Dr. Sheila McGuirk Awarded Veterinarian of the Year Award The Wisconsin Veterinary Medical Association (WVMA) awarded Sheila McGuirk, DVM, MS, PhD, DACVIM, of Dodgeville, the WVMA Veterinarian of the Year Award at its 101st Annual Convention on Friday, Oct. 14. Dr. Nigel Cook believes Dr. McGuirk is synonymous with calf health and disease. “Bovine veterinarians know her best from her Drs. John T. Been, Sheila McGuirk and Scott Spaulding prolific presentations at CE meetings around the world,” says Dr. Cook. “She always presented the information they needed to know, created and delivered tools that they could use in everyday practice, and left everyone with the skills to enhance their practice of veterinary medicine when they returned home.” Dr. McGuirk obtained her DVM degree from the University of Georgia, and completed a residency in food animal medicine and surgery, MS and PhD at Ohio State University. She became ACVIM board certified in 1982 and joined the faculty at UW School of Veterinary Medicine in 1983. In addition to presenting at continuing education events around the world, Dr. McGuirk also answered countless questions in the Hoard’s Dairyman magazine from 1999 to 2015. She also oversaw the arrival and health of the cattle brought to World Dairy Expo, which delivered referrals to the UW School of Veterinary Medicine Teaching Hospital and provided veterinary medical students with the opportunity to be involved with the animal checks as the cows arrived. Beyond her academic work, Dr. McGuirk has served the University of Wisconsin on all levels. According to Dr. Cook, she served the SVM as the Associate Dean for Clinical Affairs from 1991 to 1999 and was a member of the University of Wisconsin Athletic Board for 12 years. Dr. McGuirk was also instrumental in the development and implementation of the Ambulatory Clinical Rotation for fourth year students, which she supervised for over two decades while serving on almost every school committee. “She has always been one of my hero’s and a trusted colleague, but also my confidante and friend – always willing to give her advice and support,” says Dr. Cook. “I can think of no finer person, nor a better colleague than Dr. Sheila McGuirk to be a recipient of this award.” Dr. McGuirk is the only two-time recipient of this award in WVMA history. n

At one point, people truly believed the world was flat. We all know this core belief was dramatically disrupted. Within recent months the WVMA emailed out several regulatory changes and announcements to our members. I am recapping those changes in this column to make sure everyone is aware of the changes. 1. The Wisconsin Controlled Substances Board recently made changes to the Schedule of some controlled substances. Here is an excerpt from the press release: “The Controlled Substances Board voted to take affirmative action on six dangerous drugs. PB-22, SF-PB-22, AB-FUBINACA, ADB-PINACA and U-47700 will be Schedule I drugs while Thiafentanil will be placed as Schedule II. The decision was made at a meeting of the Controlled Substances Board at the Department of Safety and Professional Services (DSPS). “According to 961.11 (4) of the Controlled Substances Statutes, the Board may take affirmative action to designate a substance as a controlled substance 30 days from the date of publication of the federal final order,” said Doug Englebert, Board Chair. “We are pleased that the U.S. Drug Enforcement Administration (DEA) has decided to schedule these dangerous drugs, allowing us to follow suit and more quickly and efficiently make these drugs illegal in Wisconsin.” Thiafentanil, a large-animal anesthetic, is a Schedule II drug effective October 26. PB-22, SF-PB-22, AB-FUBINACA and ADB-PINACA, all types of synthetic marijuana, and U-47700, a substance with similar effects to heroin, fentanyl and other opioids will also be listed as Schedule I drugs effective November 7, 2016. “We continue to work to combat drug abuse and misuse, and I applaud the Controlled Substances Board for being proactive and taking affirmative action to fight this growing epidemic,” said Governor Scott Walker.

