Rapid Response Tools that Help to Control and Prevent the Spread of a Disease Outbreak By Dr. Darlene Konkle, Acting State Veterinarian Wisconsin Department of Agriculture, Trade and Consumer Protection A farmer goes out to feed his cattle and notices half are not coming to eat. As he looks closer, the animals are reluctant to move and many are drooling. An evaluation and testing confirm the animals have foot and mouth disease, and within the last month the farm purchased and sold animals from and to multiple destinations in multiple states. Should this situation really occur, a rapid response is critical to minimize the risk of further spread and to identify at-risk farms. Foot and mouth disease, although not often fatal, will affect the ability to export animals and animal products. Affected animals have pain and are less productive, losing body condition and milk production, perhaps never to attain or regain their full potential. Although foot and mouth disease has not been in the U.S. since the 1920s, it is present in other parts of the world, leaving opportunities for re-introduction. Several examples of animal disease outbreaks that have recently affected Wisconsin include bovine tuberculosis, highly pathogenic avian influenza, and porcine epidemic diarrhea virus. Electronic Certificate of Veterinary Inspection Animals traveling interstate are required to be accompanied by a certificate of veterinary inspection (CVI). These documents serve as a record of animal movement that is submitted to state animal health agencies. They are used to identify at-risk locations in the event of an animal disease outbreak. With the help of the Wisconsin Livestock Identification Consortium (WLIC), the ability to locate information associated with CVIs will dramatically improve by being able to search for information electronically. This will save valuable time in finding where diseased or at-risk animals are or have been should a disease outbreak occur. When veterinarians use electronic CVIs it eliminates the need to mail in documents and improves the accuracy and efficiency of tracing animals. It’s a new year! With that comes a time of new beginnings. I’m sure you’ve been hearing many people talk about their New Year’s Resolutions. Have you made yours? How is it going? We all know the typical year-end resolutions: to lose weight, eat better, exercise more, etc. According to U.S. News, approximately 80 percent of resolutions fail by the second week of February, so the odds are against you! I’d like to talk about a resolution I did keep last year -- to volunteer more. When I was asked to serve as WVMA president, there were many reasons to decline. The opportunity to volunteer my time to make a difference, however, led me to say “yes.” “Volunteering is so pervasive it’s invisible. We take for granted all the things that have been pioneered by concerned, active volunteers.” -- Susan J. Ellis, president of Energize, Inc., a training, consulting and publishing firm that specializes in volunteerism. It seems that our society is becoming more disconnected. I could go days without talking to anyone if desired, by texting my friends and family, ordering online, doing self-checkout at the grocery store or having my meals delivered through UPS, checking up on my family and friends through Facebook and Instagram, telecommuting to work, etc. All of these “improvements” in technology and conveniences have, in my opinion, disconnected us and allowed us to find excuses to become involved with organizations that rely on volunteers to function. For more than 100 years, our WVMA has promoted and protected veterinarians through the hard work of the WVMA staff and countless volunteers. I want to make sure that people continue to make the WVMA a great organization. There are many great opportunities to become involved: • Participate in the multiple continuing education events that will be held throughout the state over the next year. We have planned something for everyone, so stay tuned! • Join one of the many committees or task forces that keep our

organization going. There is a committee that matches your interests out there, just ask. • Get involved in your local Veterinary Medical Association. Local associations offer great educational events and provide a way to meet and get to know the veterinarians in your area. • Contact your legislators about local and state issues that affect our profession. A personal connection with your local representative is powerful and can make a difference. • Call or email the WVMA office and ask how you can help. We all have talents and interests that can help our profession. We are the only organization in Wisconsin representing veterinarians on legislation and public policy. We tackle issues impacting veterinarians, the veterinary profession and our patients now and in years to come. We cannot do this without you, so please make a “new” New Year’s Resolution and consider being an active member of the WVMA! Try something new, expand your interests and take on a challenge! l

Wisconsin 2019 Legislative Preview By Jordan Lamb, JD, DeWitt Ross & Stevens Record numbers of Wisconsin voters turned out for the 2018 midterm elections, which were held November 6, and the results were classically Wisconsin. Our state voted “blue” at the top of the ticket, electing a new Democratic Governor, Tony Evers, and a new Democratic Attorney General, John Kaul, but the electorate voted “red” in the local legislative races resulting in a Republican majority in both the State Assembly and State Senate for the 2019 legislative session.

