Kashmiris main stake holders: mainstream parties ahead of the assembly elections in the state. Senior NC leader and former parliament member from South Kashmir Dr Mehboob Beg told KNS that Modi is taking hard stand on Kashmir in view of the coming state elections and that as the elections would end, he would follow Vajpayee’s policy on Kashmir. Beg maintained that Kashmir cannot be addressed sans the inclusion of Kashmiris in the process as they are the main stake holders of the Kashmir issue. Pertinently, hours after the Pakistan High Commissioner, Abdul Basit, defended his meeting with the Kashmiri separatists, India hit back saying there were only two stakeholders on Jammu and Kashmir - India and Pakistan, asking the neighbouring country to respect past accords on truce. "After 1972 and the signing of the Shimla Agreement by the Prime Minister of India and Prime Minister of Pakistan, there are only two 'stakeholders' on the issue of Jammu and Kashmir - the Union of India and the Islamic Republic of Pakistan. This is a principle which is the bedrock of our bilateral relations. This was reaffirmed in the Lahore Declaration of 1999 between PM Nawaz Sharif and PM Vajpayee," a statement issued by the MEA said. (KNS)
Encounter rages in Keran sector, 2 militants killed Srinagar, August 20: Two militants were killed in an ongoing encounter at Keran sector in north Kashmir’s Kupwara district on Wednesday evening. Shafi accuses Congress of sabotaging NC’s employment plans
Srinagar, Aug 20 (KNS): The gulf between national conference and the Congress got further widened on Wednesday when the member parliament and senior NC leader Mohammad Shafi Uri accused Congress of creation hurdles in addressing the mounting unemployment problem in the state. Shafi said that Congress right from the day one it allied with the National Conference to form the government in Jammu and Kashmir has been sabotaging the governance on the ground.

Basit defends meeting separatist leaders New Delhi, Aug 20: Pakistan High Commissioner in New Delhi Abdul Basit Wednesday reiterated that Kashmiri people are the prime party to Kashmir dispute and his meeting with separatist leaders of Kashmir is legitimate. He said that Pakistan has been meeting them (separatist leaders) for the past several years and it has been a long-standing practice. He said that it is important to engage with all stakeholders and that is the bottom-line. Talking to reporters in New Delhi, Pakistan High Commissioner said that Kashmiri people are legitimate stakeholders of Kashmir dispute and in no way his meeting with them is illegal and illegitimate. “You have your national positions, we have ours. We have to look at these issue dispassionately,” Abdul Basit said. Basit was reacting on the decision of India to call off Foreign Secretary level talks with Pakistan after he met Kashmiri separatist leaders at his Embassy office in New Delhi. Srinagar, Aug 20: Banks operating in J&K State have extended credit aggregating Rs.2,570.02 Crore to 92,135 beneficiaries both under Priority and Non-priority sector during first quarter ended June 2014 of the FY 2014-15. J&K Bank alone has disbursed Rs.1707.13 Crore which accounts for 66.42% of the total credit disbursed by all the banks in the state under the annual action plan of the current financial year. This was stated by Mushtaq Ahmad, Chairman & CEO, J&K Bank (Convenor J&K SLBC), while addressing the 94th meeting of J&K State Level Bankers’ Committee (SLBC) today at SKICC Srinagar. Srinagar, August 20 : As the government of India declared that Kashmir is a bilateral issue between India and Pakistan, the mainstream camp here ridiculed the union government’s assertion saying people of Kashmir are the main stake holders of the issue. Opposition PDP while reacting over the statement said that Kashmir issue touches the skin of every resident of Jammu and Kashmir and that the people here have a right to present their point of view. PDP’S chief spokesman and legislator Naeem Akhtar said that the people of the state are the real stake holders of the Kashmir issue as the bullets being fired in Kashmir don’t pierce through the chest of people staying in New Delhi or Islamabad. Two Kashmiri students expelled in mid-session Meerut, Aug 20: After expelling ten Kashmiri students in March this year for allegedly cheering for the Pakistan Cricket team, Swami Vivekanand Subharti University Meerut has suspended two more Kashmiri students whose names according to their parents never figured in the controversy that time. In March this year, at least 67 students were expelled by Swami Vivekanand Subharti University for allegedly cheering for Pakistan cricket team. After the intervention of the State Government the University authorities revoked the suspension order of 57 students while the fate of remaining 10 students was decided by Disciplinary Committee which after finding them ‘guilty’ expelled from the University. The expelled students were later on adjusted in Sri SAi University Palam Pora and APG Univer-
