Richcraft Homes broke ground for the Charlotte Condominium in the Sandy Hill area of Ottawa during a family and friends launch event on Oct. 18. Those in attendance enjoyed champagne, canapés, pizza and other refreshments, and listened to speeches by Mathieu Fleury,

city councillor for Lowertown, Sandy Hill and Vanier; Mayor Jim Watson; and Steve Grandmont, COO for Richcraft Homes. The Charlotte Condominiums will be built at 560 Rideau Street and the sales centre is located at 594 Rideau Street. A public launch was held Nov. 2.

Glenview Homes launches Flagstaff Potential new-home owners camped out for two nights to have the privilege of waking up on the morning of Oct. 26 to be one of the first to buy in Glenview Homes’ new community of Flagstaff. People lined up patiently to view the model home and decide which lot to choose.

THE RIGHT FIT CONDO RULES AND YOUR LIFESTYLE

If you’re like most of my condobuying clients, your home search is centred around location, suite layout and building amenities. These are the physical aspects of your home, and they’re incredibly important. But there are also intangible aspects, such as rules and regulations, which may affect the way you actually live in your condo. The vast majority of these rules are reasonable; however, they do vary from condo to condo. They can be found in the Condo Declaration, and it’s well worth your while to read them as part of your home-hunting research. (While rules can be added or eliminated by the condo board, owners are given a vote on important issues, and can demand meetings to review other changes.) Depending on your lifestyle, you may be passionate or indifferent about any of the following issues, each of which is often regulated by condo rules: Ŕ Smoking. Smoke-free condominiums are a relatively new development, but they have indeed made their Ottawa debut. These condos ban smoking even in the privacy of your own suite, so that the highest air quality is maintained. Ŕ Rentals. Some Ottawa condominiums have restrictions on short-term rentals (that is, leases of less than a year or even 12

Airbnb-type rentals). One condo complex recently made the news for disallowing renters who don’t constitute a family. While sometimes controversial, such rules are meant to ensure that all residents have a vested interest in maintaining a well-kept building with a pleasant atmosphere. Ĺ” Pets. Some condos ban all types of pets, while others embrace them. Some place restrictions only on certain types of animals. Ĺ” Barbecues. While Ottawa has no bylaws pertaining to natural gas-line barbecues on balconies, some condos do restrict them due to safety concerns. Ĺ” Parking. Condos may restrict parking for commercial and/or oversized vehicles. Ĺ” 1MVH JOT GPS FMFDUSJD DBST This issue caught my eye when an Ottawa condo made headlines for deciding that a resident with an electric car should pay for his own electricity and for the installation of a meter. At the other end of the spectrum, some “greenâ€? condos

provide plug-in stations for this very purpose. While rules and regulations may not be the stuff your condo dreams are made of, I’m happy to report that there are condo rules to suit every demographic. When you purchase a property, there are many ways to take title. The way in which you take title will often depend on your circumstances. Is the property an investment with partners or a family home? Are you going to live in the property or rent it out? How do you want the property to transfer when you sell the property or if an owner dies? This article will explore the following three ways to take title to a property and the effect on your ownership: Joint tenancy, tenants in common, and sole ownership. 16

Joint tenancy is the most common form of ownership for spouses or family members, as it allows for the property to pass to a surviving owner(s) by right of survivorship.

JOINT TENANCY

When two or more people purchase a property as joint tenants, it entitles them to an equal share in the property. In a joint tenancy, each owner on title owns 100 per cent of the property. Joint tenancy is the most common form of ownership for spouses or family members, as it allows for the property to pass to a surviving owner(s) by right of survivorship. This means that the property doesn’t need to be in a will and does not form part of a

deceased’s estate. It avoids probate, saving both time and money. The deceased owner’s name is removed from title to the property and the remaining owners increase their ownership interest proportionately. The process for removing the deceased person’s name requires the provision of proof of death (e.g. an original death certificate) and the registration of a Survivorship Application by the remaining owners. …cont’d on p. 20

TENANCY IN COMMON

Unlike a joint tenancy, when two or more people hold title to a property as tenants in common, each owner owns their proportionate share only. Therefore, if one of the owners dies, the deceased owner’s share is dealt with through the deceased’s estate. For example, if Larry, Moe and Curly own a property, each with a 1/3 share, and Larry dies, Larry’s interest is dealt with in accordance with his will. Neither Moe nor Curly would receive Larry’s ownership interest in the property. Tenants in common have no right of survivorship. SOLE REGISTERED OWNER

estate. If the owner dies without a will, or intestate, then the property would be passed according to the laws of intestacy in the prevailing jurisdiction. CORPORATIONS

If land is held in a corporation, the death of a shareholder has no direct impact on the ownership of the land. The shareholder’s estate would deal with the shares in accordance with estate and tax law where the shareholder resided. LIMITED PARTNERSHIP

Ownership of land in limited partnership is held by the general partner as trustee, so the same rules apply as above for a corporation. The death of a holder of a limited partnership unit has no direct impact on the ownership of

the land. The unit holder’s estate would deal with the shares in accordance with estate and tax law where the unit holder resided. No matter what your goals are for your new property, you should discuss your ownership options and any plans you have for the property with your real estate lawyer. Design Awards THE OTTAWA HOUSING INDUSTRY CELEBRATES ITS STARS

The room was abuzz with excitement at the Shaw Centre on the evening of Saturday, Oct. 19 for the Greater Ottawa Home Builders’ Association (GOHBA) Housing Design Awards. Approximately 550 industry insiders, sponsors and friends dressed in their finest to celebrate the best in the industry. In its 36th year, the annual awards competition recognizes excellence in design and quality of construction in the new-home and renovation industries. Judges consist of Home Builder Association members from across Canada and may include builders, renovators, architects, planners, educators, interior designers and anyone else considered by the Housing Design Awards Committee. Up to five finalists were selected in each of 51 categories. Linda Oliveri Blanchard from Enercare, presenting sponsor and chair of the Housing Design Awards Committee, gave an opening speech, leading into comedian and MC for the night, James Cunningham, who kept the audience smiling in between the presentation of the awards. Described as a “smooth, wellorganized event” by one participant, once the winners were announced, there was plenty of time to mingle and dance at the post-gala reception.
