THE BREAKS

“The Breaks”, as it’s referred to by locals, is steeped in history. Traversed by Lewis and Clark in the early 1800’s as they explored the Missouri River, the area eventually became an important inland port for trading during the Western expansion. One of the most infamous residents was Wild Bunch member Kid Curry, an outlaw and bank robber who was known to use this area as his hideout.

Scenic and wild, The Breaks was designated as a national monument in 2001, along 149 miles of the Upper Missouri River. The Upper Missouri River Breaks National Monument includes over 375,000 acres of geologic formations, wildlife areas, wilderness areas and points of historic significance. Ripe with wildlife including elk, mule deer and a thriving bighorn sheep population, the area is popular with hunters and wildlife enthusiasts alike. Nearby Charles M. Russell National Wildlife Refuge is famous for its elk harvest and for its namesake – painter and cowboy Charles M. Russell.

ZORTMAN

The discovery of a rich vein of gold in 1884 brought miners to the Little Rocky Mountains, establishing the town of Zortman. A prosperous mining town for many years, a fire in 1936 destroyed most of the area’s mining operations but visitors can still find historic log cabins and miners’ shacks around town and try their hand at panning for gold. Today this small community, of just 60 year-round residents, is better known for its access to the Little Rocky Mountains for endless camping, hiking, fishing, and hunting opportunities.

KID CURRY & THE WILD BUNCH

The Central Montana area known as “The Breaks” has a rich history of inhabitants including explorers, outlaws and artists. One of the most notorious residents of The Breaks was Harvey Alexander Logan, known better as Kid Curry, a member of the Wild Bunch along with Butch Cassidy and Sundance Kid.

Referred to as “the fastest gun in the West”, Kid Curry’s career as an outlaw started in Montana where he shot and killed a neighbor who had accused him of romancing his daughter. Rather than stand trial, Curry fled Montana and began living life as an outlaw. Curry would return to Montana several times with the Wild Bunch, once robbing a train in Red Lodge using dynamite to blow up the train’s safe and then heading to his hideout in The Breaks.

The Kid Curry Hideout once served as Kid Curry’s horse hideout. Historians say the gang used the property to escape an angry posse after robbing a train in Wagner, Montana. The days of the Wild West long past, The Breaks is still a place full of adventure for visitors and residents alike.

The legend of Kid Curry Hideout says that Kid Curry and the Wildbunch used this ground as a hideout, corraling the gang’s horses in the slot canyon that is formed by the sandstone rimrocks. The narrow opening between the towering canyon walls made the perfect hiding place for the gang and their stolen goods, keeping them out of site from the ridges above. The natural funnel created by the rock formations also traps cool air in the canyon, protecting the Wildbunch from the heat of the day and the heat of the law.

CONDITIONS OF SALE

• All purchase offers must be in writing and specify an earnest money amount equal to no less than 5.00% of the Buyer’s offering price. Earnest monies shall be deposited in escrow within 5 business days of acceptance of the offer by both parties.

• All Buyers must provide the contact information of the Buyer’s banker or financial institution that can assist the Sellers and their agents in validating the Buyer’s financial ability to execute the transaction. All Purchasers must demonstrate to the Seller’s satisfaction unquestioned financial capability to purchase the property.

• The Sellers will provide and pay for a standard owner’s title insurance policy. Any endorsements requested by the Buyer or any lender will be at the Buyer’s expense. Title to the real property will be conveyed by warranty deed.

• All of the Ranch’s water rights will be transferred to the Buyer and all of the mineral rights which the Seller actually owns will be conveyed to the Buyer at Closing.

The Seller reserves the right to effect a tax-deferred exchange for other real property in accordance with provisions in Section 1031 of the Internal Revenue Code. RELATIONSHIPS IN REAL ESTATE

Montana law requires real estate licensees who are acting as agents of sellers or buyers of real property to advise the potential sellers or buyers with whom they work of the nature of their agency relationship.

SELLERS AGENTS

A seller’s agent, under a listing agreement with the seller, acts solely on behalf of the seller. A seller can authorize a seller’s agent to work with subagents, buyer’s agents and/or transaction coordinators. A subagent of the seller is one who has agreed to work with the listing agent, and who, like the listing agent, acts solely on behalf of the seller. Seller’s agents and their subagents will disclose to the seller known information about the buyer which may be used to the benefit of the seller. Individual services may be waived by the seller through execution of a limited service agreement.

BUYERS AGENTS

A buyer’s agent, under a buyer’s agency agreement with the buyer, acts solely on behalf of the buyer. A subagent of the buyer is one who has agreed to work with the buyer’s agent with who, like the buyer’s agent, acts solely on behalf of the buyer. Buyer’s agents and their subagents will disclose to the buyer known information about the seller which may be used to benefit the buyer. DUAL AGENTS

A real estate licensee can be the agent of both the seller and the buyer in a transaction, but only with the knowledge and informed consent, in writing, of both the seller and the buyer. In such a dual agency situation, the licensee will not be able to disclose all known information to either the seller or the buyer. As a dual agent, the licensee will not be able to provide the full range of fiduciary duties to the seller or buyer. The obligations of a dual agent are subject to any specific provisions set forth in any agreement between the dual agent, the seller and the buyer.
