) In the event of the failure of an Income-tax authority, to furnish such information or documents (indicated in para iii above), he may
draw an adverse inference. v) He can suggest remedial measures for redressal of grievances. vi) He can also report his findings to the Secretary, Department of Revenue and Chairman, C.B.D.T.
Duties The duties of the Ombudsman are to:
i) Exercise powers of superintendence and control over his office. ii) Maintain confidentiality of information coming into his possession and not divulge the same to third parties, except with the consent of the person who furnishes such information. He may, however, divulge such information to an opposing party to the dispute in order to reasonably comply with the principles of natural justice. iii) Protect the taxpayers’ rights and reduce their compliance burden. iv) Identify issues that increase the burden of compliance and bring the same to the notice of the CBDT and Ministry of Finance. v) Furnish a monthly report to the Chairman, CBDT and Secretary, Department of Revenue recommending appropriate action including that to be taken against erring officials. vi) Furnish an annual review of the tax administration to the Chairman, CBDT and Secretary,
Department of Revenue. vii) Compile a list of awards made by him during the financial year and report the same to the Chief Commissioners concerned and Chairman, CBDT so that the same can be taken into account while writing the Annual Confidential Reports of the officials concerned.
Nature of the Proceedings
The proceedings before the Ombudsman are quasi-judicial in nature. He is not bound by any legal rules of evidence. He is expected at all times to be fair and reasonable while performing his functions.
Nature of Awards
As already indicated, he shall try to settle a complaint by agreement in the first instance. If such agreement is not forthcoming within a month or such further time as the Ombudsman may allow, he may make an award. This shall be speaking order and shall clearly specify the directions to the authority concerned- including making of an apology. The award, however, cannot affect the quantum of total income or tax assessed or the penalty already imposed. The Ombudsman can award compensation upto Rs. 1000/- for the loss suffered by the complainant. Such compensation will be the first charge on the budget allotted to the authority complained against. The award shall be binding on the department but it shall be binding on the assessee, only if he issues a letter of acceptance within 15 days of its receipt. If the complainant does not accept the award or fails to furnish a letter of acceptance within 15 days or further period of
15 days if the Ombudsman permits, it shall lapse and be of no effect. If it is accepted by the assessee, the authority complained against has to implement the award within one month of its having being made. Compliance of having done so has to be reported to the Ombudsman.
Check List
A check list has been prepared to help you file a complaint. This is given below: 1. The complaint has not been signed by the complainant. 2. It has not been signed by the authorized representative. 3. It does not contain:a. The name and address of the complainant b. Supporting documents c. Details of the relief sought from the Ombudsman. 4. It has been made electronically but the hard copy (print out) does not have the complainant’s signature. 5. The complainant does not seem to have reported to the immediate superior of the officer complained against. 6. More than one month has not passed before the representation to the immediate superior was filed. 7. The complainant does not appear to be aggrieved with the reply received from the immediate superior. 8. (a) The complaint has been made after the expiry of one year
from the receipt of the reply of the immediate superior; OR (b) Where no reply has been received from the immediate superior: The complaint has been filed after the lapse of 13 months from the date of filing of the representation before the immediate superior. 9. The complaint is the Subject matter of an earlier proceeding with the Ombudsman. 10. The ground(s) of the complaint is/are also the subject matter of a proceeding in appeal, revision, reference or writ before an appellate authority or a revisionary authority or a Court of Law. 11. The ground is not covered by Guideline 9 of the Income Tax Ombudsman Guidelines, 2006. 12. The complainant is represented by an authorized representative but no power of attorney to represent the complainant has been filed before the Ombudsman. Remember, the answer to every statement in the check list should be negative. A positive response to statements are Sr. No. 1 to 7 and 12 would indicate that the complaint is defective and the Ombudsman cannot proceed further to redress your grievance till the defect is removed. A positive response to statements at Sr. No. 8 to 11, on the other hand, would indicate that not only is the complaint defective but it is also incurable. No purpose would be served by filing such a complaint. We all have a positive responsibility in making this institution effective. We can do so by ensuring that we eschew the defects indicated in the check list given above and avoid filing frivolous or vexatious complaints.