Dr. Scott Spaulding Assumes Wisconsin Veterinary Medical Association Presidency

Scott Spaulding, DVM assumed the Presidency of the Wisconsin Veterinary Medical Association (WVMA) at the WVMA 101st Annual Convention on Friday, Oct. 14. He will serve as president for one year. Dr. Spaulding believes; “There is an abundance of opportunity in veterinary medicine, my goal is to increase private practice relevancy to position the profession to recognize and benefit from areas of opportunity the veterinarians should own. Good medicine is good business and good business supports good medicine. The WVMA must support development of the profession’s business acumen and increase focus on the economics and finance of veterinary practice”.

Dr. Spaulding earned his DVM from UW-Madison in 1991 and joined Janesville’s Badger Veterinary Hospital staff in 1992. Dr. Spaulding practices ambulatory, equine primary care; clinical interests include preventative medicine, equine nutrition and equine dentistry and also serves as Badger Veterinary Hospital’s President and CEO. From his career’s beginning, Dr. Spaulding has been actively involved in local and national organizations. His commitment to his family, his community and his career drives him to make a difference in the organizations he serves. His problem solving reputation motivated the American Veterinary Medical Association to appoint him as Chair of the Veterinary Economic Strategy Committee to chart the course for the profession’s future economic health. 2. Wisconsin State Veterinarian Issues Special Order to Control Canine Brucellosis “To protect both canine and human health in Wisconsin from the bacteria that causes canine brucellosis, Dr. Paul McGraw, state veterinarian at the Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) has issued a special order requiring dogs that are not spayed or neutered and are bought or obtained at an auction outside the state. These dogs cannot be imported into Wisconsin without meeting the new requirements. “Canine brucellosis is on the rise in Wisconsin threatening the health of both dogs and their owners,” Dr. McGraw said. A significant source of infected dogs are out-of-state dog auctions, where the large-scale sale and movement of untested or known positive dogs often occurs. The special order prohibits the importing of a sexually intact dog into Wisconsin that has been bought or obtained from an auction outside the state unless the dog has been issued an import permit from the Department and has documented proof of a negative brucellosis test within 30 days before import. Canine brucellosis is caused by a bacterium called Brucella canis. The bacteria cause reproductive failure in dogs, particularly those kept in kennels for breeding purposes, but can also cause a variety of other health problems that develop later in life. The disease is found worldwide, but in the United States is most frequently found in dogs from southern states.

