Dr. Robert Leder Nominated for WVMA President Elect

I am humbled to be nominated as the next president-elect of the Wisconsin Veterinary Medical Association (WVMA).

The WVMA is an amazing organization that is the voice of veterinary medicine in the state of Wisconsin providing great service and guidance to its members. My vision for the WVMA is to continue being Wisconsin’s proactive voice of veterinary medicine to government, industry, the public and within our profession. Twelve years ago I began my term on the WVMA executive board representing District 4. During that time of service I came to appreciate the teamwork of an army of volunteers, from all aspects of our profession, addressing issues confronting veterinary medicine and providing services to our members. The executive board and our committees are the working gears of our association. A new executive director was brought on board at the end of my term. Since that time the WVMA has become more engaged and proactive addressing the issues that confront veterinary medicine.

The only way that we can stay at that front of the wide and diverse issues we confront is to have input from everyone. Networking with the executive board and our committee members is critical to identifying the new issues on the horizon. This is your grass roots organization; your conversation is the fertilizer that keeps it growing. I hope that you engage in the conversation to make the WVMA even better. Biography

Dr. Robert Leder grew up on a dairy farm in North Central Wisconsin. He graduated from the University of Minnesota, College of Veterinary Medicine in 1982, and then completed a food animal internship at the University of Idaho’s Caine Veterinary Teaching Center in Caldwell, Idaho. Dr. Leder has been practicing veterinary medicine in Wisconsin since 1983, working primarily with dairy cows and farmers. He is currently a partner in a ten-doctor practice with offices in Bear Creek and Clintonville, Wis. He will be retiring from practice this fall. A continuous member of the WVMA since 1983, Dr. Leder served on the WVMA Executive Board from 2004-2008. He helped draft our Large Animal Welfare Guiding Principles, and is currently on the Animal Welfare committee. Dr. Leder and his wife Penny operate an 80-acre farm where they rotationally graze 75 commercial ewes. Bob has been active in the Wisconsin Sheep Breeders Co-op, giving many presentations on sheep health and management over the years. They have two adult children, Heidi a small animal veterinarian in Colo., and Casey, who is an emergency room physician in La Crosse, Wis. n

High Hurdles - High Expectations Isn’t it Great Being a Veterinarian?... Dr. John T. Been

One of the greatest events at a track and field meet for me is the high hurdles competition. The individuals who compete in that event are such a great combination of speed, grace and athleticism. They always capture my imagination and admiration. Most people don’t appreciate the hours of training, conditioning and preparation that go into those few seconds of actual competitive performance, but like in all things, good results are not given but earned. One of the finest aspects of the WVMA that I have come to really appreciate is that characteristic of tackling big problems. It has been a real pleasure serving with staff and committee members who are so motivated to be actively involved with ongoing issues as well as proactively responsive to potential threats to our profession. Just like those great high hurdlers, setting high expectations is the key to moving an organization forward. I believe your WVMA does that so well. I’d like to site a couple of areas of effort that the WVMA has been actively focused on in the past several months as examples of tackling big issues. Our Food Armor® program continues to grow and has earned national recognition as a non-regulatory HACCP (Hazard Analysis & Critical Control Points) program for proper drug use in our nation’s meat and milk supplies. Our Food Armor® committee (Dr. Jon Garber, chairperson) along with Dr. Katie Mrdutt (Food Armor® outreach specialist) and Kim Brown Pokorny (executive director) have done a marvelous job in developing a great working model that is serving our agricultural community and consumers so well. The WVMA Executive Board has further approved the formation of the Food Armor® Foundation, Inc. which will be a tax-exempt 501(c)(3) corporation. This

new model will be separate and distinct from the WVMA and will be very beneficial from the aspects of liability and sustainability. Very exciting and great potential. Another current effort that I’d like to mention is the establishment of our OSHA (Occupational Safety and Health Administration) Task Force (Dr. Ken Waller, chairperson). This is a group of member volunteers who have come together to explore an alliance with OSHA that would tailor a usable set of policies and guidelines that address safety and health considerations in the veterinary workplace. The veterinary workplace is unique in its risks and potential hazards. An OSHA alliance with the WVMA would be the first of its kind nationally. It is our goal to have a usable set of guidelines available as a member service that would both increase veterinarian and lay worker safety, as well as prepare private clinics for an OSHA inspection. This task force has had its first few meetings and are well into establishing the framework and objectives for this alliance. Thanks once again to all those member volunteers who serve so well and enthusiastically on all of our WVMA committees. We are a strong organization because of your efforts. We will continue to set high expectations so that we can keep on clearing those high hurdles!

Up-Date on Covenants Not to Compete By Gregory E. Scallon, DeWitt Ross & Stevens, s.c.

