She then worked in an emergency hospital in Louisville, Ky. before settling into general practice in southern Indiana. Impressions of FFA Proficiency Awards Dr. Jane Clark

I recently represented the WVMA at the Wisconsin FFA Convention held annually at the Alliant Energy Center in Madison. We sponsor the awards in the Veterinary Science proficiency area and I presented the 1st Place award to this year’s winner who worked for a small animal veterinary clinic where she performed hands-on care of the animals and assisted the veterinarian with treatments. All FFA members have the opportunity to participate in “Supervised Agricultural Experience (SAE)” awards. An SAE is a year-round activity, conducted outside the classroom, which will help develop the students’ skills in agriculture and one or more areas focused specifically on research, business or employment. It really is a real-life model for students to get their hands wet in an area of interest to them. But besides learning new skills that may help create solutions to problems, feed the general population or serve the community, FFA also is important in other ways. They meet new people and make new friends. Some of these people have influence over government policy, such as senators, congressmen and local commissioners. Others are important as networking contacts. You never know what job might open up that someone thinks you are perfect for! FFA students often travel to leadership conferences to help build student leaders, give them confidence, and help them grow and develop as people. They can attend career development events, which are competitions to challenge participants to improve their knowledge and skills to gain an edge in different categories. The direct practical experience an FFA member gains by choosing one or more of the available

proficiency categories, leadership conferences or career development events all contribute towards the member’s eventual career success. Lastly, many scholarships are awarded to FFA members either by the National FFA Foundation, local FFA chapters or alumni groups. I was the recipient of an FFA scholarship to apply towards my undergraduate degree at the UW-Madison in 1976. So how does this column have meaning for WVMA members? Why should you care? Well, while the WVMA sponsors the state Veterinary Science proficiency award, there are many other awards that apply to veterinary medicine that you or your clinic could become involved with in one way or another. Whether you assist a student in defining a research project involving cattle, swine, sheep, equine, goats, poultry or wildlife, or you hire an FFA student to assist you in your small animal hospital, or you answer health related questions in a disease outbreak, sponsor a scholarship, or become a mentor, there are many ways in which our profession could help these students become energized, knowledgeable and productive members of our animal dominant field. Revised Bylaws up for Vote at Annual Meeting Kim Brown Pokorny

Under the guidance and oversight of the WVMA attorney and the Nominating and Procedural Committee, the Executive Board has discussed, updated and approved the revised bylaws for your consideration. Over the years, changes have been made at annual meetings that would impact one section of the bylaws, but created an issue with another section of the document. The thorough revisions took all sections into consideration are comprehensive and provide clarity. The primary areas of revision include renumbering the order of the bylaws (for better flow), a change in membership categories and removing items that our attorney recommended be included in association policies, not the bylaws. Furthermore, the position of treasurer can now be held by an active or life member of the WVMA. Members are encouraged to view the proposed, revised bylaws under the “members only” section of the WVMA website, www.wvma.org. Members will vote on the bylaws at the Annual Meeting on Friday, October 9. n

Obtaining Informed Consent In An Emergency When The Owner Is “Missing In Action” Megan Senatori, DeWitt Ross & Stevens, s.c.

