WVMA Member Spotlight – Dr. Robert McClellan

Wisconsin native, Dr. Robert McClellan, is a 1986 graduate of Iowa State University College of Veterinary Medicine. Currently, he is the owner of Superior Animal Hospital, a six doctor, AAHA accredited small animal hospital. Dr. McClellan moved to Superior, Wis. after practicing in southern Wisconsin and northern Illinois as a mixed animal and relief veterinarian. Throughout the many changes in his career, he has always valued his WVMA membership and known the importance of organized veterinary medicine. “My first veterinary employer and mentor, Dr. Dean Peterson, made a strong impression on me that it was important to become involved and support our profession through organized veterinary medicine,” he says. “At local, state, and national levels, there is so much to be gained by working together.” Serving as a mentor for current veterinary students, Dr. McClellan enjoys hosting students for veterinary student externships.

“This is one of our favorite activities, as it is stimulating to see what is being taught to students, as well as to see their developing areas of interest,” he says. When talking with veterinary students, his greatest piece of advice is to take every opportunity possible to participate and observe the profession in a variety of locations. “As was my experience, and the experiences of current and past students, one does not always end up doing what we started out thinking we were going to do,” he says. Superior Animal Hospital serves as an internship site for veterinary technician students, participates in the local high school veterinary medicine youth apprenticeship program and accommodates a wide variety of job and career shadows for students of all ages. Dr. McClellan has also found great reward in working with the local humane societies and animal shelters in the community. “We are very fortunate to have a quality humane society in our city and county,” he says. “We volunteer veterinary exams there weekly and provide care when needed.” This community support mentality is shared throughout the clinic and can be seen in the medical services provided to homeless animals as well as sponsorship of fundraising events. “Our staff morale is supported when we save, repair, and help place the pets that do not have a home,” he says. “We are involved in our community in many other ways, and we feel it is part of our mission to make our community a better place to live.” n

New Beginnings Dr. Jane Clark

I will use my final President’s column to help summarize the WVMA initiatives acted upon up to this point of the WVMA’s 100th year. The Executive Board began 2015 by restructuring its 20+ committees to more accurately reflect the current direction of the organization according to the strategic plan. We reduced them to a number more manageable by our present staff, eliminating the need to hire more people. All of these committees are composed of WVMA member volunteers so we wanted to respect their time and effort by serving on committees of purpose. Many of these committees have already met and the rest will meet this fall. 2015 was another year of huge legislative progress and many thanks go to our legal counsel for navigating us through the legal system and advocating for our members. The Veterinary Examining Board (VEB) was successfully moved in the Governor’s 2015-17 budget (along with funding and authority) to Department of Agriculture, Trade and Consumer Protection (DATCP). We feel this is a better fit for this board and the hope is that reports of unlicensed practice will be addressed to the fullest extent of the law. We must protect the practice of veterinary medicine and all that it encompasses, including all species and all types of practice. This affects us all. Another big win was keeping the Wisconsin Veterinary Diagnostic Lab (WVDL) a part of the UW system as many positions have work responsibilities in the WVDL and the UW-SVM as some are also UWMadison faculty. Our Food Armor® program has continued making excellent progress to the point where we were able to enhance our part-time veterinarian position to full-time. This position manages and provides training to veterinarians and the farms they serve to help eliminate antibiotic/ drug residues in meat and milk and to ensure proper drug use. We are positioned well to lead the nation in this endeavor. In July, with the help of an outside consultant, we began setting up the structure of our foundation as well as the process of selecting board members, who will be responsible for carrying out the mission of the foundation moving forward. We hope to have this board in place by the end of 2015.

