Mortgages While Navigating A Divorce

If it’s your first time meeting with a mortgage broker, you want to come prepared to ensure you get the most out of that time Here are some great questions to ask during your first meeting with a mortgage broker

1. How Much Can I Afford?

Usually, people pick their homes before they organize their mortgage financing, but it should be the other way around. First you need to determine what monthly payment you would be comfortable with and what money you have available for a down payment, then you can dive into house hunting. Your total debt load, including your home costs and other debts such as credit cards and car loans, shouldn’t exceed a certain percentage The best way to determine what you can afford is to talk to a mortgage broker and complete a mortgage application You can also try my mortgage affordability calculator!

2. What Type of Mortgage should I consider?

Are you someone who likes a predictable payment or are you comfortable taking some risk to get a lower rate? A fixed interest rate is set when you sign for the mortgage; it won’t change for the entire term you have chosen, for example a 5 year term. A variable rate, however, will change according to market interest rates, which may cause concern for some.

3. How much do I need for down payment?

Many homebuyers assume they need to make a sizable down payment to get the best mortgage rate, but that’s not actually the case Mortgage insurance products allow buyers to put as little as 5% down and still get the same competitive mortgage rates, if not better, than those who put down 20% or more Having mortgage default insurance lowers the lender’s risk and cost and can mean a lower interest rate for the borrower To see how much you quality for, use my mortgage qualification calculator!

4 What should I take into account for the future?

According to research conducted by Sagen, one of the three default mortgage insurers, roughly 70% of Canadians would be concerned about paying their mortgage if interest rates were to rise, or if they or their partner lost their job. Everyone is excited about buying a beautiful home, but not everyone is thinking about what that means in the long term. What you can afford today might not be the most practical choice in years to come. Will you still be able to make payments when you factor in the costs of parental leave and daycare? What if your job situation changes or interest rates rise?

There will be several people who will help with the growth and development of your child. These can include teachers, doctors and counsellors. It will be importantforeachparenttobeinvolvedandtoreceive information and recommendations from these professionals. Attending meetings and appointments, receivingemailsorhavingaccesstotheschoolportal willalloweachparenttoreceivethesameinformation andwillreducethechanceofconflictbetweenthem.

4.Maintainaqualityrelationship.

Allow your child to love each parent equally. Avoid speakingnegativelyabouttheotherparentortheother parent’sfamily.Thequalityofaparent’srelationshipis not about the amount of time the child spends with them.Takeaninterestinthingsthatareimportantto them such as their activities, school and hobbies. Creatingspecialtimewithyourchildcanbeendonein person or from a distance. 5.Learntocommunicateasco-parents.

Wearenotbornwithgoodcommunicationskills;thisis somethingwelearn.Ifyouandtheotherparentstruggled with communication before your separation, it could become even more difficult when you are living in separate homes. Good communication will be the foundation for your co-parenting relationship. You will needtomakedecisions,arrangeappointmentsandfigure outholidayschedulesforyourchild.Whetheritisbytext, phoneoraco-parentingapp,thebetteryoucommunicate; thesmootherthingswillgo.Co-parentingclassesorcoparenting counselling are a couple of options that can helpyoutoimproveyourcommunicationandtobuilda healthierco-parentingrelationship.

6.Resolveparentalconflictoutsideofcourt.

Conflict between parents is toxic for a child’s brain development. This can put them at a higher risk of developing emotional, social and behavioral issues and mayhaveanegativeimpactontheirphysicalhealthtoo Usinganadversarialprocesssuchascourtcanincrease tensionandconflict.Choosinganoutofcourtprocess such as Mediation, can reduce fighting and encourage collaborationbetweenco-parents.Thisprocesscanhelp you resolve issues in a more civil and calm manner keepingyourchildoutofthemiddlesotheycanfocuson friends,schoolandactivities.

Parents living in separate homes can have quality relationships with their child. Communicate with your child openly and be present when interacting with them. Have a reliable parenting schedule and consistent routines between homes to help them adapt to the separation. Work on having good communication and reduced conflict between you and the other parent. Keeping these tips in mind will help promote healthy development and build resilience in your child

Our weekly Women Only, SMART Recovery Zoom meetings, are a beacon of light for many women, including myself. I’m Ann Davidson, a family mediator and divorce coach (soon to be CDC certified!)