“Thousands of dogs are transported into Wisconsin from other states annually, in some cases bringing the bacteria into previously uninfected facilities,” McGraw says. The disease is usually spread through contact with infected birthing tissues and fluids, but can also be transmitted by contaminated objects such as bedding, equipment, clothing or shoes. It can also be found in the milk, blood and semen of infected dogs. Humans can become infected by direct contact or aerosol exposure to infected animals fluids. In humans, the symptoms of Brucella infection include fever, headache, weakness, chills and weight loss, and can result in significant health issues if not properly diagnosed and treated. Dog handlers who experience these symptoms should contact their healthcare provider. Dog breeders and dealers are encouraged to work with a veterinarian to develop protocols for testing new animals and quarantining new animals added to their facility. Dog owners should monitor their dogs for signs of the disease and contact a veterinarian if present.” Finally, a reminder that if you are seeing dogs being brought into Wisconsin with heartworm, to contact Dr. Yvonne Bellay at (608) 224-4888. LEGAL BRIEFS Megan A. Senatori, DeWitt, Ross & Stevens, s.c. Dear Legal Briefs, I have a new client who dropped off his cat to be spayed, but then never returned to retrieve his cat. He paid for the services over the phone – so, this is not an effort to avoid paying me. Nonetheless, he never picked up his cat and our calls and emails are not being returned. We’ve been trying for a week! I’m not in the business of re-homing animals, so at this point I’d like to turn this animal over to a law enforcement or humane officer. However, I heard that there were recent changes to Wisconsin law about holding periods for abandoned or stray animals. Do those changes effect veterinarians? I cannot continue to hold the cat and have made lots of attempts to reach this owner. Can you help? Sincerely, Concerned Veterinarian Trying To Do The Right Thing Dear Concerned Veterinarian: Great question. The short answer is that yes, there were changes in March of this year to the holding period in Wisconsin for abandoned and stray animals. However, those changes did not change the legal notification requirements or holding period for a veterinarian who wishes to turn an animal over to law enforcement or a humane officer. Let’s talk details. Effective on March 3, 2016, abandoned or stray animals entering an animal control facility or humane society with an animal control contract now have a five (5) day stray hold period, 4 days plus the day the animal was taken into custody. Wis. Stat. § 173.19(1). However, the animal cannot be euthanized until seven (7) days after the animal was taken into custody, unless euthanasia is necessary to alleviate physical suffering or to protect the safety of shelter staff, volunteers, or the public. Wis. Stat. § 173.19(1m). The holding period was reduced from an eight (8) day hold period under the prior law, which was previously calculated as seven (7) days plus the day the animal was taken into custody. Those changes, however, did not impact the notification requirements or holding periods for veterinarians who wish to turn an animal over to a law enforcement officer or humane officer. Under Wisconsin law, your legal obligations in the situation above are as follows: First, Wisconsin law sets forth a procedure that applies if a veterinarian wishes to deliver an animal to a law enforcement or humane officer. In such a situation, the veterinarian must notify the owner of the animal by certified mail, return receipt requested, that the animal is ready to be picked up and that the animal would be delivered to a law enforcement or humane officer if not picked up within 7 days. Wis. Stat. § 173.13(2) (a)(1). Therefore, while it is great that you have been trying to reach this client/owner by both telephone and email, you must send the notification by certified mail, return receipt requested. Next, the veterinarian must then hold the animal for the full seven (7) days to provide the owner with an opportunity to reclaim the animal. The seven days should be calculated from the day after the day on which the return receipt was signed or until the letter was returned to the veterinarian as undeliverable. Wis. Stat. § 173.13(2)(a)(2). If the animal remains unclaimed and the veterinarian then wishes to deliver the animal to a law enforcement or humane officer, the veterinarian must certify that he/she has followed the notification procedures outlined above. Wis. Stat. § 173.13(2)(a)(3). Finally, if the animal is accepted by the law enforcement or humane officer, the veterinarian “shall provide the person accepting the animal with any requested records concerning the animal’s ownership, health or licensure.” Wis. Stat. § 173.13(2)(b).

Fortunately, the situation you are facing is not common. Most clients are loving owners who are anxious for the return of their animals. Nonetheless, there are indeed situations where animals are abandoned by leaving them with a veterinarian. We suggest the following best practices to navigate this type of situation: • While the law does not require phone calls (or emails) to reach the owner, that is a practical first step. We recommend documenting when those calls (or emails) were placed to the owner and the outcome for each attempt. For example, veterinary records could say “Called 10/3/16 at 3:30pm. Left voicemail stating animal available for pick up.” Document any important details about the calls (i.e., “voicemail box full, unable to leave message”). • If the calls or emails have not been returned within 24 hours, we recommend resorting to the notification procedures above. The fact that the calls have not been returned within a day should be cause for alarm. It could be that the owner is abandoning the animal. On the other hand, there could be an emergency that is preventing the owner from returning the call. Either way, the objective is to get the holding period started so that you, as the veterinarian, are not stuck continuing to hold an animal that has been abandoned by your client. • Follow all of the steps outlined above (send the notification, certified mail, return receipt requested) and then hold the animal for the duration of the holding period. • Maintain documentation of compliance with the notification and holding periods. For example, be sure to retain a copy of the letter that you have sent to the owner. Document in your records how long the animal was held and that you did not receive a response to the letter. Save the receipt from the United States Postal Service that you sent the notification certified mail, return receipt requested. • Follow through on your obligation to certify that you have complied with the notification and hold requirements and turn over the records regarding ownership, health or licensure to the law enforcement or humane officer as legally required. • Left unaddressed by the statutes is whether a veterinarian has a duty to follow the notification and holding procedure if the veterinarian wishes to simply keep or re-home the animal in some other way. To be safe, we recommend following the notification and holding procedure in those situations as well, to protect the veterinarian from a claim by the owner that he/ she did not abandon the animal. n