Joint Committee on Finance. Senator Alberta Darling (R) and Representative John Nygren (R) will return once again as the co-chairs of the very powerful Joint Committee on Finance. This committee will get the first crack at Governor Evers’ proposed biennial budget bill when it is introduced in February. This 14-member joint Senate/Assembly committee will reflect the majorities in both houses and will consist of 12 Republicans (6 from each house) and 4 Democrats (2 from each house).

Congress. In Wisconsin congressional races, U.S. Senator Tammy Baldwin (D) easily defeated her Republican challenger, State Senator Leah Vukmir (R), and Senator Baldwin will go back to the U.S. Senate in 2019. Interestingly, there were no party changes to the Wisconsin congressional line-up. Even though the U.S. House of Representatives switched to Democratic control, Wisconsin’s congressional delegation remains unchanged in terms of party affiliation with five congressional districts represented by Republicans and three represented by Democrats.

Governor Evers’ Transition. Governor-elect Tony Evers spent time between the election and inauguration assembling a transition team to assist him with staffing his office, writing a budget bill and filling all of the appointed agency positions that will be left vacant when Governor Walker’s term ends. Governor-Elect Evers will have to appoint a Secretary, Deputy Secretary, Assistant Deputy Secretary, Communications Director, Legislative Liaison, Chief Legal Counsel and numerous Division Administrator Positions, among others, in each administrative agency. As such, he assembled a panel of advisors to both assist with the transition and the recruitment and selection of individuals to fill these positions. At the time of this writing, no agency appointments had yet been made.

Wisconsin State Legislature. Despite the “blue” at the top of the ticket, both houses of the Wisconsin legislature will remain in Republican majorities for the 2019 session. The Assembly Republicans will hold a 63-36 majority. The Senate Republicans gained one seat, further solidifying their majority for the 2019 session at 19-14.

New Legislature Arrives in January 2019. The new Wisconsin state legislature and newly elected Governor will be sworn in in early January. It is expected that the 2019-21 Biennial Budget Bill will dominate the first six months of the session with funding for Senators Scott Fitzgerald (R) and Jen Shilling (D) will lead their respective parties in the State Senate for the next two years. Senator schools and roads to be hotly debated budget topics. WVMA’s Fitzgerald has been majority leader since 2011 and Senator Shilling advocacy team will be closely monitoring and participating in the development of this budget with regard to any potential changes has been minority leader since 2015. that could affect our membership. l In the Assembly, Representative Robin Vos (R) will once again be Speaker and Representative Gordon Hintz (D) will serve as minority leader. Representative Vos has been the Speaker since 2013 and Representative Hintz has been minority leader since October of 2017.