Many veterinary medicine practices require, as a condition of employment, that a prospective employed veterinarian sign an agreement that the employee will not perform services similar to those performed for the employer, whether for a competing practice or in a new practice, within a stated geographic area for a stated period of time. The restrictive covenant may also prohibit the employee from providing services to specific clients of the employer. I wrote about the general rules in Wisconsin regarding creating an enforceable covenant not to compete in a Legal Briefs article in the WVMA’s April, 2010 newsletter. A recent case decided by the Wisconsin Supreme Court made a significant change to the law governing enforcement of covenants not to compete. This article is to up-date the earlier Legal Brief and highlight this change in the law. As stated above and in the earlier Legal Brief, best practice is to require that a prospective employee sign a covenant not to compete prior to commencing employment. But, what if you overlook doing so at commencement of the employment, and then decide at a later date that you want to require the employed veterinarian sign a covenant. Can you cure your initial oversight by imposing the covenant requirement during the course of the employment? As a general rule, all contracts, including an employment agreement, require giving “consideration”. The act of offering employment to a person is generally considered adequate consideration for the employee’s agreement to sign a covenant not to compete. However, until recently, the law in Wisconsin was that merely continued employment was not considered adequate consideration to support enforcement of a covenant not to compete. Historically our advice to an employer in this situation was to couple the requirement that the employee sign a covenant not to compete with a contract renewal and compensation adjustment. This adjustment in

compensation created additional consideration for the covenant. In a recent decision, the Wisconsin Supreme Court held that continued employment is enough consideration for a covenant not to compete. The Court stated that “an employer’s forbearance in exercising its right to terminate an at-will employee constitutes lawful consideration for a restrictive covenant.” This case involved an “at will” employee, which is an employee who does not have an employment agreement, which seems to be the most likely scenario. However, it seems also applicable to an employee otherwise covered by an employment agreement that is lacking a covenant not to compete, provided that the other terms of the employment agreement regarding termination are properly followed. The Court addressed the concern that an employer might require the employee to sign a covenant not to compete as a condition for continued employment, and then terminate the employee shortly thereafter. The Court held that the employee was adequately protected by other contract formation principles such as fraudulent inducement or good faith and fair dealing. Our recommendation is, of course, that your practice incorporate a covenant not to compete into the documentation at the time you make an offer of employment, and thus avoid the need to address the issue after the employment commences. Failing that, we continue the recommendation, if circumstances allow, that employers couple an increase in compensation, or other additional consideration, with the requirement to sign a covenant not to compete, to strengthen the argument that adequate consideration has been provided. If an employer elects not to provide other consideration and takes the “sign the restrictive covenant or you’re fired” approach, the employer will be required, if challenged, to demonstrate that the covenant not to compete really was a condition of continued employment and be prepared to terminate an employee who refuses to sign. n

One Health Harmful Algal Bloom System (OHHABS) What are harmful algal blooms? Harmful algal blooms (HABs) occur when algae and cyanobacteria grow out of control in bodies of water. This overgrowth can produce toxins harmful to people and animals, or kill animals or plants in the water by severely depleting oxygen when they decompose. HABs most often occur in warm, nutrient-rich bodies of freshwater, marine water, or brackish water (salt and fresh water mixed together). Normally, algae are important organisms in oceans, rivers, and lakes because they are the building blocks of the food chain and ecosystem. When they grow out of control, however, they can harm people, animals, and the environment.

Why are HABs a public health issue? HABs can affect the environment, drinking water, recreational water, and food. Exposure to HAB toxins through water, food, or air may cause a range of mild to severe symptoms in both humans and animals. Exposures can result in symptoms that affect the skin, stomach and intestines, lungs, and nervous system. Animals, such as dogs, cattle, birds, and fish, are more likely to be affected because they are more likely to drink from or swim in affected waters. People can be affected from exposure during work or recreational activities, or from contaminated drinking water or food. HAB events can cause serious illness in humans and animals, and damage the environment. For example: • • •

In 2007, 15 people were affected with respiratory illness from exposures to HAB toxins from a HAB near the Florida coast. From 2007 to 2011, HAB-associated foodborne exposures caused 273 cases of human illness. These illnesses included stomach, intestinal, and neurologic symptoms from eating finfish or shellfish. From 2009 to 2010, 11 HAB-associated outbreaks from recreational exposures in freshwater settings in three states were reported to the CDC. The 61 people sickened in the outbreaks experienced skin irritation, stomach, intestinal, respiratory, or neurologic signs and symptoms. These 11 outbreaks represented 46% of the 24 outbreaks associated with untreated recreational water reported for 2009-2010. In 2014, nearly 500,000 residents of Toledo, Ohio could not use public water to drink, cook, or bathe for almost three days because it was contaminated with a toxin from a HAB in Lake Erie. In fall of 2015, a cyanobacterial bloom of Microcystis covered 636 of the Ohio River’s 981 miles. Microcystis can produce microcystin, a toxin that can cause diarrhea, vomiting, and liver damage, and can kill animals that drink contaminated water.