2016 WVMA Convention Award Winners Friend of Veterinary Medicine Award

The Friend of Veterinary Medicine Award is given to an individual or organization in recognition of their service, commitment, and contributions specifically to organized veterinary medicine in Wisconsin. Dr. John T. Been, Dean Mark Markel, Dean Mark Markel accepted and Dr. Scott Spaulding the award on behalf of the University of Wisconsin School of Veterinary Medicine. “The support the WVMA has received from the veterinary medical school under Dean Markel’s leadership is unmatched,” says Kim Brown Pokorny, WVMA executive director. The School of Veterinary Medicine has helped the WVMA organize wetlabs, hosted executive board meetings, encouraged students and faculty to be members and allowed the WVMA to interact with students throughout the school year. Through Dean Markel’s unwavering support of organized veterinary medicine and his continued dedication through ongoing communications and engagement with both faculty and students, the largest number of faculty and students ever are now members of the WVMA. “I would be remiss if I didn’t recognize everyone at the Veterinary School and Teaching Hospital that supports Dean Markel and his leadership vision,” says Brown Pokorny. “Regardless of their position or title, the entire faculty and staff team is always more than helpful, accommodating and supportive of the WVMA.” Meritorious Service Award

The Meritorious Service Award is given to veterinarians in recognition of their service, commitment, and contributions specifically to the WVMA and organized veterinary medicine. Since graduating from the Drs. John T. Been, James Zielger and Scott Spaulding Michigan State University College of Veterinary Medicine in 1987, Dr. James Ziegler has been an active member of the WVMA. He has served on numerous committees and task forces and will complete a four year term on the WVMA Executive Board in December 2016. “Dr. Ziegler is always the first one to step up and volunteer when help is needed – regardless of subject or issue,” says Kim Brown Pokorny, executive director of the WVMA. Dr. Ziegler founded Wolf River Veterinary Clinic in 1996, a companion animal practice in New London, Wis. with a part time satellite location in Manawa. The clinic also houses S.A.F.E. (Stray Animal Fund Endeavor), a 501(c)(3) program which takes in strays from the area, houses them, cares for their medical needs, and adopts out unclaimed adoptable pets.

“He is a true champion when we need someone to testify at the Capitol on a veterinary bill or rule change,” says Brown Pokorny. “He always rearranges his schedule on short notice and willingly makes the trip to Madison.” Presidential Award

This award is given by the outgoing president to a person or a company who, in the opinion of the president, has provided extraordinary service or assistance to the WVMA. Dr. David Jeans currently serves as treasurer of the WVMA. Dr. John T. Been, Dr. David Jeans, and Dr. Scott Spaulding “One of the most important responsibilities within our organization relates to the management and oversight of our financial health,” says Dr. Been. “Keeping a steady hand and mind on the fiduciary aspects of the WVMA as our treasurer requires a real commitment of time, effort, and talent.” Dr. Jeans earned his bachelor’s degree in Agriculture Education from the University of Wisconsin - Madison in 1985. From 1985-1987, he volunteered with the Peace Corps in Sierra Leon, West Africa. In 1993, Dr. Jeans graduated of the University of Wisconsin School of Veterinary Medicine. “He serves us well and I appreciate his service,” says Dr. Been. Trisha Fasse-Neerhof, DVM Trisha Fasse-Neerhof, DVM. She represented District 3, which includes Winnebago, Green Lake, Fond Du Lac, Sheboygan, Dodge and Washington counties. Dr. Fasse-Neerhof graduated from the University of Wisconsin School of Veterinary Medicine in 2005. Currently, she is practicing mixed animal medicine at Healthy Paws Veterinary Clinic in Sheboygan Falls, which shestarted in 2012. Alan Holter, DVM Alan Holter, DVM. He represented District 6, which includes Sauk, Richland, Crawford, Grant, LaFayette and Iowa counties. Dr. Holter graduated from Iowa State University College of Veterinary Medicine in 1988. He has practiced small animal medicine at Dodgeville Veterinary Service in Dodgeville since 1990. He has been a member of the WVMA since 1990 and has served on the Membership & Member Services Committee, Awards & Recognition Committee, Budgeting and Auditing Committee and has served as vice chairman of the executive board.