Legal Checklist for New (And Not so New) Veterinarians By Bryan C. Esch, JD, DeWitt Ross & Stevens S.C. You just graduated from veterinary school and are ready to join the workforce as a practicing veterinarian. The past years have been filled with class, late night studying and clinics, honing your talents for veterinary medicine and hopefully doing what you love. As you get started, you will encounter various legal issues in your career and personal life. The decisions you make or fail to make can have a major impact on your personal and professional success. You should be aware of various legal considerations as you transition from veterinary school to an associate veterinary position and maybe, one day, to ownership of a veterinary practice in a solo or group setting. The following discussion is an overview of some of the myriad of issues you will face – some early-on and some as your career advances. Associate Employment Contracts Most likely, you will be taking a job with an established veterinary practice and will be asked to sign an associate employment contract. Being an employed veterinarian will allow you to focus on becoming proficient in the practice of veterinary medicine and you will not have to consider the myriad of legal issues faced by practice owners. Although certain provisions in employment contracts may appear (and, in fact, be) standard, these contracts may contain provisions, like non-compete restrictions and other restrictive covenants that need to be closely reviewed in light of any facts unique to your situation (also considering the needs of the practice) and avoid restrictions that might prevent you from doing what you want to do as your vet practice develops and changes over time. Your associate employment contract should also address your compensation and employee benefit package, hours of work and other terms of employment. Because of the importance of this agreement and its impact on your future, you should have any employment contract presented to you by a prospective employer reviewed by an attorney who can advise you on the legal considerations.

Buy-in Transaction or Veterinary Practice Purchase After working as an associate for a few years, you may be offered the opportunity to buy into the veterinary practice, as one of multiple owners, or you may have the ability to purchase the entire practice from your boss. If you are contemplating such a purchase, you need to make sure you carefully review the legal and financial status of the practice to ensure you are getting a good deal and a fair price and to confirm the future prospects of the practice in the marketplace. You and your legal and accounting advisors should conduct proper due diligence, and your lawyer will need to draft comprehensive agreements to implement the purchase. You will need to determine whether to buy using an asset purchase or stock purchase, negotiate the terms of the purchase agreement and any related real estate purchase or lease, and develop the terms of any seller restrictive covenants. If you are buying into a practice and will have co-owners, you will want to make sure the practice has an adequate buy-sell agreement. Employee Benefits If you are employed by an existing veterinary practice, you may have employer-provided health insurance, dental insurance, group life and disability insurance, and a retirement plan (401(k), SEPIRA, profit sharing plan, etc.). These plans can be complicated and difficult to understand, but they are crucial to your financial security. You should carefully review your summary plan descriptions for each employer-provided benefit plan so you understand the terms and conditions. Personal Insurance

As a professional, you should responsibly insure yourself against the risks you face in your practice and your daily life. Adequate professional liability insurance, either provided by your employer or personally obtained, is a must. You should also carry sufficient Practice Start Up amounts of car insurance and renter’s insurance or homeowner’s insurance, and consider whether you need an umbrella insurance If instead of starting or continuing as an employed veterinarian, you are considering starting your own veterinary practice, there are policy for more liability protection (especially important if you own a boat, ATV or snowmobile). Welcomes Dr. Ailam Lim! Dr. Lim joined WVDL as the Virology Section Head in August of 2018. Ailam earned her PhD from Michigan State University in 2010, her doctoral work focused on biomarker discovery for bovine tuberculosis. Dr. Lim has broad interests in emerging infectious diseases, zoonotic and vector borne diseases for livestock and companion animals. Her focus at the WVDL will be in improving the testing to safeguard our bovine industry and food safety, as well as expansion of testing for companion animals and shelter medicine.

2019 is the year when all current livestock premises IDs need to be renewed. A reminder that any location in Wisconsin where livestock are kept must be registered – whether there is one animal or more. • Goats • Sheep • Camelids