sity Shimla. “Everything was running smoothly now but three days before I received a letter from the Swami Vivekanand Subharti University authorities in which I was asked to take my son back to his home as they have suspended him from the University,” the father of a Baramulla student Sheikh Ashfaq told CNS. Gujrat manufactured EVM’s provided to J&K Kamal casts doubt
Srinagar, Aug 20: The State Administration has procured at least 15,000 Electronic Voting Machines (EVMs). Officials told CNS that all these machines have come from Gujrat and these were procured only after Election Commission of India approved them to cover all 10015 polling stations. A top district administration official told CNS that for the first time all the EVM’s have come from Gujrat. “All these ENM’s have been manufactured in Gujrat while Election Commission of India after verifying and inspecting them has come to believe through these machines any
kind of rigging or bogus voting could be easily checked,” he said. The officials said that these new EVM’s are equipped with several such features that were capable of detecting the rigging and bogus voting. The Election Commission office in Jammu and Kashmir would soon be conducting first trial of the EVMs. “These EVMs apart from being completely temper proof have a unique feature of displaying date and timing of start and closure of voting. This new feature of the EVMs would nullify any attempt by anyone to temper with the EVMs or indulge in bogus voting,” officials said. Meanwhile, criticizing Elec-

The position is quite satisfactory”, he said. He said that under priority sector, the banks have disbursed an amount of Rs.1340.95 Crore to 63,985 beneficiaries thereby achieving 11% of target in financial terms and 9.48% in physical terms. The first quarter usually remains sluggish but the banks have to make strenuous efforts to achieve at least 80% of the Annual Credit Plan by 31st December 2014, he added. He cautioned the banks about the paltry credit disbursement in education sector. “The low appetite under the scheme despite zero rate of rejection of cases is a cause of concern and needs serious introspection”, he said. Under Non-Priority Sector, the Chairman said, banks have disbursed Rs.1229.07 Crore to 28,150 beneficiaries thereby achieving 16.32% of target in financial terms and 13.49% in physical terms. Regarding Credit Deposit Ratio, the Chairman observed that CD Ratio of all banks operating in the State at the end of quarter under review stood at 46.47% as against 39.40% during the corresponding period of previous year. The trend is encouraging but there is lot more to do to achieve the National Benchmark of 60% CD Ratio, he said. Under Government Sponsored Schemes in the State, the Chairman stated that, against the Annual Action Plan 2014-15 target of Rs 412.27 Crore to 21,280 beneficiaries for all banks operating in the State, the achievement of banks during the first quarter under five major Government Sponsored Schemes, viz. NRLM, PMEGP, NULM, JKSES and SC/ST/OBC is just Rs 42.63 Crore to 2006 beneficiaries across the state registering a performance of 10% of the target in financial terms and 9% in physical terms. Stressing upon all the stakeholders to put in strenuous efforts to improve the position under this vital segment, he said, “The achievement is not satisfactory by any standards.” Regarding the GoI, MoF initiative for 100% coverage of farmers under Kissan Credit Cards Mushtaq Ahmad said that banks have been able to achieve 79% of target till the end of June 2014 by sanctioning 7.73 lakh KCCs against the revised target to cover 9.81 lakh farm operating families in J&K State. Regarding non-achievement of 100% coverage of farmers under KCC Scheme upto the extended timeline i.e. 30th June, 2014 despite concerted efforts made by all the stake holders, he said, “The performance under this vital segment is a matter of concern.” The SLBC decided that the individual banks should take concerted efforts for covering the remaining farm operating families under KCC Scheme upto31st December 2014 which was fixed as the final timeline for 100% Coverage under the scheme. As regards EBT Scheme, he stated that in Phase-I the scheme has been implemented in six pilot districts of the State