James Ziegler, DVM James Ziegler, DVM. He represented District 4, which includes Florence, Marinette, Oconto, Menomonie, Shawno, Waupaca, Outagamie, Brown, Kewaunee, Door, Manitowoc and Calumet counties. Dr. Ziegler graduated Michigan State University College of Veterinary Medicine in 1987 and opened Wolf River Veterinary Clinic in 1995. He has served on numerous committees and task forces and received the 2016 Meritorious Service Award for his years of dedication to the WVMA and organized veterinary medicine. 50 Year Award Winners

Thomas Beckett, DVM Dr. Thomas Beckett graduated from The Ohio State University College of Veterinary Medicine in 1962. He is a mixed animal veterinarian who started his career practicing with his brother in Drs. John T. Been, Thomas Beckett, Rising Sun, Ind. He later Larry Smith and Scott Spaulding moved to Birnamwood, Wis. and in January of 1966 started his own practice which over time grew to a six person practice. Dr. Beckett has many fond memories from his time practicing, but the memories he is fondest of are his time as the president of the WVMA. He served on the WVMA Executive Board for four years. He was president-elect in 1979 and president in 1980. As president Dr. Beckett enjoyed traveling to district meetings and talking to member veterinarians across the state. He also enjoyed being president during the formation of the University of Wisconsin School of Veterinary Medicine. Another fond memory Dr. Beckett recalled was the time that he and Dr. Eric Williams, along with other American Association of Bovine Practitioners (AABP) members, traveled to England and Wales. They presented an award to James Herriot and were also able to visit with colleagues. He practiced for 38 years before retiring in 2000. Throughout his career many changes occurred and the profession evolved. The evolution that sticks out to Dr. Beckett, is how veterinary medicine started as emergency practice and evolved to preventative practice, such as herd health. John Fritsche, DVM Dr. John Fritsche graduated from the University of Minnesota College of Veterinary Medicine in 1966. He is a mixed animal veterinarian who spent the first 20 years as a large animal veterinarian and the last 25 years as a small animal veterinarian. After graduating in 1966, Dr. Fritsche worked at a small animal clinic in Greendale, Wis. for one year before he opened the Franksville Veterinary Clinic in 1967. He retired 46 years later in 2012. Throughout that time Dr.