Question: I heard a story online about how a woman was watching a friend’s cat and ended up paying $700 in emergency veterinary care only to have the friend (owner of the cat) go MIA after vacation. When owners are on vacation, who is in charge of the veterinary care and how should vets handle these situations? This is a good question and one that fairly commonly arises. What happens when the owner, who is the person who has historically provided direction regarding the animal’s care, is on vacation (or otherwise MIA) and a medical emergency occurs involving the animal? Who can make decisions regarding the animal? How can veterinarians protect themselves while also protecting the health and well-being of the animal? This month’s Legal Brief addresses emergency care when the owner is not present due to vacation or some other reason and, in particular, how to meet informed consent requirements. As a starting point, the veterinarian should be concerned about how to comply with the informed consent requirements in this scenario. Under the law, informed consent must be provided by the veterinarian to the “client.” That does not necessarily mean that informed consent must be obtained from the owner of the animal. VE 1.02(3) clearly defines “client” to include both “the person who owns” the patient, as well as “the person … who has primary responsibility for the care of the patient.” There are a variety of scenarios in which a person who presents a patient for care may not be the “owner”, but may well have the “primary responsibility for the care of the patient.” The care of an animal during an owner’s vacation is one such scenario. The purpose of the language in VE 1.02(3) is, in our view, to provide some degree of flexibility so that the veterinarian can obtain informed consent to proceed with the care of an animal during an emergency even when the owner of the patient is not readily available for some reason. We believe it is acceptable under the law for the veterinarian to rely upon informed consent received from the person who is responsible for caring for the patient while the owner is on vacation. For example, this person may be a friend or family member of the owner, or could even be someone at a boarding facility or a pet sitter who is caring for the animal during the owner’s vacation. While speaking with the owner of the animal is always preferable, the informed consent rule specifically allows the veterinarian to obtain informed consent from a non-owner who has “primary responsibility for the care of a patient.” As a precaution, we recommend several “best practices” in this type of situation: • The veterinarian should inquire of the person presenting the animal if the owner is available by telephone and, if so, we suggest trying to reach the owner. We recommend then documenting in writing that the veterinarian tried to reach the owner. If the veterinarian is successful in reaching the owner, the owner can provide direction regarding the animal’s care over the phone. If the owner cannot be reached, the likelihood of an unhappy client or the filing of a grievance is reduced by

the veterinarian having tried, even without success, to reach the owner. • The veterinarian should verify with the person presenting the animal that he or she has primary responsibility for the care of the animal while the owner is out of town or otherwise unavailable. It is always a good idea to have the person presenting the animal make that representation in writing, but inquiring verbally and documenting that in the records will also suffice. What if the medical emergency is serious enough that taking steps to locate the owner could jeopardize the patient’s health? On the one hand, a veterinarian who proceeds with emergency treatment before receiving informed consent could end up with a client who refuses to pay for the services rendered or who objects to the services for some other reason. On the other hand, trying to locate the owner to obtain informed consent in certain emergency situations could risk the patient’s health, cause unnecessary suffering to the patient, and could potentially result in the patient’s death if treatment is not given in time. Either option poses risks, but, on balance, we believe the best option in this particular situation is for the veterinarian to first stabilize the animal and then obtain informed consent from the “client” prior to any further treatment. Stabilizing the patient is consistent with the Veterinarian’s Oath, which requires “the protection of animal health” and “the prevention and relief of animal suffering.” It is likewise consistent with ethical considerations, as the American Veterinary Medical Association Principles of Veterinary Medical Ethics provides that “veterinarians should first consider the needs of the patient: to relieve disease, suffering or disability while minimizing pain or fear.” Additionally, it seems unlikely that a grievance would be warranted where a veterinarian acted to try to save the patient’s life. Veterinarians might consider using forms that ask owners to list the persons who may make medical decisions regarding the animal’s care in the event of an emergency. Such a form can be kept with the patient’s records and is helpful in providing the veterinarian with guidance before a medical emergency arises. Such paperwork may not solve all problems (i.e., what happens when the owner leaves the animal with someone who is not listed on the paperwork), but it can be helpful in many situations. We previously assisted the WVMA with creating forms that address issues such as this. Such forms are available to members on the WVMA’s website. The forms are templates only and should be modified to suit a veterinarian’s unique needs and practice. However, the forms provide a good start for implementing written policies and procedures to ask for information before an emergency situation arises. Last, but not least, how does the veterinarian ensure payment in this type of situation? We recommend getting the payment up front. Then, the person caring for the animal and the owner can resolve any issue between them, without the veterinarian being stuck in the middle or getting stuck with the tab. n

