OSHA, Wisconsin Veterinary Medical Association Alliance Aims To Reduce Employee Exposure to Hazards Associated with Veterinary Medicine OSHA and the Wisconsin Veterinary Medical Association (WVMA) established an alliance to provide the association’s members with information, guidance and access to training resources to protect workers’ safety and health. The alliance will emphasize reducing injury and illness on the job and will focus training on common hazards faced by veterinary clinic workers, including exposure to pharmaceuticals, anesthetic gases, sterilization agents, x-ray radiation and animal behavior. Training will also cover hazards related to ergonomic stressors associated with the lifting and handling of animals. OSHA and the WVMA will work together to promote awareness of the agency’s rulemakings, enforcement initiatives and safety campaigns, including an understanding of workers’ rights and employer responsibilities. The partners will also speak, exhibit and appear at OSHA or WVMA conferences, forums and roundtable meetings on hazards veterinary clinic workers face on the job. “OSHA’s alliance with the WVMA allows us to work together with veterinary industry employers, workers and leaders to promote awareness and provide training to improve worker safety in Wisconsin clinics and field operations,” said Ann Grevenkamp, OSHA’s area director for its Madison office. “The people who care for our pets and other animals face many unique hazards including work-related musculoskeletal disorders, which are among the most frequently reported causes of lost or restricted work time. Working together, we can develop methods to reduce such injuries.” Through its Alliance Program, OSHA works with groups committed to worker safety and health to prevent workplace fatalities, injuries, and illnesses. These groups include unions, consulates, trade or professional organizations, businesses, faith- and community-based organizations, and educational institutions. OSHA and the groups work together to develop compliance assistance tools and resources, share information with workers and employers, and educate workers and employers about their rights and responsibilities. Starting with the January 2017 issue of the WVMA Voice, look for monthly articles from OSHA addressing different work place topics. The articles will address all areas of the veterinary medical profession. The first topics to be covered include: • Animal Bites • Anesthesic Gases

2016 AVMA Economic Summit Dr. Scott Spaulding

The AVMA Veterinary Economic Strategy Committee and the Economics Division hosted the 4th annual Economic Summit in Schaumburg on October 24 – 25. A few dozen participants attended the first Summit in 2013, over 200 representatives of private practice, academia, allied organizations and industry participated in this year’s event, legitimizing the AVMA Executive Board’s 2009 vision to develop strategies addressing the profession’s economic issues. I’m most gratified, as an inaugural committee member and recent committee chair, to report the progress made in understanding our profession’s finance and economics is nothing short of amazing. Twenty-four presentations on wide varieties of financial and economic topics place this meeting at the top of the attendance list for veterinarians seriously interested in fine tuning their practice’s financial performance. A few high highlights-

The new sign at the clinic entrance was unveiled during a special ceremony on Thursday, Sept. 22, 2016. New OSHA Rule Eliminates Blanket Post-Accident Drug and Alcohol Testing By Stephen A. DiTullio, DeWitt Ross & Stevens, s.c.

In mid-May of this year, OSHA announced a new rule that eliminates employers’ use of blanket post-accident drug and alcohol testing in the workplace. The new rule was originally set to become effective on August 10, 2016, but was then delayed until November 1, 2016. As of November 1st, if your veterinary practice or clinic uses a blanket post-accident drug and alcohol testing policy, it should immediately cease from doing so. The generally recommended best practice at this point is to pursue one of three options: 1. Cease using a blanket post-accident testing policy in favor of a reasonable suspicion testing policy. 2. Provide specifically in the post-accident testing policy that it is not a blanket requirement that all accidents will require testing, but rather only where it appears an employee’s consumption of alcohol or drugs likely caused or contributed to the accident. 3. Allow both 1 and 2 in your workplace. Of course, other additional best practices must be considered when preparing either a limited post-accident testing policy or a reasonable suspicion testing policy. For example, in regard to a reasonable suspicion testing policy, an employer should outline in writing for managers to follow a list of telltale signs that would result in a reasonable suspicion of alcohol or drug use (e.g. slurring of words, bloodshot eyes, loss of balance, smell of alcohol or marijuana, etc.). Similarly, it is recommended that a similar outline in writing should be prepared to provide signs or support that consumption of alcohol or drugs likely caused or contributed to the