In August, I was invited to speak to the incoming class of 2019 at the UW School of Veterinary Medicine to let them know how we serve WVMA members as well as students in the School of Veterinary Medicine. I thoroughly enjoyed interacting with these young future DVMs and wish them all well in their studies. The school, represented by Dean Markel, sponsored student and faculty membership in the WVMA so if you are one of the recipients of this, please thank them. I know we really appreciate it! Just in case you wanted to know what else the President does, I chaired five WVMA Executive Board Meetings, met with the personnel committee to conduct WVMA employee reviews, represented Wisconsin at the AVMA leadership conference held in Chicago each January, and sat in on House of Delegate meetings in Chicago and Boston at the AVMA convention. I was the emcee at the April UW-VMTH Blue Coat Ceremony and attended the spring awards banquet. I spoke to veterinary students at a “Vets to Vet School” luncheon on utilization of veterinary technicians, and I recently returned from the Heartland Veterinary Conference in Minneapolis. As I end this yearlong journey as President, I am beginning a new one as a retiree. I look forward to what the future has in store for me, just as I look forward to the future of the WVMA, as we begin year 101. My first retired act was to accompany my dad, a Korean War Veteran, on the Badger Honor Flight September 12th. It was an emotional experience for us and I cannot thank all the sponsors and volunteers enough for this special day. Cheers and thanks to all for a wonderful year! n

The Food Armor® Committee has launched the Food Amor® website, www.foodarmor.org. This website will be used as a tool to promote Food Armor® certification and accreditation to veterinarians and farmers, as well as supply information to the media and public. Varying levels of access allows veterinarians to renew their accreditation and farmers to access management tools. Marketing materials for veterinarians and farmers are also available. In September, members of the Food Armor® Committee attended the American Association of Bovine Practitioners (AABP) Annual Convention in New Orleans. They provided a preconference training on the program, exhibited at the trade show and had the opportunity to present Food Armor® to a national audience of bovine veterinarians at the Zoetis Technical Breakfast. The Food Armor® accreditation and certification program was launched nationally at this conference. Food Armor® is the only comprehensive program of its type in the country. Its goals are two-fold, 1) reduce meat and milk residues, and 2) ensure proper drug use. There is great need and demand for the program across the country. To date, this has been a self-funded program and is a model of the value of grass-roots work and success. Thank you to all the members of the Food Armor® Committee and Dr. Katie Mrdutt, Food Armor® outreach specialist. Great work!

Do You Have Outside Service Providers? Protect Yourself! Bryan C. Esch, Esq., DeWitt Ross & Stevens, s.c.

You may be considering working with other service providers to expand the services provided at your clinic or animal hospital or you already may have relationships with groomers, behavioral specialists, chiropractors, acupuncturists, or other outside vendors who work out of or receive referrals from your practice. Many veterinarians work with outside providers to make available additional services to their patients and clients and to increase their revenues. This may be a great way to generate new relationships for your practice and keep your patients and clients happy. However, these kinds of service relationships may generate additional risks for you because your clients may mistakenly assume that your practice is providing these services. Some simple actions should be taken to minimize these risks and to ensure your practice is protected. Due Diligence

Before entering into a relationship with a service provider, you should get to know the service provider’s business. You will want to investigate the service provider’s business reputation to ensure they provide a quality, reasonably-priced service. You may obtain information about the service provider through a formal background check, an informal internet and social media search, or by talking to clients and other business associates of the provider. You will also want to check the service provider’s credentials to ensure that all necessary licenses, permits and certifications have been obtained. Written Contract

The most important thing you can do to protect your practice when you have an outside service relationship is to enter into a written contract with the service provider. The written contract, whether it is a lease for specific space within the clinic building or another form of agreement outlining the terms of the relationship, will reduce the likelihood of a dispute between you and the service provider. The contract should clearly address any payments of rent or revenue sharing to be made by the provider, specify that the relationship between the parties is an independent contractor relationship and not a partnership, joint venture or employment relationship, obligate the provider to maintain adequate liability insurance, and provide that the provider will indemnify the clinic for any liability arising from the provider’s services.