i.e. Srinagar, Ganderbal, Jammu, Rajouri, Kargil & Leh and benefits under IGNOAPS have been transferred successfully into the beneficiaries accounts. He further stated that data validation in respect of remaining 16 Districts is under process and these districts shall be covered under the scheme very soon. A special session on Comprehensive Financial Inclusion Plan was held in the meeting wherein representative from Department of Financial Services, MoF, GoI, A K Dogra gave a Power Point Presentation of the Plan. Priority Sector Review Under Agriculture Sector the banks have provided total credit of Rs 478.59 Crore in favour of 35,725 beneficiaries against a target of Rs 4004.55 Crore favouring 4,19,015 beneficiaries, registering an achievement of 12% in financial terms and 9% in physical terms, during the first quarter of FY 2014-15. Under Micro & Small Enterprises Sector, the banks have disbursed total amount of Rs 484.12 Crore in favour of 13,436 beneficiaries’ upto the end of Q1 of FY 2014-15 thereby registering an achievement of 12% in financial terms and 9.36% in physical terms. In Education Sector banks have disbursed a paltry amount of Rs16.09 Crore in favour of 666 beneficiaries during the period under review thereby registering an achievement of 3% in financial terms and 5% in physical terms. Under Housing Sector, banks have disbursed credit amounting to Rs.196.59 Crore in favour of 6,482 beneficiaries during the period under review thereby registering an achievement of 8% in financial terms and 17% in physical terms. Srinagar, August 20 (KNS): Hundreds of employees protested in press colony on Wednesday on the call given by Kashmir Joint Action Committee (KJAC), for regularization of daily Wagers and casual workers in Jammu and Kashmir. As the protesting employees reached press colony, the police asked them to disperse but they insisted on going ahead with the demonstration, following which fifteen of them were detained. They demanded that their pending salaries be released and paid regularly. The employees
have been frequently holding protest demonstrations, in support of their demands over the past several months. The protesters told KNS that their legitimate demands are not addressed by the state government over the past several months. ”We suffer and are on hunger strike from long time but the state government could not solved our problems. Soldier’s frozen body found after 18 years Srinagar, Aug 20: Indian Army has found the body of a soldier in general area of Siachen Glacier after 18 years. Army said that Havaldar Gaya Prasad of the 15 Rajput Regiment had gone missing from the Siachen Glacier in 1996 and after the expiry of 18
years, due to extremely low temperatures in the region the body of the soldier was found intact. Army said that on Wednesday, the body of the soldier was flown to his native place Mainpuri in Uttar Pradesh for his last rites. (CNS)

2G case: Delhi court gives bail to Raja, Kanimozhi, Karunanidhi’s wife Former telecom minister A Raja, DMK MP Kanimozhi and seven others, chargesheeted by the Enforcement Directorate (ED) in a 2G scam-related money laundering case, were on Wednesday granted bail by a special CBI court. “All the bail applications are allowed,” Special CBI Judge O P Saini said and asked them to furnish a personal bond of Rs. five lakh each and a surety of like amount. Earlier during the day, the court granted bail to DMK supremo M Karunanidhi’s wife Dayalu Ammal, who was also chargesheeted in the case. 83-year-old Ammal was given bail on a personal bond of Rs. five lakh with two sureties of the like amount. The court, however, dismissed the plea of Ammal seeking discharge in the case on the ground that she was not well and was suffering from unsoundness of mind. ED had chargesheeted 19 accused -- 10 individuals and nine
firms -- in the case saying that the transaction of Rs. 200 crore, which was allegedly paid to DMK-run Kalaignar TV, was “not genuine” and it was a “bribe for grant of telecom licences to DB Group companies”. Ammal was holding 60% stake in Kalaignar TV while Kanimozhi and Sharad Kumar were holding 20% stake each, the agency had said. It had also claimed that its probe into the case emanates from 2G spectrum allocation scam and the accused had allegedly conspired and committed offences under provisions of the Prevention of Money Laundering Act (PMLA). Besides Raja and Kanimozhi, ED had named Swan Telecom promoters Shahid Usman Balwa and Vinod Goenka, Directors of Kusegaon Fruits and Vegetables Pvt Ltd Asif Balwa and Rajiv Agarwal, Kalaignar TV MD Sharad Kumar, Bollywood producer Karim Morani, Ammal and P Amirtham as accused in the case.