Fritsche saw much change personally as well as in the profession. Over time he saw his client base change from mostly large animal to all small animal. He also witnessed many technological advances in diagnostic equipment and services. Dr. Fritsche has many memories from his 46 year career, but clients and staff were at the center of those memories. Dr. Fritsche said, “I enjoyed working with clients who were warm-hearted and appreciative of my services. Many of them became really good friends. I also had a wonderful staff of employees who worked hard and were devoted to their responsibilities.” Marvin Rohm, DVM Dr. Marvin Rohm graduated from the University of Minnesota College of Veterinary Medicine in 1957. He is a large animal veterinarian who spent 35 years practicing in both Rudolph and Auburndale, Wis. Of his time practicing Dr. Rohm said, “I worked in the transitional period between Dr. Herriot’s All Creatures Great and Small time and more larger farms and specialized work.” He saw much evolution while practicing. He witnessed small, one person practices change to large multi-person practices. Small dairy farms turn into large dairy farms and the rise in companion animal practices. Dr. Rohm has many fond memories from his career and two that he reflects on are the many friends he made and passion he had for mentoring young veterinarians who chose dairy, genetics and embryo transplant paths for their careers. Lawrence Sirinek, DVM Dr. Lawrence Sirinek graduated from the University of Minnesota College of Veterinary Medicine in 1962. He is a mixed animal veterinarian who spent the last 15 years of his career practicing small animal medicine. He started his career with large animal ambulatory service and over time shifted toward mixed practice. When his knee gave out, he moved exclusively to practicing small animal medicine. As his career evolved so has the veterinary profession. Dr. Sirinek noticed through his career that veterinary clinics went from “primarily do-ityourself” to efficient staffs that include certified veterinary technicians, assistants and practice managers. He also noticed the multitude of technological advances within clinics. Dr. Sirinek has many fond memories of his career, but two stand out. The first happened in 1966, when he constructed a rear support for a dachshund with rear limb paralysis. He assembled the support from aluminum split rods and wheels from children toys. The second memory was when he expanded his practice in Watertown, Wis. to meet the needs of his small animal clients. He said of his career, “It was a very interesting and fulfilling life.” Larry Smith, DVM Dr. Larry Smith graduated from the Iowa State University College of Veterinary Medicine in 1964. In 1965 he purchased a solo mixed practice in Lodi, Wis. sizes. In the 1990’s Dr. Smith left the practice due to health reasons and moved to conducting studies for the pharmaceutical industry which he continues today. He is an active member of the WVMA, serving one term as the District 5 representative on the Executive Board, on the Veterinary Diagnostic Lab Committee and on the Legislative Committee. Dr. Smith was the committee chairman when the state legislature passed the bill to create the University of Wisconsin School of Veterinary Medicine. He was honored by the WVMA in 1980 by receiving the Meritorious Service award and the Veterinarian of the Year award in 1985. Dr. Smith’s career spans more than 50 years and is full of great memories and experiences. Dr. Smith recalled one of his most fond memories from practicing, “I recall a humorous incident when a client was certain her cat had a massive tumor in its abdomen. I palpated the cat and informed [the client] that I could feel the kittens in the abdomen. She informed me that was impossible because the cat never goes out of the house. She insisted it was a tumor and she wanted an x-ray to prove it! To keep her happy, I did the x-ray and showed her the skeletons of six kittens. I asked her if there were any other cats in the house. She replied that the cat’s son was but you didn’t need to worry about him being involved! When I informed her that in that situation, cat behavior is different than what it usually is with humans, she

grabbed her cat and left, never to be seen again.” Dr. Smith said about his ongoing career, “A degree in veterinary medicine affords opportunity to explore many different careers.” Robert Swingen, DVM Dr. Robert Swingen graduated from Iowa State University College of Veterinary Medicine in 1966. He is a mixed animal veterinarian who practiced in LaCrosse, Wis. He said of his career, “I found veterinary medicine to be challenging and interesting every day. I enjoyed the people I worked with and found those relationships very satisfying. Medicine and science were of special interest to me [and this] career filled the goals I had set in life.” As a WVMA member, Dr. Swingen served on the Executive Board as the District 7 representative from 1988 to 1991. He practiced veterinary medicine for 44 years. Over that time he saw the industry and the profession change. Dr. Swingen said, “The greatest change has been the explosion of information and continuing education at the state and national levels. The internet, magazines, books, seminars all contributed to the advancement of veterinary medicine. The second change has been the advancement in business management and finance that has allowed veterinarians and staff to work more efficiently and as a team to provide the best care for clients and their and their animals.” n