Why do we need HAB surveillance? Evidence suggests that HABs are increasing in frequency and severity due to climate change, farming practices, storm and wastewater runoff, and other environmental issues. The identification of HABs is critical to determine their patterns of occurrence, to protect water and food supplies, and to alert the public when there is a problem. HAB-associated outbreaks can be reported in the National Outbreak Reporting System (NORS). However, NORS only captures aggregate information about two or more human cases of illness. Surveillance for individual cases of human and animal illness will provide additional information on the annual number of cases, where illnesses are occurring, and symptoms from exposure.

What is the One Health Harmful Algal Bloom System? This voluntary reporting system, called OHHABS, is accessible to state and territorial public health departments and their designated environmental health or animal health partners. It collects data on individual human and animal cases of illnesses from HAB-associated exposures, and environmental data about HABs. The goal of OHHABS is to collect information to support the understanding and prevention of HABs and HAB-associated illnesses. OHHABS is an example of One Health surveillance. The One Health concept recognizes that the health of humans is connected to the health of animals and the environment. The human health, animal health, and environmental health communities can more effectively address many linked health challenges by working together.

What is the difference between OHHABS and NORS? OHHABS is linked to NORS and shares web-based reporting features. OHHABS is an event-based reporting system for HAB events and HAB-associated human and animal cases of illness. NORS is an event-based reporting system for foodborne, waterborne, and enteric disease outbreaks that may collect HAB-associated aggregate outbreak data. DEA Acknowledges Veterinarians’ Ability to Practice across State Lines American Veterinary Medical Association

With President Barack Obama’s signing of the Veterinary Medicine Mobility Act in 2014, it became legal for veterinarians to carry controlled substances across state lines to provide complete medical care to patients outside their clinics. The U.S. Drug Enforcement Administration dotted the final “i” on the legislation recently, formally acknowledging its provisions in a letter to practitioners who are registered with the DEA to dispense controlled substances. The 2014 legislation resulted from a concerted effort by the AVMA, our members and allied organizations. The letter quotes the new law’s provision that a veterinarian “shall not be required to have a separate registration in order to transport and dispense controlled substances in the usual course of a veterinary practice at a site other than the registrant’s registered principal place of business or professional practice, so long as the site of transporting and dispensing is located in a state where the veterinarian is licensed to practice veterinary medicine and is not a principal place of business or professional practice.”

“A prime example is that a veterinarian may dispense controlled substances while making ‘house calls’ (e.g., at a stable) without being registered at that location,” according to the letter. “And, in such a scenario, the veterinarian does not need to be registered with the DEA in the state where the dispensing occurs, as long as the veterinarian is registered in some other state and is licensed to practice veterinary medicine in the state where the dispensing occurs.” The letter was sent to all DEA registrants, as well as DEA field offices and diversion investigators, following discussions between DEA officials and AVMA staff. n

This change will be voted on by the voting membership at the Annual Business Meeting on Friday, October 14. All members are invited to attend the Annual Business even if they are not attending any CE events at convention.

New Clinic Login Offers New Features for Practice Managers Practice managers can now use a clinic login on the WVMA website to pay invoices, register members for WVMA events and more. “This is a feature we are really excited about offering our members and their practice managers,” says Kim Brown Pokorny, WVMA executive director. The clinic login will allow practice managers to pay invoices, update clinic information, register clinic veterinarians for WVMA events and pay membership dues. “Not only are we decreasing our paper trail, but we are making things easier for our members and their employees,” says Brown Pokorny. Before, practice managers would either need to call into the WVMA office to handle these tasks or login under each member veterinarian’s website credentials to register or pay dues. Cost Benefit 101: Staff Scheduling Software Darren Osborne, MA, Director of Economic Development, Ontario Veterinary Medical Association The person who creates the staff schedule in a veterinary hospital walks a precarious path balancing fairness to staff, vacation schedules, daycare requirements, illness, seniority, maternity leave and staff turnover. Even the best schedule leaves someone feeling jilted and there is no way to measure the effectiveness of the best schedules. On a busy day, an entire shift can threaten mutiny because, “the other shift had way more people and less work.” Maybe they have a point. To make matters even worse, this daunting task of scheduling is unending. Before the schedule ends another one has to be created. The notion of just copying the old schedule doesn’t work in most hospitals because daycare schedules have changed, kids are out of school for the holiday or someone is on vacation. And then some veterinary staff have shift patterns that would challenge amateur code breakers. Jo takes a class every second Wednesday and has to be home early on Thursday because he can’t get anyone to watch the kids that day, but is available all summer. Who can keep up with all that? Easy to build...