I am a proud member of the Fresh Start team! We, Don Schapira, Lisa Huberdeau, and I have a deep dedication to serving our clients

Separation and divorce were foreign to me until I found myself in the middle of my own family transition Through personal experience and outside experience as administration support in a law firm, I yearned to support family transition in a less adversarial way; in a way that repurposes the relationships without destroying the family unit

My role with Fresh Start is to be the constant. I am the mediator who is present alongside clients throughout our process, beginning with the initial consultation and then individual goal-setting sessions to uncover what is important as clients move forward and restructure their family unit, ensuring that they are able to determine their needs.

Don Schapira is the lead financial mediator and joins the process for the division of assets and liabilities. Lisa Huberdeau is the lead parenting mediator and together we support parents as they create their Child Nurtured Parenting Plan. These stages provide our clients with their Fresh Start Negotiated Resolution

Once complete, we partner with lawyers who convert the Fresh Start Negotiated Resolution into a Separation Agreement based upon our clients work with us and provide independent legal advice to each party

Clients then send their signed Separation Agreement back to me for the drafting and filing of Court documents to obtain Divorce Judgment

Each step is completed at the pace our clients set for themselves

4 Lessons Carrots Have Taught Me

Those long orange (very versatile) veggies you know & love can teach you a few things about living a better life! And it actually has nothing to do with the nutrients they’re chock full of. Here’s what I’ve noticed..

Growing carrots is fun. Even if you don’t have a large garden, I’d recommend trying it sometime, even in a small space. The tiny brown seeds are sown thinly just slightly below the soil surface.

Their 1st lesson is Patience. You’ll be waiting & watching for about 3 weeks (or more) before the first appearance of finely frilled green stems push their way above the ground

The 2nd lesson is Prioritizing. You are going to get a LOT of carrots exuberantly sprouting along their rows It’s so exciting to see this fresh new life appear from the tiny dry brown lifeless-looking flakes of seeds you placed in the dirt a month ago The harsh fact is, most of these will need to be yanked out of the ground For about 80% of these little green guys (just a wild estimation here haha) their job is complete once they’ve assisted their neighbors in breaking the surface in search of the sun

The only way you will grow these fledgling veggies into full-size carrots is to give them more room. The only way to do that is to thin them out. (Just a warning - this never gets easier – at least I always feel kinda bad about having to make the decision of who stays & who must go..).

How does this apply to your life? In order to optimize your time & energy, your life will undoubtedly require some thinning of the busyness and distractions that drain your resources If you focus more energy and attention on fewer things, they have a chance to grow bigger & stronger and juicier What else is there to learn from a carrot? Read on!

How many times have you heard or seen the reference to the proverbial carrot as a visual for attaining your goals? Picture it - a donkey pulling a cart with the driver dangling a carrot before his nose from a long stick

Apparently, the donkey keeps walking forward trying to reach the carrot, while also pulling the cart. Once they reach the destination, the donkey earns his reward & can finally eat that carrot AND the driver gets to where he wanted to go!

So, the 3rd lesson here is Perseverance. Keep your eyes on your carrots! Define & refine your goals so they are clear and very tempting Envision them ripe with all the details you can possibly imagine When you can see, taste, smell and FEEL the reward - so sweet, so juicy, so satisfying – then Patience and Prioritizing becomes easier

It's best if these first 3 lessons, Patience, Prioritizing & Perseverance are practiced continually Patience is needed to keep your hopes up and your optimism high Prioritizing is very important, as you will need to reassess and do more thinning multiple times during the growing season (this also applies to your carrot crop). Perseverance will get you to the final end goal with a positive attitude. But there’s still more!

Lesson #4 is Packaging. Don’t get hung up on only accepting your dreams if they appear in a certain package at a certain time You shouldn’t try to program every single detail in such a rigid way that the universe is restricted by what will satisfy you The universe has bigger & better things in store for you! Imagine, visualize and vocalize all the details of your goals, using all your senses – the plan here is to really FEEL the goal That’s what the universe will fulfill, the feeling – and what materializes will be better than what you’ve dreamed up So, allow for variations on the packaging and the timing (And just like the donkey & his driver, the best goals are designed to bless others too )