DATCP conducted several disease investigations since 2006 where livestock premises registrations helped identify locations with animals susceptible to specific diseases. This process currently takes under an hour. Prior to premises registration it may have taken several weeks for staff to go door-to-door to find locations with at-risk animals. This tool allows Wisconsin to respond faster to educate veterinarians and livestock owners about a current disease situation and to perform any required disease testing. The more quickly these steps can be taken, the more likely we are able to contain the disease and more rapidly lift movement restrictions. Also, an active livestock premises registration is an eligibility requirement for a livestock owner to receive state indemnity. Under state law, Wisconsin has the ability to provide an indemnity payment to a livestock owner for animals condemned due to a contagious or infectious disease. Livestock owners with an expired premises registration or those who never register their premises do not meet eligibility for a state indemnity payment. In partnership with WLIC, more information about how livestock owners can renew their livestock premises will be announced in the new year. Creating an Effective Customer Referral Program By Jessica Eversoll, Botham, INK. “Would you recommend us to a friend?” It’s the most important question we can ask of our customers and it’s the most telling indicator of business success. By initiating a referral program and incentivizing existing customers to refer new customers to your business, you are essentially both asking and answering that most valuable question. Referral programs are the the most costeffective way to gain new business because a referral costs your business exactly zero dollars to produce. Additionally, word-ofmouth referrals are the most trustworthy form of advertising; new customers are four times more likely to purchase if they are referred by a friend. Above all, word-of-mouth referrals do not end after one referral has been made. One individual tells a friend, then that individual tells another friend and so on creating a snowball effect that multiplies as your business grows.

As a business, this is good news because it means that incentives such as points, discounts or products are more appealing than cash. It is also important to note that the most effective referral programs offer incentives for both the existing customer and the new customer.

However, don’t assume that your satisfied customer will refer others to your business simply because of their positive experience. They may need some encouragement. You can increase referrals by incentivizing customers to make a referral. Successful businesses leverage their existing customer base to acquire new customers.

Referrals are the most valuable when we make the effort to thank the customer for the referral and notify them of their earned incentives. Everyone likes to be appreciated; an email, phone call or even a handwritten thank you note will acknowledge the customer’s efforts and likely lead to more referrals.

As with any successful program, begin by establishing goals. Goals for your referral program should be crafted around what you hope to gain from the program. Examples of goals could be increased sales, revenue, brand awareness, new clients or current client retention. Goals should be specific, measurable, attainable, realistic and timely. After you have established goals for the program, create a list of possible referral sources. These could include current and past customers, existing leads, partnering businesses, and vendors. Determine the best ways to connect with this list to launch your referral program, be it via phone, email or in person. Next, clearly outline incentives for making a referral. According to a study at the University of Chicago, non-cash incentives are

Of course, no referral program will accomplish its goals without some promotion. Newsletters, email blasts, social media and sales people are easy channels for spreading the word. It’s also smart to have a tracking system in place so that you can measure the success of the program. Tracking things like who was referred, who referred them and the date of the referral can be benchmarked against promotions and incentives. One way of measuring referrals is simply to ask new clients, “How did you hear about us?”

Referrals are a gold mine for businesses. Referred customers are much more likely to purchase and return higher lifetime customer value. Referred customers trust their friends’ recommendations far more than they trust any other marketing that you will do. Social media makes initiating and tracking a referral system pretty seamless and can ensure that both your existing and new customers know how important they are to your business. Estate Planning Even if you are single and do not have kids, you should do some basic estate planning. Everyone should have financial and health care powers of attorney in place in case they are incapacitated and can’t make their own financial and health care decisions. You may also want to have a simple will to appoint your desired personal representative/executor and to designate your probate assets to your intended beneficiaries. At the very least, you should confirm

that you have executed beneficiary designations to direct your retirement plan assets, IRAs, life insurance, and bank accounts to your preferred beneficiaries. As a new veterinarian, I am sure you are excited to get started on your professional career. Take a few minutes, both as you start your career and periodically thereafter, to talk to qualified advisors to make certain you pass your legal check-up. l

respondents reported medical problems as a cause. This includes 27 percent of veterinarians going to work in private practice, a business percent reporting lost work from medical problems and 14 percent overhead expense or key employee policy can help protect against reporting caring for a sick family member.1 these risks.4 It is becoming increasingly important as well; as modern medicine lowers fatality rates it also incidentally raises disability rates.2 Today’s 20-year-olds have a 1 in 4 chance of becoming disabled at some point in their life.3 This, compounded by the fact that premiums are tied to age, and that you can “price lock” policies, makes putting off disability insurance inadvisable.