You may also consider including rules governing how the provider markets or provides its services within your facility or to your patients and clients. Insurance

You will want to obtain an insurance certificate from the provider’s insurer confirming that the provider has adequate liability coverage. The insurance certificate should list your practice as an additional insured under the policy. Talk to your insurance agent to confirm that the provider’s coverages are adequate. Notices to Clients It is important that your clients understand that the extra services are provided by the provider and not your practice. You may reduce misunderstandings by: • Posting a sign in your waiting area or within the dedicated space within your building where the services are provided confirming that you do not provide the ancillary services and that the services are provided by the provider; • Including a notice on your practice website similar to the posted sign; • Inserting a notice provision in your new patient/client agreement similar to the posted sign; • Requiring the service provider to include similar notices in its new patient/client agreement, on its invoices, and on its website. Having outside providers provide ancillary services to your patients and clients can benefit your practice by providing you with extra revenue, more service offerings, and improve client satisfaction and retention. Implementing the above risk mitigation strategies will reduce the chances that your practice will be damaged by the actions of your third party service providers. n

Dr. Yvonne Bellay is Appointed to the AVMA Panel on Depopulation Working Group WVMA Member, Dr. Yvonne Bellay, been selected to serve as a member of the Companion Animals Working Group of the American Veterinary Medical Association’s (AVMA) Panel on Depopulation (POD). Comprised of 11 members, the AVMA POD will be led by the existing Chair of the AVMA Panel on Euthanasia, Dr. Steven Leary, and will include the Working Group Chair for each of the following species/expertise areas: poultry, cattle, swine, small ruminants, equids, aquaculture, companion animals (e.g., animal control and sheltering facilities), laboratory animals, zoo and wild animals. In keeping with the importance the AVMA places on professional ethical behavior, a credentialed ethicist has also been invited to participate as a member of the POD. Two additional individuals, one representing USDA and a second representing the NIH Office of Laboratory Animal Welfare, will participate in meetings of the POD as non-voting observers. n

WVMA Member, Dr. Patrick Warpinski, Named America’s Favorite Veterinarian Earlier this summer, Dr. Patrick Warpinski, WVMA member and owner of The Animal House Pet Clinic in Green Bay, was selected as one of 20 finalists out of a pool of over 500 nominees in a contest for America’s Favorite Veterinarian. The contest was created by the American Veterinary Medical Foundation (AVMF) in celebration of the special relationship between veterinarians and their communities and to raise awareness for the Veterinary Care Charitable Fund (VCCF), a fundraising effort that allows pet owners to support each other in times of hardship. After the initial call for nominations, a committee of judges including animal health industry leaders and bloggers, selected the top 20 finalists based on each veterinarian’s community involvement, ethical behavior, passion for the profession and connection to animals and their owners. In August, AVMF decided to halt its America’s Favorite Veterinarian Contest and declare all 20 finalists “America’s Favorite Veterinarians”. Dr. Patrick Warpinski

Dr. Warpinski earned both his Bachelor of Science (’85) and his Doctor of Veterinary Medicine (’91) from the University of Wisconsin. In 2015, he was named Badger of the Year by the UW Alumni Brown County Chapter, and was one of 10 veterinarians selected worldwide to participate in the NOBIVAC global veterinary exchange pilot program. Verify Your CE Provider to Stay in Compliance In recent years there has been an increasing trend of veterinarians and veterinary technicians participating in CE offered by non-approved providers. This issue has been discussed at recent Veterinary Examining Board (VEB) meetings, Veterinarians are being found out of compliance with the VEB licensing requirements. It is the responsibility of the veterinarian or veterinary technician to know if the CE is valid. Non-approved CE does not count towards your 30 credit requirement. You must meet the 30 credit requirement through approved providers, or you will be in violation of your veterinary license. For more information what providers are approved, credit requirements and types of credits, refer to a portion of VE 10.03(04) below. VE 10.02 Continuing education. (1) (a) Except as provided in subs. (3) and (4), a veterinarian shall complete at least 30 hours of continuing education pertinent to veterinary medicine in each biennial renewal period. The 30 hours of continuing education shall include all of the following:

(5) Continuing education hours shall be completed during the preceding 2−year licensure or certification period.

• At least 25 hours of continuing education that relates to scientific topics pertinent to veterinary medicine.

(6) To obtain credit for completion of continuing education hours, a licensee or certificate holder shall, at the time of each renewal, sign a statement certifying that he or she has completed, during the preceding 2−year licensure or certification period, the continuing education programs required under sub. (1) or (2), as appropriate.