When you harvest those carrots, there will surely be some wonky misshapen ones, some big, some small, but they will all have the same sweet taste of success! Just like the abundance that is all around you, notice the unexpected beauty in the green stems on top. Add them to a bouquet of flowers as a gorgeous accent! Every time you eat your bright orange bountiful veggies, you will be rewarded for your patience, prioritizing, perseverance, and for appreciating the packaging they arrived in Be sure to celebrate your carrots (& their lessons) whether you grew your own, were gifted some or bought them!! Who knew how smart they were?! You would be wise to apply the same 4 lessons they’ve taught me - Patience, Prioritizing, Perseverance & Packaging to create much abundance in your life

Growing carrots (and gardening in general) is a great way to spend time with your family & friends – get everyone involved Marvel at the magic of seeing seeds sprout and grow into food It’s always a thrill to discover fresh tomatoes, cucumbers & beans hiding amongst the plant leaves, and who can resist fresh peas? Zipping those plump pods to reveal the sweet crunchy orbs is so satisfying! I fondly remember shelling peas with my Oma as a little girl. The original “ snap chat” lol.

RE-IMAGINING FAMILY JUSTICE

When a couple has reached a point in their relationship that they have decided to separate or divorce, they are dealing with many questions and challenges They will start to tell friends and family, and begin the process of separating their lives and sorting out new relationships They will need to decide where each of them will live. They will work out their parenting arrangements including which parent the children will live with, arrangements for the other parent to spend time with them, who will make decisions about day-to-day matters and about the big decisions in their children’s lives. They will need to work out financial arrangements including how they will pay for two households, divide their property, and ensure that they are able to meet their financial needs

These are hard decisions, made more difficult by the emotions that surround the ending of their marital relationship There may be feelings of anger, fear and even despair These are normal for a couple to experience, and hopefully find social supports to assist them to work through

Some of the ways that those supports can assist, will be to help navigate the changes that are taking place in the lives of this family And to teach and coach new skills Perhaps basic skills about finances and meal planning About communication And co-parenting children. These are new ways of telling the story of your lives, which focus on all the positive hopes and dreams you have for you and your children.

There are a variety of community and natural supports that can help couples to build new pathways forward for themselves and for their children.

We want to share the importance of finding these supports and building these skills, so that you will not just survive the changes that come with separation and divorce, but that you and your family will thrive

That is the focus of our work to re-imagine the family justice system.

You might have noticed that we haven’t mentioned anything yet about the law or legal processes, which are important, but not the first priority for family wellbeing. What we know from the experience of separation and divorce over the past 55 years in Canada (since the Divorce Act first came into effect) is that focusing on legal, adversarial processes has not served families well Rather than ensuring that all of the needs of families are being met through supports and skills, it tends to channel people’s attention in to fighting about these issues and provides them with tools for fighting

There are many important justice system reports that have called for change Until recently, the changes have been focused on improving and amending court processes and legal supports The assumption has been that separation and divorce would involve court determination about disputes, and that day-to-day decisions in our lives are “disputes” Really these are “decisions” that most parents can make about where they will live, the things they can do to live fully, and how they will love their children and support them to grow up well. And if there are still unresolved questions, families can mediate rather than litigate.

While sometimes necessary, family litigation creates a story line that too often ends in serious financial and emotional costs from fighting things out in Court; in families that have not sought out the kind of supports and skills that focus on their family’s well-being; and in children who have suffered through the toxic stress of a family that is essentially a battle zone

There is scientific evidence about the harm that this kind of fighting causes for children and their parents (see the resources at Alberta Family Wellness Initiative - including “How Brains Are Built: The Core Story of Brain Development”) This knowledge has helped us to create a very different story about separation and divorce In this new story, the supports that families need for all of their social, relationship, parenting, financial and health needs are given priority Where parents and children can build skills that will help them through this challenging time, and legal professionals play a role of helping families to achieve a good agreement. In this new story, the goal is to ensure that families will succeed and thrive as they move forward.