accident. Another essential part of any drug testing is to determine which drugs will be tested for and include that list in your policy. As a reminder, never allow an employee who is being tested to transport himself/herself to the testing location; a designated management employee should provide that transportation for the employee. Keep in mind that if drug and alcohol testing is conducted pursuant to existing requirements of a federal or state law, it will not be considered a violation of this rule to continue such post-accident testing (for example, pursuant to federal Department of Transportation regulations). Likewise, the new rule does not impact pre-employment drug tests. But as another reminder, such tests should only be administered after a job offer has been made contingent upon passing a drug test and/or background check. While any of the above three approaches is acceptable, any employer that currently uses a blanket post-accident testing policy should consider which approach makes the most sense for its workplace. The key point is that any blanket post-accident testing policy needed to be changed by November 1, 2016 – or if it has not yet been done, it should be changed immediately. All veterinary practices and clinics should double check their employee handbooks or other workplace policies to ensure that this change has been made. Failure to comply with the new OSHA rule could result in the assessment of penalties – which increased earlier this year at a level up to $12,471 per violation or up to $124,712 for willful violations. As such, this failure to comply could be expensive, but it can be easily avoided if action is taken now to update any such policies. n

Membership Approves Changes in Life Membership Category At the October 14, WVMA Annual Business Meeting, the WVMA membership approved to update the life member category. Below is the new description with the approved changes. To see a complete listing of WVMA member categories, visit www.wvma.org. Life Member - A life member is one who has reached the age of 70 years by January 1 of the year the application is made and has been an active member of the state association for at least 35 continuous years. Upon application to the association, such person may be designated a life member following the approval of the executive board. A life member shall be exempt from paying dues. Such life members may participate in association activities and serve on the committees but may not hold elective office or serve as a member of the executive board. This individual shall not be allowed to vote. Cost $0/year. n

Speakers Announced for “What’s your piece in animal welfare?” WVMA Seminar March 30, Madison, WI Dr. Yvonne Bellay

Dr. Yvonne Bellay manages animal welfare programs for the Wisconsin Department of Agriculture, Trade and Consumer Protection, where she is also an epidemiologist. She oversees the department’s training and certification of local humane officers, and its dog seller and rabies control programs. In addition, she deals with zoonotic disease and public health issues, serving as the department’s liaison with state and local public health departments. Dr. Bellay also acts as a resource to local authorities in investigating and resolving local animal welfare complaints. Randall Lockwood, Ph.D.

Extension Faculty from the Department of Animal Sciences and Iowa State’s statewide network of county and regional extension specialists, he is responsible for the development and delivery of veterinary extension programs designed to meet the needs of Iowa’s cattle industries, veterinarians and the allied agri-business industry. Dr. Shearer’s primary areas of research interest are lameness and welfare issues of beef and dairy cattle. He is a Diplomate of the American College of Animal Welfare and serves as a board member and scientific advisor to multiple organizations and dairy operations. Meg Sohns

Dr. Randall Lockwood has degrees in psychology and biology from Wesleyan University in Connecticut and a doctorate in psychology from Washington University in St. Louis. He is currently Senior Vice President for Forensic Sciences and Anti-Cruelty Projects at the American Society for the Prevention of Cruelty to Animals. He has testified in many trials involving cruelty to animals or the treatment of animals in the context of other crimes, including dogfighting, child abuse, domestic violence and homicide.

Meg Sohns is the Crisis Intervention Manager at Domestic Abuse Intervention Services (DAIS). In her role at DAIS, Meg coordinates the Crisis Response and Crisis Line Programs, supervising 35 - 40 individuals within both programs. She also oversees the Sheltering Animals of Abuse Victims (SAAV) Program for DAIS, providing direct services to SAAV’s clients. She has worked at DAIS since the Spring of 2008. Meg graduated from Winona State University in 2007 with a Health Promotion – Community Health Degree with a Women and Gender Studies Minor.