A Pinch of Prevention is Worth a Pound of Cure One of the most satisfying parts of doing behavior in general practice is the opportunity to find concerning behaviors on regular exams and help prevent them from becoming bigger problems. Early intervention can give both owners and pets a much happier relationship and can pave the way for a healthier pet physically and mentally. The Time and Place for Pharmaceuticals With the many adjunctive therapies, supplements, diets and psychopharmaceuticals on the market today, it can be difficult to decide what to implement and when. This session discusses indications for implementing your multi-modal therapies to yield the best outcome behaviorally. Indications for sedation and pre-medication for general exam and procedures in private practice are also discussed. By keeping these tools in mind, a pet’s medical and prophylactic care can be tailored to their individual behavioral needs to allow that pet to be as comfortable and confident as possible during their visits. Keeping Good Puppies from Going Bad This lecture covers puppy socialization classes, what to ask in puppy visits in relation to behavior and recognizing red flags in young puppies. This lecture will help arm you with the information to keep puppies in their home and keep a strong bond with their humans. Husbandry Training. It’s Not Just For Zoos Anymore! When low stress handling or drug desensitization is not enough, training will be needed. This lecture covers implementing a training program for patients that are very fearful at the veterinary hospital. Go beyond “happy visits” and teach animals to cooperate with their own care to increase client compliance.

Training Pets to Veterinary Procedures Melissa Newcomb, DVM and Alicea Howell RVT, VTS (Behavior), KPA CTP In a busy practice it can be hard to imagine taking the time to train animals to be more comfortable with veterinary procedures such as ear and eye exams, blood draws and nail trims. However, this wet lab will demonstrate how easy it can be to modify current procedures to greatly improve patient compliance and reduce stress. The outcome will not only be more comfortable patients, but also higher morale among the staff and less injuries! Much of this conditioning can be accomplished at regular appointments and the majority of it can be accomplished by the technicians. The small animal wetlab will be located at the Dane County Humane Society on Sunday, October 11.

Heidi Barnes Heller, DVM, DACVIM Dr. Heidi Barnes Heller received her DVM from Michigan State University in 2000, followed by a rotating internship at the University of Illinois. Board certification was obtained from ACVIM following completion of a residency in neurology and neurosurgery in 2004. She was the staff neurologist in a Chicago referral hospital until December 2011, at which point she joined the UW-School of Veterinary Medicine as a clinical assistant professor in neurology and neurosurgery. Managing Chronic Canine Seizures What does good seizure control mean? This session will focus on antiepileptic drug treatment options, therapeutic monitoring, and target seizure management for canine seizures in a case based format. What’s New in Feline Seizure Management? Managing a feline patient with seizures can be challenging! In this session we will discuss new (and old) anti-epileptic drug treatment options, how to interpret serum drug levels for cats, and several case examples. The Neurologic Examination for the Busy Practitioner You don’t need to be a neurologist to be successful! Learn tips on how to perform the neurologic examination and localize a lesion within the brain, spinal cord or neuromuscular system. During this session we will review pertinent neuroanatomy and will practice lesion localization through case based discussions. Walk the Line: The Many Uses of Gait Analysis During this session we will focus on differentiating between lameness, ataxia and paresis when watching a patient walk and the significance associated with each of these findings. Demystifying Canine Vestibular Disease During this session we will review the anatomy and normal function of the vestibular system, and apply this knowledge to a case based discussion of lesion localization, differential diagnosis, diagnostic testing and treatment options for canine vestibular disease. Sheryl Shaw, DVM, MPH APHIS Module 4: Preventing Disease Introduction and Spread As an accredited veterinarian, one of your many roles and responsibilities is to ensure disease is not introduced or spread among animal populations. Veterinarians providing education about