You can tell your own family story in this way, by choosing to limit your fighting about the important changes that are happening in your lives, while seeking the supports you need to make the best decisions for your children and their well-being The professionals in this magazine, in your local Family & Community Supports office and Family Resource Network, in your own faith-based and professional community can help you to navigate challenges and build new skills to help you and your children thrive in the new family structure that you are creating

Making the Most of Mediation

Families engaging family law courts in Alberta are required to participate in at least one Alternative Dispute Resolution (ADR) process before going to court Mediation is a recognized form of ADR Courts across Canada have made similar rules because mediation is recognized as an effective form of resolution for families It provides a great opportunity to save time, money, and resolve issues

Mediation is not a one-size-fits-all model. Styles can vary from mediator to mediator, so it is important to ask questions

What experience does the mediator have? I gained my knowledge and experience mediating family law disputes through my work as a family lawyer over the past ten years I also have training in trauma informed practice, biological impacts of separation and stress, and communication methods for high conflict individuals

Will the mediator share recommendations to assist the parties in generating options for settlement? My mediation style is to prioritize the participants generating their own options whenever possible, but sometimes parties can get stuck.

Willthemediatormeetwiththeparticipantsaheadoftimeto explain the mediation process? The length of preparatory time with the mediator can vary widely. Are the fees for mediation calculated on a flat-fee or an hourly basis? I offer mediation services on a flat-fee basis because I believe it allows parties to effectively budget for mediation. My flat-fee mediation services include a preparatory meeting, the mediation session, and a written reportingfollowingthemeeting Mediationmayalsobebilled based on the actual time spent by the mediator Knowing how parties will be billed is very important to adequately budget for the mediation process and avoid surprises when invoicesforservicesarereceived

Alberta has the highest rate of police-reported intimate partner violence in the nation, according to Statistics Canada, with 535 incidents per 100,000 population in urban areas This is a stark reminder that many survivors of abuse need greater hands-on help to escape gender-based violence situations Shelter Movers has recently arrived in Calgary and Edmonton to help meet this need

Since its establishment in 2016, ShelterMovers has opened 9 Canadian chapters and has completed over 6500 moves. The two Alberta chapters, which opened in September of 2023,havecompletedover20movesinjustfourmonths

When asked about the impact of Shelter Movers’ arrival in Alberta, the Honourable Marci Ien, Minister for Women and Gender Equality and Youth said, “Shelter Movers’ expansion to Edmonton and Calgary is such an essential service because we know that one of the most dangerous times in the life of someone experiencing domestic violence is when they are trying to leave home I’m truly inspired by how their incredible team, who are mostly volunteers, work day in and day out to make sure that survivors of gender-based violence can move safely and quickly I’d like to ask Canadians to consider volunteering for Shelter Movers to strengthenyourowncommunitiesandimprovethequality

Shelter Movers provides free moving and storage services for referred clients, something no other Canadian charity offers The step-by-step process is done with dignity, high levels of security, and in strict confidence Planning and financing a move can be a daunting task during the best of times, but Shelter Movers believes fleeing an abuser should be safe and easy

Fleeing domestic violence takes courage and resources. Shelter Movers works with local women’s shelters, security services, vehicle rental companies, and storage companies to relocate survivors and their belongings. In the absence ofShelterMovers,survivorsrisklosingeverythingtheyown, or worse, staying in an abusive situation due to lack of support. To continue to provide this service to survivors at no cost, Shelter Movers is looking for more Albertans who have time to assist with moves, as well as businesses to partnerwith.

You never enter a relationship with someone thinking that one day this is where you would end up Being mentally and emotionally beaten down, controlled financially to the point where when you realize how toxic the relationship is, you cannot leave because you do not have the financial means to do so

My name is Maj Osman, I am the President and Founder of Women on Wings Society We are a non profit organization that has been in operations since 2019 I started this non profit in memory of my mother Salwa Osman

As someone who left a 16-year marriage, I did not even know or realize how abusive the relationship was until I finally found the courage and strength to leave, not just for the sake of my mental and physical health but for my four children who were also suffering from this abuse. I could no longer watch them, watch me be beaten down on all levels.

I did not know at the time what resources were out there for women experiencing domestic violence.

Women on Wings Society was created to help women connect them with the right resources to help get them out of these situations, and to break these cycles and generational traumas.

Leaving is just the first step, healing the trauma is the next

We have collaborated with a trauma release therapist as well as a divorce coach who assists our clients on how to deal with a narcissistic ex We provide financial assistance, food hampers, and other supports pending the circumstances that they are in

All funds that we raise goes back to the community, as our board is a volunteer board of 6 powerful women who have a passion for this cause

We hold 2 fundraisers a year to help us raise funds to provide these services to our clients and assist them through what they are going through