She also announced that the year 2015-16 would be observed as the year of water conservation which would give an impetus to her government’s commitment to not only rejuvenate the Ganga along with other rivers across the country but also save water by involving citizens through a people’s movement. Plus Two schools: Govt to appeal against HC order Chief Minister Oommen Chandy said here on Wednesday that the government would go on appeal against the interim order of the High Court disallowing the sanctioning of higher secondary schools and batches without recommendation of committee headed by Director of Higher Secondary Education.Talking to the media after a meeting of the Cabinet, the Chief Minister said that the Court directive to issue notice to the Cabinet subcommittee, which had recommended sanctioning of schools in addition to those recommended by the Director’s committee, was not legally tenable. “If the Cabinet is merely to sanction list submitted by the Director, what is the need for a
democratic government?” he asked.Maintaining that the High Court order was not a set back to the government, the Chief Minister said that the schools were sanctioned because the Cabinet subcommittee was satisfied about the need. The Court itself had ordered earlier that schools should be sanctioned on the basis of need. However, it disallowed some of the schools on the ground that there was nothing on the file to establish their need. However, the government would be able to substantiate the need. Mr. Chandy noted that the government had specified that there should be 40 students in a new school in the first year and 50 in the second year for the Plus One course.

Fighting Cyber Crimes
W
ith the continual expansion of the ‘cyber world’ around us, more and more people and organizations are getting intertwined on the internet and other platforms, including the mobiles and the fast expanding ‘cloud’. This on the one hand has proved to be a boon for the business, establishments, enterprises, education field, interpersonal relations and the society as whole; but at the same time has also become a preying ground for the unscrupulous elements thereby providing innumerable and innovative ways of cheating and defrauding. This defrauding can take place not only with respect to financial losses but also in relation to reputation, privacy and networking websites, including matrimonial websites. As a result, there is a continuous effort on the part of the Government to take such steps as will prevent and punish the cyber crimes and their perpetrators so that even the common man can tread on the cyber highway without fear of falling prey to unscrupulous elements. In this effort the Central Government is working in consort with all stakeholders. As per the Crime Data /information maintained by National Crime Record Bureau (NCRB), 2,464 cases of crime such as hacking and others, were registered during 2012. A total of 1,440 cases were related to loss / damage to computer resource/ utility reported under hacking with computer systems (Section 66(1) of the Information Technology Act 2000) and 435 cases were related to hacking under Section 66(2) of the Information Technology Act 2000. For committing such crimes, 749 persons were arrested during 2012. There were 589 cases of obscene publications / transmission in electronic form under Section 67 of Information Technology Act, 2000 during the year 2012; wherein 497 persons were arrested. In addition, 259 cases of cheating through cyber forgery and 118 cases of cyber frauds were registered under Indian Penal Code (IPC) provisions. Further, as per the information provided by Reserve Bank of India 6,034 frauds involving credit /ATM/ debit cards were reported in 2013.
Fighting Cyber Crime Needs Concerted Efforts
Police and Public Order are State subjects under the Constitution and as such the State Governments and Union Territory Administrations are primarily responsible for prevention, detection, registration and investigation of crime including Cyber Crime and for prosecuting the criminals through Law Enforcement machinery within their jurisdictions. The Cyber space is virtual, borderless and anonymous. Anyone can open e-mail account in any name including fake name from any part of the world. Any user with any email address is allowed to register with social networking sites with any name including fake names. No background information check is performed by the social networking sites, which leads to creation of fake accounts by miscreants for committing
crimes/ frauds. Most of the networking sites are located abroad. The servers of these social networking sites are also located abroad. A total no. of 3, 45, 37 and 36 cases of fake accounts/ profiles on various social networking websites were reported to Indian Computer Emergency Response Team (CERT-In) in the year 2010, 2011, 2012 and 2013 (till November) by various Law Enforcement Agencies. CERTIn, further, contacted these social networking websites for disabling of fake accounts and for getting user access details of these fake accounts/ profiles. In most of the cases, such fake accounts were successfully disabled in association with social networking sites, having offices in India. However, success rate is low in disabling accounts and getting information from social networking sites having offices abroad.