zoonotic diseases is another important responsibility. This can include instituting biosecurity protocols, proper disinfection procedures, and wearing appropriate personal protective equipment (PPE) when working with animals. This module will review concepts that are essential to prevent and control the spread of infectious disease agents. After completing this module, an accredited veterinarian will be able to: • Describe disease prevention practices that limit exposure to animals and humans • Select job-appropriate PPE to minimize zoonotic disease exposure and fomite spread • Implement appropriate cleaning protocols and select effective disinfectants for different situations • Implement basic biosecurity practices for veterinary clinics, animal shelters, and livestock facilities • Access additional resources for infection control practices including appropriate PPE selection APHIS Module 6: Exotic Avian Diseases This module consists of two sections that will prepare you to recognize two important diseases that poultry, pet and zoo birds share. First, you will learn some general information that pertains to avian influenza (AI) and exotic Newcastle disease (END). Then you will apply the introductory information to a scenario based on an exotic avian disease case that occurred in the United States. Upon completion of this module, you will be able to: • Realize the economic impact of an exotic avian disease outbreak • Describe the hazards presented by less virulent forms of AI and Newcastle disease viruses • Recognize the clinical signs associated with high pathogenicity avian influenza (HPAI) and END • Apply basic biosecurity measures for these diseases • Report a possible exotic avian disease and understand the investigative process APHIS Module 10: Personal Protective Equipment for Veterinarians The focus of this module is primarily on daily protection from biological hazards. A review of more sophisticated levels of PPE utilized as part of an animal health emergency response is also provided. APHIS Module 12: Animal Disease Traceability Upon completion of this module, an accredited veterinarian will be able to: • Explain the aspects of ADT to clients and the public • List the official identification devices and methods used for different livestock species • Explain why documentation of interstate movement of livestock is necessary for effective traceability • Locate the regulations governing the interstate movement of different species of livestock • Describe the responsibilities of an accredited veterinarian with respect to ADT, specifically Title 9 of the Code of Federal Regulations (CFR) Part 86 and Part 161 APHIS Module 23: Use of Antibiotics in Animals One of the primary roles of many accredited veterinarians is to identify, treat, control, and prevent disease in animals. Many of these diseases are a result of a bacterium and require antibiotic administration as a means of treatment to relieve animal suffering and reduce pathogen load in animals destined for human consumption. Deciding which antibiotic to use can be complicated in some cases. Veterinarians utilize their problem solving skills, clinical training, and information gained through continuing education to arrive at the best possible option to treat their patients. Increasing awareness of the diagnostic tools, regulatory issues, and antibiotic resistance debate led to the development of this educational module. Upon completion of this module, accredited veterinarians will be able to: • Evaluate various parameters when selecting antibiotics for use in animals • Describe the benefits and limitations of various antibiotic susceptibility testing options • Locate and interpret antibiotic labels for the purposes of informed therapeutic decision-making • List the agencies involved in regulating antibiotics and monitoring antibiotic resistance and residues • Apply the key components of the Animal Medicinal Drug Use Clarification Act (AMDUCA) to making decisions about antibiotics • Locate information to assist in making decisions on antibiotic use in animals Large Animal Track 1

Michael Apley, DVM, PhD, DACVCP Dr. Michael Apley is a veterinarian with a PhD in physiology (pharmacology), and is a Diplomate of the American College of Veterinary Clinical Pharmacology. His practice background includes general practice in central Kansas and a feedlot consulting/contract research practice based in Colorado. Dr. Apley was on the faculty at Iowa State University through 2005 and is currently a professor in the Department of Veterinary Clinical Sciences at Kansas State University.

Residues in Milk and Cull Dairy Cows This session evaluates specific challenges with violative residues in cull dairy cows (as well as other food animals) and also what we have learned from the recent FDA milk residue study. At the end, you will understand where tolerances come from, where they do and don’t apply, how cull cows and milk are tested, and a practical to-do list to help your clients avoid violative residues. Juggling VFDs, Prescriptions, VCPRs, ELDU Prohibitions, and Guidance Documents December of 2016 is on the way and marks the time when veterinarians will take responsibility for authorizing an additional 97 percent of all food animal antimicrobial use; that of feed and water use. There are a lot of questions out there as to the VFD format and what all is covered. As if this weren’t enough, now there are even more reasons to worry about the definition of “veterinary oversight” and who will determine this definition. What is a guidance document and what does that have to do with you? Are you sure you understand the ins and outs of the extralabel use prohibitions? If you think regulators and legislators are going to be the key drivers of change, you might want to think again. What is Driving all this Regulatory Activity Anyway? Real and Perceived Issues with Antibiotic Resistance This session covers the antibiotic resistance challenges in both human and veterinary medicine. How are the challenging pathogens related? Who is to blame? What are the main antibiotics of interest? What is medically important and who decides what is and isn’t? Who is this consumer guy anyway? Where Does Susceptibility Testing Fit in Everyday Practice? Yup, not every animal with a “susceptible” bacterial infection will be a treatment success, and not every animal with a “resistant” infection will be a treatment failure. It is about populations and success/failure rates with and without an effective antibiotic. Do you know which susceptibility testing criteria have been approved by the CLSI? Would you like some questions to ask diagnosticians about your susceptibility testing results which will make them run down the hall screaming and throwing papers? Sure you do. What Do Antibiotics Actually Do Anyway? Now that we have talked about residues, regulations, resistance, and susceptibility testing, do you ever wonder just what difference you make in treatment outcome for all of this trouble? What about respiratory disease, pinkeye, footrot, hairy heel wart, or mastitis? Well, since you asked, it so happens that in cattle we probably have the most negativecontrolled, naturally-occurring disease, prospective, and randomized clinical trial data of any species (including humans). You will get to guess number-needed-to-treat (NNT) for each disease before the results are revealed. n