Your Best Bet for Paying Associates

Darren Osborne, MA, Director of Economic Development, Ontario Veterinary Medical Association If veterinary medicine was a casino, in employment terms the practice owner would be “the house” and the associate veterinarian would be “the player”. In this environment, when both parties are generally risk adverse individuals, the option of commission based pay can be the best bet for both the house and the player. The process of hiring a veterinarian is a bet. The practice owner is placing a bet that the new associate will bring in enough revenue to cover their wage and the costs associated with running the veterinary hospital. The associate knows the amount of money at stake but is betting that their new job will have enough non-pecuniary benefits to like quality of clients, co-workers, boss, environment, commute and stress to justify the commitment. At the end of any given period, both the owner and the associate weigh the gains and losses in their respective roles and decide to continue or terminate the employment. Weighing the risks, the owner has the most to lose. They are placing a bet that may lose money for a short time but will eventually pay off. If the associate does not earn enough to cover the costs associated with employment, it comes out of the owner’s pocket. Worst case scenario, the associate not only costs the practice money, but damages the long term reputation of the practice. The associate has less to lose because they get paid (for a while) regardless of the revenue they generate. If the associate decides the non-pecuniary benefits are not enough to justify the employment they can quit and find employment elsewhere. Given the current economic climate of falling client numbers and stagnant veterinary revenues, the risk of hiring an associate veterinarian has to be near an all-time high. When you layer that risk with the notion that most veterinarians are risk averse individuals anyway, we are left with a casino where everyone is standing around the gaming table and no one is placing or accepting bets. Enter a new game – commission based pay. Commission based pay provides an opportunity for the practice owner to transfer some of the risk to the associate veterinarian. When the associate is paid based on commission, the owner is off the hook for any losses. If the associate does not perform, they do not get paid. If the associate turns out to be the better than average, the practice owner pays them what is due to them for their superior performance. With commission based pay the associate is taking on more risk but that additional risk provides an opportunity to earn significantly more income. If the commission based associate lands a job with higher than average client numbers, higher than average fees and a crack team of technical staff, they can earn as much as a practice owner. However, if that same

associate lands a practice with slow client traffic, low fees and little assistance, they can struggle to eat. For the latter reason, a guaranteed salary tied to the commission based pay is the best option. Decades ago, Mark Opperman, a practice management consultant, coined the term ProSal to explain a combination of production based pay and salary based pay. With ProSal, the associate’s pay is based on production but is guaranteed their salary every month even if they do not make their revenue target. A ProSal agreement might look something like this – an associate gets paid 25 percent of their professional revenue but is guaranteed to earn a salary of $80,000 per year. If the associate generates more than $320,000 in professional revenue they will earn more than $80,000 (25 percent of $320,000) and if they generate less than $320,000 they will get the minimum salary of $80,000. This guarantee of the salary ameliorates some of the risk for the associate and protects them from earning less than a specific amount. ProSal works for a practice owner because they can transfer a lot of the risk to the associate. For example, if a practice owner is presented with an associate who expects a salary of $125,000, the practice owner can either pay the higher salary and take on the risk or offer a ProSal arrangement that pays the average salary ($80,000) and 25 percent of professional revenue. If the associate earns $400,000 in professional revenue they will earn their target income. With ProSal, if the associate is unable to live up to their expectations, for whatever reason, the practice owner is not on the hook for the extra income, the associate is. In the examples above, I have used the term “professional revenue”, this includes all revenues except pet food sales. Pet food sales are generally not included because the mark up is too low to provide a commission based income. Some hospitals offer 10 percent of food sales when it is on the invoice for a visit with the veterinarian. When a client comes in to purchase food between visits with the veterinarian, the income goes to the hospital and the associate veterinarian generally does not receive any compensation. The same policy applies to drugs and medication sales – if it is sold during the consultation then the revenue would be applied to the associate – if the client picks up a refill the revenue would be applied to the hospital. In an era where future revenues are unpredictable for even the most savy practice owner and associates have a desire to earn above average incomes, ProSal can be the best bet. n