Steps Taken by the Central Government to Prevent Frauds
Government has taken the following actions to prevent frauds by social networking sites and matrimonial sites: · Government has notified the Information Technology (Intermediary Guidelines) Rules 2011 under Section 79 of the Information Technology Act. These rules require that the Intermediaries, including national and international social networking sites and matrimonial sites, shall observe due diligence while discharging their duties and shall inform the users of Computer resources not to host, display, upload, modify, publish, transmit, update or share any information that is harmful, objectionable, affect minors and unlawful in any way. The said rules also require the intermediaries to appoint Grievance Officers to address the grievances received from users and affected individuals / organizations as and when received by them. · Government issued an advisory on 17th August 2012 to all the intermediaries, including national and international social networking sites, advising them to take necessary action to disable inflammatory and hateful content hosted on their web sites on priority basis. · Government also conducts awareness campaign on the issue to educate users. · The Government is in regular dialog with the intermediaries including social networking sites for effective and efficient disablement of such content.
Creating an Efficient Fighting Force to Beat Cyber Crimes
Fighting any type of crime needs a robust, dedicated, efficient and well-trained force and fighting cyber crimes is no exception. To train and develop Cyber Crime investigators, the Central Government has taken a series of steps, which include: · Ministry of Home Affairs has issued an Advisory to the State Governments and Union Territory Administrations to build adequate technical capacity in handling cyber crime including trained manpower for detec-
tion, registration, investigation and prosecution of cyber crimes. Also, under the Cyber Crime Investigation programme, Ministry of Home Affairs is supporting the establishment of Cyber Crime Police Stations (CCPS) and Cyber Crime Investigations and Forensic Training Facilities (CCIFTF) in each State / Union Territory of India under Police Modernization Scheme. Action also has been taken to set up a National Centre of Excellence exclusively devoted to render Cyber Forensic services and to act as National Research and Training Centre on Cyber Forensics. · A major programme has been undertaken on development of cyber forensics tools, setting up of infrastructure for investigation and training of the users, particularly police and judicial officers in use of this tool to collect and analyze the digital evidence and present them in Courts. · Indian Computer Emergency Response Team (CERT-In) and Centre for Development of Advanced Computing (CDAC) are involved in providing basic and advanced training to Law Enforcement Agencies, Forensic labs and judiciary on the procedures and methodology of collecting, analyzing and presenting digital evidence. · Cyber forensics training lab has been set up at Training Academy of Central Bureau of Investigation (CBI) to impart basic and advanced training in Cyber Forensics and Investigation of Cyber Crimes to Police Officers associated with CBI. In addition, Government has set up cyber forensic training and investigation labs in the States of Kerala, Assam, Mizoram, Nagaland, Arunachal Pradesh, Tripura, Meghalaya, Manipur and Jammu & Kashmir for training of Law Enforcement and Judiciary in these States. · In collaboration with Data Security Council of India (DSCI), NASSCOM, Cyber Forensic Labs have been set up at Mumbai, Bengaluru, Pune and Kolkata for awareness creation and training programmes on Cyber Crime investigation. National Law School, Bangalore and NALSAR University of Law, Hyderabad are also engaged in conducting several awareness and training programmes on Cyber Laws and Cyber crimes for judicial officers.
Enough Funds Provided for the Fight
A total budget of Rs. 2074.45 lakhs has so far been sanctioned by the Department of Electronics and Information Technology (DeitY) , Ministry of Communications and Information Technology, for implementing the projects to train and develop Cyber Crime investigators, forensic examiners, judiciary and setting up of cyber crime investigation training labs. Rs. 500 crore has been allocated for DeitY in the 12th Plan period (2012-17) for Cyber Security Programme including Cyber Safety, Security and Surveillance, Cyber Crime Investigations and Cyber Forensics.