Bochsler Chosen to Lead Veterinary Diagnostic Lab Philip N. Bochsler, chief of pathology at the Wisconsin Veterinary Diagnostic Laboratory (WVDL), has been selected as the lab’s next director. Dr. Bochsler will assume his new duties Monday, July 6. UW-Madison Chancellor Rebecca Blank, in consultation with the WVDL Board of Directors, appointed Dr. Bochsler after a national search. Darrell Bazzell, UW-Madison vice chancellor for finance and administration, says Bochsler has developed a strong record of leadership, service and achievement since he joined the WVDL management team in 2001. “With his experience and expertise, Dr. Bochsler is well-suited to move into the director’s position and provide the highest quality of service to the lab, the university, the state and its agricultural community,” Bazzell says. The WVDL is attached to UW-Madison’s Office of the Vice Chancellor for Finance and Administration for administrative purposes. Dr. Bochsler says he is honored to have the opportunity to serve the state of Wisconsin and a world-class laboratory and university. “I look forward to working with the outstanding team of professionals at the WVDL and with our clients and partners across the state,” he says. The WVDL’s mission is to promote animal and human health by providing high quality veterinary diagnostic laboratory services and professional expertise.

In addition to his duties as WVDL’s chief of pathology, Dr. Bochsler is a clinical diagnostic professor in the School of Veterinary Medicine’s Department of Pathobiological Sciences. Dr. Bochsler will succeed Dr. Peter Vanderloo, who has served as interim director since the departure of former director Thomas McKenna in September 2014. McKenna left the WVDL for a new position in Massachusetts. Philip N. Bochsler The WVDL’s mission is to promote animal and human health by providing high quality veterinary diagnostic laboratory services and professional expertise. The lab serves diverse groups ranging from industry and regulatory agencies to local communities, animal owners and veterinarians. In addition to its main facility at UW-Madison, the WVDL has a branch laboratory in Barron. The WVDL has an annual operating budget of $9 million and a staff of 75. n

WVMA Sponsors State FFA Veterinary Science Proficiency Award On June 16, Wisconsin Veterinary Medical Association (WVMA) President, Dr. Jane Clark, presented Hannah Glennon of Amherst, with the State FFA Veterinary Science Proficiency Award at the 86th Annual State FFA Convention in Madison. This award recognizes the student who best demonstrates an understanding of veterinary practices and animal health care in Wisconsin. Glennon began her proficiency by working at Amherst Veterinary Hospital in Amherst during her sophomore year of high school. Cleaning around the clinic was her original responsibility and soon she was able to assist with appointments. Currently, Glennon is enrolled at the University of Wisconsin – Stevens Point and will be starting the pre-veterinary program in the fall. She hopes to attend the University of Wisconsin School of Veterinary Medicine and own a practice one day. The top state finalists in the veterinary science proficiency area received monetary awards made possible by sponsorship from the WVMA. Glennon has yet to find out if she will be selected as one of four national finalists. If selected, she will compete at the National FFA Convention in Louisville, Ky. in October. The four national finalists each receive a plaque and scholarship thanks to sponsorship by the American Veterinary Medical Association. n