Michelle Welch is a Senior Assistant Attorney General in the Virginia Attorney General’s Office and is the Director of the Animal Law Unit at the Attorney General’s Office. She is charged with taking all animal law questions in Virginia. She is called on by agencies all over the Commonwealth to act as a special prosecutor in animal cruelty and animal fighting cases. Michelle has been appointed a special Assistant U.S. Attorney for the Western District of Virginia to aid in animal fighting prosecutions. She frequently gives advice to local law enforcement authorities and prosecutors all over Virginia and across the nation. She also trains prosecutors, animal control and law enforcement officers on the state of Virginia animal law. She is a frequent speaker at many conferences, including the Virginia Animal Control Association and is the President of the Virginia Animal Fighting Taskforce. Food Armor® Recap 2016 By: Dr. Katie Mrdutt, Food Armor® outreach specialist

2016 has been an exciting year for the Food Armor® program! Following a successful national launch in the fall of 2015, the Food Armor® program continues to grow and receive requests for trainings across the nation. In 2016, the program trained over 850 veterinarians, producers, industry professionals and veterinary students in 11 different states across the country. A few of the year’s highlights include the visionary move to the Food Armor® Foundation, a nationally recognized award from the USDA NIFA Veterinary Services Grant Program and the successful completion of the program’s first third party audit to officially make Food Armor® a nationally recognized, independently verified program. In May of 2016, the WVMA Executive Board approved the separating of the Food Armor® program from the WVMA to its own 501(c)3 non-profit foundation. This monumental move allows for the program to more accurately portray its national scope and provides for a sustainable model for the future. The final steps of the move are in place and the new board of directors will soon be seated. In August of this year, the Food Armor® program was notified by the USDA that it was awarded a multi-year grant from the USDA NIFA Veterinary Services Grant Program (VSGP). The grant will allow Food Armor® to train veterinary medical students in multiple veterinary colleges over

the next three years, providing 4th year food animal veterinary students valuable skill sets to take to into practice and better serve their food animal clients. The goal of the Veterinary Services Grant Program is to provide education, extension and outreach to rural, veterinary shortage areas. Over the life of the grant, the program plans to train 450 veterinary students. In 2016, Validus performed the first third party verification audits on Food Armor® certified farms. Independent third party verification is crucial for demonstrating transparency, accountability and continual improvement to consumers of dairy products. The information gathered during these audits not only provide feedback for the program to continuously improve its training and outreach but also allows for Food Armor® to demonstrate to outside stakeholders the impact it is having on our nation’s dairy farms and food supply. Food Armor® has proven to be a comprehensive, grass-roots action plan program that provides concrete solutions to achieving responsible medication use on farm. Wellness Risk Factor Study Finds Positive Correlation to VMA Membership By: Caroline Faust, DVM and Elizabeth Strand, PhD, LCSW The University of Tennessee Knoxville, Veterinary Social Work Program

In a recent article published in JAVMA, Nett et al. (2015) found that membership in a veterinary medical association is positively correlated with less mental illness and suicidal ideation. The authors also found that 9.3 percent veterinarians were experiencing severe psychological distress at the time of the survey and that 16.8 percent had contemplated suicide since graduation. These distressing numbers are higher than that of the general US adult population. The number of veterinarians currently in psychological distress nearly doubles when controlling for membership in organized veterinary medicine (9.3 percent for members of a VMA vs. 17.5 percent for those that are not). A similar but less pronounced pattern is seen when examining the relationship between currently married, separated/divorced and never married veterinarians (8.1 percent, 13.8 percent and 14.3 percent respectively). The authors hypothesized that these patterns may be related to the interpersonal relationships in a veterinarian’s life. They go on to site research that names social support as a positive influence on mental health. Alternate factors associated with psychological distress were working in shelter medicine and being in practice for less than 20 years. It was unclear from the data if it was age, a change in class selection criteria,

or another factor that led to increased risk in younger vets. Other research questions revealed a disconnect between veterinarians and the general population when it comes to perception of those with mental illnesses and the help available. Psychologically stressed veterinarians were significantly less likely than those similarly afflicted in the general population to state that “People are caring towards those persons with mental illness,” and less likely than nondistressed veterinarians to agree that “Mental health treatment is accessible.” This perception of a lack of support may be one factor contributing to higher distress levels. The findings of this study open a pathway to better caring for veterinarians in psychological distress. Veterinary medical associations play an important part in this battle as they provide social support and a vehicle for dissemination of information. Because so many veterinarians in distress perceive that no aid is available, VMAs have the opportunity to step in as helpers. Support systems such as the AVMA’s Early Career Online Community and VIN’s From the Trenches message board provide practitioners with a group with whom they have similar trials, worries, and sometimes even victories.