Employee scheduling software helps practice owners and managers wade through all these problems with easy to build schedules for each staff that are woven into the calendar. For each staff, you simply build the schedule and let it run for the year. The software makes it easy to account for repeating shift patterns (eg. every 3rd Thursday off) so it really takes very little time. You repeat this process for each staff and you are done. The first time I used scheduling software I sat down with a practice owner and, without any knowledge of the software; we knocked out a 12 month schedule for two DVMs and seven staff in little over two hours. With pen and paper, she admitted that scheduling twelve months would have taken more than 18 hours to create and several more hours editing to account for unplanned absences. Once the schedule was built we used a feature in the software that stacked all the schedules and generated a chart that helped identify staff gaps or bottlenecks. Different staff types were color coded and when total staff hours for each type was plotted against the hour of the day it showed there was not enough staff on for surgery mornings and too many staff on in the middle of the day most days. Both the morning gap and noon time bottleneck were suspected before she saw the chart but

they were pretty hard to miss looking at the chart. The stacks of staff were really low on surgery morning and really high during lunch. The easy solution to this problem was to drag staff hours from the middle of the day to surgery mornings. Using the scheduling software you can even experiment with different staff allotments until you get it just right. If you input the wage for each staff the software will show you how much you are spending on staff each month or each week. This function is especially useful if you are trying to lower staff costs. You can give yourself $15,000 as a target for staff wages in a month and then add, take away or change the hours in specific shifts until you hit your expense target. There is an app for that...

With the available Staff Scheduling app on their phone, staff take their schedule everywhere they go. Using their phone, staff can see their schedule any time they want, look up their vacation time and see when other staff is working. If the schedule changes, the phone app is automatically refreshes and alerts can go out to staff notifying them of any changes. Saw you look...

One sneaky feature in the app is ability for practice owners and managers to see when staff has looked up their schedule. If I check


my schedule on my phone for the week, an icon appears on the manager’s calendar that tells them I looked at my schedule Sunday night. So when I don’t show up Monday and say, “Oh sorry, I did not know I was scheduled,” the manager can say, “That’s weird, someone used your phone to look up your schedule Sunday night at 9:00 pm. You forgot that awfully fast.” On the cloud...

A helpful feature for forgetful staff is a feature that automatically reminds staff with email or text that their shift is about to start. One hour before the shift starts, the phone buzzes and a message appears, “Jo, you have one hour until your shift.”

How much...

For most hospitals (with less than 20 employees), staff scheduling software costs $40 US per month per year. This cost can be recouped with the hours saved setting up and editing the schedule throughout the year. It can also be recouped with improved productivity by rearranging the schedule to eliminate gaps and free up bottlenecks. When you factor in the automatic alerts that can eliminate missed shifts and the wall can fast track shift trades, scheduling software not only makes financial sense it makes life a lot easier. n

Another cloud based feature on the software is a wall that allows staff to post upcoming conflicts and requests for shift trades. Similar to the wall on Facebook, anyone can post on the wall and all can see all the other posts. It might say, “I have a wedding the first weekend in November. Can anyone take my shift that week?” It is color coded so everyone knows that the request is a receptionist or a tech or a veterinarian. Shift changes or trades can be set to go through the person in charge of the schedule or staff can be authorized to make the change and the manager simply gets the information on the trade.

Convention Wetlabs Offer Greater Learning Opportunities for Student Members For the second time, the Wisconsin Veterinary Medical Association (WVMA) will be hosting four wetlabs for student members at the association’s annual convention. The wetlabs will be held on Saturday, October 15.

“After last year’s wetlabs, we heard a lot of positive feedback from student members and it was an easy decision to host more in 2016,” says Kim Brown Pokorny, WVMA executive director.

There is limited availability for each session and students must sign up prior to convention. With limited space, students are responsible to fill their space if for some reason they cannot attend.

In 2015, wetlab topics included embyro transfer, goat medicine, canine ultra sound and poultry medicine.

“We had a large number of students interested in the wetlabs that weren’t able to sign up last year,” says Brown Pokorny. “This is why are offering the embryo transfer session again.”

“The students are the ones who decide what topics are covered,” says Brown Pokorny. “Once we know what they are interested in, we do our best to meet their requests.” Wetlab topics for 2016 are pocket pets, canine medicine, equine medicine and embryo transfer. Each session is instructed by a WVMA member who can supply the students with firsthand knowledge of what they will face in the field on a daily basis. While each subject takes longer than three hours to completely understand, the topics are narrowed down to specific cases the students are interested in learning more about and getting more