• All 30 continuing education hours in this subsection shall be documented. A minimum of 25 hours of continuing education shall be documented by an approved continuing education provider.

(7) A veterinarian or veterinary technician who fails to complete the continuing education requirements by the renewal date shall not practice as a veterinarian or veterinary technician, as appropriate, until his or her license or certificate is renewed.

• A continuing education hour shall consist of 50 minutes of contact time.

(8) For auditing purposes, every veterinarian and veterinary technician shall maintain records of continuing education hours for at least 5 years from the date the certification statement required under sub. (6) is signed. The board may audit for compliance by requiring a veterinarian or veterinary technician to submit evidence of compliance to the board for the biennium immediately preceding the biennium in which the audit is performed. Documentation of completion of continuing education hours shall include one of the following:

A minimum of 12 hours of continuing education shall be documented by an approved continuing education provider. • A continuing education hour shall consist of 50 minutes of contact time. Note: A list of approved program providers is contained in s. VE 10.03 (4). (3) Subsections (1) and (2) do not apply to an applicant who applies to renew a license or certificate that expires on the first expiration date after initial issuance of the license or certificate. (4) The board may waive the requirements under subs. (1) and (2) if it finds that exceptional circumstances, such as prolonged illness, disability, or other similar circumstances, have prevented an applicant from meeting the requirements.

VE 10.03 Continuing education programs and courses. (1) CRITERIA FOR PROGRAM AND COURSE APPROVAL. To be approved, a continuing education program or course shall meet the following criteria: • The subject matter of the program or course shall be pertinent to veterinary medicine or veterinary technology. • The program or course sponsor agrees to record registration and furnish a certificate of attendance to each participant. (2) UNRELATED SUBJECT MATTER. If a continuing education course includes subject matter that is not pertinent to veterinary medicine or veterinary technology, only those portions of the course that relate to veterinary medicine or veterinary technology will qualify as continuing education under this chapter. (3) MODALITIES AND METHODS OF DELIVERY. Modalities and methods of delivery of continuing education programs acceptable to the board include one or more of the following:

pertinent to veterinary medicine or veterinary technology shall be approved for 5 contact hours each. • (h) Up to 15 hours per biennium for veterinarians and up to 8 hours per biennium for veterinary technicians shall be granted for a combination of continuing education hours completed under pars. (e) to (g), provided the continuing education is published or presented under the auspices of a provider approved under sub. (4). (4) APPROVED PROGRAM PROVIDERS. Subject to compliance with the requirements set forth in subs. (1) to (3), the board shall approve attendance at and completion of one or more continuing education programs approved by any one of the following approved program providers as fulfilling the continuing education hours required under this chapter: • a) A national, regional, state, or local veterinary medical or veterinary technician association.

• a) Attendance at a scientific workshop, seminar, or laboratory demonstration pertinent to veterinary medicine or veterinary technology.

• c) An accredited college or university.

• (b) Self−study of veterinary medical or other pertinent scientific journals.

• d) An association listed in the AVMA or the National Association of Veterinary Technicians in America directory.

• (c) Enrollment in graduate or other college level courses pertinent to veterinary medicine or veterinary technology. Credit for qualified courses will be approved on the basis of multiplying each college credit hour by 10.

• e) An AVMA accredited veterinary school or veterinary technician program.

• (d) Enrollment in an internship, residency or certification program approved by a veterinary specialty organization recognized by the AVMA or in an AVMA accredited veterinary school. • (e) Authorship or co−authorship of a published work, such as review articles, abstracts, presentations, proceedings, book chapters, and web−based continuing education materials shall be approved for 5 hours each. • (f) A peer reviewed publication shall be approved for 5 hours.

They have all felt the very public and detrimental pain of announcing to the world that their confidential client data has been stolen and is now available to cyber criminals and millions of people’s identities are at risk. Year to date the corporate data breech count in the nation is at 521 and rising. This equates to 17,829,689 personal identification records that have been compromised.
